BRIEFS HALF-CENT SALES TAX EXTENSION FOR FLAGLER SCHOOLS ADDED TO NOV. 8 BALLOT On the Nov. 8 ballot, Flagler County voters will decide whether to extend a half-cent sale surtax for another 10 years, raising $8 million per year for technology, safety, buses and other improvements for Flagler Schools. The Flagler County Commission voted 4-0 to add the tax to the ballot and also encouraged the school administration to now reach out to the community to make sure voters know the importance of supporting the sales tax extension. “It’s in the public’s hands,” County Commission Chair Joe Mullins said. In the past 10 years, Flagler Schools has used the sales tax funds to provide laptops and tablets for students, allowing students to be prepared for at-home learning before the pandemic. Students spoke in favor of the sales tax, at the meeting, saying it provided them opportunities to excel in their education and career development. “I think this is really important,” County Commissioner Greg Hansen said to Flagler School Superintendent Cathy Mittelstadt after her presentation. “I encourage you to do the best you can … to get the word out.” He offered to speak to groups at the school administration’s request, if needed.

Road closure planned for Florida Park Drive starting June 28 Beginning June 28 and lasting about four months, Florida Park Drive will be closed at the intersection of Farraday Lane (south end of the loop) due to the construction of a city of Palm Coast Utility project. Construction crews are reconstructing a section of sanitary sewer and constructing a new lift station to replace an older station. Barricades and signage on Florida Park Drive will block vehicle traffic. Detour signs will be placed to assist traffic. City Council allows two cell towers to move forward With assurances that the tower would be built to look like a tree, and with assurances from city staff that other alternatives near the Palm Harbor Golf Club were not viable, the Palm Coast City Council on June 21 voted to allow Diamond Towers V LLC to proceed with the next steps toward building a communications tower on city-owned land at a utility pump station off Clubhouse Drive. A second tower is also planned southwest of the intersection of Town Center Boulevard and Royal Palms Parkway. Both towers should help improve cell reception for residents in those areas. Both towers would be up to 150 feet tall. In each case, a site development fee of $25,000 would be paid to the city; in addition, the city will receive 40% of any new recurring revenue generated by the new towers. “Our aging population is increasingly vulnerable to health and safety emergencies,” said Mayor David Alfin, who voted for the proposal. “Residents should be confident that cell phone service will be available everywhere, at any time in Palm Coast.” The city entered an agreement with Diamond in 2017 after hearing from cell phone carriers that the city’s ordinances made it burdensome to build towers in Palm Coast. Under the agreement, Diamond builds the towers on city land, and carriers like T-Mobile or AT&T can then enter a contract to place their antennas on the towers, Palm Coast

Land swap and rezoning leads to housing debate A 12-acre parcel just east of Old Kings Road will be rezoned to multifamily, after a 3-1 vote by the Palm Coast City Council on June 21. The rezoning follows a land swap that will enable the city to build a flyover over Interstate 95 to link Whiteview Parkway to Old Kings Road some day in the future. The probability of an apartment

But that contract expired last month, while city staff were still in discussions with Diamond about adding towers at the Clubhouse Drive and Town Center Boulevard sites. T-Mobile is interested in the Royal Palms/Town Center Boulevard site, while AT&T is interested in the Clubhouse Drive location. Other carriers could be added, but Diamond’s representative said communications companies are usually easier to negotiate with after the tower is already built. So far, Diamond has built three towers — one on Palm Coast Parkway near Heroes Memorial Park, one on Palm Harbor Parkway near Fire Station No. 24, and one near the city’s tennis center. When the the city proposed adding a tower in the Palm Harbor Golf Club area several years ago, it encountered resistance from locals, and the City Council voted against it. Similarly, some residents near the golf club continue to oppose any towers nearby. “The last location wasn’t that great, at the golf course,” City Council member Eddie Branquinho said June 21. “This one, in my opinion, is even worse. But then again, we need the service.” The late Lou Vitale proposed alternative locations, and Akins said June 21 that each had been investigated and rejected for legal and practical reasons (one was in a flood zone, one

Greg Blose, president and CEO of the Palm Coast Regional Chamber of Commerce, said cell reception in the city is “pretty terrible” and needs to be addressed. Still, he said he sympathizes with people who live right by the tower. “Location is going to be an issue for any resident,” he said. “If it was going by my house, I’d probably be saying something about it, too.” City Council member John Fanelli noted that he has family living near a tower, and it didn’t negatively impact property values. Fanelli’s and Branquinho’s reluctance to support the tower was evident in their refusal to second Councilman Ed Danko’s motion to lead to a vote. Alfin passed the gavel to Branquinho, who is serving as vice mayor, and made the second himself. Then it passed 4-0. Councilman Nick Klufas was absent. Although the City Council approved Diamond’s request, several steps remain before construction could begin. Diamond will host a neighborhood meeting in July to hear residents’ concerns. Ultimatum for Green Lion, as city wants help paying the water bill Green Lion’s Tony Marlow called the City Council ‘crooks,’ for what he felt were ever-increasing demands. BRIAN MCMILLAN EXECUTIVE EDITOR

After 15 months of negotiations, the Palm Coast City Council voted 4-0 on June 21 to give the owners of the Green Lion 10 days to decide whether to accept the terms of a new agreement, including a surprise that hadn’t been considered until this meeting: Rather than the city paying the estimated $24,000 per year in water costs at the city-owned building, the Green Lion would be required to pay half, or about $12,000 per year. The negotiation process, which cost the Green Lion about $20,000 in legal fees, according to owner Tony Marlow, so infuriated him that Marlow disrupted the meeting, shouting that the City Council members were “crooks.” When he was warned by Mayor David Alfin twice, following meeting protocols, to be silent, Marlow stormed out, repeating his accusations. Shortly thereafter, Marlow’s son Chris also shouted out complaints to the City Council, prompting

deputies from the Flagler County Sheriff’s Office to approach him to escort him from the room. When he stopped shouting, he was allowed to remain. Tony Marlow took offense to being called a “robber” in a previous city meeting. City Council member Eddie Branquinho took offense to being called a “crook,” and the two traded verbal jabs during the meeting. But the City Council was insistent at the meeting that the taxpayers no longer subsidize the Green Lion. CONTINUING SUBSIDY

