Charter School Foes Spark Educ. Bill Veto

by Tony West You know a political movement has arrived when opponents take drastic steps to spike it.

Barely 10 years old in Pennsylvania, charter schools have arrived as a threat so potent that Gov. Ed Rendell vetoed a bipartisan omnibus education bill, solely because one of its provisions might give a tax break to some charter-school real estate.

The Governor’s veto triggered outrage in the General Assembly. Advocates for the bill, HB 101, vowed to redouble their efforts to pass it after the election next week.

Lobbying for the veto was a coalition of public school districts across the state, including Philadelphia’s. Mayor Michael Nutter backed them up, writing to the Governor, “I understand there are provisions of this bill that you may support. The State should not, however, be granting special tax exemptions for lessors of land to charter schools that do not already qualify under existing exemptions.”

“The Governor gets an F for this decision,” responded State Rep. James Roebuck, who chairs the House Education Committee and drafted the measure.

At issue is whether a business that rents space to a charter school, but pays taxes on its building, should be able to convert itself into a nonprofit corporation and thereby become exempt from the realestate tax.

No, said Philadelphia School District Deputy Superintendent and CEO Leroy Nunery II. Writing to Rendell, Nunery said, “Based on the information known to the School District at this time, there is a potential significant revenue loss to the City of Philadelphia and, by extension, The School District … if this Bill becomes law.”

Proponents of HB 101 scoffed at this claim, at least currently. They said it would apply to only three charter schools around the state, none of them in Philadelphia.

Neither the Mayor’s Office nor the School District was able to provide specific finan-

cial information about this feared revenue loss.

Major legislation like this is rarely vetoed by any Governor, simply for one of its provisions – especially one of such small scale. It is a little like seeing the President veto the annual defense appropriations bill because he doesn’t like a particular destroyer.

Also unusual, Roebuck noted, was the speed and stealth with which the attack on charter schools was mounted. The Governor never discussed his concern with Roebuck throughout a year of lawmaking and did not even call him personally to tell him he would veto the bill. The letters by Nunery and Nutter which urged the veto were written only last Thursday and Friday.

Rendell cited a concern this tax-abatement provision might be unconstitutional as one reason for vetoing the bill. But Roebuck responded, “That is very much in doubt, and if a court had struck down that one section, the rest of the bill would have survived.

The Governor should have let it be resolved in the courts rather than kill these important educational reforms.”

Among those reforms are steps to revise the State’s school-violence reporting, to create economic-education and personal financial-literacy programs, to combat dating violence, and to control skyrocketing college-textbook prices.

As for the question of the loss of tax revenue, Roebuck scoffed, “Public-school real estate is already exempt from taxation. A school is a school.”

State Sen. Anthony Williams called Roebuck’s legislation, which was crafted in tandem with State Sen. Jeffrey Piccola (R-Dauphin), “historic.” “These two men come not just from different parties, but with radically different ideologies,” Williams explained. “Compromise is not normal in these times. A lot of work by a lot of people went into this bill.”

The measure passed the Senate unanimously and cruised through the House 180-19.

While charter-school real estate may be a small issue today, Rendell’s move left no doubt the overall growth of charter schools casts a large shadow over the future of public schools.

There are now 63 charter schools in Philadelphia, serving 32,000 students. The money that pays for charter schools is taken from the overall public-school budget, so it is a zero-sum game for the School District: Every added pupil in a charter school means that much less funding for School District operations, even though the School retains nebulous oversight – but little operational input – into its upstart rivals.

It is no wonder, then, the School District has resisted the growth of charters in other ways. Last Friday, for instance, Walter Palmer Leadership Learning Partners Charter School in North Philadelphia won an injunction in court that removed a cap placed by the School District on its student-body size.

“The School District does not want the charter-school movement to come to fruition,” said Sultan AshleyShah, a spokesman for WPLLCCS. “There is a faction within it that does not want the charter schools to grow. They are afraid of an exodus from their system.”

Not all public-school advocates are opposed to charter schools. Former Superintendent Paul Vallas was friendly to charter schools, as was former School Reform Commission Chairwoman Sandra Dungee-Glenn.

The current Superintendent Diane Ackerman has been much cooler to them, charterschool supporters say. And the Rendell Administration never warmed up to them. A core opponent is the Governor’s Secretary of Policy & Planning Donna Cooper, a secretive backstage power who, in the eyes of many, always pulled the strings on Education Secretary Gerald Zahorchak. Zahorchak quit earlier this year, leaving Thomas Gluck as acting secretary for the waning days of the Rendell Administration. There is

no way Rendell would have vetoed HB 101 against Cooper’s wishes.

