THE farming community and industry bodies have applauded the Federal Government’s recent announcement it will introduce an effects test to address the misuse of market power as recommended by the Harper Competition Policy review.

Prime Minister Malcolm Turnbull and Treasurer Scott Morrison announced the effects test will be included in Section 46 of the Competition and Consumer Act 2010.

It will replace the existing ‘purpose test’ to shift the onus of consideration from a company’s purpose in undertaking conduct to the effects that conduct can have on competition.

The announcement comes after a number of industries mounted a fight for better

The National Farmers’ Federation (NFF) applauded the introduction of an effects test which it said will strengthen Australian competition law and rebalance power for primary producers across the agricultural supply chain.

NFF chief executive officer Tony Mahar said the effects test had been the subject of significant NFF advocacy efforts given its importance to building open and transparent marketplaces that facilitate high levels of competition.

Govt back flips on backpacker tax AFTER a strong campaign against increasing the tax rate for working holiday makers led by the National Farmers’ Federation (NFF), the Victorian Farmers Federation (VFF) and other farmer groups the Federal Government has agreed to review the idea.

Minister for Tourism Richard Colbeck said the government will look at other options that will avoid negative impacts on Australia’s backpacker intake after growers, industry groups and government members expressed serious concerns about the impact the tax would have on Australian industry.

NFF president Brent Finlay said he was heartened by the government’s acknowledgement of concern surrounding the tax, originally announced in last year’s Federal budget, and its willingness to examine viable alternatives.

“We welcome this commitment to review the proposed tax

which, if left unaddressed, will stifle agricultural productivity at a time when we should be looking to build upon the significant growth potential of our global markets,” he said.

“Since the announcement of this tax we have heard from primary producers from across the country who says this will damage both their businesses and their communities.

“At the core of this issue is the threat the tax poses to the ability of farmers to access a secure and reliable workforce – something which underpins our capacity to produce premium quality food and fibre at increasing volumes as dictated by surging demand for Australian product.

“We now look forward to continuing to play a key role in the review process and finding a workable solution that supports our primary producers in operating productive and profitable businesses that are a driver of the broader

economy,” Mr Finlay said.

VFF Horticulture vice president Emma Germano echoed Mr Finlay’s concerns and said the review is welcomed because the proposal of taxing backpackers 32.5 per cent on all income will have a major impact on the availability of labour.

“Backpackers provide a valuable source of labour for farmers who already face challenges in attracting seasonal labour,” she said.

“The government needs to realise the damage a new tax will cause to the agriculture sector industries and instead develop a solution that will benefit all stakeholders.”

More than 40,000 visa holders work in the agriculture industry each year and contribute about $3.5 billion to the Australian economy.

Ms Germano said that the NFF, VFF and others were advocating a fairer solution of 19 per cent tax on all income.

“We have always said that if backpackers want to work in Australia, they need to be taxed like the rest of us, but the government needs to be reasonable in its approach.

“We can’t expect backpackers to pay a tax rate of 32.5 per cent when an Australian resident next to them could be paying 13 per cent, because it is hard to explain and is a major disincentive on their productivity,” Ms Germano said.

Federal Member for Murray Sharman Stone said that her office had received numerous contacts from orchardists, abattoirs and packing sheds in the Goulburn Valley expressing concern about the impact of a potentially reduced labour supply for next season due to the original tax hike for backpackers.

“It has been so hard to employ dairy industry workers that a new special visa for dairy workers form overseas has now been introduced in response to

industry frustration with finding workers,” she said.

“The backpacker tax would not only impact on the agriculture sector it could also affect the tourism industry which also relies on overseas holiday maker workers.

“Backpackers who travel the country visiting many of our great tourist destinations also work in the hotels and bars across the nation.

“Backpackers are an important part of the seasonal labour supply in agriculture and we cannot afford to remove any incentives that encourage them to make Australia their working holiday destination,” Dr Stone said.

Not all industry groups’ welcomed the review with the Australian Workers’ Union (AWU) slamming the decision, with AWU national secretary Scott McDine stating the tax was important, not only as a revenue measure, but as a way for ensuring backpackers

were not used as a means of undercutting Australian jobs.

“Temporary foreign workers who come to Australia are often dangerously exploited, paid under the table at illegal rates, and used to undercut wages and conditions for working Australians,” he said.

