Howell resigns from council, citing cancer JONATHAN SIMMONS NEWS EDITOR

Palm Coast City Councilman Jack Howell has resigned from the City Council, citing personal health reasons.

“I had cancer-related issues that are presenting themselves again, and I don’t want stress because stress is not good on cancer,” Howell said July 9, the day he gave his letter to City Manager Matt Morton.

Howell had been the councilman for the District 2 seat, and took office in 2018. A retired Marine Corps colonel and a pilot, Howell is also the founder and

CEO of Teens-In-Flight.

“I’ve enjoyed my time on City Council,” Howell said. “Was I frustrated? Yes, because there was a block vote against me. ... I knew that going in.”

He added that his resignation was unrelated to recent controversies about the city’s relationship with Coastal Cloud.

“I have to look after me nowadays,” he said. “At 77, I don’t have too many years left, and my goal is at least to try to make it until next year.”

By refusing to sign easements that would allow a $25 million dune restoration project to proceed along their beachfront property, 13 property owners are endangering the entire 2.6-mile proposed Army Corps of Engineers project, according to the Flagler County government.

“If we can’t get this logjam broken in the next couple of weeks, this is essentially a dead project,” County Administrator Jerry Cameron said during a July 13 County Commission meeting.

“The Corps is not going to move forward with gaps in it. I don’t know how we would deal with that; unless these folks come to the conclusion that we are in fact improving their property considerably by this effort ... I think that we’re essentially dead in the water.”

The county government has spent months attempting to get individual beachfront property owners to sign easements the Army Corps of Engineers requires in order to add additional sand on all of the properties along the 2.6mile stretch of coastline that has been determined to be most at risk of future storm damage.

The county had been approved for the federal project in the aftermath of damage sustained during Hurricane Matthew.

Because gaps in the restored dune would lead to “breach points” that could compromise the project’s integrity, the Army Corps of Engineers will not proceed if it doesn’t receive easements for all of the properties.

So far, the county has received 126 easements, but is missing easements for 15 properties owned by 13 people.

Of those, 10 are represented by an attorney and want the county to pay to have the work performed on their land, County Attorney Al

Hadeed told county commissioners in the July 13 meeting.

The county’s deadline to obtain all of the easements was June 30.

County officials met with Army Corps officials on Wednesday, July 8, to discuss options, Hadeed said.

“We talked about excluding the properties that didn’t sign,” he said. “They said that that would not be possible, that it would violate the congressional directive as to the restoration of these dunes. ... We did talk about the possibility of temporary construction easements as one option to try to get around unwilling owners and perhaps resolve issues at that time, but they said that is not acceptable under their rules.

Right now their standard is, looking at our beach, they need a 100% participation by owners in order to proceed with the project.”

The 10 people who are holding out for money have already been informed that the county and the city of Flagler Beach don’t have money to purchase interests in properties, and that the dune restoration would enhance their property’s value, not lessen it, Hadeed said.

County Commission Chairman David Sullivan called the situation unfortunate, and asked if all of the property owners understand the situation.

“Essentially, Mr. Chairman, it boils down to this,” Cameron replied. “Maybe not 100% of them, but the majority of them: ‘If you want to improve my property and protect it, you have to pay me.’”

Hadeed said that there’s a fairness concern over any possibility of paying the holdouts: If the holdouts were paid for their easements, that would be unfair to people who had already signed easements in good faith.

“We told everybody from the very beginning, ‘Look, we want to put all of our money into the dunes. We do not have any money to purchase property interests,’” Hadeed said, “... If we were going to pay anybody, it would seem to me we need to pay them all.”

Commissioners agreed that they would not pay for easements.

Among the property owners who have refused to let the Army Corps of Engineers build a dune on their property was one man who would speak to the Palm Coast Observer only on the condition that his name not be used.

The owner is represented, as are 10 others, by Clearwater-based eminent domain attorney John LeRoux. LeRoux did not immediately respond to a request for comment.

The owner was frustrated that the county has said he can’t access the beach without a dune walkover and that parking is restricted on the beachside of State Road A1A. He believes he should be able to access the beach by walking directly down from the road.

The property owner said he had not spoken with anyone from the county to hear the county’s side of the story. (Regardless of the Army Corps project, a walkover would be required to legally access the beach from his property.)

“I’m not opposed to helping out in the project,” the owner said. “If you want it and need it, then here it is, but there’s a cost.”

Another owner, Raj Desai, said he consulted with his Flagler County neighbors as well another eminent domain attorney in Jacksonville to make sure he had all the details. Desai decided to sign the paperwork to allow the dune to be built, after he was advised independently that his property would be benefitted, not harmed, by the project.

Will the county get desperate enough to pay the holdouts, regardless of the legal necessity to do so?

Flagler County will sell the former Sheriff’s Operations Center property on East Moody Boulevard for $807,000, concluding a years-long debacle that began when deputies started reporting strange symptoms while working in the building, and environmental testing revealed mold and water intrusion.