The Green Lion Cafe has operated the food and beverage concessions at the golf club since 2017 and asked in 2021 to extend the contract for another five years. In February 2022, City Council members had directed city staff to terminate the city’s lease with the restaurant and solicit proposals for a new one, saying the current lease was “robbing” taxpayers by requiring the Green Lion to pay only $600 per month — well under the market rate. The council did so even though the Marlows had already told city staff that the restaurant was willing to accept a staff-proposed lease that would have doubled the restaurant’s rent this year, with stepped increases following until the monthly rent reaches $2,503 in 2026. But the council quickly reversed its decision after dozens of locals

turned out to the following week’s City Council meeting to demand that the council reconsider. When it did so, the council didn’t simply accept the lease amendment that city staff and the restaurant had already been working on. Instead, the council directed city staff to solicit a commercial real estate professional to conduct a fair market value analysis on the property. City Attorney Neysa Borkert exchanged 10-15 emails with the Marlows’ attorney in the past month or so, she said, but communication eventually ceased. On June 20, the day before the meeting, Alfin told the Marlows in an email that he felt the city had negotiated “to accommodate your requests and balance the public’s interest.” He continued: “The Concession Lease Agreement describes a business model that should yield healthy revenues and profits without continuing subsidy from the City of Palm Coast.” However, he wrote: “If the profit and loss of the operation are not in line with your expectations, we should accept that the venture does not satisfy both parties’ expectations and undermines the potential for long-term success.” On June 21, Chief Development Officer Jason DeLorenzo presented to the City Council the latest step in the negotiations, with the result that the city would pay the annual

water costs of $24,000; the Green Lion would assume the other utilities and would also pay an annual lease total of $23,859 beginning Sept. 1, increasing 3% each year after that. That gives the city a deficit of $141 for the first year of the new lease, but a profit of $575 in 2023, $1,312 in 2024 and increasing profits in subsequent years (assuming the water price doesn’t increase). Chris Marlow’s comments at the June 21 meeting confirmed that there was still tension between the two sides. He asked that the city table the agreement so more details could be worked out. After the meeting, Marlow told me that among his concerns was the condition that the city could terminate the lease if any Green Lion employees committed a crime. Borkert addressed that concern during the meeting, stating that the new agreement would soften that provision, giving the Green Lion more flexibility — but not complete control — on handling its own staff. The City Council also agreed to let the Green Lion determine its own hours of operations. PAYING FOR WATER

City Councilman Ed Danko suggested early in the June 21 discussion that the Green Lion should be required to pay 50% of the water costs, since it likely accounted for well over 50% of the water usage at the golf club; previously, the city was paying 100%.

THREE MINUTES? Green Lion’s Chris Marlow took exception to how he felt he was treated during the June 21 meeting. He began his remarks by requesting more than three minutes to speak; Mayor David Alfin denied his request, which is city protocol for public comments. Given the significance of the lease that was at stake, former Flagler Beach Mayor Linda Provencher chided Alfin for not allowing Marlow more time to negotiate. Later, Tortuga’s Florida Kitchen & Bar owner Scott Fox challenged that decision, pointing out that the city allowed another business that was making an application at the meeting to have a seat at the table. Why not give the Green Lion the same courtesy? Likewise, City Council candidate Alan Lowe asked why the three-minute timer was turned on for Marlow, but it was not turned on when a previous speaker was at the microphone (the city clerk said it was an oversight but that she does keep the time and would have warned the mayor if the time expired). A third inconsistency occurred but was not mentioned in the meeting. During the closing public comment portion, speakers are instructed to limit their comments to items that were not on the meeting’s agenda. But Johnny Lulgjuraj, owner of Oceanside Beach Bar and Grill, spoke about something that was on the agenda: the Green Lion lease. Moreover, even after the alarm sounded, he was allowed to finish his thoughts — calmly, but well after his three minutes had expired.

Alfin wasn’t so sure: He worried about setting a precedent based on an arbitrary number. Paying half wasn’t nearly enough for one resident, Robert MacDonald, who gave an emotional plea to the city to require the Green Lion to pay for all of its water. “How dare you say you’re going to pay half of their water bill,” he said. “How do you justify to the people that they’re going to pay half the water bill, when people are losing their houses, losing their jobs? You can’t possibly explain that to us.” In the end, Alfin agreed with Danko. Alfin gave up the gavel so that he could make the motion: He proposed that the Green Lion be given 10 days to decide whether to accept the terms of the contract — plus play 50% of the water bill. The vote was unanimous. Chris Marlow shouted his objections once again, on his way out: “You’re not even going to let us talk? Welcome to negotiating with the city of Palm Coast.” — Jonathan Simmons contributed.

No vacancy: Tight market means rental prices go through the roof With vacancy rates at historic lows, rental prices continue to rise. BRENT WORONOFF STAFF WRITER

Housing vacancy rates in the first quarter of 2022 were at or near historic lows according to the U.S. Census Bureau’s Housing Vacancy Survey. The tight market for rental properties can be felt in Volusia and Flagler counties, real estate experts say. “As soon as we put something on the market, it’s gone,” said Rachel Toth, a property manager for Rent Me Homes in Ormond Beach and Port Orange. Toby Tobin, a Flagler County real estate expert and the publisher of gotoby.com and host of “Real Estate Matters,” on Flagler Broadcasting, said he’s never seen the market this tight. “In every segment of the market, demand is exceeding supply,” he said. That not only includes home sales

but also rentals for single-family homes, duplexes and multifamily housing, he said. The nationwide rental vacancy rate for the first quarter of the year was 5.8%, the Census Bureau reported. That is higher than the historic low of 5% but lower than the quarterly rate estimate at any point during the 35-year period from 1985 through 2019. As a result, rental prices have steadily increased. The average price per square foot of Rent Me Homes’ rental property was $1 to $1.20 in 2019, Toth said. Now, the average is $1.35 to $1.50 per square foot. “Price are continuing to rise,” she said. A townhome under 2,000 square feet that would have rented for $1,500 a month last year is now renting at $1,900, Toth said. A three-bedroom, two-bath home that would have rented for $1,400 to $1,800 one to two years ago is now renting at between $2,000 and $2,500 a month, she said. Toth said new listings are usually gone within 10 days.

