El juez deberá evaluar con mayor rigor si el acto reclamado afecta realmente derechos fundamentales y si suspender la obra sería contrario al interés social o al orden público. En la práctica, esto reducirá drásticamente la posibilidad de frenar proyectos mediante amparos cautelares, lo que afecta de manera directa al mercado inmobiliario, sobre todo en destinos turísticos donde existe alta presión por los recursos naturales y por el desarrollo de nuevos complejos habitacionales y turísticos.

Para desarrolladores, la reforma implica un cambio de reglas contundente. Ya no bastará con obtener permisos superficiales o tramitar autorizaciones de manera acelerada: cualquier irregularidad que antes podía derivar en una suspensión temporal ahora podría no detener la obra, pero sí volverse un riesgo serio una vez que se dicte sentencia de fondo.

Esto obliga a los desarrolladores a reforzar sus expedientes técnicos, ambientales y urbanos, incluyendo estudios de impacto, consultas comunitarias, CONTINUA PÁGINA 10

dictámenes de protección civil, acreditación de propiedad y análisis de compatibilidad con planes de desarrollo. Un proyecto que avance con documentos deficientes podría construir durante meses sin obstáculos, pero enfrentarse más tarde a órdenes de demolición, sanciones, revocaciones de permisos o pagos millonarios por daños.

Por ello, la reforma no reduce el riesgo jurídico: lo desplaza hacia etapas posteriores, lo que vuelve imprescindible una planeación robusta desde el inicio.

Para compradores — especialmente aquellos interesados en propiedades frente al mar— la nueva Ley de Amparo exige una mayor disciplina antes de invertir. Si antes una comunidad o un tercero podía detener una obra en lo que se resolvía un litigio, ahora la obra podría continuar incluso si existen dudas sobre su legalidad.

Esto puede traducirse en riesgos patrimoniales: un desarrollo que avance sin suspensión judicial podría ofrecer preventas, vender unidades y levantar infraestructura que, posteriormente, sea declarada

ilegal. Por ello, los compradores tendrán que apoyarse en due diligence más completos: revisar la cadena de propiedad, permisos de construcción, licencias ambientales, régimen de propiedad en playa (concesiones, ZOFEMAT), antecedentes de litigios y cumplimiento normativo.

Para los vendedores y agentes inmobiliarios, la responsabilidad también crece: deberán brindar información clara, certificada y verificable, ya que cualquier ocultamiento o error podría generar reclamaciones futuras ante

Now, even if a project contains irregularities, it may continue during the litigation process—only to face severe consequences if the final judgment rules against it. This expands the risk horizon: instead of being stopped early, a project could build infrastructure, sell units, and invest capital before later being subject to demolition orders, revocations of licenses, fines, or environmental restoration obligations. As a result, developers in coastal markets must strengthen their technical, environmental, and urban-planning files, including impact studies, consultations with local communities, property-title verification, and compliance with shoreline and ZOFEMAT regulations.

Buyers—particularly those investing in beachfront properties—must now exercise increased caution. Without the automatic possibility of stopping construction through a suspension, a buyer could unknowingly invest in a project CONTINUES PAGE 10

Esta figura, que permitía a colectivos ambientales, ciudadanos y organizaciones civiles interponer amparos para detener obras potencialmente dañinas, queda ahora más acotada: solo quienes demuestren una afectación directa podrán acudir a esta vía. En zonas de playa —donde convergen comunidades locales, ejidos, hoteles, desarrolladores y autoridades— este cambio reducirá el número de amparos colectivos, pero también podría debilitar la protección ambiental preventiva. Sin la posibilidad de suspender obras con facilidad, proyectos con impacto en manglares, dunas, esteros o áreas de anidación podrían avanzar hasta que un juez dicte sentencia, lo cual, en ecosistemas frágiles, puede equivaler a daños irreversibles. Por ello, la presión recae ahora más en los mecanismos de consulta, en la transparencia de las autoridades y en la vigilancia social previa al inicio de cualquier proyecto.

