MAKING YOUR MILES COUNT Robert D. Scheper

Investing in the Intangible to Survive the Long Run Nearly two decades ago I had the occasion to attend a small claims court case between an Owner Operator and a carrier. My client’s case (the Owner Operator) was straight forward. The carrier refused to pay the operator for miles as well as an insurance claim that clearly belonged to him (the Owner Operator). The details of the case are available in story form in the first chapter of my second book “Making Your Miles Count: Choosing A Trucking Company”.

came together in a rather comical dance trying to educate the magistrate on carriers, highway tractors and freight movement.

He had no clue how store shelves were restocked. He had never even considered that freight, other than that which he had seen on trains, needed to be moved. He had always wondered what those big, rolling boxy things on the highway were.

After five minutes he thanked them both for their information.

The plaintiff (the Owner Operator) began his argument by outlining the operator carrier contract and then over- viewing the documents regarding missing pay and the insurance claim issue. About 45 minutes into the presentation, half way through the insurance claim story, the magistrate held up his hand and asked for clarification. “... this truck you keep talking about, it’s not a half ton truck?”

The details of the conflict were then further articulated, and it appeared from the magistrate’s responses that he understood the conflict that the contract presented.

In his final questions he nailed down the issues in what I thought was a clear, logical and simple form. After the presentation, both parties left and were scheduled to return to hear the verdict.

Both the plaintiff and the defendant looked at each other in stunned disbelief. After a few minutes of back and forth explanation, it was clear that the magistrate had little to no understanding about the transportation industry. Both the plaintiff and defendant

Two weeks later the parties were again standing together before the magistrate.

The verdict was read, outlining the steps of logic the magistrate used. The problem was, the verdict’s logic was indescribably irrelevant and read like it was the summary of a completely different case. It referred

to things that weren’t even testified to and was clearly baffling to both parties.

As the informal setting of small claims court sometimes allows, both the plaintiff and defendant asked for clarification on points during the summary, trying to determine if he was even reading the right case. However, once the verdict in favor of the defendant (the carrier) was stated, the plaintiff was left alone asking for assistance. He was soon shut down.

In the hall, after dismissal, the defendants were openly laughing as they left. They certainly won that battle.

The case was then appealed under a different magistrate and was settled in favor of the plaintiff about nine months later. The experience taught me a clear lesson about justice; sometimes, there are incredibly strange events and outcomes. To be successful on your day in court, it may very well take two… or more.

The carrier in this case is no longer in business. The President declared bankruptcy less than two years after these events and neither he nor the Vice-President are even in the transportation industry (to my knowledge). They may have won that battle, but they lost the war.

Nothing Is More Expensive Than Missed Opportunity

A few months back I wrote an article that suggested that fleets have, from time to time, the opportunity to share in financial gains with drivers, and that to do so was something that makes perfect sense. I’m talking about paperwork compliance, HOS, speed limit policies, on time performance, fuel consumption etc.

When these positive things happen, the carrier makes more profit that was hidden from them in the past; and they get this profit by the actions of the folks in charge of the equipment - the drivers.

So how do they reward these folks? They do it by sharing their newfound gain. It is a win-win-win.

The carrier makes more money, the driver makes more money and now that same driver has skin in the game which hopefully engages the driver who is then less likely to go looking for a new employer.

So why aren’t more carriers doing this type of thing? I’m not sure but it might be that they feel it is too complicated to get started. Might it be that they are resistant to change? I see this in carriers all the time. They may be too caught up in the whirlwind of the day to day activity of being a busy motor carrier. It could be any number of things.

For those of you who read my ramblings you would know that I do very few product reviews.

It’s just not my thing. But after I wrote the winwin article I was contacted by a company who asked if I would take the time to look at their product and give them my honest opinion on it.

I like all the new technologies that are coming out and I wish I was better at understanding the intricacies of them than I am, but I am always interested in expanding my horizons, so I agreed.

I’ve got to tell you I really believe that these folks have an outstanding product. I looked at it, I vetted it through a couple of industry experts for their opinion and they whole heartedly agreed. This product is the perfect thing to get your gain share efforts started with drivers and it is super easy to understand and to install. The name of the company is Vnomics. I chatted with the President and learned of their beginnings, which as it happens, evolved out of the defence industry and has now morphed its way into a commercial application focusing on Class 8 vehicles.

What these folks have is a technology that is a small box that is wired into the ECM, which is almost invisible. The magic happens in two phases. The first thing that happens is when the

And in fact, the savings are exaggerated because the truck is being driven more efficiently. In addition, fleets could expect less downtime, less maintenance expense and less wear and tear on the power units because it is being run in the sweet spot for that power train more often.

technology learns the attributes of the engine, the drive train, the weight of the unit, among other things and determines what the optimum driving habits are for that truck to perform in that environment, at 100% fuel efficiency. This is where the driver comes in. While the unit is learning the attributes of the vehicle, which takes anywhere from a few days to a week, it is also learning the driving technique of the person behind the wheel, how they shift, average speed etc. Once the unit has enough data, it enters its second phase and this is when it turns into a coach. What I mean by that is if a driver over revs the engine, a small audible sound will take place telling the driver that fuel is being wasted. When the vehicle exceeds company speed policy, the same thing happens.

