OMPLYING with the Supreme Court orders, the Election Commission of Pakistan on Friday night issued the election schedule for the upcoming general elections scheduled for February 8. Earlier in the day, Chief Election Commissioner (CEC) Sikandar Sultan Raja had confirmed the elections schedule would be announced tonight. Hours earlier, the apex court had ordered the electoral watchdog to announce the election schedule by tonight after it suspended a Lahore High Court verdict against the appointment of returning officers (ROs) and district returning officers (DROs) from the bureaucracy. In a notification, the ECP said the public notice would be issued by the RO on December 19 with the dates for filing nominations with the RO from Dec 20-22. The ECP said the names of the nominated candidates would be published on Dec 23 and the last date for scrutiny of their nomination papers would be from Dec 24-30. The last date for filing appeals against the RO’s decisions on rejecting or accepting nomination papers is January 3 with the last date for deciding the appeals by an appellate tribunal on Jan 10. The revised list of candidates will be published on Jan 11 and the last date for withdrawing one’s candidature is Jan 12. The ECP said election symbols will be allotted to political parties on Jan 13 with polls set for Feb 8. ISLAMABAD: Chief Election Commissioner (CEC) Sikandar Sultan Raja on Friday called on Chief Justice of Pakistan Qazi Faez Isa to discuss the possible repercussions of the Lahore High Court (LHC) verdict against appointment of Returning Officers (ROs) and District Returning Officers (DROs) from bureaucracy. According to sources privy to the development, the meeting was attended by Justice Ijazul Ahsan and Justice Tariq Masood and Attorney General of Pakistan. CEC Raja apprised the apex court judges regarding the LHC order which suspended the electoral body’s notification requesting returning officers (ROs) and district returning officers (DROs) from the bureaucracy for the general elections slated for February 8, 2024. Sources said that CEC Raja informed the chief justice of the preparations being made by the ECP for the polls slated to be held on February 8, 2024. The Supreme Court (SC) on Friday issued notice to former ISI chief Lt-Gen (r) Faiz Hameed on former Islamabad High Court (IHC) judge Shaukat Azizi Siddiqui’s petition challenging his removal. The notices were also issued to former IHC chief justice Anwar Khan Kasi, former registrar of the Supreme Court Arbab Muhammad Arif and retired brigadier Irfan Ramay. A five-member bench led by CJP Qazi Faez Isa and comprising Justice Amin-ud-Din Khan, Justice Jamal Khan Mandokhail, Justice Hasan Azhar Rizvi and Justice Irfan Saadat Khan conducted proceedings on the plea of Shaukat Aziz Siddiqui against his removal as ICH judge. Today’s proceedings were also broadcast live on the apex court’s website as well as on its YouTube channel. CJP Qazi Faez Isa remarked if the allegations made by Siddiqui were true, then “these army generals were facilitating someone else.” He asked ex-Islamabad High Court (IHC) judge Shaukat Azizi Siddiqui’s counsel if there was any officer who wanted to become Pakistan’s prime minister in 2018. Addressing the petitioner’s lawyer, the CJP remarked, “You did not make them party against whom you leveled allegations.” The bench had asked what Siddiqui’s lawyer and his client wanted if there is a problem with the pension we can say it to the Attorney General of Pakistan Mansoor Awan. The government has announced significant decrease in the prices of all petroleum products by upto Rs 14 per liter which will remain effective across the country during the last fifteen days of the on-going month of December 2023. As per the announcement made by the finance division on late Friday night, the prices of all petroleum products have been decreased for the second half on current month of December, 2023. The petrol price has gone down from Rs281.34/litre to Rs 267.34/litre after witnessing a cut of Rs 14/litre. Similarly, the price of HSD/diesel has been reduced by Rs 13.50/litre from 289.71/litre to Rs 276.21/litre. Likewise, price of kerosene oil has been decreased by Rs 10.14/litre from Rs 201.16/litre to Rs 191.02/litre. Furthermore, price of light diesel oil (LDO) has find a cut of Rs 11.29/litre from Rs 175.93/litre to Rs 164.64/litre. The government has decided to revise the prices of petroleum products for thr fortnight starting from 16th December 2023 as recommended by Oil and Gas Regulatory Authority (OGRA), said the Finance Division. On 1st December, the government maintained the prices of petrol at Rs 281.34/litre while it reduced the price of HSD by Rs 7/litre and Kerosene oil price also witnessed decrease of Rs 3.82/litre. Moreover, the government approved Rs 4.52/litre cut in the price of LDO for the first half of December, 2023.

Caretaker Prime Minister Anwaarul Haq Kakar on Friday reiterating Pakistan’s principled position and support on Kashmir issue, categorically said that no one could dare cast an evil eye on Pakistan and that its desire for peace should not be misconstrued as weakness or hesitation to face any aggression. “Pakistan is not a war mongering nation. But if anyone thinks that we are weak, shying away or hesitating, they should remove this misunderstanding. Muzaffarabad is not Gaza and New Delhi is not Tel Aviv…No one can dare to kill 4,000 children here,” he said in an interaction with the students of different colleges and universities of Azad Jammu and Kashmir during his two-day visit. Expressing his confidence in Pakistan’s defense capabilities in the context of the Indian aggression, he said though Prime Minister Narendra Modi and Benjamin Netanyahu of Israel had same attitudes, they had different implementing capability and response mechanisms. To a question, the prime minister strongly rejected the rumours of any change in Pak-

istan’s policy to follow the Indian suit to merge AJK in Pakistan, he said, “No one can think of such stupid act. Coming to Gaza situation, the prime minister said Pakistan would continue to raising the voice against Israel which was using brutal force against Palestinians. He said Pakistan had sent a field hospital and doubled its humanitarian assistance for the Palestinian people. He said the immediate focus should be to achieve ceasefire and establishment of humanitarian corridor. “Gaza is close to our hearts… Israel earned nothing but hatred. Israel earned no fame,” he remarked. About the repatriation of foreigners, Prime Minister Kakar reiterated that only the illegal foreigners were being repatriated as they had been posing security challenge for the country. About the brain drain, he reiterated his earlier position of not discouraging it as the diaspora would become an asset in form of remittances and projecting Pakistan’s image. However, he called for improving education quality and fill the gaps to enhance the number of graduates to fulfill domestic and global supply needs.

Indian unilateral, illegal acts to fuel Kashmir freedom movement: PM Kakar

MUZAFFARABAD: Prime Minister Anwaarul Haq Kakar on Friday, calling the recent verdict of the Indian Supreme Court as a tool to consolidate Indian illegal occupation, said that such unilateral and illegal decisions would further stimulate the Kashmir freedom movement. Anwaarul Haq Kakar addressing a press conference in Muzaffarabad, today, said despite having support from the world powers, India could not succeed in its nefarious designs of diminishing the freedom movement and resolving the Kashmir dispute according to its own wishes. “The movement is not diminishing and this is the biggest problem of India which again and again is trying to bury it through various tactics,” he said. He said more than 90,000 Kashmiris have been killed, over 1500 faced forced disappearances and pellet gun injuries, and thousands of the women suffered rape, while the human rights abuses were also documented in two of the UN re-

ports. “Such painful memories cannot be forgotten for centuries,” he added. To a question, the prime minister, expressing the government of Pakistan’s resolve to support the Kashmiris in their just cause of freedom, said this movement would continue with new strength and would remain consistent. He said, during his two-day visit he held useful and constructive interactions with the Hurriyat leadership, members and cabinet of AJK legislative assembly, students, and journalists to inject new vigour and energy in the Kashmir freedom movement. During the meetings, input from various stakeholders, including the Kashmiri leadership, would be incorporated to reinvigorate the freedom movement, he said. He added that the unilateral and illegal decision, either by the Indian courts or assemblies, would never be accepted and Pakistan rejects such decisions.

ECP to announce action plan in light of law, Constitution, says Solangi ISLAMABAD

Caretaker Federal Minister for Information, Broadcasting and Parliamentary Affairs Murtaza Solangi said on Friday the Election Commission of Pakistan (ECP) would announce its action plan in the light of the Constitution and law. Talking to the media outside the ECP he said under Article 218(3) of the Constitution, the only constitutional body responsible for conducting elections in the country was the Election Commission. “We neither can question the Election Commission, nor we can supervise it, in fact, the Election Commission supervises the caretaker government,” Murtaza Solangi maintained. He said if anyone had a complaint with the ECP, he could contact the Election Commission. The ECP under the Constitution enjoyed the power to appoint District Returning Officers, Murtaza Solangi remarked. The present caretaker regime was appointed under the constitutional process. He said everyone had the right to freedom of expression under Article 19 and 19A of the Constitution, media was free, and there was no restriction on it. To a question, he said that the caretaker government was providing equal opportunities to all registered political parties and leaders of political parties had the right of criticism.

