NOTICE TO MEMBERS re POOL DECK DEFECTS
Power Ranch Community Association, Inc. - June 16, 2021 Homeowners RE: Notice of Potential Construction Defect Claims related to Failing Pool Decks and Notice of Membership Meeting Dear Homeowners, We are writing to provide notice to all owners within the Power Ranch Community Association (the “Association”) of the Board of Directors’ intent to proceed with litigation on behalf of the Association against the contractors responsible for manufacturing and installing the pool deck system (the “system”) that surrounds several of the Common Area pools in the community. In accordance with Arizona law at A.R.S. § 33-2002, prior to proceeding with such action, the Board is required to provide certain information to the members of the Association, all of which is included below, and to hold a meeting of the members. As you may be aware, visible damage is evident in the decking systems surrounding several pools at the Association. The Board of Directors recently engaged the services of an expert—Gervasio & Assoc., Inc.—to inspect these areas and provide reports regarding the damages and recommendations for repairs. The reports are available for review upon request. A summary of Gervasio’s Reports regarding the existing damage is set forth below. Community Pool (Ranch House) In 2009, Raven Pools, Inc. (“Raven”) submitted a proposal to the Association to resurface the existing pool deck at the Community Pool. The work was performed in 2010. In 2014, Raven cleaned, prepped and recoated the entire deck surface as part of its routine maintenance. By early 2017, the deck surface had deteriorated and Raven was retained to resurface the area. This time, Raven used a Miracote system in the resurfacing. By summer of 2017, the Miracote surface material began to fail and delaminate. Pursuant to the warranty on the system, Miracote redid the work performed by Raven using a different contractor (Sumac) to resurface the entire area. Subsequently this surface also delaminated, and certain areas resurfaced by Raven in 2017 were not repaired by Miracote. At present, delamination failures exist in: (l) most of the Miracote surface materials placed by Raven Pools, (except for a wide band of panels north of the pool immediately south of the E-W deck drain for the Lap pool); (2) almost all of the Miracote surface materials placed by Miracote’s contractor; and (3) in isolated areas along moisture sources (deck drains and planters) of the original “Florie” system installed by Raven Pools in early 2010. Miracote: (1) did not provide complete/detailed written instructions about the system furnished for this application; (2) failed to provide proper instructions/sufficient crushed quartz to enable Raven Pools to create tenacious bond layer at the top of the concrete; and (3) provided an ineffective one coat sealer layer that failed to protect the underlying (and vulnerable) scratch/base and surface/texture coat layers. Raven Pools: (l) failed to provide a consistent/adequately bonded crushed quartz layer, even though it had concluded that Miracote provided inadequate instructions/materials; (2) provided inconsistent and poorly bonded scratch/base and surface/texture coat layers; and (3) installed Miracote’s pigmented sealer enabling premature wearing and moisture intrusion into the vulnerable underlying layers. Miracote’s Replacement Contractor, Sumac: (1) failed to adequately/consistently prepare the existing concrete surface; (2) did not adequately bond the “Aqua-Blok XL” to the concrete substrate; (3) provided inconsistent and poorly bonded scratch/base and surface/texture coat layers; and (4) installed paint coating over Miracote’s sealer enabling premature wearing/moisture intrusion into the vulnerable underlying layers.
Barn Pool In late 2017, Raven Pools, Inc. resurfaced approximately 8,100 sq. ft. of the existing “KoolDeck” at the Barn Pool and resurfaced the pool shell with “White Mini Pebble,” while also repairing a structural crack in the middle of the pool shell. The Gervasio Report notes that, at present, there is delamination and side patching in the deck surface along the sides of wide cracks, unrepaired cracks which are reflected through the newly applied deck surface material, delamination along the side of poorly installed Zurin drain, loss of surface paint coating on the deck surface, and poorly repaired ‘wear mark.’ In addition, the Report notes that although Raven performed the repair to the crack across the pool shell, it appears that a parallel crack developed alongside it. Juniper Knolls Pool In early to mid-2019, Raven Pools resurfaced approximately 5,583 sq. ft. of the deck coating at the Juniper Knolls pool. The pool has since experienced damages to this coating and to the plastic control joints between the concrete deck’s panels. These damages include delamination, bubbles in the KoolDeck coating, loss of the paint coating, and lifting of the plastic joints. On April 14th of this year, the Association sent a letter to each of the contractor’s involved in the system’s manufacturing and installation (Raven Pools and Miracote) to provide notice of the defects and an opportunity for the contractors to inspect repair these issues. Gervasio’s Community Pool Report was provided with the initial letter, and the subsequent reports regarding the Barn and Juniper Knolls pools were provided to Raven and Miracote in May when the Association received them. While both contractors have performed inspections of the system, neither has proposed any type of settlement to the Association. In fact, the Association has been advised that the insurance carrier for the contractors does not intend to discuss or negotiate any type of settlement until a construction defect lawsuit is filed. At this point, the Association has little choice but to proceed with asserting claims against the above-identified contractors. The Association may proceed with claims including but not limited to breach of contract, negligence, and breach of warranty (express and implied). In bringing these claims, the Association would seek reimbursement for the expenses it has occurred as a result of the system failures, and damages in an amount sufficient to enable the Association to make any and all repairs that are necessary in order for the system to either function correctly or be replaced entirely. In proceeding with litigation, the Association anticipates incurring expenses and fees related to hiring consultants, expert witnesses, court costs, and attorneys’ fees. The Association estimates that these expenses could range anywhere from $30,000.00 to $50,000.00 or more, depending on the course of the litigation. The Association would seek to recover these expenses from the contractors. The Association does not anticipate that this litigation would have an impact on the values of the homes within the community. In accordance with A.R.S. § 33-2002 and A.R.S. § 33-1804, the Board of Directors is noticing a meeting of the Association’s members to be held on July 15, 2021 at the Barn to discuss this matter. The meeting will begin at 6:00 P.M. There is no membership vote required in order to proceed with the litigation described herein, and therefore no ballot accompanies this letter. However, the meeting will provide members with an opportunity to learn more about this issue before the lawsuit proceeds. If you have any questions regarding this matter, please feel free to contact Rebecca Hill, Community Manager at rhill@ccmcnet.com. Sincerely, The Board of Directors Power Ranch Community Association, Inc.

