In the moment A day before President Rodrigo Duterte was to give his first State of the Nation Address (SONA) on July 25, Communications Secretary Martin Andanar said the speech was so moving that it made him cry. He also said it would be fairly short, around 38 minutes, and that there would be an announcement that would make people fall off their seats.

As it turned out, Duterte decided basically not to follow the script and gave an hour-anda-half speech that — depending on whether you are a fan or not — was either the best or the worst SONA ever delivered.

Duterte actually stuck to the speech during the first part, but he apparently got bored after a few minutes and decided to take matters into his own hands.

Critics say he lost an opportunity to connect with the people and present his programs in a clear and concise manner.

But supporters — and based on a recent Pulse Asia survey, the vast majority of the people are in this

category — say by being himself, he actually delivered the message in a way no other President has ever done, or could ever hope to do.

As someone who followed him during the campaign period and heard almost all his speeches, I can say that Duterte kind of reverted to campaign mode in his SONA. He was simply talking to the people, and in many ways he talked above the heads of the members of Congress whom he was supposed to be addressing.

He probably saw that the speech, as written, would be lost on the people and so he decided to deliver it as if he were talking to a crowd in Pandacan, or in Leyte, or in Maguindanao – minus the cuss words, of course.

But the result was that the people did not get to hear exactly what it was that made Andanar cry. Because of the absence of drama in Duterte’s SONA as he delivered it, Andanar became the subject of ridicule, so much so that he had to issue a reply: ‘‘The emotional moment

is a very subjective one, Prof. [referring to political analyst Antonio Contreras] There are issues that I’m passionate about that were mentioned in the speech; unilateral ceasefire (no amount of medals or cash gifts will compensate for lost lives), no separation between God and State, Muslim and Lumad TV, task force against media killings.”

He also said Duterte’s quote, “And the Filipino, disciplined, informed and involved, shall rise from the rubbles of sorrow, apathy, and pain so much that all mirrors of the world will reflect the face of a passion that will change this land,’’ was emotionally charged. ‘‘Again, we all have our own ways and biases,’’ he said.

Personally, I actually teared up a little when Duterte announced that he was declaring a unilateral ceasefire with the New People’s Army (NPA). For me, that was enough to justify Andanar’s preview/review of the speech.

I also rather enjoyed the speech because it was like listening to him during the campaign; it was honest, raw, and in the moment. *** Just a few days after Duterte’s declaration, members of the NPA ambushed a Citizen Armed Force

Geographical Unit (CAFGU) in Davao del Norte, killing one militiaman and injuring four others. A disappointed Duterte gave the NPA until midnight on July 28 to give its side on the ambush or he will back out from the peace talks.

“Are we into this truce or are we not? Give me an answer until tonight otherwise balik tayo sa away [we’ll go back to fighting],” Duterte said. “If we cannot honour a ceasefire, let’s just fight!” he added. He also told the military to stay on alert and be ready to protect the people.

One of Duterte’s campaign promises is that he would seek to end the decades-old rebellion both by the NPA and the Moro Islamic Liberation Front. He has already approved a master plan for peace designed by Presidential Adviser on the Peace Process, Secretary Jesus Dureza, and the peace talks with the communists will resume in August. But that does not mean he will sign a peace deal at all costs; he still demands that the rebels follow previous agreements and honour ceasefires. Otherwise there would be no sense in talking at all.

DU30’s first 30 There were some surprising images circulating on Philippine news sites after President Rody Duterte’s first State of the Nation Address (SONA). Breaking bread with militants? Bagong Alyansang Makabayan (known as Bayan, an alliance of militant organizations) not burning an effigy of the President, and not holding an anti-government protest, but rather a “love fest?” As if this didn’t make my whole world topsy-turvy enough, photos of the Director General of the Philippine National Police, Ronald Dela Rosa, visiting and shaking hands with Renato Reyes Jr., the Secretary General of Bayan, were not nearly as unexpected as hearing that, after Bayan’s SONA rally, the president himself had merienda with militant leaders traditionally in opposition to the government.

This breaking of bread shouldn’t be too much of a surprise, though, considering that President Duterte met with jean-clad Bayan leaders (it is traditionally prohibited to wear blue jeans in Malacañang Palace) after taking his oath of office. A photo was taken of this meeting that I will never forget: President “Digong” raising his fist, apparently in solidarity, with militant leaders. The raised fist

is a symbol of the left movement globally, of groups the world over fighting for the people and against government abuses that lead to suffering. Meeting with Bayan immediately after his oath of office and after his first SONA – in addition to the fact that he has appointed many leftleaning officials to government posts – indicates the different tune that DU-30 has taken up with his presidency.

