CHANGE IS INEVITABLE Most people hate change. I watch them fight it. Yet, we’ve all dealt with drastic change over the last 18 months or so. We didn’t really have a choice. The pandemic hit and we dealt with it, adjusting our lifestyles and business practices. The changes affected the whole world, not just Pennsylvania. For those of you who hate change: congratulations, you did great.

Organizations need to change in order to survive, also. PSLS needs to make changes, evolve, or our organization and profession will become extinct. As President of PSLS, I attend meetings for our various committees and task forces. Most recently, the Public Relations Committee and the Young Surveyors Network had a joint meeting on workforce development and how to best attract young talent to our profession. And to do that, we need to make the Society and Profession more appealing to the younger generation.

How do we accomplish this? How do we make a profession and organization whose average age is 58 years old appealing to younger and more technologically advanced talent? The first thing we must do is accept the fact that it isn’t about us anymore. Our careers are established, we have our licenses, our party chief positions, our management positions, our own businesses. We need to quit living in the past, quit holding on to what used to be, get out of our comfort zones, and look toward the future. The future of our businesses, our profession, and PSLS. You’ve all heard the definition of insanity. It’s doing the same thing over and over expecting different results. I’d like to thank you all in advance for your patience and support as PSLS makes changes, evolves, and looks to the future. We might not like all the perspective changes, but then again, it's not about us anymore.

YOU JUST SIGNED A CONTRACT TO PERFORM A MINOR SUBDIVISION – ARE YOU ALREADY IN TROUBLE? WRITTEN BY DON HOUSLEY

As a licensed professional land surveyor in Pennsylvania, you have just had a contract to perform a subdivision accepted by a client. Most likely you are excited and ready to get started! Are you already in trouble?

Many of us have completed minor subdivisions without an issue. Perhaps these projects have all been in one or two of the communities you always seem to work within.

You are comfortable with the process; the town is friendly, you know the staff, you know the procedural regulations, ordinances, and perhaps even the members of the planning commission and council, (supervisors, or commissioners). Maybe this is a new community you have never worked in? Either way, you have previously completed so many of this type of subdivision in that general area you are still comfortable with your decision on performing this newly contracted task. Great!

BUT, any of these scenarios could prove to be a problem if you did not follow the protocols prior to writing your contract. Certain provisions, required by the local Zoning and Subdivision Ordinance (SALDO), may have been left out of the proposed contract. What had started as a minor subdivision you thought would be easy to knock out and turn a reasonable profit on has now become more troublesome. Well, maybe…

You complete the required survey of the boundary of the property, you prepare a plan for recording, showing a proposed subdivision or lot line revision per your own standards that have worked for you in the past. Perhaps you assist your client with or complete the application on their behalf yourself, print your plans and then make the submission to the municipality.

Truly, what is your first reaction? Dismay? Disbelief? And, most likely anger?

Who do you immediately blame? Of course, it was the engineer that did the review. Correct? It must be them. I have done so many of these, they have to be wrong!

I am sure you have heard one or more of these reactions from someone else or even have some personal favorites of your own?

Let us look into a couple of things. Actually, let us look into you and your thoughts prior to accepting the job: Did you research the CURRENT Zoning Ordinance to see if the pending project meets the zoning requirements?

Are any variances needed to complete what your client desires?

Did you research the CURRENT Subdivision and Land Development (SALDO) Ordinance to see if the pending project had unique requirements that perhaps needed to be addressed or explained to the municipality prior to or at the time of application such as these examples: All subdivisions require the locations of ALL BUILDINGS, SEWERS, WATER MAINS, FIRE HYDRANTS, CULVERTS, GAS LINES, ALL UTILITIES ON THE SUBJECT PROPERTY OR WITHIN 200’ of the boundary All existing easements – location width and purpose Location of MONUMENTS and LOT MARKERS (existing or proposed)

A short time later you receive a communication from the municipality and oh my, they have presented you with a review of your submission with what appears to be a complete disaster. The municipal engineer has made comments based upon the current ordinance that were not covered in the signed proposal, they were not mentioned before in prior submissions, and now you must deal with them in some fashion.

Concrete Monuments are required to be set at the points of intersection of all boundary lines on the full external boundary of the subject property Utility feasibility reports or service capability letter Municipal certifications required for recording Every new lot shall have frontage on a public street “Flag” lots shall not be permitted Considering the above, are Waivers or Modifications needed for your project? Did you allow time to complete the applications (if needed) or at the very least, draft and type a written narrative explaining why your client deserves to be granted relief from the requirements of the Municipal Codes?

Did you call the zoning officer or other municipal officials to discuss your pending project, your client’s thoughts and your professional opinions to see if the municipal staff had any issues with what you were proposing?

Let us assume you submitted the application without any or all of the required items described above on your proposed subdivision. Now the Municipal Engineer has completed a compliance review has pointed out the missing items as “deficient.”

