Brady Joins Fight for Whistleblowers

ONGRESSMAN Bob Brady (D-Phila.), ranking member of the House Administration Committee, joined Congressman Elijah Cummings (D-Md.), the ranking member of the House Committee on Oversight & Government Reform, and 21 other senior Democrats in a letter calling on President Donald Trump to immediately rescind three Executive Orders targeting federal whistleblowers.

“Your Executive Orders are the most direct and systematic attack on whistleblower protections in a generation,” the members wrote. “They strip federal employees of procedures that were put in place to protect them against retaliation by their superiors – who are

often political appointees – and they deny whistleblowers the representation of union members when they are punished for speaking the truth. Your Executive Orders also degrade existing protections against undue partisanship in the federal workforce, allowing political appointees to terminate employees arbitrarily and without the check of meaningful collective bargaining.”

Brady said, “These hard-working and dedicated federal employees deserve protection.” More than 20 years ago, Congress enacted protections for whistleblowers who report waste, fraud, and abuse. Before that, whistleblowers risked discipline, transfer, and termination in retaliation for their

acts of patriotism. Collective bargaining and union representation provide the first line of defense to federal whistleblowers, along with established procedures to protect the nonpartisan professionals who make up the U.S. civil service.

“Your executive orders risk turning the federal workplace into a reality-show environment in which they can be fired for raising concerns with potentially illegal orders, unsafe work conditions, sexual harassment, or waste, fraud, and abuse,” the members wrote. “Your new executive orders will mark the end to meaningful contract bargaining in the federal government. They will incentivize agency managers and political appointees

to impose their will and flout the legal requirement to negotiate mutually agreeable solutions. We believe the harms caused by your executive orders constitute an unprecedented attack on good governance and a professional, non-partisan civil service. For all of these reasons, we ask that you rescind them immediately.”

The executive orders would eliminate the ability of whistleblowers to challenge their firing in grievance proceedings before a neutral arbitrator. They would cut whistleblowers off from receiving union representation. They would deny unions the use of office space in federal facilities unless those spaces are also provided to charities or employees pay market-rate

rent to the agency for the space.

All collective bargaining agreements would be opened for renegotiation as soon as possible. Agency managers would be free to dictate contract terms without review and to bypass mediation.

The Democratic letter follows a similar letter sent on June 11, 2018, by 21 House Republicans also calling on President Trump to rescind his executive orders. Their letter warned, “We are concerned that the recent executive orders embark upon a path that will undo many of the longstanding principles protected by law which establish checks and balances not only in the federal workplace, but for the American public.”

Even if the City Republican Party manages to retain Taylor’s seat, they cannot duplicate his decades of experience and respect overnight.

Since Democrat’s control the executive branch of the Keystone State, you might think Democrat-heavy Philadelphians would be well represented in its corner offices. Think again. Philadelphians are under-represented in the cabinet and top echelons of Gov. Tom Wolf, himself a Midstater. Just three of our own come to mind: Patrick McDonnell, Secretary of Environmental Protection; Jerry Oleksiak, Secretary of Labor & Industry; and Denise Smyler, General Counsel. While these jobs matter, they are not pivotal in setting overall

State Sen. Sharif Street (DN. Phila.) was chosen as vice chair and Kathryn Huggins, a 34th Ward protégée of Congressman Bob Brady (D-Phila.), assumed the role of recording secretary.

It’s up to these two to further causes dear to the hearts of Philadelphians (as opposed, perhaps, to Allegheny County residents) in important statewide counsels. Regardless of party affiliation, city residents must now rely on these two to conduct logrolling on our behalf when time comes to get important things done at the state level.

Interestingly, though, PDP chose as its party chair Nancy Patton Mills, who is based in – guess where? – Allegheny County. Patton Mills was chosen to lead the state party at

The Lieutenant Governor’s Office often functions as a semi-official voice of geographical balance in the executive branch. But Philadelphia’s Lt. Gov. Mike Stack has been booted from the Democratic ticket in the November election. If Wolf wins re-election, the Lieutenant Governor’s Mansion will be occupied by John Fetterman, who hails from Wolf’s native York County and won fame as mayor of a Pittsburgh suburb.

Within Pennsylvania Democratic Party leadership, though, Philadelphia still is able to hold the reins of power. That is, perhaps, only as it should be: One out of every five Democrats in Pennsylvania lives here.

Showing that at least one official is taking seriously the unconscionable fiscal oversight that led to some $28 million missing from City coffers, Rebecca Rhynhart released a damning audit of its finances that revealed, among other significant

If you’re looking for the bright side to her report, take solace in the knowledge that it also showed Philadelphia is No. 1 in something other than the NFL: the City has the worst accounting practices among the nation’s 10 largest cities.

Just days after Rhynhart’s report, Mayor Jim Kenney not only felt the need to finally address the issue in depth – including his insistence that he is not treating this mishandling of taxpayers’ dollars with a typical “Philly shrug” – but to also take action weeks after the fact.

We applaud his decision to, in his words, “not kick the can down the road” by delaying action on resolving this critical issue.

