Charitable thoughts...

The way charities are run was very much in the spotlight over the past few months. Most important for all charities was the introduction by the various regulators across the UK of a new Statement of Recommended Practice – or SORP – for financial reporting. The aim is to make reporting simple for the trustees of smaller charities while creating greater transparency across the board.

• Alongside the new SORP, the Fundraising Regulator’s new Code of Fundraising Practice has now come into effect. As well as laying down standards to protect donors from misrepresentation, the new code requires charities to protect fundraisers themselves from threats and harassment.

• In addition to the statutory measures, a new voluntary Charity Governance Code has been launched. Created by a cross-sector steering group, the code is there to act as a barometer for trustees and boards to measure themselves against. It also acts as a guide for boards on how they interact with each other and the public.

• The legacy sector also saw a welcome new development in the form of the Legacy Academy – a series of training modules for private client advisers.

The four modules aim to give advisors guidance on the

process of raising the issue of legacy giving and the process of creating a legacy. They have been devised

by Remember A Charity and published to coincide with Remember A Charity Week.

• Those who manage legacies for charities were also in the spotlight as the Institute of Legacy Management launched its Love Your Legacy Manager campaign.

The campaign, which kicked off with a webinar called All Systems Go, is in response to a feeling among some legacy managers that they are undervalued and misunderstood.

• Leaving provision for pets is an area of legacy law that is often misunderstood. The popular comic notion of someone leaving their fortune to their cat is legally impossible: animals are property in law and cannot inherit anything. Ensuring much-loved animals are adequately cared for is something that a legator can do. Care must be taken in how the provision is worded, however.

• With Christmas almost upon us most charities have their seasonal campaigns in full swing. For those who are still engaged in some last-minute planning, we have a few pointers from Enthuse and Charity Digital.

EVERY DAY WE MAKE GOOD THINGS HAPPEN, BUT WE CAN ONLY DO IT WITH YOUR HELP The photograph on the right of border collie Nipper was taken on the same day that he’d been taken to a vet’s to be put to sleep.

Purchased as a ‘surprise’ gift, he was unwanted. This beautiful puppy was just eight weeks old and is just one of almost 10,000 animals rescued by Friends of the Animals.

There was a happy ending as – now renamed Stanley – he was rehomed with one of the charity’s voluntary drivers, who adores him.

Friends of the Animals began in March 1990 and had very humble beginnings. Veterinary treatment is invariably the charity’s biggest outgoing and to date they have spayed or neutered 45,000 animals. Thousands more have been wormed and inoculated – often for the first time in their lives!

Founder Helen Sinclair MBE, who was honoured for Services to Animal Welfare in 2014, takes up the story: “There have been many memorable cases, where we’ve saved animals’ lives against all the odds. Animals such as the puppy who slipped under the railings of a balcony – luckily bouncing off the conservatory roof which broke her fall. Then there was the dog who fell down a manhole in the road after someone had removed the cover, and poor Marshall, who had three broken legs and a severed ear.

“Susie, a Labrador/Staffy cross (pictured above), was badly burnt in a house fire, but made a good recovery; and the dear little cat above had everything wrong with him, but survived and thrived.

“When 11 month old Border Collie ‘J.J.’ came into our care, she had a pin / plate poking through

a badly infected front leg, a paw so badly crushed the bones had fused together and a stab wound.

“Her original owner pleaded guilty to causing unnecessary suffering to a protected animal and was fined £2,000 and banned from keeping an animal for ten years.

“As you can see from the wonderful photo below, ‘J.J.’ went on to much better things.”

Gifts in wills fund one in two veterinary treatments and so legacies are an absolute lifeline to the rescue and spaying/neutering work carried out by Friends of the Animals.

The charity has a policy of non-destruction, unless an animal is sick or injured with no hope of recovery, and they keep admin costs to a minimum. Very importantly, 90% of their staff are volunteers, which ensures as much of your gift as possible is spent on saving animals.

Pitted against that constant battle to save lives was the action of the person who set fire to the front of the Charity’s base.

“But, happily,” said Helen, “we're a resilient team and together with the help of supporters, we barely skipped a beat and just kept on going.

“We truly appreciate that people have many choices regarding charities to support, but no one appreciates it more, or tries harder than we do, to get the very best possible use from every penny donated. Thank you for your consideration.”

LEGACY BODIES OFFER PRE-BUDGET WISH LIST [IN THE RUN-UP to this year’s

Autumn Budget Statement on 26 November, Remember A Charity came together with the Chartered Institute of Fundraising to underline the need to protect the fiscal incentives for gifts in wills and to remove the barriers for donating from a pension. As the two organisations pointed out Inheritance Tax (IHT) is rarely far from the headlines.

After the announcement in the 2024 Budget that unused pension pots would be included in the scope of Inheritance Tax from April 2027, there has been much debate about how the change could have an impact on legacy giving.

On one hand, it could encourage charitable gifts in wills, with donors and their advisers coming together to explore a range of tax mitigation strategies. But the uncertainty and complexity around the new proposals could also have the reverse effect and stall giving for some.

To address the issue, the two organisations filed joint submissions to HM Treasury’s Budget portal and to the House of Lords Finance Bill Sub-committee, calling for the barriers to tax-effective pension giving to be removed and highlighting the need for clearer guidance for the public on any incoming IHT changes.

The submissions emphasise the vital need to preserve the current fiscal incentives – where legacy gifts are tax-free and estates donating 10% or more can qualify for a reduced IHT rate of 36%. The incentives not only encourage generosity, but crucially they help to normalise the vibrant area of philanthropy, promoting discussion of charitable legacies among professional advisers, clients and others.

