OUTGOING MESSAGE I would like to take this time to thank you all for the opportunity to serve as President of the Pennsylvania Society of Land Surveyors. It has truly been an honor, privilege, and eye-opening experience. I took over the presidency in September of 2020 to finish out Jonathan Tabas’s term when he was appointed to the State Registration Board.

16 months later, I’m about to conclude my own full term as president and pass the gavel on to Terry McMillen, Jr. in January at the in-person conference in Hershey, PA. You are not rid of me yet. I’ll serve on the Executive Committee for one more year as the Immediate Past President. It's typically a 5-year commitment to serve on the Executive Committee. And my time as Secretary, Vice President, and President Elect prepared me for my time as President. I’d also like to thank a long list of past presidents, board members, committee chairs, and friends who gave me guidance, advice, and support.

We welcomed Natalie Butler, John Palatiello, Paul Miller, and the support team from Miller/Wenhold to our organization. I thank you all for your patience during the changeover. Things have settled down and now they’re full speed ahead. Look forward to changes from this group, they have some great ideas. Hopefully by now you have visited our new website and set up your profile. Electronic certificates for professional development hours are now being delivered directly to your account.

My work with the Legislative and Government Affairs Committee has probably been the most rewarding for me.

Our lobbyist, Bob Regola, Regola Consulting, LLC, has really emphasized the importance of me, as the President of PSLS, and as a Woman Veteran Owned Small Business, being the face and voice of PSLS in Harrisburg. I hope to continue working with the committee as well as the Public Relations Committee.

I encourage you all to get involved in your society. Get more active in your chapter and join a committee. The work is truly rewarding, and you keep up to date on all things surveying, like new technologies and policies. I look forward to seeing everyone at the 2022 Annual Surveyors' Conference. THOUGHTS ON PROFESSIONAL PRACTICE & EDUCATION SERIES:

FACULTY LICENSURE WRITTEN BY: KNUD E. HERMANSEN P.L.S., P.E., PH.D., ESQ.

This will be the first of several articles giving thought to the topic of professional practice and education.

I have reached the age where I have a great many opinions and have no fear of sharing them. I have no employers that would take umbrage of my opinion. Perhaps some current or past clients might object, but they are free to seek others to perform their services should they wish.

If this is the first of several articles I plan to write, I can introduce myself thoroughly in this article and be reticent about an introduction in later articles.

I am retired after 30 years of teaching, though I still do contract teaching for surveying and engineering programs. I have also retired from the military where I was a surveyor and engineer for over twenty years. I have been licensed in several states as a surveyor, engineer, and attorney. I still have an active license for each profession in at least one state. I have consulted in a wide variety of roles offering surveying, engineering, and legal services.

I have surveyed many miles of boundaries. I was a member of a licensing board at one time. On numerous occasions I have served as an expert witness, trial attorney, appeals attorney, arbitrator, mediator, boundary commissioner, and, of course, a professor and instructor. Old age, experience, and my varied and unique practice I hope gives me a perspective that will generate some thought, no doubt some controversy, and perhaps some changes.

After the graduate has practiced in the surveying profession for fifty years and still wishes to maintain a low opinion of my instruction, I will welcome their thoughts and give them worthy consideration.

The point I wish to make in this missive is to share my opinion on faculty licensing. I do not believe a quality surveying program must require every faculty to be licensed to practice the profession of surveying. However, I do believe a majority of faculty should be licensed to practice the profession. I will offer three reasons for my opinion.

First and most importantly, I am of the firm opinion that no amount of education and research in surveying or ‘geomatics’ (as some programs prefer to use), allows a faculty to provide the impactful presentation experience allows. Of course, any person wishing to become faculty and claim they have experience outside of academics should have enough experience to be able to qualify and sit for professional exams in at least one state.

I am mindful that some faculty may have experience in areas of surveying practice that their state of residency will not accept toward licensure. Yet, that person will not be prevented from applying and being licensed in some other state that does accept their experience for licensure. (There is no state, by law, that can demand residency in the state before being licensed.) By way of example, I would refer the reader to some states that require a license for, and therefore must accept experience in areas of, remote sensing and GIS when applying for professional licensing.

