Court sides with city in Marshside ruling

Beach Safety aims to be reaccredited

A Volusia County Circuit Judge has ruled to uphold the Ormond Beach City Commission’s denial of a development order for Marshside Village.

The commission unanimously denied the 144lot subdivision development slated for the corner of Airport Road and Tymber Creek Road in October 2018, due to flooding concerns, reduced perimeter setbacks and small lot sizes. The developer also had an agreement with CANDO 2 to instate a $25,000 penalty per acre of wetland damaged in the project.

Circuit Judge Michael Orfinger concluded on June 9 that the developer Edward Speno, of Edward James Corp., and his attorney failed to demonstrate “they were denied procedural due process, that the city failed to observer the essential requirements of law, or that the action of the City Commission was not supported by competent substantial evidence.”

The petition to repeal the commission’s vote was filed on Nov. 15, 2018, a month after the commission decision.

Volusia County Beach Safety Ocean Rescue is seeking reaccreditation through the Commission for Florida Law Enforcement Accreditation, having obtained the recognition since 2006.

In early December, assessors from the CFA will review the agency’s policies, procedures, management, and operating practices.

out that a development order for the subdivision was previously denied in 2013 due to proposed small lot sizes.

In the 2018 proposal, lot size was still an issue, and city staff raised concerns over traffic impacts, stormwater management and the compatibility of the project with surrounding subdivisions, court documents state.

The Planning Board also recommended the city deny the 2018 development order.

On the CANDO 2 agreement, Orfinger issued the opinion that “the effect of the CANDO agreement on the City Commission’s vote, if any, is sheer speculation.”

Court documents state all parties acknowledged it was unenforceable, and while the developer and his attorney may suspect it impacted their application, their suspicion has no legal or evidentiary support.

“As a board, we’re not medical professionals. There are no epidemiologists up here, and so the reality is that we rely on the Florida Department of Health to guide us in the right direction.”

Ocala man drowns in Daytona Beach A 27-year-old Ocala man’s body was found on Sunday, Oct. 25, after he went missing while swimming in the beach near 1024 N. A1A in Daytona Beach, Volusia County Beach Safety reported.

Elijah Rashad Thomas was swimming with family members in an unguarded area of the beach when he was caught in a rip current and was rendered unable to return to shore.

His body was found approximately nine miles north of where he was last scene.

Beach Safety expects his death to be ruled a drowning, but awaits an autopsy.

Feeding Volusia Halifax Urban Ministries to distribute 50,000th bag of food this week

HUM volunteers and Ocean Center staff load food bags into a van for distribution.

ach Tuesday, volunteers with Halifax Urban Ministries arrive at the Ocean Center’s exhibition hall to help pack almost 3,000 bags of food for struggling families.

It’s an operation that has been in place since May, and after this week’s COVID Response FeedA-Family session, HUM will have distributed over 50,000 bags of food throughout Volusia County, a milestone HUM Executive Director Buck James said they never thought they would accomplish.

“In retrospect, it’s really aweinspiring to see what happens when everybody from the community comes together and works together,” James said.

With 48 distribution points in the county, HUM’s objective is to centralize efforts to feed Volusia families. Every bag is the same — they contain items such as fresh produce, a loaf of bread, pasta, cereal and pre-packaged meats.

HUM receives two weekly semitrucks full of food at the Ocean Center.

James said they are averaging about 82 volunteers a week, many from the surrounding faith community. Without the volunteers, the operation could not be complete, he said.

James recalls going home the night before the first food bag distribution, taking one last look at the boxes of food in the Ocean Center’s arena, and how he later woke up in the middle of the night hoping volunteers would show up in the morning to help.

“Every week, people showed up to volunteer,” James said.

Ted Hordecky, member of Our Lady of Lourdes Catholic Church, is one of those volunteers. The work is rewarding, he said. Like him, several of the volunteers are retired and put in up to 12 hours a day for the operation.

“A lot of hands makes a light load,” Hordecky said.