COMMUNITY AND FRIENDSHIP LIVE HERE BY PHAEDRA EARHART Board Secretary
As my husband and I sat at the bottom of the staircase, we wondered, had we just made a terrible mistake? In 2005, we moved into our new home in Power Ranch. We didn’t know any of our neighbors, what the community would be like, or anything about our new location. We only knew we liked the layout of the house. For several years, we existed happily in our little bubble. Then in 2010, I opened my own business and started networking. I signed up for different events around Power Ranch, hoping to grow my business. One of my first events was a weekly wine tasting hosted by a PR resident. After a month of hanging out, drinking wine, and laughing, I had met some of my very best friends, to this day. I started getting more involved in neighborhood events, and even sponsoring some myself. What I gained was so much more than new business. I had gained friendships and community. Power Ranch is an incredible community; one of the best in the East Valley. I want to encourage everyone to get involved, at any level. The lifestyle team does an amazing job in creating multiple events throughout the year with a variety that will entertain all families. Attend some events and get to know your neighbors. I promise that you will feel that sense of community and just what Power Ranch is all about.

SPLISH, SPLASH AND SAFETY
BY AMY BARRETT, COMMUNICATIONS COORDINATOR
Its pool season here at Power Ranch, so we would like to take a moment to share these important reminders so everyone can enjoy the water safely. The Power Ranch Pool Rules were created using City/County codes, keeping in mind our large number of pool users. Below are ten rules and etiquette reminders for residents and their guests. 1.
No Food or Drink in the Water. Residents are permitted and encouraged to relax and enjoy the pool deck with a snack or meal. After all, that’s why the grills are there! However, per Maricopa County, food and drink are not allowed within four feet of the pool water. This helps keep the water and filters clean from accidental spills and the pools open for use.
2.
No Glass in the Pool Area. Per City Ordinance, glass is not allowed in the pool area. Before you step through the gates, please make sure you are not carrying any glass bottles or containers. Glass is a significant safety hazard, especially in a space where most residents walk around bare-foot. Not only that, the City can perform inspections at any time, without warning. If any glass items are found in the pool area, they can, and will, shut the pool down.
3.
No Pets Allowed. We all love our furry friends, but nobody loves a furry pool filter. Per Arizona law, any pet outside of your residence is required to be on-leash and under owner control at all times. For their safety and that of our residents, pets are not permitted to enter the pool or be inside the pool gates at any time – with the exception of service animals. (Emotional support animals are not considered “service animals” per ADA).
4. No Smoking. For the comfort of all our residents, smoking, including the use of e-cigarettes, is not permitted in any amenity space. There are designated smoking areas around the property which are the required 25 feet from building entrances, so be sure to utilize those for a smoke-break! 5. Two Guests per Resident. Residents are warmly invited to bring guests to any of our community’s amenities. Please remember to accompany your guest at all times. This helps ensure that all of our residents are able to equally enjoy the amenity spaces without feeling overcrowded. 6. Children. Please keep safety at the top of your mind when it comes to water and your children. There are no lifeguards on duty at our pools, and a life-threatening accident only takes seconds around water elements. 7. Swim Diapers. All babies and toddlers must be in swim diapers. We understand that your child may be “potty-trained” but please be respectful of the shared space. Remember, accidents can happen at any age, and generally it is the older kids that get excited and don’t want to stop and use the RESTROOM – REHYDRATE – REAPPLY! Parents, remember the 3R’s and help us keep the pools open all summer. 8. Be Healthy. Ensure you are healthy and physically well enough to be visiting the pool. Residents and guests with irritated eyes, colds, nasal or ear discharges, any obvious skin or body infections or cuts may be asked to leave the pool area. 9. Music. Please be mindful of your neighbors and respect the family community in which we live. Please bring earphones with you when listening to music that may be inappropriate in the pool area.

