PRESIDENT'S MESSAGE Introduction & Goals Let me introduce myself. I’m Terry E. McMillen, Jr., I had my first experience on a survey crew in the summer of 1985 and again in the summer of 1986, served four years in the United States Marine Corps, attended Penn State Wilkes-Barre to earn my degree, and started my process to be a licensed registered land surveyor in the Commonwealth of Pennsylvania. I perform all types of surveys from ALTA/NSPS Land Title Surveys, any size boundary retracement, large farm surveys down to the private quarter acre lot surveys, subdivisions for commercial properties down to the small lot splits, highway occupancy plans (HOP) for utility companies, and construction surveys and layout. I have been with McMillen Engineering, Inc. for 36 years. I started as a crew helper and am now the President and owner. McMillen Engineering, Inc. has completed the requirements to gain its Veteran Owned Small Business (VOSB) designation.

My goals for the coming year.

Continue to help you all make this the best profession out there. I believe it is important keep land surveying a profession needing licensure to provide this service. We need to be diligent in keeping “Joe Angle-Turn” out of being able to create a service to hand out boundary surveys. We have a Legislative Committee that is doing a great job staying on top of things.

But we could use more help. Some of the back ends of the legislation trying to get through the system would allow people without a license to create plans for different agencies without the seal and signature of a licensed professional. This means that soon the untrained draftsmen will be able to create plans. You, as a licensed professional, will not be needed.

Our profession will be watered down quickly.

I want to see a trespass bill enacted into law. It’s hard enough to do boundary retracement. Some days that key piece to the puzzle is just inaccessible due to purple paint or posted signs.

With the help of our lobbyist, Bob Regola, I believe PSLS can get both of these accomplished, but we need every member’s help.

I have two challenges for you: Jumpstart your local chapter. Find that central point where you can meet once a month or once every two months. Swap field experiences, problems, or success stories from the last time you were together. Our society has been using video conferencing over the last few years. Try that as well. We have a new, revamped web site. After you sign in you can look through the member portals to search for fellow members of your chapter.

Help to better our profession by volunteering on a committee or board of directors. Let’s face it, not all of us have the same practice or ways to do things in the areas we work. Bring your experience and knowledge of your area and how the profession works for you to the board or a committee.

What committees are out there, you may ask? Look at the website to find a list. One committee in particular that needs help is the Budget & Finance Committee.

FS EXAM AS A STUDENT GRADUATION REQUIREMENT BY: KNUD E. HERMANSEN P.L.S., P.E., PH.D., ESQ.

This is the second article focusing on professional practice and education. While I suspect there is support for the thoughts I am going to reveal among the profession, many academic administrators and faculty will disagree with what I am about to say. Agreement among all is never possible. Even the best of advice is often dismissed. Not that my advice is always the best.

There is an old Jewish saying “If God lived on earth, people would break His windows.”

By way of introduction and upon which my thoughts will be measured, I introduce myself briefly. I taught surveying for more than 30 years and still do contract teaching for surveying and engineering programs. I was a surveyor and engineer for over twenty years in the military before retiring. I have been licensed in several states as a surveyor, engineer, and attorney - almost fifty years as a surveyor. I still have an active license for each profession in at least one state.

The focus for this article will be to advocate requiring the fundamentals of surveying exam in order for a student to graduate from a surveying or geomatics program. Note that I emphasize that I am not advocating the student pass the exam in order to graduate, merely be required to take the exam.

I suspect those reading this article are familiar with the three exams required for licensure. Briefly, the first exam is the fundamentals of surveying (FS) exam. The second exam is the professional surveyor’s (PS) exam. The third exam is the state specific exam. The FS exam tests the examinee on topics that a quality surveying program should cover in its curriculum. Most states, if not all states, allow senior college students to take the FS exam. Therefore, there is no barrier to prevent a surveying program from requiring that students take the exam as a pre-requisite for graduation.

Whether the graduate seeks employment in the private or public sector, licensing is generally required to achieve more pay and higher positions. Licensing is required to own or manage surveying firms offering services to the public. What better way to begin the transition from academics to a professional stature than require the first professional exam while still involved in academic learning?

Second, the breadth and depth of surveying knowledge will never be more retentive than at or near graduation. After graduation, graduates tend to increase their depth of knowledge in limited topic areas of surveying while forgetting knowledge in other topic areas.

By way of example, the new employee that spends the next four years after graduation doing drone mapping is likely to have forgotten a great deal of the knowledge they once possessed on boundary law, measurement adjustment, and so on. Therefore, the best chance for passing the FS exam that tests on a broad range of surveying topics is immediately prior to or shortly after graduation.

I have heard students claim they will be better able to study for the FS exam later after they are employed and without the academic burdens of course attendance, homework, and course exams. I caution otherwise. My experience shows that the new graduate is often immersed in long hours at work and is soon distracted with marriage, home ownership, child raising, and family commitments.