The work to bring the food bags into the hands of families goes beyond packing and distribution. Ormond Beach resident Jerry Cutter serves as treasurer on HUM’s executive board, and said their role in bringing the opera-

tion together is administrative in nature.

“It’s quite an accomplishment from the time we sit down in the director’s meetings and we see this all come together because we work behind the scenes all the time, raising the money, buying the food,” Cutter said.

Since May, HUM has moved its packing sessions from the arena to the ballroom until finally migrating to the exhibition hall, where six columns of 240 bags can be set up at once, minimizing the amounts of packing rounds volunteers need to complete. Once each round is finished, the food

EMPLOYEE DROP-OFF 10:11 a.m. — 1900 block of West Granada Boulevard Suspicious person. A 35-year-old Daytona Beach man was found lying in the grass with an empty container of alcohol beside him, and another in a plastic bag, according to a police report.

The man told officers he arrived that morning to work and was “intoxicated to the point that he was left at this location,” the report states. The man wasn’t sure what time he stopped drinking the night before and wasn’t sure how he got to work.

Police transported him to a receiving facility for detox.

OCT. 22

ROCK SALT 4:53 p.m. — 1600 block of North U.S. 1 Possession of heroin. Police arrested a 35-year-old Daytona Beach woman following a traffic stop after finding narcotics and paraphernalia inside her vehicle.

Police report that two clear small plastic bags containing a “clear rock-like substance” were found in the rear center console, but though the reporting officer suspected it to be methamphetamines, the substance could not be tested on site and had to be sent to a laboratory. Small plastic bags with heroin residue were also discovered.

boyfriend is a heroin user, but advised that a friend was using rock salt in the small plastic bags to rip people off who were seeking ti purchase methamphetamines.

She was taken to jail.

OCT. 23

DRUNK DRIVER 1:54 a.m. — Intersection of Wilmette Avenue and North Yonge Street DUI. A 38-year-old Ormond Beach man who passed out behind the wheel of his car while drunk driving handed police his debit card instead of his driver’s license once police woke him up.

According to his arrest report, police found the man slumped over the wheel while in the turn lane of North Yonge Street, with the vehicle still in the “drive” position and foot on the brake.

After failing to turn off his vehicle, the reporting officer reached into the car and placed it in park before shutting it off.

The man’s slurring was so bad, the reporting officer asked him if he was speaking English.

When police asked if he had anything to drink, the man said “some beer and some shots,” according to the police report.

He failed the field sobriety exercises and was taken to jail.

Anti-mask mothers trespassed from Volusia County Schools district building The group delayed the School Board meeting by over an hour.

A group of seven women were removed from the Volusia County School Board meeting on Tuesday, Oct. 27, after they refused to follow the district’s mask policy.

This delayed the meeting by over an hour.

The women wished to speak against the district’s mandatory face covering policy, which was on the agenda for the board to vote on after the district added a disclaimer on face shields and clarified what constituted “strenuous physical activity.” The previous policy was set to expire on Nov. 2, and the board was also voting to establish it as a set mandate with no expiration date.

The women livestreamed their confrontation with district staff and DeLand police on Facebook.

They were instructed by district staff to either wear a mask and stay in the room, or wait outside until it was their turn to speak on the item.

Following multiple refusals, the group was trespassed from the building. The School Board later voted to unanimously adopt the mandatory face covering policy with the new changes, though School Board member Jamie Haynes expressed hygiene concerns regarding children wearing the same mask throughout the school day, and School Board

KATE CUMISKEY, former teacher member Carl Persis pointed out that the World Health Organization recommends children under the age of 5 not wear a mask because they are less likely to do so properly.

School Board member Ruben Colon quoted a past email by Patricia Boswell, the Volusia County Department of Health administrator, where she stated the Centers for Disease Control recommended masks in public settings to help control the spread of COVID-19.

“As a board, we’re not medical professionals,” Colon said.