Would it be professional of you to be upset, angry or in total disbelief with the engineer?

Should you describe their review to your client as “they are just being so excessive” or how about “they are just picking on me”?

One of my favorites I seem to hear all too often is “I don’t have to do this in any other community”.

It is in you and your client’s best interest to recognize the Municipal Engineer is or can be your “friend” in this process.

The proper approach is to show your client the actual written ordinance, admit to the client you “missed” these items in quoting the project, and in order to comply with the rules and regulations of the Municipality you will need to perform the items required by the ordinance.

If some items seem excessive for the application at hand, you may consider requesting relief. If your client wishes to request relief, you need to discuss why it would be a hardship to comply with all the remaining guidelines of the ordinance.

You (or the client) will need to prepare a written request through a narrative, describing the section of the ordinance by article, section, subsection, the specific item requested, and a short paragraph on why the request is being made. It may be necessary and permitted to request some form of partial relief to do less than the full requirement. It would also be fully advisable to instruct your client as to the rules of an application for waivers or modifications to municipal ordinances.

Unlike a zoning variance, a request for a waiver or modification may be a financial burden or hardship. The burden of proof to request relief is generally less than those required for a variance. Simply put, other reasons for SALDO relief can be varied and too excessive to cover in this article.

I would then suggest a call to the Municipality and the engineer to discuss your plans. Chances are, this is not the first time they have heard of the exact same problems you are facing. It is your job to explain your problems to the Municipal staff and engineer on a professional level. Have your paperwork, hardship, and explanation of requested relief all together, leave the “why do you have this in your code” and “this is so excessive” types of comments at home. They do not help. Remember, these requirements were there when you quoted the job. Most likely, they have been in there for years and such comments are not productive at this point and can cause the staff to become defensive. In most applications, this would work against your client’s wishes. Try working with them.

Remember, the Municipal Engineer is a licensed professional who, by ethics and professionalism, is generally considered an independent counsel when it comes to the representation of the ordinance. Their professional opinion to the municipality is generally accepted as a fair and just representation to both the Municipality and the applicant. The engineer is generally “in your field of practice” and should, could, or may be the best representative to understand and perhaps support your request.

Under your professional license, you also owe your client a fair and professionally just municipal application process. Keep in mind, the Municipal Engineer by the PA MPC charges an hourly rate for the review of the application. This is in addition to the application fee. Every time they review and/or spend time on your client’s application, the Municipality is charged for their time.

Most likely, those costs are passed onto your client. If you are not professionally productive in your progress, are you really representing your client in the best professional way possible?

ABOUT THE AUTHOR "Mr. Housley started his career as a surveyor working at various levels on field survey crews for his fathers firm – Kurch Housley and Associates, Inc. In 1976 Don, along with his father, purchased Triangle Engineering and Land Planning Services where he served as the CEO of the Corporation until 2009 when he joined KLH Engineers Inc. In 2014, Don moved to R. F. Mitall Engineers, Inc. as the company Manager. The firm was then absorbed by K U Recourses, Inc., a multifaceted engineering and land surveying professional corporation. Don is a multi-disciplined individual with a wide range of experience including Land Surveying, Erosion and Sedimentation Control, Storm Water Management, Aerial and Field Topography, Public Hearings, Zoning, Planning and Subdivision of Property. Donald is a Registered Professional Land Surveyor of the Commonwealth of Pennsylvania with over 50 years experience. Don was elected the 2019 Surveyor of the Year by his constituents of the PSLS. Now, Don is working closely with his 3 sons, DJ, David and Daniel all of whom are active in the land surveying profession and the local PSLS. David, a PLS, has just accepted a position as PSLS SW Chapter Director. DJ, a planning and zoning expert also, is finishing up his Engineering degree at Point Park University and can be dual licensed in the future. Daniel is currently working toward PLS licensure by acquiring his field experience as a survey crew chief under his father’s expertise."

SIDE-SHOT FROM HARRISBURG At the top of the PSLS legislative priority list is HB 609. The primary sponsor in the House is Representative Joe Emrick (R-137-Northampton). The bill passed the House by a vote of 197-4 on May 4. It is now pending before the Consumer Protection and Professional Licensure Committee of the State Senate. Senator Robert (Tommy) Tomlinson (R-6-Bucks) is chairman. I’ve spoken with Senate Majority Leader Kim Ward (R-39Westmoreland) and Senator Jay Costa (D-43-Allegheny), Minority Caucus Chair, to gage any intelligence they have, particularly with any concerns they’ve heard from Senators about the bill.

PSLS has finalized a Myths vs. Facts document addressing some of the rumors and misunderstandings that have circulated about the bill. I will be setting up meetings with all three of the aforementioned legislators to go over the Myths vs. Facts. In fact, while the legislature is in summer recess, I will be in Harrisburg on September 27 to advocate for and lobby our position on the Myths vs. Facts document.