In this missive I will focus on surveying faculty qualifications. I will never claim to be among the best faculty. I am sure there are some former students that will claim I am not even a satisfactory faculty for I had hard standards and high expectations that left some students disgruntled and unhappy that I chose to apply these standards to them. As I said, I am too old to change or even give much care to what a young student, lacking experience, may believe. To put it simply, their opinion is seldom my reality.

FACULTY LICENSURE - CONTINUED

Second, I believe it important that faculty set an example that will encourage students to seek professional licensing in the surveying field. This is done most effectively by the faculty themselves being licensed to practice the profession of surveying. I have seen numerous articles in professional magazines that lament the aging of the licensed surveyor population and how few young persons are entering the profession. Many employers lament the difficulty of finding young persons interested in filling employment openings. Young adults are not given a good example by allowing surveying instructors to be unlicensed.

Third, I believe faculty are much more inclined to have been or become active in their state and national professional societies when licensed. I am of the very firm belief that a successful college surveying program must enjoy the support of state surveying societies. To enjoy that support, there must be continuous interaction and familiarity between the academic program and the professional society. The interaction and familiarity are often absent or tenuous at best when faculty are not licensed. Lacking a license, the faculty can’t be a full member of the professional society.

I have such a firm opinion on the importance of requiring licensed faculty that I would demand licensing as a prerequisite for a faculty member even at the expense of academic qualifications. If the only choice to fill a faculty position was between a licensed individual and one with a Ph.D. of similar temperament, I would opt to always take the licensed individual.

Many universities that host surveying programs require a Ph.D. These same surveying programs do not require professional licensing of faculty. For some reason which I cannot comprehend, even after 30 years in college teaching, university administrators think it much more important to hire a Ph.D., without practical experience, often without experience as a resident, to teach surveying topics. The administrator will not accept someone without the Ph.D. that would have many years of relevant experience, relevant license, and familiarity with the residency where a graduate is likely to seek employment.

Having given my opinion, I now offer advice by suggesting ABET and professional societies make strenuous and consistent requests of administrators of surveying programs to demand current faculty become licensed and new faculty to be licensed prior to employment. The line is very clear.

If a person wishes to teach in a surveying or geomatics program, they should have a professional license.

SIDE-SHOT FROM HARRISBURG With the summer recess behind us, the Pennsylvania House & Senate are back in session. The Senate returned to Harrisburg on September 20 and the House on September 27. With that being said, Amy Hopkins, PSLS President and I went to Harrisburg on September 27 and met with almost every member of the Senate Consumer Protection and Professional Licensure Committee to discuss HB609. We explained the purpose of HB609 and shared the Myths vs Facts document with the members. We received a very favorable response from the members and have their support when the chairman of the Committee, Senator Robert “Tommy” Tomlinson decides to run this piece out of committee. Since then I have learned that Senator Tomlinson is off on a legislative leave, therefore I am trying to see if Vice-Chairman Ryan Aument can move this piece of legislation out of committee. Furthermore, a legislative alert was sent out to make sure that Senator Regan was informed of PSLS position since one of his constituents in the GIS field is trying to encourage him to block this legislation.

Also, with regards to the proposed Right-of-Entry legislation, which is an amendment to the Trespass Law 3503, we are working on a one pager to start discussions with key members in the House and Senate. Once this piece is drafted and I identify a sponsor in the House and Senate, we will have the Legislative Research Bureau (LRB) draft this legislation. Upon it is drafted, the bill will be circulated for sponsors and we will start advocating for support of this legislation.

Won a $5 million appropriation amendment in the House to the Interior appropriations bill for FY2022, providing for USGS to begin a land level change/subsidence program.

Secured a provision in the House Financial Services and General Government Funding bill for FY2022, prohibiting the General Services Administration (GSA) from awarding or facilitating the award of any contract for the provision of architectural, engineering, and related services, including surveying and mapping, in a manner inconsistent with the Brooks Act.

