THE PUBLISHER Dear Reader, Marbella is growing solidly once again, and moving rapidly into a new era of modern construction and international investment which will surpass the activity of prior cycles. We predict, however, that the future growth will be gradual and healthy, one of very carefully planned construction and attention to detail, as opposed to the quick-turnaround construction often witnessed in the “boom years” of the previous cycle. With very little new construction having taken place over the last 8 years, there is a strong demand for quality, new villas and apartments. We are also beginning to witness the comeback of the Spanish buyer, along with the comeback of the Spanish economy. Historically, the Spanish market represented the very foundations of the Marbella property market, and no recovery is complete without this critically important sector. The changeover in the municipal government in June 2015 went smoothly, and the new government headed by José Bernal appears to be doing their job well and effectively. The 2015-2016 winter in Marbella has given us incredibly good weather, and we had similar levels of activity as in the shoulder seasons of Autumn and Spring, a resort city with a true twelve-month season. We can hear Marbella singing again! In the past couple of years, most of the major international agencies have taken a foothold in Marbella. The biggest and most recognizable

of them all, Savills, with over 700 offices worldwide, chose Panorama as their Marbella associate office in 2014, followed by Knight Frank, Hamptons International, and a few others all associating themselves with other established reputable agencies in Marbella. Christopher Clover has been writing about Marbella property for 46 years. The Marbella property market is now well into its fifth straight year of recovery, after the bubble burst at the end 2007 and 2008. The number of residential sales in 2015 increased by 9.83 % over the sales volume of 2014 and has almost achieved the volume of the pre-crisis year of 2006, and prices are starting to climb once again in Marbella’s most in-demand residential areas. There is a similar scenario throughout all of Spain, although recovery on a national level is a couple of years behind Marbella whose “head start” to recovery is a result of its “multi-country” source market - whereas the national market is mainly comprised, as one might expect, of Spanish buyers and sellers. As a result, it is safe to say that the property

market recovery in Spain, in this current economic cycle, began in Marbella.

Key market Indicators 1. Sales Volume As one can see from the accompanying chart, the number of sales in Marbella reached 4,390 properties sold in 2015, less than one percent short of the number of sales in the pre-crisis boom year of 2006 when 4,432 properties were sold. It is interesting to note that the rate of increase of sales in 2015 over the prior year has dropped compared with the increase of sales in 2014 over 2013, which was an astounding 28.3%. The explanation is a simple one: there existed a strong pent-up demand

During 2012 and 2013 it became evident that the market bottomed-out in 2011 and the bargain-seeking buyers rushed to purchase properties before prices started rising once again. With most of that pent-up demand satisfied, the rate of growth in the number of residential properties sold in 2015 compared to 2014 has consequently dropped to what still remains a healthy 9.83 %.

Panorama (and are adjusting their asking prices), raised them rather than lowering them. This is in stark contrast to a general trend of price decreases over the last eight years. 4. Bank foreclosures are significantly lower The number of permanent residences foreclosed by banks nationally, dropped by 13% in 2015 after year by year rises since 2008 (source: www.ine.es), another clear indicator of a market coming back to good health. 5. Number of residential construction projects in Marbella Statistics from the Colegio de Arquitectos of Malaga (see chart above) show the number of approved residential construction projects, as well as architects completion certificates issued for finished residential construction projects, from 2010 right through to 2015. These are additional indicators of the strong upturn in the market. 6. Tourism still growing strongly Real estate sales are intimately linked with quality tourism. Conflicts or outright wars in many countries outside of Europe, the depreciation of the Euro against the Dollar

and Pound Sterling, plus the attraction of the great weather in Spain has resulted in the entry of tourists into this country, growing in 2015 at a pace of 4.9%, closing the year with a record 68.1 million tourists (source: www. ine.es). A further announcement in February stated that a record total of â‚Ź67,386,000,000 was spent by foreign tourists in Spain last year (source: pressdigital.es, 5th February 2016). On the Marbella level, the tourism figures are very interesting (see chart far right). Especially notable is the increase of the Spanish tourism market. As we have said many times over many years, an upturn in tourism always precedes an upturn in property sales. Finally, one should take into account that Marbella is the pioneer of a new type of tourism: residential tourism - based on second home ownership, which started in the mid-fifties, and is not included in the official statistics for tourists visiting Marbella. This has given an entirely new dimension to tourism in this area, and is one of the reasons why there are so few hotels, compared with most other resort cities throughout the world where their tourism is largely hotel based.