“To be honest, backpackers probably won’t be too concerned about paying some tax if they have access to full award rates of pay, overtime payments, and other conditions of employment.

“Instead of worrying about how much tax temporary foreign workers pay, the business lobby would be better off telling their member organisation to give jobs to young Australians who are desperate to work.

“Rather than inching toward a generous tax cut for foreign workers, the government should be helping link young Australians for jobs at home,” Mr McDine said.

Minister finally announces members of livestock committees VFF, will return to the SGCAC. Recently, Leader of the Victorian Nationals and Shadow Minister for Agriculture Peter Walsh voiced concerns that the levy money generated through the livestock industry may be used to subsidise government projects instead of funding priority biosecurity measures.

“The Cattle and Sheep and Goat Compensation Funds are in place to ensure there is money available to livestock producers in the case of a major biosecurity outbreak,” he said.

“Some of the funds also go toward preventative biosecurity projects, as chosen by a committee of industry representatives.

“When questioned by The Nationals in parliament, the minister refused to rule out using the levy funds to subsidise her department’s costs.

“Something just doesn’t add up.

“Jaala Pulford must explain her intentions to livestock producers who are rightly concerned their levy money could be redirected to other projects – putting their industry’s biosecurity at risk,” Mr Walsh said.

When questioned in parliament by Member for Northern Victoria Damian Drum who asked Minister Pulford if she could rule out that the delays in announcing the committees was due to her plans to change the rules on how the industry levies can be used, Minister Pulford said that there are processes that take time to ensure the correct candidates are chosen.

“Indeed the chairs of these bodies are cabinet appointments, and so there is a process that does take some time to make sure that the candidates are selected, interviewed and properly appointed in accordance with the legislation that governs these arrangements,” she said.

“I can assure Mr Drum that these announcements will be made in the very near future and that he can park all his conspiracy theories back on the bench.”

After announcing the appointments to these committees, Minister Pulford said that it was important that she have highly credentialed industry advice to help guide decision making.

Wetlands proposed for closure during 2016 duck season THE State Government is set to close six wetlands to duck hunting this season to protect and provide refuge to threatened birds.

Johnsons Swamp State Game Reserve near Kerang, Heywoods Lake State Game Reserve at Boundary Bend and Round Lake at Lake Boga will be closed.

Johnsons Swamp will be closed for the first four weeks of the season due to a significant presence of Australasian Bittern which will be closely monitored, with the impact of hunting activity re-assessed in coming weeks.

Heywoods Lake, Round Lake and Lake Elizabeth State

Game Reserve near Kerang will be closed to duck hunting as surveys coordinated by the Department of Environment, Land, Water and Planning detected the presence of significant numbers of threatened Blue-billed ducks.

Kow Swamp near Gunbower and Reedy Lakes at Kerang will also be closed to reinforce their status as wildlife sanctuaries where hunting is prohibited.

duck hunters to participate in legitimate recreation.

“Any wetlands closed will continue to be monitored by government officials throughout the season and may be opened to hunting if circumstances change and the threatened birds move to other locations,” he said.

“It is possible other wetlands will be closed this season and hunters should ensure they are aware of these before hunting by checking the GMA website or calling 136 186.”

Hunters are also reminded to be on the lookout for bluegreen algae as popular hunting areas may be affected.

Mr Hyams said hunters should be aware that wetlands along the Murray Valley may be affected by blue-green algae, which should be avoided as it is potentially toxic and can be dangerous to both people and dogs if ingested.

He added that there is limited research in how ducks are affected by the algae, however, hunters should be cautious.

“As a precaution, hunters should discard the internal organs (particularly the liver) of ducks and rinse the duck with clean water prior to cooking and eating,” Mr Hyams said.

“The shift towards examining the effects of behaviour will mean a more objective measure to assess the impacts of misuse of market power and anticompetitive behaviour within the supply chain,” he said.

“While we do not view this as a silver bullet solution we do see it as an important tool to not only improve competitiveness, but also to drive innovation, productivity and profitability across the sector.

“The test, in conjunction with the appointment of Mick Keogh as the Australian Competition and Consumer Commission’s (ACCC) first Agricultural Commissioner, most certainly creates a more level playing field for all supply chain participants,” Mr Mahar said.