DAVIS-BACON ACT AND PENNSYLVANIA SURVEY PERSONNEL WRITTEN BY: JOHN PALATIELLO

Several PSLS members have recently contacted the association’s new management firm, Miller/Wenhold, with inquiries about compliance with the Davis-Bacon Act. These inquiries have prompted this review of the issue.

The Davis-Bacon Act is a federal law enacted in 1931 during the Great Depression and amended in 1935 and 1964. The law requires the payment of locally prevailing wages and fringe benefits to “laborers and mechanics” as determined by the U.S. Department of Labor. The Act applies to direct federal contracts and District of Columbia contracts in excess of $2,000 for the construction, alteration, or repair of public buildings or public works. Congress has also included prevailing wage requirements in numerous statutes under which federal agencies assist construction projects through grants, loans, guarantees, insurance, and other methods. Covered contractors and subcontractors must pay their laborers and mechanics employed under the contract no less than the locally prevailing wage rates and fringe benefits as required by the applicable wage determination.

It is important to note this law applies only to construction related services. Historically, it was determined that members of survey crews were not considered “laborers and mechanics” under the meaning of such term in the law. In the early 1960s, a question arose as to whether that interpretation was valid. In a landmark opinion, Arthur Goldberg, then Secretary of Labor under President John F. Kennedy (and later an Associate Justice on the Supreme Court) wrote that the Act applies to survey crews on to the extent they "perform manual work, such as clearing brush and sharpening stakes”, which Goldberg observed "are not commonplace”.

In the ensuing years, the Labor Department reaffirmed that very limited application of the law, and it became a standard recognized in several court and administrative rulings.

During the Obama Administration, the International Union of Operating Engineers lobbied the Wage and Hour Division, the agency within the Department of Labor with responsibility for implementation of the Davis Bacon Act, to rescind the Goldberg policy and expand the application of the law. The result was All Agency Memorandum 212, issued on March 22, 2013.

Fortunately, as a result of a 7-year effort by the National Society of Professional Surveyors (NSPS), the Trump Administration, before leaving office, released a new document, AAM 235 on December 14, 2020. It notes “AAM 212 is rescinded effective immediately.”

The conclusion is that the federal Davis-Bacon Act does not apply to any member of a survey crew, working on a Federally funded construction project, except to the extent that such workers, "perform manual work, such as clearing brush and sharpening stakes”. It should be noted that the Act never applied to a licensed professional surveyor, or supervisory personnel, such as a party chief.

A famous surveyor, Thomas Jefferson, is said “Eternal vigilance is the price of liberty”. This battle may not be over as the Biden Administration has indicated its intent to review Davis-Bacon Act regulations, as soon as this month, which may cause a revisiting of the survey issue. NSPS will stay on top of any proposed rulemaking.

DAVIS-BACON ACT AND PENNSYLVANIA SURVEY PERSONNEL - CONTINUED

It should be noted that many states have enacted their own prevailing was laws, sometimes referred to as a “miniDavis-Bacon Act”. Pennsylvania has such a law, the Pennsylvania Prevailing Wage Act (43 P. S. §§ 165-1 - 16517), which requires the “prevailing wage” rate to be paid to contracted labor for construction projects with an estimated cost of $25,000.00 or more when state or local government funds are involved. The Pennsylvania law uses the term “workman”, rather than “laborer or mechanic”, but appears to cover similar personnel.

The information provided here is to help PSLS members understand how the Davis-Bacon Act and Pennsylvania Prevailing Wage Act affect their work and is NOT legal advice or an official determination on whether or not such laws apply to any specific project.

If any PSLS member has experience with the Pennsylvania Prevailing Wage Act and whether or not its application to survey personnel has been determined, please provide that information to the PSLS office. If a PSLS member has any questions about whether the Prevailing Wage Act applies to a specific project, they should contact the PA Department of Labor and Industry for an official determination. The PSLS staff would be pleased to assist any member with any such inquiry.
