A special court on Friday rejected the postarrest bail petition of Pakistan Tehreek-e-Insaf (PTI) Vice Chairman Shah Mehmood Qureshi in cypher case The Special Court has been established to hear cases registered under the Official Secrets Act Special Court Judge Abul Hasanat Zulqarnain announced the verdict reserved earlier According to the verdict the court dismissed the bail plea of Shah Mehmood Qureshi primarily to his absence during the proceedings The court also rejected another plea Qureshi had filed through his counsel Ali Bukhari, seeking exemption from in person appearance in the court Bukhari had filed applications on behalf of Qureshi seeking exemption from attending court proceedings and requesting the summoning of Shah Mehmood Qureshi for the case

T H E A R R E S T: On August 19, the Federal Investigation Agency (FIA) arrested Mr Qureshi from his residence in Islamabad on Saturday and booked him under the Official Secrets Act 1923 in a case pertaining to a diplomatic cypher According to the FIR the case was registered against PTI Chairman Imran Khan and Qureshi on August 15 over the alleged misplacement of a diplomatic cable from the US under sections 5 and 9 of the Official Secrets Act 1923 read with Section 34 of the PPC

He ordered that Ch Pervaiz Elahi be detained for 15 days “to avoid any likelihood of breach of peace/unlawful assembly in the district adding that the PTI leader had the right to appeal to the government against the decision Ch Pervaiz Elahi is among several PTI leaders who have been booked under the MPO amid the state’s crackdown against the party in the aftermath of the May 9 riots His arrest today came hours after the LHC ordered the National Accountability to release the PTI president and barred authorities from arresting him in any case

Earlier the former chief minister s son Moonis Elahi claimed his father was abducted from outside his Lahore residence

LHC hearing

Earlier in the day, the LHC ordered the NAB to release Elahi in a case of allegedly receiving bribes/kickbacks in exchange for getting the “contracts of road schemes of Gujrat Highways Division awarded to favourite/hand-picked contractors”

At the outset of the hearing today Justice Amjad Rafiq asked why Ch Pervaiz Elahi was not presented in court In his reply, the NAB prosecutor said the accountability watchdog was prepared to bring the former chief minister to court but it received a letter from the Punjab government today detailing threats to Ch Pervaiz Elahi’s life “The NAB had even asked the government for security to bring Ch Pervaiz Elahi here [the court] he said adding that the Punjab deputy inspector general (DIG) had replied in a letter that bulletproof vehicles and police armoured vans were being used in the operation against riverine gangs

The prosecutor added that the NAB was ready to present Elahi without security “but if something happens

who will be responsible”

Here, Pervaiz Elahi’s lawyer Rana Intizar Hussain said “We are ready to provide a bulletproof vehicle ”

Subsequently the court ordered the anti-graft body to present the PTI president within an hour and warned that it would otherwise issue arrest warrants for the Punjab DIG At around 12:15pm, the NAB presented Pervaiz Elahi in court However, Justice Rafiq once again asked why the accountability bureau was hesitant to present the former chief minister in court

He then ordered Pervaiz Elahi’s release and barred authorities from arresting him in any other case

In a written order issued in the afternoon the court said Pervaiz Elahi s custody in the NAB is found in an unlawful manner

It added: “The petitioner shall not be arrested in terms mentioned therein including the NAB or any other authority/agency/office etc nor shall be detained under any laws relating to preventive detention

Talking to reporters after his release today Pervaiz Elahi held the PML-N responsible for the current state of the economy All of them have run off to London after ruining the economy, he said “They have kept me inside, I don’t even know what is happening in the country ” the PTI president added

Timeline of arrests and rearrests

Elahi was first taken into custody on June 1 from outside his Lahore residence by the ACE for allegedly taking kickbacks in development projects

The next day, he was discharged by a Lahore court but was rearrested by the ACE in a similar case registered in its Gujranwala region However, a Gujranwala court had then discharged him on June 3 in two corruption cases pertaining to the embezzlement of funds

Nevertheless even after being discharged the ACE then rearrested Elahi for illegal recruitments in the Punjab Assembly On June 9, a special anti-corruption court had given the ACE a last opportunity to present the record of the illegal appointments case

The same day the National Accountability Bureau (NAB) came into action and initiated another inquiry against Elahi for his alleged involvement in embezzlement in development projects in Gujrat and Mandi Bahauddin After a sessions court on June 12 had set aside a judicial magistrate s decision of Elahi s acquittal in the embezzlement case, the next day, a judicial magistrate again sent him to judicial lockup after the LHC suspended the said order of the sessions court