The board will continue to examine its mask policy as COVID-19 conditions develop.

The district’s attorney, Kevin Pendley, said that for every person that doesn’t believe a face covering policy should be

required, there’s another that believes it should be. Students and families who were opposed to wearing masks during the school day were given virtual options for learning: Volusia Live and Volusia Online.

“If you’re going to choose to come onto school property, this is a mandatory face covering policy that applies to everyone across the board,” Pendley said.

During the public comment portion of the agenda item, former teacher Kate Cumiskey said the trespassing of the group of women was “really disconcerting” and that she was still shaken up over it.

“The entire situation showed appalling ignorance about science,” Cumiskey said. “It was a stark, jolting reminder of the absolute necessity for education, to me.”

Jeremiah’s Italian Ice opens new location in Ormond Franchisee Hayden Boyd, 21, said he’s ready to bring ‘good memories and a flavorful experience’ to the residents.

The first Jeremiah’s Italian Ice gelato flavor 21-year-old Hayden Boyd tried was strawberry.

One taste made him reminisce about his trip to Disney.

He recalled sitting on a bench in Magic Kingdom and eating a strawberry popsicle.

“The moment I tasted a Jeremiah’s strawberry gelati, it reminded me of that memory,” Boyd said. “It reminded me of that happy childhood and everything else that went along with it.”

Then, he started seeing others having similar experiences when trying the franchise’s ice cream. Now, he and his two partners, Glenn and Bryan Repple, are opening their first Jeremiah’s

Italian Ice location in Ormond Beach at 162 S. Nova Road, in the former’s Little Caesar’s building.

Doors opened at noon on Tuesday, Oct. 27, and Boyd said he was ready to bring “good memories and a flavorful experience” to the locals.

The Ormond Beach location, complete with a drive-thru, is one of three that Boyd and his

partners plan to open in Volusia.

The other two are planned to be located in New Smyrna Beach and Port Orange. Originally from Columbus, Georgia, Boyd said he considers himself a small-town boy at heart, and that when they were searching for towns to open up shop in, they felt these cities would fit in well with both the Jeremiah’s Italian Ice brand.

Boyd moved to Ormond Beach in February. The new store has a mural paying tribute to Ormond Beach history inside its dining room.

“You can’t say you’re for the community or anything like that unless you are part of the community,” he said.

At 21, he is the youngest franchisee in the company. Boyd became familiar with Jeremiah’s through his former employment managing for Spectra Food and Beverage at the University of Central Florida. Part of his job was to bring in local brands to sell food at the university’s stadium during games, and having noticed the strong following for Jeremiah’s in Orlando, he reached out and created a working relationship with the brand.

That’s when he fell in love with the brand’s mission, which he said invests

and presents opportunities for their staff and community.

“Hayden, Glenn, and Bryan embody what it means to be a part of the Jeremiah’s family,” said Jeremy Litwack, founder of Jeremiah’s Italian Ice, in a press release. “Their excitement to give back to the community and serve as mentors to their employees makes us confident that they are going to be strong leaders in the Ormond Beach community. We can’t wait to see all of the amazing things they do as they introduce our concept to the area.”

Opening a new business during the COVID-19 pandemic wasn’t easy. Boyd said they originally planned to open back in June, but that they held off until it was safer to do so. He hopes in the future, they’ll be able to host fundraisers and spirit nights for local causes.

“It’s definitely had its challenges, but the motivation and the push is to give back to the community and give back to people,” Boyd said.

A vaccine is the answer Dear Editor: The winter months usually bring many snowbirds down to Florida, but I suspect the pandemic will influence how many make the trip this year to warmer weather.

We welcome snowbirds because they are an integral part of our communities and our economy. With unemployment numbers bouncing up and down as we try to get a grip on COVID, I feel the only way to stabilize our economy and ensure Florida’s tourism industry can return to normal is with a science-backed vaccine.

