1. The Executive Yuan (hereinafter referred to as the “Yuan”) hereby establishes the Youth Advisory Committee (hereinafter referred to as the “Committee”) to strengthen the public participation and communicating mechanisms of the youth as well as provide them with participation channels for the formation of public policies.

2. The missions of the Committee are as follows: (1) Collect and reflect the opinions of the youth.

(2) Actively provide advice on public policies concerning the youth.

(3) Other matters concerning the promotion of youth participation in public affairs 3. The Committee shall have one convener, which shall be concurrently held by the Executive Yuan Premier; two deputy conveners, appointed by the Executive Yuan Premier from among the Ministers without Portfolio, one of whom shall be elected by a Youth Representative member; and one chief executive, to be held by the Minister of the Ministry of Education who is also responsible for assisting the convener in coordinating the relevant business of the Committee; the Committee shall consist of 25 to 30 members. The convener, the deputy conveners of the Committee, and the executive director are ex-officio committee members, while the remaining members are assigned as follows by the Executive Yuan Premier: (1) Minister of the Ministry of Labor (2) Minister of the Ministry of Economic Affairs (3) Youth representatives consisting of 20 to 25 persons who in principle, are enrolled students with ROC nationality or

young people in the society aged over 18 years and under 35 years old Several candidates for members who are youth representatives specified under subparagraph 3 of the preceding paragraph shall be recommended by relevant ministries involved in youth affairs and assigned after being selected by the Executive Yuan Premier.

4. The members of the Committee shall serve for a term of two years.

Upon expiration of the term, they may be re-employed (reassigned). When a vacancy arises on the Commission for any reason, such member shall be re-employed by the Executive Yuan Premier for the term until the expiration of the original term.

However, the tenure of the members representing relevant government agencies shall be the same as that of their primary official positions; members who are represented by youth representatives may be changed along with the convener.

5. The Committee meeting is generally held once every four months; if necessary, a special meeting may be held.

The meeting is chaired by the convener. If the convener is unable to attend the meeting for any reason, the convener shall designate the deputy convener to act as the agent.

Members of the Committee shall attend the meeting in person.

However, if a member who is a member of the agency is unable to attend the meeting for any reason, s/he may assign a representative of equivalent rank.

Members of the Committee shall comply with the principles for preventing conflict of interest; without authorization, they may not make any public statement on behalf of the Committee.

When a meeting is held, agencies related to the matter in issue may be invited to attend as required.

6. In order to ensure the quality and efficiency of the meeting, the deputy convener of the Committee may hold a pre-conference meeting to discuss matters such as the agenda of the meeting and the proposals of members. After the proposal of members is discussed in the preconference meeting, it may be considered based on importance, urgency and feasibility thereof. After the resolution, such proposal will be selected to be included for discussion in the said meeting. As for similar agenda in various proposals, it is necessary to reorganize or adjust the content after the resolution depending on the need. A proposal is made after coordination and integration in the preconference meeting.

7. This Council may establish a number of working groups and the convener assigns a member to serve as person in charge, responsible for planning and promoting activities under the work group.

When the working group convenes a meeting, relevant agencies, scholars, experts, civil organizations or other youth representative may be invited to attend.

8. The appointments of Members of the Committee and relevant staff members are in a without-pay status.

9. The Ministry of Education serves as an advisor for the Committee.

The sponsoring agencies of the Ministry of Education and the working group handle the budget for the Committee and working groups’ meetings.