On June 20 Elahi finally secured relief from an anticorruption court in Lahore but could not be released from jail as orders for his release were not delivered to the prison administration

Attempts at economic diplomacy will run into the rock of economic and political reality

TH E R E has been a lot of emphasis recently on foreign investment and along with a repetition of what seems to be a standard instruction to all missions abroad, a Special Investment Facilitation Council was set up by the outgoing government, and it was heartily approved by the caretaker government, which summoned a meeting of this body The SIFC focuses on agriculture mining information technology defence production and energy and on bringing investment from the Gulf There were two high-profile events, attended by both the then PM, Mian Shehbaz Sharif, and the COAS, Gen Asim Munir, on mining and agriculture, which attracted mutation from Gulf attention from Gulf businessmen While the SIFC, with its heavy military presence in both the apex and implementation committees may assure investors from the Gulf that the military is on board it should not disguise the fact that the country has problems which may make it an uphill task to attract foreign investment Red tape is a problem, and the SIFC may provide a solution, but that is not the only problem

The economic issues are such as to make it difficult to prepare even a feasibility study let alone spend actual money The foreign investor will have no certainty as to how much foreign exchange he must bring in because he will have no idea what the rupee, in which he must do a lot of his spending, will be worth Then there are the political issues He would not know when elections are to take place, at which point he will have to deal with a different set of policy makers As a result it is almost impossible to develop a timeline for any project

Suspension of Sentence: A significant win?

TH E Islamabad High Court today accepted t h e a p p l i c a t i o n f i l e d b y f o r m e r P r i m e Minister Imran Khan, under Section 426 of the Code of Criminal Procedure, seeking suspension of orders passed by Addit i o n a l S e s s i o n s J u d g e I s l a m a b a d We s t i n t h e Toshakhana Reference filed by the Election Commission of Pakistan

At this stage an application under this Section is to be tentatively assessed without delving into the merits/demerits of the case The trial court found the accused guilty of corrupt practices and convicted him under Section 174 of the Election Act 2017 and sentenced him to three years simple imprisonment with fine of Rs 100 000 which is viewed as a decision per incuriam Amidst this legal quandary whilst facing hundreds of cases, it is critical to mull over the mandate of THE constitutionally created organ of the State; Election Commission of Pakistan With hindsight, we would All do things differently The Election Commission through its Secretary (purportedly acting as an authorized officer on behalf of the Commission) filed a criminal complaint against Imran Khan, under Section 137(4) of THE Election Act, 2017, for failing to submit the statement of assets and liabilities for the fiscal years 2018-2019, 20192020 and 2020-2021, along with that of their spouses which were to be declared in the prescribed manner envisioned under Sections 137 and 138 of the Election Act 2017

Without delving into the modalities of trial to this end, the trialc Court passed its verdict and sentenced the former Prime Minister Imran Khan for three years simple imprisonment with a punitive fine As a consequence thereof the Election Commission notified the disqualification of the former Prime Minister Imran Khan under Article 63(h) of the Constitution from being chosen or elected as a member of Majlis-e-Shoora (Parliament)

The decision on application for suspension of sentence by the Islamabad High Court, spurred a noisy altercation amongst several quarters in terms of equating suspension of sentence with a presumption of innocence that would eventually lead to acquittal As a necessary corollary it is indeed a much more prudent approach to be cognizant that the powers conferred on the appellate Court under Section 426 of Code of Criminal Procedure are not wider than the power to release on bail under Section 497 and 498 of the Criminal Procedure Code For the purposes of Section 426 a sentence can be

This all leads to making a student a semirobot, having no human or societal awareness and thoughts This type of student only measures success in numbers When numbers come in human life the values of customs and traditions run out We in Pakistan are witnessing the same generation

But, is the current generation responsible for this? Is our government responsible for this?

Are parents and society jointly responsible for all this?

