WIRE FRAUD ALERT THINK DIFFERENTLY

Email-based, real estate fraud schemes are on the rise. One common scenario is altering wiring instructions with the intention of rerouting funds.

Keeping this in mind, First American Title is changing the way we receive payment information. It is imperative that we are familiar with the people in our transactions.

RELYING ON EMAIL ALONE IS NO LONGER AN OPTION.

Fraudsters often use email to send falsified wire instructions to unsuspecting victims. Please warn your buyers and sellers to only follow wire instructions they receive personally from First American Title.

Additionally, we will not accept disbursement instructions for seller or buyer funds via email OR from any third party (attorney, real estate agent, etc).

ALTERNATIVE INSTRUCTIONS?

If your buyer or seller receives alternative wiring instructions that appear to be from First American Title, make sure they contact their escrow officer at a trusted phone number for confirmation.

Know that our wiring instructions do not change so any communication is suspect. Our banking institution is First American Trust.

IN SHORT – wire instructions will not be accepted by email. New wire instructions must be hand-carried or uploaded to the First American Secure Portal.

14. Mortgagçes

14.0 The violation of any prcvisions, covenants, conditions or restrictions contained in this Declaration shall not restrict, impair or defeat the lien of any mortgage or deed of trust now existing or hereafter made in good faith and for value on any of the Parcels, or part thereof, or restrict, inpair or defeat any right or power of sale contained therein or linit or prevent the forecicsure thereof; provided, however, that any subseguent owner of any of the Parcels, or part thereof, whose ownership was obtained by foreclosure, trustee's sale or conveyance in lieu, shall thereupon be subject to and bound by all of the provisions of this Declaration.

15. Validity

15.0 The invalidity of any provision of this Declaraticn or any portion hereof, shall not be deemed to impair or affect in any manner the validity, enforceability or effect of the remainder of this Declaration and, in such event, all of the other provisions of this Declaration shall continue in full force and effect as if such invalid provision had never been included herein.

16. Successors and Assigns

16.0 This Declaration, the terns and provisions herecf and amendments thereto shall run with the land, and shail be bindiag upon, enforceable against, and inure to the benefit of all parties having or acquiring any right, title or interest in the Parcels including, without limitation, the Declaran:, all owners of the Parcels. all lessees, and the respective successors, assigns, heirs and personal representatives of all such parties. Nothing herein shall b construed as prohibiting an owner fron transferring any portion of his Parcel in accordance with law provided that any such successor in interest shall likewise be bound by the provisions hereof in relation to acreage owned.

17.0 In the event of any conflict between the provisions of this Declaration, the Ey-Laws and the rules and regulations pro-

rulgated by the Association, the order of precedence shall be as Follows: (1) Dcclaration; (2) y-haws; and (3) Rules and Rogelations.
