Planning is progressing well with a variety of speakers who will be of interest to JPs from a rural background as well as our urban cousins.

By John Geary On Saturday 10th August 2013 at the Morayfield East State School the Queensland Justices Association held a refresher Workshop for Justices of the Peace and Commissioners for Declaration to continue their ongoing development to assist in providing quality ongoing service to the community. The all day workshop was a great success with over seventy in attendance.

Uncle Lloyd Hornsby (Gawura) gave us a traditional Welcome to Country.

The Workshop was opened by Mr Darren Grimwade MP for Morayfield.

The session was well received and very in depth as to the forms and processes within the Family Law Court.

The afternoon sessions covered: Enduring Power of Attorney documents by Lindsay Hall of Files Stibbe Lawyers of Bribie Island; Caboolture Court House and the processes of the court by the Registrar - Mr Peter Hasted; then a panel taking questions from the attendees closed the day’s events.

Planning has already commenced for next year’s workshop.

The President of the QJA addressed the workshop on the ongoing need for refreshing knowledge.

The morning session covered Family Law documents and this was delivered by Russ Boman who has a long volunteering association with the Family Law Court in Brisbane.

President’s Report Dear Colleagues It is the beginning of a new financial year and I would like to take this opportunity to advise members that the Association is in excellent shape financially and membership-wise. We have experienced a 75% growth in turnover in the last 12 months.

Director Mr David Read and I will be attending the ACJA Conference in Darwin in October 2013. I was appointed Vice President of the ACJA at the Nelson Bay ACJA Conference in 2011 and will be appointed President of the ACJA in Darwin in 2013.

The Director responsible for IT and administration, Mr Keith Revell has organised many changes in the office with the installation of a new server, changes to the website and matters relating to the Constitution and related policy matters.

The training program of new JPs and C.Decs has been very successful across the State. The quality of training has improved with the introduction of our PowerPoint presentation being used with the QJA Activity Books. Mrs Linda Evans is kept busy keeping track of all of the student Assessment Books and the assessors marking these.

The Association now has 29 Branches and 8 Contact Groups across the state from Cairns to the Gold Coast and west to Mt Isa. The Northern Region Director Mr Chris Porter has been very active establishing new branches where possible including the Whitsundays and Charters Towers. Other Directors have been busy in their regions giving support to branches.

Vice President Mr Bob Pilkington is our representative on the newly formed JP Advisory Council and advises the Board of Directors on matters which may affect our members. Vice President Mrs Marian Vierveyzer is the Board’s HR person and looks after the employment requirements for the Association. She also is currently working on the QJA’s Strategic Plan.

Vice President Mr Raymond Young OAM attended the Law Week Church Service at St Paul’s Cathedral together with the QJA Registrar Ms Angela Yin and myself. I was able to have a short discussion with our Patron the Honourable Paul De Jersey AC and the President of the Queensland Law Society on JP related matters.

Directors Mr John Carpendale, Mr Keith Revell and Registrar Ms Angela Yin meet on a monthly basis to discuss financial and budget issues to ensure that the Association is working within its means. Mr Carpendale is also currently working on the plans for the Australasian Council of Justices Association Conference which the QJA will be hosting in Brisbane in October 2014.

We have currently provided a correspondence course to enable people in remote areas the opportunity to become JPs or C.Decs.

The Association is currently working on a suitable online program and this will be available in the near future. I must thank Ms Sue Koenig for all of the work she is doing in the Office in ensuring that all student enrolments, class materials and other general office work is carried out in a satisfactory manner.

Lastly, I wish to thank our Registrar Ms Angela Yin for all of the hard work that she does to ensure that the Association runs smoothly.

This is my final President’s Report in the Journal, as I retire at the Annual General Meeting in November this year. Although I will miss the challenges and the opportunities the position brings, I am confident that my tenure has set the Association for a bright and optimistic future and a solid base with which the new President and incoming Board of Directors will continue to improve and build upon.

News in Brief Membership Renewal Payments

Annual General Meeting

Timely receipt of membership subscriptions is necessary to enable the company to effectively budget and plan out its activities for the financial year.

The Annual General Meeting of the QJA will be held at 10.00am on Saturday 9th November, 2013. All are welcome to attend and the Notice of Meeting appears later in this Journal. Afterwards, all attendees are invited to stay and partake in a light lunch.