I admit that I was not a Rody Duterte supporter, however hard it was to deny the certain appeal he had with people. During my most recent trip to the Philippines, less than two months before the 2016 election, I saw a much more excited political environment than I did when I visited in 2011.

At the Charaptor restaurant along Seaside Boulevard in Manila, the TVs were not playing sports; they were showing the presidential debates, and I was surprised at the amount of people who had gathered to watch. This election grabbed a lot of attention, partly because of the figure of Duterte, a man who had become popular for his “cleaning up” of Davao City and his aversion to the establishment and status quo of the Philippine government. His calls for cleaning up crime and government corruption no doubt

struck a chord with the masses of the Philippines, and unlike other politicians, he had his record in Davao to give him an air of legitimacy. However, there are a few things that make me nervous about the figure of Duterte.

In my discussions with friends and family about DU-30, it was often stated that he had cleaned up Davao City of crime – as if he would be able to do this with the rest of the Philippines. His claims to this end have been challenged multiple times, as well. Duterte’s rallying cry was that he would end crime within six months of taking office and he would order the killing of criminals. After his May 9th election, the deaths of suspected drug runners and drug lords spiked, although a large percentage of those killed have been drug pushers, often those living in poverty. And, let’s be clear, “suspected” is the key word here to describe these criminals who are never proven guilty; summary executions go against the basic human right to a trial.

When the United Nations Human Rights Council issues a warning to Philippines about these killings (as well as those of journalists), the world should take notice.

There appears to be little sympathy for the victims of these killings from the general population, however, and it might be hard to argue for the rights of a criminal. Yet, there are a few issues that this brings up. The first is that in a democracy, the right to a trial is a basic tenet. There have been too many instances of police

planting evidence on the dead bodies of suspected criminals to forego a judicial trial where one may answer for evidence presented against them. Duterte’s so-called “Death Squads” are thus an affront to democracy. Many complain that “due process” has failed in the past – but it is not the process that has failed, but corruption and inefficiencies.

Now, Duterte has said that his big problem is the people, the mass of Filipinos living in poverty, and that poverty and crime are related. But his thinking is backwards: crime does not create poverty. Drug runners, dealers, and other “low level” players are often forced by economic conditions or by strongmen to engage in crime to survive. If they had gainful employment and the sense of self-esteem that comes with a legitimate day’s work, the incentive of crime would be reduced. Cycles of crime are systemic. They require economic systems that cannot offer decent jobs to those who become involved in creating and selling drugs. They require families living below the poverty level who often turn to drugs as an escape from their harsh realities. This system is present in the Philippines, and is made worse by the fact that many police officers are involved in the drug trade. Indeed, one of Digong’s first official moves in his war against drugs was to suspend five PNP generals and accuse them of fostering drug lords, and he put the entire PNP force on See MALEK p5

And, just before this went to press, I discovered that the Quezon City Police Department has sacked 88 police officers for involvement in drugs – 35 that were part of the District Anti-Illegal Drugs Division. That is how deep rooted the problem is. It is not just the drug runners or dealers because these players are of so little consequence ultimately. This is not a defense of criminals’ actions, but a plea to battle the true roots of such crimes Before DU-30’s inauguration, a major drug-lord in Cebu was killed in a police operation, with one news outlet reporting that residents “wept in distress” because he had been such a big benefactor of the community. Of course, he would give out money and engage in charity to guarantee residents would turn a blind eye to his actions, but his role as a community benefactor indicates not only that the government

PILIPINO EXPRESS couldn’t stop him, but also that local residents came to rely on him for support – suggesting they had lost faith in local government.

Many things need to change, and this is going to have to be a topdown effort. The failed “war on the drugs” in the U.S. has largely demonstrated this.

Duterte appears to be a man of the people, and much of what he and his cabinet has done in his first thirty days in office has given me hope for his presidency. This extends to his cabinet, including Gina Lopez, the environment secretary who has wasted no time suspending mining licenses and ordering an audit of all mines in the Philippines, many foreign owned (including by Canada).

But the Philippines faces an added challenge in its long struggle with drugs and crime.

History has countless examples of what happens when laws and human rights (protected by law) are flouted in the name of fighting crime, and I don’t think I need to list examples. Countries that have low levels of drug-related crime have a few things in common,

such as treating addicts as patients not criminals, and campaigns that target the root causes of crime.

One can condemn the drug trade and insist on due process – maintaining this in tough times is what makes a nation great.

