NA endorses bill proposing up to 3 years in jail for disclosing identities of intelligence officials

The National Assembly passed a bill on Monday to amend the Official Secrets Act 1923 which proposes up to three years in jail for anyone who discloses the identity of members of intelligence agencies informants or sources

The bill, titled Official Secrets (Amendment)

Bill, 2023 , was moved by Parliamentary Affairs

The Statement of Objects and Reasons of the bill says “It is imperative to amend the Official Secrets Act 1923 and make it more effective in view of the changing social milieu to ensure the safety and security of official documents

The bill, a copy of which is available with Dawn com, proposes adding Section 6-A (unauthorised disclosure of identities) to the act, under which “a person shall commit an offence who intentionally acting in any manner prejudicial to public order safety interests or defence of Pakistan or any part therefore, discloses in such a manner that exposes the identity of such undisclosed persons in any man-

ner the identity of the members of intelligence agencies informants or sources thereof

It proposes imprisonment for a term of up to three years and a fine extending to Rs10 million

The bill says that any person who “abets, incites, conspires or attempts to commit the offence [ ] shall be liable to the same punishment”

The bill added an additional definition for enemy in Section 8-A which would mean any person who is directly or indirectly, intentionally or unintentionally working for or engaged with the foreign power, foreign agent, non-state actor, organisation entity association or group guilty of a particular act tending to show a purpose that is prejudicial to the interest and safety of Pakistan

It also proposed substituting Section 9 (attempts or incitement to offences), by stating that anyone who incites, conspires, attempts, aids or abets the commission of an offence would be punished with the same penalty and liable to be proceeded against in the same manner as if they had committed the offence

Moreover the bill added subsection 2-A to Section 11 (search warrants) which said that intelligence

agencies may now at any time enter and search any person or place without warrant and if necessary, by use of force, and seize any document or anything which is or can be evidence of an offence committed, or suspecting of been committed”

It further suggested adding Section 12-A (investigations) to the law The proposed amendment states that an investigating officer under the act shall be an officer of the Federal Investigating Agency who would be designated by the FIA director general for investigation

“If the FIA DG deems it suitable, he may constitute a Joint Investigation Team convened by such officer and consisting of other such officers of intelligence agencies It added that FIA would have to complete the investigation of cases triable by the court established within 30 working days

The bill also proposed including Section 12-B (admissibility of material collected) under which “all material collected during the course of inquiry or investigation including electronic devices data information documents or such other material which facilitates the commission to any offence under this Act, shall be admissible

ISLAMABAD: The Pakistan Meteorological Department (PMD) on Tuesday forecasted another spell of rains in upper parts of the country from Wednesday (today) due to the penetration of monsoon currents from the Arabian Sea

According to PMD alert a westerly wave is also likely to enter the country on Thursday (tomorrow) Under the new spell, it said rains with wind/thundershowers are expected in Azad Jammu and Kashmir ’s Neelam valley, Muzaffarabad, Poonch, Hattian, Bagh Haveli Sudhanoti Kotli Bhimber and Mirpur from the night of Wednesday to Aug 7 intermittently

PRIME Minister Shehbaz Sharif on Tuesday said the upcoming elections would be held on the basis of the 2023 digital census elaborating on there are high chances of a meeting of the Council of Common Interest (CCI) to approve census results

We have to hold the elections on the basis of the new census When a census has been conducted the [polls] should be held on its basis unless there is an obstacle that cannot be overcome But I don t see [any such hurdle] Premier Shehbaz Sharif shared the views during a recorded interview on Aaj News show Faisla Aap Ka , which was aired on Tuesday

When asked about the possibility of any delays in elections he was emphatic in saying that this should not be the case but also added that the ball will be in the election commission s court PM Shehbaz’s statement is a deviation from that of his ministers’ previous assertions who said that the upcoming election would be held on the basis of the 2017 census

This decision however had prompted a terse response from the Muttahida Qaumi Movement-Pakistan (MQM-P), one of the ruling allies in the Centre that maintains Karachi’s population has been undercounted in the new census

In an apparent bid to appease the party PM Shehbaz held a meeting with its leaders in Karachi last week where he assured them that any decision on the matter would be made after consultation with all coalition partners

Senate’s body on communication reviews affairs of NHA

The Senate Standing Committee on Communication on Tuesday examined in detail progress of various on-going and completed projects total revenue generated by the National Highway Authority and its other administrative matters

The Senate standing committee headed by Senator Prince Ahmed Umer Ahmedzai was also briefed on the progress repair and renewal of projects effected by devastating floods last year and inquired about the preparedness of flood this year

The committee was informed that the NHA along with NESPAK is working on a complete novel structure and alignment of bridges affected by floods The committee was apprised that the NESPAK will furnish the structural design and NHA will give a presentation to the committee in next meeting on realignment of Pinjra Bridge The said project will take around 2 years to complete The committee was apprised that a complete hydrogel study of the NHA network is required to address floods in the country It was also briefed that the NHA restored the roads affected in the flood