Former Khyber Pakhtunkhwa (KP) governor Sardar Mehtab Abbasi has parted ways with Pakistan Muslim League-Nawaz (PML-N), announcing that he will contest the elections as an ‘independent candidate’. In a statement, the former KP governor said that he was parting ways with PML-N and would contest the election as an independent from NA-16 Khyber Pakhtunkhwa. Expressing concerns about the provincial leadership of the PML-N, Sardar Mehtab Abbasi said that the leadership only thinks of itself and its structure in Khyber Pakhtunkhwa is over. Furthermore, he said he had differences with Nawaz Sharif on principles but nothing with Maryam Nawaz. “There should be democracy in political parties, hypocritical thinking and attitude have become important in PML-N,” he claimed. Mehtab Abbasi further said that Nawaz Sharif has a weak team and solving the economic crisis is difficult. “Today the PML-N is only limited to Punjab,” he added.

If implemented, the tax burden may increase for individuals in lower and middle-income slabs, experiencing a notable rise in their tax rates. FBR officials noted that in the last fiscal

year, the FBR collected Rs264 billion in income tax from the salaried class, with the highest contributions coming from individuals earning between Rs200,000 to Rs300,000 per month. FBR spokesman Afaque Qureshi stated that the technical report from the IMF’s mission is yet to be received. The report highlighted 74 types of tax exemptions related to personal income and allowances costing Rs232 billion in the last fiscal year.

The decision was made by the Executive Committee of SIFC during its seventh meeting chaired by Caretaker Minister for Planning and Development Muhammad Sami Saeed in Islamabad. During the meeting, the committee acknowledged progress in various sectors and economic ties with friendly nations, particularly the recent memorandums of understanding and agreements with the United Arab Emirates and Kuwait. The Sindh Integrated Emergency & Health Services (SIEHS 1122) has joined hands with ChildLife Foundation for enhancing emergency and health services across the province. The partnership will enhance the capacity of the ambulance team to handle children’s emergency during transportation. It will be evolved into live tele-consultations and bubble CPAP machines will be added in the ambulances. Brig (R) Tarique Quadir Lakhiar, CEO SIEHS and Dr Ahson Rabbani, CEO of ChildLife Foundation, signed the Memorandum of Understanding (MoU) on behalf of their organizations. Sindh health minister Dr Saad Khalid Niaz was also present. “SIEHS plays a pivotal role in providing free ambulance services to patients across Sindh and the partnership with ChildLife will further help in saving lives of millions of children through tele-consultations of pediatric patients who require emergency care,” said the Health Minister. Under this strategic alliance, ChildLife will support SIEHS 1122 by providing live tele-consultations for pediatric patients within SIEHS 1122 ambulances. The ChildLife will seek assistance from SIEHS 1122 in efficiently transferring patients entering its network. They will mutually assist in enhancing the capacity of their respective staff through collaborative efforts in capacity building. “This collaboration marks a crucial milestone in our mission to provide top-notch emergency and health services to the people of Sindh,” said the CEO SIEHS. CEO-ChildLife Foundation said that “This collaboration is a testimony of the innovative services the team has developed and scaled. We are honored to partner with SIEHS to share our practices and experience saving lives with this virtual emergency care model throughout the province. President Dr Arif Alvi issued a new ordinance on Thursday to create a Privatisation Appellate Tribunal, which would take over the functions of high courts in privatisation matters. The ordinance aims to avoid delays in selling state assets and settle disputes quickly. The presidency issued a statement saying that the president issued the Privatisation Commission (Amendment) Ordinance 2023, which amended the Privatisation Commission Ordinance of 2000 from Section 28 to Section 33. Sections 30 and 33 of the Privatisation Commission Ordinance 2000 were repealed through the new ordinance. The president issued the ordinance under Article 89-1 of the Constitution. The interim federal government decided to introduce the legislation after the Lahore High Court (LHC) accepted a petition challenging the planned privatisation of Pakistan International Airlines (PIA). The purpose of the new ordinance was to eliminate unnecessary delays in privatisation, resolve issues and ensure compliance with the principles of law and justice, the presidency said. The ordinance came after Privatisation Minister Fawad Hasan Fawad met with the president on Tuesday and explained the need for the ad hoc legislation. Fawad said that the ordinance would provide in-

vestors the confidence to invest with the understanding that there would be only one forum to redress any legal issues arising out of any transaction with an appeal to the Supreme Court. According to the presidency, the Privatisation Appellate Tribunal would have jurisdiction to hear and adjudicate civil and criminal matters relating to privatisation. The powers given to high courts in the Privatisation Commission Ordinance 2000 were now transferred to the Privatisation Appellate Tribunal. The new ad hoc law states “no court other than the Privatisation Appellate Tribunal constituted under this (new) ordinance, hereinafter called as the Appellate Tribunal, shall exercise jurisdiction under this ordinance”. The Appellate Tribunal would have the same powers as a civil court or a criminal court trying a suit or case under the Code of Civil Procedure 1908 or the Code of Criminal Procedure 1898. The Appellate Tribunal would have the authority to summon and enforce the attendance of any person and examine him on oath; requiring the discovery and production of documents and material objects; receiving evidence on affidavits; and issuing commissions for examination of witnesses and documents. President Alvi made one change in the draft that had been approved by the federal cabinet. He passed the amended ordinance proposed by the government after chang-

ing Section 28. The president changed the proposed government ordinance to appoint a retired judge of the Supreme Court instead of a retired judge of the high court as the chairperson of the Appellate Tribunal. Under the ordinance, a retired judge of the Supreme Court would be the chairperson of the Privatisation Tribunal. The Appellate Tribunal would have one technical member and one judicial member. The Supreme Court would have the power to hear appeals against the decisions of the Appellate Tribunal. The newly inserted section states “any person aggrieved by an order of the Appellate Tribunal may within 60 days thereof prefer an appeal to the Supreme Court.” The government approved the transfer of all cases pending before high courts to the proposed Appellate Tribunal. The federal government would have the authority to remove the chairperson or a member of the Appellate Tribunal on the ground of physical or mental incapacity or misconduct, after giving a notice of not less than 30 days and an opportunity of being heard. The government made the ad hoc legislation effective from the year 2000. The life of a presidential ordinance is only 120 days and it can be extended by another 120 days by the National Assembly. Before the ordinance, all high courts had concurrent jurisdiction over privatisation cases. Under the ordinance, the federal government would establish a three-mem-

ber Privatisation Appellate Tribunal. On December 8, Profit reported that the federal cabinet had approved the issuance of the Privatisation Commission (Amendment) Ordinance 2023 to ensure the privatisation of government assets, including PIA. The cabinet had decided to end the role of the high courts and other courts against privatisation and to establish the Appellate Tribunal to hear the petitions filed or to be filed against privatisation. The cabinet also decided that after the issuance of the ordinance, the decision of the Privatisation Commission Appellate Tribunal could only be challenged in the Supreme Court, while the cases pending in high courts and other courts across the country would be transferred to the Appellate Tribunal. The Appellate Tribunal was established on the request of domestic and foreign investors. The privatisation process had been badly affected by the filing of cases in various courts.

These examinations were conducted in July-August 2023. A grand ceremony for distribution of certificates and cash prizes was held at Hafiz Hayat Campus. Vice Chancellor Prof Dr Muhammad Mushahid Anwar was the chief guest of the ceremony. Controller of Examinations Tanzila Qamar announced the results. In ADP science exams, Lahza Mubeen of Punjab College Dina, Jhelum, secured first position by obtaining 673 marks. Pakiza Rizwan of the same college grabbed second position by securing 649 marks while Fiza Asghar of Girls Science College, Tanda, secured third position with 638 marks. In the ADP Arts exams, Mahnoor of Government Degree College Women Saghir Shaheed Park, Gujranwala, secured first position by securing 623 marks. Iman Azhar of Superior College, Jalalpur Jattan, claimed second position by securing 622 marks. Third position was secured

Senate sub-committee discusses scrutiny of institutions aﬃliated with PNMC

The sub-committee of the Senate Standing Committee on National Health Services, Regulations, and Coordination on Friday discussed the scrutiny of institutions affiliated with the Pakistan Nursing and Midwifery Council (PNMC), their ties with hospitals, and the issuance of fraudulent degrees/certificates to nurses. The meeting of Subcommittee held at Parliament House with Senator Rubina Khalid in chair, issued recommendations for enhancing the standards of nursing institutions.

