En cuanto puede, escapa de su lujoso hotel para ir al centro vallartense. Le encanta este lugar: “con sus calles empedradas, el mar y las montañas conviviendo en un paisaje maravilloso, en uno de los lugares más bonitos del país. La comida, con gran sabor a México. Caminar a lo largo del Malecón, junto al mar y admirar la bahía.”

El centro vallartense es orgullo de una de las pocas poblaciones mexicanas de playa que conserva una identidad propia y tradicional, mientras resiste los embates de la modernidad. El Malecón: el mar en primera fila

El famoso Malecón es parte fundamental del área. Es un agradable andador que data de la década del 30 del siglo pasado y antes era circulado por automóviles. Desde hace unos años, fue convertido en una avenida peatonal que mide cerca de un kilómetro y va desde el hotel Rosita, en el norte, hasta el anfiteatro de Los Arcos, justo frente a la Plaza de Armas.

El Malecón es muchas cosas. Por ejemplo, un museo aire libre con notables esculturas de artistas mexicanos y foráneos. Cuenta con una agradecible cantidad y variedad de negocios como tiendas de recuerdos, cafés, heladerías, joyerías, bares y restaurantes... Desde este privilegiado sitio se pueden tomar fotos de la Bahía y gozar de las puestas de Sol que tanta fama dan a esta costa. Uno está en primera fila para disfrutar el espectáculo del océano Pacífico y el cielo, apenas interrumpido por botes, veleros y lanchas; mientras que, en el lado contrario, al oriente, así como al sur, las montañas de la Sierra Madre Occidental complementan el paisaje con su majestuosidad y exuberancia.

La vida pausada y relajada del centro se vive en sus calles empedradas. Uno debe dedicar tiempo para recorrer sus avenidas y calles, en algunos casos deberá subir algunos escalones para conocer rincones fabulosos y disfrutar de la vista de la población y el mar, además de tomar fotos para presumir a los amigos o simplemente para el recuerdo.

Una ciudad de película

El Gringo Gulch, a espaldas de la iglesia de Guadalupe y a un lado del río Cuale es uno de esos sitios que hay que ver. Entre sus magníficas residencias y mansiones, destaca la casa Kimberly, que fue habitada hace algunos años por la pareja sensación Richard Burton y Liz Taylor; por ahí vivió también John Huston, el director de La Noche de la Iguana, la cinta que catapultó Puerto Vallarta a la fama mundial en 1964, y basada en una historia de Tennessee Williams, quien fue otro de los visitantes asiduos de la ciudad.

Si bien la ex villa de Las Peñas era conocida por un selecto grupo de foráneos, la película estelarizada por Burton, y en la que aparecen Ava Gardner, Sue Lyon y Deborah Kerr, le acabó de dar mayor exposición a un poblado relativamente aislado de México y el mundo. En los años 60, Vallarta era el paraíso de los famosos. Además del privilegio del clima, sus bellezas naturales, la comida y su amable gente, actores, pintores, can-

tantes… podían disfrutar de deambular tranquilamente por sus calles sin que nadie los molestase. Esa época la vivió de pequeño el fotógrafo Sergio Toledano. Procedente de la ciudad de México, prácticamente creció en casa de su tío Xavier de la Torre, célebre artista, diseñador de ropa, comerciante de antigüedades y arte.

Villa Leonarda era la casa de De la Torre, una construcción muy antigua, de las primeras de la ciudad y ubicada en pleno centro y a la orilla del río Cuale. La casa era punto de reunión de celebridades, como el actor Rock Hudson, por quien Xavier hizo amistad con Liz Taylor. Entre otros famosos en ese ambiente estaba el actor Peter O´Toole.

Sergio Toledano evoca con nostalgia esos años “maravillosos” que atestiguó a corta edad: “Las estrellas de cine paseaban por la ciudad. Las playas estaban muy bonitas y Mismaloya destacaba como la más bonita del mundo; Conchas Chinas era un sitio fabuloso”.

En la actualidad, décadas después, Sergio encuentra una ciudad que ha perdido algo de ese encanto original y ha crecido sin mucha planeación, afectando hasta cierto punto su imagen de pueblo pintoresco.

A pesar de todo, Puerto Vallarta sigue siendo hermoso, concluye Toledano, sin perder el optimismo: “La ciudad tiene un lugar bien ganado en el mundo del turismo, con su gran bahía, su fisonomía y arquitectura de pueblo mexicano, sus áreas naturales, su gente amable y algunos de los mejores restaurantes del mundo”.

La Ley General de Bienes Nacionales define a la zona federal marítimo terrestre como la franja de 20 metros de tierra firma, transitable y contigua a la playa, que por su naturaleza jurídica, no puede ser objeto de transacción comercial.

En caso de existir construcciones en la propiedad federal, se deberá contar con un permiso expedido por la Secretaría del Medio Ambiente o bien, una constancia de haber regularizado las construcciones ante la Procuraduría del Medio Ambiente. El adquiriente debe obtener un levantamiento topográfico que delimite la zona federal con precisión, para determinar cuál será el objeto de la transacción; es decir, cuál es la superficie de propiedad privada susceptible de ser transmitida y cuál la superficie de zona federal, que no podrá ser adquirida en propiedad, pero sí podrá ser concesionada

El segundo caso en Vallarta una persona compró un departamento y nunca se preocupó por revisar la concesión. En la zona colindante se encontraba un puesto de frutas en situación irregular. Un día, el dueño del puesto obtuvo recursos económicos y construyó dos niveles que bloquean la vista al mar desde el departamento. Si los propietarios del predio colindante hubieran contado con su título de concesión en regla, no tendría que enfrentar estos problemas, que son complejos, largos y caros.

Cuál es la situación actual?

Actualmente, las modificaciones a las leyes han hecho el trámite más corto para recibir una concesión, pero a su vez lo han complicado, ya que ahora es necesario ser un abogado especialista para comprender y coordinar los aspectos legales, topográficos y ecológicos que se involucran. Usted puede obtener un título de concesión para preservar la playa en el estado en que se encuentra; o bien, puede solicitar un permiso federal de

rgelia Garcia, encargada de invitar, coordinar y dirigir la ya famosa TourCaravana, ha tenido un éxito rotundo en la presentación de las propiedades que Domus tiene en El Tigre, Golf & Country Club.
