Poll Wagyu is backed by 42,850 carcasses across the 3 operations and 6000+ Polled carcases – our success is driven by commercial productivity.

The Hammond family of Robbins Island Wagyu in Tasmania, the de Bruin family of Mayura Station in South Australia, and the Hamblin family of Strathdale Wagyu in Queensland, joined forces in 2013 to create a genetic powerhouse. These highly profitable commercial production systems are the heart of Poll Wagyu, driven by some of the best in the world at producing the very thing that makes Wagyu special – carcasses. Carcasses that have high marbling, big EMA, heavy HSCW and high eating quality fat profiles.

Central to the success of each operation is monitoring the performance of progeny from birth to chiller assessment for continual

improvement. Animals are assessed on birth weight, growth, temperament, structure, and finally as a carcass. Cows are monitored for maternal traits and fertility, all operations using fixed time AI programs and culling on fertility. Now with Poll genetics, we are providing structurally sound animals and superior carcase performance with the additional benefit of no horns.

This commercial success is what gives us the confidence in the genetics we sell and the assurance that they are going to drive the operations who invest in them to new heights. All while having a positive impact on the Wagyu industry as a whole.

Herd Health Management for Poll Wagyu Evolution Sale 2025.

HERD HEALTH MANAGEMENT BULLS

• All bulls were born and raised on Strathdale Wagyu properties in Qld near Middlemount or Sarina Qld.

• The bulls were moved to Leyburn for the sale and fed a high corn silage and barley straw ration for sale preparation. As seen by the presentation of the bulls they have not been overdone and are ready to work if old enough.

FEMALES

• All females were born and raised on Strathdale Wagyu properties in Qld near Middlemount or Sarina Qld.

• The females have been on dry Leyburn natural grasses that have been frosted as seen in the images. Access to Lucerne hay in racks has aided their preparation to keep them in good forward store order without excessive fat deposition.

• The cows have had their calves weaned off them prior to the sale and they are due to calve again in September.

• The heifers are all un-joined.

PESTIVIRUS MANAGEMENT

• In 20 years, 2 complete herd examinations have been completed.

• Annually each weaner cohort has been screened by Swans Veterinary Services for Pestivirus Antibody presence. No presence of PI animals has been detected for more than 11 years. All animals are additionally vaccinated twice at weaning age and thereafter annually with Pestigard.

JOHNES MANAGEMENT

• The complete herd is J-BAS 7 across all 7 properties. Previously all properties were tested to J-BAS 8 standards, however since requirement has reduced, J-BAS 7 is now maintained.

CATTLE TICK MANAGEMENT

• 3 Germ Blood – Trivalent Tick Fever Vaccination given to all animals after weaning. All animals are bred and raised in tick area also.

• Tick pre-treatments were applied to all bulls and tick line clearance was attained prior to movement to Leyburn Qld.

• All bulls and females are currently located at Leyburn which is a tick free area on the Darling Downs Qld.

• All sale animals are suitably vaccinated and have been pre-exposed to live ticks to enable safe travel back to tick areas without risk of tick fever issues.

OTHER VACCINATIONS

• Ultravac 7 in 1 Vaccine given prior to and at branding with annual boosters. The vendor suggests Vibrio vaccinations be given by the buyer for bulls that will be used as live cover bulls.

BREEDING SOUNDNESS EXAMINATIONS

BULLS

• BBSE examinations and semen tests were carried out by Ced Wise AB Services on 22 July 2025 at Leyburn.

• Reports pertaining to the examination will accompany each bull and will be available on the electronic catalogue and the StockLive platform.

FEMALES

• Pregnancy test and general inspections were carried out by Ced Wise AB Services on 22 July 2025 at Leyburn.

• Semen morphology tests will also follow and be provided on the same platforms providing the younger weaner bulls supplied a suitable semen collection.

• Reports pertaining to the examination will accompany each female and will be available on the electronic catalogue and the StockLive platform.

• No females have ever been flushed or had IVF OPU carried out on them.

• Both cows have weaned calves every year since initially joined in a 2 chance AI breeding system with no cover bull

REGISTRATION INFORMATION

• WAll animals are 100K SNP tested and registered with the Australian Wagyu Association.

• Our catalogue has QR codes on each animal to allow fast access links to online photos, videos, AWA registration information and EBV's as required.

A pen of 7 animals is entered into the feedlot with all other competition cattle.

These cattle are then judged on feedlot performance, carcass performance, camera assessment information, overall value and taste-off competition by a panel of expert judges.

