The Children of Bernard J. Zimmerman Here is a bit of advice to anyone setting up a trust when there are two sets of children involved. When estate planning, it is best for each individual to have their own bank account and trust. If the trust is a joint trust, in husband and wife’s names, either party can change the trust without the consent of the other. If one spouse gets sick, the other spouse can close accounts and/or transfer money to new accounts without the consent or knowledge of the other. So, in order to keep your estate plans the way you truly want them, for YOUR children, set up individual trusts that list each spouses’ children as their successors in their own trust and owners on their own bank accounts. It is very easy for a lawyer to set up a trust, but it is your responsibility to see that it is set up so that your children are not taken advantage of. If you pass first, your children have virtually no control over what happens to your money and belongings if you have a joint trust.