It is no easy task that DU-30 faces, but, as a man of the people, I hope that he realizes the roots of these problems and addresses them: improving the economy; implementing policies that do not benefit the wealthy, but the poor; revitalizing the Philippine economy and manufacturing industry, even if it will bring growing pains; eliminating

PAGE 5 corruption; and working with all levels of Philippine society to create a nation that works for everyone.

Excluded relationships and family sponsorship Does it seem at times that everyone has an opinion about family class immigration? This should not surprise anyone because all newcomers, from the Philippines for example, have some firsthand experience with Canadian immigration.

Many have followed the law and program guidelines and have experienced minimal problems immigrating to Canada. Then there are the others who have experienced all manner of problems and challenges.

My topic is the question of what happens to people who lie about their marital status or do not disclose biological children and then later want to sponsor them under the family class.

This question is not uncommon and the spectre of the “secret marriage” or undeclared children remains a defining characteristic of applications from the Philippines. Why else does IRCC request National Statistics Office (NSO) stamped and authenticated CENOMAR or Advisories on Marriages?

Undeclared relationships and children represent a major challenge for the families concerned as well as for the licensed immigration

consultants and lawyers who are hired to help out.

First, all readers should understand that in the immigration world there is no reward for telling lies or misrepresenting your status. The “obligation to answer truthfully” is set forward in the Immigration and Refugee Protection Act and Regulations: “a person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires,” IRPA s. 16(1). A failure to honestly disclose marital status or biological children can have a negative impact on not only the person you are trying to sponsor under family class, but also on the sponsors themselves, if they have lied.

The non-accompanying family members who were not disclosed on an application for permanent resident will become an “excluded relationship” and someone who cannot be sponsored to Canada. “A person shall not be considered a member of the family class by virtue of their relationship to a sponsor if

…(d) subject to subsection (10), the sponsor previously made an application for permanent residence and became a permanent resident and, at the time of that application, the foreign national was a non-accompanying family member of the sponsor and was not examined,” IRPR s. 117(9) (d). This is not good news for the applicant and runs counter to the bad advice given to many applicants to not worry about secret marriages or children until you are landed in Canada. Sound familiar? The marriages are not secret nor are the children. The problem could have been avoided by telling the truth.

This does not mean that there is no hope at submitting a sponsorship of an excluded family member. It can be done but it comes with risks. First, there is the question of disclosure because the sponsor must reveal that he or she failed to include the applicant in their application for permanent residence and this opens them up to inadmissibility challenges on the grounds of misrepresentation under IRPA section 40. Yes, permanent residents and even Canadian citizens can be challenged on lies they told in the past – in this case, relationships or children they failed to mention.

John Feliciano: Culinary Olympian

By Judianne Jayme The Filipino Food Movement has taken the world by storm with pop-up dinners and restaurants featuring Filipino food (with innovative twists and fusions) happening everywhere you look.

Filipino chefs are really taking the spotlight in the wider community, and are entering various highlevel competitions. I’m sure we have all heard of or watched our own hometown Filipino standout chef, Jeremy Senaris, and his rise to the first runner up position in Masterchef Canada.

One local chef to keep an eye on is John Feliciano, currently

the Executive Chef of the Glendale Golf and Country Club.

Feliciano is a member of the Canadian Culinary Federation (CCFCC) and he has an evident taste for culinary competitions, including the 2010 Centrex Iron Chef competition in Winnipeg.

Early on in his career, this drive for competition earned him five Gold medals, four Best in Category awards and a Top in Show award at the annual Local Culinary Salon in Manila. He has recently gone to the international level of competition representing Culinary Team Manitoba at the 2012 Culinary Olympics, which was held in Erfurt, Germany. He

will represent Manitoba once more in this year’s 2016 Culinary Olympics.

Catch Chef Feliciano in action at the upcoming Foodo-rama event at the Philippine Canadian Centre of Manitoba (PCCM). He will be present at the Kusina Showdown on August 7th at 12:00 p.m.

As a member of the CCFCC, he has taken on the role of mentor to other up-and-coming young chefs making their mark on in the culinary arts. A full feature on Feliciano and one of the students he mentors will be available in the next edition of Pilipino Express.

On the other hand, the sponsorship of the family member who appears to be a member of an excluded class can be mitigated for humanitarian and compassionate considerations, under section 25 – especially the “best interests of the child.” There is no guarantee that such an explanation will satisfy immigration authorities but this is an opportunity for the applicants and sponsors to explain themselves and convince immigration authorities that they deserve special consideration or exemption from the exclusion definition.

If the applicant was unaware, as many are, of the options open to them, then there is a strong likelihood that the outcome will be a refusal decision. However, Immigration does give the Canadian sponsor a chance to appeal the refusal under IRPA section 63(1), but the grounds for appeal are very limited.