Depending on how the meetings go will determine if we need a major grass roots effort. We will try to push for a Senate vote in the fall session. Stay tuned and we’ll let the membership know if we need to employ a grass roots effort of PSLS members contacting individual Senators.

HB 1144 / SB 534, addressing well permits, includes section 301, which provides that the permit application shall be accompanied by a plat prepared by a Certified Professional in Erosion and Sedimentation Control. The bill passed the House 113 to 88 on May 25. I’m working with Senator Scott Hutchinson (R-21- Butler, Clarion, Forest, Venango and Warren), the prime sponsor, to offer the amendment removing certified professional in erosion and sedimentation control in favor of the licensed professional land surveyor.

SB 535 Amends Title 27 (Environmental 21-Resources) to establish the Advanced Permit Review Program to provide an expedited method through the use of qualified licensed professionals. This provides for the permit review procedure, the erosion and sediment control permit procedure, and the dam safety and waterway management permit procedure. The bill is sponsored by Senator Gene Yaw (R-23- Bradford, Lycoming, Sullivan, Susquehanna and Union) and is likely to move through the legislature but may face a veto by the Governor. The House and Senate chairs are supportive of this bill.

DEP Act 34 of 2020, alternate septic systems and Act 34 implementation appears to face no short term change. The Department of Environmental Protection (DEP) will continue to keep everything as it is for the next 2 to 3 years until it is time to revisit the regulations and act.

PSLS is exploring a Right-of-Entry bill. It will likely be an amendment to the Trespass Law 3503 and perhaps modeled after the West Virginia Law. I have discussed this issue with a few Senators and Representatives and PSLS will need to prepare a document to inform key legislators.

Moderated the kickoff event launching the bipartisan Construction Procurement Caucus in the House.

Secured a provision in the House Financial Services and General Government Funding bill for FY2022, prohibiting the General Services Administration (GSA) from awarding or facilitating the award of any contract for the provision of architectural, engineering, and related services including surveying and mapping in a manner inconsistent with the Brooks Act. Conducted a virtual Congressional “Day on the Hill” program in April.

JOB BOARD Surveying Faculty Position Open in Maryland The Community College of Baltimore County (CCBC) is seeking a licensed professional land surveyor to teach a variety of survey technology and civil engineering-related courses, as well as serve as the Survey Technology Program Coordinator within the CCBC Engineering Department. Licensed surveyor required. Licensure in the state of Maryland preferred. Out-of-state licensure is acceptable, pending acquisition of Maryland licensure within one (1) year of hire.

NSPS seeks applicants for Executive Director The National Society of Professional Surveyors (NSPS), based in Frederick, MD, is seeking letters of interest and credentials/resume from individuals wishing to be considered for the full-time position of Executive Director. The Executive Director operates as the Chief Executive Officer of the organization in conjunction with the elected Officers, the Executive Committee, and the Board of Directors. Applicants must have leadership experience in the workplace as well as within a professional society similar in nature to NSPS, in addition to experience working with a small staff in which all employees share responsibility for meeting the needs of the organization and its members. Preference will be given to candidates who hold a license as a Professional Land Surveyor in one or more states. Exceptional verbal and written communications skills are critical as is proficiency with Microsoft Office Suite. Experience in direct advocacy with regulatory entities, as well as governmental bodies and agencies (especially state and national), is also required. Ability to travel domestically with some international travel is required. Benefits include: 401(k), health insurance, vision and dental, paid holidays, vacation and sick leave. Must be willing to relocate to the Frederick, MD, vicinity. Individuals will be required to provide a valid Driver's License. Salary negotiable based on experience and qualifications.

GOOD DEEDS: NEW BRITAIN FOOD LARDER VOLUNTEERS DOTTIE AND BYRON RIMMER NAMED VOLUNTEERS OF THE YEAR BUCKS COUNTY COURIER TIMES The Bucks County Opportunity Council has chosen Dottie and Byron Rimmer as their Volunteers of the Year. The Rimmers supported the council's outreach mission through their work at the New Britain Baptist Church Food Larder for 20 years.

The Food Larder is a choice food pantry that allows individuals to choose items needed, rather than being issued the same items with each visit. Recently retired from the pantry, the Rimmers formed close relationships with individuals and understood the needs of the community.

The couple’s familiar presence made participants feel comfortable about receiving food donations, and the Rimmers often provided information about available assistance and connections to other resources throughout the county. Their dedication to feeding Bucks County residents in need shined through with their work.

"We want to thank the Rimmers for their dedication and persistence in the fight against hunger," the council said in a statement.

"Bucks County is lucky to have such dedicated volunteers in this community. We commend Dottie and Byron for their efforts and thank them for their service. They truly are heroes."