“Our portfolio is about 200 homes and 5% or less are on the market,” she said. Tobin said that of the 58 longterm rentals listed on the MLS system in Flagler County, only 13 were under $2,000 a month. And higher prices do not seem to be deterring would-be renters. “Tuscan Reserve was completed in 2021 and completely occupied in three months,” Tobin said. Until 2019, Flagler County had gone 50 consecutive months without a permit for a multifamily development, Tobin said. That drought ended with the Palms at Town Center’s 88 units and Central Landings at Town Center’s 233 units. There are several developments in the pipeline right now. On June 7, the

Palm Coast City Council approved a 251-unit apartment complex on a 10.6 acre parcel in Town Center. Construction is expected to begin soon on Dos Palmas, a 285-unit multifamily development at the corner of Matanzas Woods and Belle Terre parkways.

As for single-family home rentals and duplexes, the prices could continue to rise. “A lot of investors are finding it’s an optimal time to sell, and that limits the market,” Toth said. “With new purchases at higher prices, we are seeing higher rental prices.”

Two candidates have qualified to run for Flagler County School Board District 1. Sally Hunt is challenging incumbent Jill Woolbright. This is Hunt’s first time running for public office. Woolbright won a seat on the board in 2020 to finish the remaining two years of Andy Dance’s term after Dance stepped down to run for County Commission. Woolbright moved to Flagler County in 1989 and taught in Flagler Schools for 29 years before retiring in 2019. She raised four children, all of whom graduated from Flagler Palm Coast High. Woolbright studied elementary education at UCF and graduated summa cum laude before beginning her teaching career in 1991. “During my career, I successfully taught a wide spectrum of students from those with emotional/behavioral disabilities to the gifted and talented,” she wrote in an email. In 2016, her three-year

student progress score was ranked No. 1 in the state among sixth-grade math teachers. Following her retirement, she still had a passion to advocate for students, she said, which led to run for School Board. “I understand what students need to succeed and what policies, materials, resources and support systems are necessary to enable their success,” she said. Hunt has lived in Flagler County for 7½ years. She owns a small travel business with her husband and has a 10-year-old daughter. She is a former licensed teacher in exceptional student education and general education and taught in Arkansas public schools. Hunt has a master’s degree in education and bachelor’s degrees in business administration and business education. She has worked for Walmart, Nike and Deere & Co., working in employee recruitment and development.

She said she was motivated to run for School Board because of what she observed in workshops and meetings. “There is an opportunity cost to the long ideological debates the School Board has had,” Hunt said. “Valuable time has been taken away from effectively supporting teachers and school staff as well as taken time away from driving academic achievement and overall student success. To give one example, the School Board should not have had to debate for two months over using the word ‘success’ vs ‘equity.’” Woolbright said the most important issue facing Flagler Schools is striving for the academic success of all students. “The pandemic impeded the academic progress of students across the nation,” Woolbright said. “We need to strategically work to enable our students to make up losses in progress while meeting the individual needs of our students, whether that be through remediation or acceleration.” Hunt said many important issues face the School Board, including achievement gaps due to COVID, recruiting needs and teacher support, bullying and violence inside and outside of schools and parental involvement. “I’m not driven by one particular issue,” she said. “I care about our community, period. I want our students to be so well prepared when they graduate that they are ready for anything.”

Three candidates, all Republicans, are competing for the District 2 Flagler County Commission seat. Incumbent Greg Hansen has filed for reelection, and is being challenged by Janet McDonald and Denise Calderwood.

QUALIFYING PERIOD ENDS The qualifying period to run for local offices closed at noon June 17. According to the Palm Coast city charter, a council race with more than two candidates will have a primary. The District 4 race, which has only two candidates, will go to the general election. The city charter dif-

fers from state law, which requires all nonpartisan elections to appear on the primary ballot, regardless of the number of candidates. Hansen, a retired U.S. Navy captain, has served on the Flagler County Commission since 2017, when he was appointed by Gov. Ron DeSantis to fill the seat after the death of Frank Meeker. He was re-elected in 2018. “I absolutely love this job,” Hansen said when asked why he’d decided to run for re-election. “It gives me the opportunity to engage with Flagler County residents and businesses to solve problems and provide support.” His top concern, he said, is the loss of the county’s beaches, and ongoing efforts to find a solution. He added that he’s also concerned about economic development, affordable housing and health care, including mental health care. Hansen is a 1969 graduate of the United States Naval Academy. In his 27 years of service, he served in Vietnam with the Naval Advi-

She’s worked as program director for Flagler County Health Department and as a deputy sheriff. “I’m running for the commission seat because I am worried that the average person (formerly middle class) is not being represented,” she wrote in an email to the Palm Coast Observer. She added: “We are slowly losing our quality of life here, and our trees! What’s next, are we going to be selling our beach? I’m fiscally conservative and socially and environmentally friendly.” Calderwood has been a Flagler County resident since 1974, and attended Bunnell Elementary and Flagler Palm Coast High School, according to her candidate bio. She holds a master’s degree in public administration and a bachelor’s in criminal justice. Calderwood has helped obtain grants for organizations including the Flagler Playhouse, the Palm Coast Arts Foundation, the African American Cultural Society, the Flagler County Health Department, the Flagler County school district and the Flagler County Police Athletic League, according to her candidate bio. Calderwood helped begin the county’s first Young Republicans Club, and has served on the League of Woman Voters of Flagler County and the Flagler Palm Coast Kiwansis Club.