In its submission to the Treasury’s Budget portal the organisations said: “This submission calls on Government to nurture the growth of charitable legacy giving in the UK by protecting the Inheritance Tax incentives for supporters who choose to remember a charity in their will, and to remove the barriers that can prevent people from donating their unused pension in the same way.”

The submission to the House of Lords Finance Bill Sub-committee, following its call for evidence, read in part: “In this response, we highlight the importance of ensuring the legislative framework considers

the impact on charities, many of which are reliant on gifts in wills to fund crucial services for people in need across the UK. The fiscal incentives for donating in this way are a vital component that has enabled legacy giving to flourish at a time when charities, community-based organisations and their beneficiaries are so urgently in need of support.

“This submission articulates our concern that the additional burden and complexity for personal representatives in the current legislative proposals will lengthen the timeframe in closing estates significantly, with negative implications for grieving families and charities alike.

“Delays or uncertainty about the release of legacy income – one of the most significant sources of voluntary income, raising £4.5 billion annually – will have a direct consequence on the services charities can provide. We believe this must be reviewed urgently.” q

CAMPAIGN HELPS LEGACY MANAGERS FEEL THE LOVE [A STAR-STUDDED PANEL of legacy

experts kicked off the Institute of Legacy Management’s 2025 Love Your Legacy Manager (LYLM) campaign on 22 October.

Titled All Systems Go and hosted by Paul Browne – both an ILM board member and head of legacy administration at Legacy Link – the webinar attracted a host of delegates from a raft of different charities.

ILM CEO Matthew Lagden began proceedings by paying tribute to the hard work of legacy teams and said All Systems Go had been borne out of survey results which showed nearly 80% of respondents had identified a lack of internal support or resources as a key challenge.

“Legacy managers tell us that they frequently feel undervalued and not properly understood. We are trying to turn that perception around,” he said. “By focusing this campaign on internal systems and processes and hearing a range of experiences from our panel contributors, our aim is to share ideas about how you can work within your organisation to garner support and improve your working environment.”

Paul Browne talked about the importance of legacy managers being advocates for their roles, of grasping every opportunity to educate colleagues throughout their organisations and

of being able to take management teams with them on the legacy journey.

“I always have a ‘lift pitch’ ready – a 30-second pitch prepared in my mind – which explains ‘what is legacy management’; and I can deliver that to anyone, whether it’s the CEO or the receptionist,” he explained. “As a legacy manager, we are the point of reference, the competent person that anyone can come to if they have a question about legacy management, and it is important that you are recognised as such.”

Katherine Ellis, a solicitor and senior consultant at Legacy Link, gave webinar participants a potted history of how Legacy Link’s work with cancer care charity Maggie’s and homelessness charity Crisis had helped both charities to dramatically increase legacy pipelines, thanks to increased engagement with senior managers and persuading them to invest in both teams and processes.

Banging on doors

Sharing her first-hand experiences as head of legacy engagement at Oxfam was Sinem Bilen-Onabanjo. Talking about her three-year journey into securing more investment in legacies, she said: “You

need a strong business case and a growth mindset: it is not a job for the weak-hearted; you have to take no, after no, after no to get what you want. Our team loves banging on doors, whether they are open or not.”

Turning to technology, Paul Browne made a plea to set spreadsheets aside and use online systems – such as FirstClass or Access thankQ – highlighting the importance of putting information into a manageable format that can be easily shared and followed up.

It was then time to answer questions from members and joining Sinem and Katherine were fellow Legacy Link experts Marcia Prince and Duane Saunders.

Both responded to one member who asked what the first steps should be in educating a senior management team. For Marcia, it was about having three induction slides to introduce people to legacies, and every time there was a change of personnel grabbing 10 minutes of their time for a quick presentation. For Duane, it was about celebrating successes to show the added value that legacy managers bring.

FAIRNESS IN THE FAMILY COURT MAY HELP REDUCE CHILD SUICIDE RISK, CHARITY FOUNDER BELIEVES [PROMOTING AND ASSISTING in

access to justice in the Family Court is the aim of Parenting Together, a charity set up by former youth worker Gerry Hannah.

Gerry points out suicide is the most common cause of death among young people – often prompted by the depression caused by family break-up. He believes that in many cases the break-up of the family is avoidable if parents are able to present their version of events.

Said Gerry: “British Family Courts sit in private and they convict parents merely on the ‘balance of probability’. In some cases a judge is persuaded to make a misinformed decision based on race, gender, heritage, beliefs and social status – often causing serious depression which can have lethal consequences.”

Gerry formed his association with humanitarian experts and professionals to ensure low-income, disadvantaged parents involved with social services or Family Court proceedings receive fair and equal justice.

He added: “We mostly provide specialist legal services, advocacy and reports for disadvantaged parents in Family Court proceedings.

Our experts, professionals and associate solicitors often work pro bono to help us resolve exploitation and unlawful abuse of the family

law and child protection systems. We framed our projects on the government’s Every Child Matters report, published in 2003, that recommended engaging families in the care and protection of children.”

He points to cases of parents with learning difficulties asking people on social media for advice when they cannot understand the legalese, acronyms and procedures.

“They are usually misguided, posting views and comments that go against them in court. Their social media ‘friends’ are often predators who exploit single parents with young children. We recently submitted evidence to the CPS against a few of these sexual predators targeting our vulnerable parents and their children.”

The current project is a continuation of Honeypot Families, a work-in-progress study comparing families in the safest happiest regions of the UK with families in what Gerry describes as ‘the most dangerous city in Europe’.

