*)): Â&#x192; *)$) + In late December and early January 2010, a meeting was held with the Acting Director-General, Department of Justice and Attorney General (DJAG), Executive Director JPs in the Community, and the Registrar of the JP Branch. As a result of these meetings, a Memorandum of Understanding has been signed by the QJA and DJAG so that both parties can work together in providing training and assistance to The Queensland JPs and C.Decs. The JP Branch have agreed to provide four examinations in Queensland Magistrates Courts each year for our Course Students to access the DJAG examination.

The Hervey Bay Branch hosted the 2010 State Conference in October with over 100 JPs and C.Decs attending. The key note speaker at the conference, Mr Lawrence Springborg MP, Deputy Leader of the LNP indicated a strong support for JPs and C.Decs in Queensland. The State Conference for 2011 will be hosted by the Noosa Branch and the date will be announced in forthcoming editions of the Journal.

I attended this yearâ&#x20AC;&#x2122;s Australasian Council of Justices Association (ACJA) in Ballarat with immediate past president Mr Bob Pilkington.

Delegates from all States, Territories and New Zealand attended.

Outcome from this yearâ&#x20AC;&#x2122;s conference was the development of a letter recommending standardisation of JP duties across Australia. This letter has been forwarded to Mr Cameron Dick MP, Attorney General and Minister for Industrial Relations and to Mr Lawrence Springborg MP, Shadow Attorney General and Deputy Leader of the LNP for consideration.

Nathalie was born in Aramac, Central Queensland and raised in a rural background.

Until her retirement Nathalie worked and lived for over three decades with Aboriginal and Torres Strait Islander people. Nathalie worked closely with the Department of Justice and when she moved to Rockhampton she quite regularly visited JPs in remote areas.

Nathalie was well known in Government circles in Brisbane and in her role as JP(Mag Crt) was well received by the traditional owners of our land.

Her judgements were always fair and she was respected by the elders.

A tireless worker for the QJA and the Aboriginal and Torres Strait Islander community, Nathalie will be remembered by all who were associated with her.

â&#x20AC;&#x153;Today I would like to speak to you about the future of Justices of the Peace in Queensland, and as we gather here in Hervey Bay for the 2010 Queensland Justices Association (QJA) Annual Conference looking [ & z \ Â&#x2C6;

The role of the Justice of the Peace has evolved over time from the `

Despite this changing face of the JP, they still hold a vital role in administration of Justice. Many are still called upon to act as the checks and balance to police matters with the signing of warrants in remote areas. z $8))Â&#x2026; [ ?$ /

It can be said that Justices of the Peace still retain (and occasionally use) the power conferred or re-conferred on them in 1361 to bind over unruly persons â&#x20AC;&#x153;to be of good behaviourâ&#x20AC;?.

In Queensland each year, JPs handle around 3500 matters a day, alleviating the need for more formal legal intervention. z $::8

Part of that review has led to the creation of the Support Person under the Police Powers- if no one on the list is available, a JP may be called upon to act in the role as Support Person.

At present in Queensland we are faced with more and more legislation from a Government obsessed with rules and regulations. At the same time we are faced with more and more layers of legal administration.

2010 STATE CONFERENCE year in a row. The 2010 Report on Government Services paints a disturbing picture of this Governments mismanagement of our court system.

*))8 ): [ ?*&?)) criminal cases and more than 35,000 civil matters caught up in the Queensland justice systemâ&#x20AC;&#x2122;s bottleneck. There is a very serious problem in the court system and it is the result of poor planning and poor management. Queensland now has one of the worst court congestion problems in Australia and proposed â&#x20AC;&#x153;reformsâ&#x20AC;? looked set to put further pressure on the Magistrates Courts and District Courts.

So we look at the work of the Magistrates Court and the Higher Courts and ask ourselves what has happened, has the appointment of barristers and solicitors as Magistrates really been the right move or has it made the Magistrates Court more complicated, and overly legalistic?

QCAT- The future of the Justice of the Peace here in Queensland has to be guided by recent changes in other levels of change in the legal system.

In 2009 we saw the introduction of Laborâ&#x20AC;&#x2122;s super-tribunal system that was supposed to streamline and coordinate all minor civil matters, yet we saw a blowout in many hearing times and once again an increase in rules, laws and procedures.

Despite being a system that is supposed to be inexpensive to people & money. % z \ / @ [ Â&#x20AC; Scotland volunteer their time to handle some 1/3rd of all minor criminal

+ As you may be aware, in Scotland the Justice of the Peace works unpaid in the Justice of the Peace Court and they handle almost 1/3rd of all criminal matters, including shoplifting, anti-social behaviour offences, and minor + In Scotland this is seen as a community court where people are judged by their peers.

As we look forward to the role of Justices of the Peace in Queensland I [ Â&#x2C6; % 7 Justice of the Peace courts Justice of the Peace courts are an integral part of Scotlandâ&#x20AC;&#x2122;s criminal justice system, hearing almost a third of the criminal cases which come before courts in Scotland. ' / Â&#x2019; Justices of the Peace can impose custodial sentences of up to two months, Â&#x201C;*&#))+ % ] ` ` [ the availability of community sentences, and has indicated that it intends to make effective non-custodial sentences available to all Justice of the Peace courts. ' / Â&#x2019; Cases which typically come up before the Justice of the Peace courts include motoring offences, breach of the peace, assault, theft and shoplifting. These offences often cause distress or aggravation to local communities. It is crucial that they are dealt with promptly and fairly.

The summary justice system comprises all court cases which do not ` ` Z \ :#Â?

Scotlandâ&#x20AC;&#x2122;s courts.

Justices of the Peace and Sheriffs both deal with summary cases although the Sheriff has greater sentencing powers and deals with the cases which are not heard in the Justice of the Peace courts.

Justice of the Peace courts are affected by major changes, which are currently being implemented in Scotlandâ&#x20AC;&#x2122;s summary justice system.

A major aim of the changes is to ensure that Justices of the Peace have the skills and training to enable them to hear some of the cases which were previously heard in the Sheriff Courts.

This would allow all cases to be heard more quickly than is currently the case. As a result, major changes have been introduced to the training and recruitment of Justices of the Peace. A system of appraisal for Justices of the Peace has also been introduced. % $::8 /