Reasons for the growth of the Marbella Property Market Every indicator, whether national, regional, or local, shows the same improving market trend. The following factors play the key roles in the recovery of Marbella’s property market: • A quality city, a twelve-month season. Marbella continues to be a low rise quality resort city with a real twelve-month season, which has little competition elsewhere in the Mediterranean, where many coastal cities and towns are simply continuous concrete jungles that roll up the pavements at the end of October until April of the following year. Marbella’s winter population is in excess of 275,000 residents, counting the official population and the “floating” unregistered population together, exploding to around three times that number in peak season. The modern Malaga airport is only 35 minutes’ drive from Marbella and offers direct flights to 125 worldwide destinations every week. The fast train, the AVE, puts Malaga City within two and a half hours of Madrid. Marbella is an ideal spot from which to take trips to the white villages of Andalucía, Seville, Córdoba and Granada with its ski resort, Sierra Nevada. Portugal

is only 4 hours’ drive from Marbella. And all of Morocco, across the Straits of Gibraltar, is just a short ferry trip away. Marbella ticks most of the boxes for many people due to the above factors and many more. It doesn’t for others, who prefer the Balearics or other prime resort areas. And that is as it should be. • A low Euro. The Euro continues its low against Pound Sterling and the Dollar, making Marbella area real estate relatively more affordable for those who count their assets in other currencies. • Competitive pricing. There remains an ample inventory of resale properties, especially but certainly not exclusively below €1,000,000, which are highly competitive in price, as prices take time to catch up with the larger number of sales. • Low mortgage rates. With interest rates at record lows plus fierce competition among Spanish banks, there is plenty of motivation for purchasers to obtain mortgages. Typical 20-year variable rates as of April 2016 are Euribor (nominal rates, as of writing at 0%) +1.70% and fixed rates from 2.75%. • High yields when compared to other types of investment. With interest rates heading towards negative, and a bear stock market, real estate investment becomes markedly more attractive, especially if combined with the incredible lifestyle change of living part of the year in Marbella. • A safe haven. Marbella is considered a safe haven of quality within the European Union. This factor alone attracts hundreds of millions of euros of real estate investment every single year by investors from less secure parts of the world, in addition to buyers from the classic markets within the European Union itself.

Who is buying? In the fourth quarter of 2015, buyers from the E.U. made up more than 60% of all foreigners purchasing properties. Once again the British were the largest single group, with over 30% of the total number of foreign residential purchasers in Spain (see chart above). In Marbella, the foreign purchaser easily represents 80% of the overall property market.

What is selling? All types of properties. Marbella provides an amazing variety of high-end as well as less expensive properties. It is fascinating that there can be mansions for sale literally walking distance to Puerto Banús, in high quality residential neighbourhoods, priced at several million euros, co-existing with beautiful, but lower level homogenous areas nearby, also walking distance to Puerto Banús, priced from €250,000. Sales are increasing across the board and in all categories, from the least expensive to properties priced over €10 million. High-end market is back with strength. One clear trend is that the number of “highend” property sales -which we define at €4,000,000 or above- is accelerating. We have estimated that there were over 100 sales in the greater Marbella area over €4 million in 2015, easily 30% above the prior year’s sales in that category. New or refurbished properties. Many buyers are not very keen on undertaking refurbishments themselves with respect to properties built more than 10 or 15 years ago. But those who want to own properties in certain areas have limited choice, since there has been very little new construction in the last 8 years, and it will be another year or two before the supply of newly built or refurbished properties increases. While there are buyers for older properties, these are mostly buyers or investors (either local or international) very familiar with the Marbella property market, seeking to refurbish properties either for their own use, or for resale for a profit. Scores of smaller companies or investors have been searching out these older properties to refurbish over the last three years.