Florida’s governor has made strides to boost in-state travel and reopen, but there remains uncertainty within our business communities, uncertainty which further drives home the need for the stability a vaccine could provide. Right now, we need to renew focus on supporting the pharmaceutical researchers, scientists and manufactures who have gone all-in on finding treatments and cures that can help us.

I will be voting for the candidate that seems to be most inclined with these initiatives — one who trusts science and who wants to reopen safely.

Our Volusia County Dear Editor: I had hoped for a civil discourse so we can all be privileged in learning what the county council candidate platforms are, keeping in mind that these are the folks we are trusting with our tax dollars to be our stewards. What a shock and disappointment! Deb Denys decided to not only form her own PAC, ($265,000, deep-pocket donations). As if that was not bad enough, she pursued with character assassination of her challenger, which, in our 21st century I find it to be unacceptable, offensive, egregious, and a desperate attempt to be elected because you have no platform. We will remember the $500,000 tax money Denys voted on to conduct a special election for us to have the privilege of raising our own taxes. If that is leadership, I pass!

Sadly, Barbara Bonarrigo capitulated to the same diabolic despot tactics with her character assassination of Heather Post. It’s quite simple folks; If you can lie, deceive, cheat and fabricate yourself to an election, you will do the same when officially in office!

Deb Denys: Responding to Mr. Collins’ letter, I stand by my eight-year track record of economic development, lower taxes and a balanced budget, support for law enforcement and water cleaner today than when I took office. My inexperienced opponent is out of his depth and offers ill-conceived and unexplained positions. He lacks both the experience and ability to serve as county chair. Regarding my fundraising advantage, not surprisingly, my opponent just cannot get support because of his improbable policy positions. When looking in the mirror, he sees an angry candidate without a plan. Experience matters!

Partington for Ormond Beach Dear Editor: I see where candidate Rob Bridger has criticized our present Mayor Bill Partington for supporting the beautification effort for Ormond Beach. Compare the beautifully landscaped roads leading into our city with other cities that don’t have this type of vision. Ormond Beach is a vibrant city and the quality of life here is

second to none.

Incidentally, as chair of the North U.S. 1 Coalition, whose purpose in coming together was to enhance the beautification of the north entrance to our city and county, almost the entire cost of the landscaping along North U.S. 1 was through grants from the budgeted portion of FDOT’s landscaping program.

I just can’t get over how Mr. Bridger is so critical of just about every aspect of Ormond Beach. I urge you to focus on all of the positive qualities of our community that our Mayor Bill Partington has supported and worked towards, and to vote to keep him in office.

Campaign of disinformation Dear Editor: Disinformation is false or misleading information that is spread deliberately to deceive. We have seen this disinformation being spread at the national level for a long time and recently seen it in Volusia County with political campaigns distributing misleading and deceptive campaign mailers with claims like “I Will Never Defund the Police” and others claiming that their opponent “Will Defund the Police.” My opponent recently sent out a glossy mailer entirely devoted to his insistence he will not defund the police; he appears to be falsely claiming that I will defund the police which is patently false.

This national issue was never a local issue, and it is shameful and despicable that our elected officials would make such baseless claims. We deserve better.

Under our current leadership support and officer salaries have not been adequate to prevent or fill six vacancies with five more officers at risk of leaving for other jurisdictions. We’re undermanned and underpaid. Property crimes are very high compared to the state average, but my opponent doesn’t want to talk about that.

I am very proud of and fully support our excellent police and fire departments and I would not support defunding our police.

Disinformation campaigns are used to cause confusion and fear and to divert attention away from real issues that are important to our community.

Environmental protectors?

A play on words Dear Editor: So much for the “non-partisan” political race for the mayorship of this fine city.

Using the word “conservative” (seven times) in the latest slick mail-out received, Bill Partington avoided using the “R” word thereby tiptoeing around a questionable topic in this cleverly designed piece. In fact, if readers did not understand the terminology on the face of the piece, the smug message is repeated on the reverse side.