Feed the Need drive Radiance vote to be raises over $26,000 postponed to July 11 Volusia County’s 12th-annual Feed the Need drive donation will help provide over 104,000 meals to those in need. JARLEENE ALMENAS ASSOCIATE EDITOR

Second Harvest Food Bank was presented with almost $26,000 at the Volusia County Council meeting on Tuesday, June 21, a donation made possible through the county’s 12th-annual Feed the Need drive. The $25,776.15 donation will help the food bank deliver hunger relief aid to individuals and families in need in the community as Second Harvest partners with over 80 local agencies in Volusia County. According to a press release by the county, every dollar donated is able to be converted into $9 worth of food. With every $10 donated able to fund 40 meals, the donation will help provide over 104,000 meals. “Second Harvest Food Bank can’t do the work that we do without generous donors like county employees or community partners like you all,” said Stephanie Marie Palacious, director of advocacy and government relations for Second Harvest. The Feed the Need drive, held between March 21 and April 1, was able to raise $15,776.15, thanks to the participating agencies: the county, the Volusia County Tax Collector’s Office and the cities of Daytona Beach,

Daytona Beach Shores, Edgewater, New Smyrna Beach, Orange City, Ormond Beach, Pierson, Ponce Inlet, Port Orange and South Daytona. The remaining $10,000 were donated from the county’s leftover State of the County event funds. “Traditionally, the fundraiser has spurred a friendly — and I say friendly, but it’s sometimes more than friendly — competition among participating agencies to make it a fun event for a very serious cause,” said Kevin Captain, Volusia County community information director. Fundraising winners were announced during the meeting in four categories. The city of Ormond Beach was recognized for being the municipal government that collected the most money. The city raised $700. The recognition for the most money collected by a county operating division went to Volusia County Fire Rescue, which raised $2,320. This year’s award for the most money donated percapita, based on the number of employees in each county division or city government, went to the county’s treasury and billing department, which raised $2,283, and the town of Pierson, which raised over $500. The county’s purchasing department and the town of Ponce Inlet were named runner-ups. “Every person, every division, every city and local government will get a certificate of acknowledgement and participation for the Feed the Need fund drive because it is such an important activity,” Captain said.

The Flagler County Commission voted 3-0 to postpone a vote on the Radiance development (formerly Eagles Lakes) until July 11 — and to move the meeting’s start time from 9:30 a.m. to 5 p.m., to enable more residents to attend and voice their opinions. County Commissioner Andy Dance abstained. County Attorney Al Hadeed said Dance had consulted with the Ethics Commission about the propriety of voting, considering his personal connection with the matter, and he was advised that he could be involved in the discussion but could abstain. Dance chose to abstain from voting, although he did say he felt the next vote should occur in the evening, not in the morning. Mullins said some residents who weren’t in attendance at the June 20 meeting may have wanted the Radiance/Eagles Lakes vote to be in the morning on July 11. In either case, residents can email their concerns, he said, and be heard. The Radiance/Eagle Lakes community spans the gap between Interstate 95 and Old Kings Road in southern Flagler County. Recent changes favored by the county’s planning board would cap the community at about 1,200 homes, rather than the approximately 1,800 that developer Kolter Land Partners would otherwise be able to build under the new Future Land Use Map designation. Density would be about 1.94 units per acre. “We have staff that’s reviewed it,” Mullins said. “Something is going to occur

The Flagler County Commission voted June 20 to remove the 4% maximum cap to the cost of living adjustment for county staff members, in order to be “continue to attract and retain high quality employees” in a time of high inflation. The COLA will now be based on the Consumer Price Index calculation in March, rather than the preceding December. There was no estimate provided for the impact to the county budget, but Commissioner Dave Sullivan warned that it could be substantial. Unlike the federal government, he said, “We’re not allowed at this level to print money, and this high rate of inflation is putting us in a difficult situation.” He said the item, which was on the consent agenda and was not accompanied by a staff presentation, “is going to cost us a lot of money. … Stand by. There’s a lot of employees who are well deserving. … I just want to caution everybody: This is a serious matter. … Things are happening beyond our control, and it’s really affecting how we are operating on the county level.” Commission Chairman Joe Mullins praised the move, saying it will allow the county administration to adjust staff salaries “in real time.” The commissioners also asked suggested that county employees be given July 5 off — with pay — if County Administrator Heidi Petito felt it was possible.

My insurance covers hearing aids...doesn’t it???

As a Doctor of Audiology for over 15 years, the absolute most wonderful part of my work is seeing my patients thrive and enjoy their lives with better hearing. However, like all jobs, there is one part of my job that I HATE...and that’s dealing with the insurance companies! Hearing aids can be a sizable investment in your health, often costing anywhere from $3000 to $6000 if you do not have insurance coverage for hearing care. The cost of hearing aids are a combination of factors, including the professional expertise and services required to fit and adjust them for the patient’s hearing loss and the advanced computer circuitry built into the devices. Many people don’t realize that there is more computing and processing power in those tiny devices than a fullsize desktop computer (and a desktop computer would not last long if you kept it in your shower 14 hours a day- a wet, warm environment similar to your ear canal). Although the cost of technology has come down over the years, another aspect that contributes to the cost of hearing devices is the research and development that goes into creating the advanced algorithms that make hearing aids so “smart” (for example, most advanced

hearing aids can tell the difference between speech that you want to hear, like your spouse sitting in front of you, versus the speech of the table next to you, which is actually processed as background noise and reduced instead of amplified). Millions of dollars are spent by the laboratories to develop this technology, so although the manufacturing of the device itself may be relatively inexpensive, the R&D costs are recouped when the technology is released into the market. Finally, the majority of the cost that you pay is for the time and expertise of the professional, someone like me; a Doctor of Audiology to evaluate you and recommend the right options for your hearing loss as well as the fitting and programming and continued care for those devices. This is similar to having a knee replacement. The implant itself

may be $2000 or $3000, but the success of treatment lies heavily in the hands of the surgeon who is performing the surgery, and that is where most of the cost comes from. Luckily, most patients do not need surgery to hear better! Unlike knee surgery however, most insurance plans, including