All too often the graduate who has not taken and passed the FS exam while in college, fails to pass the exam later or cannot commit the time to prepare and take the FS exam later.

I provide three arguments for a surveying program to require students to take the FS exam.

First, I believe a primary purpose for any surveying program is to provide graduates to feed the needs of employers and the profession.

For a third reason, I believe a graduate that has passed the FS exam, and placed this achievement on their resume at graduation, has many more opportunities for employment and advancement upon graduation than a graduate who has not taken the FS exam. An employer will seek out graduates and pay a higher wage to those that have already passed the FS exam. These students have proven a mastery of topics deemed necessary for professional practice and advancement.

While other compelling arguments can be made, I believe these three arguments are sufficient for those reading this article to understand the basis for my opinion. So why don’t all survey programs incorporate the requirement that students take the FS exam as a pre-requisite for graduation?

I will give two reasons that seem to be prevalent reasons told to me. The first reason is that some programs rely on large number of foreign nationals to increase enrollment numbers and finance university coffers that rely on tuition money. Foreign nationals have no interest or need to pass any professional exam that is not recognized or necessary in their counties of residence.

Such is their disdain for this requirement that when forced to take the exam, they select answers without contemplation. These programs fear the foreign student will switch their studies to another program that does not require the FS exam for graduation.

The second reason, perhaps partnering with the first reason, is that program administrators do not want the FS scores to be used to judge the extent of their graduate’s knowledge and ultimately the quality of the surveying program. It is no secret among the profession that many surveying programs are on tenuous grounds due to low enrollment or faculty deficiencies. Often students that should not be in college, let alone a surveying program, are admitted and moved along much as many public schools move students along to graduation. Perhaps this happenstance is the eventual outcome of a society that gives a trophy to all participants, not just the winners. I will say no more as rational arguments sometimes get lost or ambushed when placed in this arena.

Having given my opinion, I now offer advice. My advice is for professional societies to press their local surveying programs to initiate this requirement if the requirement is not already a mandate.

If the program seeks the support of the profession then the profession should seek the commitment of the program toward the profession by demanding students take the FS exam.

SIDE-SHOT FROM HARRISBURG With the holidays behind us, we begin the last year of Governor Tom Wolf’s term. The Pennsylvania State Senate returned to Harrisburg on January 18 and the House on January 24.

On February 8, Governor Wolf delivered his final budget address to the General Assembly in Harrisburg. Budget hearings by the Senate and House Appropriations Committee began on February 15 and conclude on March 17. Shortly thereafter, the House and Senate resume the legislative session.

With regard to HB 609, which amends the engineer, land surveyor and geologist registration law (Act 367 of 1945), it remains in the Senate Consumer Protection and Professional Licensure Committee, chaired by Senator Robert “Tommy” Tomlinson. Just prior to the Senate recess for the budget hearings, I spoke with Senator Tomlinson and he indicated to me that he would speak with his executive director, Jen Smeltz, to consider moving this piece of legislation out of committee. Since that time, I have spoken with the majority of the committee members making sure that we have the votes to pass once it is brought up. Furthermore, the two Senators that were blocking HB 609 from coming out of committee because of concerns from constituents in the GIS field, Mike Regan and Camera Bartolotta, appear to have agreed that they will let the bill move forward, however, they will vote no. I will continue to advocate for the bill in an effort to get this out of committee shortly after budget hearings.

Also, with regard to the proposed “right-of-entry" legislation, which is an amendment to the trespass law, § 3503, a one-page issue paper is being prepared so I can start discussions with key members in the House and Senate to secure sponsors and develop support. Once this is accomplished, the Legislative Research Bureau (LRB) will draft the legislation modeled after the surveyor right of entry laws in other states, including West Virginia.

PAC Report The annual report for 2021 was filed, showing a balance of $4,226.69. We started the year with a balance of $1926.69. I recently received donations of $275.00, bringing the balance to $4501.69. I want to thank everyone who contributed to the PAC. With that being said, we are working on a few PAC events: March Madness NCAA basketball tournament pool A guided tour of the State Capitol building in Harrisburg As we continue to have some key pieces of legislation in the works, we must have money in the PAC so we can attend events and be visible. This will open doors so we can make the case for legislation in order to represent the best interests of surveyors and the health, safety, and welfare of the citizens of the Commonwealth. CAPITOL CONTOURS Major NSPS Highlights Thus Far in 2022: PSLS member Brent Birth has once again been named to the mapping working group to advise the Federal Communications Commission (FCC) and U.S. Department of Agriculture (USDA) on the Task Force for Reviewing the Connectivity and Technology Needs of Precision Agriculture in the United States, representing NSPS. Brent and NSPS were responsible for adding the support for the USGS 3DEP national LiDAR mapping initiative in the task force’s final report for 2021.