Diane Castelbuono, who now heads the city’s Office of Charter Schools, is a recent alumna of Rendell’s Dept. of Education.

Rightly or wrongly, it may soon be too late for charterschool foes to roll back this new form of public education.

The families of charter-school students tend to be motivated.

They now form a political

special interest of their own and they have the will to lobby for their ends.

Rendell has consistently presented himself as Pennsylvania’s “education Governor.” Now, in the waning days of his term, he cannot lay claim to that title any longer, charged Roebuck.

The audit comes just as reins of the Sheriff’s Office shifted from Sheriff John Green, who announced his intention to retire several months ago, over to Chief Deputy Sheriff Barbara Deeley.

What surprised Deeley was not the audit, but the fact the office had fully complied with the requests of the Controller for the files and material he needed.

In his own words, at an elaborate press conference, Butkovitz admitted his audit was incomplete. He said,

“When I hold a press conference after the completion of a departmental audit, I announce specific findings and a list of recommendations. Unfortunately, I will not be announcing any specific findings today regarding the 11 custodial accounts, with assets valued at $53 million that are maintained by the Sheriff’s Office and were part of our department audit for FY 2007-08-09.”

money to bring out a strong “Get-Out-The Vote” army ... which both the Democrat and Republican committees are the logical place to go for.

This again places Philadelphia into the pivotal spot, its turnout determining which way the state will go, this is especially so since both contenders for Governor could well split their voting populace in their home bases in Western Pennsylvania.

City Commission Chairwoman Margaret Tartaglione believes the city will see at

least 30% of its voters exercising their right to vote Tuesday. That could translate into over 300,000 votes. Not all will be for Onorato in this heavily dominated Democrat stronghold. At least 184,000 of the 1,200,000 registered are Republican and expected to vote that way.

As of today, the Republican City Committee, which is dealing with a dissident faction opposed to its leadership, has not received word to anticipate any funds from either the Toomey or Corbett campaigns. That can be considered a serious error on the part of both candidates.

It should be noted outside interest groups — from the US Chamber of Commerce to Union groups — are spending much more freely after a US Supreme Court ruling in January. In the last two months, three national advocacy groups have spent more than $2 million on television ads around the state.

GOP Has Absentee Edge In Penna “Despite fresh polls showing … Joe Sestak making a comeback in the Pennsylvania Senate race, Republicans remain encouraged by a small but potentially crucial datapoint: absentee ballots.”

That was the word from Politico, the Washingtonbased online magazine. Its reporter David Catanese noted, “According to numbers tabulated by the State Board of Elections, Republicans hold an 8% advantage over Democrats among those requesting absentee ballots in the commonwealth. Among those who have already returned their ballots, the gap grows wider, with Republicans topping Democrats by 19%.”

Catanese noted, “As of last Friday, 171,860 Republicans had asked for ballots, compared with 155,440 Democrats, giving the GOP a 49% to 41% lead. Republicans held a 56% to 37% lead among the close to 66,000 who have already voted.

“While historically more Republicans than Democrats vote absentee, Toomey’s campaign is heartened by the early gap. “‘It’s beyond anything we've historically seen in Pennsylvania. That’s a net 19point move from the Democratic registration advantage,’ said Toomey Campaign Mgr. Mark Harris, pointing to the Democrats’ 11-point partyregistration advantage.

“Pennsylvania’s absenteevoting law is one of the most restrictive in the country. Residents may only cast ballots as absentees if they are unable to get out of their homes or not in their voting precinct the day of the election. Absentee ballots usually only comprise about 4% of total ballots cast, said Harris.

“On the heels of a new Muhlenberg College poll showing Sestak with a 3-point lead over Toomey, the Service Employees International Union announced it was dumping $2 million into a getout-the-vote operation. The union plans to deploy 900 of its members to go door to door for Sestak and Democratic gubernatorial nominee Dan Onorato, in addition to $500,000 to fund its get-outthe-vote program in Southeastern Pennsylvania.”

Looking at past elections, the Republican Party’s top candidates have been historically reluctant to give campaign funds to their organized City Committees. They seem to want to spread dollars to operatives they entrust rather than the existing organizations. If, as reported, they intend to do the same, they’ll be repeating mistakes which proved costly in past elections, losing them legislative seats as well as statewide races.

Corbett has raised $22 million with Onorato just behind him with $19 million. Both have earmarked the bulk for television, on which the messages getting dirtier with charges that each candidate’s team is running frantically, to counteract the other’s, at the last minute.

It is believed Onorato is pragmatic enough to understand the value of the Philadelphia Democratic City Committee led by Congress-

October 19, 2010 Dear Union Members & Friends of Labor: Only two years ago the citizens of our Country voted the Republican Party out of Washington for being the most incompetent administration in the history of the United States of America.