Furthermore, it was unnecessary to insert the term “socialist liberals” in the text. Meeting and talking with the four challengers, they are not only downright nice individuals, but also more concerned about the welfare of the Ormond Beach citizens than those who are currently in control.

If the local developers are flush with dinero, some should spend those additional funds on maintaining the property they own. That eyesore adjacent to the aforementioned vacant lots, affectionately known as Wawa, shall be your legacy.

‘Trumpism’ impact

Dear Editor: With so many areas of the city suffering unmeasurable environmental damage, how can the commission incumbents claim to be protectors of the environment?

Why did the commission abolish strong Ormond Beach wetland rules? Why clearcut trees and green space in low-lying areas like Granada Pointe? What environmental tradeoffs did the city receive in return for the large commercial developments in the Sterthaus floodplain?

When the mayor touts the Central Park lakes as a flood control project, is he saying flood control is the tradeoff for all the current and future development runoff from homes and streets? What is being done about the invasive weed and algae blooms that have compromised the ponds and ditches? Why is the city’s use of herbicides so prevalent? Why have all the natural creeks that once flowed through Ormond Beach been ditched for flood control? What are we doing about nutrient runoff and the resultant algae blooms?

Why is there so much factual evidence to contradict the claims of strong environmental protections alleged by the incumbent?

Dear Editor: I write from the perspective of being the son of parents who had to live under the Nazis until they could leave Czechoslovakia. Fair minded people realize that Donald Trump is singularly responsible for the tragic devolution of our society.

A frightening impact is Trump’s divisiveness and sanctioning hate, racism, violence and domestic terrorism. A disturbing example in our community is the widespread theft of Biden for president signs, one of which was shot-gunned.

Make no mistake, it all flows from the top.

Now that we are in an election season, it occurred to me to seek the views of candidates seeking City Commission and County Council positions to see if they are helping to reverse the devolution of our community under Trump from their perspectives. I asked if they supported Trump, and only four candidates seeking city positions responded: Rob Bridger, Tom Grigsby, David Romeo and Ken Smith. Only County Council chair candidate Jeff Brower responded. The other three county Republican candidates did not.

It is up to each of us to act insofar as possible to restore our democracy. So much is at stake. We need to vote.

With the holidays approaching and a lot of social-contactdeprived citizens hankering for winter celebrations, the CDC and local health experts are warning that COVID-19 is spiking in much of the country, and social gatherings remain a risk.

“The last thing you want is a holiday tragedy where somebody gets really sick, and it spoils the whole thing,” said Dr. Stephen Bickel, medical director at the Florida Department of Health Flagler.

Bickel is advising caution this holiday season: Holiday gatherings with people outside your household are a risk, he said.

The number of people at the gathering: Gatherings with more people pose more risk.

The size of a holiday gathering should be determined based on the ability to reduce or limit contact between attendees, the risk of spread between attendees, and local health and safety laws.

“I’m not going to any,” Bickel said. “If I was, it’d be wearing a mask. ... It’s high risk, there’s a tendency to take your mask off, how do you limit the number of people — it’s just hard.”

A holiday party is not like a classroom or an office where people are confined to assigned seats that can be spaced well apart, he said.

But, he added, “If you’re going to have a holiday event, I definitely would avoid having it inside — I’d consider avoiding it entirely. Outdoors is thought to be 10-20 times safer than indoors.

So if you have a choice of eating outside versus inside, I’d always pick the outside.”

To be as safe as possible, he said, you’d also have to limit the numbers and wear masks — but how much fun is that? And, he noted, holiday gatherings that revolve around shared meals aren’t conducive to constant mask wearing.

The locations attendees are traveling from: Gatherings with attendees who are traveling from different places pose a higher risk than gatherings with attendees who live in the same area.

Florida faces potential ‘third wave’ of COVID-19 infections Rapid testing, once available, could help reduce COVID numbers as vaccine is developed NEWS EDITOR

The United States is facing spiking COVID-19 numbers as the country approaches the fall holiday season, but the extent to which that will affect Florida and Flagler County aren’t yet clear.

