By Saul F. Rosenthal, Colorado Association of Realtors® Q: What does it mean if a real estate yard sign says “Under Contract?” Is that the same as “Sale Pending?”

A: A home isn’t truly sold until what’s known as “a closing” where many documents are shared and signed and the title on the property changes hands.

If you are the seller, then you will sign a purchase contract (or agreement) in which you commit to sell the property at the offered price and with specific conditions if the buyer meets his/her commitments.

Buyers make their commitment by placing a deposit on the property and then taking certain steps to move toward a closing, like securing a loan and scheduling an inspection.

Home sales sometimes come with contingencies.

Buyers may want to make a purchase contingent on selling another home, or on a satisfactory inspection, a negative Radon or soil test, or only if repairs will be made by the seller and similar restrictions. In signing the contract with contingencies, the seller commits to meeting these conditions. If they are not met to the satisfaction of the buyer, then the contract may be cancelled.

Buyers usually need to get financing to make the purchase. And so, that may be a condition of the purchase agreement, as well. If the financing were to fall through,

then the contract would no longer be valid. Buyers will want a valid title to the property showing that there are no liens or other owners involved. Without a clear title, buyers are likely to walk away.

All of these situations – and more – make it appropriate for sellers to keep properties on the market even after they have accepted an offer and signed a contract.

Under Contract simply means that a binding agreement between buyer and seller exists. Sellers may not enter into another contract with a different buyer and the buyer is obligated to purchase the property if all of the contingencies and conditions are satisfied. This is the first step in completing a purchase or sale.

Once all of the contingencies have been cleared, the sale becomes Pending, awaiting a clear title search and any other legal steps required by the state before a closing can take place.

While no other offers may be accepted by the seller after signing a contract, the property may continue to be shown in search of “back-up” offers.

Nature putting a damper on gardening BOULDER - Just when our excitement for spring reached fever pitch, Mother Nature decided to amuse herself by playing cat-and-mouse with warmth. First, she turned on the faucet, then turned off the heat. But only on the weekends, when a lot of gardeners wanted to get outside. During the week, she tossed sunny days and clear skies at us, just to watch us press our noses to the windows of offices and meeting rooms in longing for outside.

Declarations were made to get those plants in the ground, come heck or high water, and gardeners double downed by breaking out umbrellas, wellington boots and raincoats. Nature upped the ante with hail and sleet. We battled back with walls-O-water, cloches,

“When do we get to start gardening? When?

When?” said Amy Lippold, her wail of frustration summing up every gardener’s feelings. Staring at another grey, wet day, I had no answer.

People do this all the

time in other locales. True, they fight more plant diseases and have slugs the size of Buicks, but, being hardy folk, they overcome the obstacles. Colorado gardeners just need to toughen up and learn to deal with a little damp.

This means getting your sprinkler systems ready for when the rain stops falling. Take time to turn the system on and walk around each head as it runs to ensure that it’s level and watering flows unimpeded from the nozzle. Since it’s raining all the time now anyway, getting a little wetter from inspecting your irrigation shouldn’t faze you.

Once you’ve given your system a checkup, turn it off until the rain stops falling. You don’t need to run sprinklers during rain storms. We’ll go from cold to hot in a menopausal minute once the weather returns to normal, so check the forecast daily to gauge when the time is right to turn the

system on for the summer.

If your plants look gnawed, put out slug traps, tenting them with a raised cap to keep them from overflowing with rainwater. Slug traps are small, margarine-sized plastic containers that you pour beer into to attract the mollusks. They crawl in and drown. Any beer will do so there’s no need to go with expensive stuff.

Delay planting warm season crops until the soil warms a little more. Most temperature readings of the soil are registering right around 60 degrees which is the minimum temperature for germination of beans, cucumbers, squash or pumpkins. And if the soil is soaked and cold, chances are higher that they’ll rot before they sprout. Wait a bit to let soil temperatures raise more.

Tomato, eggplant, peppers, and tomatillos should be given protection from the chill nights if you plant them outdoors.

They’ll sit and sulk in the cold soil too, so warm the soil with black plastic placed over it or WallsO-Water set in place for at least seven days before you plant. Memorial Day

weekend is a good target for planting them out.

Check container plantings to ensure that they are draining instead of holding water. Saturated soil is a deadly situation for roots to stay in but a lot of decorative containers don’t have adequate drain holes.