It's been a big 12 months since the last Poll Wagyu Sale, and the team at Strathdale Wagyu has been hard at work. The launch of our own beef brand has brought fresh energy to our program and strengthened our focus on producing high-quality cattle.

We've also made great progress with the continued development of our shedded feedlot, which proudly features our Poll Wagyu animals during our open day. On the genetics front, our commitment to breeding polled animals remains stronger than ever.

Introducing our own brand has only reinforced our belief in the polled Wagyu's ability to deliver elite carcase performance - with the added benefit of being horn-free. For the past few years, we've consistently used Poll sires across the herd wherever genetics allow, and that confidence is clearly reflected in the bloodlines on offer at the 2025 Evolution Sale.

Below is just a snapshot of some of the standout carcases we've processed this year... and every one of them came from polled animals.

Robbins Island Wagyu now has a herd that is comprised of 83% polled females. All horned animals are bred to polled bulls, and polled females are either bred to poll bulls, or proven horned bulls for genetic diversity. Consequently, every animal produced on Robbins Island is influenced by Poll Wagyu genetics.

We continue to sell our meat around the World. Our brand is respected and commands similar, or higher prices than the top tier fullblood brands. We sit at the pinnacle for Wagyu production outside of Japan – while doing it with Purebred Polls.

It is a credit to the collaboration of the 3 operations that the genetic quality of the polls stacks up at this level.

What a 12 months it’s been at Mayura. Our passion to elevate the quality of Wagyu beef in Australia has never been stronger. Mayura was awarded back to back class champion in the AWA Branded Beef Competition and was reserve champion overall for 2025.

We moved past 10,000 MIJ imaged carcasses in our genetic R & D program, performance proving many young sires. Our goal is to uncover the next generation of sires providing genetic diversity that our industry needs to move forward.

Our commitment to Poll Wagyu is rock solid as a genetic contributor and to provide important progeny testing of up and coming new sires.

Poll Wagyu Conditions of Sale

The sale will be conducted under the ALPA Conditions of Sale as applied by the Agents and is printed in the back of this catalogue. The following are Special Conditions applied by the Australian Wagyu Association (AWA) to generate a high level of quality assurance.

Poll Waygu Stud offer lots under the following conditions:

1. ALL LOTS ARE AWA REGISTERED AS PUREBREDS.

2. BREEDPLAN:

• Data published in the sale catalogue is current at the time of printing. Latest data is in the online catalogue.

3. BREEDING SOUNDNESS & GUARANTEES OF FERTILITY

• All bulls offered for sale have passed a semen fertility test by a registered veterinary surgeon and a semen evaluation certificate will be available.

GUARANTEES OF FERTILITY

BULLS:

All bulls are guaranteed breeders and to so prove within six months of the date of sale or by reaching the age of 24 months whichever date shall be later.

CLAIMS:

Claims under the above guarantees of fertility must be made to the vendor within six months from the date of sale and prior to the animal entering a quarantine area other than on the vendor’s property.

• Claims must be accompanied by a veterinary certificate which must clearly identify the basis of the claim.

• Infertility resulting from injury or disease occurring after the sale of the animal will not be covered by this guarantee.

• The vendor retains the right to have the animal placed on a property nominated by the vendor or returned to the vendor’s property for further assessment of fertility for a period not exceeding six months. In the event of the animal being proven fertile within the period, the costs incurred shall be borne by the purchaser. In the event of the animal not being proven fertile within the period the costs incurred shall be borne by the vendor.

LIABILITY OF A VENDOR:

• Except for costs defined elsewhere in the conditions of sale, the liability of a vendor in respect to claims relating to fertility shall not exceed the purchase price of the animal(s) or provide mutually agreed upon replacement animals.

REFUNDS:

• In the event of a claim being substantiated and the purchase price being refunded, the animal(s) shall automatically become the property of the vendor and be returned to the vendor or be disposed of according to vendor instructions at vendor’s expense.

• This guarantee is voided automatically if the animal is returned to the vendor in poor physical condition or with any injury as determined in the sole discretion of the vendor acting reasonably, or if tests carried out on behalf of the vendor within 14 days of return proved positive to any diseases which may affect the animals fertility or ability to breed naturally, or the purchaser admits that it has or the vendor forms the view acting reasonably that the purchaser has collected and stored semen from a bull or has performed super ovulation or flushed a female.