There are a number of memberships that remain unpaid and ultimately this is a double hit on the business, firstly because we don’t have the overdue money and secondly because the State Office then has to use time and money to chase up the outstanding amounts.

If there are any members who have overlooked paying their subscriptions, it is requested that they do so now. If you fall into this category, you should have recently received a reminder notice, either by post or by email.

Please take the time to action this reminder by either sending in your payment, or contacting State Office to discuss.

Failure to pay your subscription means you will not be able to vote for the new QJA Board, nor attend and vote at the forthcoming AGM. You will no longer receive this Journal, nor have access to the growing content in the QJA Members Only website, or have the experienced QJA team available to help with your JP duties.

Those planning to attend are requested to register online using the new QJA Event Booking system on the QJA website or you can contact the State Office (07) 3392 2455 or 1800 061 423 or email admin@qja.com.au so that we can effectively cater for the day.

Any members who cannot attend have the right to appoint a proxy for all matters other than elections for the board. For Members eligible to vote a proxy form has been included in this issue of the Journal and is available on the website or from State Office upon request.

News in Brief Board Elections this Year Nominations for positions on the new Board of Directors have now closed. We have received nominations from a cross section of regions throughout the state.

All financial Members of the QJA, except Associate Members are entitled to vote. The resumes of all candidates appear elsewhere in this journal. Included with this Journal eligible Members will receive the rules of voting and a ballot paper, as well as a Ballot Only envelope, and a Reply Paid envelope in which to return your ballot paper.

All members are reminded that they must correctly fill out the ballot paper for the vote to be valid.

You are reminded to write your details on the Ballot Only envelope flap. These details include your name and address, and your QJA membership number (not your JP signing number), which you should be able to find on your membership card, membership certificate or immediately above your address on the front of the envelope that this journal arrived in.

I was appointed to QCAT panel in July 2013 and have completed several sessions now.

The learning curve is vertical as there is always a different situation in each case. The legally qualified member(s) I have been sitting with have been excellent and have assisted me in sticky situations.

We support each other with questioning, checking on legislation and making decisions along with reasons.

I have been very impressed with the way QCAT has given us the support we need to do the job.

I am going to give a short talk at the South Pine Branch meeting on the experience at QCAT for the members of that branch on 3rd Oct 2013.

Constitution Update

Attorney-General and Minster for Justice Jarrod Bleijie has welcomed the return of a proud position in Queensland’s legal and justice system.

The Board has agreed on, and recommends, the following minor updates to the Constitution which will be presented at the November 2013 AGM for consideration.

Rule 22 (f): modified to clarify how many Members living at the same address are eligible for the reduced Membership Fee. Rule 80 (f): By removing the “Schedule 1 – Model Rules” section from the Constitution document to a stand-alone “By-Laws” document this rule needs to be amended: Schedule 1: Removed from the Constitution document and created as a stand-alone By-Law document.

The By-Laws: This is a new document which now has the Branch Model Rules which have been modified as follows: Rule 7 (a): Specifying a minimum number of general Branch Meetings of Members per year.

QCAT Trial update Apologies to Bruce Little who was not recognised in the last Journal as being appointed as part of the QCAT trial. Bruce has been sworn in and already completed his first court appearance.

The title of Queen’s Counsel has now been reinstated and the appointments were confirmed by Executive Council on Thursday.

“This is well deserved recognition of Queensland’s senior legal fraternity who have overwhelmingly chosen to restore the title of QC,” Mr Bleijie said.

“70 of Queensland’s 73 Senior Counsels (SCs) opted to switch to the more recognised and esteemed title. From now on, eminent barristers will be appointed as QCs.” “The QC title is more widely recognised and understood as a mark of professional distinction at the Bar and this move will provide greater clarity amongst the general public. Queensland silks now have the edge internationally, particularly in Asia where the use of QCs is preferred.”

Welcome Aaron Dunster!

Aaron Dunster has been appointed our new Admin Trainee. As well as a dry sense of humour, Aaron brings many useful skills to his position, including website development and bookkeeping in MYOB. You will get to meet Aaron at the QJA’s 20th Annual State Conference in Bundaberg in October. This position is now full-time, to cope with the student enrolments and rapid membership growth.

Sue Koenig will still be around to mentor Aaron, as well as ensuring compliance with our Policies and Procedures and our server, which needs to be tidied up. It has been two years since our internal QJA Policies & Procedures manual was first published, and it will be well out of date in some areas already!