Weeds are running amok with this water so leave time to patrol your beds for new sprouts. Take a trowel or Hori-Hori, the Japanese digging tool, out with you as you patrol.

Weeds are easier to pull when the ground is soft and a nudge upward with the tool makes keeping the beds tidy a snap.

Colorado home prices hit new peak BOULDER – Home prices in Colorado hit a new peak in March with a 10 percent year-over-year increase, according to the latest Home Price Index report

One of 12 states to reach new home price highs, Colorado is joined

by Washington, Oregon, Alaska, Hawaii, Nebraska, Oklahoma, Texas, Louisiana, Tennessee, North Carolina and New York.

And the upward trend is expected to continue.

RE/MAX of Boulder Projections show Colorado prices adding another .8 percent in April 2016 and 5.7 percent through March 2017, according to CoreLogic.

Nationwide, home prices gained 6.7 percent yearover-year and 2.1 percent from February to March 2016. Prices are expected to rise 5.3 percent from March 2016 to March 2017.

The five states registering the largest year-over-year increase are: • Washington 13% • Colorado 10% • Oregon 10% • Florida 9.3% • New York 8.2% Zero states showed negative home price appreciation.

“Home prices reached

the bottom five years ago, and since then have appreciated almost 40 percent,” said Anand Nallthambi, president and CEO of CoreLogic. “The highest appreciation was in the West, where prices continue to increase at double-digit rates.”

Home inspections: How long are they? Three questions last between 20 to 30 BOULDER – Home underwriters ask years. inspectors should note the age of major components of a house such as the roof, furnace, water heater and exterior paint. Based on these age estimates prospective home buyers can make informed decisions on the life expectancy of these potentially expensive items. Following are some predicted life expectancy of some materials, systems and components.

Exterior paint will typically last about 8 to 12 years. Surface preparation and paint quality are the big factors in a paint’s life expectancy. Interior paint should last from 10 to 15 years with high humidity being a contributing factor.

Caulking both exterior and exterior lasts about 7 to 10 years.

A well maintained furnace can last 20 to 30 years. Changing filters on a regular basis and having it cleaned and/or serviced periodically will add some longevity. While using

an and Kathy Mihelic have been married for 26 years. With the kids out of the house, they decided it was time to leave Wichita.

Kansas was a great place to raise their family, but they are excited to be back in Colorado.

“Dan and I met 30 years ago at CU Boulder,” Kathy said. Even though they’ve been gone for a fair bit, Boulder feels like home to them. “We’re excited to be back.”

The Mihelics are hardly alone in making a Colorado-bound move.

More and more families are relocating to the Boulder County area. For some, it’s a return home.

For others, the fulfillment

“There’s just so much here [in Colorado] that’s so much more fun to do than that.” Why spend their limited time and energy on upkeep? Why not instead spend it exploring the many outdoor activities they enjoy?

A second major requirement for Dan and Kathy was location. They wanted to have outdoor options close at hand, of course, but they also wanted convenience.

The final non-negotiable for the Mihelics was space.

They weren’t looking for a huge 5,000 square foot home, but they wanted to make sure they had room where they needed it. This is one more area where Boulder Creek simply shines.

“We really liked the idea of a ranch [style home],” Kathy said of their new house. The model they picked is designed with a convenient emphasis on main-floor living—something for which Boulder Creek is well known. The master suite, living room, kitchen, laundry room and an additional room which can function as either a guest bedroom or an office are all located on the main floor of the house.

Dan and Kathy have kids, and they wanted to make sure they also had enough space for the occasional visit. That’s where the fully finished lower level really comes in handy. Downstairs there’s another big entertaining space and even more room for overnight guests, as well as another bathroom.

“We call it right-sizing,” she said.

Right-sizing is not the same as down-sizing. The goal isn’t just a reduction in square footage. Instead, Boulder Creek’s architects have created floorplans that eliminate superfluous space while preserving an overall open feel. The great room on the main floor, for example, is roomy and comfortable. The master suite is generous.

The result is a home that is neither unnecessarily big, nor cramped. Extra space, like the lower level family room, is tucked away, there when you need it and out of the way when you don’t.

Rittenberry also spoke to the kind of community that’s developing out at Calmante. “Everybody moving here has made a lifestyle decision,” she

said. The neighborhood is filling with folks who are interested in making the most of their free time, both when relaxing and when engaging in active hobbies. Naturally, that lends itself to a strong sense of community.