Other market insights The building cranes are up again, the wheel has turned, the cycle starts anew. 1. Prime land and new projects Another recent trend in Marbella is the re-emergence of investment groups from different parts of the world– most of them well known, some of them private consortiums – studying the market, and many of them buying up the best building sites available. Virtually all of the prime, fully-zoned sites have been sold over the past two years, including what is effectively the last major beachfront development site on Marbella’s Golden Mile, a well-known parcel of land to the west of Marina Puente Romano called “El Ancón”, where planning for an ultra-modern beachfront residential estate of about 65 apartments and 5 villas has already begun. Other major investment purchases have been 170,000 m2 of beachfront land in the eastern part of the municipality, between the Los Monteros and Don Carlos Hotels, by Platinum Estates of Hong Kong, for the construction of a five-star luxury hotel resort with 600 linear beachfront metres that will also include “branded” exclusive villas, a beach club and a commercial area – a planned investment of €200 million; Urbania’s brilliant development “Icon” of 28 villas and 160 apartments in Santa Clara; new developments by Taylor Wimpey, one of the strongest developers on the Coast today, selling off-plan very successfully; and various projects led by the Norwegian Solvilla group. The best of the remaining groups of single family plots have also sold to developers, large and small, who are planning different projects of mostly gated communities comprising from five to thirty villas. In summary, there are about 20 new projects starting in Marbella, with easily another dozen or more in the pipeline.

2. Betting on the top-end of the market The trend towards building for the top-end of the market is clear. Not only has there been a tremendous investment in real estate over the last two to three years in Marbella, but also there has been a big vote of confidence for the highest-end of the market on the Coast west of Marbella. In late 2014 Sotogrande was sold to the top U.S. and European funds, Cerberus Capital Management and Orion Capital, with plans just now being finalized to produce stunning projects destined to appeal to the most wealthy buyers. Further details are available through Panorama. Also, in January of 2016, La Zagaleta (U.K.) Ltd., a subsidiary of the company owning perhaps the most exclusive country clubstyle residential estate not just in the Marbella area but in all of Europe, purchased the Valderrama golf club and nearby development land for an initial investment of €40 million with an additional €200 million of planned development and investment over the next decade.

This is clear, hard evidence backed by big money, that the entire Marbella coast and westward is rapidly moving into a new era of property development. 3. Marbella’s next General Zoning Plan In November of 2015, Marbella’s 2010 general zoning plan was nullified by the Spanish Supreme Court, an action that caused the municipal general zoning plan to revert immediately to the old 1986 plan. Although this came as a big surprise, this is not particularly bad news: the 2010 plan was extremely difficult to manage from an operational standpoint, including the necessity to analyze the “urbanistic charges” in many urbanizations and the requirement for compensations from developers of these affected properties, in addition to the many unjust and conflictive legal situations arising from that plan. While a new general plan is being drafted (which will take three to four years before final approval), intelligent provisional measures are being taken by the Town Hall

“There still remain some wonderful buys in all price categories but especially below €1 million.” to protect the interests of those owners particularly jeopardized by this nullification, including specific modifications to the 1986 plan which, once approved by Marbella’s Town Hall, can then be sent for approval to the regional government. There is a consensus among top experts in urbanistic issues that the annulment of the 2010 plan will not affect most end-buyers of real estate, other than to eventually reduce the supply of new properties for sale over the next three to four years. In fact, few potential buyers are querying this event as they expect to be protected by their lawyers as well as their agents in order to avoid purchasing properties with significant issues or risks. To put this issue in perspective, only 15% of the properties in Marbella are affected by this change (Diario Sur, March 4th, 2016). While many developers have been affected by not being able to develop their land until the new general zoning plan is approved, others are now in a position to build more than they could under the annulled plan or build where they previously could not build at all. Since

approximately 17,000 living units can still be built under the 1986 plan, according to the Town Hall (Diario Sur, March 13, 2016), it certainly does not appear likely that Marbella will run out of development land in the next three or four years. Most seem to agree that the end result of the new General Plan will be positive and the interim, manageable.