En términos económicos, la reforma genera un doble efecto. Por un lado, otorga certidumbre a inversionistas que han sido históricamente afectados por amparos que detenían obras durante meses o años. Con reglas más estrictas, los proyectos técnicamente bien preparados tendrán menos riesgo de parálisis. Pero, por otro lado, eleva los costos legales y de cumplimiento para todos los participantes: desarrolladores deberán invertir más en auditorías jurídicas y ambientales; compradores deberán contratar más asesoría especializada; y vendedores tendrán que demostrar con mayor claridad la legalidad del producto inmobiliario que ofrecen. En destinos de playa como Los Cabos, Riviera Nayarit, Puerto Vallarta, Tulum o la Costa Alegre, donde la presión por el suelo y la sensibilidad ambiental son especialmente altas, esta reforma no solo ajusta un procedimiento legal: redefine completamente la manera de planear, aprobar, comercializar y defender un proyecto.

En conclusión, la nueva Ley de Amparo inaugura una etapa en la que la prevención será más valiosa que la litigación. Los desarrollos que actúen con transparencia, documentación sólida y consultas desde etapas tempranas serán los grandes beneficiados. Quienes busquen avanzar con permisos débiles o procesos deficientes enfrentarán un escenario más incierto y costoso.

Para compradores, vendedores y desarrolladores, especialmente en zonas de playa, esta reforma obliga a trabajar con mayor rigor jurídico y ambiental, porque en este nuevo México inmobiliario, los errores ya no se detienen con una suspensión: se pagan al final, y con intereses.

This makes thorough due diligence essential: reviewing title chains, environmental permits, land-use authorizations, zoning, litigation history, and concession status. Sellers and real estate agents will also bear greater responsibility; transparency and verifiable documentation will be fundamental to protect both clients and professionals from future liability.

A pivotal aspect of the reform is the redefinition of “legitimate interest.” Previously, environmental groups and civil organizations could file amparos to stop works that threatened ecosystems or community rights. Under the new framework, only those who demonstrate a direct, personal impact may file such challenges. In coastal regions—where ejidos, private owners, hotel groups, and local populations often coexist—this significantly reduces the reach of collective protections.

Although the reform accelerates project timelines, it may weaken preventive environmental defense. Without the possibility of obtaining quick suspensions, fragile ecosystems such as mangroves, dunes, wetlands, and turtle-nesting areas may suffer irreversible damage before a court issues a final decision. This makes early community engagement, transparent permitting, and rigorous environmental compliance more crucial than ever.

Economically, the reform creates a mixed landscape. On the positive side, it provides greater certainty for well-structured developments, reducing the threat of long delays caused by injunctions.

However, it increases transaction costs across the real estate chain: developers must invest more in legal compliance, buyers must perform more comprehensive due diligence, and sellers must ensure all property documentation is accurate and defensible. In coastal destinations such as Los Cabos, Puerto Vallarta, Riviera Nayarit, Tulum, and Costa Alegre—where land values are high and environmental oversight is strict—the reform reshapes how projects are planned, approved, marketed, and protected.

Ultimately, the new Amparo Law signals a shift toward prevention rather than reaction. The projects that will thrive under this framework are those built on transparency, robust documentation, strong community relations, and full regulatory compliance. Those attempting shortcuts may progress during construction but face costly consequences later.

For buyers, sellers, and developers in Mexico’s coastal real estate markets, this reform redefines not only the legal landscape but the entire approach to investment, development, and long-term risk.

a arquitectura, por definición, es una disciplina de rigidez.

Lucha contra la gravedad, exige estructuras firmes y, durante siglos, se rindió ante la línea recta. Pero Frank Gehry, quien falleció el pasado 5 de diciembre en Santa Monica a los 96 años, nunca estuvo interesado en la rigidez. Él estaba interesado en el movimiento.

Al mirar atrás a sus casi ocho décadas de carrera, es fácil perderse en la hipérbole, pero en el caso de Gehry, la realidad es lo suficientemente asombrosa. rchitecture, by definition, is a discipline of rigidity. It fights gravity, demands firm structures, and for centuries, surrendered to the straight line.

But Frank Gehry, who passed away on December 5th in Santa Monica at the age of 96, was never interested in rigidity. He was interested in movement.