Any appeal must be submitted to the Immigration Appeal Division (IAD), which has the authority to hold a hearing in a location closest to the sponsor, but the reader must be mindful of the limited grounds on which an appeal may be filed. “IRPA section 67 (1) to allow an appeal, the Immigration Appeal Division must be satisfied that, at the time

the appeal is disposed of, (a) the decision appealed is wrong in law or fact or mixed law and fact; (b) a principle of natural justice has not been observed.” If this looks daunting, consider the limited time the sponsor has to respond “no later than thirty days.”

What should we learn from the above? First, it is important not to lie on any immigration application. Second, if the sponsor has lied, then he or she should get good advice before submitting the sponsorship application.

There are chances within the law, depending on each case, but these must be explored carefully and presented. If the submission has already been challenged or refused is even more reason to get help. It would be advisable to engage the services of a licensed immigration consultant or immigration lawyer on these matters. It is easy to put yourself in trouble, but no so easy to get out.

Pinoy iron men represent Manitoba in gruelling races Four Filipinos represented Manitoba in two separate Ironman competitions in Alberta and British Columbia on July 24, 2016. Paquito Brucal, Armand Siapno and Norman Garcia competed in the Ironman 70.3 Calgary race (1.2-mile swim, 56-mile bike, 13.1-mile run) while Ferdinand Del Rosario competed in Ironman Whistler (2.4-mile swim, 112-mile bike, 26.2-mile run). They are all members of the Winnipeg-based Sulong Triathlon Group.

Ironman triathlon races are considered one of the most difficult one-day athletic events in the world.

Paquito Brucal said, “After months of training and one long, gruelling day, I finally reached the finish line. Who would have thought that I could race in all these disciplines on the same

day? I’m still surprised about everything.”

Armand Siapno said, “I was emotional when I crossed the finish line because it was a celebration of countless hours of preparation over the span of two years. Also, my entire family was there to cheer, including my dad who flew all the way from the Philippines. It was my dad who taught us the importance of having a goal in life and to do everything to fulfill it. Never in my wildest dreams did I think that I could finish this Ironman 70.3 race.”

Ferdinand Del Rosario said, “I tried this because despite its constant reminders of my limitations, it also shows me the amazing things I can do once I overcome them.”

All four triathletes have plans to compete in other Ironman races all over the world.

The phoenix footstool – the feng shui symbol of material comforts and success In feng shui, the ideal position for a house embodies what’s called the “armchair” position.

This position has a rise at the rear of the house, and the left or east side of the house is higher than the right side of the house, as you are looking out from the front of the house.

Many feng shui devotees know about the importance of the supportive cosmic tortoise that is represented by the rise at the rear of the house. This rise gives support, like the back of a chair, so that the residents have opportunity in their lives.

But one of the areas of the home and your environmental feng shui that’s often missed is the position of the phoenix.

And it’s this position and portion in the landscape that creates the relaxation that comes from having enough money, prestige and success – and why it’s so important to activate!

The phoenix is the fabled bird that can burn and then regenerate from its ashes. It symbolizes success and the ability to rise again after difficulties.

But in feng shui, the phoenix is represented by the area at the front of your home. This portion of your home or garden is in the front of the house and should be lower than the rise at the rear of the house.

What’s most interesting is that the phoenix isn’t simply represented by flat land. It’s also represented by a small mound of earth or even a small boulder at the front of the home. It symbolically represents a footstool.

Think about when you relax

how you will put your feet up. This is what we want for your home – the ability to enjoy the kind of success that allows you to relax and put your feet up.

This is often represented by a nicer car, pretty clothes, relaxing vacations where you really do put your feet up and relax and savour your success!

It’s also one of the reasons why you want the area in front of your home to be open and able to attract the chi of success. The phoenix not only represents success, but the ability to purchase those material things that represent success – and the relaxation that comes with success.

The phoenix represents not having to work so hard because you’re recognized for your efforts.

If you’ve ever been in a job and felt like you had to shoot off a roman candle to get someone’s attention, you know what I’m talking about. The person who receives recognition has opportunities brought to them – and that’s relaxing all by itself!

Bakit daw kailangang talikuran ni Marian ang maganda niyang career? Puwede raw naman niyang pagsabayin ang pagiging ina at artista.

Pero sa isang banda ay positibo ang desisyon ni Marian na tutukan si Baby Zia sa mga panahong kailangang-kailangan ng isang anak ang buong atensiyon ng kaniyang magulang.

Minsan lang maging bata si Baby Zia, isang araw ay magugulat na lang tayo dahil dalagita na pala ang kaniyang anak. Ganoon kabilis lumipad ang panahon.