County Commissioners voted 4-1, with Commissioner Joe Mullins dissenting, to accept GPR1 LLC’s bid for the property.

“This is a historic moment in our county over the past few years,” Commission Chairman David Sullivan said.

The structure at 901 E. Moody Blvd. was previously a hospital, and sat vacant for years before the county bought it and repurposed it for the Sheriff’s Office’s use.

The county is still paying off the costs of the renovation. The FCSO evacuated its staff from the building in June 2018 after staff members filed worker’s compensation claims for illnesses they thought were related to the building.

“As a property owner,” Sheriff Rick Staly said during the meeting, “I don’t like the debt that we’re being saddled with, either.

But the reality is, it’s time to close the chapter, put it behind us.”

Evidence stored in the building has been moved, with the exception of gambling machines which will be destroyed this week.

The county had decided not to try to remediate the building itself, County Administrator Jerry Cameron said, because although a CDC report on the structure had suggested potential remediation steps, it didn’t guarantee that taking those steps would render the building habitable.

“So it would have been a risk to go forward,” Cameron said. “But the people who have bid on it are fully aware of the risk.”

GPR1 LLC placed its bid on July 8, and submitted a $40,350 check for a non-refundable bid deposit, according to a county staff document. GPR1 LLC lists a mailing address in Ormond Beach and a registered agent who lives in Flagler Beach.

The building is being sold asis, and the results of all studies conducted on the building will be given to the buyer, Cameron said.

The county decided earlier this year to build a new, replacement Sheriff’s Operations Center on Commerce Parkway near the county’s Emergency Operations Center in Bunnell.

City Council considers holding tax rate steady

Presenting the City Council with options for the coming year’s millage rate, city staff at a July 14 City Council meeting proposed setting the maximum millage rate at the current rate of 4.6989.

Because the Property Appraiser’s Office is predicting a property value increase of 6.8% in Palm Coast, holding the millage rate steady would bring in an estimated additional $1.6 million in property tax revenue for the city government, according to city staff.

That money that could be used to help patch shortfalls from revenue loss in other areas of the city budget due to COVID-19. It’s not entirely clear how much the city will lose in revenue.

“The state revenues that we have not received ... are a concern,” said Helena Alves, the city’s finance director.

“They’re typically released in July. … In this environment, that is a big wild card.”

The city also hopes to add four staff positions this year

— to hire three firefighter EMTs, and convert two parttime Parks and Recreation positions to full-time.

The city will vote to adopt its maximum millage rate in a meeting on July 21, and will vote on its final millage rate and budget on Sept. 23.

The rollback rate — the rate that would bring the city the same dollar amount in sales tax revenue as was received this year — would be 4.5236, according to city staff.

The council also considered a presentation

of the city’s Strategic Action Plan Roadmap for 20202021 — including focus areas such as the Town Center Innovation District, a business-friendliness initiative, and streetlights — but City Manager Matt Morton cautioned that the roadmap, in the context of COVID-19, is optimistic.

Mayor Milissa Holland noted that the city will have to have a “real, honest conversation” about which projects to move forward.

Holland: Friend got COVID-19 at Publix Warning residents to take mask-wearing seriously, Mayor Milissa Holland said one of her friends recently took a COVID-19 test as part of a requirement to go on a trip, and the test came back positive — even though the friend had no symptoms.

The friend had tested “at a very high percentage,” Holland said.

“They asked her where she had been especially in the last three days, because to test that high you’d have to actually come in contact with someone that would have transmitted it in that time period,” Holland said.

“The only place she had been, with her children in the last three days, was Publix.

And she got it at Publix, and her two children tested positive. So: no symptoms, feeling fine. However, they’re asymptomatic, walking around our community, not knowing.”

Holland said she’d been to Publix herself over the weekend, and only noticed one person not wearing a mask.

“There was tremendous compliance with this, so thank you to our residents. ... But I share that story with you because that is what happened even as of last week. ... You could be walking around feeling fine right now and not know that you indeed have COVID-19.”

County rejects agreement with Captain’s BBQ City seeks applicants for council The case over Bings Landing may proceed to jury trial.

Flagler County Commissioners voted 5-0 on July 13 to reject a proposed mediation settlement with Captain’s BBQ, the restaurant at the county-owned Bings Landing park.

The county government and the restaurant have been in mediation since February 2020 over the details of the restaurant’s use of the county facility, after the county in 2018 at first approved, then weeks later rejected, a lease that would have let Captain’s BBQ’s owners build a larger restaurant building in another part of the park.

“I’m absolutely in favor of declaring an impasse on this mediation,” County Commissioner Donald O’Brien said.

“There’s a number of things here that are very concerning to me, and that I could not accept. The rent is not even close to market rate. ... I can’t accept the rent as it would be delineated going out to 2040 ... I can’t accept assignability of the lease; I can’t accept any control whatsoever of the pavilion, for not even for one day — it should be for first-come, firstserved for the public; and I’m real uncomfortable with renewal options that take us out to 2041.”