Looking back at his nearly eight-decade career, it is easy to get lost in hyperbole, but in Gehry’s case, the reality is astounding enough. He didn’t just design buildings; he designed a new way to build and perceive cities. With his departure, the world loses not CONTINUES PAGE 14

While Modernism preached purity and Postmodernism played with historical irony, Gehry declared: “Construction is raw, life is chaotic—let’s celebrate that.” It was the dawn of Deconstructivism, though he never wanted to carry the “ism.” That house taught us that architecture could be a collage, a three-dimensional sketch that never quite dries.

De la cerca de alambre al Titanio Para entender a Gehry, hay que olvidar el brillo del Guggenheim por un momento y volver a 1978, a una esquina suburbana en Santa Monica.

Allí, Gehry tomó un bungalow rosado de estilo colonial holandés y lo “explotó”. Lo envolvió en materiales “baratos”: madera contrachapada sin tratar, metal corrugado y, lo más impactante, cercas de alambre.

Esa casa fue un manifiesto.

Mientras el modernismo predicaba la pureza y el posmodernismo jugaba con la ironía histórica, Gehry decía: “La construcción es cruda, la vida es caótica, celebremos eso”. From Chain-Link to Titanium

To understand Gehry, one must look past the glimmer of the Guggenheim for a moment and return

to 1978, to a suburban corner in Santa Monica. There, Gehry took a pink Dutch Colonial bungalow and effectively “exploded” it. He wrapped it in “cheap” materials: raw plywood, corrugated metal, and, most shockingly, chain-link fencing.

That house was a manifesto.

If Santa Monica was his laboratory, Bilbao was his consecration. When the Guggenheim Museum opened in 1997, it changed the global economics of cultural tourism overnight.

Before Gehry, museums were neutral boxes for storing art. Gehry demonstrated that the building could be the work of art. The titanium curves, evoking ships and fish (a recurring obsession in his work), were not mere aesthetic whims; they were technical feats achieved thanks to CATIA, software designed for aviation that CONTINUES PAGE 16

Antes de Gehry, los museos eran cajas neutras para guardar arte. Gehry demostró que el edificio podía ser la obra de arte. Aquí, la exuberancia exterior de acero inoxidable sirve a un propósito interior sagrado. A diferencia de la frialdad de algunos auditorios modernos, el interior del Disney Hall, forrado en abeto Douglas, se siente cálido, íntimo, casi como estar dentro de un violonchelo. Gehry entendía que la arquitectura, al final del día, es para las personas. Creaba espacios que te abrazaban, incluso si por fuera parecían estar a punto de despegar.

Más allá de la forma

A lo largo de los años, se le acusó de ser repetitivo, de “arrugar papel” y convertirlo en edificios. Esa es una lectura superficial. Si observamos obras como la Casa Danzante en Praga o la Fundación Louis Vuitton en París, vemos una sensibilidad profunda por el entorno.

La Casa Danzante no es solo un edificio extraño; es un diálogo con el barroco y el art nouveau de Praga, una pareja bailando (Fred y Ginger) en una esquina bombardeada durante la guerra. Es historia cicatrizada con humor y gracia.

Un legado inconcluso

Frank Gehry trabajó hasta el final. Su longevidad creativa fue inaudita. Nos deja un legado que va más allá de las formas esculturales; nos deja la libertad. Él liberó a los arquitectos del miedo a la imperfección y a los ingenieros del miedo a lo imposible.

Many critics argue, and I concur, that his masterpiece is not in Spain, but in Los Angeles.

The Walt Disney Concert Hall (completed in 2003) is perhaps his most resolved building.

Here, the exterior exuberance of stainless steel serves a sacred interior purpose. Unlike the coldness of some modern auditoriums, the interior of the Disney Hall, lined in Douglas fir, feels warm, intimate, almost like being inside a cello. Gehry understood that architecture, at the end of the day, is for people. He created spaces that embraced you, even if on the outside they looked ready to take flight.

Beyond Form

Over the years, he was accused of being repetitive, of “crumpling paper” and turning it into buildings. That is a superficial reading. If we look at works like the Dancing House in Prague or the Louis Vuitton Foundation in Paris, we see a deep sensitivity to the environment.