The convener expressed concern about the absence of the Secretary and Health Minister during the meeting. The committee was briefed that minimum clinical hours for nursing students have been increased, a step applauded by the subcommittee. Senator Rubina Khalid raised the issue of accrediting nursing education institutions that do not meet the necessary criteria. The convener directed the Pakistan Nursing and Midwifery Council to identify officials responsible for licensing non-compliant colleges, recommending an urgent inquiry by the FIA. The committee also proposed revi-

sion of the nursing education curriculum in Pakistan and stressed the importance of instilling ethics in nursing students. Additionally, the committee suggested at least one week-long training sessions for inspectors and the inclusion of competent nurses in the Council’s accreditation committee. The sub-committee further recommended that every nursing college should have affiliation with a 250-bed hospital. The committee welcomed the newly appointed president of the Pakistan Nursing and Midwifery Council, urging active pursuit of pending issues. They expressed support for the new president and anticipated improved standards in nursing. Addressing the matter of MSNqualified nurses with degrees from foreign institutions through online study, the committee listened to representatives highlighting the non-recognition of their degrees by the Council and HEC. The committee directed both entities to collaborate closely to resolve the issues faced by these affected nurses. The committee meeting was attended by Senator Prof Dr. Mehr Taj Roghani, officials from the Ministry of Health and PNMC.

He said the LHC judge had acted “well beyond” the high court’s territorial jurisdiction and “in undue haste at the eleventh hour”. The top judge rebuked PTI’s Barrister Niazi, adding that he was expected to be cognisant of the Constitution and the law but also read the Supreme Court’s Nov 3 verdict which said that “no one should be allowed to, on any pretext, derail democracy. “However, one individual appears to have done just that and it is indeed a matter of considerable regret that he claims to belong to a political party.” He ordered for the PTI plea to be forwarded to the apex court to determine its maintainability, saying that the SC would hear the petition itself if it deemed it appropriate. “The petition as filed appears not to be maintainable,” the top judge observed. CJP Isa also instructed the ECP to “do its job” and issue the election schedule by tonight. The top judge also ordered that a show-cause notice be issued to PTI’s Barrister Umair Khan Niazi, seeking an explanation as to why contempt proceedings should not be initiated against him. The hearing was subsequently adjourned for an indefinite time after notices were issued to the federal and provincial

governments and the ECP petition was admitted for hearing. Earlier, ECP lawyer Sajeel Swati came on the rostrum to present his arguments. The chief justice questioned him whether a larger LHC bench was constituted to hear the matter to which the ECP counsel responded that one was formed for Monday. Coming to the petition by PTI additional secretary general Barrister Umair Khan Niazi, the chief justice questioned if elections could be halted across the whole country just on the basis of his plea. Instructing Swati to read out the apex court’s Nov 3 order which had stressed that elections would take place on Feb 8, CJP Isa said: “Shall we issue a contempt notice? … Barrister Umair Khan Niazi’s [petition] is a violation of the Supreme Court order.”

cised the PTI for needlessly involving the Supreme Court in affairs. “Their strategy is to make the elections controversial before they are held. They don’t need neutrals but PTI umpires in the elections.”

MAJOR PARTIES TO BECOME PARTY IN LHC CASE: Meanwhile, major political parties — including the PPP, PML-N and Balochistan Awami Party (BAP) — decided to become a party in the case being heard by the LHC. In a post on social media platform X (formerly Twitter) today, PML-N Central Information Secretary Marriyum Aurangzeb said the party had decided to approach the LHC to ensure the timely conduct of elections on Feb 8. “The PML-N will be a party against the LHC’s decision regarding ROs,” she wrote on X, adding that the party’s legal team had begun preparing a petition in this regard. The PPP announced that it would file a plea in the LHC seeking to become a party in the case. PPP Senator Farooq Naek expressed hope that the Supreme Court would suspend the LHC order. “Otherwise, we will present our stance on the larger bench [of the LHC] that democracy should not be derailed at any cost,” he said while speaking to Geo News. Naek said

all speculation would end if the Supreme Court suspended the LHC stay order. “Our party, Bilawal [Bhutto Zardari] and former president Asif Zardari have the same stance that polls should take place on Feb 8 at any cost,” he said, adding that the apex court, President Dr Arif Alvi and even the chief election commissioner had agreed to hold the polls. Naek said ROs and DROs fell under the authority of the ECP. He termed all that was happening as a tactic to delay the polls. “If elections don’t take place on time, it will not be good for democracy and economic stability,” he added. “Our first wish is that the judiciary gives its officers for the polls, additional session judges, session judge, and senior judges so that they become ROs and DROs.” Naek concluded that if judicial officers were not available, the bureaucracy was the second option “but our first preference is that judiciary supervises the elections”. Meanwhile, a statement from BAP’s Khalid Magsi said he had directed his party to prepare a petition seeking to become a party in the case. PTI ACCUSED OF DELAYING POLLS: Earlier, Rehman said rumours of a delay in elections had started doing the

rounds after the LHC announced its decision on the PTI petition. “Due to the order, the ECP suspended its training sessions for ROs and DRO,” she noted, alleging that PTI’s “double standards” had delayed the release of the election schedule. “Who is responsible for this?” Rehman asked. “The PTI has once again tried to derail the electoral process,” the PPP leader claimed. “This reflects their undemocratic and apolitical mindset. It is clear that the PTI does not want elections to be held in the country.” Rehman reiterated that the PPP was fully prepared for polls and expressed hope that the judiciary would resolve the matter soon. Earlier in the day, PML-N leader Ahsan Iqbal had accused the PTI of “conspiring to sabotage elections” in the country. “This proves that they can see their future, they can see defeat in polls and to save themselves from this defeat, they are trying to delay the elections,” he claimed. Iqbal demanded that elections should be held on time to bring the country out of uncertainty. He called the PTI petition in LHC a “suicide attack”, claiming that its purpose was to delay polls. “We won’t let the PTI run away from elections,” he asserted. “We urge the ECP and the Chief Justice of Pakistan to take all necessary actions needed to hold elections on time,” Iqbal added.

The LHC decision against notifying ROs has once again stirred up doubts about timely polls

HE Lahore High Court has accepted a PTI petition against the appointment of executive officers as Returning Officers for the upcoming election, but that has led to the Election Commission of Pakistan cancelling all ROs’ appointments. Those appointments are essential for an election schedule to be issued, for the very first step for a candidate is to obtain nomination forms, which are only available with the RO of his or her constituency. The LHC was silent about where the ECP was supposed to obtain substitutes, but it should be noted that ROs from the executive were used in 2018, because the respective high courts had refused to allow the ECP to use members of the subordinate judiciary as ROs. The high courts cannot be said to acting arbitrarily, because there is a clear and direct constitutional provision separating the executive and the judiciary, with the result that high courts do not allow judges to perform executive functions, such as acting as ROs. The ECP had already requested the high courts to provide judges as ROs, but this request has already been rejected. It must be noted that the PTI made no objection in 2018, when ROs were drawn from the executive after a while, when they won the election. It seems as if they are developing cold feet now that they feel the ROs and other methods will now be used against them rather than in favour. One of the issues arising is that this judgement may be used to further delay the elections. Elections should have been held by now, but it was only after arm-twisting by the Supreme Court that the ECPP gave a date of February 8. Though the other political parties have gone in appeal to the Supreme Court, the elections, whenever held, will not yield a government accepted as legitimate except by the winner. That propaganda will penetrate society, with the result that no one will accept the results except diehard supporters of the winners. Unless there is no interference, no prior determination of the result, people will not accept the results. Even then, it will take more than one election, probably three or four, free of interference, before results are trusted. HE war in Ukraine has been going on for almost two years. People are talking about the possibility of a peace deal, but fighting is still happening. In the Middle East, there’s a bitter and intense war between Hamas and Israel that has been happening for about a month. There’s also talk about Serbia getting ready for war. Back in 1998-1999, Serbia and Kosovo had a really violent war, and the USA and NATO supported Kosovo, even bombing Serbia. I hope the information I’ve heard is wrong, but I’m worried that this could lead to more conflict beyond the Balkans. In the Philippines, China has been causing trouble, and Japan is publicly saying it’ll help the Philippines defend itself by sending warships if China attacks. Japan is also working more closely with Malaysia. Meanwhile, China and India have been having an on-and-off border war. Japan told India that they’re ready to offer some support. China is going through economic difficulties, and even though some people think they have a strong navy, I don’t believe it’s as powerful as they say. Japan’s decision to challenge China, with US support, is a big change for Japan in the Western Pacific, and China might have a hard time dealing with that. China’s economic troubles are also making its government weaker. Turkey is getting involved politically in Central Asia, an area that really matters to Russia. This could lead to a dangerous situation. After Russia’s invasion of Ukraine, Moscow’s influence there rapidly declined. Nearby Azerbaijan’s effective victory in the 2020 Nagorno-Karabakh conflict, with Turkish military support, also shifted the regional balance. With Turkey’s rise as a regional power, Erdogan has moved to capitalize on these geopolitical shifts to expand Ankara’s influence in Central Asia. Recently, Turkey has been mediating peace talks between Russia and Ukraine, helping with Ukrainian grain release efforts, and assisting in a prisoner swap between the two countries. Turkey is also looking to play a bigger role in Central Asia and China, aiming to create new trade routes that don’t rely on Russia. This move is influenced by Turkey’s own energy needs and its efforts to connect culturally and economically with the region. With Russia at war with Ukraine, Turkey is strengthening its global ambitions and foreign policy goals, positioning itself as a key link between Asia, Europe, and the Middle East. This could bring new trade opportunities and better regional connectivity for Central Asian countries. Turkey’s involvement also opens up access to European and global markets for these countries and China, without relying on Russia. However, the increased use of drones by Turkey might lead to conflicts between Central Asian countries, especially Kyrgyzstan and Tajikistan. In the larger picture, Turkey is striving for more geopolitical power on the world stage. Erdogan, Turkey’s leader has stated that the country can and wants to pursue foreign policy goals that align with its own interests, rather than just those of NATO. However, it remains to be seen how successful Turkey will be in achieving these objectives. The tensions in Southeast Asia, the Balkans, Eastern Europe, the Middle East, and Central Asia don’t seem to be connected in any big way. Green and sustainable is the only possible way ahead