“We concluded that Judeo-Christian families functioned efficiently to provide the best outcomes for everyone because they are based on a mutually agreed contract where adults vow to love, care and respect each other until death.” q

LEGACY PROMOTION WEEK SEES ACADEMY LAUNCH [

REMEMBER A CHARITY, the umbrella body for promoting gifts in wills, has launched a new, free training series for private client advisers – the Legacy Academy. The launch coincided with this year’s Remember A Charity Week, which ran from 08-14 September.

Developed in partnership with CPD training provider For Legal, the four-part webinar series is designed to equip advisers with the insight and confidence to have values-led discussions with high net-worth clients about charitable legacies. The on-demand training series is available on a complimentary basis through both For Legal and Remember A Charity’s websites. It complements existing training webinars for solicitors and will-writers, also available through For Legal.

The Legacy Academy training series consists of four sessions: • Why and how to start a legacy giving conversation • Tax, structures and legacy giving • Succession planning and legacy giving • A personal reflection on legacy giving: A client’s perspective Remember A Charity explained: “Legacy giving has become a vital income stream for UK charities, raising £4.5bn in 2024 alone to fund crucial services from medical research to environmental campaigns.

Although legacy giving has become increasingly popular at all levels of wealth, for high net-worth individuals it is even more prevalent. In fact, recent research shows that half of people in the UK with over £1m in investable assets have already pledged a charitable gift in their will, with charitable will trusts and donor advised funds also becoming more widespread for this audience.”

The option of leaving a charitable legacy is particularly appealing in the UK due to the generous Inheritance Tax (IHT) incentives available, the statement continued. They include the fact that gifts to charity are free of tax and donations of 10% or more of the net value of the estate can reduce the IHT rate from 40% to 36%. Professional advisers play a key role in helping clients understand their charitable options, including how a charitable legacy can be incorporated in their estate alongside any gifts for their loved ones and how to maximise the tax incentives.

Remember A Charity works with a growing network of professional advisers, including solicitors, professional will-writers, tax specialists and wealth advisers, to provide resources, information and training on charitable legacies.

Each September, Remember A Charity Week acts to encourage advisers to use the platform to make clients aware of the option of including their favourite charities in their wills, alongside their loved ones.

Lucinda Frostick, director of Remember A Charity, commented: “For advisers, it’s becoming increasingly important to be able to support clients in meeting their philanthropic needs and passion for good causes. And that’s particularly evident when it comes to planning a legacy, where family and charitable causes so often come together.

LEAVING PROVISION FOR PETS: WHAT IS THE LEGAL POSITION? [

FOR MANY PEOPLE, provision for their much-loved pets after their deaths is a major area of concern. That issue was the subject of a guest blog on the website of Remember A Charity by Lucy-Allena McIlroy, associate solicitor in the Will, Trust and Estate Disputes team at Irwin Mitchell.

Introducing the article, she writes: “When it comes to estate planning, many people include provisions in their wills to ensure the welfare of their loved ones, including their beloved pets. Gifting pets in your will is a heartfelt gesture, but it's essential to understand the legal considerations involved.”

She explains that, under English and Welsh law, pets are seen as property rather than individuals and, as such, have no legal rights. Consequently, they cannot be named as beneficiaries under a will. The popular idea of someone leaving all their property to their cat has no basis in law.

Pet guardians

Ms McIlroy points to the possibility of appointing a pet guardian to care for pets after a person’s death.

She cautions: “It is crucial to have open discussions with the chosen guardian to ensure their willingness and ability to take on this responsibility; you should bear in mind that the person you appoint cannot be compelled to accept your pet, so you might want to consider making a gift to an animal charity which is contingent on that charity taking care of or rehoming your pet.”

People can also allocate funds in their wills to support their pets’ future care.

“You may consider leaving a specific sum of money to a person or to a charity entrusted with their care or you might explore establishing a trust dedicated to covering the costs associated with your pet’s wellbeing, such as veterinary care, food, grooming and any other necessary expenses,” she writes.

Keep up to date

It is also essential to keep a will updated, as circumstances may well change after the will is initially made. There are also calls to change the way animals are treated legally, so a will may become outdated.

HELPING THE FORGOTTEN PEOPLE OF ZIMBABWE [

ZANE: ZIMBABWE A NATIONAL EMERGENCY is a UK registered charity working to help the most destitute, vulnerable and impoverished people in Zimbabwe. It is the largest supplier of financial aid to elderly people in Zimbabwe who lost their life savings and pensions in the economic collapse and subsequent hyper-inflation.

This includes over 440 frail veterans and their widows who fought for the Crown.

ZANE assists with rent, medical bills and food – and, crucially, also provides comfort, advice and support.

In addition, ZANE funds a clubfoot correction programme, successfully treating over 6,600 children to date. ZANE also funds education programmes including the provision of pop-up classrooms in a high-density township for children who would otherwise not receive an education. It runs creative therapy workshops for women living in extreme poverty who are victims of political violence and trauma.

Zimbabwe remains a country in crisis. With some of the highest inflation and unemployment rates in the world, Zimbabwe’s economy teeters on the brink of collapse. Coupled with a woefully inadequate healthcare system, the need for ZANE is greater than ever for the most destitute people in Zimbabwe. q • To find out more about the work of ZANE visit www.zane.uk.com

CARERS NEED SOME TLC, TOO [ JOANNA LUMLEY, Patron of The Respite Association (TRA),

recently paid this tribute to carers: “Carers are my heroes: caring 24/7, week-in and week-out, often for years on end, with no breaks or holidays and no complaints.”