The officials from the Ministry of finance said that NHA has spent 2 4 billion rupees on repair/rehabilitation of the side roads out of NHA network in all provinces

but not a single penny has been received from the government till date It was further informed by the NHA officials that the Prime Minister of Pakistan has decided that expenditure incurred on roads in provinces funds may also be provided by the respective province

The committee also received briefing on details of revenue generated by NHA since January 2019 including toll tax and other sources mentioning annually, monthly break along with its utilization It was apprised that a total of 135 488 43 million rupees was earned by toll revenue (national Highways & Motorways for the period of January 2019 to June 2023 out of which motorways earned Rs44 376 84 and National Highways earned Rs91,111 59 million The committee was also briefed that the 112,187 1 million rupees were utilized on maintenance and 4 277 2 on establishment

While taking briefing on the details of on –going projects inaugurated by the Prime Minister of Pakistan since 1st January 2023 to-date, the committee showed concern over the incomplete ongoing projects The Chairman committee said that each project only gets 10 to 15 pc of funds annually which causes delay in its completion price escalation and disputes amongst the authority and contractors He said this delay causes great loss to the country as the NHA has to pay the liability of escalated rates to the contractor The Chairman Committee sought details of all

the delayed projects in the last 5 years and cost of liability of each project paid to the contractor in next meeting The committee was told that bidding is continued on around 10 -15 new projects in last 6 months

The Senate Body also took briefing from the NHA on the current status of recruitment process of jobs advertised on 6th May and 21st May, 2023 It was briefed that NHA advertised 96 projects posts of different cadres on 7-5-2023, total number of applications received against the post was 6851 out of which 4756 candidates were shortlisted after shortlisting of candidates written tests of shortlisted candidates were conducted on 19, 20 of July, 2023 the paper checking is in progress and the eligible candidates will be called for interview Similarly NHA advertised 37 vacant post regular post of different cadres against Baluchistan quota on 21 05 2023 against which 309 application were received And shortlisting of candidates is in progress

The committee remarked that much recruitment is made on Baluchistan quota to candidates domiciled for Balochistan However the local communities who are the real deserving candidates remain unprivileged in this regard The committee recommended that test should be conducted in the local city and also an office should be established in the city to process recruitments so that the local community is benefited the most The

chairman committee also constituted a sub-committee comprising of Senator Danesh Kumar, Senator Munzoor Ahmed Kakar and Senator Umer Farooq to probe in detail the recruitments process on Balochistan Quota

The NHA requested the committee to enhance maintenance grant to which senator Umer Farooq remarked that if NHA will submit their suggestions, committee will surely consider it and will forward recommendation on its enhancement if seem appropriate The committee was informed that there are 86 toll tax stations which are recently awarded to different company by bidding process The committee also inquired about a project which went viral on social media inaugurated by Molana Fazul Rehman and directed to provide its details

The committee was briefed that the project is of DI khan by pass it a 3 4 Billion project at a length of 36 km

Earlier in the meeting the committee members showed reservation on the persistence absence of the Minister from the meetings and said that perhaps more than busy the Minister seems not interested in resolution of problems faced by the general public

The representatives of Unions of Civil Aviation Employees put forward their concerns on outsourcing of airports especially related to their job security

In case of early dissolution, the Election Commission of Pakistan (ECP) is bound to hold the general elections within a period of 90 days after the dissolution according to Article 224(2)

However with just a few days left in the dissolution of the assembly the prime minister and opposition leader are yet to begin consultations regarding the selection of the caretakers

On this PM Shehbaz said during the interview that the process would begin following the completion of consultation with the allies on the matter

This makes it more imperative that the two countries should coordinate their efforts to end this However, though the Taliban were presented as the answer to Pakistan’s problems when they took over in Kabul Pakistan has proved unable to prevent them from giving safe havens to the Tehrik Taliban Pakistan who have launched a terror campaign, nor from reining in the IS-KP, which has claimed responsibility for the Bajaur blast on Sunday Under the circumstances, cooperation on this issue is unlikely which is quite apart from the antivaxxer stance of the Taliban who subscribe to the theories about the vaccine being a conspiracy

The decision reached by NATO s members was that weapons and aid will continue to flow and sanctions on Russia will remain in place, but Ukraine’s admission would be delayed until the end of hostilities What the NATO members are saying to Zelenskyy is that it s one thing for us to give you everything you need to repel the invasion of your territory and quite another for us to declare a full-scale European continental war with Russia

This hesitation is smart, because it’s doubtful that public opinion in many NATO countries would accept such a move And it’s even more questionable that even if there were support in some countries for such a war with Russia that the support would be sustainable over time

