Environmental law headlines in the United States trumpet retreat, dismantling, and regression. The news from Pace | Haub Environmental Law that you will read in this report is quite different. It evidences the continued development of the environmental rule of law, progress toward a sustainable future, and the value of the work we do at Pace | Haub Environmental Law.

Message from the Executive Director & Faculty Director of Environmental Law Programs

In 2025, the International Court of Justice (ICJ) and the Inter-American Court of Human Rights (IACHR) issued landmark Advisory Opinions recognizing the duties of states to address climate change (Obligations of States in Respect of Climate Change, Advisory Opinion on the Climate Emergency and Human Rights). The Advisory Opinions represent the culmination of years of research and advocacy by thousands of members of civil society, including by the students, alumni and faculty of Pace | Haub Environmental Law. In 2016, the Global Center for Environmental Legal Studies (GCELS) submitted Motion 087 which was adopted by the International Union for the Conservation of Nature’s (IUCN’s) 2016 World Conservation Congress and supported a decision inviting the General Assembly to request an advisory opinion from the ICJ on the principle of sustainable development in view of the needs of future generations. In 2019, students,

inspired by environmental law legend and Normandy Chair for Peace, Tony Oposa, created an online petition and coordinated the submission of letters of support for a request for an advisory opinion to Permanent Representatives to the UN. This year, the Environmental Law Institute published a commentary evaluating the scope of the forthcoming ICJ opinion authored by students in Professor Nicholas Robinson’s class Environmental Law Seminar: Rights Before the UN World Court. In 2023, GCELS submitted an amicus brief to the IACHR on climate-related displacement and Professor Camila Bustos subsequently provided expert testimony before the IACHR. Closer to home, Pace | Haub Environmental Law students, alumni and faculty successfully advocated to enshrine environmental rights in Article I, section 19 of New York State’s Bill of Rights. Now we are working to support the effective implementation of those rights. The Pace Environmental Law Clinic invoked Article I, section 19 in litigation seeking to enjoin a dangerous hazardous waste incinerator. The most recent New York State Supreme Court decision interpreting Article I, section 19 characterizes it as fundamental and selfexecuting, citing to an article authored by Pace | Haub Law Faculty.

And we were excited to welcome Professor Sam Bookman, an internationally recognized expert on environmental rights, as a Haub Visiting Scholar and Visiting Professor to help build out the Pace New York Environmental Right Repository.

We have also turned our attention to Pace | Haub Environmental Law’s physical home, our White Plains campus. We research, write, study and lecture on the ancestral homelands of the Lenapehoking. This past April, Pace | Haub students and faculty, with the founders of the Lenape Center, convened a symposium on the treaties of the Lenape Nation where the students presented a compendium of the treaties, assembled for the first time in one place, as the culmination of their work in the class Environmental Law Seminar: Indigenous People’s Treaty Rights.

We express gratitude to our friends in the Lenape Nation and look forward to their partnership in addressing the environmental challenges of our shared future.

We wish to take a moment to acknowledge the extraordinary contributions of Jason Czarnezki whose energy, vision, and dedication over the last decade as the Executive Director of Pace | Haub Environmental Law was instrumental for the Program’s growth and excellence. Jason has gone on to become the dean at the Chicago-Kent College of Law. We wish him well and commit to grow the program he nourished.

This report shares news of environmental law through the lens of the work that we do at Pace | Haub Environmental Law. We train students, recruit faculty, support alumni, and engage with environmental law at all levels, from local land use to international policy. We do this in service of the larger goal of building a more just, more sustainable world. We recognize the importance of practicing effectively (and training our students to practice effectively) within existing doctrine while also valuing thinking big— envisioning how doctrine must evolve. Progress is rarely fast and sometimes it is two steps forward and one step back.

* Spotlights on New Faces Lauren Roth, Associate Professor of Law, Faculty Director of Health Law and Policy Certificate Education: BA, George Washington University; JD, Harvard Law School; PhD, Columbia University Experience: Previously, Lauren was a professor with the Jacob D. Fuchsberg Law Center at Touro University, teaching business and health law courses. She was also the Associate Director and Acting Assistant Professor at NYU School of Law Lawyering Program. At Pace | Haub Law, she teaches Health Law in America, Contracts, and Corporations and Partnerships.