Across the country there are thousands of unpaid carers; and since its formation in 2001 TRA has been supporting them to get a desperately needed break.

John Turner, one of the charity’s two part-time staff, explained: “It doesn’t take a great deal to have an enormous impact on the lives of carers. They don’t see what they are doing as a burden because they are caring for someone that they love; but they just need a little rest.”

“One lady, whose son is on the autistic spectrum, explained that he only sleeps for two hours per night, so that is all the sleep she gets, too. That lady just wanted a normal night’s sleep to catch up – while a gentleman in his seventies, caring for his wife who has dementia, wanted a weekend so he could go to his granddaughter’s first piano recital.”

TRA also have three holiday facilities - in Cornwall, Wales and Yorkshire - where they give carers a week-long break by the seaside. A carer who had a break in the charity’s caravan at Rhyl

wrote: “We had the most amazing time on holiday – gutted to be home in fact. Whilst I was there I couldn't help thinking of you and what an amazing opportunity you gave us. Me and my family are extremely grateful and always will be.

CHARITY AIMS TO RAISE EXTRA FUNDS IN ITS 75TH JUBILEE YEAR! [

THE HORSE RESCUE FUND is a long-established equine charity.

In 2025 they will be celebrating 75 years of service to the equine welfare industry. The charity has a colourful history of pioneering work in changing attitudes towards equine welfare. Most recently they have had to adapt to helping horses relinquished to them due to economic problems or those associated with the social welfare issues of their owners.

As a smaller charity in the equine sector, it is unfortunately often overlooked for funding, which makes the 75th anniversary year celebrations all the more important for raising awareness as well as funds.

In the 75 years since the fund was established by the Walbancke family, hundreds of horses have been given a second chance at a happy life. From early days in their back garden to the purpose-built yard occupied today, the ethos has remained the same – Rescue, Rehabilitate, Rehome.

The charity currently has over 50 horses out in homes and can house up to 20 horses, ponies or donkeys on the yard, if needed. These horses, once in their care, are treated as individuals – staying at the yard until they are emotionally and physically ready for rehoming.

A spokesperson commented: “We feel that although we are not trying to turn over numbers, as a smaller charity we can make a real difference to the individual horse, offering a lifetime of ongoing care and support.”

This year the charity has run far more events than usual to celebrate their 75th anniversary, aiming to raise a substantial amount of money by the end of December to help continue their vital work. With winter fast approaching, and the need for extra hay, feed and bedding, the charity is now promoting their Winter Hay Appeal. With this being the most expensive season of the year, donations are even more vital for the continued well-being of the horses in their care at present and those yet to arrive.

West Midlands community for over 130 years since it was founded in 1892, and they have always provided homeless dogs with a refuge and a place to feel safe. From humble beginnings it is now proud to be the largest dog rescue charity in the region, operating from two rescue centres.

NEW SORP INTRODUCES TIERED REQUIREMENT FOR REPORTING [A NEW Charities Statement of Recommended Practice: Accounting

and Reporting by Charities – the SORP – aims to make charities’ financial reporting more proportionate.

In finalising the new accounting framework, the charity regulators across England and Wales, Scotland and Northern Ireland, who together make up the SORP-making body, have balanced a desire for simplicity and clarity for charities with the importance of transparency for donors and interested third parties.

That is reflected in a refreshed approach to trustees’ annual reports to include a wider range of achievements and risks, alongside the introduction of three new tiers that require the most detail and transparency from the UK’s largest charities. Unless required by Financial Reporting Standard 102, only charities with incomes of more than £15m will be required to produce a detailed statement of cashflows, reducing the burden on charities with an income between £500,000 and £15m.

Key changes confirmed in the SORP update, which will take effect for accounting periods starting on or after 1 January 2026, include new requirements for how charities should report on certain types of income and lease arrangements.

The three new tiers are: Tier 1 – for charities with income up to £500,000 Tier 2 – for charities with income between £500,000 - £15m Tier 3 – for charities with income above £15m There are refreshed Trustees Annual Report requirements, with further guidance added on how to report financial reserves and plans about the future. Areas of particular public and donor interest – including impact reporting, environmental, social and governance issues – now have dedicated sections, with associated guidance on reporting.

Updates to how charities should account for social investments make it simpler for charities to report on such holdings and align the definition of

social investments in SORP with the definition in the Charities Act 2011.

There are also easier to understand requirements for reporting provisions and contingencies.

Regulators will work with sector bodies and professional advisory bodies to support the shift to the new framework during the coming months.

Consultation and deliberation on the new SORP has been extensive, including a three-month consultation that took place earlier in 2025 – attracting 150 responses from charities, professionals and independent bodies. The consultation showed wide support for the move to a threetier reporting framework, though views varied on the most appropriate threshold levels.

Reflecting that, and other considerations, the SORP-making body has opted to confirm the tiers proposed in its consultation for the time being.

The SORP-making body is committed to considering the tiers through further work during 2026-27.

Charity Commission chief executive David Holdsworth said: “We welcome the changes introduced by DCMS to ease administrative burdens for charities in England and Wales. We’re also beginning work with them to explore further opportunities to simplify the regulatory landscape.

In related changes announced by DCMS for England and Wales, the threshold for some charities to produce accounts reflecting the SORP is to be doubled from £250,000 to £500,000. NEW FUNDRAISING CODE COMES INTO EFFECT [THE FUNDRAISING REGULATOR’S new Code of Fundraising

Practice took effect as of 1 November, following a six-month transition period. The code sets the standards for charitable fundraising across the UK. It is the first major review since 2019 and the most significant update to the code since the Fundraising Regulator was established.