Seeking election as: Senior Vice President or Board Member Ray Burrows is the current President of the Queensland Justices Association and as per the Constitution will be standing down. He is seeking election as Senior Vice-President with Board Member as a second preference.

Ray was born in Southport on the Gold Coast and is married to his wife Beverley and has two married daughters and one grandson.

He has been a Justice of the Peace since 1979 and upgraded to JP (Qual) in 1991. He has been a QJA Member since his appointment in 1979.

Ray has been the Secretary of the QJA Redland City branch since 2005. He has served on the QJA Board since 2007 and was elected President in 2009. He was the QJA Journal editor from 2007 to 2009. His other services to QJA have been to co-ordinate the QJA refresher workshop in Cleveland in 2006, co-ordinate the State Conference in 2009. He regularly volunteers as a JP at Capalaba Central Shopping Centre and Cleveland Magistrates Court JP signing centres.

Ray holds postgraduate qualifications in educational administration and has a Bachelor of Education, as well as qualifications in electrical engineering and electrical fitting (automotive). He holds a Cert IV in Training and Assessment (TAE40101), which enables him to teach in Registered Training Organisations, such as QJA. During his working life, Ray spent 15 years in the automotive/transport industries and then 32 years in TAFE and was consistently promoted throughout his career to finally become a Faculty Associate Director. He was involved in Curriculum Development at State and National levels in areas such as automotive, engineering, transport and maritime. Just prior to retiring, Ray was the Registrar of Yeronga TAFE responsible for all training matters.

Ray’s extensive experience in the development and delivery of training make him an ideal candidate for the positions he is seeking. His key achievements as President so far include overseeing QJA’s RTO compliance, training of JPs, increasing the branch network and liaising with the Department of Justice.

Seeking election as: Board Member Appointed as a JP in 1978, I have been Secretary of the Brisbane North Branch of the QJA since 2010 and am heavily involved in branch activities. I have been a director of the QJA since November 2011.

My business background is in the financial services industry, including over 20 years at an executive level. Since completing full-time work in 2005, I have served on the boards of several financial services organisations (superannuation funds, credit unions and financial planning companies). I am currently a member of the board of QInvest (a financial planning company).

Academically, I hold a bachelor degree from the University of Queensland and post-graduate diplomas in Applied Finance & Investment and Financial Planning. I am also a diploma graduate of the Australian Institute of Company Directors (AICD) and an Accredited Investment Fiduciary.

My professional memberships include the Association of Superannuation Funds of Australia (fellow), the Financial Services Institute of Australasia (fellow), AICD and QJA. I am a strong supporter of continuous improvement and ongoing education. Recently, I have become a participant in the student assessment component of the QJA training program.

I seek the support of members for my re-election to the QJA Board for another term so that, with my fellow directors, I can build on the strong foundation we have put in place over the past two years.

Name: COURT, Ron

Location: Caboolture

Seeking election as: Board Member Ron became a JP (Qual) in 2004 and has regularly worked at the Caboolture Court House from the beginning of the “JPs in the Community Program”. He is currently enjoying his role as a Qualified Trainer and Assessor with QJA. Currently serving a second term as Chairperson for the QJA Caboolture Branch, commencing with small meetings in a coffee shop to now hosting workshops that are well turned out and open to all JPs and C.Decs alike.

The Caboolture Branch offers its meetings in different locations as to make them accessible due to its large area.

Ron is very keen in raising awareness within the community of the Professional role and Quality service JP (Qual) and C.Decs provide. Ron has a strong belief in ongoing Professional Development, and if elected to serve on the board would continue in achieving this goal.

Having worked within all three levels of Government Ron believes this will be an asset to the QJA and its members in moving forward to future targets.

Ron has lived in the Caboolture area since 1978; and has seen the growth within the Shire into what is now known as The Moreton Bay Region.

He spent 19 years with the Caboolture Shire Council retiring as an OHS/Training Advisor. Was Chairperson for the Corporate Safety Committee and currently registered as a Rehabilitation and Return to Work Co-ordinator with Cert IV in Workplace Training & Assessment (TAE40110).

Now running two very successful businesses one as a Civil Marriage Celebrant with a Diploma in Funerals, he is on the committee of the Caboolture/Morayfield & District RSL Sub Branch and is an active Legatee with the Redcliffe, Caboolture, Bribie Island Legacy Group.