Medicare do not cover hearing aids. In fact, Medicare does not cover hearing aids, dental care or vision care. If you have a Medicare supplement that follows Medicare guidelines, your supplement will not cover them either. I wish

they did! Over 80% of seniors over the age of 60 will have some degree of hearing loss, so the need is there. Some private insurance companies have a hearing aid benefit, for example, they will cover $500 or $1000. This often depends on whether the doctor is in or out of network, or whether a patient has met their deductible or out of pocket. To make things even more complicated, some insurance companies contract their hearing care benefits out to “Third-Party” Providers, bringing yet another entity into the mix. This can all be very confusing for patients (and doctors)! In fact, some of the cost of the professional services that you pay to the doctor when you get your hearing aids goes to employing the people who must verify, file and follow-up on the insur-

ance coverage for the patient. For third-party coverage, many patients will find that they don’t actually have a real hearing aid benefit- it is a discount plan where you must choose from a limited list of hearing aids, and

then you get a “discount” off the MSRP of the price of the device. Due to the limits on the technology available, and the reduced services that are covered, many professionals have opted out of participating in those third-party plans. Depending on the plan, sometimes the reimbursement the clinic receives does not even cover the cost of providing the service, making it impossible to participate. Because of this, many private-practice doctors do not participate with 3rd Party Plans. To summa rize, healthy hearing is a priority and care can be a significant investment. The success of your

results depends on many factors, including the expertise of the provider and the quality of the technology. Be an informed consumer and investigate what benefits you have available, do your research, choose the most qualified provider and work with your doctor to choose the best treatment plan and hearing aids to maximize your success- your ears depend on it! STOLEN WALET? 3:30 p.m. First block of Palm Harbor Village Way Filing a false police report. On April 30, deputies pulled a local man over in a traffic stop and asked him for his license. He said he didn’t have it, telling deputies, “last time you stopped me, you took it.” Deputies checked body camera footage of the last time they’d pulled the man over, and the video showed a deputy handing him back his license, according to a Sheriff’s Office report. On June 12, deputies pulled

the man over again. Again, he didn’t have his license, and said deputies hadn’t given it back to him during a prior traffic stop. “I don’t have money to get another,” he said. On June 14, the man walked into a Sheriff’s Office branch location and reported that someone had broken into his car on June 9 and stolen his wallet, containing his driver’s license. He said he needed the theft report to avoid paying the $30 state fee for a replacement license. The man then went to a DMV office and filled out the paperwork for a duplicate license, requesting a fee waiver because his had been stolen. Deputies noted that on June 12, several days after the supposed theft had occurred, the man had been blaming the Sheriff’s Office for his missing license and had said nothing about it having been stolen from his car. They arrested him for filing a false theft report and obtaining the license fraudulently.

ANGRY FOR COFFEE 4:23 p.m. — 1600 block of West Granada Boulevard Larceny. Police responded to a coffee shop chain after receiving a call about a shoplifting incident. The reporting officer met with an employee, who said she made a coffee for a man in his 40s, and the

man did not like how it was made. She told the man she would have to call her manager to figure out how to give him a refund, since she was a new employee. The man was not happy with it, according to the incident report, and began to yell. Before he left, he grabbed a bag of coffee. The manager wanted the incident documented in case he returned.

DISTURBING THE LANDSCAPE 6:08 p.m. — 100 block of West Granada Boulevard Criminal mischief. An officer was flagged down in the parking lot of the police department in reference to a woman throwing debris into the road. The officer then saw the 52-year-old Daytona Beach woman ripping plants and flowers from the grounds of the police department and throwing them into the road, all while cars passed by. The damages were estimated to be between $50 and $100. The woman told the officer that she was angry because she had just been issued a trespass warning, according to her arrest report. The reporting officer had been the one to do this, and he noted in her arrest report that the warning had been for “disorderly behavior and for attempting to steal a dog.” She was taken to jail.

Staly wants 10 more deputies, pay raises The Palm Coast City Council is considering a new impact fee structure to help pay for law enforcement. JONATHAN SIMMONS SENIOR EDITOR

The Flagler County Sheriff’s Office wants to add 10 more deputy positions to keep up with the county’s population growth, and the city of Palm Coast is considering a new impact fee structure to help pay for rising law enforcement expenses. The city already uses impact fees — one-time fees developers pay to local governments to offset the effects of their new development on infrastructure and government services — to pay for road projects, fire rescue services and parks. The fees are typically a flat dollar amount assessed on each new housing unit: For instance, the fire impact fee last year was $367 per home. After Flagler County Sheriff Rick Staly told the Palm Coast

City Council on June 14 meeting that he’s seeking funding to add 10 more deputies — five funded by the city, and five funded by the county — Mayor David Alfin suggested the City Council consider enacting a new impact fee structure. “I am looking forward to transitioning our historical budget process into a a program that would resemble an impact fee structure for public safety,” Alfin said. “That would allow us to keep pace with growth that is very difficult to detail and to be specific about.” Alfin added that he’s not the one to determine how many deputies the Sheriff’s Office needs. “I am not an expert in that area, the sheriff is,” Alfin said. An impact fee would give the FCSO money to use as needed, he said. Staly said he supported that idea. “It takes the burden off the taxpayers for the capital needs of growth, and so it makes growth pay for those kinds of things,” he said. Staly added that he believed from his conversations with county commissioners that the county government would be interested in coordinating with the city government on a new funding plan. Palm Coast doesn’t have its own police department, so it contracts with the Sheriff’s Office for policing, paying extra to have services above the level of service that the Sheriff’s Office offers in unincorporated Flagler County. The city has increased that funding in recent years, and last year paid for 10 new deputy positions, bringing the city’s annual contract with the FCSO to $5,615,712. Staly told the council that while crime in Flagler County has dropped to an all-time

low, traffic crashes and calls for law enforcement service have increased with Flagler County’s rising population. “We still can not drive anywhere in the county, specifically in the city of Palm Coast and certainly on our state road system, which is where most of our fatalities have been occurring,” Staly said. The Sheriff’s Office had 115,000 calls for for service last year, and is on track to have 118,000 this year, Staly said. About 73% of the FCSO’s workload is in Palm Coast. Although the FCSO has hired enough deputies to reduce the deficit of law enforcement officers it previously had relative to the city’s population, the agency now needs to hire more deputies to keep up with population growth, Staly said. The agency must also increase deputies’ starting pay to keep up with other area law enforcement agencies’ salaries, Staly said. Officially, Flagler depu-