The new code introduces new requirements on: • Convenience giving and unstaffed collections – donors must • always be able to identify the charity and understand how their • donation will be used.

• Fundraiser safety – charities must take reasonable steps to • protect fundraisers from harm and harassment.

• Fundraising platforms – platforms must be clear about how any • fees are added and tell donors how voluntary tips can be • amended or removed, providing a straightforward way to do that.

The requirements form part of a wider modernisation of the code, which has been redesigned to be easier to use, adaptable to future fundraising methods and supportive of innovation across the charity sector. The extensive consultation process involved hundreds of organisations and thousands of responses, helping to ensure the new code supports real-world fundraising practice while maintaining strong protections for the public.

Since the code was published in April, the Fundraising Regulator has provided support through new guidance and sector events – reaching more than 4,000 fundraisers and charity leaders.

A recent survey of UK fundraisers showed that 90% are positive about the new code, with 91% feeling the new code is clearer.

Lord Toby Harris, chair of the Fundraising Regulator, said: “Today marks an important step forward for fundraising standards in the UK.

The new code is clearer, easier to use and designed to reflect the realities of modern fundraising.

“We are grateful to the many charities and fundraisers who shaped these changes. Their input has helped us create a code that continues to protect the public, supports innovation and reinforces trust and confidence in charitable giving.

“We will continue to work closely with the sector to make sure organisations feel confident in applying the code and that fundraising remains legal, open, honest and respectful.”

Stephanie Peacock, Minister for Civil Society, commented: "The charity sector plays a vital role in communities across the country, and public trust is essential to its success. This updated Code of Fundraising Practice will help ensure that charitable giving remains transparent, safe and accessible for everyone.

"The new protections for fundraisers and clearer requirements around digital giving reflect the changing nature of charitable fundraising, while maintaining the high standards the public rightly expects.”

To help organisations adapt, a new digital version of the code has gone live on the Fundraising Regulator’s website at www.fundraisingregulator.org.uk/code. The Code Advice Service continues to offer tailored one-to-one support for charities and fundraisers with specific questions about the code.

More than 1,600 fundraisers and charity leaders joined a Are you code confident? webinar on 15 October to prepare for the new code. The session included a short quiz on key rules and practical fundraising scenarios, examples of how to use the regulator’s guidance, and a live Q&A. The high level of engagement reflected the strong commitment across the sector to understanding and applying the code in everyday fundraising. q

ANIMAL WELFARE CRISIS STRETCHES RESOURCES [CARING FOR UNCLAIMED stray dogs can be challenging – and the

rising numbers are having an impact on Hope Rescue’s already stretched resources. Most of these dogs have been deliberately abandoned and Hope Rescue has committed to never leaving a dog behind regardless of age, breed, health or behaviour. This means that many of the dogs that come to Hope Rescue need additional care, be that through veterinary treatment, behaviour and training support, or both.

Hope Rescue currently holds the local authority stray dog contracts for Rhondda Cynon Taf, Bridgend, Caerphilly and the West Side of the Vale of Glamorgan. They also commit to take in every unclaimed stray from the county boroughs of Merthyr, Blaenau Gwent and Torfaen, resulting in over 1,000 dogs a year entering the rescue centre.

DAME JULIA UNWIN has been announced as the government’s preferred candidate for the Charity Commission for England and Wales chair.

Culture Secretary Lisa Nandy said: “Dame Julia brings a wide range of experience and expertise to the role, having worked across both civil society and regulation. It makes her an outstanding candidate to be the chair of the Charity Commission.

“This will be a vital, public role to ensure that the Charity Commission’s independent regulation delivers high levels of public trust and confidence in charities.”

Dame Julia Unwin has had a long career, largely in the voluntary sector, and has also served on the boards of a number of regulatory and government bodies, including five years as a Charity Commissioner in the late 1990s. She was a member of the board of the Housing Corporation for nine years. She served as chief executive of the Joseph Rowntree Foundation from 2007-2016. She has had experience as a consultant, adviser, mentor and speaker in the voluntary and broader public sector.

Dame Julia chaired the Civil Society Futures Inquiry, which reported in 2018, and was awarded a DBE in 2019 for her services to civil society. As well as chairing the Board of Governors of York St John University, she is the inaugural chair of Smart Data Foundry, a subsidiary of Edinburgh University engaged with using private sector data for public good.

Under the terms of the Charities Act 2011, the appointment of the Charity Commission for England and Wales chair is made by the Secretary of State for Culture, Media and Sport.

Ministers were assisted in their decision-making by an advisory assessment panel, which included a departmental official and a senior independent panel member approved by the Commissioner for Public Appointments.

HESSILHEAD WILDLIFE RESCUE TRUST is situated near Beith, in North Ayrshire. It was set up as a charity in 1986, although its founders Andy and Gay had been caring for injured and orphaned wildlife since 1970, when they rescued a fox cub from a gamekeeper and his dogs. As the number of casualties increased year on year, Andy and Gay needed financial and practical help.

Once the trust was set up, new aviaries and enclosures were built. A membership scheme proved popular and many volunteers were recruited. The Centre now occupies a 20-acre site, including woodland, marsh and open water, this gives a variety of release sites for its patients.

Approximately 3,500 wildlife casualties are now treated each year, with the aim of returning them to the wild. Among the many hedgehogs, foxes and familiar garden birds, there are deer, otters, badgers and seals. In addition, swans are treated regularly, along with buzzards, peregrines, herons and sea birds.

