Disposing of the House After the Relationship Ends

or a couple, buying a house is an act of hope—that the house will become a treasured home and that their relationship will endure. Buying a house is also a business arrangement, in which the parties must consider their respective contributions to the purchase and upkeep of the property, and contemplate what might happen if their relationship does not last. According to the National Association of Realtors, approximately 61 percent of homebuyers are married couples, while unmarried couples account for about 10 percent of the market. Married couples typically take title as tenants by the entirety. If the marriage breaks up, and the spouses cannot agree on what to do with the home, the judge in a divorce proceeding has the power to award the home to one spouse as part of the property distribution, or order that the property be listed with a realtor and sold. The judge’s decision may not make anyone happy, but it is usually final and clear. When unmarried couples part ways, disposing of the home can become complicated and costly. Unmarried couples often take title to their homes as tenants in common, meaning that each party has an undivided one-half (or some other proportion agreed upon) interest in the property that can be transferred without the consent of the other party. If one of the owners dies, that owner’s share goes to his or her heirs. Sometimes unmarried couples take title as joint tenants with right of survivorship, which means that if one tenant dies, the SEPT 2025
survivor succeeds to his or her share and becomes the sole owner. The best course of action for an unmarried couple breaking up is to continue to have a civilized business relationship, and agree to sell the home and split the proceeds, or to agree that one party will buy out the other’s interest. Sometimes, however, emotions run too high for the parties to come to an agreement. If that happens, Missouri law provides the statutory remedy of partition.
In a partition suit, one owner of the property files suit against the other owner or owners and anyone else having an interest in the property (e.g. a mortgage holder), asserts that the parties cannot agree on the disposition of the property, and requests that the court order the property sold and then divide the proceeds according to parties’ respective interests therein. The judge’s power to order the property sold in a partition suit is not as broad as it is in a divorce action. That is, the judge in a partition suit cannot order the parties to list the property with a realtor or select the manner of sale. Rather, the judge in partition action has the 21

power to order the property to be sold one way, which is by the sheriff on the courthouse steps, in a manner similar to a foreclosure sale. The pool of potential buyers in a partition sale is drastically reduced as compared with the pool of buyers in a traditional house sale. This is because the winning bidder in a partition sale must have cash available to pay the full sale price on the day of the sale. As a result, the sale price is often well below market value. The couple who resort to partition to divide their former home both lose in the end, and the winning bidder profits after flipping the home. The utility of a partition action is that the threat of a sheriff’s sale often motivates warring parties to work together in their mutual interest. If that fails, it still brings closure to the business side of a failed relationship. While few people assume that their relationships will break up, the difficulties associated with partition should cause unmarried couples to think twice about purchasing a home outside of marriage.