• In the event of a dispute as to whether a lot is a breeder, such dispute shall be resolved by the vendor and the purchaser and the auctioneer. While the auctioneer will use their best endeavors to assist, shall have no liability or responsibility in that regard. In the event that a lot is alleged or proved to be a breeder the purchaser shall nevertheless be obliged to pay the auctioneer the full price and any other monies or interest payable by the purchaser in accordance with these terms and conditions.

4. PRE-SALE INSPECTIONS:

• All lots will be available for inspection on the designated inspection days. See our website for information on Open Days.

5. GENETIC CONDITIONS:

• Results of DNA testing for specific genetic conditions appear in this catalogue which indicate the lots status and whether it is DNA tested free or ‘free by pedigree’, or a carrier of B3, CHS, CL16, F11 and IARS. Also, see AWA registration links provided on our website for genetic conditions.

6. BIDDING:

• The sale will be a live auction with an online interface through Elite Livestock Auctions allowing appropriately registered potential buyers worldwide to bid. Potential online buyers from Australia should register with elitelivestockauctions.com.au Special arrangements must be made by International Bidders with Kennedy Livestock who will provide a temporary Buyer password for this sale only.

7. INSURANCE:

• Ownership of a Lot changes to the Buyer at the fall of the hammer. Insurance is recommended and will be available at the sale.

8. EXPORT PROTOCOL:

• Availability of Lots to International countries is indicated and those buyers should check with authorities to ensure access to their purchases. Contact vendor/agent for latest eligibility for various countries. Check online for latest update.

9. TRANSFERS:

• Poll Wagyu will transfer the ownership of live Lots to the new owners at no cost to the Buyer.

10. FREIGHT and DELIVERY AFTER SALE:

• All live animals are at the vendor`s property. Freight is the Buyers’ responsibility to arrange and pay for. Delivery will not be approved until the Buyer has paid in full.

11. GST:

• The sale will be conducted on a GST exclusive basis and GST of 10% will be added to the sale price on the invoice.

12. RISK & LIABILITY RELEASE:

• Any person visiting Old Ellengowan Shearing Shed does so at his/ her own risk.

• Any person visiting Struggle Downs Feedlot for lot inspections does so at his/ her own risk

• All visitors release the vendors and agents from all actions or demands due do any loss, death, damage or injury occurring on the premises.

• The vendors or agents are not responsible and have no liability for any death or injury to any person or any loss of or damage to visitors, their property or otherwise.

13. HOW TO BID:

• Registered bidders can bid live at the on-property auction or online through www.stocklive.com.au or by telephone via a nominated agent/ third party approved by the Agents.

14. BIDDING VARIATIONS (PER LOT or PER ITEM): Lots will be offered for sale in the following manner:

• Live cattle: bidding is per Lot.

• Semen Lots:

1. Prospective buyers will bid on Lot 1A / 2A,

2. The winning bidder will have option to take Lot 1B / 2B at the same price,

3. Otherwise, bidding for Lot 1B / 2B will recommence at the current bid price to give the opportunity to another buyer.

His dam JKCPP0250 has produced 2 carcasses averaging a camera marble score of 12.3, while adding an average of 65kg carcass weight to the sire’s average. Her first calf weaned off with the heaviest weaning weight of the 700-calf drop.

Her grand-dam JKCPG876, we consider to be the most proven carcass performance Red Wagyu cow in the world. G876 has produced 71 carcasses, averaging BMS 8.8, HSCW 484kg, EMA 104. A super cow that not only performs on the hook, but has progeny with good doing ability, fantastic temperament, and females who milk highly and wean off the heaviest calves. In addition, the carcasses don’t have the excessive external fat typical of red wagyu genetics.

G876 genetics have been proven across both the Robbins Island Wagyu and Strathdale Wagyu herds.

A G876 x PWYPMQ182 steer in the 2021 Ekka Competition graded BMS 9+, Masterbeef 9.9, 501kg and WON the taste test for the entire competition including all Fullblood entries.

CE45’s sire – JKCPS0142 is a FX014 son out of PWYPN0826. N826 produced an MIJ 13.8 marble score carcass.

FX014 is renowned as a Red Wagyu bull who performs like a Black Wagyu. We have seen evidence of this, with FX014 progeny averaging Masterbeef 11.2 in the Robbins Island Program. We believe we have produced a polled red bull that carries the best traits of both breeds.

Sired by Mayura Notorious, a proven bull who adds enormous eye muscle area and fantastic marbling and fineness to his progeny.

However, his greatest traits are the immeasurable fat profiles he adds to his carcasses. His meat eats better. This is evident in Notorious being the sire of the champion carcass at the Australian Wagyu Association Branded Beef Competition both times progeny of his were entered.