The terms proposed in the mediation settlement would have required the county to renovate the county-owned building in which the restaurant operates,

would have given Captain’s preferential access to a nearby park pavilion on holidays, and would have extended below-marketrate rent into the future.

Commissioner Joe Mullins warned about the possible legal consequences of rejecting the mediation settlement.

But Commission Chairman David Sullivan was also uncomfortable with the agreement.

“I tend to agree with Mr. O’Brien on this, that an option three impasse is the only way we can go,” Sullivan said. “Doesn’t mean it’s over or anything else, but I don’t see any way else to go at this point.”

Commissioner Greg Hansen agreed.

Palm Coast resident Peter Johnson thought the restaurant’s rent was too low.

“I think that in the future, the commission should be extremely careful on selling out our parks, basically, to private enterprises,” he said. “As far as use of the pavilion goes, I agree with Mr. O’Brien: There shouldn’t be a single day that they basically don’t have to play by the rules.”

Rick Belheumer, a Flagler Beach city commissioner, noted that the Flagler Beach government has an agreement with a restaurant — the Funky Pelican, on the Flagler Beach pier — but it requires the restaurant to share its profits with the city government. The proposed lease mediation with Captain’s BBQ doesn’t require that.

County Attorney Al Hadeed, responding to a question by Mullins, said the case would likely proceed to a jury trial.

O’Brien said he understood the potential consequences.

“I’m making my comments and my recommendation with the full understanding that we’re going ahead to a possible jury trial, and if that’s the way it is and we can’t get a better draft mediation settlement than what we have now, then that’s what needs to happen, in my mind,” O’Brien said.

Palm Coast will seek applicants for the District 2 City Council seat vacated by Jack Howell, the councilman who resigned on July 9 for health reasons.

The City Council held a special meeting July 14 about how it will handle the vacant seat, which leaves the council with four members instead of its usual five.

According to the city’s charter, City Attorney Bill Reischmann told council members, the city must select someone to appoint to the seat within 30 days. The seat, because there are still more than two years remaining in the term, will then be up for election at the November election.

The city will advertise the vacancy in local media and send letters to Citizens Academy graduates, committee members and former council members who live in District 2.

The city must receive applications by noon July 24. (View the application form at shorturl.at/ ejvF9 ). The council will shortlist candidates on July 28, then interview shortlisted candidates and make a final selection during an Aug. 4 council meeting.

“We want someone who knows a wide range of issues that we deal with on a daily basis,” Mayor Milissa Holland said.

seat in the election, as it may give them an advantage.

Howell’s resignation came too late for the seat to be placed on the ballot for the August primary, so it will go on the November ballot, Reischmann said.

Because there will be no primary election for the seat, whoever wins the election by a plurality in November will win the seat. A tie would be selected by a coin toss.

That’s happened twice in Palm Coast, Holland said.

Because COVID-19 would complicate the process of seeking candidate petition signatures, council members considered waiving the requirement that council candidates collect 150 signed petitions or pay a $960 fee to qualify to run. But they decided against waiving the requirement.

“The people who really want this job: Show me how much you want to serve,” Councilman Eddie Branquinho said. “... If you really want to serve, show me that you’re willing to work for it.

Councilman Bob Cuff agreed.

“We need to have some qualification,” he said.

He noted that petitions could be distributed electronically. They would still need to be returned to the candidate as hardcopies.

“I think providing the option for collecting the necessary signatures on petitions electronically as an alternative to paying the fee is still a good way to do it,” Cuff said. The council agreed.

Views on mask mandate: too far vs. not far enough Mask mandate needs enforcement Dear Editor: The Palm Coast City Council continues to pussyfoot around with the mask-wearing issue. Months ago, maskwearing began as a friendly reminder, then evolved to a slightly stronger CDC recommendation, and later just another anemic recommendation that was craftily dressed up as some legal-sounding “Proclamation.”

Then, last week, forced by the surge in virus cases, the council finally came out with the “mandate.” But, it has no teeth, it’s not an enforceable ordinance, it has no sanctions for non-compliance, and as such is not much more than the old friendly recommendations.

And, as to compliance, nothing meaningful is likely to change. We will still have the usual irresponsible recalcitrant residents refusing to play ball and simply thumb their noses at this kind of mandate.

The council’s lack of will and courage to get serious about mask-wearing continues, and, unfortunately, any commitment to enacting a meaningful enforceable ordinance remains elusive.

Allegations of misuse of her official title to advertise for business for the private company that employs her are extremely disturbing to me as a citizen of Palm Coast. Mayor Holland’s emails to Orlando city officials clearly pose a serious issue of conflict of interest.

Her denial of even knowing of the marketing letter put out by her employer after “interviews with her” is preposterous on its face. Her private emails that appear to use her position to open doors for her

County should impose mandate Dear Editor: Our governor took a page from the presidential playbook and decided to hand off to local governments the responsibility to adopt measures to ensure the safety for local

I would ask the Palm Coast City Council members to demand that Mayor Holland step down, but they are afraid of the mayor and clearly lack the courage and perhaps the integrity to take any action.