By appointing a task

force to oversee efforts to right the fiscal ship, Kenney is not following the head-in-the-sand precedent set by his predecessors in City Hall. And by naming former City Controller Jonathan Saidel, who has won respect for his probity and commitment to fiscal responsibility from all corners, as the task force co-chair, Kenney has proven that he wants results. Saidel will be joined by the Pennsylvania Intergovernmental Cooperation Committee, City Council and the Office of the Inspector General, among others. Missing from the group: the City Controller, who declined to participate.

In a way, she doesn’t need to; by lighting a fire under city officials, she’s already done her job.

Sheriff on Tuesday, July 10, 2018 at First District Plaza, 3801 Market Street, at 9:00 AM. (EST) Conditions of Sheriff ’s Sale for JUDICIAL/FORECLOSURE SALE Ten percent of the highest bid for each property auctioned off shall be deposited in certified check, attorney’s check or money order with the Sheriff by each bidder when his bid is registered, provided that in no case shall less than Six Hundred Dollars ($600.00) be deposited, otherwise upon failure or refusal to make such deposit, the bidder shall lose all benefit of his bid and the property may be offered again and sold unless a second bid has been registered, then, the second highest bidder will take the property at the highest bid price.

Additionally, where there is active bidding, the highest bidder, and the second highest bidder, if any must post the entire amount of the cost of the distribution policy for the property at the time of sale by certified check, attorney’s check or money order with the Sheriff. The Sheriff reserves the right to reject any certified check, attorney’s check or money order that on its face has an expired use date and is presented for payment of the deposit.

The balance of the purchase money must be deposited in certified check, attorney’s check or money order together with a Deed poll for execution by the highest bidder to the Sheriff at his office within 30 days from the time of the sale. An extension of time for an additional 30 days may be granted at the discretion of the Sheriff upon receipt of written request from the buyer requesting the same, except when a second bidder has been duly registered. Also, if the first bidder does not complete settlement with the Sheriff within the thirty (30) day time limit and a second bid was registered at the sale, the second bidder shall be granted the same thirty (30) day time limit to make settlement with the Sheriff on his second bid.

Thereafter, the Sheriff shall be at liberty to return the writ to court. A second bid must be registered on any property immediately after it is sold.

The second bidder must present the same amount of deposit that the highest bidder delivers to the Sheriff at the sale. An extension of time under no circumstances will be granted or honored by the Sheriff whenever a second bid is registered on a property at the sale.

The first bid or opening bid on each property shall be set by the City of Philadelphia. In no event will the successful bidder be allowed to settle on the property unless all the Sheriff’s costs are paid notwithstanding the final bid.

When can I buy a house after filing bankruptcy?

As a bankruptcy attorney, many of my clients are concerned that once they file bankruptcy they won’t be able to buy a house. Or at least they won’t be able to do so for the 10 years a Chapter 7 bankruptcy stays on their credit report.

The regular income level is based on your job and how long you’ve had it. It’s easier to get a loan if you’ve been working in one place for a while on a steady income. The loan committee used to also take a close look at the amount your payments on the house will be in relation to your total income.

Finally, the amount you can put down towards the purchase of the house makes a big difference.

The higher the percentage of down payment, the more protection for the bank.

So, what does this mean?

If you want to buy a house after filing bankruptcy, you can. It may be you will need to wait a year or so until your income and expenses stabilize and until you can sock a few dollars away for a down payment, but that’s probably a sound economic policy anyway.

Truth is that many lenders shy away from lending money to people who have recently sought the protection of bankruptcy. But that actually doesn’t last very long. My clients find that after a year or less, the credit industry is back knocking at their doors with credit-card offers, home-loan offers, etc.

Recently, a client called three months after the Chapter 7 bankruptcy filing and before her case was even closed, wanting to know if there was any reason she shouldn’t accept the credit-card offer she had just received!

Mortgage lenders generally look at three things to determine legibility to get a home loan: FICO score, regular income level, and the percentage of the purchase price you are able to put down. Generally, after filing bankruptcy, your FICO score comes back pretty quickly in a year or so.

This isn’t the first time that a Philadelphia mayor and controller have been at odds and it certainly will not be the last. ALAN BUTKOVITZ, Rhynhart’s predecessor in the city controller’s office, and ex-MAYOR MICHAEL NUTTER had several epic throw-downs on City budgeting and fiscal management. They had many blistering verbal exchanges that made Center City hotter than a tailgate on a Sunday afternoon in August at the Citizens Bank Park parking lot.

It does not have to be this way. JONATHAN SAIDEL was occasionally critical of MAYORS ED RENDELL and JOHN STREET during his time as city controller, but he always found a way to work with mayors in a team-focused way to

improve City operations.

On the state level, AUDITOR GENERAL EUGENE DePASQUALE and GOV. TOM WOLF have an equally team-centered approach and typically avoid any confrontational responses involving State fiscal and managerial issues.

The bigger question is how the controller’s report plays in City Council. Will the majority of Council believe the mayor’s op-ed or will they put more faith in the controller’s report and presser?

