ccording to the Washington Coalition for Open Government (WCOG), after reviewing a Bothell Reporter investigation, the Bothell City Council violated open meetings laws by discussing the potential purchase of Wayne Golf Course during a 2013 executive session, and then allowing the right of first opportunity to purchase the back-nine property to lapse

without taking the issue to a public council meeting.

“Any time you make a decision in an executive session, you’re almost always breaking the law, because decisions are not supposed to be made outside of public meeting,” said WCOG Vice President Michele Earl-Hubbard, who is also a lawyer for Allied Law Group.

According to the city, Earl-Hubbard is currently in litigation with the municipality concerning other open government issues.

The fact that the council

discussed more than just the sale price of the property and came to a consensus to not take action is a violation of state law.

“The executive session regarding property is… to discuss the price you are going to offer or the price you are going to accept; it’s not meant for making decisions whether or not to lease things, whether or not to buy things,” Earl-Hubbard said.

Bothell is full of many caring individuals. Nidhi Mehta Seth, Bothell resident and mother, recently hosted a dance-a-thon in Redmond to raise funds for cancer research.

Seth is from India, where women’s health issues are not part of public awareness, so she took it upon herself to raise awareness of cancer.

“I had heard about it and had supported other walkers’ fundraising [for the Susan G Komen three-day walk in Seattle] by donating, and I wanted to take the challenge and walk,” Seth said. “The more I heard about it the more I wanted to do it.”

like to do it,’ but there was nothing [no money],” said Bothell Deputy Mayor Del Spivey during the April 7 meeting. “No discussion to seek a consensus to come to the dais and make a motion to take any type of

“Growing up, I’d never heard anyone talking about breast cancer in India,” Seth said. “I don’t remember if my mom went for a mammogram or a checkup, or even if she was checking herself. At that moment, I heard about something and thought ‘if I do the walk maybe my aunts and cousins back in India will hear about it and will get more aware about…breast cancer.”

She feels that it’s still considered taboo to talk about breast cancer in India, but she’s making waves nonetheless.

McMenamin’s draws on city’s history for Anderson School building of Bothell will be forever entwined with the new McMenamin’s.

Each of the 72 rooms in the hotel is named after a former employee who worked within the Anderson School.

Local artists, such as Michelle Waldele-Dick, will have works of historic-themed art gracing the walls of the hotel and attached amenities. The old principal’s office is now a gathering area with refreshment bar.

“Wouldn’t you like to drink in class and sleep in class? Isn’t there an allure there?” Mike said. “There’s so much history in schools, the whole thing about families and traditions, so people love to come back to their school in a different sort of manner.”

And the stories have been coming out of the proverbial Anderson-School woodwork through people who used to attend class in the building.

“A lot of our connections have been through local citizens saying: ‘Hey, my old neighbor used to go there and has a story he wants to tell,’” Mike said. “Then the photos started coming out of people’s drawers and all the great stuff, that’s where it comes from. You can’t just snap your fingers and get that… to get deeper into the

stories you’ve got to go to the actual people.”

Much of the history of the Anderson School has been preserved and used around the hotel and its amenities.

According to Brian, the Bothell historians have been working to find the great stories of the Anderson School for several years.

“One of the main things that we like to get involved in are places that have histori-

cal value because of the deep reservoir of history that’s basically the soul of the place, you’ve got that connection.

Where people can come and see themselves in the old photos, or their folks, or relatives, or folks they know,” Mike said. “A school is such an intense people experience with all the families going through the school and all the hijinks that can be interpreted with the artwork. And all the stories that pop out, that’s really good stuff.”

At the north end of Bothell’s new revitalization project, the McMenamin’s Anderson School will be a big piece on the final redesign of Bothell’s downtown core.

“The community takes a sense of ownership in the school because it’s been here since the 30’s and they want to keep it,” Brian said, “that you hope is an important part of the community.”

hen McMenamin’s opens on Oct. 15, many Bothellites will have access to an entirely new experience, right in their own downtown.

The revitalization process of the old Anderson School, formerly owned by the Northshore School District, is less than six months away from being completed. The old junior high school will be a 72-room hotel, with bars in the old courtyard, a junglethemed pool area, a theater and more, all available to Bothell citizens.

