Contracts for Deed: Let the Buyer & Seller Beware By - Diana Brazeale Most real estate transactions are straight sales, in which the buyer pays for the property in cash or with a bank loan and the seller gives the buyer a warranty deed at closing. Sale transactions are closed at a title company, which will examine the title to the real estate, arrange for title insurance, and work with lenders to arrange the payoff of existing liens and the documentation of new liens prior to closing. Some sellers and buyers do not want to take this route, and instead convey real estate via contract for deed. A typical contract for deed provides for the buyer to take possession of the property and make monthly payments to the seller until the purchase price is paid in full. At that time, the seller is obligated is to deliver a warranty deed to the buyer. Sometimes the seller will sign the warranty deed at the beginning the payment term and have an escrow agent (usually a title company) hold it until the buyer completes the payments. The reasons parties may opt for a contract for deed are manifold. The seller may have an existing loan on the property that he does not want to pay off. The buyer may not qualify for mortgage loan, because of a spotty credit history or insufficient documented income. The property may be in poor condition, so that a lender would be unwilling to finance a purchase. The seller may not have clear title to the property. The reasons for entering into a contract for deed often reveal potential problems.

If you are the buyer, ask these questions: Does the seller have clear title to the property? If you don’t know the answer, get a title report from a reputable title company. Does the seller have an existing loan on the property? If so, consider a contract provision whereby you make your contract payments directly to the lender until the loan is paid off. Many contracts for deed have failed when the seller collected payments from the buyer and then did not make the mortgage payments, resulting in foreclosure. What is the condition of the property and is it insurable? If you have doubts, get an inspection, and consult an insurance agent before you sign. What about the utilities? If the property is rural, find out November 2023

if it has its own well and septic system, and have them inspected. If there’s a shared well, find out who controls it and how many other properties have access to it. Does the seller have other debts that may become liens on the property? Remember that the property remains in the seller’s name until all of the payments are made, and that the property is subject to liens for the seller’s debts.

If you are the seller, you should have some questions as well: Does the buyer have sufficient income to make the contract payments? Request tax returns and/or paystubs if you have doubts. Does the buyer have a history that shows that he is likely to make the payments? Check Missouri case. net, and be on the lookout for recent evictions or lawsuits for debts. Will the buyer maintain the property in good condition, and will he be able to make repairs as needed? If the buyer defaults, can you afford to continue making the mortgage payments AND hire an attorney to get the buyer out of the property? This process is expensive and it can take months. The ultimate question for both buyers and sellers is this: Do you trust the other party? If you sign a contract for deed, you will be dependent on the other party for years to fulfill his obligations. Before you sign, do some research on the person and on the property, and consult a real estate attorney if you have doubts.