A mandate that people wear masks when entering a building would be unenforceable.

So we must have an immediate independent investigation of the allegations, and the council should nominate a temporary mayor, one that is not currently running for re-election on the council. The investigation must be completely independent of the city’s attorney.

The allegations against Mayor Holland are alarming.

Why is there no enforcement of fireworks law?

Dear Editor: Even though fireworks are illegal in the city of Palm Coast, inconsiderate residents continue their blatant disregard for these ordinances and laws and persist to annoy us, terrorize our pets and wildlife, create a fire danger and enable their children to disobey the law. And there has been, as always, no noticeable enforcement efforts.

This year there were 158 fireworks-related complaints made to the Sheriff’s Office over the July 4 weekend, but there were no arrests, no citations, and no confiscations of

illegal fireworks.

Since our law enforcement officials obviously don’t care, the responsibility has to shift to the folks in our community to simply be responsible respectful neighbors.

Have a nice barbecue, display the flag, drink some beer, enjoy friends and family, wave some sparklers around, and be considerate of neighbors and their pets, recognize the dangers of fireworks and demonstrate to your kids what it’s like to be a responsible law-abiding citizen and a good neighbor.

voted them into office but now, they do not trust you or me, the governed, to make decisions that impact our own lives and our health.

In effect, the Palm Coast mayor and City Council took matters into their own hands to mandate social interaction regarding the citizens of the city. They passed a resolution mandating the use of face coverings throughout the city of Palm Coast.

Unlike Sheriff Rick Staley, our county commissioners, and our governor who have allowed for the citizenry to determine the best course of action based on medical/federal guidelines, the mayor and City Council have lost trust in the people, and have overstepped their bounds.

They have determined the citizens of this great city cannot be trusted to act in their own best interest and now must be forced to comply with government mandates. If they don’t trust us to make good choices for our own health and our own businesses, will their next step lead to removing our ability to vote because we can be trusted to make good choices in that area as well?

As for me, I have lost trust in our mayor and City Council and will vote in the next election, as long as I still have that right, for candidates that represent we the governed and not their own agendas.

‘Mandate’ did nothing for Palm Coast Dear Editor: As a city, we should not be in the habit of making laws that are not actually laws. The City Council’s mask “mandate” is not a “mandate.” There is zero provision for enforcement within the ordinance itself, and all reporting around the ordinance stipulates that the Flagler County Sheriff will not be asked to enforce the ordinance. That leaves it up to the City’s Code Enforcement personnel which, according to City Attorney Bill Reichmann, will not be asked to enforce the ordinance either.

I am confused as to what the mayor and council think they accomplished on July 7. Businesses were already allowed to require masks upon entry if they so chose. Many businesses in Palm Coast have been doing so. Nothing in this resolution changes that mechanism in any real way.

I personally believe wearing a mask and socially distancing as per CDC guidelines is vitally important in the face of rising numbers of COVID-19 cases around the country and specifically here in Florida.

The resolution and vote by Milissa Holland and the Palm Coast City Council was a last minute, politically motivated stunt and not the act of a wellfunctioning government who has any clue as to what they are doing.

Concealed gun and drugs seized during traffic stop A 19-year-old man, Jordan Mercarter, concealed a firearm en route to a drug deal and was intercepted by the Flagler County Sheriff’s Office during a traffic stop on July 9.

“Guns and drug dealing is a dangerous business and often leads to violence,” Sheriff Rick Staly said. “While some might not think dealing marijuana is a big deal, it proves to be one when people are carrying firearms for protection and committing crimes. I’m glad this traffic stop by Deputy Conway was able to take this dealer off the streets before his drug dealing turned violent.”

Two passengers in the vehicle were released from the scene.

He was held at the Adams County Prison pending extradition to Flagler County. Due to the COVID-19 pandemic, his extradition was delayed. I hope that the courts deal harshly with him.”

Paul Anderson files for County Commission seat Paul Anderson is making his third attempt at running for a public office in Flagler County.

Anderson, a resident of Palm Coast for the past 18 years, previously ran for a seat on the Flagler County School Board in 2016 and again in 2018. He’s currently gunning for the Flagler County Commission’s District 5 seat.

His main initiative?

“I’m running because I’m tired of the last two years of decisions that our county commissioners have made that is making it harder to keep our taxes down,” said Anderson.

“My whole campaign is focused on making sure that Flagler County residents don’t pay for things that we don’t need and that their taxes don’t go up because of mistakes made by the past commission.”

Anderson, a small business owner since 2009, said he wants to help “fix the things that have put us into financial jeopardy.”

Among those poor decisions, Anderson said, were the Sheriff’s Operation Center and the former Sears building off Palm Coast Parkway, which the County Commission purchased for $1.25 million in 2018 — before discovering it was full of mold.

“I do my homework,” Anderson said. “I don’t usually say something unless I already have the background information on it. I think that’s lacking in our current County Commission, and it shows in purchases like the Sears building.”

Health Department doubles staff Health officials praised cities for mask mandates.

The Department of Health in Flagler County’s staff will double soon, to respond to the increased cases of COVID-19.