Future predictions and trends • Is Marbella in a buyer’s market or a seller’s market? The truth is somewhere in between, and it also depends on the price category and location. While most are competitively-priced, we find that the price of some of the most expensive properties on the market to be overly optimistic. There still remain some wonderful buys in all price categories but especially below €1 million, where we anticipate that the stock of resale properties will last for some time to come, except for the best-located properties. • Will it take less time to sell? While a wellpriced, very well located property can sell within weeks, selling a property in Marbella An International Associate of Savills

The Spanish buyer will gradually return to purchase property in the Marbella area, as the national economy continues its improvement over the coming months, as they have been returning already as tourists (see chart).

in the best of times can still take a year or more, depending on its location, condition and the applied pricing strategy. For anyone wanting to sell quickly, there is a market to buy it (unlike five years ago) and the sale is only a question of having a good agent who can advise you on the correct asking price and who knows how to get the property quickly on the market. • What is a good investment? When one remembers that most prices are still at 2004 levels, we believe that any property bought at a fair market price today in Marbella will stand to give excellent capital appreciation over the next years. • Both supply and demand will increase. The trend towards the construction and sale of properties in all price categories in the greater Marbella area will continue unabated. • Prices will continue to gradually increase. Especially with properties in the €1,000,000plus bracket where there is less supply. As demand increases and supply shrinks, prices will gradually increase. • Land prices will continue to increase. Well priced plots in the best areas of Marbella will become harder to find as the supply dwindles.

• A new era that pushes the limits of architectural design. Amazing, creative new projects will be put on the market in 2016 which will result in pushing Marbella towards a new era of real estate. One must remember that there has been very little new construction in Marbella for the last 8 years. • The Iranian market. The newly-opened Iranian market will start purchasing in Marbella, which has been historically very popular with the Iranians for decades. • A gradual market improvement. Even though Marbella has led the property market recovery in Spain due to non-residents snapping up bargain properties since 2012, we do not expect a property “boom”, but a more gradual, balanced, healthy market improvement as we have seen in 2015 and as 2016 appears to be shaping up. Panorama opened its first office in Marbella in 1970, on the firm premise that this area was so special that it would, with luck, good governance and continued good planning, remain so and become one day, perhaps the most important resort city in Europe. Nothing has been more fascinating than to witness first-hand the evolution of this magnificent resort city, and the beauty it has held in each of its stages of growth. After 46 years, and the ups and downs of several cycles it looks to us as if Marbella has come a long way towards realizing its full potential.

Finding a property The Internet has become by far the most useful tool for those looking to buy properties and a net-based property search is usually the first step taken by any potential buyer. But, is it the right second step, once one sees a few desirable properties on several sites, to contact and make appointments with all the agents offering those properties, agents you don’t know or may not have even heard anything about, some of whom do not even identify themselves correctly on their sites? Perhaps another option to consider, even while looking at everything on the net, might be to seek out as a first priority a really qualified, experienced agency to work with that has a large direct inventory of the kind of property you are looking for. There are several great agents in Marbella to choose from, many who have outstanding credentials, long experience, excellent product and area knowledge, and adhere strictly to the agents’ code of ethics. Additionally, choosing such an agent will assure that they pull out all the stops to spend plenty of time with you to get to know you and your special requirements as well as possible, sharing with you their market knowledge and recent comparable sales actually made, and who will eventually find just the right property for you. If it’s not in their own inventory they will go out and find that special property through their colleagues in other agencies on a commission-sharing basis.