The centre operates a 24-hour rescue service and there are more than 60 enclosures and aviaries, a hedgehog hospital, a seal/swan unit and intensive care facility. It also offers training courses on the handling, care and treatment of wildlife casualties.

Spring and summer are especially busy, with hundreds of nestling birds being hand reared. Care is taken to rear all youngsters with minimum human contact. That prevents wild birds and mammals becoming too used to people, so giving them a good chance of survival in the wild.

Hessilhead is primarily a voluntary organisation. Its volunteers help in many ways: fundraising, building and maintenance, driving patients to the centre and daily cleaning and feeding. q

THE CHARITY COMMISSION’S interim chair and chief executive issued an open invitation to its Annual Public Meeting on 9 December. Mark Simms and David Holdsworth, together with a number of their colleagues, provided updates and insight into the commission’s activities and answered questions about their work.

It was a hybrid event open to all members of the public and charity representatives who wished to attend in-person or join online.

Those attending in person, at RSA House in London, had the opportunity to visit exhibition stands and speak to members of staff both before and after the main meeting. q

CHARITIES UNDER INCREASING PRESSURE, RESEARCH FINDS [CHARITIES ARE UNDER increasing

pressure to meet growing demand for their services while facing continued rising operational costs, according to new Charities Aid Foundation (CAF) research.

CAF’s UK Charity Insights research with charity leaders found that 44% cited increased costs over the past 12 months as one of their main challenges. That is significantly more than the 30% who reported that in 2023 following the peak of inflation, and compares to 14% who listed it as a key issue in 2021.

The growing concern over operational costs comes as demand for charity services continues to rise. Over eight in 10 (83%) charities reported that demand for their services has increased, with 86% expecting demand to grow over the next 12 months.

With charities unable to pass on cost rises, the research finds the financial strain on the sector is affecting the delivery of services. Only 11% of charity leaders said that they have been able to smoothly meet the rise in demand, and 70% say they spend most of their time solving problems – with 30% of their time spent on strategic planning.

Less than a third (30%) of charities considered the sector to currently be in a

healthy position, and 42% were optimistic about its future. Financial pressures and funding cuts are the main reason why leaders think the sector is unhealthy.

Charities are also found to be operating within a precarious funding environment.

Over half (52%) of those surveyed said that they were not confident they would be able to cope with demand if they saw a decline in one of their income streams, rising to 63% for charities with incomes of less than £250,000.

Funding challenges for the sector also includes low levels of support from businesses. The research found that while 61% of charities received some financial support from corporates, less than one in ten (6%) said that donations from business was one of their main sources of income.

Chief executive of the Charities Aid Foundation, Neil Heslop OBE, said: “Whether it’s a local community cafe, cutting-edge health project or initiatives that transform the lives of homeless people, charities are central to our social fabric.

Yet their role has never been tougher.

With ever-increasing demand, inflationary pressures remaining and significantly fewer funding opportunities, charities cannot pass on costs and are having to do much more with less.”

CAF is calling for a co-ordinated, crossgovernment approach to charitable giving and philanthropy, and for the government to introduce policies that encourage donations to support charities. They include: • Using match funding schemes to multiply the power of government spending, including by rolling out place-based giving schemes that bring together charities, donors and communities.

• Requiring the FCA to embed conversations about giving into regulated financial planning frameworks and set out a plan for how all regulated financial advisers will receive training on philanthropy.

• Modernising Gift Aid to simplify administration and unlock unclaimed funds for charities.

• Requiring larger companies to report annually on their charitable giving.

• Allowing lifetime gifts to charity from unneeded pension pots.

The report also sets out ways charities can assess and build their resilience, including through diversifying their income streams and widening their networks. Donors can further their support to good causes by topping up their regular direct debits and payroll giving in line with inflation. q

TRUSTEES INVITED TO EMBRACE NEW GOVERNANCE CODE [A REFRESHED Charity Governance Code features a

strengthened focus on behaviours and inclusion. The updated code gives clearer guidance to help charity boards improve how they lead and make decisions.

The updated code sets out eight core principles for charity boards. It helps trustees think about how they work together, make decisions and manage risk. The new version puts more emphasis on board behaviours and culture. It highlights how ethics, decision making and inclusion support strong governance.

Compliance with the code is not a regulatory requirement: it is the Charity Commission and statute that tell charities about what they must do. The code draws upon, but is fundamentally different from, the Charity Commission’s guidance. It is a practical tool for trustees to encourage discussion about standards, behaviours and processes that are helpful in cultivating good governance.

Meeting the code’s principles and outcomes will provide strong assurance to external stakeholders that a charity is well governed.

How the code was developed

The code was created by a cross-sector steering group, with the National Council for Voluntary Organisations providing secretariat support. It draws on feedback from trustees, charity leaders and governance professionals.

Next year, an interactive online version will launch, with tailored case studies and resources for different sizes and types of charities.

Radojka Miljevic, chair of the steering group, said: “This is the most significant refresh of the code in eight years. We’ve added a stronger focus on the behaviours that sustain good governance and hope this

will help boards reflect and grow.”

Rosie Chapman, former chair of the group, said: “The refreshed code builds on strong foundations and takes the sector’s understanding of good governance to a new level.”

Using the new code

Charities are encouraged to start using the new code now. It helps boards review how they work and identify where they can improve.

Trustees should also include a short statement in their annual report explaining how they use the code.

The Charity Governance Code website explains: “How a charity uses the code may change over time, particularly where the charity is growing and changing. We recommend charities that decide to follow the code use an ‘apply or explain’ approach.