“I think it’s fair to call it a third wave that the country’s experiencing — Florida not so much yet,” said Dr. Stephen Bickel, medical director at the Florida Department of Health-Flagler.

In the north, cold weather pushing people indoors is likely part of the reason for the spike, and and that’s less of a factor here, he noted.

But people do seem to be letting their guard down about COVID-19 safety precautions.

“People get more active; they have more parties, more social activities,” he said.

“It doesn’t take much to multiply the effects.”

Europe is also experience spiking numbers, he noted.

At this point, Bickel said, rapid testing of large swathes of the population‚ including people who aren’t experiencing any symptoms — could drop COVID-19 numbers back by 50%-75%, but the rapid tests in development are still working their way through regulatory hurdles.

“We’re just not testing enough,” he said. “We might be picking up 5% to 10% of the infectious activity going on. ... If it’s patientdriven and it’s driven by symptoms, you‘re probably missing at least half, if not three-fourths, of their contagious period.”

In terms of testing, Flagler has been ahead of most of the state, and has consistently been near the bottom in terms of infection rates and death rates. Two other counties that have emphasized testing — Alachua County and Brevard County — have also experienced low infection and death rates.

Florida and Flagler County might derive some protection against a winter spike from Florida’s climate, since winter doesn’t drive Floridians inside, and also from the fact that the virus has already been circulating in the community.

“We have some low-level immunity,” Bickel said. “It’s not approaching herd immunity, but … that may have an effect. We may not get it as bad. We’re hoping that some of the developments, like the rapid testing, can nip it in the bud. It’s quite possible that our wave, if we have one, will be delayed and subdued.”

But with the holiday season approaching, he added, “If I had to make a prediction … I think that we will have an uptick in COVID.”

SPEEDIATRICS FUN DAY FESTIVAL The NASCAR Foundation recently partnered with the Boys and Girls Clubs of Volusia/ Flagler to host three Speediatrics Fun Day Festivals across Volusia County, where more than 150 children participated in NASCAR-themed activities, according to a press release.

The activities were guided by volunteers including NASCAR employees, local community leaders, business people and law enforcement officers. On Oct. 16, the festival was brought to the Rossmeyer Family Holly Hill Boys and Girls Club.

Children participated in field day activities like a tire race and sponge relay. Kids also took part in bike and pedestrian safety provided by the Health and Planning Council, the press release states. New bicycles were given to over 150 club members.

REMEMBERING A LOVED ONE Friends and loved ones of a late local tow truck driver held a celebration of life event at Tomoka Christian Church on Friday, Oct. 23.

David James, 47, died on Sept. 22 after suffering a medical episode while driving, leading to a crash involving multiple vehicles in South Daytona. The commemorative event was held by his former fiancé, Jacquelyn Rivers.

She described James as an easygoing man, one who loved to laugh.

He was great with children and had a passion for BMX bikes. Rivers said James was an excellent tow truck driver and mechanic. The pair dated for almost five years, having met on his birthday.

riday night’s district matchup featured Mainland and New Symrna Beach.

Mainland scored early on and maintained their lead, only giving up one touchdown late in the third quarter. This would be the only time New Smyrna got on the board.

Going into the fourth quarter with a score of 34-7, Mainland pushed forward, eventually setting the final score to 41-7.

The win was particularly special, as it was Scott Wilson’s 100th win as head coach of the Bucs.

Million-dollar home sells in Plantation Bay A

house in Plantation Bay was the top real estate transaction in Ormond Beach and Ormond-by-the-Sea for the week of Sept. 20-26 in the Multiple Listing Service.

Anthony and Parniya Whitehead sold 1342 Redbourne Lane to Ryan Smith, of Ormond Beach, for $1.1 million. Built in 2006, the house is a 4/5 and has a fireplace, swimming pool and 4,771 square feet. It sold in 2007 for $1.7 million.