He added that agriculture has “burgeoning global opportunities” which will be a lead contributor to the national economy.

“The industry deserves to be positioned as an economic priority, including having a legal framework that facilitates growth and financial gain for all, starting at the very foundation of the sector – the primary producer,” he said.

Fruit and vegetable store owner Rick Aumann, who has run Fruits N’Fare in Benalla for

the past 21 years, said he will not believe the effects test will come to fruition until he sees it.

“The government can’t control the supermarkets on anything, so why would they be able to enforce this?

“I mean, don’t get me wrong, it sounds good and I hope it happens, but there are not a lot of fruit and vegetable shops around anymore as they have been priced out of the market,” Mr Aumann said.

The former shearer said that after 27 years in the industry running a very successful business, he has seen profits “go backward” over the past five years due to the opening of a nearby Aldi supermarket.

“We sell everything, all year round and we have a better range than the big supermarket chains, but I don’t have the capacity to just slash prices to unrealistic levels,” he said.

Australia’s largest tomato processing company, Echucabased Kagome Australia’s chief executive officer John Brady said that anything that helps level the playing field for primary producers is a plus.

“As our country moves from mining to dining and we start to utilise the amazing resources that we have for ourselves and for overseas markets it is important that the government starts to get

involved and do something about it.

“Evening out the playing field, particularly in regards to food is necessary and having the government actually taking some action is imperative,” Mr Brady said.

AUSVEG deputy chief executive officer Andrew White said that the reform is long overdue for Australia’s vegetable and potato growers.

“Many of these growers are small business owners that will now be better protected by rules that take into account the conduct of those with market power,” he said.

“It is essential that our growers are protected against anticompetitive behaviour and that there are adequate provisions in place for them to operate their business profitability so that the local industry can remain economically viable in the future,” Mr White said.

He added that in an environment where growers are struggling to remain profitable due to rising production costs and tighter profit margins, it is important that they can operate their businesses without any extra and unfair pressure that comes from the misuse of market power by other operators in the supply chain.

“Giving the ACCC the

authority to take action against those who are found to be abusing market power is reassuring news for our growers.

“Considering the Australian vegetable and potato industries contribute significantly to the national economy and employ tens of thousands of workers across the country, it is vital to ensure that our growers can conduct their businesses in a fair environment and are protected from those who participate in anti-competitive behaviour,” Mr White said.

Australian Dairy Farmers (ADF) president Simone Jollife said the effects test is another tool to help provide integrity and transparency regarding the impact of retailer actions on their suppliers.

“In conjunction with the government’s introduction of the Food and Grocery Code, which included a large number of ADF’s recommendations, this is a constructive step toward fostering a more competitive business environment,” she said.

“Moving toward a more objective measure to assess the impact of anti-competitive behaviour will build a more open and transparent marketplace.”

ADF is hopeful that this will assist in preventing damaging practices, including predatory pricing in the future.

Farmers happy with Port deal VICTORIAN farmers are pleased that after many months, both sides of politics have ďŹ nally agreed to a deal on the sale of the Port of Melbourne lease which will be privatised after legislation was recently passed through State Parliament.

The legislation was passed after months of negotiations between the major political parties on what compensation should be paid to the new owners if a second port was built.

Victorian Farmers Federation (VFF) president Peter Tuohey said the deal delivers a clear commitment to ensuring 10 per cent of the port proceeds goes to rural and regional Victoria through the establishment of a Victorian Transport Fund. “The Andrews Government has already committed $200 million to the Agriculture Infrastructure and Jobs Fund, so it’s great to see even

more money committed to rural infrastructure from the Victorian Transport Fund,â€? he said. “It’s great to see both the government and coalition agree with the VFF’s stance that a fair share of the port revenue goes into agricultural infrastructure, given food and ďŹ bre exports dominate the port throughput.â€?