Since then, the Republicans in Congress have done nothing but criticize and vote against every effort made by our new President to put America back together again… never before has an American President been left to face so many adversities with little or no cooperation from the Republican Party.

Unbelievably, the eight year dynasty of George W. Bush and his fellow Republicans has driven our nation to its knees. The aristocratic manner in which they governed only served to favor the very rich while ignoring the plights of the average American citizens, ultimately causing economic havoc not only in the United States, but around the world—- all because of the Republicans’ greed for power and the lustful ideals of their corporate advocates.

As a direct result of the Republican philosophy of “governing for the rich,” the ‘American Dream” of yesteryear has been diminished almost to the point of extinction for millions of our citizens. Because of the Republican legacy of financial devastation, every day over eight thousand (8,000) American families are losing their homes due to mortgage defaults. For those families the “American Dream” is already lost!

Yet the Republicans in Congress continue to support the corporate outsourcing of good American jobs! Thus, the ‘American Dream’ will be lost for millions of other American families who are hanging on by the skin of their teeth with the hope that our government will start working together to turn our Country’s economy around just so they can go back to work.

Even though the Democratic Party is working hard to rebuild the economic status of the America we once knew; and, under the leadership of President Barack Obama, we are moving in the right direction, the Republicans would have us believe that only they know the way, when in reality, they are the cause of every problem our Country is enduring today!

It’s time to stand up to their lies and deception and let the Republican Party know that we did not forget who continues to support the corporate outsourcing of American manufacturing jobs through “Tax Free Trade Agreements” that only benefit the corporations.

It’s time to stand up against the Republican Party to let them know that we did not forget who supports the corporate exploitation of millions of immigrants, both legal and illegal, who are brought into our Country to replace American workers at less than life sustaining wages.

It’s time to stand up against the Republican Party to let them know that we did not forget who lied to the American people to make us believe that the war in Iraq was necessary; when, in fact, it is a senseless and unwinnable conflict that has caused the death and mutilation of thousands of American soldiers and has cost our Country over one trillion dollars to date.

And last, but certainly not least, it’s time to stand up to the Republican Party to let them know that we did not forget that the last time they were in power, they allowed their corporate friends on Wall Street to pick pocket the American people out of trillions of dollars in pension funds and other personal investments while at the same time, condoning the CEO’s of those very same corporations to collect billions of dollars in bonuses.

Thank God we didn’t permit them to dupe us into investing our Social Security Funds with the same wizards of Wall Street!!!

The Republicans are nothing but a bunch of corporate owned politicians that would like the American people to believe that they did nothing wrong…when in fact, THE REPUBLICAN PARTY HAS DONE NOTHING AT ALL FOR THE AVERAGE AMERICAN CITIZEN! Just ask yourself this question: What more can the Republicans do to America that they haven’t already done?

Your very own answer to this question should agitate you to the point where you can’t wait until Election Day to cast your vote against any Republican that is a candidate for any office in any branch of our government anywhere in America.

Only by exercising our right to vote, can we teach the Republican Party that America belongs to all of her people—-not just the rich! So, for the sake of the “American Dream” please stand up for your country, for yourself and your family, for your job and for your right to a decent way of life.

Despite Arbitrator’s Decisions, Fire Fight Continues

by Joe Shaheeli Maybe, just maybe, Mayor Michael Nutter has turned a blind eye to just how important this city’s firefighters are and why, because of the dangers facing them with each fire alarm to which they respond, they deserve extra care.

Whatever. his reasons, though he says it’s basically the economic recession forcing a need to make fundamental reforms, the Mayor is appealing the decision just

handed down by the American Arbitration Association on the firefighters contract.

That decision has poured more fuel on the incendiary battle between firefighters and the Nutter administration.

The arbitration began in mid-September 2009 and ended in late April.

The Mayor’s Side….

The Mayor indicated he is appealing because “Though the arbitrators’ contract award takes a crucial step toward re-

form by establishing a hybrid pension system, it imposes more than $100 million in new costs over the Five Year Plan without giving the City the required tools to manage these costs. This award offers the City no flexibility to cope with these costs short of simply cutting services. And that is something we’ve already been forced to do over the last two years in the Fire Dept. and throughout municipal government.”

He added, “Unlike the contract for members of the Fraternal Order of Police, this award does not give the City the right to furlough, which can be used to help fund the added cost of a contract. Furthermore, where the FOP contract provided ways to save tax dollars in the area of healthcare costs, lesser savings can be anticipated in this firefighter’s award even though it has a self-insurance mechanism similar to the FOP.

