he real estate market in 2026 is widely expected to demonstrate strength and resilience relative to recent years, anchored by several key economic and housing-specific trends. While the market won’t necessarily experience the rapid price appreciation seen during the pandemic, many indicators point toward growth, increased activity, and a healthier balance between buyers and sellers.

One of the primary drivers of a stronger housing market next year will be more favorable mortgage rate conditions.

After peaking in the 7%–7.5% range during 2023–2024, mortgage rates are forecast to moderate toward the mid-6% range in 2026, according to the National Association of Realtors (NAR) and other major housing forecasters. This easing of borrowing costs, even if modest, is expected to bring more potential buyers back into the market, as lower rates improve purchasing power for many households. ost real estate contracts are prepared by real estate agents or attorneys, but some independent-minded and expense-conscious investors prefer to draft their own contracts. As an attorney who has litigated many homemade real estate contacts, my advice is this: DON’T draft the yourself. For the average person, the purchase or sale of a home is the most important transaction of your financial life, and doing it wrong can have dire consequences.

If you’re bound and determined to go it alone, keep some basic principles in mind.

DO specify a date, time, location for closing. This is typically when the purchase price is paid in full and when the seller signs a deed to the buyer. Closing usually happens at a title company or an attorney’s office.

DO decide who will be responsible for real estate taxes and put that in the contract. In most real estate contracts, the parties pro-rate the real estate taxes based on the closing date.

DO put your contract in writing. An oral contract for the sale of real estate is not enforceable in a Missouri court.

DO be specific describing the property to be sold. “123 Main Street, Anytown, Missouri” is a good start, but it’s better to include the full legal description of the property from the seller’s deed.