Will Council members looking to reduce or stop Mayor Kenney’s tax increase use the controller’s input to demand more cuts in the City budget and fewer tax increases?

That is what makes the timing of this report so interesting. Does it give leverage to those that did not previously have leverage or did not have a lot of leverage? A lot of questions to be answered, and the answers shall come soon.

Speaking recently in Scranton, U.S. Attorney General Jeff Sessions pointedly made a poster child for sanctuary cities out of Philadelphia.

Addressing law-enforcement officials at a closed conference, Sessions said, “It cannot be that someone who illegally crosses the border in El Paso, Texas, and two days later arrives in … Philadelphia is home free,” he said.

Sessions took aim at Mayor Jim Kenney over a video showing the mayor dancing after his Law Department bested Sessions in a lawsuit to prevent the U.S. Department of Justice from withhold federal grant money in order to force changes to local law-enforcement policies.

“This is the elected mayor of a major city in America celebrating lawlessness,” said Sessions. Sanctuary cities trigger higher crime and the opioid epidemic, the attorney general told his audience.

Saidel to Lead Fiscal Inquiry Mayor Jim Kenney has selected former City Controller Jonathan Saidel to lead a financial-reconciliation task force to investigate the City’s poor accounting for tens of millions of dollars.

It was a good choice.

Saidel ran the City’s books well when he occupied the Controller’s Office. He has no direct political connection to either the current or former administration and is widely liked.

Fittingly, the General Assembly started their respective sessions with another first: Hindu prayers from world’s oldest scripture.

Hindu Rajan Zed delivered the invocations from the Rig-Veda and other sacred texts before the Senate and House and sprinkled few drops of water from the River Ganges, considered sacred by Hindus, on the occasion.

Zed, who is the president of Universal Society of Hinduism, recited from Rig-Veda, the oldest scripture of the world still in common use and other ancient Hindu scriptures. He started and ended the prayer with “Om”, the mystical syllable containing the universe, which in Hinduism is used to introduce and conclude religious work. “Lead us from the unreal to the real,” he quoted from the scriptures.

It is a different approach from the 2014 GOP gubernatorial candidate, Gov. Tom Corbett, who, although he was very approachable by Philadelphians in practice, spent little time addressing Philadelphia issues in his campaigns.

Wagner has also picked up another cause dear to Philadelphian hearts: raising the minimum wage.

While this matters to many Pennsylvanians statewide, it is of particular interest in a city with a high poverty rate.

SB 865, proposed by Wagner, would increase Pennsylvania’s minimum wage to $8.75 per hour in 50-cent increments over three years, but keep a training wage of $7.25 for everyone age 18 and below. It’s not as big an increase as what Democrats are calling for, but it takes a proactive stand on a subject in which hardcore conservatives have long resisted any change.

Wagner’s attention to Philadelphia may reflect a pragmatic, non-doctrinaire approach to policy. Then again, it may have been stimulated by the fact he got beaten in Philadelphia in the primary by ultra-conservative Western Pennsylvania health-care magnate Paul Mango. It is said that Mango’s success locally depended more on liberal contributions to Republican ward leaders than to his ide-

ology. Regardless, Wagner may have decided that he can neither take the city vote for granted nor write it off.

However, it will not eliminate the alcohol-per-drink taxes, as those are protected by specific legislation passed by the state in 1971.

The soda tax has not generated the projected revenues and was more regressive than expected. I should say, more regressive than a number of Democratic politicians predicted. Anybody with a brain cell would have known that middle-class and upper-middle-class people with cars would drive across the city line and buy their soda there.

Also, if you are going to go to a suburban Wal-Mart in King to stock up on drinks, you are also going to do all of your grocery shopping there – thus negatively impacting other City tax revenues and jobs Mustio’s bill appears to have some Democrat support, owing to the regressive nature of taxes on food items. Poor people pay more of their income on necessities than those better off. But then, many of the bill’s proponents like the limousine liberals in Center City and Chestnut Hill, will

tell you that soda is not food, thus not a necessity.

Sorry, I should have said Tesla Model X (priced at $80,000) liberals.

Of course, MAYOR JIM KENNEY and CITY COUNCIL PRESIDENT DARRELL CLARKE are upset because the soda is for pre-K education. It is reported that an additional 50-cent sales tax would result in an approximately $82 million in new city revenues. An additional 25-cent sales tax would increase revenues by roughly $41 million.

This compromise is not good enough for Kenney and Clarke, who are spending our tax money to lobby against it. Kenney and Clarke stated in writing that raising the sales tax would “drive individuals over the city border to purchase goods and services.” And how is this different than what the soda tax is already doing?

While I am opposed to any new taxes, a sales-tax adjustment is fairer as it hits all taxable products and businesses. I think the City needs to find the funding for pre-K from other sources. As CITY CONTROLLER REBECCA RHYNHART’S recent report noted, the management and oversight of the City’s financing activities is seriously lacking.

Perhaps before we start adding taxes, we should be looking for better financial management and prioritizing our spending – what novel thoughts.
