I was told there is a new 3.8% real estate tax on any new home sales because of Obamacare. Is this true?
M.J. – San Juan Island
Hi M.J., The recent healthcare legislation passed did not impose a 3.8% real estate tax on home sales. It did, however, impose a 3.8% transaction tax on proﬁts over the capital gains threshold. In the Affordable Care Act, there’s a new Code Section 1411. This imposes the 3.8% Medicare Tax on investment income beginning next year.

First; this tax will be imposed only on individuals with annual incomes over $200,000 or couples with annual incomes over $250,000. This is only about 3% of households. Second; the 3.8% tax will apply only to the amount of capital gains OVER the threshold, which is $250,000 for a single person or $500,000 for a couple. So, if a couple making more than $250,000 per year sold their house and made a proﬁt of $600,000, they would be required to pay the additional 3.8% tax on the gains realized above the $500,000 threshold, or only on $100,000. So, it’s not a tax on all real estate sales. This Medicare Tax will likely affect only a small percentage of home sellers in 2013. – Gary

Hi D.R., Yes, there is. As of April 1, if you are selling a home in Washington State, you are required to have Carbon Monoxide detectors installed: (a) on each ﬂoor, and (b) outside each sleeping area. You know, there have been plenty of studies done comparing homes for sale by owner and homes for sale using a real estate professional. By a large majority those sold with a Realtor(c) sell for more money in a shorter period of time. – Gary