Research & Scholarship: Health law and policy, business law, the intersection of environment and health are among her teaching and research interests. Her scholarship focuses on the role of the government, business, and employers in American health and social welfare and how to promote equal access to health care. The Commonwealth Fund awarded her a grant to serve as Principal Investigator for a 2024-2025 research project titled State Regulation of Medicare Brokers. Recent Activity: She was selected as a Health Law Scholar by the Center for Health Law Studies at Saint Louis University and the American Society of Law, Medicine and Ethics. She currently serves as Secretary of the Association of American Law Schools Section on Law, Medicine and Health Care.

Michael Hamersky, Executive Director, Pace Energy and Climate Center, Adjunct Professor of Law Education: BA, Boston University; JD, Fordham University School of Law; LLM, Pace | Haub Law Experience: Michael teaches Natural Resources Law and focuses on climate change mitigation, clean energy deployment, sustainable development, international conservation, ocean governance, and renewable energy incentive structures. Michael focuses on the clean energy transition, addressing barriers to and incentives for renewable energy deployment, and has worked with NYSERDA to update New York’s battery storage, and wind energy systems model laws, as well as to develop large renewable energy project siting and permitting process resources used to educate municipalities statewide. Research & Scholarship: From protecting ocean ecosystems to renewable energy incentives under the Inflation Reduction Act, Michael has published several research papers and presented at conferences on various topics, including on the impact of climate change on Indigenous people in Navajo Nation. Recent Activity:

Michael is also an adjunct professor at Fordham University School of Law and was the Climate Change and Land Use Policy Fellow at the Land Use Law Center prior to his appointment as Executive Director of the Pace Energy and Climate Center. At Pace | Haub Environmental Law: Michael appeared on behalf of the Pace Energy and Climate Center at the IUCN World Conservation Congress in Abu Dhabi and COP30 in Belem, Brazil.

Sara Gonzalez-Rothi, Visiting Associate Professor of Environmental Law Education: BA, University of Florida; JD, University of Miami School of Law Experience: Sara served as Senior Director for Water at the White House Council on Environmental Quality throughout the Biden-Harris Administration. Earlier, she was Senior Counsel to the U.S. Senate Committee on Commerce, Science, and Transportation, advising democratic members on ocean and atmospheric-related federal policy, and Legislative Counsel to a U.S. Senator on environment, energy, agriculture, and animal welfare issues. She also held the role of Senior Policy Specialist at the National Wildlife Federation. Research & Scholarship: Sara focuses on pragmatic environmentalism in her scholarship. Recent Activity: Sara published an article on offshore wind energy for the New York State Bar Association, served on the steering committee for a Coastal States Organization/National Sea Grant Law Center symposium on the public trust doctrine, presented at the National Forum of the National Caucus of Environmental Legislators, and joined the boards of the Coastal States Stewardship Foundation, the Dodon Center for Ecological Farming, and Green Amendments for the Generations. At Pace | Haub Environmental Law: Sara joined the faculty in August 2025 and will be teaching Administrative Law and Water Law in Spring 2026.

Sam Bookman, Visiting Assistant Professor and Haub Visiting Scholar Education: BA/LLB, University of Auckland; LLM and SJD, Harvard Law School Experience: Sam has held postdoctoral positions at Harvard Law School and NYU Law School. He is also Senior Staff Attorney in the Environment Program at the Cyrus R. Vance Center for International Justice, where he has advised environmental NGOs across the world,

and represented clients before international courts and tribunals. Before coming to the U.S., Sam practiced as a lawyer in Aotearoa/New Zealand and was a clerk to the country’s Chief District Court Judge. Research & Scholarship: Sam’s research spans constitutional design, climate litigation, social movements, and environmental human and nonhuman rights. His work is widely published in prominent national and international law reviews and has been cited by the International Court of Justice and the Supreme Court of Pakistan. He has also authored many book chapters, blog posts, and contributed to numerous research reports and collaborations. Recent Activity: Sam’s recent publications include a book chapter on Indigenous Peoples, climate change, and private law; an empirical study of the U.S. “Rights of Nature” movement; and a comparative analysis of constitutional climate cases in Germany, the U.S., and Mexico. At Pace | Haub Environmental Law: Sam joined the Pace faculty in August 2025 and taught Climate Change Law and Constitutional Law in Fall 2025. He will also be working with Professor Katrina Kuh to update Pace Law School’s “Environmental Right Repository” on New York’s recently enacted “green amendment.”