His mother K0234 is an outcross poll cow from the Hammond’s herd. She was not focused on in the early days because she was sired by a backup bull. Once her data came through everything changed. Her first carcass was a 52% marbling (approx. camera marble 15) with a bull who averages 8.8. This carcass received the 3rd highest points at the 2022 Australian Wagyu Association Branded Beef Competition.

Combining proven carcass performance on both sides of the pedigree, all with the polled advantage. U71 is a bull that could change the industry.

She is a homozygous polled cow who produced the Grand Champion carcass at the EKKA 2024 carcass competition with a whopping 15.2 marble score. This carcass was sired by KKWFE0002 – who she is back in calf to. This calf will be polled.

For anyone in the Wagyu industry this cow capitalises on over 90 years of collective performance breeding from the Strathdale, Mayura and Robbins Island herds and catapults you to the highest end of all Wagyu performance. She is sired by Macquarie Discovery J20 – a bull sired by the famous G113. While we don’t have data on J20 himself, we do have data on 5 G113 sons through the Robbins Island Wagyu, Strathdale Wagyu and Mayura production systems. All bulls are performing exceptionally well. Bringing high marble as well as big weights and big EMA.

We are excited by this combination of J20 over a Midnight female back to G640. G640 is proving to be a very good cow, consistently giving high marbling carcasses with all sires used over her, heavy carcass weights and big eye muscle areas.

Last year she had 2 MIJ marble 12.2 carcasses through the Robbins Island Wagyu program. She also is the biggest original poll cow and has fantastic maternal traits.

Midnight females are still performing extremely well in the Robbins Island system – across 35 carcasses his females are averaging Masterbeef 10.3 marble. Consistently grading marble scores higher than the sire used over them averages.

Combining G640, 52Y, Midnight and J20 has given us a homozygous polled female that we believe is very balanced across all carcass and maternal traits.

This is the first time Poll Wagyu has offered a N654 progeny for sale. N654 is absolutely prized in our herds. He busted a shoulder when multiple bulls ganged up on him, only leaving behind under 150 straws of semen. He is a outcross for our programs, coming from an outcross Strathdale cow. Combining a sire stack of E10, Yasufuku Jr and TF147, bulls not represented highly in our genetics. E10 and Yasufuku Jr are at the top end for eating quality. Not only bringing abundance of marbling but also the unquantifiable fat profiles that separate high end Wagyu at the same marble scores. N654 is averaging Masterbeef 10.55 marble on 23 carcasses, this average includes lower content cattle, of which he is averaging a staggering 13.0 on 2 F3 and 9.63 on 10 F2 carcasses.

CF66’s dam U425 is sired by D507 out of a 52Y x G1463 cow. D507 is now world renowned for producing some of the best marbling and fineness of marble of any bull outside Japan. U425’s dam, L646 has had her heifers retained for breeding purposes, however her granddam G1463 has had 3 carcasses through the Robbins Island Program, all have been 9 or 9+.

While we don’t have data on J20 himself, we do have data on 5 G113 sons through the Robbins Island Wagyu, Strathdale Wagyu and Mayura production systems. All bulls are performing exceptionally well. Bringing high marble as well as big weights and big EMA.

We are excited by this combination of J20 over a Midnight female back to G640. G640 is proving to be a very good cow, consistently giving high marbling carcasses with all sires used over her, heavy carcass weights and big eye muscle areas.

Last year she had 2 MIJ marble 12.2 carcasses through the Robbins Island Wagyu program. She also is the biggest original poll cow and has fantastic maternal traits.

Midnight females are still performing extremely well in the Robbins Island system – across 35 carcasses his females are averaging Masterbeef 10.3 marble. Consistently grading marble scores higher than the sire used over them averages.

19. (a) Subject to the right of rejection in Clause 18, all conditions and warranties expressed or implied by law are hereby excluded from the sale to the extent that the law allows. All lots are open for inspection prior to the commencement of the sale and are sold with all faults, if any. No compensation shall be given for any faults, imperfections, errors of description, number in or of any lots sold or otherwise.

(b) Any claim or objection arising out of an error or misdescription in the provision of relevant information in terms of legislation or regulation concerning the National Livestock Identification Scheme (NLIS) must be made by 5:00pm on the seventh day after the fall of the hammer. No objection, requisition or claim against the vendor or agent in respect of such error or misdescription can be made after that time.