Mr Tuohey added that the VFF was looking forward to working with the State Government on identifying priority projects, many of which desperately needed funding. “In agriculture we need infrastructure investments in irrigation modernisation, pipelines to secure water for livestock producers, freight rail line upgrades, the elimination of mobile phone black spots and a raft of other projects,�

Mr Tuohey said. “Our support of the sale has always depended on the State Government ensuring these issues

are addressed and the port remains competitive.�

Mr Walsh said. “Daniel Andrew’s proposal to send 97 per cent of the port sale proceeds to level crossing projects in Melbourne was not a fair deal. “We will not accept the scraps off the table thrown to regional Victorians by the Andrews Government. “In those amendments (to the Delivering Victorian Infrastructure Port of Melbourne Lease Transaction Bill 2015) we have secured 10 per cent of port sale proceeds – or up $700 million – for transport

infrastructure projects in regional Victoria,� he said.

Victorian Leader of the Liberal Party Matthew Guy said that the proposed amended Bill does not preclude the development of a second container port for Victoria after the adaption of a “reasonable compensation regimeâ€? capped to the ďŹ rst 15 years. “The Liberal Nationals have spent months ensuring the best deal possible for business, agricultural producers and consumers – both today and future generations,â€? he said. “The process engaged by the Upper House inquiry last year bought many critical issues to the attention of the Parliament. “It is this evidence that has guided the Liberal Nationals position and as such, this evidence that has produced what is now a workable, reasonable outcome,â€? Mr Guy said.

It is expected that the Port will be sold by the end of the year.

Passion for Merino breed snares award AFTER two solid days of judging across North East Victoria, the 2016 McLennan-McColl Flock of the year champion has been awarded to Robert and Tim Hayes of Tarcombe Herefords.

The winning 1500 hectare property at Ruffy is home to 2500 Merino ewes which are run alongside the family’s registered Hereford cows.

Robert Hayes said that he, along with his family including wife Jan, son Tim and daughter-in-law Cindy, were all thrilled to have won the award.

“We are passionate about Australian wool and promoting the strength of the industry to the upcoming agricultural youth,” he said.

“We are pleased to show our sheep and promote the Merino breed and it is a great honour to receive the award.

“A big thank you must go to Rex Bennett of Elders Rural Services for his support, RASV, Merino Victoria and all sponsors for promoting the Merino sheep,” Mr Hayes said.

DEPUTY Prime Minister and Minister for Agriculture and Water Resources, Barnaby Joyce knows he has a tough battle ahead to retain the seat of New England, but said he still has plenty he wants to fight for.

At a recent press conference held in Tamworth, Mr Joyce said the good news is that recent Ipsos and Fairfax polls indicate that the Coalition would win if the election was held now, but the bad news is that the seat of New England would be won by Independent Tony Windsor.

“It’s quite obvious, and a statement of the bleeding obvious, that from the office of the Deputy Prime Minister, you’ve got a vastly better chance of getting through the important issues of New England than as a backbencher in what will, for all intents and purposes, be the opposition,” he said.

“This is going to be, as I always thought, an incredibly

tough campaign.

“I have never shied away from a political battle.

“I remember when I was in the Senate and had basically a safe seat and a safe job, I resigned from that and basically went on the unemployment queue to come down here because I believe in the people of the New England, I believe in coming home.

“It doesn’t really concern me that I put it all on the line again,” Minister Joyce said.

He said that has a strong desire to ensure that prime agricultural land is protected, particularly in relation to the BHP Caroona mine, which falls in the New England electorate.

“That mine would be a real threat and we don’t want a mine on prime agricultural land,” he said.

He added that he would make sure that the upcoming election be about delivery, mainly the delivery of jobs.

Support for drought welcomed, but VFF wants more grim across the state.

“This funding will help our farmers deal with the impacts of drought and the ongoing dry that’s undermining the carrying capacity of many farms as they face repeated seasons of low rainfall and stock water shortages,” he said.

“However, the VFF will continue to lobby the government to deliver more support, especially for water tanks and emergency piping to deliver stock and domestic water, as well as funds for water carting,” Mr Tuohey said.

He added that water corporations are doing what they can to find alternative

supplies, but ultimately many farmers face having to cart water, rather than risk watering stock with contaminated supplies like the current toxic blue-green algal blooms that are in the Murray River.

Mr Tuohey said the VFF is arguing the government should be ensuring that water is made available to farmers, free of charge, at standpipes in drought affected areas.

“While cartage – fuel and driver time – is the greatest cost, we’d like to see the government working with water corporations to ensure farmers don’t have to pay for the actual water,” Mr Tuohey said.