One of the major aspects for citizens of Bothell will be free access to the newly renovated pool area. While it’s not going to be a traditional swimming pool, it will be an exotic place to go and relax for free.

“We expect a lot of usage,

we hope the whole town is in here at once,” said Mike McMenamin, who co-owns the company with his brother Brian. “We want to have a good ole party going on.”

There will also be a community room with a game room on the other side of the old wood-shop-turnedbrewery. Hotel patrons and Bothell residents will be able to use it for free.

The old gymnasium has been repurposed for multiple uses. Split into different areas, there will be a business meeting space, gathering space and a first-run movie theater.

The new brewery will have a 10-barrel system, serving up locally handcrafted beers, including the Hammerhead, Ruby and Terminator Stoutas. The brews are smallbatch and one-time brews to offer variety in the McMenamin’s Woodshop Bar. However, not everything will be new. The history

Element Residential will have to pay for the retroactive permits and the fees associated with not having those prior to the demolition. The fees and fines total nearly $2,000. No other punitive actions are being called for under Bothell municipal code. Element Residential will also have to apply for a permit to remove the cypress trees,

which were also reportedly removed without the proper permits. The Verde opened on March 7 and features the five and six bedroom craftsman­style homes priced from the

he city of Bothell municipal code violation concerning the historic buildings removed to construct the Verde, developed and owned by Mayor Joshua Freed's company Element Residential, was due to misunderstanding by the contractor, according to an April 15 city memo.

Contractors with Element Residential demolished the Harries house and water tower without the proper permits but Freed states that efforts were made to save the structures.

The issue began when a city of Bothell inspector at the Verde saw that a contractor, hired by Element Residential, had demolished the house and the water tower, according to a memorandum from city of Bothell Community Development Director Bill Wiselogle dated April 15 to members of the city council and city management.

"The contractor reportedly assumed that a demolition permit issued previously for another structure on the property, a garage, allowed demolition of all structures thereon," the memorandum states.

"A proposal to demolish a structure on the historic inventory normally would require submittal to the city of an analysis of potential alternatives to demolition, in addition to submittal of the demolition permit applications themselves."

The Landmarks Preservation Board stated in a letter to the city that they were not notified of

the demolition because the permit was not issued. Freed said that the Landmarks Preservation Board was well aware of the development plans and was involved in the hearing process.

It’s a bargain by any standard. This is Bothell’s way to preserve the land and the course and the enjoyment of the nature of our trail.

Unfortunately, there are surveyors all over the back-nine of the course at this time. They are mapping out the new development for the mayor’s new houses (Wayne Manor). Can you imagine taking down all those trees and grass?

What about the potential for slides down the steep hillside? The hillside is geologically unsafe and compromised. What about the wildlife and the salmon?

Even the new neighbors to the south of the course, in

their new houses, should want to preserve this land.

It’s the only open land left around here. It is not replaceable. How our own mayor could be part of a housing development on this beautiful course is beyond belief. If it is not preserved now, the developers with the pavement, roads and houses will win. We need to stop this disaster.

The golf course has been targeted for preservation by the city for 20-plus years, but the mayor (who has 20-plus corporations under his name), bought the backnine, with no discussion and no citizen input. There was no listing and the question of “insider-trading” has been referred to many times. KING-5 television also talked about the beautiful open space, and the aging golf course. When looking into the golf course, it became apparent that the course was “allowed” to age, gracefully, but to it’s detriment.

A couple of golfers were recently discussing the Wayne Golf Course. A few consistent comments came up during the discussion.

One golfer plays at Inglewood and the other golfer plays at Sahalee. The first comment was that the course was a great beginners course, and was even fun for experienced golfers. The other comments though, had to do with the amenities of the course. It was stated that the clubhouse is 40-50 years old, and that the parking lot is pure gravel, making it difficult for golf carts and bikes.

It appears that the management had not upgraded the “curb appeal” of the golf course for many years.

Each of these amenities (parking lot and clubhouse) are something that defines many golf courses in the area. Where to park your car, and the clubhouse, often becomes the “curbappeal” of the operation.