The Butkovitz Fiasco

ANOTHER OPINION branches.

The first problem that needs to be addressed is the role of City Controller. That office in no way should have a seat, or appoint people to a seat, to any agency. That office’s responsibility is to audit those agencies and having their own people on a board is an overwhelming conflict of interest. For example, the Controller sits on the pension board.Does anyone expect Controller Butkovitz to issue a report critical of dealings he does on the board? He also has two appointments on the Pennsylvania Housing Authority board. Again, his job should be auditing it, not running it. The same goes for the Pennsylvania Auditor General, who has a seat on the Delaware River Port Authority board. Audit it, don’t run it.

The second problem is that we have elected legislators and their appointees sitting on boards that carry out executive branch duties. The legislature’s role is to create the laws the executive agencies work under. Giving it powers to appoint corrodes the separation of powers. The most well

The Governor makes the appointments (because it is a State agency), but it is set up in a way where the choices are supplied by the State House and State Senate. The legislature should be reserved to confirming executive appointments, not making them.

The third problem is the involvement of the judiciary in the appointment process. They had sole authority to appoint members to the soon-to-be-defunct Board of Revision of Taxes. Instead of the BRT being independent from the other branches, it politicized and corrupted the judiciary. There is one purpose of the judicial branch and that is to run the courts; anything outside of that is a distraction at the least and a conflict at the most.

The fourth problem is the heavy use of protected term lengths for appointees and the inability to remove board members. While some may think it helps give the board independence, in reality we don’t want the boards to be independent. We want our elected leaders, the Mayor

and Governor, to accomplish certain goals, goals that change from election to election. Prohibiting the executive branch from replacing people hamstrings them. A simple question is, if we replace a Mayor or Governor, why should we still have their people running the government? Protected terms for board members have the end result of protecting people’s political power bases, not creating independence.

When all is said and done, we have a bunch of agencies that receive and spend billions of dollars a year and experience no oversight and no accountability because no one is able to watch the watchers.

This needs to change and these are just the beginning of reforms that need to be made to the Philadelphia Home Rule Charter and the Pennsylvania Constitution. It is up to us to push for these reforms and to restore the fundamentals of our government.

by Adam Lang The many government agencies we have in and around Philadelphia and the way they are organized are key contributors to the disaster that is our local government.

Being that we are in the birthplace of our nation and the US Constitution, we would hope the ideas and philosophy behind the formation of our government weren’t so easily forgotten. As anyone who has taken an American civics class, an American history class or knows anything about the Constitution can tell you, our government is based on the idea of “separation of powers”. The idea is that having checks and balances between the legislature, executive and judicial branches helps to keep power broken up between the different branches and to keep each of them accountable.

Sadly, Philadelphia and Pennsylvania have for a long time destroyed this framework. A modernization of the City Charter and Pennsylvania Constitution needs to be done to fix the breakdown that has been created because the current setup creates a unification of power amongst the separate

We usually applaud the audits conducted by City Controller Alan Butkovitz ... but we weren’t surprised at his haste for calling down the Sheriff’s office for its alleged refusal to cooperate with the Controller in his latest audit of that office.

His effort this time to single out the Sheriff’s Office as one of his big audits has been defused by the fact he admits the audit was incomplete (so why release it then?), because he refused to receive additional materials provided by the Sheriff’s Office. He then made it obvious he was among those hell-bent to get rid of the Office of Sheriff as one of the County row offices by proceeding to cast a shadow of possible criminal activity.

We believe, in his anxiety, the Controller has fumbled away all chances of ever being considered nonpartisan in his audits.

The time for a proper, full-fledged audit is at hand.

Let it be done with the proper materials, and with proper time allotted to both offices.

The air crash was the worst in Poland’s history and included 14 members of the United States boxing team.

Philadelphia’s Lonnie Young was a member of the team and was among the young victims. Many of the boxers were in their teens, taking their first trip out of the United States.

Future light-heavyweight champion Bobby Czyz was on the team and didn’t realize how fortunate he was when he was injured in a car accident just days before and had to cancel the trip. Czyz once told another team member, nearby Coatesville heavy-

weight Jimmy Clark, “You’ll even be late for your funeral someday!” How right he was, as Clark showed up late and missed the flight.

The team was preparing for the upcoming Olympic trials. Later, President Jimmy Carter would have the United States boycott the 1980 Moscow Olympics because of the Soviet Union’s invasion of Afghanistan. While boxing historians will not forget the 1980 team didn’t compete in the Olympics, they must also remember those boxers that were taken before they had the chance to compete for the team due to this horrendous tragedy.