“This means charities seek to meet the principles and outcomes of the code and can either apply some of the proposed practices or explain what they do instead. This may also be relevant for charities whose distinctive governance features mean a different approach may be needed in some limited circumstances (eg certain membership organisations, faith-based charities or charities with a corporate trustee).

“Charities that adopt the code are encouraged to publish a brief statement in their annual report explaining their use of the code. This does not need to be a long list of policies or procedures – a short statement is fine.

“Some charities work in areas like housing and sport that have their own sector-specific governance codes. These codes may take precedence over this one. Charities are encouraged to state in their annual reports which governance code they follow.” q

KIDNEY KIDS SCOTLAND, a very small charity with a huge heart, has for the last 25 years supported Scottish children with renal and urology conditions. The main aim of the charity has always been to enable these children to receive treatment as close to home as possible and minimise disruption to the family unit.

In addition the charity helps hospitals all over Scotland, supplying them with much needed equipment and funding posts recognised as being essential. Chronic Kidney disease is a condition that has no cure and that children and their families must learn to live with.

OWL SANCTUARY WHERE CONSERVATION COMES FIRST [

ESTABLISHED IN 2001, the Suffolk Owl Sanctuary – known affectionately as S.O.S. – operates a comprehensive facility for the rescue, care and rehabilitation of owls and other birds of prey across East Anglia. It also promotes the need for the conservation of threatened raptor species throughout the UK with its Saving Britain's Owls initiative.

The S.O.S. Raptor Hospital at Stonham Aspal is unique in the region. It is specially equipped for the care and treatment of the many injured wild owls and other birds of prey it receives every year as a result of road traffic accidents, mishaps, starvation, trauma, disease, poisoning and sometimes even shooting or trapping.

Many of the birds can be given a recuperative, short-term pick-meup before being re-released into the wild, whilst those that are more seriously injured but stand a chance of recovery are given medical aid and/or surgery, as determined by their vet.

The birds are then allowed space and time to fully recuperate in one of the secluded recovery aviaries before being carefully returned to the wild.

S.O.S. operates a wild owl nest box scheme that includes building, locating, curating and repairing environmentally friendly nest boxes in appropriate locations to replace the gradual erosion of natural nesting sites.

S.O.S. is funded purely by donations and, as a small charity, the legacies it receives play an important role in enabling it to sustain the resources needed to actively promote the conservation of owls and other birds of prey throughout the UK. q

TOP 10 AREAS FOR ‘SUPER GIVERS’ REVEALED [NEW RESEARCH from the Charities Aid

Foundation has identified the 10 places with the greatest concentration of ‘Super Givers’: people who support charities in a multitude of ways.

In the UK, just over 1% of the population are classified as Super Givers – around 676,000 people. Those are people who have gone above and beyond to support charities in the past year, doing every one of the following: donate money, donate goods, volunteer, fundraise for charity and sponsor someone else’s fundraising efforts.

In those locations, the research found that 2.4% of residents on average fall into that category, exceeding the national rate by more than twofold.

Top 10 Super Giver Hot Spots are North East Hampshire, Wirral West, Surrey Heath, Mid Ulster, Hamble Valley, South Down, Reigate, Sefton Central, Maidenhead and Sheffield Hallam.

The hot spots appear to be centres for generosity in general, as they all have an above-average percentage of people donating to charity. In particular, Wirral West, Sheffield Hallam and Sefton Central are also in the UK’s top 10 for the average proportion of income donated to charity in 2024.

The proportion of Super Givers increases with age: over-65s are almost twice as likely to fit the

description than 16-24-year-olds (1.6% vs 0.9%).

Overall, almost half of all Super Givers in the UK are over the age of 55 (49%).

Women are also leading the way: 1.5% of women support charities in all the five categories, compared to 0.9% of men. That trend continues with age, with women over 55 forming nearly a third of that dedicated group.

Super Givers report a deeper sense of belonging, with 22% feeling a very strong connection to their local area: compared to the national average of 12%. Satisfaction with neighbourhoods is also higher, as 35% of Super Givers say they are very satisfied, far outstripping the UK average of 22%.

Acts of kindness and optimism ripple through those communities, with 76% of Super Givers agreeing that people in their area are generally kind, and 65% believing British people are generous overall.

While Super Givers say they have more opportunities to get involved in their communities than the average Brit, Charity Commission data shows that Super Giver hotspots are not necessarily areas that have a higher density of charities.

Philippa Cornish, head of giving at the Charities Aid Foundation, said: “At a time when charities are facing increased challenges and far

fewer people are regularly donating to charity, it’s vital to celebrate those who go the extra mile to support them.

“When people engage with charities, they feel more connected to their local area, more satisfied and more optimistic. So, for those who can’t commit to all forms of giving, contributing in just one of these ways is still incredibly valuable to both donor and charity.

“Championing the work of charities and their supporters, and creating opportunities for more engagement, will strengthen the bonds within communities and help to build the social fabric of our country.”

Lois Shrimpton, a retired person based in Surrey, supports numerous local charities.

She volunteers at the Stripey Stork baby bank in Reigate – one of the UK’s top ten Super Giver Hot Spots – as well as supporting a local foodbank and volunteering at her grandchildren’s school. Alongside her community of fellow volunteers, Lois has found all sorts of ways to give back, including organising discos and doing multiple fun runs.