Besides the parking, weddings and many other special occasions are celebrated in the clubhouses of these courses. The lack of “curb-appeal” also becomes the reason to “fail “ for some courses. This allows developers to come in and purchase these beautiful areas for houses and condos, rather than upgrade the golf course. But then the city loses a valuable green space and asset as a golf course.

The USGA (United State Golfers Association), and the PGA (Professional Golfers Association), are great organizations because they actually attempt to keep these courses from developers and bring them back to their prime. They should have been contacted years ago to help the front- and back-nines, and the amenities of this beautiful course.

The entire golf course could be a very viable business in the Bothell area. In fact, the

need for public golf courses in cities is becoming a real problem. We may have forgotten that this “ Wayne Land” is also a golf course.

The original homestead owner, Joe Blyth, designed it more than 70 years ago.

It just needs some upgrades for all 18-holes. There are unique opportunities for a great clubhouse, with restaurant and bar as part of a newly designed clubhouse.

In fact, it could be a prime attraction for the thousands of people who pass by regularly on the Burke-Gilman trail. What a natural longterm plan for the golfers and the trail enthusiasts in the Bothell area.

There are high school golfers playing almost every day on the Wayne course.

Other golfers say it is a great course and enjoy the river, the boaters and the wildlife. Other golfers say that the lack of a “success-

In fact, there was no motion from the council for the next 45 days allowing the right of first opportunity to purchase to lapse. According to Earl-Hubbard that lapse is an action by the council, of which the public was not made aware.

According to Revised Code of Washington (RCW) chapter 42.30, also known as the Open Public Meetings Act, “action” is defined as a discussions or considerations of final actions and more.

“They clearly made a consensus about [the purchase of the back-nine]. I think that they broke the law and, it was more than just breaking the law, it is violating the trust of their constituents because they’re not supposed to go into closed session to discuss anything beyond those 13 means,” Earl-Hubbard said.

“I think they’ve acted illegally and really shortsightedly because they’ve caused their citizens to doubt them and mistrust them, and every decision you make in a secret setting is going to be one that your citizens will mistrust.”

Bothell City Attorney Joe Beck disagrees with EarlHubbard’s conclusion.

“No decision of any type was made and certainly no final decision was reached in executive session,” Beck wrote in a letter to the

Reporter. “Also, the council did not reach a consensus to act or not act that in any way constituted a final decision.”

Some of the 13 issues covered under executive session, RCW 42.30.110, include matters of national security, selection of property with likelihood of increased price, evaluate complaints made against public officers or employees and more.

Beck, who attended the executive session, said during the April 7 meeting that the council never discussed the price because the city also said that the council should, if any action was desired, take action in a public meeting other than letting the 45-day right of first refusal run out and did not discuss it again until 2014.

“I explicitly stated that and, as you have stated, the consensus was there’s no money,” Beck said during the April 7 meeting.

“Final actions,” according to the Washington State Open Meetings Act, are defined as a collective positive or negative decision by a majority of members on the governing body.

“The courts have defined final action as anything that is an attempt to get a consensus; it can be a straw vote, it can be a raise of hands: any attempt to reach a consensus of the body is a final action,”

Earl-Hubbard said. “Action is just considering, talking, discussing, deliberating; final action is when you actually start trying to get each other to a consensus agreement one way or the other.”

By agreeing there was no money to purchase the property, a consensus was made.

“Making a decision to let something run out is making a decision,” Earl-Hubbard said. “I think that what they did here, in making a choice whether or not to make this offer, absolutely broke the law.”

According to the Open Meetings Act, the only property-specific information to be discussed in executive session pertain to the cost of the property.

In Chapter 42.30.110, the portion of the Open Meetings Act regarding executive sessions, councils may go into executive session “to consider the selection of a site or acquisition of real estate by lease or purchase, when public knowledge regarding such consideration would cause a likelihood of increased price.”

Beck insists that the executive session was needed for that exact reason.

“The fact is that the open discussion of such sensitive issues and potential tactics did have the possibility of causing an increase in the

ultimate price,” Beck wrote.

“If the city’s strategy for acquisition were made known on any property the city would be severely hampered in acquiring property. Under the law it is sufficient that the council had valid reason to go to executive session, and they are not required to know for certain beforehand that open discussion will result in an increase in the ultimate price - they only need to believe that open discussion would result in a likelihood of increased price.”