“I am very pleased that, after months of waiting, Local 22 members have received the new four-year Act 111 Award.

The new contract Award is a major victory for our members given the substantial obstacles that have been thrust upon us over the past eighteen months.

“It’s a fair award that addresses the needs of Fire Fighters and Paramedics and the City. There are plusses in it for both sides.

“The differences between our Award and that of the Police are relatively minor with the important distinction that Local 22 members will not be subject to furloughs.

“Considering the many areas of similarity, some benefits to the City are not included in the Police Award, there is no reason to appeal this award.

We call on the City and our friends in City Council to quickly accept, as they did the Police Award, this Fire Fighter Award so that members and their families may enjoy some peace and security.

“If the Award is viewed simply on its merits, there is no reason to appeal the Award.

“Since the decision to appeal clearly cannot be made

on the merits, we can only conclude that the appeal is another in Nutter’s two-year assault on Fire Fighters, Medics and our retirees.”

The Award contract suggests: Four-year award, expires Jun. 30, 2013. Wages.

One-year freeze for FY 2010, followed by 3% across-theboard increase, effective Jul. 1, 2010 (retroactive), and 3% wage increases on July 1, 2011 and Jul. 1, 2012. Similar to Police Award. But not awarded the 5% stress differential Police receive.

Medical. City proposal to move to self-insurance system granted, effective January 2011.

Local 22 H&W Plan and benefits continue. City to receive $5 million rebate from current Fund reserves, in addition to savings achieved by self-insurance. Same as Police Award, except larger per-capita rebate.

Pension. No change to pensions for current employees, including the DROP. New employees will have choice between Plan 87 with a 6% employee contribution or the City’s “hybrid” plan.

Same as Police Award.

Furloughs. The City is not permitted to furlough our members.

Retiree Medical. City re-

quired to continue payments into Retiree Medical Fund to supplement post-retirement medical costs faced by our retirees. Same as Police Award.

Chief’s Aides. City cannot eliminate or reduce Chief’s Aides.

Promotions. Written component added to Chief Officer promotion examinations just like Lieutenant and Captain promotional exams. Modernizes the process, to match process used in most major cities.

Legal Services. City required to increase payments to the Legal Services Plan. Same as Police Award.

Comp Time. Chief Officer comp-time cap increased from 1100 to 1200 hours, and retirement cashout increased from 550 to 600 hours. Same as Police Award.

Vacation Cashout. Disabled members will now be entitled to cash out their accrued vacation upon retirement. Same as Police Award.

Vacation. No change for current employees. New hires may use only 1 week of vacation during summer for first 5 years on the job. Same as Police Award.

Residency. No change to the long-standing residency requirement. More restrictive than Police Award.

A few things every good politician should have learned on their first day on the job: Where their office is, whom they should support, what not to say, where is the restroom, and most important of all, don’t pick fights with reporters! Thus, imagine our surprise when it was reported radio personality MoSHAY LaREN recently blasted veteran STATE SEN. LeANNA WASHINGTON online and on the radio, because the Senator declined to discuss the walk against domestic violence, having been told LaRen is a potential competitor. Among the myriad of recent invasions of my Facebook page is a button asking me to make a commitment to voting.

If it weren’t for the fact just about all my Friends have sent me one of these buttons at least once over the last two weeks, I’d think that they’re a great idea. I have always said one of the things that get people to the polls quick, fast and in a hurry is peer pressure. If it can cause people to take up smoking, why not voting?

But while I have a group of Friends who are practically browbeating me to the polls, I am pelted with messengers who are equally passionate in the other direction. They’re telling me not to vote.

It seems as if they believe that the Citizens United decision, you know, the one in which the Supreme Court says GlaxoSmithKline has the same free speech rights that I have despite its being (a) an inanimate object and (b) possessive of a million times the money I have, has had its intended consequence: We the people have lost our voice in this government. Neither party represents us. We are the United States of Corporations.

Yo! Here we go again with this Halloween question: What is a ghost? The concept of a ghost is based on the ancient idea that a person’s spirit exists separately from their body.

Many societies use funeral rituals as a way of ensuring that the dead person’s spirit would not return to “haunt” the living.

In the first century AD, Pliny the Younger recorded reported the specter of an old man with a long beard, rattling chains, was haunting his house in Athens.

Centuries later, in 856 AD, the first poltergeist – a ghost that causes physical disturbances such as loud noises or objects falling or being thrown around – tormented a family living in a farmhouse in Germany by throwing stones and starting fires, among other things.

The ghost of Anne Boleyn, the second wife of King Henry VIII, has been reported at the tower of London as well as in various other locations.