Kaya habang lumalaki ang anak nila ni Dingdong ay gusto niyang maibigay kay Baby Zia ang lahat ng pangangailangang pagmamahal at atensiyon nito.

Hindi madaling matatanggap iyon ng mga tagahanga ni Marian Rivera, pero kung talagang mahal nila ang kanilang idolo, dapat ay tanggapin at respetuhin nila ang desisyon ng atkres.

Para kay Baby Zia ang kaniyang desisyon, hindi para sa kaniyang sarili lang. Gusto niyang lumaki ang kanilang anak ni Dingdong sa kaniyang bisig at hindi sa yaya.

At hindi naman siya permanenteng magpapaalam, pansamantala lang iyon, habang ginagabayan niya ang kanilang anak ni Dingdong.

Pero ayon sa mga nakausap naming impormante ay naging maayos ang kanilang usapan, walang dudang nakaplantilya na ang mga gagawing shows ni Kris sa Dos, kasama na rin sa kanilang usapan ang mga pelikulang gagawin niya sa Star Cinema.

Marami mang naiinisnaartehan sa aktres-TV host ay mas maraming kababayan natin ang nakaka-miss sa kaniya sa telebisyon lalo na sa umaga.

Sabi nga ng kaibigan naming propesor na matagal nang tagahanga ni Krissy, “Ilang buwan nang hindi kumpleto ang bawat umaga ako dahil sa absence ni Kris. Nasanay na kasi ako na siya ang unang-una kong pinanonood everyday.

204 Filipino Marketplace Family Fun Day 204 Filipino Marketplace (also known as 204FM) is a Facebook group that connects Filipinos in Manitoba in a virtual community. It started in November of 2015 and has since grown to almost 21,000 members. 204FM serves as venue for members to interact by exchanging ideas, sharing experiences, and posting news about businesses. It was named “Marketplace� reminiscent of the palengke or wet markets in the Philippines where people go for fresh goods, to interact with all kinds of people, hear the latest news, and chat with old

friends.

The group held its second get-together on July 17th at Kildonan Park. Some 500 members arrived bringing food for the potluck fun. Nangako ang mga opisyal ng Philippine Consulate mula Toronto, Ontario na sisikapin nilang kada buwan ay narito sila para sa kanilang outreach services program sa mga Filipino dito sa Manitoba. Naroon ako noong nakaraang ika-16 ng July, una sa tatlong araw ng outreach na ginawa sa Holiday Inn, sa Elice at Century.

Sinamahan ko ang isang kababayan na hindi raw niya alam ang gagawin dahil wala siyang balitang nabasa or narinig sa radio tungkol sa outreach? “Bakit nga ba gayon?” tanong ko sa unang opisyal na nakausap namin. Sagot sa akin, nasa website daw. Iyon ang utos ng kanilang bossing.

Kaya lang, paano kung walang computer o hindi alam maginternet? Sa kabuuan naman, aking obserbasyon, maayos ang nakita ko sa kanilang serbisyo.

Waring hindi balidong ikatwiran ng China na wala silang pakialam sa desisyon ng UN tribunal. Alalahaning ang Pilipinas at China ay kapuwa signatory sa UN conventions tungkol sa “Law of the Sea.” Mapa ng Pilipinas ang punto na dapat pagbatayan na hindi dapat masakop ng South China Sea. *** Nabalitang may apat na US senators ang nakipagkita kay President Duterte about two weeks ago. Ang report ay hindi nakalampas sa Beijing officials.

Sinundan pa ng pagbisita ni VP John Kerry. Ang China ay nagbabalang baka maging “cradle of war” ang South China Sea. *** Habang ang mga lider ng Pilipinas ay pumapayag na maging “tuta” ng US – ang Pilipinas at China ay mananatiling parang tubig at langis sa isang bote. Kung ang EDCA na Executive Agreement ay tinuring na legal ng Korte Suprema, marahil may karapatan din ang bagong Pangulo na ang nabanggit na kasunduan ay mapawalang bisa kung nakakasama sa interes ng bayan. *** Sa totoo lang ang US, Japan at ibang kasapi sa ASEAN tulad ng Vietnam, Malaysia, Brunei at Taiwan ang dapat nakikipagayos sa China tungkol sa freedom of navigation for sea and air sa South China Sea. Planong gamitin ang facilities sa mga kampo ng AFP at PNP na pagdadalhan sa naging biktima ng bawal na gamot. *** Kumpare daw at supporter sa kampanya ni former Davao City mayor at ngayon ay President Duterte si Peter Lim na isa sa