Also, if engine idling is excessive, an audible sound tells the driver. You get the idea.

Again, I don’t usually endorse products, but I can’t help myself with this one. One of the reasons for this is because I remember how I struggled to bring this type of scenario into the fleet I was running some time back. How do you do it if you’re running a fleet that has a combination of flat beds and vans with weights that vary from 125,000 lb multi-axel and then go to van applications where your biggest customer averages 25,000 lb payloads, let alone discuss the geographic differences? All we could do was show the driver where they stood compared to their peers. With this product, it’s easy to share gain with the entire fleet as a percentage of maximum potential efficiency.

In addition to all these audible noises, the unit will tell the driver when the truck shuts down exactly what percentage of efficiency the unit performed at.

So, to play it out, if your new Vnomics technology shows you that the fuel efficiency percentage of your fleet, is at let’s say 90%. And you know your cost of fuel and for easy calculation, it’s $3.00 US a gallon and your fleet average MPG is at 7.5, that is .40 cents US per mile @ 1.30 exchange = .52 cents per mile Canadian. Vnomics could help your fleet get from 90% to say 98% and that would be an 8% increase at .52 per mile and that is a 4.16 cent per mile savings. Assuming the truck does 10,000 miles per month or 120,000 miles per year per vehicle, that equals to $5,000.00 in savings on a single truck.

Should We Promote Same-gender Training Policies?

Imagine you are a 24-year-old female who decides to become a professional driver. You attend a truck driving school during the day for three to six weeks. You proudly display your newly earned commercial driver’s license to the recruiter, who promises you a great job with new equipment and a friendly dispatcher.

You then learn that you need to go out on the road with a trainer; a 58-year-old man with whom you will be sharing the cab of a truck, including the bunk area, for the coming weeks.

Regardless of his clean record, his paternal demeanor or his soft smile, the thought of sharing a small space with a stranger of the opposite sex could be terrifying.

A recent 20/20 segment hosted by Diane Sawyer titled, “My Reality: A Hidden America” interviewed women who had been sexually assaulted by male trainers. One was told she would have to have sex with her trainer before he would “pass” her. Some of these women told Sawyer they carry knives and other weapons for protection.

Is this the industry we are promoting to women? Would you encourage your daughter to enter an environment that pairs men and women in a training situation with a sleeper bunk only inches away?

Some carriers have taken steps to minimize the possibility of sexual harassment by training women in day cabs which allows them to return home each night. Others have turned to a same-gender training policy. Prime, Inc. adopted the same gender training policy in 34 • OVER THE ROAD

2003 after the EEOC filed a Title VII violation against the carrier for sexual harassment toward a female trainee.

Prime Inc. was then (again) found guilty of violating Title VII because its policy discriminated against women because some female trainees faced a delay in obtaining a female trainer. The Equal Employment Opportunity Commission (EEOC) claimed the company “denied employment opportunities to [women].”

The EEOC attorney went on to state, ‘women are entirely capable of understanding and assessing the risks of truck driving.’ Really?

Does it seem reasonable that women be expected to deal with unwanted sexual advances because they are “CAPABLE OF UNDERSTANDING” these risks?

This claim is alarming in so many ways. How can we, as an industry, expect women to be fully prepared for sharing a very small space, which includes sleeping quarters, with an unrelated individual of the opposite sex? Did the court even consider the proximity of the sleeper berth in its decision? They should.

Recently I learned about research done by Dr. Jennifer Hirsch and Dr. Claude Mellins who spent years interviewing college students to better understand “how the hidden forces of campus ecosystems [affect] how and when assault happens.” They learned that when students socialize in dorm rooms where a bed is present, the incidence of sexual assault increases. The claim is that sex is often enabled JULY 2018

by opportunity. I reached out to Dr. Hirsch to ask for her insight into how the proximity of a bed in a training situation could increase the incidence of sexual assault for professional drivers. She has agreed to work with us to better understand these issues as they apply to our industry.

Since the EEOC won its case against samegender training policies in the court, we are asking for legislative solutions to this issue.

Congressman Michael Gallagher (R-WI) has agreed to support this action and is currently working on a way to include the Bona Fide Occupational Qualification into future legislation. We recently gave Congressman Gallagher a ride-along with a female driver to better understand these concerns.

Women In Trucking Association understands that not all carriers can or want to adopt a same-gender training policy. But we assert that they should have this OPTION if they so choose. Consider the example of the Hooters chain of restaurants. Whether you eat there or not, you’ve probably seen the skimpy tank tops and short orange shorts worn by the (female) servers. How can Hooters limit their criteria to women only?

If you are willing to provide your support for the OPTION to invoke the BFOQ to support the opportunity for a carrier to adopt a samegender training policy, please contact me (ellen@womenintrucking.org). The more industry support we have, the better our case will be to advance this issue.

There is a way for an employer to discriminate under a provision called the “Bona fide occupational qualification” (BFOQ). Hooters defended their hiring practices by claiming their “restaurant concept…includes certain ambiance requirements.”