Earlier this year, the DOH had 56 people on staff, according to Health Officer Robert Snyder. Last week, 14 staff arrived, including registered nurses, to assist with contact tracing among other tasks. He announced on July 10’s “Free For All Friday,” on WNZF, that another 40 were going to be hired.

He said in a later interview that the DOH is able to able to serve the community and is not strained, but this staffing will make sure it stays that way.

“We just don’t want to miss a beat when it comes to community testing,” Snyder said.

Testing has expanded recently.

The 40 additional staff members, which will hopefully include many local hires once a process is finalized, will allow the current staff to return to normal duties at the Department of Health and be less involved in responding to the pandemic.

More than 100 new laws signed by DeSantis Teacher salaries, school choice, Everglades, budget cuts JIM TURNER NEWS SERVICE OF FLORIDA

More than 100 new laws hit the books from the 2020 legislative session, with issues ranging from expanding school vouchers to increasing fines for bear poaching.

Out of 156 bills Gov. Ron DeSantis had signed into law as of June 30, 112, including the state’s new $92.2 billion budget, took effect July 1, the start of the state’s fiscal year.

Other measures, such as a bill (SB 140) that helped clear the way for people to legally set off fireworks on July 4, New Year’s Eve and New Year’s Day, took effect immediately after being signed

by DeSantis, or shortly thereafter.

Here are some of the key bills: BUDGET AND TAXES

HB 5001: The record $92.2 billion budget increases public-school funding by $137 per student and provides 3% pay raises for state workers. Also, it includes $500 million to increase teacher salaries, $625 million for the Everglades and other waterrelated projects and $100 million for the Florida Forever conservation program.

HB 7097: A $47 million tax package includes a pair of salestax “holidays,” with back-toschool shoppers able to avoid paying sales taxes from Aug. 7

through Aug. 9 on clothes costing $60 or less, school supplies costing $15 or less and on the first $1,000 of the cost of personal computers. The bill also includes a disaster-preparedness tax holiday that was held around the June 1 start of hurricane season.

SCHOOLS

HB 7067: Lawmakers took a series of steps to increase school choice, including dramatically expanding the Family Empowerment Scholarship voucher program. The program, which was created last year, provided 17,724 vouchers as of February — a number that will be able to jump to more than 46,600 during the 2020-2021 academic year.

HB 641: Coupled with $500 million in the budget, the bill sets the stage for public-school teachers to get pay raises. It also eliminates the controversial Best and Brightest teacher bonus program.

HB 1213: The bill will lead to public-school students learning

about the 1920 Ocoee Election Day riot that involved attacks on black residents and requires the Department of Education to develop standards and curriculum for teaching the history of the Holocaust.

HB 7011: The Florida High School Athletic Association will be required to take a series of steps to protect high school athletes from suffering heat strokes.

For example, the association will have to establish requirements for “cooling zones,” which could include such things as cold-water immersion tubs.

HEALTH CARE

HB 389: Pharmacists will be able to play an expanded role in providing health care to patients.

In part, they will be able to enter “collaborative” agreements with physicians to treat patients for chronic illnesses, such as arthritis, asthma, chronic obstructive pulmonary diseases, Type 2 diabetes, HIV, AIDS and obesity.

Rules still need to be finalized to carry out the bill.

HB 607: Advanced practice registered nurses will have authority to practice independently of physicians, a top of priority of the legislative session for House Speaker Jose Oliva, R-Miami Lakes.

SB 1344: The bill will help clear the way for building new “intermediate care” facilities for people with disabilities.

SB 698: Health-care providers will not be able to conduct pelvic exams on women without written consent. The measure also seeks to prevent misconduct by doctors who provide fertility treatment.

PRAISE FOR MEDNEX AND BUDGET CUTS

State Rep. Paul Renner, District 24, praised Gov. Ron DeSantis for making the necessary cuts to the state budget. Renner predicts “major shortfalls” in the future. “The sooner we rein in our oveall spending the better,” he said on WNZF’s “Free For All Friday.”

State Sen. Travis Hutson joined Renner in celebrating the one expenditure that made it past DeSantis’ veto pen, which was the University of North Florida’s MedNEX, planned for Palm Coast.

“This will have long — everlasting — positive effects, from an economy standpoint and also for health care in Flagler County,” Hutson said.

HB 743: The bill revises a 2019 law meant to crack down on opioid abuse by allowing health care practitioners to discuss nonopioid alternatives with patients’ representatives rather than just the patients. The measure also requires practitioners to provide people with a state-published pamphlet on opioids.

ENVIRONMENT

SB 172: Lawmakers moved to block Key West and other local governments from imposing bans

on certain types of sunscreens that contain the chemicals oxybenzone and octinoxate. Key West approved such a ban because of concerns that the chemicals could damage coral reefs.

SB 712: Dubbed the “Clean Waterways Act,” the bill sets new rules for septic tanks, increases fines for environmental violations and imposes requirements on agricultural fertilizer.