HE notion of sustainability has been developed in congruence with the principles of ecological balance where a stable ecosystem is created through the harmonious coexistence between a species and its environment. Similarly, sustainable development puts forward the concept of a harmonious balance in a country’s economic system through the simultaneous attainment of social, environmental, and economic gains. Growth which negatively impacts any one of the three pillars cannot be considered sustainable growth and thus cannot lead towards the creation of a Just ecosystem. As the global corridors resonate with the pledges and speeches of the world leaders made during COP28, the primary question arises as to whether the planned global green transition also checks the box of a socially sustainable transition, especially for developing nations like Pakistan. In many developed countries, a green transition is already taking place, creating jobs and economic opportunities. However, a transition on the scale necessary to combat and control climate change also carries a significant social cost in the form of losses of jobs, livelihoods, and a decrease in public and private revenues in many areas that may be considered environmentally unsustainable. Bedazzled by the promises of the green transition many of us conveniently forget about the social cost of this dynamic transition. For developing countries, the social dimension may become a key obstacle in the path towards net zero. This in no way undermines the importance of a green transition rather it opens the doors towards the more evolved and dynamic concept of Just Green transition. Developing countries like Pakistan need a “Just Green Transition’’ to simultaneously combat threats like climate change, rising food insecurity and inflation, climateflation, fossilflation, and the resultant socio-economic challenges. The International Labor Organization (ILO) defines a Just Green Transition as “greening the

economy in a way that is as fair and inclusive as possible to everyone concerned, creating decent work opportunities and leaving no one behind”. In the aftermath of COP28, we are frequently hearing and reading about why it has become critical to phase out the use of fossil fuels and carbon-intensive technologies. Although correct, this does not mean the closure of businesses since that will negate the environmental gain with the social cost. Rather the main focus of Just Green Transition is to support workers and communities affected by the phasing out of polluting activities through the creation of green jobs, training and skill development, financial support, green business facilitation, and support to Small and Medium Enterprises (SMEs) effected by the green transition. With transparent planning and the active participation of a broad range of stakeholders, governments can minimize the fear, opposition, and inter-community and generational conflict that may upend the move away from fossil fuels and other environmentally adverse activities that are warming our planet, such as deforestation and wasteful production practices. Pakistan’s banking industry can play a pivotal role by leading the country through the Just Green Transition. The banks can initiate a green revolution across all economic sectors through sustainable and climate financing. Through the provision of sustainable financing with low-interest rates, the banking industry may create a balance between the attainment of economic, environmental, and social sustainability during the green transition. The provision of green and sustainable loans for the renewable energy sector is a primary example of the Just Energy Transition. Based on the ideology of the Just Green Transition, the banking industry may provide green loans to various economic sectors including sustainable and climate-smart agriculture, the green construction industry, the sustainable textile industry, e-vehicles manufacturing and assembling, green manufacturing, and eco-tourism. the smog season in an attempt to combat air pollution. However, in line with the ideology of a Just Green Transition, The Bank of Punjab launched a Green Loan Scheme for shifting traditional brick kilns to zigzag technology. This Green and Sustainable initiative by The Bank of Punjab avoided the social cost that was being created by shutting down a primary economic sector and in turn developed a green and sustainable economic sector. Similarly, under the ideology of Sustainable, Green and Clean Pakistan, The Bank of Punjab has launched several different Green and Sustainable Loan Schemes like Shamsi Tawanai, e-Business Qarza, Women Entrepreneurs, Special Persons, and Storage of Agricultural Produce. Such green and xustainable financing by the banking industry will result in the creation of a robust green job market in Pakistan that will positively contribute to the sustainable development of the country. It is pertinent to note that a Just Green Transition will not just help advance climate action in Pakistan but also play an important role in the attainment of the United Nations Sustainable Development Goals (UN-SDGs) 2030. Through the creation of green economic sectors and connected green jobs, UN-SDGs related to affordable and clean energy, decent work and economic growth, reduced inequalities, and responsible production and consumption may be met. A Just Green Transition will enable Pakistan to combat the many forms of inflation plaguing the country’s economy including food inflation, climateflation, and fossilflation. Just Green transition is a vision that is impossible to achieve without the holistic collaboration between all the concerned stakeholders of society, meaningful public-private partnerships, and a cognitive shift towards environmental consciousness within the society. Let us start by applying the concept of Climate Justice to our internal policymaking before asking for it from the outside world. It is the responsibility of the concerned stakeholders to strategically plan and execute a green transition that leaves no one behind and creates vibrant horizons for inclusive economic growth in Pakistan.

Why are the Japanese talking tough at the same time as the Palestinians and Israelis are at war, and the Balkan states are on edge? It’s not just that there are war situations; it’s that they’re happening at the same time. The USA might be part of this complicated situation. Today is the 52nd anniversary of the Fall of Dhaka

AST Pakistan, the eastern wing of the country, died on 16 December 1971 at the Paltan Maidan in Dacca (now spelled as Dhaka). On its debris emerged a new country, Bangladesh, as a result of big conspiracy and naked aggression by India in the garb of the Mukti Bahini patronized by the neighbouring country through Shaikh Mujibur Rehman. It was on this day, perhaps the darkest day in the history of Pakistan so far and also for future, that the then Commander Eastern Command, Lt Gen A.A.K. Niazi, had surrendered before the Indian Army’s Lt Gen Jagjit Singh Aurora at a ceremony, symbolically laying down his pistol. The very presence of the Indian general established the bitter fact that it was India and none else which had caused the separation of East Pakistan from West Pakistan and breaking the country which had emerged on the world map only on 14 August 1947 out of nowhere and which was hardly 24 years old. The factors responsible for this great tragedy are yet to be identified and the guilty ones have not been punished, despite being so named in the comprehensive Report of the Commission of Inquiry headed by the then Chief Justice of Pakistan, Mr Justice Hamoodur Rehman. The three member Commission of Inquiry was constituted by Zulfikar Ali Bhutto who had become the President as well as the first-ever Civilian Chief Martial Law Administrator at the Fall of Dacca and the stepping down of then President/CMLA/Commander-in-Chief General Agha Muhammad Yahya Khan, handing him over the remainder of Pakistan which was founded by Quaid-i-Azam Muhammad Ali Jinnah through the struggle of the Muslims under his inspiring leadership for a separate homeland of their own. For refreshing the memory of the readers, it is men-