In recent years we have purchased another 300 acres on two neighbouring properties to provide agistment for young stock and provide extra home grown feed.

We are just finalising a development project on 200 of these acres installing a lateral irrigator and lasered bays to maximise production.

You will find no feed wagons or feed pads on the farm as we are still a pasture and hay-based feed system with grain and proteins provided through the dairy.

How long have you been a farmer?

I have always loved farming, always preferring to drive a tractor for the day than go to school.

I left school in 1988 to work on our home farm at Katunga and then this Yalca property once purchased.

Lisa and I have been together since 1995, marrying in the year 2000 and grew our family with Dylan arriving in

After many years of sleepless nights irrigating we are now blessed with a fast flow automated irrigation system which Lisa is now in control of, as computers and I don’t get along.

So now she can boast that she does all the irrigating, hence only from the cool office and not on the four wheeler in the middle of the night with bugs in her eyes.

Dylan and Lily are now in year 9 and year 7 at Goulburn Valley Grammar School, respectively.

Both are involved in local sporting groups in Waaia and Katunga.

Lily has a keen interest in the cows and Dylan has just started assisting with tractor work on farm.

This has become more of an interest lately, as typical teenagers the monetary benefit is a motivator.

Best advice or farming tip you have received?

You get out of life what you put into it.

I have been very lucky to have a hard working and successful farming family, who have always provided advice and support.

Describe your perfect day?

A day where nothing goes wrong - very rare on a dairy farm.

What is the best thing about being a farmer?

Being able to watch our children grow and have the flexibility to attend sports days and involve them in our working life on a daily basis.

Everyone aspires to be their own boss and in control of their own destiny and farming allows this independence.

What is the worst thing about being a farmer?

Not being in control of the value of the product we produce – it is a seven days a week, 24 hour a day, 365 days a year job.

If you could be someone else for the day, who would it be and why?

Eddie McGuire - I admire his hard work, ambition and passion.

I’m a morning person, so a few hours on breakfast radio followed by a day surrounded by the Collingwood Football Club and Melbourne Stars Cricket Team would be easy to take.

Water security on a knife’s edge for rural towns THE Murray Darling Basin Authority sent out a media release recently stating that flows along the Murray River are expected to vary downstream of the junction with the Goulburn River as environmental water moves through the river this autumn.

It also informed its recipients that the pulse of environmental water is expected to raise river levels noticeably in the Echuca district for about two weeks while the water leaves the Goulburn River and enters the Murray.

“The autumn pulse will use water from the Victorian Environmental Water Holders and the Commonwealth Environmental Water Holder (CEWH), and deliver benefits through the Goulburn River and along the Murray River, all the way to the Coorong and Lower Lakes.

“It will also include water traded from the Goulburn Valley to the Murray River,” the release stated.

CEWH would be the situation for Lower Lakes SA. A report commissioned by the Australian Bureau of Statistics highlights irrigation development for the cotton and nut (almond and walnut) industries.

What is proposed for the 2017/2018 growing year is 15,000 hectares of nuts and triple acreage for cotton.

This demand, as indicated in the report, could push temporary water to $350 per megalitre.

Farmers need to be aware that combined CEWH releases and the nut and cotton demand will make it very difficult to buy temporary water in the future.

The report also shows a capital gain of close to 10 per cent per annum.

I suggest farmers need to secure their water requirements with carryover for 2016-2017.

Furthermore, the farmer needs to control inputs with a long-term goal of holding enough high security water in Victoria or general security in NSW to enable our future food and fibre production.

THE dates for 2017 Beef Week have been announced with the event starting in East Gippsland on Friday, January 27 and ending in north east Riverina on Saturday, February 4.

Beef Week director Geoff Phillips said the nine Beef Week days are adjusted each year to avoid clashes with other events and to act as a prelude to the busy on-property bull selling season that begins mid-February.

“The event continues to grow in importance with a focus on bull sales with one of the bulls on display this year selling for $110,000 a couple of weeks later at the stud’s annual sale.

“Whether studs produce 10 bulls or 300 bulls a year, Beef

homozygous, 920 kilogram, apricot coloured bull by the US super sire Hunt Mr Jock 44J from the elite donor female Ramomie Abigail U2.

Forty-nine out of the 54 bulls offered sold to the top of $29,000 at an average of $7602.