Name: HULL, Doug

Location: Hervey Bay

Seeking election as: President, Senior Vice President or Board Member Doug wishes to maintain the “member focus” of the Association to achieve the maximum benefit to members.

From the time Doug Hull first looked at QJA membership, he recognised the need to have all the JPs working at the same high skills level which can only be achieved through continuous/ regular training. To this end, Doug was one of the first to successfully commence Branch training for new JPs and Professional Development at Branch level. This was one of the original stimuli for QJA Branch training.

Doug’s vision for the QJA is to encourage all JPs to continue to train and develop their skills through the provision of the necessary resources and to grow the organisation through encouraging new JPs to join us by demonstrating the benefits of membership. Doug also sees that a further membership group (Corporate Membership) can be added to the company to provide an added dimension to the Organisation. Corporate membership is defined as Membership taken out by a Business Organisation on behalf of its JP workers.

Doug’s desire is to foster cross Branch/ Contact Group social activities to promote interaction between JPs and their families. He recognises the support families give to JPs and wants to encourage the families to be recognised through inclusion in QJA activities.

Name: PASQUALE, Carmelo

Location: Mackay

Seeking election as: Board Member I am currently employed at Ergon Energy in Mackay as a Project Manager working in the development of Standard Work Practices. In my 30 years at Ergon I worked firstly in the field as a Linesperson/Electrical Mechanic and then worked in many management roles which included Area Operations Manager Mackay. My qualifications include Associate Diploma of Electrical Engineering and an Advanced Diploma in Business.

In 2009 I helped establish the QJA Mackay Branch. I am the current Chair for the branch and have served a total of 4 years in this role and 1 year as Deputy Chair.

I have in lived in Mackay for 15 years. In July 2000 I was elected to the St Joseph’s Parish Council where I served as the Vice Chairperson for 5 years. July 2000 I commenced my duty as a Justice of the Peace Qualified. This year I have been coordinating the JP’s in the Community signing centre at Caneland’s Shopping Centre.

I am always looking for a challenge and willing to assist others. If elected to the Board I will work hard and provide what assistance I can to the Justice of the Peace Qualified and Commissioner for Declarations in our State of Queensland.

Name: PILKINGTON, Robert

Location: Ipswich

Seeking election as: Senior Vice President or Board Member Bob Pilkington is one of the current Vice-Presidents and is seeking re-election as Senior Vice-President or Board Member.

Bob was born in Lismore in New South Wales and is married to Cecilee, has three married daughters and six grandchildren.

Bob has been a Justice of the Peace (Qualified) since 1994 and a member of QJA since that time also. He was elected Chairman of the Ipswich branch in 1995 and appointed Councillor (previous term for Director) in 2001. Bob was elected Vice-President in 2003 and then elected the 41st President of QJA in 2005, a position he held for the maximum two terms until 2009, before being re-elected to the Board once again as Vice-President that same year. His Presidency oversaw many strides forward, including the publication of The Guide to JP Practice in Queensland and QJA’s RTO status. He is also a qualified trainer and has trained many students to become JPs at QJA. Bob served for 20 years in RAAF throughout Queensland, New South Wales, Victoria, New Zealand and South-East Asia. He operated his own small business for four years and for five years managed an equal opportunity employment agency for the Uniting Church. For 14 years, he was a trade instructor/correctional supervisor at Borallon Correctional Centre.

He represented QJA as a delegate to the national peak body of Justices of the Peace, the Australasian Council of Justices Associations from 2006 to 2010.

Name: PORTER, Christopher

Location: Townsville

Seeking election as: Board Member I was born in Rhodesia and raised in Kenya , I went to England to train as a Chemical Engineer, met and married my wife in 1965. We have 4 children and 2 grandchildren. We have travelled and worked extensively in Africa in the seventies came to Australia in 1977 and settled in Mount Isa. Worked for Mount Isa Mines and formed our own Design Office working for the mines in the area. I won a small business award in 1989. We then moved to Charters Towers, then onto Townsville continuing our sucessful business. I retired 4 years ago but continue working for the mines on a casual basis.