tioned here that the other two members of the Commission of Inquiry were Justice S. Anwarul Haq, a judge of the Supreme Court of Pakistan and Justice Tufail Ali, Chief Justice of the Sindh and Balochistan High Court. Even 52 years after the Great Tragedy as a consequence of the shameful Fall of Dacca, those named in the Hamoodur Rehman Commission Report, submitted in two parts, have not been named as such so far, what to talk about those who had caused the dismemberment of Pakistan being tried and punished in any manner whatsoever. The Commission’s Report itself has not been made public in full so far as it contained the names of many sacred cows. The respect and reputation of a number of army generals and senior army officers is perhaps as much more superior, protected and safeguarded than the Motherland itself. The duly censored part of the Hamoodur Rehman Commission was made public many years back without the names of those found guilty and as such did not offer a true and full picture of the dirtiest episode ever enacted, at least as viewed by the three senior most judges of the Superior Courts. The Fall of Dacca had occurred when a military dictator was at the helm of national affairs. As a matter of sheer coincidence another military dictator was at the helm of affairs in 2006 as the President / Chairman Joint Chiefs of Staff Committee/ Chief of Army Staff General Pervez Musharraf, who was on record to have advised the people of Pakistan to forget the 16 December 1971 great tragedy. And most unfortunately, a turn around over the Kashmir issue was then also seemed to be on record. The then Commander of the Eastern Command was on record to have said that he had surrendered before the Indian Army General on the orders of the General Headquarters (GHQ) in Islamabad. He had thus written a new

chapter of the greatest ever surrender by about 90,000 Pakistanis, most of which were the army officers and jawans. The burning question that still irks the mind of this scribe and must also be disturbing millions others who were witness to the Great Tragedy from close or distant angles is whether those who were forced to surrender before the enemy could not lay down their lives in the defence of the sacred soil of the Motherland, No doubt the Commander Eastern Command had surrendered before the Indian Army General on a green signal from the GHQ and the army officers and jawans were bound to follow the command. But the circumstances which prevailed then were certainly not ordinary,

Biden’s rising tension with Israel

It isn’t Mr. Biden’s place to pick Israel’s leaders. Instead, he could try listening to Israelis about the risks of empowering a Palestinian Authority (PA) that has refused to condemn the Hamas massacre

RESIDENT Biden made headlines by declaring that Israeli Prime Minister Benjamin Netanyahu “has to change.” As is typical with the President, his subsequent remarks were hard to follow, but many heard them as a call for a new Israeli government coalition willing to jump-start a two-state solution. It isn’t Mr. Biden’s place to pick Israel’s leaders. Instead, he could try listening to Israelis about the risks of empowering a Palestinian Authority (PA) that has refused to condemn the Hamas massacre. Or he could listen to Palestinians, 72% of whom believe Hamas was right to launch its Oct. 7 attack, according to a new poll by the Palestinian Center for Policy and Survey Research. That figure rises to 82% among West Bank Palestinians, who are ruled by the PA, not Hamas. Mohammad Shtayyeh, the prime minister of the PA, said Sunday that “Hamas is an integral part of the Palestinian mosaic.” The problem is that this is true. That’s why no one in his right mind in Israel thinks of creating a Palestinian state today. Hamas doesn’t want a two-state solution; it wants the final solution. Israelis are focused on defeating Hamas, a goal the U.S. shares. Mr. Biden was right to say Tuesday that “nobody on God’s green Earth can justify what Hamas did. They’re a brutal, ugly, inhumane people, and they have to be eliminated.” He was also right to stand up for Israel at the United Nations, where the international herd demands a cease-fire. Israel fights on because it has no other choice if it wants to survive as a state. But many nations see these U.N. votes as consequence-free gestures for peace or solidarity. That a cease-fire now would mean a Hamas victory and the death of Israeli deterrence, bringing on the next massacre and the next war, doesn’t concern them. Israelis know Mr. Biden is under pressure from the

Democratic Party left to stop Israel’s Gaza operation, and they are making sacrifices to satisfy him. U.S. Secretary of State Antony Blinken insisted that the Israeli campaign “we saw in northern Gaza not be repeated in the south,” and Israel has complied. It is now telegraphing its attacks to the enemy so civilians can flee, and it is using a smaller force with less reliance on air power and artillery. As a result, Israel is taking more casualties. Ten soldiers were killed Tuesday. That follows five Monday and seven Sunday for a total of 445, including Oct. 7. The rising fatality rate is noticed in Israel, if nowhere else. In a video making the rounds, an infantry officer protests in Hebrew: “How can it be that an area isn’t cleared from the air before allowing our soldiers to enter?” Israel did that earlier in the war, he says, but now “our fire power is being restrained because our leaders may have started prioritizing the enemy’s lives over the lives of our soldiers.” A petition by soldiers’ mothers makes a similar point. Israel gets little credit for its sacrifices. Mr. Biden even criticized it Tuesday for “indiscriminate bombing,” a slander so belied by the evidence that the White House tried to walk it back. Civilian casualties in Gaza are tragic, but they are mainly a result of Hamas’s way of embedding in what should be safe civilian spaces. The U.S. military also couldn’t avoid civilian casualties against ISIS in Mosul, Iraq, or other post-9/11 engagements. The U.S. doesn’t bomb indiscriminately either. Facilitating the transfer of fuel and aid to Gaza also hasn’t stopped U.S. criticism. On Oct. 18 Mr. Biden said, “If Hamas diverts or steals the assistance, they will have demonstrated once again that they have no concern for the welfare of the Palestinian people, and it will end.” Really? Hamas theft, some of it caught on video, is so blatant and pervasive that Gazans denounce it publicly. Still, Israel keeps aid flowing, and the U.S. has pressured it to open another crossing to let in even more. Israel has no good choices here, but America does. The President can focus on supporting a U.S. ally in vanquishing a genocidal enemy.

Take exemplary action against MP, House staﬀ TRIBUNE

ESS than three months after hosting its first House session, the new Parliament complex witnessed a major security breach when two intruders jumped into the Lok Sabha hall from the visitors’ gallery and opened smoke canisters. Even more shocking was their audacity to cause chaos in the House on the 22nd anniversary of the 2001 Parliament terror attack, which had claimed the lives of nine securitymen and staff. The Lok Sabha Secretariat has suspended eight security personnel for lapses, even as a probe has been initiated on the orders of the Ministry of Home Affairs. The intruders and their accomplices have been arrested and booked under the antiterror law UAPA (Unlawful Activities Prevention Act). The incident has glaringly exposed the vulnerability of the parliamentary security system, which needs to be dismantled and replaced with a professional force. The intruders had

gained access to the gallery through visitor passes arranged by BJP MP Pratap Simha. Parliamentarians invariably entertain requests for such passes from members of their constituencies. As per the Parliament rulebook, the MP has to certify that ‘the visitor is my relation/personal friend/known to me personally and I take full responsibility for her/him’. It is apparent that due diligence was not exercised by the MP and his personal staff while processing applications. That the duo managed to sneak in smoke canisters shows criminal laxity. The security gaps, if not plugged at the earliest, can be exploited by terror groups and other antiIndia elements — to the detriment of national security. The entry of visitors needs to be tightly regulated, even as all MPs and their staff must closely scrutinise every application they receive. There should be zero tolerance to any lawmaker’s irresponsible conduct that imperils Parliament’s physical or digital security. Trinamool Congress MP Mahua Moitra was recently expelled from the Lok Sabha for sharing her parliamentary login with an unauthorised person. Exemplary action should be taken against Simha as well.

They were Genl Agha Muhammad Yahya Khan, Gen Abdul Hamid Khan, Lt Gen S.G.M.M. Pirzada, Major Gen A.O. Mitha, Lt Gen Irshad Ahmad Khan, Maj Gen Abid Zahid, Maj Gen B.M. Mustafa, Lt Gen Amir Abdullah Khan Niazi, Major Gen Muhammad Jamshed, Major Gen M. Rahim Khan, Brig G.M. Baquir Siddiqui, Brig Muhammad Hayat, Brig Muhammad Niazi, Cdr Gul Zareen of Pakistan Navy, Brig S.A.Ansari, Brig Manzoor Ahmad, Brig Abdul Qadir Khan, to mention only the senior officers. This week’s antitrust victory for Epic Games may disrupt two lucrative digital outlets