(c) Any statements made by the vendor or the auctioneer whether in writing or orally to the effect that any female has been pregnancy tested or scanned positive shall mean and require only that a certificate in writing shall be supplied to the buyer signed by a qualified veterinary surgeon or certified scanner certifying that the said female has been tested or scanned on the date specified in the certificate and that in the opinion of the surgeon or scanner was pregnant on that date.

(d) For slaughter cattle, the agent undertakes to make every reasonable effort to ensure that any NLIS cattle device number is transferred from the saleyard PIC to the purchaser’s PIC on the NLIS database no later than midnight on the day of the sale.

“companion animals” means all animals originating from the same property on a particular day. Where lots are split and sent to multiple establishments, then all of these animals shall be regarded as companions.

3. The following applies in interpreting these terms and conditions:

(a) The following words have the following meanings:

Fees means all levies, charges, fees, costs and other expenses incurred or relating to these terms and conditions and the sale and purchase of livestock including, without limitation, transaction levies, yard and weigh dues, cartage, advertising and rebates, and whether paid for, or incurred, by the agent;

Livestock means animals auctioned pursuant to these terms and conditions; and Price means the amount at which the lot has been sold to the buyer referred to in clause 7 of these terms and conditions

(i) plus any Fees and other expenses incurred in relation to the purchase of livestock that are payable by the buyer; and

(ii) plus any GST added in accordance with clause 12.

(b) These terms and conditions are subject to legislation or regulation in the State in which the auction is conducted and in the event of any conflict then the legislation or regulation will prevail. The provisions of these terms and conditions are in addition to, and do not derogate from, the duties and rights of vendors, agents and buyers set out in legislation and regulation in the State in which the auction is conducted.

4. Subject to any reserve price, and to the right, prior to the fall of the hammer, of the vendor to withdraw any lot without declaring the reserve, the highest bidder shall be the buyer

5. The auctioneer has the right to bid on behalf of the vendor provided that right is notified prior to the commencement of the sale and is subject to State law

6. A bid cannot be made or accepted after the fall of the hammer unless, in accordance with clause 8, the auctioneer decides to put the lot up again

7. Prior to the fall of the hammer the auctioneer shall announce the last bid and receive any further bids. The last price called by the auctioneer at the fall of the hammer shall be the amount at which the lot has been sold.

8. In the event of a disputed bid, the auctioneer is the sole arbitrator of the successful bidder or the auctioneer may decide to put the lot up again. The auctioneer’s decision is final.

9. The auctioneer may refuse to accept any bid which, in the auctioneer’s opinion, is not in the best interest of the vendor and need not give reasons for doing so.

10. A bidder shall be deemed to be a principal unless, prior to bidding, the bidder has given

(e) For other slaughter livestock the agent undertakes to make every reasonable effort to ensure that the NLIS information is transferred from the saleyard PIC to the purchaser’s PIC on the NLIS database no later than midnight on the day of the sale.

(f) Where livestock have a food safety or market eligibility status derived from the National Vendor Declaration (NVD) and/or the NLIS/ERP database, the agent will inform the buyers by presale catalogue and/or announce the status prior to the offering of those lots.

20. If delivery is made to, or possession obtained by, the buyer or its representative before full payment of the Price, then until full payment is received, the buyer:

(a) does not acquire title to the livestock;

(b) holds the livestock as bailee only for the vendor;

(c) must act in a fiduciary capacity in its relationship with the vendor;

(d) must store the stock separately or so that they are readily distinguishable from other livestock owned by the buyer;

(e) is responsible for the safety and well being of the livestock;

(f) may make a bona fide sale for market value of any or all of the livestock. As between the buyer and the subsequent buyer, the sale shall be made by the buyer in its own name and not as agent for the vendor, however as between the vendor and buyer, the sale shall be made as bailee and agent for the vendor; and

(g) must keep and account for the proceeds of any subsequent sale separately from its other money and hold those proceeds, together with the benefits of any rights against subsequent buyers, on trust for the vendor.