I have been a JP since 1988 and enjoy working as the Northern Region Director travelling and meeting new members and am currently Vice Chairman of the Townsville Branch. Since becoming the Northern Region Director I have been involved in forming new branches in Bowen, Ingham, Cairns and Mareeba. I hope within the next two months to form new branches at Charters Towers, Airlie Beach and Innisfail. I hope to establish more still, as it is a large region. I currently sit as a volunteer JP in the Townsville Mag Court and at Stocklands Shopping Centre.

Location: Bundaberg

Seeking election as: Senior Vice President or Board Member I became a JP (Qual) back in 2001 and soon after started up the Bundaberg branch of the QJA. I was the coordinator for the 2007 State Conference held in Bundaberg, which was the biggest conference ever held. I have also been instrumental in starting the social barbecues that Hervey Bay, Bundaberg, Howard and Gladstone attend. I have a lot of rural JPs that call me for assistance at all times of the day and night and I am always happy to help.

At the 2007 AGM I was accepted onto the Board of Directors. Since joining the Board, I have assisted in working through the many challenges that the company has faced, some of which are still ongoing. I have assisted other branches of the QJA to achieve their goals in building their numbers and finances.

As a Director I have been willing to travel far and wide, often at my own expense, to support QJA branches and QJA events and enjoy this for the network system that has developed.

With the skills and knowledge that I bring to the board I hope that you will see to allowing me another term on the Board to continue the hard work that I and the other directors have undertaken to ensure that the QJA is a well-managed, financially stable and credible organisation.

Location: Logan

Seeking election as: President or Board Member Keith has been a Director of the QJA since 2009 and is seeking election as President or Board Member.

Keith has been a Justice of the Peace since 1987 upgrading to JP(Qual) in 1995, and has over the years contributed variously as a volunteer to the State Emergency Services, Scouts, Volunteer in Policing, Meals on Wheels, and is currently a Child Witness Support Volunteer with PACT (Protect All Children Today) which supports children and their families going through the court processes. Keith is also a Director, and the Treasurer on the Board of PACT. After 30 years in executive management roles within the corporate IT field Keith branched out in 2001 and with his wife Gwen, purchased a Newsagency at Park Ridge which soon expanded with the addition of a new business at Greenbank, until selling both in 2008 and opting for retirement which has enabled Keith and Gwen to focus on their contribution to not-for-profit organisations such as the QJA and PACT. Keith has been on the Branch Executive Committee of the QJA Logan City branch since its inception and has co-ordinated the annual QJA refresher workshops in Logan since 2009. He has been the editor of the QJA Journal since 2009, and has responsibility for the Information Technology systems used by the QJA. He regularly volunteers as a JP at various Logan signing centres, Police Stations, and at the Beenleigh Courthouse.

Keith’s corporate and small business experience provides him with a background and confidence of being able to communicate with officials in the corporate and government community. His experience as a Manager, Director and small business owner provide the strategic and governance views necessary to effectively contribute to the Board of the QJA, while ensuring QJA Members at the coalface have appropriate support, training, and information to enable them to perform their duties effectively and with confidence.

Name: VIERVEYZER, Marian

Location: Ipswich

Seeking election as: Senior Vice President or Board Member Marian Vierveyzer is one of the current Vice-Presidents is seeking re-election as Senior Vice-President or Board Member.

In November 1999, Marian completed her JP (Qual) preparation course at Yeronga TAFE and took her Oath of Service in 2000. She became a member of QJA in 2001.

Marian has been a member of the QJA Ipswich branch since 2003 and was elected Chairman of the branch that year. Over the next three years, she established a number of initiatives for the branch including the first refresher workshop open to non-member JPs, raising interest in branch meetings to regular attendance rates of 15-20 people. This prompted Marian to co-ordinate the first State Conference not organised by State Office, making it more accessible to JPs outside the capital city.

Marian is a qualified trainer and has trained a number of students to become JPs. She has participated in a number of QJA Trainer professional development workshops.

In 2005, Marian filled a casual vacancy on the QJA Board and at the following AGM, was officially elected to the Board. As a director, she has been involved in a number of refresher seminars, including those hosted by branches other than Ipswich. She has been a guest speaker at many branch meetings and taken an active role at the Annual State Conference.

Marian was re-elected in 2007 and then in 2009 was elected Vice-President. Recently, she facilitated the creation of official QJA Vision and Mission statements and has established the QJA Women’s & Diversity Committee, with goals to foster social inclusion within QJA. In her paid career, Marian works full time in the Safety arena in the construction industry. She is married to Bill with three married children and six grandchildren (and counting).