California jury did not have much time for Google this week. After a four-week trial, it took less than four hours to decide that the company had broken antitrust laws to make billions from its Google Play app store. “I just think they need a refresher on integrity a little bit there,” one juror later reflected. The verdict in the federal trial is a nasty setback for what have become moneymaking machines. When Apple launched the first app store for the iPhone 15 years ago, it created a new kind of retail outlet for software, not only virtual but much more profitable than a supermarket. Courts and antitrust regulators are discovering how rewarding that innovation is. The man who keeps telling them is Tim Sweeney, chief executive of Epic Games, the developer behind the game Fortnite. Epic lost a similar case against Apple in 2021, when a judge largely ruled for Apple, despite accepting that it makes “extraordinarily high” profits from its app store. Epic’s victory this week vindicates Sweeney’s persistence. The fact that iPhone users must download apps solely from Apple’s store, while 90 per cent of apps on Android phones are downloaded through Google Play, has given both companies great power. That is now in question, although Google is appealing: “The verdict knocks a big hole in the wall of the walled garden,” says Mark Lemley, a law professor at Stanford University. Mark Zuckerberg, chief executive of Meta (which has its own virtual reality headset app store) once mused that Twitter’s founders “drove a clown car into a gold mine and fell in”. Steve Jobs drove a Mercedes-Benz but there was an equally accidental quality to how Apple came up with its original pricing policy of charging developers a 30 per cent fee to sell apps in its store. The idea of a software app was then novel, since the iPhone had only been launched the previous year, and it did not appear outrageous for Apple to levy a charge similar to sales margins in physical stores. Walmart, for example, has made

a 24 per cent gross profit this year on the products it sells in its supermarkets, despite being known for offering “everyday low prices”. Apple’s lead was followed by Android Market, which later became Google Play. Apple hails its store for making it easier and cheaper for developers to sell software and it has no limits on shelf space in the way supermarkets do. Developers can put their free apps on display at no cost (they pay Apple a $99 annual fee) and are charged only for selling the paid ones. So far, so reasonable. But there is a big difference between app stores and physical supermarkets: the latter must build and run stores and distribution hubs, employ checkout staff and shelf stackers, advertise widely and so on. After all these costs are accounted for, their margins often descend to single digits: Walmart’s operating margin this year is about 4 per cent. It is easier for app stores. They cost much less to operate and those with the market power that Apple and Google possess keep on generating more cash as more apps appear. There are 1.8mn apps in Apple’s store and, although more than 80 per cent of those are free, the judge in the 2021 case agreed with an estimate that its operating margin exceeds 70 per cent. Apart from being many times more profitable than Walmart, app stores have another advantage. It is easy for shoppers to switch supermarkets if one charges more than another, but it is awkward to move from an iPhone to an Android one if an app is too expensive. Google Play faces some app store competition on Android, but Apple stands alone with iOS. So be it, the Apple case judge ruled: its app store is very successful but “success is not illegal”. Google was less fortunate this week. The jury was unimpressed by its having offered some developers financial incentives to stick with Google Play, rather than defect to other app stores. It made itself legally vulnerable by trying to curb competition and maintain its grip (as well as by automatically deleting some internal messages). One of Google’s difficulties was having to make its case to a jury, rather than solely to a judge: however elegant one’s legal arguments, making so much money is never a good look. Google and Apple have acknowledged that tacitly by cutting fees for small developers. The original 30 per cent has been eroded: nearly all developers of Google Play apps pay 15 per cent or less. Google also had a feisty opponent in Sweeney, which was its own doing. Games apps account for more than 70 per cent of app store revenues, much of that coming through in-app payments for virtual goods and add-ons. If you are in a delicate position in antitrust law, placing the fee burden so heavily on developers of virtual worlds such as Fortnite is perilous. The ultimate issue is financial: Apple could not have known that its invention would work so well, but it and Google have come to operate two of the most profitable stores in history. No matter how they found the gold mine, they run it now.

The BJP manifesto advocated for the abrogation of Article 370 and Article 35A, signalling a proactive stance towards addressing historical grievances. This approach is seen as a departure from Nehru’s reluctance to annex Kashmir forcefully, contrasting with the more assertive integration of other princely states. The Modi government stated in a written reply in Parliament in 2015 that there was no intention to revoke Article 370. However, on August 5, it was abrogated. Now, on December 11, the same strategic move is being perceived as a bid to secure victory in the 2024 elections, aligning with the party’s dominant pro-Hindu stance. Now come along as we dig into the historical foundations of Kashmir. In 1947, the inception of Article 370 traces back to the signing of the Instrument of Accession by Maharaja Hari Singh, marking Jammu and Kashmir’s alignment with India under specific conditions. This pivotal document served as the gateway for the state’s integration into India, albeit with distinctive privileges. Under the umbrella of Article 370, Jammu and Kashmir enjoyed special privileges that restricted the authority of the Indian Parliament to legislate on defense, external affairs, and communication. This unique provision empowered the state legislature of Jammu and Kashmir to enact laws specifically tailored for its populace. Notably, the legislative authority of the Indian Parliament in Jammu and Kashmir was confined to matters explicitly outlined in the Instrument of Accession. Approval from the Jammu and Kashmir Constituent Assembly was imperative for the enactment of laws on other subjects. On August 5, 2019, President Ram Nath Kovind shook things up by issuing C.O. 272, tweaking Article 367 and altering the interpretation of Article 370. This move allowed the Union to amend Article 370 sans the

Constituent Assembly’s nod, a game-changer for Jammu and Kashmir’s special status. With the state under President’s Rule, the Union Parliament swiftly recommended Article 370’s abrogation through a Statutory Resolution on the same day. On August 6, 2019, President Kovind made it official with C.O. 273, nullifying all Article 370 clauses except clause 1, effectively ending Jammu and Kashmir’s special status. A legal challenge hit the scene on August 6, and by August 9, 2019, the Union Parliament sealed the deal with the Jammu and Kashmir Reorganisation Act, 2019 Chief Justice D.Y. Chandrachud led the five-member bench, asserting that Article 370 was considered an interim arrangement during war conditions, and the Constituent Assembly of Jammu and Kashmir was never intended to be a permanent body. The court deemed the 2019 declaration a valid exercise of power, stating that Kashmir lost its sovereignty upon joining India. Furthermore, the court upheld the reorganization of Ladakh as a union territory and directed the election commission to conduct legislative assembly elections in Kashmir by September 30, 2024. The court misunderstood and concealed the reality concerning Article 370. A new question arises if Article 370 was intended to be temporary, why did Maharaja and Sheikh Abdullah advocate for their own flag and sovereignty? What was the purpose of signing the Instrument of Accession, only to later contemplate its abrogation? It appears that the demand for a separate flag and other symbolic elements wasn’t merely for temporary satisfaction but rather an assertion of Kashmiri identity. Hence modi not to deceive the people by suggesting that Article 370 was inevitably fated to be abrogated. Instead, the argument is centered on the interpretation of the Constitution. The discussions around autonomy, symbols, and the Instrument of Accession raise questions about the original intent and how it aligns with subsequent decision Now we have to recall the words spoken by Sheikh Abdullah. Constituent assembly 11 august 1952, “Here I would like to point out that the fact that Article 370 has been mentioned as [a] temporary provision in the Constitution does not mean that it is capable of being abrogated, modified, or replaced unilaterally. In actual effect, the temporary nature of this Article arises merely from the fact that the power to finalize the Constitutional relationship between the State and the Union of India has been specifically vested in the Jammu and Kashmir Constituent Assembly. It follows that whatever modifications, amendments, or exceptions that may be-

come necessary either to Article 370 or any other Article in the Constitution of India in their application to the Jammu and Kashmir State are subject to decisions of this Sovereign body.” Sheikh Abdullah’s stance found support from the Supreme Court of India in the Sampat Prakash case, where it rejected the characterization of Article 370 as a temporary provision. The five-judge bench argued that Article 370, governing the Government of Jammu and Kashmir, has consistently remained operative and has not ceased to be in effect. Another perspective contended that its temporariness was contingent upon a plebiscite to ascertain the people’s wishes. In addition, the focus shifts to the Keshvanand Bharti judgment, which established that certain aspects of the Constitution, termed “basic features,” are immune to alteration through constitutional amendments. However, a significant shift in interpretation occurred, challenging this precedent. The Supreme Court, as the authoritative interpreter of the Constitution, clarified that its jurisdiction extends to interpreting the language employed in the Constitution. Decisions made under Article 141 are considered legally binding. When examining the term “life” in Article 21, the Court determined that it encompasses the notion of “living with human dignity.” Furthermore, the Court recognized the implicit protection of the right to privacy under Article 21. Contrary to the previous interpretation, the Court asserted that the term “temporary” in the heading of Chapter XXI doesn’t inherently imply a fleeting nature. Instead, any temporary provision may be labeled as “special.” The addition of the term “special” in the chapter heading resulted from the 13th constitutional amendment in 1962. Sardar Patel himself acknowledged in the Constituent Assembly that a “special provision” had been established for Kashmir due to the unique relationship between the central government and the state. Global coal use at all time high in 2023 – IEA PROFIT