Maria Jovita Lambert, Associate Director of Graduate Admissions and International Affairs, Adjunct Professor of Law Education: BBA LLB, Jindal Global Law School; LLM in Environmental Law, Pace | Haub Law Experience: Maria teaches Introduction to the American Legal System and works closely with international and graduate students. She oversees Haub Law’s international partnerships and programs. Her work focuses on climate change, human rights, sustainability, and the role of private actors in global climate governance. She has contributed to international environmental initiatives across academic institutions, international organizations, and grassroots climate platforms.

Research & Scholarship: Maria’s scholarship focuses on international climate law, climate adaptation, business and human rights, and the legacy of colonialism in environmental governance. She has participated in multi-institutional environmental research teams, including a Fulbright-funded Sustainability Action Lab, and has worked on projects examining ecocide, climate litigation, and intersectional legal frameworks. Through the UN Academic Impact Millennium Fellowship, she founded the student-led Sustainability Consultancy Clinic.

She has presented research on climate justice, business and human rights, and state responsibility for climate harms. Recent Activity: Maria’s motion, Strengthening Business Engagement in Climate Adaptation for the Preservation of Biodiversity and Ecosystems, was adopted at the 2025 IUCN World Conservation Congress (WCC).

She also spoke on “Countering the Colonial Legacies of Conservation” at the IUCN WCC, presenting research on climate adaptation as colonial reparation and Indigenouscentered climate action.

Rhea N. Mallett, Land Use Law Center Teaching Fellow Education: BA, Amherst College; JD, Columbia University School of Law; LLM, Pace | Haub Law Experience: An alumna of the Land Use Law Center, and formerly mentored by Professor John R. Nolon, Rhea focuses on the power of local government to promote sustainable development, green infrastructure, and climate resiliency. As a Partner at McCarthy Fingar LLP, Rhea brings to her practice an expertise in land use, SEQRA, and municipal law, helping private clients and municipalities reach their land use goals. Research & Scholarship: Rhea has published on equity-based comprehensive plans as local governments throughout the country create policies addressing former land use practices that contributed to existing income, wealth, and health inequities. Recent Activity: Rhea leads trainings throughout New York State of municipal officials and board members on SEQRA, land use, open meetings law, and ethics. Since 2022, Rhea has also served as a Trustee for the Village of Briarcliff Manor, contributing to her own local government. At Pace | Haub Environmental Law: Rhea earned her LLM at Pace Haub Law, concentrating in Land Use and Sustainable Development. She regularly supervises Haub Law students serving internships with the Federated Conservationists of Westchester and will be expanding her connection with Pace | Haub Law by becoming a Land Use Law Center Teaching Fellow.

† Spotlight on Graduate Research Fellows Our fellows work part-time in one of our programs while earning an LLM or SJD in Environmental Law, with opportunities to work with our faculty and staff on innovative projects throughout the year. Past fellows have gone on to work at Riverkeeper, NRDC, AIG, Connecticut Fund for the Environment, the IUCN, and law firms. Applications for 2026-27 open in January 2026. This year, the Pace | Haub Environmental Law program welcomes: Kiran Chahal, Environmental Law Fellow Education: BA, University of California, Berkeley; JD, Georgetown University Law Center; LLM specializing in Global Environmental Law, Pace | Haub Law Experience: Kiran has served in various international and domestic legal and policy roles, including Durable Solutions Officer

with the UN Refugee Agency (UNHCR) in Bangladesh and Associate Resettlement and Complementary Pathways Officer with UNHCR in Washington, D.C. She has also worked as Assistant Attorney General for New York State, Graduate Admissions Officer at Fordham Law, and Legal Officer with the Jesuit Refugee Service in Thailand. Recent Activity: At UNHCR, Kiran led regional refugee resettlement strategy and casework oversight across the Caribbean and Bangladesh. She has developed and implemented legal and durable solutions for displaced populations in diverse humanitarian and international contexts.