We are not asking anyone to change their training process. We are only seeking relief for carriers who CHOOSE to adopt a samegender training policy in the future. Your backing will help. Will you help us ensure a safer environment for future trainees with your support? I look forward to hearing from you.

The Bona fide occupational qualification allows employers to consider a quality or attribute in hiring that might constitute discrimination in other contexts. For example, airline pilots face mandatory retirement at age 65. A male clothing manufacturer can specify a male model for advertising purposes.

Perhaps we should consider allowing carriers to use the BFOQ for training purposes IF THEY SO CHOOSE. There’s no “one size fits all” solution, so the fact that Hooters hires female servers doesn’t mean Olive Garden must do the same. It’s an option.

SCOTT BIDDLE, President, Scotlynn Commodities

The story of Scotlynn Commodities begins on a small, family farm in the community of Vittoria, Ontario which is south of Hamilton on Lake Erie. While Scott Biddle, President of Scotlynn knew farming, he also always had a passion for trucks and machinery. Early in his career he worked for a few years at the Toronto Food Terminal where he made many connections with produce buyers and gained valuable knowledge in the logistics business. These early connections in tandem with his diversified knowledge of farming (as he had worked for many years on the family farm) and his knowledge of trucking (as he had driven for several years), combined with his drive to succeed is why he and Scotlynn are celebrating twenty five years of consecutive growth since Scott began Scotlynn Commodities. Scotlynn’s initial business plan was to be a for-hire carrier servicing local farmers and floral

producers. Today, Scotlynn Commodities operates over 500 pieces of equipment throughout North America and employs well over a thousand people in North America.

So what began as a family farm in the 90’s has now grown into one of Ontario’s largest farming operations. Their logistics company in the US; Scotlynn USA, has five locations – three locations in Florida, one in Georgia and one in Indianapolis, Indiana.

Evolving from this, Scotlynn began SweetPac as their preferred brand for their premium, sweet corn grown in Canada and the US. This includes multiple farms and pack houses across North America where Scotlynn controls each stage of its products from the seed in the ground right to the grocer’s dock.

In addition to corn, Scotlynn is the largest grower of asparagus in Canada with over 450 acres under cultivation. They are also the largest grower of Jack-o’-Lantern pumpkins in Canada and one of the largest growers of ginseng, most of it being shipped to China.

City, Newfoundland. Cain’s Quest is a true northern adventure that gives racers the experience of a life time. Racers push body and machine to the limits in an all-out race to the finish for a shot at a hefty prize purse. Teams will travel through a variety of topography, deep snow, thick wooded areas and wide open frozen lakes. Teams must make it through each checkpoint and stop at mandatory layover points in various communities along the way. Not everyone who leaves the start line will cross the finish line. Scott has competed in this six day race three times. The first time he did not finish, the second time he finished fourteenth and last year he came third. The race runs day and night guided

by GPS and gut instinct to get teams from checkpoint to checkpoint. This event requires a solid strategy, top gun riding skills, the will to keep going, a tough, dependable snowmobile and a whole lot of luck!

Scotlynn was recently recognized by Loblaws as the 2018 Carrier of the Year award.

Over the past twenty five years, Scotlynn has grown to become a leader in the industry.

At the head office in Vittoria, the company has a work culture built around fitness and wellness. A personal trainer is on staff and most of the staff partakes in a thirty minute daily workout on company time. Scott states, ”When I first thought of introducing this program, I thought, I’ve got to pay them to do it and they’ve got to do it during their workday because people are not going to come in for a workout before or after work.”

Rounding out the fitness program, Scott hired a trained chef to join the company to prepare nutritious lunches and snacks every day – free of charge. “With the staff exercising and eating better and with better portion control, the culture within the office is much better,” states Scott. “We strive to be the best in the industry and every day we look at ways to improve morale in the company and these two programs definitely have helped.”

Scott also loves boating on Lake Erie in the summer and has taken his boat to Florida on the intercostal waterway. He also builds show trucks to exhibit at truck shows. But his real love is his family and farming. Scott and his wife Julie have three children; Cloey 13, Brennan 12 and Emersyn 11. All love to snowmobile with their Dad.

Scotlynn will continue to do logistics/ farming/transportation going into the future as the company has grown year over year in its first twenty-five years. “People will always need to eat perishable foods and we have not had a down turn in any of the years we have been in operation so, we will continue to grow all three areas”.

Scott is 43 years old and hopes his children have an interest in the business, but it will be twenty years before he even thinks about life without his business. “I love the assets of our business and I love trucking. Every now and then I jump in a truck and run a load. I even ran a load to Florida with my wife!” Scott ends by saying, “my passion for farming and transportation will keep this business growing and healthy for a very long time.”

We asked Scott about his hobby of snowmobiling and racing. In 2014 he began training for the Cain’s Quest Snowmobile Endurance Race which has been described as the ultimate in extreme racing. At 3,100 km of high energy racing in 2018, this race is the longest race of its kind in the world which is held in Labrador JULY 2018