Choosing a lawyer Panorama always recommends that purchasers of property in Spain retain a

qualified solicitor to represent them and qualified financial advisors to deal with tax issues. Once you have made a decision to purchase property here, even though you may not have found that special property yet, establishing a relationship while you are in Marbella can be immensely useful if you start negotiating a purchase after returning to your country of residence, as it is clearly more difficult to choose a lawyer long distance.

Getting the basics into place Having a lawyer, NIE number (a number issued to foreigners in Spain) in place, and bank account opened strengthens a buyer’s position when negotiating as he or she can put down an immediate deposit if an offer is accepted, since all the other details will have been taken care of already.

too low it will not engage the interest of the seller, and might actually prove counterproductive. An articulate offer will generally capture the attention of a vendor. We recommend getting all your points together, rather than negotiating “piece meal.” Make your offer in writing if possible (of course, subject to contract). Points to include are not only the price, but also the deposit amount and when you are prepared to pay it, when you are prepared to complete the transaction, what you understand to be included in the price (for example furniture and fittings if applicable), and an often neglected point – that all technical equipment and installations should be in good working order. Also, if you have a second choice property you should certainly advise the vendor of this fact. Your lawyer can also be consulted during the negotiation to ensure that the terms of the offer meets his or her legal criteria, and on occasion will also become actively involved in more complex negotiations.

The purchasing process Actually purchasing a property in Spain is a relatively straightforward procedure. The “last word” in property ownership

is the property registry, which will show immediately if the seller owns the property free of liens and encumbrances. Most frequently, unless an immediate payment of the full purchase price is made, a private contract of purchase is drawn up wherein the details of the purchase are reflected – the legal description of the property, purchase price, form of payment, date of completion, date of possession, etc. Upon signing the private contract, a payment on account of the purchase price is always made which can vary substantially according to the terms of the sale and the date of completion. A quite normal deposit for completion within 30 to 60 days would be 10% of the agreed purchase price. New properties which are unfinished obviously are paid for over the construction period, and all payments on account before finishing must be guaranteed, according to LAW 38/1999, by a bank or insurance company: if the property is not finished by a certain date, a purchaser has the right to reclaim the monies paid, plus legal interests. Additionally, another law obliges the property developer to arrange a ten year insurance policy with respect to any basic building defects with the purchasers as beneficiaries. When the entire purchase price is paid for the property, the seller will issue the public deed of conveyance (escritura) to the purchaser, free of liens and encumbrances. This deed is issued before a Spanish Notary, is passed from the notary to the tax office to be assessed for Transfer Tax if the property is a resale or second hand property, or assessed for Stamp Duty if the property is sold directly by the developer. It’s then presented to the Property Registry for inscription. A provisional inscription in the registry is made immediately upon issuance of the deeds.

His father, the late Williston ‘Bill’ Clover, established a highly successful estate agency in Charlottesville, Virginia, named Clover Realty that specialised in the sale of farms and important historical estates. He opened his agency in 1952 and during over forty years he built a reputation as one of the most prominent professionals in his field within this prosperous historic town surrounded by the lovely countryside of Albermarle County. The birthplace of Thomas Jefferson, it is an area known for its exclusive properties and the prestigious University of Virginia – from which Chris graduated with distinction in 1969, as did his son Alex, in 1998. But the tradition goes back even further. Though Bill Clover was a remarkable man in his own right – an accomplished athlete, Black Angus cattle farmer, tennis professor, a

designer and builder of beautiful homes, and a property developer – he too built his business on foundations bequeathed by the previous generation. Bill’s original partner had been his dad, Burtt B. Clover who opened his first real estate agency in Chicago in 1904, and went on to an important role in the development of the town of Itasca in the newly expanding suburbs of Chicago in the early 1920’s.