Lois said: “Helping other people gives me a good feeling. To anyone wanting to get involved, I say go in, knock on charities’ doors and learn about what people are up to in your community.” q

CARING FOR CHELONIA [THE BRITISH CHELONIA GROUP publishes six newsletters

a year containing details of meetings, short articles, news items and veterinary notes. Their journal Testudo is published annually and contains original articles and reviews on all aspects of turtles, terrapins and tortoises – their biology, conservation, welfare, veterinary care and husbandry. The group also organises symposia.

As well as the yearly appeals in aid of specific international causes in chelonia research and survival, the BCG assists other worthy causes in support of its aims with grants. They invite grant applications from organisations and individuals engaged on the work of chelonia conservation – such as zoos, universities, zoologists and students in this country and overseas. q

RE-HOMING IS THEIR MISSION [THE MISSION of Three Counties Dog Rescue is to accept, care for

and find homes for unwanted, lost and stray dogs and cats and to ensure their wellbeing afterwards. The charity was founded in 1971 and since then they have improved the lives of over 7,800 dogs and cats.

Before rehoming, all animals are vet checked, neutered, vaccinated, microchipped and kept in suitable conditions. Rehabilitation costs are a major part of the charity’s annual expenditure of over £200,000.

Healthy animals are never put down. As part of that non-destruction policy, several elderly dogs are kept in long term foster care. However, this means that the charity can incur large veterinary costs to maintain a dog’s health while they await a new permanent home. They now provide boarding and cremation services with profits supporting the Rescue.

Every penny raised goes to improving the lives of dogs and cats. Three Counties Dog Rescue is run entirely by voluntary and unpaid helpers, who also meet their own expenses. q

WHERE WE’VE BEEN, WHERE WE ARE AND WHERE WE NEED TO GO [IN THE BEGINNING, The Fox Project operated from a garden

shed where, if they were hard pressed, two or three fox cubs might be under their care. Fast forward 34 years and you find them spread over multiple sites with an annual rescue total of over 1,400 foxes.

Currently, the operation revolves around a hospital unit in Paddock Wood near Tunbridge Wells in Kent and a cub unit at nearby Pembury – both rented – plus around 20 home foster units run by volunteers. The system works well, but capacity is reaching its limit and building their own hospital would allow the charity to bring together the main units with a small office, overnight staff quarters, storage space and a workshop.

While the hospital project is vital to their future, and to the futures of countless sick and injured foxes and orphaned cubs, they have no illusions that some of them will have more grey hair at the end than they started out with! Just finding a place to call home will be the first hurdle. Affording it will be the next.

Although the proceeds of a couple of significant legacies have been ring fenced for the purpose, the charity find themselves competing for land that keeps rising in value – and against housing developers and property investors who, inevitably, have more funds and resources available than they do.

in a tiny concrete cage on the side of a restaurant in Azerbaijan. Fed on srcaps of food from the kitchen or by curious tourists, they were malnourished and suffered physical and psychological issues as a result of their 13 years of confinement. They would chew on the bars of their cage out of desperation to escape and, as a result, Balu had to have two teeth removed.

Rescued by the Wildheart Animal Sanctuary, these bears now flourish in a purpose built sanctuary where they have 3,500 sq m of ponds, trees, streams and caves to explore, providing them with everything they need to live out their days in peace.

At Wildheart they work tirelessly to ensure forgotten animals, like Benji and Balu, have a second chance at life – one in which they are free from fear and distress. q

Assuming each animal would have twelve puppies a year, that has prevented well over two million unwanted animals being born since their inception in 2013! So, while being focused on helping animals in need wherever they can right now, their dream is to create a world where there simply are no more unwanted animals.

Alison added: “Education is a big part of our mission. If young people grow up with Odin before being rescued – and now in his forever home the same old attitudes that allow cruelty to

LEARNING FROM THE PAST CAN BRING GLAD TIDINGS TO CHARITIES’ CHRISTMAS CAMPAIGNS [

IN NOVEMBER the team at Enthuse circulated its annual Christmas Giving Insights report, providing an analysis of charitable giving during the festive period last year. The report gives details of giving during December, split into two ways of measuring – the amount given and the number of donations.

In terms of amount given, there has been a tendency recently for a relatively even distribution of giving. That, the report says, suggests that people are settled into their hybrid working patterns and the effects of COVID have very much faded.

“The best day for festive donations this year [2024] in terms of volume fell on December 12th, amassing 5.5% of the season’s donations. This is higher than the total of the best performing day last year (4.9%), which was on December 1st.”

When it came to the amount donated, the picture is somewhat different.

The introduction to the report explains: “Interestingly, while it may have been the best day for volume of donations, December 12th wasn’t the highest in terms of overall donation value. That crown went to December 3rd.

This underlines the importance of having Christmas campaigns switched on from the start of December.

“While the last days in the workplace before Christmas are still brilliant for fundraising, it’s not the moment in time that it perhaps was. Working patterns have permanently changed from the pre-COVID norm, and with the rise of digital fundraising there’s less reason for people to wait until Week 4 of December to make their Christmas donation.”

The Enthuse report is traditionally published during November to allow charities to use the information to fine tune their Christmas campaigns. For those who are still looking for last-minute ideas, Charity Digital has 10 top ideas for fundraising campaigns. They range from Giving Tuesday, which took place on 2 December, to asking potential donors – particularly businesses – to include your charity in their New Year’s resolutions.

Her journey has been incredibly tough, but we are happy to share that Dorothèa was rescued and now lives in a donkey sanctuary in Crete, where she is finally safe and able to live out the rest of her days.

But our work is never done. The challenges animals face don’t disappear overnight, and without support, many will continue to suffer.