It s useful to recall former US Secretary of State Colin Powell’s doctrinal guidelines to be followed by any democracy before declaring war Of the items included in the “Powell Doctrine ” two are particularly relevant in this instance First Powell insisted there must be a clear understanding of the costs consequences and terms of engagement involved in the war Following this, the doctrine maintains that there must be sufficient and sustainable public support for the effort to be successful, especially if the war is expected to be of long duration According to the doctrine if these conditions cannot be met public support will wane and the resultant discontent will ensure that objectives cannot be met (Of course it

n Most Europeans continue to blame Russia for the war and support breaking ties with and continued sanctions directed against Russia

n At the same time, a substantial majority of respondents in all countries polled make clear that they are “concerned about the cost of this war and believe that a compromise should be found to save lives and resources ” Only one-third or fewer believe that it is worth the cost of continuing to fight to stop Russian aggression

n About two-thirds in most countries say their governments should be more independent in global affairs and less aligned with the US And while Russia has burned its bridges with most Western Europeans a sizable majority of respondents see the importance of their countries now developing closer ties with China

n There is support for admitting Ukraine into NATO in just four of the seven countries, and only respondents in the UK and Poland give tepid support for sending NATO troops In no country

were respondents in support of sending their own forces into the war zone

These attitudes may shift in coming months depending on the success or failure of Ukraine’s off e n s i v e a n d h o w t h e i n t e r n a l s i t u a t i o n i n R u s s i a unfolds in the wake of the failed rebellion by the Wagner Group But what s clear, at this point, is that there is growing unease with the fact that this war, which most respondents told us they believed would be over quickly is continuing with no end in sight

However going to the West is not easy and it needs a lot of money and time to acquire a legal visa People in Pakistan find it easier to move illegally without a visa Two routes are used for this illegal immigration Both are from the Balochistan province of Pakistan

One is the land route from Balochistan to Iran Turkey and then Europe The second is the sea route from Gwadar to the Gulf of Oman the Mediterranean Sea and then the southern parts of Europe It is crucial to approach the issue of illegal immigration through a humanitarian lens Owing to economic disparities, political instability and/or conflict it has become difficult to stay in the country

CHINA S top economic planner on Tuesday announced a raft of detailed measures to facilitate the country’s development of the private sector including those relating to tax reductions and supporting the platform economy

T h e N a t i o n a l D e v e l o p m e n t a n d R ef o r m C o m m i s s i o n ( N D R C ) s t r e s s e d t h e need to tackle problems private enterprises are facing and at the same time boost their confidence

These detailed measures came after the Communist Party of China Central Committee and the State Council last month released general guidelines promising to improve the business environment, enhance policy support, and strengthen the legal guarantee for its development

Wang Shancheng an NDRC official told a press conference on Tuesday in Beijing that the central government has appointed the relevant ministries to take on the responsibility to supervise and implement each measure

Meanwhile, private firms will be encouraged to participate in major national projects that are profitable and mature issue real estate investment trust (REIT) products for infrastructure projects and lead technological programs in key areas such as industrial software, cloud computing and artificial intelligence

China’s authorities will continue to publish investment cases that are “greenlighted” as a reference for companies in a bid to promote the sound development of the platform economy Companies will enjoy an easier process of tax reduction in research and development spending, shorter time in export rebates, and strengthened inclusive financial support

In terms of legal guarantees regulations and official documents violating the principle of equality for enterprises of various types of ownership will be abolished to protect the development of the private economy

The government will improve its services to help private businesses solve difficulties cut red tape in administrative approval clear arrears owed to small and mediumsized enterprises and actively engage with entrepreneurs during the policymaking

The ministries said a list of major national projects that are profitable and mature in which private firms are encouraged to participate, will be formed Also, the issuance of Real Estate Investment Trust products (REITs) for infrastructure projects will be increased, and qualified private firms will be encouraged to issue REITs so as to boost private investment A reserved quota of 40 percent for private firms in government procurement will be extended to the end of 2023 Private firms will also be encouraged to participate in major science and technological projects and lead missions to tackle core

They also vowed strengthened legal protection for private firms including greater efforts to pay up debts owed to private firms and the abolishment of regulations and official documents violating the principle of equality for enterprises of various types of ownership The ministries also called for adjustments to land supply to meet private firms demand for land use

Earlier the apex court had rejected the federal government s plea to constitute a full court for the hearing of military trial case

Yesterday, senior lawyer Faisal Siddiqi on behalf of civil society members filed the fresh petition pertaining to the trial of civilians in the military court

The full court should include all judges willing and available for the adjudication on the fundamental and complex constitutional and legal questions, it said

The petition further stated that the petitioners would have no objection if all the judges of the Supreme Court were part of the proposed full court “It is categorically stated that unlike the government’s malafide actions the petitioners have no objection whatsoever on any judge willing and available to hear this case it added