“We have a lot of really fun people who have decided to move here,” Rittenberry said. She and other Boulder Creek staff have watched as the neighborhood has begun to fill. It didn’t take long for residents to make their own connections, inviting each other over for dinner and hosting block parties.

Folks are even making connection with future neighbors through social media networks before they move from out of state.

But there’s a downside to Calmante. Because the community and floorplans are so popular, the houses are selling quickly.

Rittenberry reports that there are three floor plans still available – two with a main floor master, and one with all three bedrooms on the second level.

“We’re now getting down to the end,” she said.

How much does it cost to install a concrete floor in a cellar? By Angie Hicks, Angie’s List (TNS) Dear Angie: How much should I expect to pay for a new concrete floor of approximately 315 square feet in a cellar? The current floor is dirt. – Pamela S., Mechanicsburg, Pa. Dear Pamela: Providing square footage and the condition of the floor is a great place to start, but unfortunately I can’t give you a detailed cost estimate without knowing other factors. Here are some points to consider that may help you determine the work required and how it affects the total cost when speaking with a highly rated contractor.

Ease of access affects price While many contractors price concrete by the square foot, the labor involved also will determine the project’s total cost. For example, the contractors I spoke with wanted to know how the cement will get into the space. Will they have to carry it in buckets down stairs? Can they pump concrete in through a window? If it’s a walkout basement, they can bring it in by a wheelbarrow. As you can imagine, the easier the job, the less it costs. You can expect to pay a minimum of $6 or $7 a square foot in a best-case scenario.

Given your square footage, the minimum cost would be $1,890 plus labor.

Since you have a dirt floor, the

condition of the floor isn’t an issue. In some situations, however, the contractor will need to decide whether to demolish the existing floor or not. It’s much more affordable to simply pour concrete over the existing floor if it’s in good shape than to demo a floor that’s in poor condition before installing the new one. Consider a moisture barrier A point to remember about concrete is it’s porous and retains moisture. Notoriously known for holding humidity, basements could be problematic for concrete without a moisture barrier in place.

The barrier adds another layer of protection between the concrete slab and moisture that tries to seep from the ground. To ensure longevity, discuss waterproofing needs and options with a highly rated contractor before installing a new concrete floor.

I love to cut corners when I can, saving precious dollars in my decorating budget for my splurge items, but light fixtures are just one of those places where you get what you pay for. When you invest in great lamps, chandeliers and pendants, it shows. If your spaces have lackluster lighting, I would encourage you to begin upgrading and get the best lights your budget will allow. You’ll be happy in the end because the lighting will take your space to the next level.

A mix of fabrics Speaking of cheating, you can find decorating fabrics that allow you to get a big look for a minimal investment. If you are on a budget when decorating your spaces, this is where you can cut corners without sacrificing the look of your room.

One tip is to pick a modest fabric for your bedding, drapes or upholstered furniture, perhaps a solid or a subtle pattern, then give it a great story with an interesting trim or contrasting welt. Or, invest in one killer fabric and use it to make a pillow for your sofa or bed, then fill in with others that are made from less expensive fabrics. When picking the fabrics for your home, try using a variety of patterns, colors and textures to make your rooms more interesting and unique.

Arresting artwork One of the biggest mistakes I see people make when they invest in decorating their homes is to fill a room with great furnishings, then leave the walls blank. As a result, the room falls flat with a big thud.

Artwork is absolutely essential for a well-decorated room, so refuse

to allow yourself to be paralyzed when picking and hanging art.

When I select art, I purchase pieces I love that speak to me and lift my heart, then find a way to work them into my decor. I would never pick a piece that I thought was just OK because it looked good over my sofa or mantel. Be confident, be choosy and get artwork that shares a glimpse of your personality, a window into your world.

Something personal As much as we all love to look at dreamy decor in magazines and on Pinterest, no one should live in a room that looks like it’s been downloaded from a catalogue.

Every space in your home should reflect your unique personality, your well-lived life. Decorating accents are powerful tools to help tell your story. I like to weave in treasures from my travels, snapshots of special moments and those I love, gifts from people who mean the world to me. Add a touch of whimsy when you can, like taking that odd clay sculpture your child or grandkid made in art class, putting it on a cake plate and topping it with a glass cloche to give it the stage it deserves. Every time you walk past it, I bet it will make you smile!

One final bit of advice: Don’t let your room remain static, once you have decorated it. I believe good design evolves, and rooms should change to reflect the seasons, your interests and life stages. And above all else, have fun!