Name: YOUNG, Raymond - OAM

Location: Rockhampton

Seeking election as: Senior Vice President or Board Member I was the Chairperson of the Rockhampton Branch for many years and was elected a member of the QJA Board in 2002.

When I am in Brisbane during the Christmas and New Year break, I always make an effort to go out and meet QJA members at local signing centres, and attend Branch meetings when possible. I have also had the pleasure with my committee of organising three QJA State Conferences in Rockhampton.

I have always been prepared to travel far and wide to support the people and events of the QJA and I ask the members to consider electing me as Senior Vice-President and also elect me on the Board of Directors again so my voluntary work can be continued.

To keep up our Professional Training Program I encourage our Branch to conduct two Seminars and Refresher Workshops during the year, one in March & the other in November, also if new legislations are out JPs will know, this assist our JPs when they are signing documents.

Notice of Annual General Meeting The annual General Meeting of the Queensland Justices Association will be held at 10.00am on Saturday 9th November, 2013 at QJA House 751 Stanley Street, Woolloongabba. The business to be transacted at the meeting is as follows: 1. Members present, proxies received and apologies; 2. Minutes of the annual General Meeting held on Saturday 10th November 2012 and business arising from the minutes; Motion 1: That the Minutes of the Annual General Meeting of The Queensland Justices Association, held at QJA House, 751 Stanley Street, Woolloongabba, on Saturday 10th November 2012, be confirmed as a correct record.

6. Constitution Amendments; The Board has determined that some minor updates are required to the Constitution for clarity and recommend the following be approved.

Rule 22 (f): modified to clarify how many Members living at the same address are eligible for the reduced Membership Fee: 22 (f): Two Ordinary members who reside in the same residence are only required to each pay a fee calculated at 61%, or at such percentage as a General Meeting may determine, of the Subscription Fee and upon payment the members concerned are accorded all the privileges, and have, subject to this rule, all the obligations, of membership, provided that the Board may request proof of residency.

Schedule 1: Remove this section from the Constitution document and create a stand-alone “By-Law” document.

Rule 80 (f): By removing the “Schedule 1 – Model Rules” section from the Constitution document to a stand-alone “By-Laws” document this rule needs to be amended: 80 (f): A Branch must conduct its affairs in accordance with the By-laws.

By-Laws of the Queensland Justices Association: This is a new document which now has the Branch Model Rules which have been modified as follows: Rule 7 (a): Modified to specify a minimum number of general Branch Meetings of Members per year.

7 (a): A Branch Executive will hold at least five general meetings of the Branch Members each year of which one must be an annual general meeting and such other general meetings as they consider necessary and appropriate.

Registered Relationships are state-based regimes and each state has different forms and legislation that relate to that state. Therefore there is no age restriction on who can complete a Statutory Declaration provided the person is competent and understands the penalties for false statements.

This was discussed at the time by the previous Government, but no legislation was passed on it. Technical Bulletin 09/01 still applies: Specific numbers including passport numbers, drivers licence numbers, credit card numbers are not to be recorded into a log book.

A:

the Department of Justice and Attorney-General, JP Branch has recently updated the Disqualifications Provisions notice.

A:

Yes you can, particularly if the person who owns the vehicle is not available. If a vehicle is registered to a company, and it was the company director who was driving the vehicle, then they may complete the form as both the owner and the responsible party. Refer to JP Branch Technical Bulletin 0905 for more information.

Q:

Advanced Health Directive – does this go across all states and overseas (is it recognised) or is it only valid for use and presentation in Queensland?

A:

AHDs and EPAs are both under the Powers of Attorney (Qld) Act 1998. They are not recognised in other states and territories of Australia, as each state has its own similar regime. If a person has, for example, property in Queensland and New South Wales they should obtain an EPA for both States.

As for being recognised overseas, it may depend on which country. Independent legal advice in that particular country should be sought as to whether local authorities will accept a Queensland AHD or EPA.

On mortgage documents who is the Mortgagor and who is the Mortgagee?

A:

On Land Title documents the normal usage is: Mortgagee: A person or business making a loan that is secured by real property (normally a Bank) (the Lender).

Mortgagor: A person who has borrowed money (the Borrower).

The following is a summary of restrictions, any of which will prevent an individual from applying for, or holding the office as a Justice of the Peace (Qualified) or Commissioner for Declarations.