There is no single answer for all these questions rather we have to examine the differ-

Thirdly after the 18 h Amendment education became purely a provincial matter After 14 years democratic people had adopted the Single National Curreculam (SNC) From 2009 to 2022, every provincial education minister tested is own recipes in the laboratory on the teachers and students alike Having no proper vision and mission the education sector only produced soulless students

Fourthly technology played its role The mobile phones have captured the minds of students They know how to play a game but they do not know how to remain clean They will play games till morning but will remain late from the school This became a habit of the current generation and it seems difficult to forecast a bright future for them The function of the education must be to impart values and critical thinking in the new generation instead of mak-

The list is long but now we must define our vision and goals with proper planning to produce a generation having values which we need to run the country instead of producing a generation which only knows how to earn and earn more

We need to produce a generation which know that resources are depleting day by day, which know how to overcome climate change, which know how to avoid floods and disasters created by human activities which know the value of customs traditions interfaith harmony art and literature which has a proper vision and mission in the mind about life and world which treat all as humans instead of dividing them in categories

by the Islamabad High Court after deeper appreciation of the material and record brought forthwith in the appeal against conviction Therefore, till the final decision of appeal, the notification of disqualification issued by the Election Commission of Pakistan under Article 63(h) stays in the field and the suspension order passed by the Islamabad High Court has no bearing on the qualification/disqualification of the former Prime Minister Imran Ahmad Khan Albeit the very base, edifice and foundation on which Election Commission s purported claim may rest, raises concerns on the maintainability of the reference filed before the trial Court and any action pursuant to such a base would be considered nullity in the eyes of law and any superstructure built thereon is bound to collapse like a house of cards

Let us not cavil too much The appellate court is yet to decipher the merits of the appeal, but prima facie it appears that the reference filed by the Election Commission does not fulfil the criterion laid down in Section 137(4) of the Election Act 2017 which concretely provides a statutory period of 120 days for taking cognizance against a member of Majlis-e-Shoora (Parliament) who has purportedly failed or has falsely provided information in the statement of assets and liabilities, to be guilty of corrupt practices However consciously, the reference filed by the Commission specifically challenges the discrepancies in the statement of assets and liabilities from the period of 2018-2019 2019-2020 and 2020-21 which seems manifestly invalid as the same does not align with the statutory period provided in Section 137(4) of the Elections Act, 2017

Another egregious faux pas agitated before the Islamabad High Court, pertains to the lack of legitimate authority vested in the Secretary of the Election Commission of Pakistan to file the reference under Section 137(4) of the Elections Act 2017 before the trial Court in the purported manner and remains under challenge

Illogical surcharge

T H E people of Karachi are unfortunately being treated differently than the rest of Pakistan especially when it comes to power supply mechanism They are a victim of bad policies and resource management

Despite generating and contributing more than 50 per cent of the country s revenue, and being the economic engine of Pakistan, the city finds itself paying for the inefficiencies and losses of power distribution companies elsewhere in the country In a recent interview a former mayor of the city raised the point that people of Karachi are unfairly paying extra by way of the additional financial surcharge known as the Power Holding Limited (PHL) surcharge that became effective from March this year The surcharge is meant for the interest payments against loans held with the PHL, the company that financially transacts on behalf of power-generating companies and pays the fuel suppliers In 2020, the then government had decided to convert a large chunk of these loans into public debt and recover it from consumers to reduce the circular debt An amount of Rs800 billion is to be recovered as per the recent auditor-general s report According to K-Electric (KE) its books hold losses that need to be recovered via the surcharge People of Karachi are, therefore, unnecessarily paying more out of their pockets due to the uniform tariff policy It ensures that apart from keeping the unit rate of power the same across the country, any other cost that needs to be billed, such as the PHL surcharge, is also applicable even if losses have not been incurred by the operating power company In the future when other companies begin power delivery operations in Karachi as is the plan the PHL surcharge will still be applicable to their consumers

Inflationary pressures are hurting people, and the step-motherly treatment towards issues of infra-structure and governance, such as water scarcity, environmental degradation, dilapidated roads, broken and barely functioning sewerage services in Karachi is a further agony for its hapless citizens People are striving hard to make an honest living and pay their taxes but there is minimal return in the shape of development upkeep and governance How much more burden the people of Karachi will have to carry on their shoulders? Will they ever get some relief?

T H E lack of responsiveness and transparency exhibited by the Walton Cantonment Board in Lahore is irritating As a responsible taxpayer I feel compelled to point out the significant increase in property tax and associated charges that have been levied on area residents