Marbella was already internationally renowned as a luxury ‘jet set’ resort destination at the time, having earned a fame that spread beyond Europe to the United States. “The original idea was to primarily service American buyers and investors interested in this area,” recalls Chris, “but soon we had built up an international clientele based mostly in Europe that reflects the cosmopolitan nature of Marbella”. Chris moved here in 1973 with his first wife Kirsten to head the rapidly expanding new ‘foreign office’, and it didn’t take long for him to fall in

love with Marbella himself and set down roots here. “Those were the days when you had to ring the operator in Malaga and sometimes wait all day to get an international call through. The main link to the outside world was our cherished telex machine” recalls Chris.

“We were the first real estate agency to organise property inspection flights to the Costa del Sol, bringing in clients gathered through exhibitions and our extensive associate network in the United States at the time, and when people saw the setting, the lifestyle and the Andalusian culture they too were sold.” On one memorable occasion, Chris and his sales team received a charter plane of 120 people comprising 75 ‘buying units’ to whom they made 49 sales that week – mostly of apartments and villas in Nueva Andalucía and Bahia Dorada in Estepona, priced at between $5,000 and $30,000. “My father showed great foresight in targeting Marbella as the jewel in Europe’s second home market” says Chris.

Selling one’s property is an art. The property market in Marbella has always been competitive and sellers with less experience might achieve far better results if they take advice from experienced professionals. By Alex Clover This brief article is intended to share some essential points about selling properties, based on our own experience of more than 45 years. Marbella is not a big city like London, Madrid or New York with a captive market within 50 kilometres of the centre. Instead, it’s a small city with a mostly secondary housing market and a buying public spread out all over Europe and the world – a subtle but important nuance. Most buyers are not looking for a primary residence here, but a second or even a third home. This makes Marbella real estate less of a need and more of a luxury in which people are not drawn to property close to centres of work but to the quality of life a property can offer them. As a result, one characteristic of a secondary housing market is that especially luxurious properties can take a longer time to sell, though in our experience this is considerably shorter where both buyer and seller are serious in their intent.

Establishing an asking price The most important thing to establish is a ‘sales strategy’, at the heart of which is the asking price. In other words, if you ask too much for your property, people will not even

bother to view and it will linger unseen. Ask too little for your property, and you are potentially throwing away money. The right asking price is perhaps the most essential ingredient in the art of selling real estate and is the result of thorough market research. Do not opt for the figure you would like to hear, find out the true market value, taking into consideration: what sales of comparable properties have been accomplished, and at what price? What are other owners with similar properties asking? The more unique a property, the more an owner can ask for it and the stronger they can negotiate when trying to seal a deal. The less unique a property, the more the owners are going to have to resign themselves to the fact that there is a large supply of similar properties, and that they will have to price it competitively.

Avoid quoting a ‘net’ price One thing to avoid, if you intend to use agents to market your property, is listing on a net basis, where you want a fixed sum with the agent’s commission added on top. What will happen is that you can end up with a property marketed at several different prices, leading to confusion among potential buyers. Wise sellers will form a team with their

agents and protect their agents’ commission, as they too expect to be protected and advised by their agents, and fix one sole asking price for the property, inclusive of commission.

Exclusivity or not?

A responsible agent will try to avoid taking a sole agency unless he sincerely feels that the asking price is correct and that he or she is truly capable of selling the property within the time frame allocated. Providing agents you trust with easy access to the home is important in order not to lose potential buyers, though a good agent will screen interested parties first. They will also offer advice on how best to present the property for viewings and approach the negotiation process.

Should you give an exclusive sales agreement to an agent? If you are an absentee owner, or if you don’t feel like playing a co-ordination role among various agents of varying ability, granting exclusivity to a leading agent can make your life a lot easier. It also provides the agency in question with the confidence to fully dedicate its energy and resources to the marketing and promotion of the property. A professional

Commission Rates The standard agency fee in a resort area such as Marbella is 5% plus VAT, which covers the marketing, promotion, and listing of properties and the arranging of viewings, follow-up with prospective buyers, property searches, providing background information and support throughout the buying process and beyond. Agents don’t give keys out to clients, they always show properties personally and they will spend a great deal of time in their efforts to find the right buyer.