Samuel Carvalho, Pace Energy & Climate Fellow Education: LL.B., Federal University of Ceará; LL.M. in Environmental Law, specializing in Energy and Climate Change Law and LL.M. in Comparative Legal Studies, Pace | Haub Law Experience: Samuel is a Brazilian attorney and legal consultant who recently passed the NY Bar Exam. He serves as the Written Content Vice Chair for both the American Bar Association’s Section of Environment, Energy, and Resources (ABA SEER) Climate Change Committee and ESG & Sustainability Committee. He has worked with the Initiative for Responsible Mining Assurance (IRMA) on sustainability standards and climate policy, and as an associate at Dantas Tax Law Firm in Brazil. Recent Activity: At IRMA, Samuel conducted legal and policy analysis in the mining industry, with a focus on the European Union Corporate Sustainability Due Diligence Directive. Additionally, he contributed to the development of a mining remedy framework to address human rights and environmental harms in the sector.

Pace Environmental Law Alumni Association (PELAA): The Pace Environmental Law Alumni Association (PELAA) offers exclusive access to a vibrant community for Pace | Haub Environmental law graduates. Through PELAA, alumni can engage in a variety of social and professional events, fostering lifelong connections with fellow environmental law professionals. Members benefit from career assistance and guidance, helping them navigate and advance in the field of environmental law. This year, PELAA expanded its Board and created a Mentorship Program, designed to connect alumni with a wealth of experience in the environmental sector with current students eager to explore the field. The Mentorship Program matched 32 alumni with 33 students and hosted virtual workshops on resume building and interviewing skills. @p.e.l.a.a

News! Student Leadership Pace Environmental Law Review (PELR): Established in 1982, PELR was one of the first scholarly journals established in the then-new field of environmental law.

Affiliated with the highest-ranked Environmental Law Program in the nation, PELR is committed to publishing the most influential and innovative scholarship in the field of environmental law. In the 2024–2025 academic year, PELR published Volume 42, featuring three issues and 14 articles. The most downloaded article, “Strange Bedfellows: Guardians for Fetuses and Future Generations,” explores novel links between legal guardianship in the context of climate and abortion litigation. Volume 42, Issue 1 grew out of the 2024 Spring Sustainable Business Law Symposium, uniting leading experts on environmental law and sustainable business practices. Since January 2025, PELR’s blog, Greenlaw, has published 18 posts, with new content every two weeks. In March, PELR hosted the Spring Symposium, “American Tax Policy Institute and PELR Conference on Tax Law, the Environment, and Climate Change” in New York City, featuring distinguished panelists with expertise in tax and environmental law. Several of these panelists contributed to PELR’s Volume 43, Issue 1, Tax Law, the Environment and Climate Change. @PaceEnvtLRev

Pace Environmental Law Review

Pace Environmental Law Society (ELS): As the largest student club on campus, ELS exposes students to the environmental offerings of the Pace community, raises awareness of environmental issues, and fosters involvement in local environmental initiatives. ELS had the privilege of hosting renowned speakers like Filipa Costa, who shared the inspiring story of community-led transformation unfolding in Portugal’s Cova de Beira region, where local organizers have created a promising model for rebuilding local food systems from the ground up. ELS’s newest initiative, Fill-It-Forward, is dedicated to tracking reusable water bottle usage, where every use contributes to charitable environmental and social projects around the world and updates users on projects as they are completed.