Global coal use is expected to reach a record high in 2023 as demand in emerging and developing economies remains strong, the International Energy Agency (IEA) said in a report on Friday. Demand for coal is seen rising 1.4% in 2023, surpassing 8.5 billion metric tons for the first time as usage in India is expected to grow 8% and that in China is seen up 5% due to rising electricity demand and weak hydropower output, the IEA said. In the European Union and United States, however, coal use is set to drop by around 20% each in 2023, the report said. Coal use is not expected to decline until 2026, when the major expansion of renewable capacity in the next three years should help lower usage by 2.3% compared to 2023 levels, even with the absence or stronger clean energy policies. However, global consumption is forecast to remain well over 8 billion metric tons in 2026, the report said. To reach goals set by the Paris Agreement, the use of unabated coal would need to fall significantly faster, it added. China is expected to account for more than half of the global renewable expansion over the next three years, causing coal demand in the country to fall in 2024 and plateau through 2026, the IEA said. Half of the world’s coal use comes from China, so the outlook for coal will be significantly affected in the coming years by the pace of clean energy deployment, weather conditions, and structural shifts in the Chinese economy, the report said. This year, China, India and southeast Asia are expected to account for three-quarters of global coal consumption, up from a quarter in 1990, with consumption in southeast Asia expected to eclipse the U.S. and EU in 2023, the report said. Through 2026, India and southeast Asia are the only regions where coal consumption is expected to grow significantly, the report said.

After the crew found one of the migrant boat’s buoyancy tubes “deflated” and people “in the water”, they brought everyone they could find back to Calais.

China on Friday reported a number of economic indicators for November, with industrial output expanding at a better-than-expected 6.6 percent, also the fastest in almost two years, and retail sales also gaining a jumbo 10.1 percent year-onyear, according to data from the National Bureau of Statistics (NBS). Observers and officials said the raft of upbeat data, while factoring in a low base effect, arguably offers a fresh sign underscoring that the world’s second-largest economy has been sustaining “continued recovery and progressing for the better,” as macro policies yield more results and the country unswervingly addresses multiple challenges head-on – ranging from geopolitical tensions and insufficient domestic demand to a slowing property sector. To date, China has released major eco-

nomic figures for the first 11 months. Based on the clearly-painted economic map, observers said “without any doubt” China could achieve its pre-set annual GDP goal of around 5 percent this year and continue serving as a locomotive for the global economy. The reading on Friday also marks the first key economic data released after the tone-setting Central Economic Work Conference (CEWC), which analysts believe would give new clues for Chinese policymakers to fine-tune more targeted measures next year. If those policies kick in on time, it is likely that economic recovery will continue running at full swing in 2024, and GDP could expand above 5 percent, dismissing Western pessimism over the Chinese economic outlook, economists said. The 6.6-percent growth in industrial output in November beat market expectations of 5.6 percent, and is also the highest pace since February 2022, according to media reports. HE textile industry has raised alarms about the potential loss of major markets in the United States and Europe in response to the government’s consideration of imposing high wheeling charges for electricity under a new Competitive Trading Bilateral Contract Market (CTBCM) system. Wheeling charges are fees paid for using the national grid’s transmission and distribution network, which have become a focal point of contention. The government’s plan to introduce the CTBCM system allows power producers and consumers to bypass the state-owned Central Power Purchase

Agency (CPPA). The CPPA and power distribution companies (DISCOs) have proposed wheeling charges at Rs27 per unit, a move contested by the All Pakistan Textile Mills Association (APTMA). The APTMA, in a letter to the caretaker Finance Minister Dr Shamshad Akhtar, argued that these charges would render the CTBCM system unviable. According to the APTMA, the proposed charges are unrealistic and absurd, potentially making exports to the USA and EU countries economically unfeasible. The association emphasized the importance of competitive wheeling charges to maintain exports and cited examples from regional economies like Bangladesh, India, and Vietnam, where charges are significantly lower.

The APTMA also highlighted the impact of previous tariff changes, noting that a tariff increase from 9 cents per unit to 14 cents per unit had led to a decline in power consumption by textile and apparel firms. This, in turn, resulted in substantial losses for the power sector. The letter stressed the adverse effects of high tariffs, stating that they have priced export firms out of international markets, leading to decreased industrial production and electricity consumption. Addressing the annual meeting of the Agricultural Credit Advisory Committee (ACAC) in Lahore on Thursday the State Bank of Pakistan (SBP) Governor Jameel Ahmad called on the banking sector to increase its outreach and penetration to the agriculture sector, which is vital for the country’s socioeconomic development. He emphasized the need to strengthen and promote growth in the agriculture sector, which is pivotal for the socioeconomic development of the country. He urged the banks to ensure easy, timely, and hassle-free access for farmers to all financial services, including credit, deposits, payments, etc. The governor highlighted that despite various challenges, including floods, the agriculture credit disbursements reached an impressive level of Rs1,776 billion during FY23, witnessing year-on-year growth of 25.2% and achieving 97.6% of the overall target of Rs1,819 billion. He commended the concerted efforts of banks, specialized banks, microfinance banks, and microfinance institutions that led to these

achievements, showcasing the sector’s strength and adaptability in the face of challenges. He also showed optimism about the strong recovery in the agriculture sector, paving the way for a projected real GDP growth in the range of 2 – 3% in FY24. He said that the disbursement target for FY24 was accordingly set at Rs2,250 billion, which was 26.7% higher than the disbursement made last year. The stellar growth of 30% during July-Oct 23 gives optimism that we are on track to comfortably achieve the disbursement target, he added. He urged the banks to intensify their efforts to not only meet but also surpass the target. Acknowledging the challenges, particularly attrition of borrowers, the governor informed the ACAC that SBP would engage with each bank individually to develop plans and strategies to achieve a sustainable increase in agri borrowers continuously. He advised banks to not only develop their own agrifinance capacity but also develop partnerships with Microfinance Institutions (MFIs) to increase the outreach of agriculture and rural finance services. He also emphasized the critical need to improve the productivity of farmers to make them a better risk for the banks. He urged banks to collaborate and partner with agritechs, agricultural universities, provincial agricultural departments, and other stakeholders to improve the farmers’ productivity through the provision of quality inputs, better farming techniques,

and optimum use of agri-tech. The small farmers also need to be facilitated in the sale of their produce to enable them to fetch market-competitive prices for their produce, and the banks can connect them with large and reputed buyers, he added. The SBP governor highlighted another significant area requiring immediate consideration – the promotion of developmental loans, specifically directed toward the mechanization of the agriculture sector. He also advised the banks to assess the feasibility of financing agri-service providers, who provide agricultural machinery and equipment to farmers on a rental basis. While recognizing Pakistan’s vulnerability to climate change, the governor mentioned SBP’s green initiatives, including the Environmental & Social Risk Management Implementation Manual, Financing Scheme for Renewable Energy and Green Banking Guidelines. He called on the banking industry to proactively address climate change through risk mitigation tools, insurance schemes, and collaboration with international donor agencies to address challenges arising out of climate change. Envisioning an end-to-end automated agricultural financing ecosystem, the Governor highlighted the transformative power of digital solutions in streamlining and enhancing the efficiency of processes, particularly in the agricultural lending domain.

HREE policemen embraced martyrdom and five terrorists were killed during an attack on Police Lines in KhyberPakhtunkhwa’s Tank City on Friday, the army’s media wing said. According to the Inter-Services Public Relations (ISPR), five terrorists including a suicide bomber attempted an attack but were “offered stiff resistance by brave policemen”. “Security forces in the vicinity were immediately mobilised to support the police force and in the ensuing operation,” the statement said. “All five terrorists were sent to hell.” The ISPR said that the effective response of policemen was a testament to “their unrelenting resolve in the fight against terrorism”. “However, during an

intense fire exchange with the terrorists, three brave policemen, having fought gallantly, embraced shahadat (martyrdom),” the ISPR added. It said that the country’s security forces “stood shoulder-to-shoulder” with other law enforcement agencies to ensure peace and stability in the country. Meanwhile, Tank District Police Officer Iftikhar Ali Shah also confirmed the casualties, saying a sub-inspector was among those killed. The DPO informed that one of several militants first exploded himself at the main entrance of a police office and residence block and the others stormed in. “Our force on guard engaged them in a gun battle for hours,” DPO Shah said. SHC rejects Manzoor Kaka’s plea seeking removal of name from ECL KARACHI

The Sindh High Court (SHC) has dismissed plea of former DG Sindh Building Control Authority (SBCA) Manzoor Qadir Kaka, seeking the removal of his name from the Exit Control List (ECL) in the Nasla Tower case. Kaka moved SHC for the removal of his name from the ECL in Nasla Tower Case. The plea stated that a case was registered when he was abroad. Citing continued appearances before the relevant court, Kaka pleaded with the SHC to order relevant authorities to strike down his name from ECL. The SHC dismissing the plea of Manzoor Qadir Kaka, asked him to contact the relevant court. The court had earlier declared four accused including former DG SBCA Manzoor Qadir Kaka as proclaimed offenders. Khair Mohammad and Islam Ahmed were among other absconders. Overall, 23 accused including Manzoor Qadir Kaka were nominated in the case. The accused allegedly provided 262 square yards of state land to the Nasla Tower project. After returning to Pakistan, Kaka was rounded up, but he later secured bail from the Sindh High Court.