Frequent comments by sellers: “My property has been on the market for months and I’m hardly getting any viewings.” The only times this might be considered to be normal is if your property would only be of interest to a small cross-section of buyers – or if it is overpriced. If neither applies your property is not getting enough market exposure. Our advice: speak to your agent or

An accurately priced and marketed property should be getting a regular stream of clients viewing it. “All the clients that agents bring to my property are time-wasters.” Are they really? It likely needs to be reduced in price or perhaps you could consider making market-driven renovations in order to increase its appeal. And always

The more people who view it, the better chance there is of one of them falling in love with the property and buying it.

While photography should be representative, it should also present your property as well as it can, enthusing potential buyers. To stand out from the crowd you may need professional images, especially indoors.

If there are any small repairs or repainting that would enhance the overall appeal of the property, it’s well worth getting this work done now to eliminate any small ‘objection factors’. Also, make sure your home is spotless for photography and viewings alike, and you will instantly create a favourable impression.

If you need to sell your property within say two to three months, you need to be prepared to price it at a heavy discount when compared to similar properties on the market. This is when you really need a very knowledgeable agent working for you who can suggest the price that will achieve the sale. “How much negotiation room should I build into my asking price?” With the help of your agent we recommend pricing the property taking into consideration not only similar asking prices, but also prices at which similar properties have actually sold. Many buyers are very knowledgeable today and will recognize a realistically-priced property, but bear in mind that few will want to pay the full asking price, so leave some room for negotiation.

OTHER TIPS FOR SELLING YOUR HOME: Your property should be presented in its best light First impressions count. When agents take clients to view your property, ensure that curtains and shutters are open to let lots of light flood the property. Check your agent’s website to see how your property is presented, in terms of the photographs, the description and the accuracy of the information provided.

Get your main agent to put up their ‘For Sale’ sign This always results in enquiries. Many potential buyers drive around different residential areas before going to an agent. Without a sign, they wouldn’t know your property is for sale. Not allowing a sign to be placed is to block one of the many proven paths for reaching the market place. Our experience is that signs still help significantly in selling properties.

Facilitate viewings on as short a notice as possible If you leave your keys with a neighbour who plays golf three times a week, you are losing a vital chance to show the property at the client’s convenience. Bear in mind that the first properties that agents tend to show are the ones for which they have the keys. Properties that need appointments to be set up in advance will generally be shown less.

Negotiating a sale Let your agent form a team with you in handling negotiations, checking points with your lawyer and tax advisor when necessary. This is your agent’s job and one of the reasons you pay the agency’s fee, and experienced real estate professionals are generally far better at negotiating the commercial points of a deal than lawyers. Once this is accomplished, your lawyer should take the lead role (in coordination with your agent when necessary), draft the sales contract and supervise the eventual completion of the sale. If you are frequently travelling, it can often make sense to leave a Power of Attorney

Is the buyer expecting a counter offer from you or has he or she given you a one-andonly, take-it-or-leave-it offer? Do they have other properties in mind? Is their offer a fair one? Are all details included in the offer – price, target contract date, deposit, completion date, and precise understanding of what is included in the sale in the form of fixtures, fittings and furniture, etc.? All these items should be agreed upon at the outset before lawyers are instructed. Don’t allow yourself to be pressured by your agent or anyone else to accept an offer! A good agent will simply point out your options and offer advice based on his experience, but once you decide to proceed it is good not to waste time and risk losing the buyer. In summary, selling a property can be as easy or as complicated as any task involving one’s personal affairs. Competent, honest, professional help from agents, lawyers and tax advisors can go a long way to help you manage your sale objectively and easily.