ties this year are starting at $39,570 without overtime, which comes to about $43,000 with built-in overtime. At that pay, Staly said, “I’m no longer competitive. And I want to continue to be able to attract the type of employee that we want and, and also don’t want to be the training ground for other agencies.” So Staly has started chopping the first five steps off of the agency’s 25-step pay plan, so that new deputies start at $46,500 rather than $39,500. “Still behind all these other agencies, but I can’t survive at $39,500, so I had to do that,” Staly said. “That’s not fair to the existing employees, but it’s the only way I can be competitive and stay within my current budget.” There are also other rising expenses: For instance, the FCSO had budgeted for fuel at $2.75 per gallon; through the county, it’s currently paying $4.30 per gallon. Without more funding, Staly said, the FCSO won’t be able to maintain its current level of service. “Then, in effect it’s defunding the police, because you’re lowering the service levels,” he said. “And so I ask you to seriously consider five additional deputies.” Other council members also expressed support for in Alfin’s proposal to use impact fee money to help fund the FCSO. “I think that’s an excellent way to fund this,” Councilman Ed Danko said. “... We give you the money from these impact fees — I like that concept — and you do what you need to do with it.”

After a few days in hiding, 18-year-old Terrell Sampson was found and arrested June 16 for attempted seconddegree murder in the homicide of 16-year-old Noah Smith, in Palm Coast. He’s the fourth man man charged with Smith’s murder; the other three suspects have been charged with firstdegree murder. Sampson had been involved in the shootout that killed Smith in January and was a target in a related shooting that killed 16-year-old Keymarion Hall in May. Gov. Ron DeSantis’ political campaign this week launched a questionnaire designed to gauge how closely local school board candidates align with the Republican leader’s educational priorities. The campaign is sending what it calls the “DeSantis Education Agenda” survey to school board candidates. The

School Board’s counterproposal

The Flagler County School Board agreed to submit a new proposal as the school district, the county and the cities of Palm Coast, Bunnell and Flagler Beach work out a new interlocal agreeement. The county voted May 2 to provide a 120-day notice to terminate its involvement in the ILA. At that meeting, County Commissioner Joe Mullins criticized proportionate share mitigation payments, saying they amount to an upfront tax on new development. The mitigation payments allow the district to collect funds early in a development’s planning stage if schools lack capacity for new students the development would generate. The funds are later credited to the developer’s impact fees, which fund school construction or expansion. The district’s middle schools and high schools are currently over capacity. At a June 9 ILA oversight committee meeting, Assistant County Attorney Sean Moylan proposed a capacity reservation system as an alternative to proportionate share. Capacity reservation would require developers to pay 20% of their impact fees as a reservation for the new homes they are building regardless of whether schools are over capacity. The district would also collect the funds directly, as proposed by board member Janet McDonald. Bott presented the board with a summary of the ILA oversight committee meeting. A chart in her presentation compared proportionate share with capacity reservation for single-family and multi-family development based on the current known pipeline of new developments in the county. Impact fees for the developments would total $67,648,790. Proportionate share would collect the bulk of those fees — $51,782,844 — up front to be used for capacity improvement identified in the school board’s fiveyear facilities plan. The 20% capacity reservation fee would generate $13,529,758 with the remainder of the impact fees due when the units are constructed. Superintendent Cathy Mittelstadt said if the district doesn’t have the funds to expand, the level of service in the district could suffer. For example, labs could be taken down to add seats. Board Chair Trevor Tucker said with the county’s 20% across-the-board proposal, when schools are no longer over capacity, developers would wonder why they are having to pay up front. A wooded parcel of land south the Boston Whaler manufacturing plant may become the site of 217 new single-family homes. The Palm Coast Planning and Land Development Regulation Board voted 6-0 in favor of a master site plan for the development, called Grand Reserve East, during a June 15 board meeting. The Palm Coast City Council will have the final say on whether the site plan is approved, and will vote on it during a future business meeting. The 217 homes would be designed by Matthews Design Group and built by Amherst Homes on 141.5 acres of

land on the eastern side of Roberts Road, about 0.6 miles north of State Road 100 and south of the Boston Whaler property. About 44 acres of the site will be preserved wetlands. “This is one of the most beautiful layouts we’ve ever been able to do because of the [topography] and the wetlands ... where if you look at it, you’ll see very few lots don’t have either a preserve, or waterfront,” Ken Atlee, of Atlee Development Group, told the board. “So it’s really quite a lovely layout compared to a lot of the things that we’ve seen, where you have lots backing up to one another.’’ The city annexed the land from unincorporated Flagler County in August 2021. The Flagler County zoning designation would have allowed for up to 300 homes on the property, but the city, after it annexed the land, adopted a Comprehensive Plan amendment limiting Atlee Development Group to 217 homes on the property. The community would have a

density of 1.53 homes per acre; the maximum allowed in the city’s single-family residential zoning designation is seven per acre. Of the 217 lots, 96 would be 50-foot lots, 71 would be 60-foot lots and 50 would be 70-foot lots. The community would have two entrances: A main entrance on the south side, and a secondary one off Roberts Road. It would not be age-restricted. The development would exceed the city’s requirements for recreation space: The city requires 4.17 acres of recreation space for a development of Grand Reserve East’s size, and the developer is proposing 5.23 acres of recreation space, including an amenity center, a pool, a playground, dog parks, multipurpose fields, sidewalks and trails, a gazebo, and picnic tables in open spaces throughout the site, a city staff member told the board. A developer is proposing to add hundreds of new homes and almost

90,000 feet of commercial space to a parcel of land north of the intersection of U.S. 1 and Seminole Woods Boulevard, just southwest of the Integra Woods apartment complex in Palm Coast. Palm Coast’s planning board voted at a June 14 meeting to support a rezoning necessary for the proposed multifamily complex and commercial development, known as Seminole Pointe.

The rezoning adjusts the boundaries of the multifamily and commercial land on the property, making the multifamily section larger. The homes would be horizontal multifamily units such as duplexes and triplexes. A masterplan submitted to the city shows 420 residential units, plus 89,707 square feet of commercial space. The planning board voted 6-0 in favor of the rezoning.