There was a limited demand for the Limflex bulls the stud had on offer, with seven bulls sold, with the top three selling for $4000.

Fifty-one registered bidders competed strongly for Winchelseabased Murdeduke Angus’ 2016 offering of 62 bulls.

The stud managed a 100 per cent clearance after three bulls that were passed in sold straight after the sale.

The top price paid was $16,500 for Lot 20 CSWK18, with an average of $6215.

Landmark livestock manager for Victoria and Tasmania Ray Atwell who was bidding on behalf of first time buyers from Latrobe Park Angus is Gippsland said his clients were keen to buy a son of Murdeduke Emperor, but having missed out on the two top priced bulls, purchased Murdeduke Kacey K168 for $8000.

Murdeduke stud principal Lachie Wilson said the loyal support received from their clients is “fantastic and we want to thank them for it”.

“We sold an extra 10 bulls, achieved a new top price and an $800 increase in average on last year, in spite of what can only be described as horrible seasonal conditions,” Mr Wilson said.

STUD cattle breeders from around south eastern Australia have reported outstanding results at their annual autumn on-property sales for 2016 despite the prolonged dry putting a strain on paddock feed resources.

Among the biggest studs were Mortlake-based Banquet Angus stud of the Branson family and the Gubbins family’s Te Mania Angus Stud.

Stephen and Noeleen Branson from Banquet Angus said the recent sale was the best ever, which was preceded by the sale of 150 PTIC heifers of Banquet blood and in calf to Banquet bulls.

Although Mr Branson said the top price of $21,000 for a bull was moderate, the average of $8,868 was a $494 increase on last year and a record for Banquet.

There were 107 registered bidders from five states and New Zealand, bidding on 97 bulls for a total clearance.

The top priced bull was purchased by Paul Hawkins from Elm Grove Cattle Co. in Llangothlin, NSW, with the second top price of $20,000 paid by Richard Waderson from RCW (Vic) Pty Ltd in Shepparton.

Preceding the Banquet bull sale, Margaret and Robbie Patterson of Drysdale Estates at Mortlake offered 150 PTIC Angus heifers by Banquet bulls in calf to Banquet bulls.

These sold at a top price of $2700 for and average of $2411.67, and a gross of about $361,750.

The average price paid was about $400 above other market prices for similar aged and status heifers.

The renowned Te Mania Angus stud with co-principals Tom Gubbins and Hamish McFarlane, also at Mortlake, presented its annual drafts of females and bulls, with 566 commercial females offered online the evening before the bulls.

A pen of 14 ACR registered 30-month old cows sold, with the top price reaching $2220.

Altogether, 540 of the offering of females sold at the on-line auction.

The annual bull sale the following day had a large contingent of buyers attend, including 58 logged on through AuctionPlus which bid on the 133 bulls on offer.

Infection of the naval will often result in first a pussy discharge from the naval and can progress to swelling of the surrounding tissues or abscess formation around 1-2 weeks of age. In some cases bacteria can spread in the blood supply via the umbilical vessels. This will result in a calf that is dull, inappetent and unthrifty.

One of the common places for bacteria and infection to spread to is the joints. This condition is termed â&#x20AC;&#x2DC;joint illâ&#x20AC;&#x2122; and can affect single or multiple joints. Joint infections are very serious and can lead to irreversible damage to the cartilage. A calf with joint ill will often have large, warm, swollen joints and may be lame or just completely unable to rise. The prognosis for joint ill is poor so the emphasis should be on prevention.

The umbilicus (or naval) in calves is what remains of the connection between the placenta (via the umbilical cord) to the calf after they are separated at birth. Amongst other structures the umbilicus contains the umbilical artery and vein that previously connected the calves blood supply to that of the mother.

When calves are born the umbilical stump remains wet for a period of time which can mean that an infection can develop as the stump can act as a wick up which bacteria can travel. This risk is increased particularly if calves are born or housed in wet conditions or housed in muddy or soiled beddings.

Behaviours such as fellow calves suckling on the naval can also act as a risk factor for infection to develop. Poor colostrum consumption can also be a contributing factor to the development of infection.

solution (such as an iodine solution) should be applied to the naval soon after birth.

Ensuring adequate colostrum consumption is also a key component for prevention.