Earl-Hubbard disagreed with Beck’s assertion, though.

“In this particular context, the developer already knew that they were on the short list,” Earl-Hubbard said. “I see absolutely no value in having a secret discussion about whether or not to exercise that option. You have that discussion in public, and then you can go back into your private, executive session to start talking about what its worth and what you’re willing to pay.”

“I think it is extraordinarily disappointing that the Bothell Reporter would use as fact comments from an attorney that makes a living suing municipalities,” said Councilman Mark Lamb.

The council is currently under investigation for its actions concerning Wayne Golf Course by the Washington

Cities Insurance Authority (WCIA) for potential conflicts of interest. A company associated with Bothell Mayor Joshua Freed has a purchase and sale agreement for the back-nine property.

It’s up to the council to allow for the WCIA report to be released publicly.

Many residents have stated at council meetings that the investigation is not truly a “third party” as the WCIA is paid by the city.

“It’s [an insurance] pool, established under RCW, and we’re a member of that pool,” Beck said to the Reporter.

“To the outside world it works just like an insurance company, but it’s a form of self-insurance.”

It’s through the WCIA that the third party investigator, an attorney, is being hired, though, the person has been pulled from a firm that has done work for the WCIA and member cities in the past. The entities within the insurance pool gather their money together so there’s financial backing for reserves and claims payments, or purchasing the services of attorneys.

“For pre-claim issues… generally speaking, as the risk manager for the city, I pick up the phone and call another person and we have a conversation,” Beck said.

According to Beck, conflict of interest in the world of municipal government is a specific term and only concerns involvement by an elected official in a decision on a contract in which they have a personal interest.

“I explained to my contact at the WCIA the issues that were involved and they agreed with me that it seemed like something that would fit within their parameters to have someone investigate it, to provide a definitive answer to the council,” Beck said. “It is not a conflict of interest [to hire the attorney through the WCIA], in my mind, because they are simply funding the investigation and are simply helping us find someone outside the city to do the investigation. It’s part of their service.”

It’s not known whether the executive session, during which the decision not to purchase the Wayne Golf Course was made, will be part of the final report concerning the possible conflicts of interest with Freed’s company attempting to purchase the property.

The city of Bothell’s master plan calls for the preservation of public open space.

In the same month that Freed’s company entered into negotiations with the owners of the golf course for the back-nine, the Bothell Parks, Recreation and Open Space Action Plan was updated to include obtaining the property rights to the back-nine course.

According to EarlHubbard, a citizen had notified the WCOG about the potential violation of the Open Meetings Act and the organization is also investigating the matter.

“The whole idea, the original idea I had in my mind…I thank my friends and all the flashmobbers [who] helped me achieve it,” Seth said. “Definitely seeing the whole vision come true, and seeing how happy we all were

performing, and how happy the audience was, was great.”

Nearly all of the $2,500 raised at the Dance in Pink event benefitted the Susan G. Komen Foundation, an organization concentrating on finding a cure for breast cancer.

Seth is already working toward the next events to help raise awareness about breast cancer, including an upcoming three-day, 60-mile walk for a cure - her fourth annual three-day cancer walk - and planning next year’s Dance in Pink community event.

Kenmore team members compete at USA time trials

ix Kenmore students, and members of the Cascade Canoe and Kayak Team, competed in the US Team Trials in Oklahoma City on April 24 and 25.

“It’s really exciting to have such a diverse group of athletes – able-bodied and para, who work so well together,” said Kenmore-Cascade team head coach Dan Henderson.

“Seeing young people grow and develop into powerful and confident people over several years and knowing that I had a part in that process.”

Junior Kayaker Ben Karlinsey competed for a spot on the Junior World Championships in Portugal in July.

If selected, pool athletes will participate in a camp to determine if they will be placed in single, double, or four-person kayak teams.

Paracanoeists Hannah Pennington, Spike Kane and Alana Nichols competed for Team USA positions in the upcoming World Cup in Duisburg, Germany. The World Cup is the first quali-

fier for the 2016 Paralympic Games, set to be held in Rio de Janeiro. After Duisburg, athletes will be classified by male or female and the extent of their ability to appendages.

