Divorce: whose business is it anyway?

How does the court deal with a business in a financial dispute between a divorcing couple? There is often a niggling concern for the business owner that the court may force the sale of the business, which could have far-reaching consequences for them and their employees. Whereas the non-business owning spouse may worry that the court won’t include the value of the business in the settlement, meaning they won’t receive their fair share of the matrimonial pot.
So where does the court start? If a business is involved, the court has two main aims:
1) To establish the value of the interests of the parties in the business; and
2) To determine how that value ought to be considered in the overall financial settlement.
Establishing the value
How or whether to obtain a valuation is not always straightforward. A valuation is unlikely to assist where, for example, the main value of the business is an income stream, where there is difference of opinion about the value,

or if the value is theoretical. If there is any doubt about seeking a valuation, you should seek advice from an accountant, particularly if the non-business owning spouse is concerned that the accounts are not a true reflection of the business value.
If the court deems a valuation is appropriate, divorcing spouses will be expected to jointly instruct an expert to provide a valuation report.
Considering the value in the overall financial settlement
The court will use the valuation as a guide. The value is not the same as ‘cash in the bank’, so the court will try to distribute the risk of liquid and illiquid assets between the parties.
In a financial settlement the sharing principle applies to most cases. This means the court will share (more or less equally) all matrimonial assets accumulated during the marriage and will try not to dip into non-matrimonial assets (e.g. those built up before or after the marriage, or inherited). When a business forms part of the asset pot it is common for the court to hear arguments as to whether it is a matrimonial or non-matrimonial asset. The court will acknowledge that divorcing spouses are unlikely to want to have ties in the same business, so whilst it has the power to transfer shares, it is unlikely to leave such ties between the parties. It is also unlikely that a court will order the sale of a business if it is the source of the family’s wealth and income. This is a complex subject, so it is vital that divorcing spouses with business interests obtain specialist legal advice.

What is allergic rhinitis? This is inflammation of the inside of the nose caused by substances including pollen, dust, mould and animal fur. The body reacts to these substances and produces antibodies to ‘fight’ them causing the release of chemicals inside the nose. This condition affects children of all age groups but is most prevelant amongst the early teens.
What variations are there? Seasonal allergic rhinitis - this is when your child has symptoms at particular times of the year such as spring and summer, secondary to pollen from grass, trees and weeds, and is known as hay fever. Perennial allergic rhinitis - this is when your child has symptoms throughout the year and can be triggered by house dust mites, pets and/or mould. This type is more common in younger children.

He specialises in all aspect of adult and paediatric ear nose and throat disorders. Here he shares his specialist knowledge and advice on the common condition of allergic rhinitis in Children.
What are the symptoms? • Itchy eyes, throat, nose, ears • Sneezing, blocked/runny nose • Watering/red eyes • Throat clearing/cough • Headaches & fatigue
How is it diagnosed? Your GP can usually diagnose this condition using a combination of patient history and examination, and provide or suggest appropriate treatment. However, when treatment is not effective or the diagnosis isn’t clear then a specialist ENT consultant can help. This sometimes includes further tests such as skin allergy testing.
How can it be treated? Avoiding allergic substances - tests can be performed to determine specific allergies. For example pollen exposure can be minimised through checking weather reports, wearing wraparound sunglasses, using Vaseline around nostrils to trap pollen and keeping your child indoors whilst mowing the lawn.
Dust allergy can be limited though regular cleaning of carpets/soft toys, use of anti-allergenic mattress and pillow covers and using a vacuum cleaner with a HEPA filter amongst other things.
Medical treatment - antihistamines for example Piriton is available without prescription for children over the age of 1. Nasal sprays including steroid sprays can help control inflammation for children aged 4 and over. Eye drops can help for those children with particularly severe eye symptoms and can potentially be used in combination with sprays and oral agents.
Allergic rhinitis & asthma? Children with asthma are at higher risk for rhinitis and poorly controlled allergy symptoms can often make asthma symptoms worse. For these children it is particularly important to appropriately and preemptively manage allergy symptoms so as to keep the asthma under control as well. Your GP can refer you to a specialist Ear Nose and Throat surgeon if the symptoms prove difficult to manage or you can self refer your child should you wish to seek a private appointment.