America has its own rich tradition of historical ghosts. Benjamin Franklin’s ghost has been seen near the library of the American Philosophical Society in Philadelphia, and there are reports that the statue of Franklin in front of the society occasionally comes to life and dances in the streets.

Some locations seem to lend themselves to a haunting. Abraham Lincoln, formerly a lawyer and Congressman from Illinois, is said to have been seen wandering near the old Springfield capitol building, as well as his nearby law offices. Author Mark Twain is believed to haunt the stairwell of his onetime Village apartment building.

The pollsters are reluctant to identify a winner in the race between PAT TOOMEY and JOE SESTAK and in the race between TOM CORBETT and DAN ONORATO. Both Sestak and Onorato are considered underdogs in the races for the US Senate and for Governor and both are Democrats. Pollsters seem reluctant to recognize the momentum there seems to have shifted to the Democrats. It would be helpful if the numbers from the Senate race in 2004 and the Governor’s race in 2006 were used for comparison. No recognition is given to the fact there are a million more registered Democrats in the Commonwealth of Pennsylvania than Republicans.

If it is the independent voters who are going to determine the outcome, it might help to analyze the number to see the effect independents have had in the Senate and Governor election in the most recent past.

The Controller said he was able to examine only three of 11 custodial and related investment accounts with balances totaling over $52.7 million since 2009.

Deeley said he had access to those records, but refused to

accept them from the Sheriff’s Office.

Deeley has asked the Controller why he is refusing to complete a 2007-2009 audit to determine if there is any justification for his drastic recommendations, which could cost taxpayers hundreds of thousands of dollars.

She also wanted to know why the Controller waited 13 months before officially informing the Sheriff of this problem; why the Sheriff was only given two days to respond; and why his staff refused to remove inaccuracies

But it is true that all 3rd-party certified antivirus products are the same, in that they have all passed a vigorous test by an independent party. That cannot be said about any of the free products and, unfortunately, about some of the least-expensive products.

You also need to be careful, because some expensive and moderately priced computer-security equipment manufacturers have adopted this attitude and use free antivirus in their products.

Antivirus testing is a specialty. The skills needed to design antivirus test beds, test plans, test procedures, execute the test procedures and analyze the test results are rare.

While there is some overlap within the antivirus industry (in-house QA testers), this is a separate industry.

I find product reviews of antivirus products that attempt to review the effectiveness of a product by someone who is not a recognized tester or industry insider to be silly.

There are lots of these on youtube. It normally starts with someone saying they downloaded some virus samples from a “hacker website”.

Right there is the first fatal flaw of the test. They downloaded something that they think is a live virus suitable for testing from a website that by its very nature is untrustworthy! A real tester would gather samples from known good researchers, view the binary code of every sample to insure that there is a live virus, then use several tools to confirm their findings. They then build a test bed of appropriate samples for test. Individuals and some magazines have been guilty of similar uninformed testing in the past.

How do you buy a good antivirus product? Look for seals on the product from 3rd-party testers. A good product will have at least one and many will have more than one.

Some of the best testers in the world right now are Webcoast Lab in the UK and AV Test in Germany. You can feel safe if either or both of these companies certify a product.

Perzel Bill Gives Cops Slots Revenue $$$$

HARRISBURG - Rep. John Perzel announced he has introduced House Bill 2774 which would direct a portion of the revenue generated by

slot machines in Philadelphia to help the city cover shortfalls in its police and fire budgets.

“Like the rest of the nation, Philadelphia is facing a very difficult budget crisis,” Perzel said. “To deal with the crisis, the city’s police and fire budgets are being cut.

The threat to public safety as a result of those cuts is totally unacceptable.”

Under current law, counties hosting casinos receive 4 percent of the gross terminal revenues generated by slot machines. Perzel’s bill would direct that the local share from Philadelphia’s casinos be used to make up the short-

fall in Philadelphia’s police and fire budgets. Any remaining funds would be placed in the city’s general fund.

“When both casinos are up and running in Philadelphia, it is estimated that the local share of the slots revenue will

be about $14 million,” Perzel said. “Rather than giving the city a free hand to spend those funds any way they want, my bill will ensure public safety by directing that the funds be used to cover the shortfalls in the police and fire budgets.”

“In the last few weeks, Rendell has vetoed a number of bills – more than in his preceding two terms,” Williams commented. “I understand this is part of the armament of leaving office.”

The large majorities that passed HB 101 would permit the General Assembly to override the Governor’s veto, if that turbulent body can organize itself to do so after the General Election. The Senate will definitely return to session; it is less clear if the House can take action.

Williams affirmed, however, this education-reform measure is far from dead. “I think we’ll take another bite at that apple,” he said.