HB 1061: Lawmakers created the Nature Coast Aquatic Preserve, which is aimed at protecting about 400,000 acres of sea grass habitat along Pasco, Hernando and Citrus counties. The protections will include restrictions on such things as dredging, seawall construction and sale of submerged lands.

HB 327: People who poach Florida black bears during a closed season will face increased penalties. Poaching stems, at least in part, from the animals being killed for their gallbladders.

Bear bile, secreted by the liver and stored in the gallbladder, can bring in hundreds or thousands of dollars on the black market, where it is promoted as a cure for numerous ills.

HB 659: Non-law enforcement employees of the Florida Fish and Wildlife Conservation Commission will be allowed to operate aerial drones for eradication efforts of invasive plants and animals on public lands, and the Florida Forest Service will be able to use drones to mitigate the threat of fires on public lands.

SB 664: All government employers — such as local schools, public universities and state agencies — and their contractors will be required to use a

TRANSPORTATION

HB 969: Under the measure, up to $5 million a year will be set aside for Florida’s Turnpike Enterprise to develop broadband infrastructure as part of projects to spur new or expanded toll roads from Collier County to the Georgia border.

SB 7018: The Florida Department of Transportation will plan and build staging areas for emergency response along the turnpike system, with a priority in “counties with a population of 200,000 or less in which a multi-use corridor of regional significance is located.” Such multi-use corridors are new or extended toll roads backed last year by the Legislature The measure also requires the Public Service Commission to work with the transportation department and the Department of Agriculture and Consumer Services, to develop electric vehicle charging stations along state highways.

HB 971: Electric bicycles will be regulated in the same manner as pedal-powered bicycles, instead of as motorized vehicles.

COURTS/LAW ENFORCEMENT

HB 199: A statute of limitations will be eliminated in sexual battery cases when the victims are younger than 18 at the time the crimes occurred.

SB 1392: District court of appeal judges who live more than 50 miles from their courts will be allowed to have “alternative headquarters.” The measure also will allow the judges to be reimbursed for travel between the locations.

There will be no expectation of wearing masks in Flagler Schools classrooms as the district plans to open Aug. 10. Nonessential furniture will be removed, and desks will be placed 6 feet apart in rows.

“Our schools were made for social interaction, not social distancing,” the district’s Return to School Guide says on flaglerschools.com. “Schools are designed to bring people together, creating shared learning spaces.

We want our teachers to connect with students in-person, empower our students to collaborate, and increase the value of a shared educational journey.”

The Return to School Guide was updated July 14 to require masks for third grade and up where social distancing is not feasible. Previously, the guide stated the following: “Middle and high school students are strongly encouraged to

wear them during class changes and when social distancing is not feasible.”

Staff and visitors are also required to wear masks, as of the July 14 update. Medical exemptions will be granted as needed.

Superintendent Cathy Mittelstadt discussed the plan on July 10’s “Free For All Friday,” on WNZF. She said that for those who aren’t comfortable with the plan, there are virtual options, such iFlagler.

Mittelstadt announced on July 14 that a hybrid option will also be available, with details to come on July 15.

(Other virtual platforms exist, but Flagler Schools doesn’t get any state funding for students unless they use iFlagler. Even then, it’s a reduced rate compared with in-person education, and there will likely be a substantial funding challenge ahead.)

To a large degree, they follow the CDC’s recommendations for schools in communities with minimal to moderate community transmission.

The big challenge, he said, is what to do when a student tests positive for COVID-19.

“It’s bound to happen,” he said.

DOH Medical Director Dr. Stephen Bickel voiced some concern about the plan. He said if it were up to him, he would require masks.

“On buses, that’s a no-brainer, absolutely,” he said. “The other ones you could debate, but honestly, I would be erring on the side of the being overly strict. I don’t see the downside of that, other than it’s kind of awkward, but they’ll get used to it.”

Tom Purcell, a retired anesthesiologist, survived COVID-19.

Barely.

The Palm Coast resident spent 104 days with the disease, mostly spent unconscious at local hospitals. He was told at one point that he had been hospitalized the longest of any COVID-19 patient in the United States.

Hearing of his struggles will hopefully convince people to take the disease seriously, said Dr. Stephen Bickel, medical director for the Department of Health in Flagler County.

Purcell, 72, was interviewed for WNZF’s “Free For All Friday” on July 10. He said he had been to a family dinner in Rhode Island on March 14, and he and his wife, Helen, both contracted the disease (none of the rest of his family got it, he said).

After a mixup with his test, Purcell decided to drive himself to the emergency department at AdventHealth. He was waiting at the hospital, he said, “and that’s the last thing I remember before waking up in the middle of May in Daytona.”

He had been put in a medically induced coma due to failure of multiple organs, he later learned.

“Everybody did what they were supposed to do,” Purcell said. “It may not have been perfect, but I’m alive, and I thank God that I am.”

Purcell said he lost a lot of muscle mass, and one reason he survived may have been that he was in good shape before; he used to swim two miles a day, four times a week.