Last month, they learned they had been ranked 12th in Google’s Yelp Top 100 Donut Shops in the U.S. “It’s like winning the world championship,” Donald Summerlin said. It seemed like yesterday when the idea of One Love came to me and a small group of tennis friends. Quickly, we introduced the idea to the general manager of Hammock Beach, Brad Hauer, and tennis director Gene Paul Lascano in the fall of 2018. We shared the vision of bringing tennis players from all over the United States to play in a charity tournament to support women and children in Flagler County. They all were immediately on board. For over a decade, I have collected names of players and have been introduced to players from USTA matches near and far. It was from that database and a strong passion to help women battling through domestic violence that One Love was born. With just a few tennis friends on board in 2019, we created a website and a tournament. Players from all over were excited, booked their rooms to stay at Hammock Beach Resort and took a personal interest in the cause. The first year, USTA was a huge support and added us to their tournaments, so we had players come from all over the United States, such as Texas, South Carolina, North Carolina, Orlando and Jacksonville. And many local players took part in the event as well. Our first One Love was a great success, and much more than what we anticipated. The local community also took part in the One Love Tennis ball auction where we raised a significant amount to help our charity, The Family Life Center and shelter. Since then, COVID hit, and we were unable to have our event in 2020 and 2021, but our hearts were still beating strong for the cause. In 2021, Julie Silva and I started our own nonprofit, Women with Wings, to spread awareness and help support as many women as possible during the pandemic and through the proceeds of One Love 2022. Our cause is truly a labor of love and commitment to families that have been affected by domestic violence. We weren’t going to give up on the cause because of COVID. We still made annual contributions to The Family Life Center, but we

were determined to open up One Love this year. The tennis tournament was a dream in the making. To have ladies come from all parts of the U.S. to our community and support other women is truly a beautiful meaning of sisterhood at its finest. Ladies from all over came for one weekend to fight for one cause — supporting domestic violence victims — which in essence is our tennis family meaning of One Love. But the only way we could keep fighting was to bring awareness and bring in funds to our own nonprofit to help. Our tournament in 2022 was much more than you could imagine. Within 10 days of opening registration in February we were sold out. That meant 128 players were due to arrive in May for us to host a four-day tennis tournament. Calls and support started coming in from other women and businesses. Sponsors such as Beachfront Grille, Roadies and Bruster’s/ Nathans provided player lunches, and donors such as Rulon International, Storage Central, Fischer Concreate, Intracoastal Bank, Furniture 2 Go, Florida Family Dentistry, Schuster Law Firm and Voya Financial came to bat for us. Friends even pitched in to provide T-shirts, swag, and even a fashion show. My girlfriends are the best. Without them and their commitment to this vision, we could never do all of this. It certainly takes a village. Flagler County has provided Julie and I personally with such amazing friends over the past 20 years, and our tennis community has a way of always coming together for each other. They ran around collecting items for the auction, made baskets, added artwork to T-shirts and hats, provided entertainment, sold our “best friends tennis closet clothing” and jumped in when we needed them most. If it were not for these donations and volunteers, we would have never been able to give the Family Life Center so much. We are very proud of this event and hope for it to grow and grow for years to come. It is truly our legacy of love for women and children of Flagler County. Women with Wings, along with the players and community, were able to raise and

donate $48,500 net to give to the Family Life Center from One Love proceeds. Our tournament was filled with love for four days, and the sign of the butterfly was prevalent throughout the event. We felt when starting our charity, Women with Wings, that the butterfly was appropriate as many women feel trapped and worn like caterpillars searching and fighting for a day when they can become beautiful butterflies. Our goal has always been to help as many women as we can become butterflies. The ladies even wore butterflies on their clothing and butterfly tattoos to show their signs of support. We had an oversized butterfly for pictures with all of the attendees to bring awareness to the cause. Women who come to this event are here for the fun and camaraderie, but throughout the event they never lose focus of what our cause is really about: Women honoring and fighting for other women. This tournament does take a large amount of time to prepare, and a community of individuals that are passionate about the cause, to pull this off every year. So, there are definitely volunteer opportunities available, and we hope to gain some college students next year to do internship work with our nonprofit. We are truly beaming with pride and enthusiasm over this event and what it means for us as a community to be able to give back. Domestic Violence hits big for many women and families, with children especially. It is not always physical. It is damaging for many women’s souls and causes so much stress and family hurt and damage. As many heard the speeches from families of domestic violence victims at the One Love Tennis Ball on Friday, May 13, several survivors, family members, Trish Giaconne of the Family Life Center and law enforcement officer Jennifer Nawrocki spoke about the effects during and the aftereffects of domestic violence. Julie Silva, my Women with Wings co-founder, told a story about a woman named Pamela Leonard who was in an abusive situation and her husband’s attempt to kill her. In October of 2018 their

world’s collided, literally. After Pamela escaped the home he was trying to kill her in, she attempted to flee, and then in fear, entered into oncoming traffic. She hit a car traveling on the opposite side of the road, causing both cars to tumble, light on fire, killing the victim and causing lasting injuries to the driver of the other vehicle. The other driver was Julie’s son, Brandon. We later began to wonder, what if Pamela had someone who could’ve helped her? What if someone didn’t turn a blind eye to the abuser. Would Pamela still be alive? We are lucky that Brandon is alive. If it wasn’t for a priest outside of a rectory that night who pulled Brandon from his flaming car, Brandon might not have survived. Domestic abuse affects everyone, not just the victims. It causes a ripple effect which damages family. Those affected are our friends, neighbors, mothers, sisters, coworkers, children. Even our own sons and daughters. If you see the signs of abuse, it is time to do something. We hope that our bringing light and awareness to domestic violence through Women with Wings and One Love is that people will not continue to turn the other cheek when they see abuse happening, and they will not enable abusers anymore. It is all too common to turn the other way. If you know it is happening and you do nothing, then you are part of the problem. You may choose to look the other way, but you can never again say you didn’t know, especially when abuse turns fatal. You have to live with that if you did nothing but enable the abuser. Domestic violence affects one out of four women, and the members of their families and can cause emotional and long-term trauma. Many times, emotional and financial abuse cause as much damage as physical abuse, and unfortunately the court system too is somewhat broken where many women lose everything, including their children and access to funds, while trying to escape. The money we raise provides them a means to find the help, shelter, support, counseling and the resources to get through, survive and eventually become free and independent again. It is most certainly our legacy of love for women and children of Flagler County. Thank you to everyone involved who shared in our vision. This is truly becoming One common Love in our community! uneteenth, also known as Emancipation Day, is a federal holiday in the United States commemorating the emancipation of enslaved African Americans and is observed for celebrating African American culture. Originating in Galveston, Texas, it has been celebrated annually on June 19 in various parts of the United States since 1865. The day was recognized as a federal holiday on June 17, 2021, when President Joe Biden signed the Juneteenth National Independence Day Act into law. On Saturday, June 18, 2022, Palm Coast Mayor David Alfin presented the African American Cultural Society with a city proclamation naming the date “Juneteenth Day.” The AACS was established 31 years ago to preserve and perpetuate the cultural heritage of African Ameri-