It's a privilege not afforded any other civic-minded nonprofit corporation. It’s also a privilege quite a few good charity-based nonprofits could well use, since the message sent by the Committee of 70 was received by everyone who is connected to the City’s email system and that is thousands of employees.

This was met by surprised City employees, who have never seen any messages from non-City sources communi-

cated to them in this fashion.

In the minds of one questioning employee, it was thought the City Administration had anointed “The Committee of 70 as the champion of fair elections in Philadelphia,” inferring his group was the only one that can guarantee a fair election.

This was an obvious slap at the dedicated employees and elected City Commissioners, whose long history under the chairmanship of Commissioner Margaret Tartaglione has set hallmarks in modernizing the election process, and in insuring safe and honest elections.

Every check and balance to insure elections held in this city have been instituted and

are scheduled to begin paying back their loan obtained through the Pennsylvania Higher Education Assistance Agency. The six-month grace period usually allows the graduate time to find a job and get settled before having to begin repayment.

“For those loan recipients who are still unable to find employment, or individuals who still have outstanding student loan balances but have lost their job, there are avenues to pursue through PHEAA that can provide them with flexibility as the job market rebuilds,” said McGeehan. “The key is to get in contact with a PHEAA customer-service representative as soon as possible and explore the options.

“There have been some recent changes to expand the options that could provide viable If Ballot Question 1 is this city on Election Day options for graduates with passed by the voters of this Tuesday, it could conloan balance difficulties.”

The message calling on City employees to volunteer to help the Committee of 70 police this election is obviously a dig at the integrity of the office of City Commissioners.

The message, in part, read, “The Committee of 70 aims to be the champion of fair elections in Philadelphia. As a 70 volunteer, you will visit polling places with a partner on Election Day and answer questions from ‘Where’s my polling place?’ to ‘They don’t have my name on the rolls.

What do I do?’” – the same questions handled satisfactorily year after year by the elected and appointed members at each of the over 1,860 polling stations in this city.

Zachary Stalberg and his second in command together gross almost $400,000 in salaries, with the rest of staff of a half-dozen or less identified on tax reports as volunteers. One of his bullet points is the abolition of the City’s Row Offices, of which the City Commissioners are one.

His ability to create the impression that his group is all that stands in the way of a dishonest election system has enabled him to raise substantial contributions.

His aim is to consolidate those offices in the various departments controlled by the Mayor. Which could be the underlying reason why the Committee of 70 was given access to the City’s email system.

“There is difficulty in Pennsylvania in recruiting good candidates to challenge incumbents in many of those areas,” said Dr. Baldino.

“It’s tough to find a Republican in Philadelphia to put his or her name on the ballot in an area where they know they are likely to be trounced in an election.”

He added, “And if it's tough to get opposition parties to even get names on the ballot, raising money to challenge an incumbent in those heavily partisan districts is even more difficult.”

Tim Potts, director of Democracy Rising PA, a citizens’ advocacy group, said the major problem in the state is the legislative Districts which are drawn to practically guarantee to seat is easily won by a certain party.

“We have a legislature that has tilted the playing field towards the incumbents to a very great extent,” said

Potts. “The legislative Districts are gerrymandered to make them safe for only one party in many parts of the state.”

Potts also said the fundraising advantages afforded to incumbents help them deter political challenges or survive them when necessary.

Fundraising levels was one of the few factors which distinguished the more-competitive states from the leastcompetitive states, said Geoff Pallay, one of the authors of the study.

Pallay pointed to New Hampshire – the state ranked number one on the competitiveness survey – where campaign contributions in the 2008 State legislative elections totaled only $468,000 across the entire state. In Pennsylvania, many candidates will raise that much by themselves.

“If people know it doesn’t cost very much to run a race, they are more likely to put

up a fight and do it,” said Pallay.

He said states with terms limits on their legislatures also had more competitive elections, but other factors such as geography, population, and the political party with the majority control had little influence on competitiveness.

“Just look at the [Pennsylvania] Senate seats. You have only 50 of them and the races aren’t any more competitive,” said Dr. Baldino.

In fact, he added, State House races in Pennsylvania have historically been more competitive than State Senate races.

This year, nine of 25 State Senate Districts up for election lack a candidate from each major party.

Nearly the same ratios of State House seats – 85 out of 203 – are also uncontested.

Special to the Record from Pennsylvania Independent – With less than a week before voters go to the polls, many national observers are pointing to Pennsylvania’s congressional races as some of the most competitive, as Republicans battle to win back control in Washington.

But the state’s legislative body shows little inclination to change.