When he was finally released from the hospital, after testing negative for COVID-19 four times, his friends threw him a socially distanced welcomehome party. Neighbors have also been preparing meals for him.

Purcell said his wife, Helen, was a “big help.”

Patricia Albano, who first met Purcell in 2003 in New England when he helped her find her lost dog, was grateful he survived.

“I would not want him up above,” she said in a phone interview with the Palm Coast Observer. “We need him here still.”

Purcell said he is hopeful a vaccine is developed soon. He is in disbelief that some people think of COVID-19 as a “hoax.”

“It does exist,” Purcell said.

“It’s a real disease. Some people think it’s just like the flu, and it’s not. It can ruin all your organs in your body, and you can basically die from it.”

Christmas Come True recognized Nadine King’s nonprofit has helped over 155 families with 441 children so far in 2019.

July will officially be Christmas in July Month in Flagler County, the city of Bunnell, the city of Flagler Beach and Palm Coast.

Nadine King, executive director of Christmas Come True, was scheduled to receive proclamations from each municipality by press time, with the city of Palm Coast planning a virtual presentation on Facebook at 9 a.m. July 21.

In 2019, Christmas Come True has helped over 155 families with 441 children, King said in a press release, as well as, over $12,000 for families in emergency situations in 2019. Those emergencies have compounded for many due to job loss, from impacts of COVID-19.

“Finding resources throughout the year has been an ongoing challenge for Christmas Come True,” King said. “And now, the need has doubled as we face months of impact from the COVID19 crisis.

We are so honored to have Flagler County and our local municipalities recognize the need and support Flagler County families by proclaiming July ‘Christmas Come True Month.’”

According to the ALICE Report for Florida, in 2018, 46% of households still struggled to make ends meet.

As we come into the middle of July, there are many stressors on our working mama hearts. None of which is more consuming than the battle of “What do I do about school for my child(ren) come August 10?”

I personally cannot fathom many more days trying to find the delicate balance of toddler and growing a business, but the thought of sending him to school also makes me uneasy.

I think I missed the Global Pandemic chapter in the Book on Parenting.

This week, Colleen Conklin, working mama and longtime Flagler County School Board member, posted a long piece on Facebook that addressed and acknowledged the thoughts that many of our local mamas are battling with right now.

The thing that resonated with me was that the only constant is change.

We receive updates from the national, state and local levels almost daily, and changes come at us so fast we hardly have time to adjust.

Below is an excerpt from her post: “With all that said, remember there is one thing that is a constant in all of this and its CHANGE. Ugh. I know consistency makes everyone feel more secure but

unfortunately, it is not a luxury we have right now. Things will continue to change which will modify our plans.

I know many of you continue to have additional questions and concerns. I share those concerns. I am beyond grateful to our administrators who made thousands of phone calls last week to gather additional input. I am grateful for the emails and conversations I have had with multiple parents, teachers, and community members. I don’t have additional information to share with you at the moment but wanted to reassure you staff is exploring all available options under the Commissioners Innovative Plan released last week to provide you with additional options as you consider the upcoming school year.”

She finished her letter with: “I know some of you are worried and concerned. And some are ready to start the year. It is my hope we can all come together and support our students and staff as we move forward. I am grateful for such a caring and giving community. I have no doubt we will get through this together.”

I agree. I’m grateful for our community as well. We have some of the best educators, students, support staff, school board members, and parents in the state! We will get through this challenging time with our children loving us just like they did before!

And always remember, you’re doing a great job, Mama!

KIWANIS CLUB NAMES LAW ENFORCEMENT OFFICERS OF 2020

The Flagler Palm Coast Kiwanis Club during a July 1 Law Enforcement Officer Appreciation Luncheon and awards ceremony recognized three local law enforcement officers as the Kiwanis Club’s 2020 law enforcement officers of the year, according to a news release from the Flagler County Sheriff’s Office.

One law enforcement officer was selected from each local law enforcement agency: n Deputy Adam Gossett, Flagler County Sheriff’s Office n Officer Adrianne Zapata, Bunnell Police Department n Detective Rosonne Vinci, Flagler Beach Police Department The officers were joined at the luncheon by Sheriff Rick Staly, Bunnell Police Chief Tom Foster and Flagler Beach Police Chief Matt Doughney.

Staly was the event’s guest speaker, and gave a presentation on how the agency has helped achieve more than a 36% reduction in crime since 2017.

Saniya Lugo Navas, a senior at the construction technology flagship, earned the NCCER carpentry certification.

“Construction is a male-dominated field, so for Saniya to get that was amazing,” said Matanzas’ teaching and learning specialist for career industry certifications, Jeremy Ossler.

Brandon Woody, a junior in the digital media program, was the first to earn the Adobe InDesign certification.

“They represent what’s best about Flagler County schools,” Ossler said.

Matanzas Principal Jeff Reaves praised Ossler and Assistant Principal Mandy Kraverotis for their work.

Matanzas also started its first chapter of the National Technical Honor Society.

“This is a new trend starting to recognize students in these fields, preparing for careers,” Ossler said.