21. The purchaser agrees that:

(a) Clause 20 creates a registrable security interest under the Personal Property Securities Act (Cth) 2009 (PPSA);

(b) the Purchaser acknowledges the rights of the Seller (and/or the Agent if Clause 23 applies) to register a financing statement under the PPSA with respect to the security interest created by this clause;

(c) the Livestock are collateral for the purposes of the PPSA;

(d) to the extent permitted, the Purchaser waives any right the Purchaser has under the PPSA to receive notices; and

(e) the date upon which the security interest created by this clause comes into force is the first date on which livestock are delivered pursuant to this contract

22. The buyer may not make any claim against the vendor for actions by the vendor or its agent under clauses 20 or 21 and indemnifies the vendor and its agent against any loss, damage, costs, expenses, penalties, fines or claims suffered by the vendor, the agent or any person or entity arising from the vendor exercising its rights under clauses 20 or 21

23.1. Clause 23 applies whenever the agent pays the vendor before being paid by the buyer, which the agent is not bound to do. The agent is then the del credere agent of the vendor at law

23.2. The vendor hereby gives notice to the buyer of the assignments referred to in clause 23.3

23.3. When this clause applies, in addition to any rights of the agent that arise by operation of the law, the parties agree that, subject to clause 23.5 the agent is subrogated to all rights of the vendor under these terms and conditions against the buyer.

23.4. The vendor acknowledges that the agent may take enforcement, repossession or other action to recover any livestock for which the buyer has not paid in full, or the Price of such livestock, owing by the buyer under these terms and conditions:

(a) when this clause does not apply, as agent of the vendor (including by reselling the livestock); and

(b) when this clause applies, on the agent’s own behalf exercising the rights of the vendor by subrogation or assignment under these terms and conditions (whether in the vendor’s name or not) and, where title to the livestock has not passed to the agent, by selling the livestock as agent of the vendor without the agent having to account to the vendor for the proceeds of sale.

23.5. The agent may at any time, assign, transfer, securitise or otherwise dispose of all or any of its rights under these terms and conditions and any debts created pursuant to it (including, without limitation, the rights assigned to it under clause 23.3).

23.6. The vendor hereby irrevocably appoints the agent as the vendor’s attorney to: (a) do at any time and in any manner as the agent thinks fit all acts necessary or desirable to perfect or improve the rights and interests afforded, or intended to be afforded, to the agent under these terms and conditions; and (b) appoint one or more sub-attorneys to do anything that the agent may do as the vendor’s attorney.

23.7. These terms and conditions do not render the agent liable to the buyer as vendor nor entitle the buyer to set off against the agent any right the buyer may have against the vendor or otherwise.

(c) All livestock other than cattle sold on a liveweight basis are at the risk and expense of the buyer upon the fall of the hammer.

18. (a) Subject to this clause the sale is complete on the fall of the hammer.

(b) The time for rejection is the time commencing at the fall of the hammer and ending at the first of:

(i) delivery is taken by a representative of the buyer; (ii) departure of the animal from the purchaser’s delivery pen; or (iii) one hour after the last animal is: a. in the case of pre-sale weighing, sold; or b. in the case of post-sale weighing, weighed.

(c) During the time for rejection the buyer may reject any animal which is lame, blind or diseased where that condition existed prior to the fall of the hammer but could not be reasonably observed when the animal was in the selling pen.

(d) If the purchaser rejects an animal during the time for rejection then the sale of that animal is cancelled and the animal is returned to the vendor or sold on such terms as any buyer and the agent may agree after the agent has disclosed the reason for rejection to that buyer.

(e) This subclause applies only to cattle which are sold in Queensland at auction for slaughter. The agent has responsibility for the prevention of loss or escape (but not death, sickness or injury) of those cattle from the time of the fall of the hammer, for delivery to and from the scales, to the buyer’s delivery pen and onto the buyer’s nominated transport. This responsibility ends at the earlier of those cattle boarding the buyer’s nominated transport or sunset on the day after the sale. This

23.8. The buyer acknowledges that the provisions of this clause 23 are intended solely for the benefit of the agent (and its assigns) and the vendor. The liabilities and obligations of the buyer will not be in any way affected: (a) by this clause 23, other than as it expressly provides; or (b) by the failure of the agent or the vendor or either of them to comply with the terms of this clause 23.

23.9. The buyer must pay all amounts payable to the vendor or the agent under these terms and conditions without any deduction, withholding, set off or counterclaim whatsoever, whether the benefit of a deduction, withholding, set off or counterclaim is alleged to exist in favour of the buyer as against the vendor or the agent in any capacity whatsoever or any other person including any assignor of the vendor’s or the buyer’s interests under these terms and conditions.

24. (a) The agent agrees that he is liable to pay to the vendor the Price, less such commission as is agreed between the vendor and the agent, and in the absence of any agreement such amount as is reasonable and less the Fees that are payable by the vendor that were incurred by the agent on behalf of the vendor in relation to the sale of the livestock. (b) In the event that the buyer pays the Price or part of it direct to the vendor then the agent has no liability to