The Dancing House is not just a strange building; it is a dialogue with Prague’s Baroque and Art Nouveau history, a couple dancing (Fred and Ginger) on a corner bombed during the war. It is history healed with humor and grace.

An Unfinished Legacy

Frank Gehry worked until the very end.

His creative longevity was unheard of. He leaves us a legacy that goes beyond sculptural forms; he leaves us freedom. He liberated architects from the fear of imperfection and engineers from the fear of the impossible.

In a world trending increasingly toward algorithmic efficiency and generic glass boxes, we will deeply miss his controlled disorder.

Frank Gehry taught us that buildings can have feelings, and that if we listen closely, steel can also cry, laugh, and dance.

orque ser “famoso en Facebook” no siempre significa estar cualificado, y qué es lo que realmente importa al elegir un agente inmobiliario en México.

Casi a diario sucede: alguien que llega a Vallarta pregunta en alguno de los muchos grupos útiles de Facebook: “¿Alguien me puede recomendar un buen agente inmobiliario?”.

En cuestión de minutos, se desata la avalancha. Llegan decenas, a veces cientos, de respuestas, generalmente con los mismos nombres repetidos una y otra vez.

Si la publicación incluye preguntas adicionales, rara vez se responden más allá de la recomendación del agente inmobiliario. Y aquí radica mi problema: casi nadie se detiene a preguntar qué es lo que realmente pregunta quien publicó el mensaje original. ¿Están comprando o vendiendo? ¿Es para uso residencial o comercial? ¿Buscan vistas al mar, una zona con fácil acceso a pie, ingresos por alquiler o privacidad en la selva? ¿Necesitan a alguien que hable inglés o español con fluidez, o que conozca el proceso de certificación AMPI en México?

hy “Facebook-famous” doesn’t always mean qualified—and what really matters when choosing a real estate agent in Mexico.

It happens nearly every day: A newcomer posts a question in one of Vallarta’s dozens of helpful Facebook groups asking, “Can anyone recommend a good realtor?”

Within minutes, the floodgates open.

Dozens, sometimes hundreds of replies roll in, usually with the same handful of names being repeated over and over again.

If there’s additional questions in the post, they are rarely answered beyond the realtor referral. And here’s the problem I have with this: Almost no one stops to ask what the original poster is actually asking.

Are they buying or selling? Is this for residential or commercial? Are they looking for ocean views, walkability, rental income, or privacy in the jungle? Do they need someone who speaks English or Spanish fluently, or who understands the AMPI-certified process in Mexico?

Puerto Vallarta isn’t just one real estate market, it’s many. Each neighborhood has its own rhythm, pricing, zoning, clientele, and quirks. An agent who’s a top producer in Marina Vallarta may have never set foot in Bucerias. A condo specialist might know little about raw land deals in Sayulita or commercial property sales in Nuevo Vallarta.

Key Considerations:

Location-specific expertise: Know the areas your agent actively works in.

Property type: Not all agents are trained in commercial, business, land, pre-construction, or multi-unit sales.

Legal literacy: Can they explain Fideicomisos, capital gains, closing costs, and AMPI regulations? Many are not well-trained for Mexican law and often use legal terms (in their offer contract for example) from their own country, where they may also be a realtor. This kind of situation crops up a lot, I’ve noticed, especially when working with Canadian and USlicensed realtors trying to also do business down here.

What to Look for in a Qualified Realtor in Puerto Vallarta

Before choosing an agent based on social media praise, or their licensing in your home country, ask for and verify, the following: Are they AMPI-certified or affiliated with the Mexican equivalent of NAR or CREA? Do they seem knowledgeable

Antes de que se cargue la primera caja, su mascota ya ha detectado la anomalía. If this is not possible, the pet must remain in their safe room with the door closed, and it is essential to place a warning note for the movers. In the case of cats, they should be confined to this room or, even better, inside their carrier in a quiet, dark bathroom or closet. For dogs, keeping them leashed or in their carrier is safest, especially if combined with a long, exhausting walk first thing in the morning to help them relax. It is crucial that the pet wears a collar with updated identification (phone and, if possible, the new address) and, to prevent anxiety-related motion sickness and vomiting, large meals should be avoided just before or during the transfer.