Senior athlete Dough Ritchie and Emmanuel Bouchard competed for selection to the US Senior Team for the level of Senior World Championships, and hopefully the Olympic Games, for Canoe/Kayak.

The first qualifier for the 2016 Olympics, the Senior World Championships, will be held in Milan, Italy in August.

“One of the roles of a coach is to find ways to help athletes improve and become more competitive and the challenge of a diverse group is much greater than one that is more homogeneous – and it’s a challenge I really enjoy” Henderson said. “I get to wake up each morning with thoughts of helping athletes pursue their goals.”

According to Henderson, the athletes have spent hundreds of hours on the water since September, paddling in the cold rain and on warm, sunny days, for the opportunity. The students train

twice a day on the water, plus strength training and cardio off the water.

“To compete as an Olympian or Paralympian, one must train like an Olympian or Paralympian,” Henderson said.

And for those on the team, with training in hand, they compete like an Olympian or Paralympian.

According to Karlinsey, a junior hoping to qualify for the Junior World Championships, the athletes train seven times a week, with supplemental training off the water. He’s had five coaches contribute to his training and athletic character, along with support from family and friends.

“When I compete, I hope to perform on a level that demonstrates the support I have received from my team, family, and community. I view success as a product of both personal effort and community support,” Karlinsey said. “I have learned that an end goal that may seem daunting from the beginning can be achieved through daily effort and evaluation.

amount of effort put towards a goal can have little impact unless implemented correctly.”

While six members of the team competed in the US Team trials, there are more opportunities for students still in Kenmore. Children as young as 10 years old are able to begin training with basic instructions on boating safety to achieve their US

Olympic Team goals.

The Kenmore-Cascade staff has coached three members of the US Olympic Team, and the team practices out of the Kenmore Waterfront Activities Center at Squire’s Landing Park.

The Bothell/Kenmore Reporter requested the final results, but those were not available prior to deadline.

Kristina Hillesland has received a CAREER Award from the National Science Foundation Faculty Early Career Development (CAREER) Program. The CAREER Award is the NSF’s premier young investigator award, which integrates the investigator’s research and teaching.

This CAREER award is the third to be received by a UW Bothell faculty member over the last

three years Hillesland, an assistant professor in UW Bothell’s School of STEM biological sciences division, studies the interaction between microorganisms, with the goal of understanding how evolution affects and is affected by the interactions between species. She says this research can be the basis to understanding a great deal about evolution, “If we ever want to find or confirm general biological principles about species interaction evolution, we must consider microbes.”

Hillesland says the biological world is full of interesting traits that result from the interactions of one species with

another. For example, some microorganisms are known to be predators, others cooperate.

...obituaries H. Robert McAllister

H. Robert McAllister passed away on April 18, 2015 after a life well lived. Born at home in Seattle, WA on December 5, 1924, to William B. and Esther M. McAllister.

Bob graduated from Bothell High School in 1944 and served in Germany during WWII with the Army’s Company B 191st Tank Battalion. On August 20, 1949, Bob married Cecelia McKenzie and they built a life for themselves and their two children in Bothell. Bob spent 22 years as an auto mechanic. He then worked another 20 years as the Director of Transportation for the Northshore School District until his retirement in 1988.

During that time he was member of the Masonic Ashler Lodge of Bothell, The Scottish Rite Temple in Seattle and the Shriner’s Nile Temple of Seattle.

Bob enjoyed spending time with his family, and they joined him on his many adventures: RVing, fishing, hunting, bowling and camping. He also made time for woodworking and taking expert care of the yard.

Bob was preceded in death by his parents and brother:William M. McAllister. He is survived by his wife Cecelia McAllister; son Robert (Terry) McAllister of Everett, WA and daughter Denise (Gary Broad of Yuma AZ; sister Lois (Wallace) Wickland of Bothell; 2 grandchildren: Stefanie Broad of Auburn, WA and Gavin Broad of Renton, WA: and 3 great-grandchildren Natalie Potter and Rachel Potter of Auburn, WA and Lyric Broad of Renton, WA, plus numerous nieces and nephews.

All services at Acacia Memorial Park in Seattle. Visitation was held on Thursday, April 23rd from 12:00 pm – 5:00 pm, and Funeral Services were on Friday, April 24th at 10:00 am.