Over the last three years the property tax conservancy charges water and sewerage charges have experienced a steep rise For 2021-22, the total tax amount was Rs23,330, which rose to Rs44,695 in 2022-23, and has now been scaled up to Rs59,065 for 2023-24 There is 10 per cent increase in property tax 100pc in conservancy charges and 30pc each for water and sewerage It is evident from the data that the property tax and associated charges have experienced an alarming increase over the last few years This represents an exorbitant hike of Rs35 735 or approximately 152pc compared to the tax paid just two years ago Despite repeated attempts to seek an explanation for the exorbitant tax hikes, including emails, letters and a personal visit to the Walton Cantonment Board office, my concerns have been met with complete silence and disregard The lack of response from the authorities is not only disheartening but also raises questions about the transparency and accountability of the cantonment board As taxpayers our hard-earned money forms the backbone of financing day-today affairs of the cantonment board It is our right to expect respect and timely response to our legitimate concerns The unresponsiveness of the cantonment board has left the residents feeling unheard and undervalued OMAIR MAHMOOD LAHORE

While freedom of expression is a fundamental human right in liberal democracies the right to express one s opinion can become complex when expressing one s views clashes with the religious and cultural beliefs of others and when this rhetoric veers into hate speech As a scholar of European studies I’m interested in how modern European societies are trying to navigate the fine line between freedom of expression and the need to prevent incitement of hatred; a few are introducing laws specifically addressing hate speech

DEATH PENALTY FOR INSULTING GOD AND CHURCH: Since medieval times because of the dominant role of Christianity in political and cultural life blasphemy against Christian beliefs in European countries was severely punished

CONTEMPORARY DEBATES: The Quran burnings in Sweden and Denmark, aren t random – they re part of a broader agenda of targeting Muslims that’s being pushed by farright groups across Europe In many European countries lawmakers and others are asking whether these book burnings should be seen as exercises of free expression or more as incitement based on religion

A few countries are introducing new legislation to curb hate speech against religious communities For example in 2006 England got rid of the blasphemy

The police argued that the Quran burning wasn t just about religion but specifically targeted the Muslim community This was evident, according to the authorities as the incident took place in front of a mosque during the Islamic holiday of Eid setting it apart from other burnings that took place outside of the Swedish Royal Palace, the Turkish and Iraqi embassies and other public spaces Because of the existing hate speech law focusing on incitement against minorities rather than religions the activist received a fine from the police In recent weeks, some have called for a stricter application of the hate speech law and have demanded a ban on all Quran-burning events for implicitly inciting hatred against Muslims

A GLOBAL CHALLENGE: This discussion isn t limited to Europe alone Even in the US there s an ongoing debate about the boundaries of free speech The First Amendment of the Constitution allows free speech, which some can interpret as the right to burn holy books Terry Jones for instance is a controversial Christian pastor from Florida He organized Quran-burning events in Gainesville in 2011 and 2012 His only legal consequence was a US$271 fine from Gainesville Fire Rescue for not following fire safety rules

As societies change, I believe it has become important to recognise when freedom of speech has turned into promoting hatred Figuring out where this boundary lies understanding the standards applied and uncovering potential biases can spark important conversations While a solution that applies to every single country may not exist, it s essential to engage in this dialogue, recognising its complexity and the varying perspectives across societies

channels between Prime Minister Benjamin Netanyahu s government and the Biden administration are significantly troubled, as Israeli Cabinet ministers are still banned from meeting their American counterparts in Washington The visit of Israel s Defense Minister Yoav Gallat to New York this week reflected that amply Under strict orders from Netanyahu, Gallant did not go anywhere near Washington or the Pentagon on his visit Nor did he meet with Defense Secretary Lloyd Austin, national security adviser Jake Sullivan or with any of the US officials who manage the strategic alliance between the two countries Normally a ban imposed by an Israeli leader on a high-level US visit would have generated shocked headlines in Israel, but these are unusual times in Israel under the most hard-line government in its history Gallant’s US trip, which included a meeting with United Nations Secretary-General Antonio Guterres a fundraiser and a personal visit to his son who lives in the United States did not elicit anything more than raised eyebrows

Friday directed the customs authorities and law enforcement agencies (LEAs) for taking solid measures to curb the smuggling of sugar, petroleum products, urea, agricultural products and other items

He issued the directives while chairing a high level meeting for stopping smuggling in Pakistan

During the meeting the caretaker prime minister was briefed on the situation of smuggling of different items across the country, especially in the border areas, and about the steps taken for stopping the menace The meeting was told that 10 additional checkposts of law enforcement agencies were notified to curb smuggling in Balochistan

On the occasion Anwaarul Kakar instructed that an inter-agency report should be prepared about the officers involved in smuggling in the province He directed strong departmental action against the officers involved in smuggling in Balochistan and award of exemplary punishment to them He said the smuggling of

petroleum products was reducing revenue and putting pressure on the country s foreign exchange reserves