Timothy W. Burch, PLS was appointed New Executive Director of NSPS. He is a professional land surveyor licensed in Illinois and Wisconsin. Mr. Burch succeeds Curt Sumner, who has been the Executive Director for the past 23 years. He relocated to the NSPS headquarters in Frederick, MD beginning in January.

Tim and I made a presentation before the National Academies of Science panel on January 20 to discuss the impact on the surveying profession from GPS interference by Ligado resulting from the firm’s April 2020 approval by the Federal Communications Commission.

Gwen Cunningham

I grew up in the Philadelphia suburbs, in Montgomery County. I read about surveying in a career book and I always liked looking at maps as a kid. My senior project in high school was to re-map the trails for my Girl Scout Camp. The current map at the time was incomplete, and the new one showed all of the trails. I was a Girl Scout and obtained my Gold Award. I didn’t really know what I wanted to do after high school. My parents suggested I consider engineering. I started out as a civil engineering major and switched to land surveying in my sophomore year. I graduated from Penn State in 2007 with a BS in Surveying Engineering. After college I moved to Charlotte, North Carolina to work for CESI. I wanted to get field experience and they were one of the few firms that were willing to let me do that. I worked there until the housing market crashed and I was laid off. After the layoff I moved back to Pennsylvania to take a job at a firm in Pittson, PA. I currently live in Lancaster with my cat and my horse Glory. I obtained my license in PA in 2013. I am also licensed in Ohio, West Virginia and New York. I work for a surveying firm that focuses on the oil and gas industry so we cover a large area of the country. I often manage projects in the Midwest, as well as the east coast.

What is the most unique project you have worked on, and why?

A project that stands out to me is one that I worked on in North Carolina. We did a lot of work for the local landfill. The landfill asked us to determine if the streams running off of the trash piles were actually draining into the drainage basins. Our company sent about five crews out and had us traverse down the streams to see where they ended. The one that I was following ended in a swamp. I had to set a point for the total station in the middle of the swamp using a short stake for the occupy point. That was the only time I ever set the gun up in the water. Luckily it was summer so the water temperature wasn’t an issue.

Did you have a mentor, if so, how did it affect your career?

I started at LW Survey in 2012, which is where I work to this day. My boss when I started there, Jack Turpin, really helped me learn how to make boundary determinations and to understand how to manage projects. He pushed me to obtain additional licenses and to make the move from survey tech to project manager. I worked with him for eight years, before he moved to another firm.

What advice can you give to young surveyors?

My advice to young surveyors is to make sure that you get some field experience if you want to eventually get licensed. Once you get good at office work it is difficult to convince an employer to send you out in the field, so you need to get that early in your career. To any young women out there, I would say that if you are at a company where they don’t treat you as an equal to others in your same position, find another company. Many men that I worked with had never worked with a woman before and they had to get used to me. However, they should still be able to treat you with respect.

If you were reincarnated as a famous landmark, what would it be and why?

If I was reincarnated as a famous landmark, I would want to be the Grand Canyon. The Grand Canyon is so majestic. It just comes out of nowhere. Driving through the desert, and then all of a sudden there’s a giant hole in the ground.

Tell us an interesting or funny surveying story?

We surveyed one property on an old coal lot in Luzerne County that always stands out to me. The owner wanted us to survey her lot because she thought that her neighbors were putting their trash cans on her land and she wanted to put up a fence to stop this. The neighbor was putting the trash cans next to her house and the bears were getting into them. The neighborhood was part of an old coal company subdivision so the lots were small. I was sent out to do re-con and initially we didn’t find many corners. Finally, I realized that the GIS was shifted by about 50 feet from the existing monumentation, which made the search points all off significantly. When we went out to set the pins, we found the corner on the disputed line and her house was actually on the property line. The land owner was so upset that she cried and asked us not to set the remaining pins. That is the most upset I have ever seen someone get over a property line.

Random Headline: Resurrecting the Woolly Mammoths ( Click Here) A new company called Colossal intends to re-create and re-introduce the extinct woolly mammoth to the Siberian tundra.

How it (could) work: Entrepreneur Ben Lamm and Harvard genetics professor George Church, who have raised $15 million in funding from strategic investors and plan to use CRISPR gene-editing technology to create a new species that’s close to, but not an exact replica of, the woolly mammoths that roamed the Arctic before disappearing roughly 10,000 years ago.

OK, but why? A mammoth revival could contribute to the fight against climate change—for example, through slowing permafrost thaw in the tundra by removing trees and trampling moss, Dr. Church has argued.

Looking ahead...if everything goes according to plan, the company could begin “rewilding” mammoths in 15 years, Lamm said. But it’ll have to navigate an ethical minefield to get there.

One enterprising New Yorker, Paul Slapikas, said he made $64,000 last year simply by recording videos of idling trucks and reporting them to the city, per the NYT. Under 2018’s Citizens Air Complaint Program, New York City pays bounty hunters 25% of a fine against trucks that illegally park and idle their engines for more than three minutes. What tax form do you get for that?