Pennsylvania ranked as the 37th most competitive state out of 46 states holding elections this year. Out of 228 state legislative seats in Pennsylvania this year, only 134 have races. That leaves 94 races – 41% of the total – in which Republican or Democrat candidates are not facing major-party opposition.

The survey was released

by Ballotpedia, a Wisconsinbased nonprofit dedicated to researching information on ballot initiatives and elections in the states.

Nationwide, there are 6,125 State legislative seats at stake in the 2010 General Election and more than 32% of all candidates for those seats lack major-party opposition, according to the survey.

In Pennsylvania, 177 incumbents lacked a primary challenger this year, and only one incumbent – State Rep. Karen Beyer (RLehigh) – was defeated on primary election night in May. Dr. Thomas Baldino, a professor of political science at Wilkes University, said Pennsylvania's high number of uncompetitive elections was a result of the state’s political geography.

Since large swaths of the state are strongly conservative, Districts from Pennsylvania’s rural areas tend to vote for Republican candidates and Democrats are unlikely to even try to get on the ballot. In the major cities and suburban areas, where Democrats largely outnumber Republicans on voter rolls, the exact opposite ef-

And there was an opinion column written by a former Capitol Hill staffer that says African Americans should stay home because voting doesn’t benefit us.

I can understand the reasons why folks are telling people of color to take a pass on voting. On the side of the Latino Republican, keeping his fellow Latinos from the polls ensures a Republican victory. While Latinos are less

than impressed with President Barack Obama because he hasn’t been able to give them immigration reform, they’re certainly not going to vote for the party that gave us Arizona’s “papers please” law.

And I can even understand the frustration of the African American former Hill staffer.

Still I vote, because I recognize voting is the minimum I can do as a citizen.

Many believed when Barack Obama became President Barack Obama, he would create jobs, fix health care, and make America a better place for all of us to live by waving his magic wand.

But it doesn’t work that way. When you’re handed a country that has been messed up in ways that no one saw

coming for 12 years (and yes, I am including President Bill Clinton in my list of folks who screwed up this country), it’s gonna take more than two years for things to even begin to turn around.

And it’s going to take a Congress backing you up. It’s going to require voters, to make sure Congress is accountable to you.

If you take the time to vote, you need to take the time to make sure those you vote for realize just as you put them in that office, you’ll take them out.

If you’re not willing to do that, maybe you should sit this one out. But don’t complain when you get exactly what you demanded from your government, which is nothing.

What, you ask, is Kokopelli?

It’s a strange name for a restaurant, but within the next few weeks Kokopelli will open at 1904 Chestnut Street, where Little Pete’s held court for many years (and more recently, Pearl). For those of you who never heard the

word before (just about everybody), Kokopelli was the flute-playing, mirthful god of fertility, music and fun for the Anasazi people, a Native American tribe that lived from about 500 A.D. to 1300 A.D. in what is now the Southwestern US. Not surprisingly, Kokopelli will offer Southwestern dishes. Partners Adam Solomon, Kenny Yeretzian and Rich Brenner think that most diners will order on average three dishes per person, which will range in price from $5 to $16 each.

“I grew up in the food business, so I know it well enough to break some of the old rules,” said 31-year-old managing partner, Solomon.

New pub on Market Street Philadelphia bartenders Shawn Gormley and Nicolas

Len Lear Moore have unveiled what has been cooking on the first floor of the 200-year-old historic property at 120-122 Market Street, on the southeast corner of Market & Letitia Streets. It’s Philadelphia Bar & Restaurant — a 75-seat gastro pub.

The space features exposed brick walls, original steel beams, white butcher tile left over from longtime occupant Young’s Meats and about 50 feet of bar top, made from a silver maple tree with ambrosia swirls. “The ambrosia swirls were made naturally by

beetles over several decades,” explained Gormley.

Chef Jordan “Red” Sauter, 25, was most recently chefde-cuisine at Northern Liberties BYOB, Modo Mio, from March, 2008, until very recently. Despite his age, “Red” has over a dozen years of experience in the kitchen as well as some strong principles regarding his food.

For example, you cannot have his burger “your way.”

Sauter insists, “It is only available well done. I’ll serve it without cheese for lactoseintolerant customers, but otherwise it’s served my way.”

Sauter’s menu tops off at $20.

Liberté’s focal point is the oval-shaped central bar where mixologist Marc Yanga and his team shake, muddle and stir hand-crafted cocktails.

“Liberté offers French-inspired plates that are easy to share,” said Australian-born Chef Kevin Levett, a veteran of four- and five-star hotel kitchens in Sydney and London. “We incorporate regional ingredients into classic dishes, drawing inspiration from both the local culinary scene and from traditional

French preparations.”