Palm Coast temporarily eliminates building permitting fees The city will spend down its Building Division permitting surplus to $2.4 million before fees resume.

The revenue coming in to Palm Coast’s building permitting department has consistently surpassed expenses in recent years — a trend that led the City Council on July 7 to vote unanimously to temporarily eliminate the city’s building permitting fees in order to use up the surplus money. The decision takes effect immediately.

The measure helps keep the city in line with state law, which restricts how the money can be used and allows cities to carry a

surplus forward only so long as the amount does not exceed the average of its operating budget for that division for the previous four fiscal years.

The Building Division’s average operating budget for the last four years is $2,477,528, according to a city staff document. The end of the Fiscal Year 2018-2019 saw a balance of $3,437,187 in the building permits and inspections fund.

The fees will kick in again after the city works the fund down to $2.4 million and issues a 60-day notice to residents and developers that the fees will resume,

Chief Development Officer Jason DeLorenzo said.

“This provides, I believe, a nice result,” Mayor Milissa Holland said. “I am in favor of the approach. ... When we presented at the Home Builders Association annual meeting, they were very receptive of this opportunity, and they favored the approach as well.”

Flagler Home Builders Association Executive Officer Annamaria Abad spoke during the meeting’s public comment period and said that the FHBA is in favor of the fee eduction, but that the association had also spoken with the city previously about some other potential uses of the money — some of which, like virtual inspections, have since been implemented as a result of COVID-19 — and that the association hopes those ideas will still be looked at, as well.

“Just some things to consider, going forward,” she said. “But we do absolutely thank you for this proposed reduction in permitting fees and ask that you look at the additional options that were

spoken about before.”

The city also hopes to hire more staff for the building division: It currently has 18 full-time staff members. It had 35 in 2005, then dropped to 15 during the recession.

The city is now budgeted for 22 positions, DeLorenzo said, but has had trouble filling four positions.

It’s currently seeking three building inspectors and one plans examiner.

The city also hopes to increase cross-training so that staff members are able to perform more services.

“Hopefully this will not only expedite the permitting process, but allow the experience to be much better overall,” Holland said.

Councilman Bob Cuff said a few builders had approached him and asked why the city wasn’t using some of the surplus permitting money to to hire staff or make the processes more efficient.

City Manager Matt Morton said the the excess revenue belongs to the building community.

“This is their excess funds they paid in good faith for service,” Morton said. “So we programmed in conversations with the building community those dollars for ... continued technology enhancements and cross training, and we did that at a level we felt was reasonable and fair to our building community partners.”

Judicial candidates address residents in forum Four candidates spoke in a virtual forum hosted by the Tiger Bay Club on July 9.

Four candidates for 7th Judicial Circuit judge positions — Bryan Robert Rendzio, Dan Hilbert, MaryEllen Osterndorf and Mike Orfinger — addressed residents in a virtual forum hosted by the Tiger Bay Club July 9.

A few other candidates who had signed up for the forum were not able to participate.

Responding to a question about strategies for dealing with the backlog of cases caused by COVID-19 shutdowns, all four candidates who were able to participate spoke about the importance of technology.

Rendzio said he is currently in a 14-day quarantine himself due to potential exposure, but has been maintaining his docket over Zoom.

“It’s very effective,” he said.

“It has done a great job of keeping up and adapting to the unfortunate circumstances that have occurred. ... We’re moving full steam ahead and we’re doing everything that we can to make sure that everyone has equal access to the court.”

Osterndorf said the 7th Circuit is doing what it can with the orders coming from the Florida Supreme Court and from health agencies, using video and telephonic hearings.

“One of the most important things to remember is we have litigants that are represented by counsel and those litigants that are represented by themselves,” she said. “And those self-represented litigants don’t always have the same resources that law firms have. So you have to ensure that there’s equal access to all of those individuals. I think we’ve been very creative. I would continue with that creativity.”

Orfinger said his civil division has adapted quickly, using Zoom for everything but jury trials, and is starting a trial project next month to use Zoom for jury trials, too.

In the mental health division where he presides over Marchman Act hearings on substance abuse, Orfinger said, nonjury trials, evidentiary hearings and other hearings are being held

Orfinger spoke of community, but also the importance of family: Two weeks ago, he said, he’d presided over his son’s wedding.

“I can’t begin to tell you how helping to perpetuate my family impacted me,” he said. “It was a wonderful feeling; it was one

that I hope more people could experience. I know we experience it as parents, but it was extra special to experience as a judge.”

Hilbert said that his mother, a retired nurse who’d served as a county commissioner, instilled in him a sense of community pride and of the value of community involvement.

He’s president of his local Rotary Club, serves on the St. Augustine Police Department Retirement Board, was formerly the president of the St. Johns County Sports Club, and is also a pro bono lawyer for St Johns County and the Putnam County Veterans Court, representing veterans for free to aid them through the court process, he said. “I have to thank my mother for instilling in me this sense of community involvement, community pride and that work ethic,” he said. “My goal is to take that to the bench as well.”