The Lahore High Court (LHC) on Friday issued notices to the Deputy Commissioner and police on a petition challenging the detention of PTI Senior Vice President Sher Afzal Marwat under the Maintenance of Public Order (MPO). Marwat was arrested from outside the LHC on Thursday, when he was leaving the high court premises after addressing a lawyers convention. Footage of his arrest shared by the PTI on X (formerly Twitter) had shown policemen dragging him by the collar as several lawyers tried to stop them. He was later moved to Mozang police station from where, he was later, taken to Kot Lakhpat Jail. The police, later, informed that Sher Afzal Marwat had been arrested under the 3 MPO order. The law empowers the police to detain a person considered “prejudicial to public safety or the maintenance of public order”. The arrest was strongly criticised by PTI leaders and lawyers’ bodies. A statement shared on the party’s official X account held the caretaker government responsible for “acting as a facilitator” during the “unabated lawlessness”. On friday, Marwat’s brother filed a petition in the LHC seeking the quashing of the PTI leader’s detention orders. He urged the court to declare the arrest “illegal, maliciously motivated, void ab initio and non-est”. The petitioner has made Lahore deputy commissioner, superintendent central jail, Punjab Inspector General of Police, Lahore capital city police officer,

DIG operations, DIG investigations, Civil Lines SP, district intelligence and the Mozang Police SHO as respondents in the case. The application stated that the government had detained Marwat as a “political vendetta”. It also demanded that Marwat be released till the disposal of the petition. The petition stated that Sher Afzal Marwat’s arrest was made on political grounds and the PTI leader was not involved in any “illegal activity”. The lawyer pleaded with the court to declare his client’s detention “null and void” and issue Marwat’s release orders. Justice Masood will take oath as Acting Chief Justice of Pakistan Saturday and he will perform the duties of Acting CJP for two weeks.

In a fresh development in the controversial “illegal marriage” case, former Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan has been summoned to appear before the District and Sessions Court Islamabad on December 18. Senior Civil Judge Qudratullah, in a one-page written order, granted Bushra Bibi, Khan’s wife, exemption from attending the upcoming hearing. However, to ensure her future presence, she must deposit a personal security bond of Rs 50,000. The order further directed the Superintendent of Adiala Jail, where Khan is currently incarcerated, to facilitate his participation in the hearing. Due to tech-

nical limitations, Khan’s earlier request to attend via Skype was denied. The jail authorities are now responsible for ensuring his physical presence at the next hearing. Judge Qudratullah also confirmed that copies of the complaint and all relevant documents have been provided to both parties. The case pertains to allegations that Khan and Bushra Bibi married during her “Iddat” period, a waiting period mandated in Islamic law after divorce or death of a spouse. LHC issues notices to ECP on plea against Imran’s disqualification in Toshakhana Case LAHORE

The Lahore High Court (LHC) on Friday issued notices to the Election Commission of Pakistan (ECP) and other respondents on a plea filed Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan against his disqualification in Toshakhana case. The court also raised questions about its jurisdiction in the matter. A five-member larger bench, led by Justice Shahid Bilal Hassan, heard the petition filed by Khan against his disqualification in the Toshakhana reference. Barrister Ali Zafar, representing Khan, argued that the ECP’s decision was illegal and violated his rights. At the outset of the hearing, the court expressed concerns about its jurisdiction and stated that it would need to address this issue before proceeding with the case itself. The court inquired about the ECP’s legal representation, only to be informed that their lawyers were currently on leave. Considering this, the court opted to postpone the hearing until the ECP could send counsel. According to sources, caretaker Interior Minister Sarfraz Ahmed Bugti has tendered resignation as country’s interim interior minister on December 13. Sources claimed that Caretaker Prime Minister Anwaarul Haq Kakar has accepted the resignation on Friday. Bugti resignation came as he decided to join Pakistan Muslim League-Nawaz (PML-N) ahead of general elections 2024. More resignations from the incumbent caretaker cabinet are possible to become eligible in the forthcoming election, scheduled for Feb 8, 2024. The Pakistan Supreme Court also issued a contempt of court notice to Barrister Umair Niazi – who filed the petition on behalf of Pakistan Tehreek-e-Insaf (PTI) – seeking the appointment of ROs and DROs from judiciary, not the executive. GENERAL ELECTIONS: The Election Commission of Pakistan (ECP) had notified general elections on February 8, 2024. According to details, the Election Commission issued a notification of the date of the general election under Section 57 of the Election Act‫ ۔‬The notification said that in light of the Supreme Court’s order, the general elections will take place on February 8, 2024.

Work on power tariﬀ cut to be completed by next month: Caretaker Energy Minister PROFIT

Caretaker Energy Minister Muhammad Ali on Friday said that the power division is working hard to reduce the electricity tariff and the work on power tariff reduction will be completed by next month. Muhmmad Ali made this disclosure during a meeting of the Senate Standing Committee on Power which was held under the chairmanship of Senator Azam Nazir Tarar. Speaking on the occasion, the caretaker Federal Energy Minister Muhammad Ali stated the committee that Federal Energy Minister Muhammad Ali informed the committee that the agreements inked in the past were made in dollars and we will have to move forward with them while there is no point in talking about past the mistakes. He said we should have to adopt a strategy for improvement while considering these contracts. He said our industries cannot compete with the world according to the current rate of electricity. He said our textile industries have

got 20 to 30 percent more orders which is good and we need to reduce the power cost, capacity payments while transmission lines also need more attention. He said efforts are being made to reduce the stock of circular debt. He said demand for electricity will increase if electricity rates are decreased. He said that the tariff system should have to be made more effective while subsidies have to be removed and legal changes have to be made in this regard. He said private sector experts have to be included in this system. He said that there is a need to pay attention to the management of power distribution companies (DISCOs). There are problems for the industry on the current electricity rates, the electricity rates for industry in Pakistan are up to 16 cents while in other countries these rates are up to 9 cents, said Caretaker Energy Minister Muhammad Ali. The Standing Committee was also briefed in detail about the working procedures and performance of the Power Division. The committee was told that the work was being done under the rules of business.

Power Division has 7 wings and number of sanctioned posts is 183. With a budget of 485 million, there are total 102 development projects out of which 66 are ongoing and 36 are new projects. Officials of power division while briefing the Senate Standing Committee on Power informed that there are 12 organizations working under the Power Division. The committee was informed that there is an installed capacity of about 45,000 MW, of which 28percent is from hydro, 16pc from coal, 11% from gas, 17% from RLNG, 19% from nuclear, 1% from coal and 1% power generation is with solar source. Responding to the question of the Chairman Committee, power division’s officilas informed that power is being generated according to the demand of electricity and 12400 Megawatt (MW) of electricity is being generated on an average during the winter season and the effective operational capacity is about 23000 MW. Senate Standing Committee on Power was also informed that the circular debt doubled in the year 2018 and stood at Rs

450 billion while it increased by Rs 560 bln in 2019 and Rs 538 bln in 2020. It was also informed to the senate committee that efforts will be made to maintain the circular debt up to Rs 2310 billion in 2023-24. Steps are being taken to use future technology, said officials of power division. The officials of power division further told the Senate Committee on Power that under the new policy, there will be no capacity charges, as only energy generation charges will be the part of power tariff. World’s best solar system will be established in the Balochistan province, said Power Division’s officials. Senator Bahramand Khan Tangi said that if electricity is generated through hydro-solar and wind, then circular debts can be got rid of. Senator Saifullah Sarwar Khan Niazi said that there is a need to adopt a better and workable policy regarding solar in the country, which can bring improvement in the system. Senator Dilawar Khan said that new agreements should be made in Pakistani currency instead of dollars.

We should examine the system of neighboring countries to improve our system. The Senate Committee was informed that recovery of Rs 52 billion has been made till December 2023, while 35,000 people were arrested, 63,000 cases of power theft registered while Rs113 billion are to be obtained from the provincial governments.