Additionally, ELS planted 13 new trees on campus, utilizing native species to enhance biodiversity on our campus. Learn more about their activities in the ELS Annual Report. @envirolawsociety

Student Animal Legal Defense Fund (SALDF): SALDF advances animal interests through the legal system and fosters the growth of the next generation of animal law attorneys. In 2024, seven Executive Board members attended the Animal Conference in Portland, Oregon, participating in impactful panels on numerous pressing issues in animal law and networking with leaders in the field. On campus, SALDF hosted several events such as the “Cruelty Free Beauty & Hygiene Event,” “Representation vs. Reality: Legal Protections for Misunderstood Species,” and, in collaboration with the ELS, “Exploring Food Policy Careers & Pathways.” Additional initiatives included an animal costume contest benefiting a local animal law cause, a shelter supply drive, and a “pet toy” crafting event using donated T-shirts for a local shelter.

New Directions in Environmental Law Conference (NDEL): Pace | Haub Environmental Law was again at the forefront of the annual NDEL Conference hosted at Yale University. Pace | Haub Law student Frances Gothard (2L) was a conference co-chair along with Stephanie Prufer, a Yale Law School student. The keynote speaker was Ali Zaidi, Former White House National Climate Advisor, Assistant to the President of the United States, and Head of White House Climate Policy Office. Additional speakers included Connecticut Attorney General, William Tong, and Professors Nicholas A. Robinson and Camila Bustos. Professor Joshua Galperin was the faculty advisor and delivered closing remarks. The next NDEL conference will be held in February 2026.

Clinics / Centers / Experiential Learning The Pace Food Law Center supports legal services and advocacy, faculty scholarship, and student learning in the field of food law.

Notable Cases / SEQRA Suit: Two significant State Environmental Quality Review Act (SEQRA) victories marked the Clinic’s past year. First, the Appellate Division, Third Department, reversed a lower court’s holding that a development in the last green space along the Hudson River in Troy, New York complied with SEQRA. Highlights: As one of only two law schools that are voting members of the IUCN, GCELS students prepared to participate in the 2025 IUCN World Conservation Congress in Abu Dhabi, UAE. The United Nations Environmental Diplomacy Practicum – a program unique to Pace | Haub Environmental Law – places students in internships with Permanent Missions to the United Nations.

Highlights: The Practicum placed student interns at the UN Missions of Costa Rica and Tajikistan, and with the Permanent Observer Mission of IUCN. / The UN experience offered opportunities to engage in various negotiations and consultations for the adoption of UN General Assembly Resolutions relating to climate, environmental, human rights and sustainable development matters, including the UN Pact for the Future and the UN Declaration on Future Generations, adopted in September 2024. / Student interns supported the organization of the UN World Water Day 2025 high-level event on “Glacier Preservation” at UN Headquarters, marking the inaugural World Day for Glaciers coordinated by UNESCO and the WMO and launching the Decade of Action on Cryospheric Science (2025–2034). In 2020, the Pace | Haub Environmental Law Program launched the Environmental Law & Policy Hack Competition, an annual inter-law school problem-solving competition designed to orient students toward developing practicable environmental policy solutions.

Highlights: In its fifth year, the 2024 Environmental Law & Policy Hack Competition challenged teams to reimagine how capital can be directed toward resilient urban infrastructure while integrating equity, environmental justice, and practical implementation considerations. / The competition drew international teams for the first time, and three finalist teams from Makerere University in Uganda, the University of Pittsburgh School of Law, and Chapman University Dale E. Fowler School of Law, were selected from a competitive pool of applicants. / The University of Pittsburgh won with a proposal to convert underutilized vacant land into bioretentive green infrastructure, funded by a newly enacted stormwater fee and piloted through the University’s Environmental Law and Policy Clinic. The winning team received $2,000 to begin implementing their proposal. / Teams were evaluated for innovation, feasibility, and impact by a distinguished panel of judges: Anya Freeman, Founder & CEO of Kind Designs; Professor Keith Hirokawa, Distinguished Professor of Law at Albany Law School; Professor Eugenie Birch, Lawrence C. Future Environmental Law Professors Workshop: Every fall, the Future Environmental Law Professors Workshop brings together visiting assistant professors, fellows, researchers, law clerks, and practitioners together to learn about the environmental law teaching market. The Workshop covers a wide array of subtopics within the field, from animal law to energy law, along with the history and development of environmental law and is designed to give advice, insider perspectives, and feedback on the hiring process, along with opportunities for mock interviews and job talk presentations. Hudson Valley Hispanic Bar Association’s Trailblazer Award: Professor Camila Bustos received the “Trailblazer Award” in September 2024 from the Hudson Valley Hispanic Bar Association (HVHBA) as an honoree in academia. The award ceremony honored several attorneys of Hispanic descent working in various fields.

