Today all companies are responsible for personal data, whether they refer to their workers, customers, users, etc. Therefore it is essential to know the regulatory developments of the General Regulation on Data Protection GRPD). Although the GRPD will apply from May 2018, during the transitional period it is essential to prepare and adopt the necessary measures to ensure compliance with the provisions of the new regulations when it enters into force. In this sense, from Dreamlove we want to highlight the actions, which, as indicated by the Spanish Data Protection Agency itself through its recommendations or interpretations, should be put into practice immediately. The main actions that should be initiated during the transition period between the entry into force and the start of the implementation of the GRPD are listed below. A- OBTAINING CONSENT. One of the most outstanding novelties is the requirement that the consent be unequivocal, that is, that has been provided by a manifestation of the interested party or by a clear affirmative action. Forms of tacit or omission consent will not be accepted as they are based on inaction. In addition, in the case of sensitive data, automated decision-making and international transfers, consent must also be explicit, without it being possible to deduce an action of the user that the user consents to. After the application of the RGPD tacit consent will no longer be valid, so it is advisable not to continue to obtain by default and to review those treatments to fit the provisions of the GRPD. Today all companies are responsible for personal data so regulatory normative must be known. B- TREATMENT MANAGERS. The data controller should exercise particular caution when selecting a treatment manager, and should take appropriate measures and choose only those that offer sufficient guarantees to implement appropriate technical and organizational measures in accordance with the RGPD requirements. As a novelty in this sense a minimum content of the contracts of more extensive commission is fixed than the current one, reason why it is necessary to progressively adapt and modify the order contracts concluded before the application of the GRPD. C- ACTIVE RESPONSIBILITY MEASURES. The principle of proactive responsibility and the risk approach are the keys to the great majority of the innovations introduced by the RGPD. In this sense, risk analysis requires a diligent and proactive attitude on the part of
the companies that must analyze all the processing of personal data that they carry out to determine the way in which they will apply the measures that the RGPD anticipates. All companies must assess the risk of the treatments they perform taking into account, among other things, the type of treatment they perform. The nature of the data, or the number of stakeholders affected, in order to be able to establish what measures should be applied and how they should do so. Security measures; In the RGPD, the managers and managers will establish the appropriate technical and organizational measures to ensure an adequate level of security based on the risks detected in the previous analysis. The security measures provided for in the LOPD regulation will not be valid automatically. Only from the results of the previous risk analysis, be will it known if the current measures are adequate or if additional measures should be adopted or taken. The DPO is one of the new figures that incorporate the GRPD. Companies that deal with a large amount of personal data, when conducting a treatment that requires a regular and systematic observation of large-scale stakeholders or large-scale treatment of sensitive data, must necessarily have a DPO. A professional with the necessary qualification so that companies should take into account their professional qualifications and knowledge of data protection. Certification is not a requirement but facilitates the choice of DPO. It should be noted that it is possible to appoint a single DPO for a business group and that it be contracted through an employment relationship or through a service contract, so it is perfectly possible to contract as a DPO to individuals or legal entities outside the organization.