During the hearing, the CJP discussed the plea with other petitioners in the case and then reserved the verdict on Siddiqi’s application He said that the bench would announce the decision after discussion Justice Bandial added that lawyers would be informed in the instance of a delay in the verdict

At the outset of the Tuesday hearing the CJP noted that senior counsel Faisal Siddiqi had petitioned the court a day earlier to form a full court to hear pleas against the military trial of civilians Justice Bandial then said that the bench would first hear the arguments of ex-CJP Jawwad S Khawaja’s lawyer My client is the former chief justice of Pakistan Advocate Khwaja Hussain Ahmed said My client wants the court to treat me like a common citizen, not a special person He wants ex-chief justice to be removed from his name

Here, Justice Bandial said that the former chief justice was a prominent personality and his petition was nonpolitical At one point the apex court judge also asked if Faisal Siddiqi was hiding to which he was told that the counsel was outside the courtroom for some work and would return soon

As the hearing continued, Justice Naqvi said the law didn t give permission to pick and choose, asking why the inquiry [against civilians] was not brought on record

The Khyber Pakhtunkhwa (KP) has once again demanded the federal government to release it rightful share if Rs628 billion under 7th National Finance Commission (NFC) Award KP’s tribal districts were promised Rs470bn under the Accelerated Development Program but during the last four fiscal years only Rs69bn was provided Additionally, KP has not received Rs57bn from the previous fiscal year s net hydel profit, nor has it received Rs32 2bn earmarked for the divisible pool

To discuss the issue, a consultative meeting, chaired by Advisor to Caretaker Chief Minister on Finance Hamayatullah Khan was held During the meeting Secretary Finance Mohammad Ayaz Khan briefed the attendees on the current financial situation of the province The meeting was informed that 7th NFC Award was initially approved in 2010 when KP was not administering the tribal belt but the province is receiving the same funds even after the merger of tribal areas The Advisor stated that the Federal Board of Revenue collected Rs5 155 trillion in the first nine months of the last fiscal year According to the NFC formula, KP s share should have been Rs471 3bn

Nevertheless, KP received only Rs457 07bn, leaving an outstanding amount of Rs13 6bn

Pakistan among states getting assistance from cloud company for hacking

An obscure cloud service company has been providing state-sponsored hackers with internet services to spy on and extort their victims, a cybersecurity firm said in a report to be published on Tuesday Researchers at Texas-based Halcyon said a company called Cloudzy had been leasing server space and reselling it to no fewer than 17 different state-sponsored hacking groups from China, Russia, Iran, North Korea, India, Pakistan and Vietnam

Halcyon estimated that roughly half of Cloudzy’s business was malicious including renting services to two ransomware groups It s a rogues gallery on that through one provider said Halcyon executive Ryan Golden ahead of the report s publication Halcyon arrived at its conclusion by mapping out Cloudzy’s digital footprint in part by renting servers directly from the firm and by tying it to known hacking operations

Furthermore, the federal government has to provide thr province Rs18 6 billion for federal taxes collected during the last four years This brings the total outstanding amount Rs32 2bn as KP s share in tax collection Regarding development funds for tribal districts, the federal government had allocated Rs107bn However, it has only provided KP with Rs60bn, leaving a shortfall of Rs47bn This has led to cuts in development projects and forced KP to use Rs10bn from its current budget Furthermore KP received only RS19 85bn out of the designated Rs25bn for the Tribal Districts Development Fund A shortfall of more than Rs5bn remains unpaid

In short, the federal government has to provide KP a total of Rs144 4bn for ongoing expenses and development budgets from the fiscal years 2019-20 to 2022-23 Additionally under the Fast Track Development Program KP should have received Rs400 billion but it has only received Rs75 5 billion leaving a deficit of Rs324 5 billion Secretary Finance, Mohammad Ayaz Khan, has pointed out that Rs4 9bn has been paid in net hydel profit while Rs57bn still remains unpaid

This financial discrepancy has strained the relationship between the KP and the federal governments as the province seeks to receive its rightful share as per the constitutionally mandated NFC Award

Finance Minister Ishaq Dar on Tuesday said that petroleum prices were being jacked up by a staggering Rs19 95 per litre

The minister said that the decision was made “in the national interest” as he announced that the cost of High-Speed Diesel (HSD) was being increased by Rs19 90 to dial in at Rs273 40 per litre while that for petrol was hiked by Rs19 95 to Rs272 95 per litre

He also said that the new rates were to be effective immediately

Dar explained that the hike was due to the increase in the prices in the international market over the last 15 days

He also stressed that his team had tried to work on the Oil and Gas Regulatory Authority s (Ogra) recommendations until the wee hours of the night but found themselves with their backs against the wall

“The basic reason behind the delay in the announcement was that we were looking at if there were ways to reduce the price if