Feng-Shan Ho Prize for International Human Rights Scholarship: Fall 2024 Visiting Assistant Professor of Environmental Law, Paul Rink, received the Feng-Shan Ho Prize for international human rights scholarship at the Asia-Pacific Research Forum held in Taipei, Taiwan in July 2025 for an upcoming publication about the correct judicial standards and remedies for climate rights litigation.

Riverkeeper’s Big Fish Award: Pace | Haub Law alum, Basil Seggos, was honored with Riverkeeper’s 2025 Big Fish Award for his leadership in protecting New York’s environment and advancing bold climate and clean water initiatives. As the longest-serving Commissioner of the New York State Department of Environmental Conservation, Basil helped shape landmark environmental policies including the Climate Leadership and Community Protection Act, the $5.5 billion Clean Water Infrastructure Act, and the nation’s strongest water quality standards.

Garrison Lecture on Environmental Law at Pace | Haub Law. His lecture, “Back to the Future for Climate Liability,” explored pressing questions on climate state superfund laws. Pace | Haub Environmental Law Distinguished Junior Scholar Award: Professor Sonya Ziaja, University of Baltimore School of Law, received the 2024-25 Distinguished Junior Scholar Award, recognizing emerging junior environmental law professors for scholarly excellence and promise. Her research focuses on the overlapping areas of environmental governance, law, technology and society. At the 11th Annual Future Environmental Law Professors Workshop at Pace Haub Law in Fall 2024, she delivered the keynote address on “A qualitative empirical assessment of whether and how environmental constitutional rights matter to state natural resource managers.”

Alfred B. DelBello Visionary Award: In November 2024, distinguished Professor Emeritus John R. Nolon, founder of the Pace Land Use Law Center, received the Alfred B. DelBello Visionary Award for his pioneering contributions to sustainable land use and smart growth policies that have profoundly shaped the field and the region. The award honors Alfred DelBello’s legacy of public service by recognizing leaders whose vision and dedication shape a more sustainable future.

Nicholson Robinson Award for Distinguished Environmental Achievement: Pace | Haub Law alum Pete Casper received the 2025 Nicholas Robinson Award for Distinguished Environmental Achievement, recognizing alumni who have made significant contributions to environmental law.

Pete has dedicated his career to environmental governance and sustainability and is currently serving as Assistant General Counsel for Relicensing and Implementation at the New York Power Authority.

Elisabeth Haub Awards for Environmental Law and Diplomacy: On October 24, 2024, Pace Haub Law conferred the 2024 Elisabeth Haub Award for Environmental Law and Diplomacy on Singapore’s Ambassador for Oceans and Law of the Sea Issues and Special Envoy of the Minister for Foreign Affairs, Rena Lee, and Senior High Seas Adviser to the IUCN, Kristina Maria Gjerde, for their unwavering commitment to ocean conservation and their instrumental roles in the 2023 UN Agreement on Biodiversity Beyond National Jurisdiction. The 2025 Elisabeth Haub Award for Environmental Law and Diplomacy is jointly awarded to Professor John H. Knox and Dr. David R. Boyd for their groundbreaking efforts as successive UN Special Rapporteurs on the human right to a healthy environment. Together, they have profoundly shaped the field of international environmental law by laying the foundation for the recognition of the human right to a clean, healthy, and sustainable environment. Their work as Special Rapporteur, Professor Knox from 2012 to 2018 and Dr. Boyd from 2018 to 2024, has been instrumental in inspiring legislative, diplomatic, and judicial support for environmental rights around the globe. Their lifelong commitment to advancing environmental law and human rights has had lasting impacts from international legal frameworks to community-level empowerment.