A person who has been convicted of a serious offence at any time.

A person who has been convicted of any offence in the last five years, or has been convicted of more than two offences at any time (does not include Traffic Act offences).

A person who has been convicted of a drink-driving related offence in the last five years.

A person who has been convicted of more than two Traffic Act offences in the last four years.

A person who is an undischarged bankrupt (undischarged – not yet free from bankruptcy).

If any of the above disqualifications affect you, you are unable to be appointed, or hold office as a Justice of the Peace (Qualified) or Commissioner for Declarations.

Peter and his very proud family were present at Governor’s Residence in Brisbane where he was presented the Official Charter and had the OAM medal pinned on his chest.

In the photo, you can see the arms full of honours presented to Peter by the Queensland Governor, Ms Penelope Wensley AC. You may well be asking, ‘Why is Peter wearing the scout’s uniform’?

Well, simply, Peter has so much to do, immediately after our meeting; he had to run off in time to attend a Regional Scout meeting where Peter is also an Assistant Regional Commissioner for the Darling Downs Scout Headquarters.

Training Continues in Chilly Toowoomba

Law Week QJA President Ray Burrows with the Governor of Queensland Her Excellency Ms Penelope Wensley AC, and QJA Vice-President Raymond Young OAM at the Law Week church service in Brisbane.

The Toowoomba QJA JP/C.Dec training cohort met during the first few Saturdays in July. This cohort consisted of 3 prospective C.Dec candidates and 10 JP(Qual) candidates. This training course was cotrained by Sarah Bregonje and Peter Boyes from QJA Toowoomba.

Attendees commented on the ease and conduct of the training experience. We can look forward to these fine ladies and gentlemen joining the proud ranks of JP(Qual) and C.Dec in the following months.

Of course, we strongly recommend to the course cohort to utilise the opportunity after being sworn in to make use of the JAG Mentoring Scheme where they can obtain valuable skills and professional development with an experienced JP Mentor.

Show and tell in Toowoomba

by Sarah Bregonje (Secretary, QJA Toowoomba) Members attending the July meeting at Toowoomba received a special treat. Member and local hero, Peter Williams OAM JP(Qual) was asked to bring along something exceptional for members to examine.

As we reported in a recent Journal, Peter’s contribution to the QJA Toowoomba Branch, Justices of the Peace and a number of other worthy groups earned him being awarded in the Queen’s Birthday Honours List with the Medal of the Order of Australia (OAM).

The course is conducted at the Darling Downs Scout HQ Training Rooms in Newtown. QJA Toowoomba proudly acknowledges the wonderful facilities provided and the ongoing support provided by Darling Downs Scout HQ Officers and staff. Without their vital assistance and flexibility, we could not have the capability to use such high quality facilities.

Redland Members Recognised

Recently two QJA Redland Branch Members were recognised with 25 year service certificates presented by Hon Steve Davies MP, Member for Capalaba.

Photo of the last Professional Development night in Bundaberg which was held at the Bundy police station and the subjects were: search warrants, arrest warrants, summons and record of interview (support persons).

The CIB & CPIU detectives that were involved in night were Det. Snr Const. Nathan Lucy and Det. Snr Const. Rob Darney.

Jim Gable is Chairman of the QJA Redland City Branch.

We had a few of our students from our last course attending and they all commented on how different the search warrants and applications were to the red book (at least they are attentive) the night went well and the detectives have requested a new list of our JPs so they can be put to work. The night ended with a tour of the police station. The general consensus from our member was what an excellent night and here we are a couple of weeks later and they are all still talking about the PD with the QJA.

Logan Update

By Keith Revell – Logan A new booth for JPs has finally arrived at the Grand Plaza shopping centre.

This will provide a more comfortable and recognisable location of all the volunteers.

Bowen Meeting A workshop on “Issuing Search Warrants” was recently held in Bowen at the PCYC for local Justices of the Peace and Commissioner for Declarations.

Adeline Phelan from the Justices of the Peace Branch in Townsville conducted the workshop with the assistance of a local Police Officer.

The workshop was very well attended and those attending found the information very interesting and informative. We will all feel much more confident when asked to witness Search Warrants.

Most of the JPs and C.Decs who attended are members of QJA who volunteer their services at the Bowen Court House every week.

At the recent AGM a new committee was elected to the Branch.