GATEWAY AIRPORT OFFERING MORE FLIGHT OPTIONS BY BRIAN SEXTON, C.M., PHOENIX GATEWAY AIRPORT
Pack your bags! Phoenix-Mesa Gateway Airport recently announced two airlines coming to the East Valley airport - Avelo, a new ultra-low-cost commercial air carrier, and Sun Country Airlines. Avelo recently began operations at Gateway Airport with nonstop flights between Mesa and the airline’s hub in Burbank, CA with Boeing 737-800 service. Sun Country Airlines will begin seasonal nonstop service between Gateway and its hub in Minneapolis this November. And if that wasn’t exciting enough, the Airport’s main carrier, Allegiant Air, continues to grow their service with new nonstop flights to San Diego, Jackson Hole, Houston, and Santa Maria, California. WestJet and Swoop are expected to bring service to Canada back this Fall, bringing the total number of airlines at Gateway to five, and nonstop service to 55 destinations. Airline development is just one aspect of the growth taking place at Gateway. Construction crews are hard at work assembling the precast concrete panel exterior of Gateway Airport’s new air traffic control tower. The new Tower will be 55% taller than the Airport’s existing facility and its cab will be twice as big. The project will be completed in the summer of 2022.

BEAT THE HEAT THIS SUMMER ALL STAR DOORS ARIZONA
Our weather is one of the main benefits to living in Arizona. While our winters are great, the summer heat can wreak havoc on homes through windows and doors. One way to prolong the life of your windows and doors is to add sun screens to them. If your patio door is exposed to direct sunlight, adding a screen door with UV protection is an inexpensive way protect your door, helps your house be more energy efficient and also lets you enjoy some fresh air during our milder months. Sunscreens on your windows can offer benefits to your home too, and do so in the following ways: • Can reduce your home’s temperature, making it more energy efficient. (50% of the heat in your home enters through the windows. Sunscreens can reduce your electric bill up to 25%) • Protects your turf from being burned. (Window reflection acts like a magnifying glass and can easily burn your turf). Fun Fact: artificial turf begins to burn at 170° • Can protect carpet, curtains, artwork and furniture from fading • Provides daytime privacy, outward visibility, soft light and breezes when windows are open Arizona summers not only bring the heat but also blowing dust. Our large haboobs (Dust storms) bring dust and dirt that collect in doorways, gumming up the rollers on your sliding door, making it difficult to operate them. No matter the temptation DO NOT use lubricant products like WD40 on the bottom of your door. A simple mixture of dish soap and water can clean your track. Cleaning prevents the need to have rollers replaced more often and unnecessary wear and tear on your track. Door and Window maintenance and care, when done right, will save you 1000’s in costly repairs years down the road. o. 480.232.2605 allstar@allstardoorsaz.com www.allstardoorsaz.com

WORK-LIFE BALANCE BY JOSHUA JOHNSON MANAGER OF LIFESTYLE SERVICES
With life heading in the direction of a familiar pattern this summer, going back to the office will be an adjustment for many of us. While working from home has its own set of challenges (and benefits), getting back into a normal routine at the workplace will be something of an uphill battle for some. Maintaining a proper work-life balance is crucial to not only your physical health, but also your mental health, as well as a happy relationship with your family and coworkers. According to the Mayo Clinic, maintaining a proper worklife balance has become increasingly difficult due to our accessibility to technology, allowing for our work to further bleed into our personal lives. This can cause higher stress levels, including fatigue, poor health overall and loss of precious time with family and friends. But, there’s hope! There are steps you can take to help minimize the amount of work creeping into your home life, and to help maximize your time with your loved ones. First and foremost, it’s important to manage your schedule and to give yourself plenty of time to complete the tasks that you have.
There’s a variety of tools available to you to help with this task, including apps and websites, as well as classic planners and calendars. Find the best program or system that works for you and stick to it! Second, it’s OK to say “no.” Evaluate your priorities, both at home and at work. When you learn to stop accepting tasks out of guilt or because you feel you have to, this will help free up time in other portions of your life. Lastly, find ways to completely separate yourself from work. Check with your supervisor on their expectations when it comes to using cell phones and email while at home. A simple way to disconnect from work is to change your clothes. Get out of the clothing you associate with work and go with something more casual and comfortable. Take some time out to do an activity with your kids or spend time with a spouse. Always make time for yourself. Whether this is reading a book, practicing some yoga or gardening, find time where you can decompress and disconnect from your work life. If these activities include your spouse or partner, all the better. Your mental and physical health are essential to striking a balance between work and life. Eat well and get plenty of sleep. Work is an essential part of life, but it’s also important to ensure that the personal connections we have at home are just as essential, if not more than our work life. Here in Power Ranch, we have numerous ways to help you find that balance. Take some time and wander the trails, sign up for the classes we offer throughout the year, or simply visit with friends at one of the many events or activities. We want you to be happy and healthy, and we hope that having a diverse schedule of events throughout the year can help you achieve that.