Joseph Matthews has been the president of the AACS in Palm Coast since 2016. Matthews noted that the AACS Education Committee was instrumental in getting a Black history credit in the curriculum in the education system of the state of Florida. He also acknowledged the continuing existence of racism in Flagler County, the last Florida county to end segregation. In earlier days, local members of AACS were tasked with standing guard during the construction of the local buildint to prevent vandalism and to ensure completion of the structure. City of Bunnell Police Department Chief David Brannon explained the purpose of Bunnell Cleanup Day, on June 18, this way: “After arriving in Bunnell in late February, residents and community leaders in South Bunnell told me a breakdown in trust existed between the community and the police. Residents wanted to see change in that relationship to improve the safety of their children. ‘Frankly,’ I was told, ‘The people in this neighborhood don’t trust you (the police). They have to see you care. You can’t just say it.’ I heard what this trusted community leader was saying: Actions speak louder than words.” In response, the Bunnell Police Department proactively patrolled South Bunnell along with partners at

the Flagler County Sheriff’s Office. “Internally, we created a Community Outreach team where an idea arose from a team members’ past law enforcement experience in a similar community where the police led a cleanup day,” Brannon said. “With that idea in mind, we created ‘We Love Bunnell.’ We broke up into teams and addressed certain properties while asking other residents if we could help clean up their lawn and remove fallen tree branches, old furniture or appliances, and any other debris we encountered. Ultimately, we wanted this specific community to know we all care about them. By lifting them up, we can lift up the entire community.” Brannon added that the Bunnell Police Department officers engage with young people at Carver Community Center and Flagler Bulldogs

He hopes to host a Cops & Kids dodgeball game, noon to 5 p.m., on July 2, including a barbecue, bounce houses, and a water slide. “We welcome the support and attendance of the entire community,” Brannon said. Volunteers attended the cleanup lightly dressed with gardening-style gloves, hats and sunscreen. Each team was led by a Bunnell police officer. But after the meet, Miley’s symptoms got worse. “I had super bad symptoms the next day,” he said. “I didn’t eat for three or four days. I lost my voice. I didn’t practice at all until five days later. I never did anything all out.” His fever reached 104. He wound up losing 12 pounds. He said he didn’t feel feel like he was all the way back until the championship prelims on June 8. “Fifteen minutes before prelims, we didn’t know if he was going to run,” said Miley’s mother, Tracy Miley. He did run. And UF’s Jacory Patterson, Ryan Willie, Miley and Champion Allison went on to win the 4x400 title with the second best time in college history — they already had the best time. Miley’s 45.8 split wasn’t his best, but it was good enough. “Once he handed it off to (anchor runner Allison), we knew we got

this,” Tracy Miley said. The Gators went on two sweep the men’s and women’s team championships. “It’s always been a dream of mine to win nationals, especially with my team and on such a competitive stage,” he said. “It’s like a dream come true.” As early as last fall, Miley told his parents that the 4x400 relay team was going to win the championship. Patterson and Allison had transferred in to join Willie and Miley. “At the beginning of the year, he was talking about, ‘We’re going to win nationals,’” Tracy Miley said. “He was confident where they were going to be at the end of the year.” Miley said he could see the team’s potential early on. “Some of my teammates started doing crazy times, and I started catching up to them,” he said. “I started running really, really fast.” The quartet became the first collegiate 4x400 relay team to break the 2:59 barrier when they ran an NCAA record 2:58.53 at the Tom Jones Memorial on April 16 in Gainesville. The foursome did it again in the NCAA championship final with a 2:58.88 to beat second-place Southern California by over a second. Allison (second) and Willie (fifth) also finished among the top eight in the 400-meter final. A perfect scenario might have been breaking the college relay record again in the final, but Miley wasn’t even sure if he would be ready to run at all. “I knew I was going to try no matter what,” he said. “Everything was about trying to get me back as best I could. We were banking on me running at least decent. It definitely would have been cool (to break the record in the final), but we already had the collegiate record.”

Miley came to Florida as an 800-meter runner. He finished second in the event at the 2019 Class 4A state championships, when he was a senior at FPC. Florida coach Mike Holloway converted him into a 400 runner last year. The 6-foot-6, 197-pound Miley realizes he was never built to be a distance runner. He started running track at Matanzas High to improve his speed for football. “My freshman year, my track coach started throwing me into events, and I did good in the 800,” he said. “As I got older you could tell I needed to change.” Realizing he had a chance to run track for a major university, he dropped football and transferred to FPC his senior year. He has been running the 4x400 relay at UF since his COVID-interrupted freshman season in 2020. He dropped the 800 and started running the 400 meters after the 2021 indoor season. “This is my first full year running the 400, the first year I’ve practiced (running out of the) blocks,” he said. “Now, I’m starting to get it. Coach (Holloway) said I probably would have made nationals (in the 400) if I didn’t get sick.” He also ran the 200 at the LSU Invitational, recording a time of 21.25 seconds. “I react really well to speed training,” he said. “I’m trusting the workouts. I’m trusting the training.” FPC track coach Dave Halliday watched the 4x400 final on TV. But he said it took a while for him to process the achievement. “It kind of took me about 24 hours,” Halliday said. “Then it really hit me. Jacob is part of the fastest relay ever in the history of the NCAA’s.”