The caretaker PM said he would chair a weekly meeting to review the performance of institutions and to curb the menace of smuggling He ordered that the border markets with Iran should be made more viable so that trade could be done with proper documents

He said smuggling was causing a loss of billions of rupees to the national economy and it was critical to end the problem of smuggling

The PM was told that smuggling was reduced by 40 percent due to the untiring efforts of law enforcement institutions He was apprised of the strategy of the law enforcement departments against smuggling

The Khyber Pakhtunkhwa (KP) Local Government Department has utilised only 7% of the development funds allocated to it in the past two months In an effort to ensure the effective use of existing funds the Department of Planning and Development (P&D) has directed the LG Department to prioritise the utilisation of current funds before requesting additional allocations According to the P&D, a total of Rs4 39bn was allocated for the “Urban Development” projects over a period of four months of which Rs 2 24bn has already been disbursed So far the LG Department has expended only 7% of the allocated Rs 4 39 billion funds totaling Rs15 51 crore Additionally, the LG Department currently holds Rs2 86 billion in its accounts according to the online system The Department has stressed the need of first ensuring the efficient utilisation of the initially allocated funds before submitting any further funding requests Due to constitutional constraints in the oversight period the KP government has only approved a four-month budget, including the development budget Despite having an allocated development budget of over Rs15bn, a significant portion remains unused While it may allude to the province’s fiscal discipline it has been revealed that the KP government has quite a task at hand when it comes to infrastructural development

ISLAMABAD A H M A D A H M A D A N I Directorate General Oil of Petroleum Division has notified the Policy Guideline on Import on Foreign Supplier ’s Account Through Custom Bonded Storage Facilities and asked Managing Director (MD) of Printing Corporation of Pakistan Press for publication in the Gazette of Pakistan for general information Directorate General Oil of Petroleum Division through a letter dated 01st September, 2023 to the Managing Director (MD) of Printing Corporation of Pakistan Press Karachi has asked for publication in the gazette of Pakistan for general information regarding Policy Guidelines on Import on Foreign Supplier s Account Through Custom Bonded Storage Facilities Earlier, the federal cabinet’s economic coordination committee (ECC) in its meeting held on 27th June 2023 had approved a Policy Guideline on the subject “Import on Foreign Supplier ’s Account Through Custom Bonded Storage Facilities” which was later ratified by the federal cabinet vide decision No 382/Rule-19/2023 dated 28th June 2023 According to petroleum division in view of limited local refinery supplies, Pakistan is heavily dependent on import of deficit petroleum products In order to enhance supply access to the local Oil Marketing Companies (OMCs) diversify the sources of supply and to avail freight economies of scale international oil suppliers would be facilitated/encouraged to make investments storage and trade of crude oil and petroleum products under the Policy Guidelines As per the Policy Guideline on Import on Foreign Supplier ’s Account Through Custom Bonded Storage Facilities foreign supplier or its registered subsidiary will be allowed to maintain inventory of crude oil and petroleum products in bulk form, in their own Private Bonded Warehouses or Customs Public Bonded Warehouses located anywhere in Pakistan (without foreign exchange remittances) pending its sale to local purchasers or its re-export therefrom to other foreign countries Foreign supplier shall have the option to establish its own registered business of operate through subsidiary company (the Consignee), registered vin Pakistan, having bank accounts in the country to act under the relevant Pakistani laws/rules for undertaking operational/business activities on behalf of foreign supplier The Consignee shall have the options to develop their own dedicated storage infrastructure and utilize the customs public bonded warehouse facility on rent basis located around port premises or anywhere in Pakistan for storing crude oil and petroleum products duly licensed by the OGRA under the Pakistan Oil (Refining Blending Transportation, Storage and Marketing) Rules 2016 The Consignee’s Customs Bonded Warehouse shall be licensed by the Customs after fulfilment of requirements for operating as Public Bonded Warehouse for storage of crude oil and petroleum products under Section 12 & 13 of the Customs Act 1969 The Consignee shall be registered with the Inland Revenue, Federal Board of Revenue (FBR), under the Sales Tax Act, 1990, as an importer and exporter At the time of storing the goods received under the scheme the Consignee shall not be required to file Electronic Import Form (EIF) with his Goods Declaration (GD) for in-bonding (IB) The Consignee shall then sell the goods to licensed purchasers 9Refineries or OMCs) in US Dollars or Pak Rupees against opening of Letters of Credit through scheduled banks without requiring LC confirmation by international banks or advance payments as per applicable foreign exchange regulations Sale and purchase of goods between foreign sup-
