6th Annual Slow Down, Move Over Rally

Wes Passmore, owner of Classic Towing & Automotive, held the sixth annual “Slow Down, Move Over” rally on December 4, 2022. This rally starts in Hueytown, Alabama followed by a parade of 150 + trucks to Tuscaloosa, Alabama. The rally had everyone taken care of with food trucks, bounce houses for the kids, live music, first responders and towers from across the state. This event continues to grow attended by many tow owners, family members, local fire, and state police. The rally helps to spread the word and educate the public on the dangers facing our responders, and the loss of life that is happening from careless and distracted drivers.

This loss, unfortunately, Wes Passmore knows too well

having lost his driver, John Hubbard, to a motorist who failed to move over one lane, striking and fatally injuring John. Wes has led a tireless journey to inform the public of the dangers towers face when responding to motorists. With the event’s growth, sponsorships have increased.

Bambarger Wrecker 50th Anniversary

Dec 2022 marked the Anniversary of a dream that Chester Bambarger grew since being a little boy. This was kicked off by a celebration at Bamberger’s: Adam and Heath brought in a band, terrific food, axe throwing, corn hole, slides for the kids, and friends and family from throughout the southeast.

This story began as a dream and passion of Chester’s and blossomed to his sons. Heath Bambarger, Chester’s oldest son began working fulltime for the company in 1993 after graduating from high school. Heath remembers his first day on the job when his dad Chester told him to get a shovel and start filling all the potholes in the lot. It is an alarming fact of business and surprises many tow company owners have when that deep realization of the staggering liability issues they deal with on a daily basis faces them. Everything seems to come at you, from tow damage, to towing invoice amounts and billing, to pre-authorization for shop work and shop damage, if they’re so equipped.

The old adage “an ounce of prevention is worth a pound of cure” couldn’t be more true in today’s litigious society. To use the politically correct version, it’s all about “CYB” or Cover Your Backside.

As an advisor to tow companies and shops, my first

order of business is to look at their towing invoices and shop repair tickets to make sure they have the language necessary not only to protect the company from false liability, but also to advise the consumer of the bill or estimate/potential bill, and make sure the company can collect without issues – and in the event that you have a dispute, you’re fully protected and can bring in the money you should.

I’m not trying to over-simplify, but many incidents can be prevented with forethought. If you don’t give an estimate, and your consumer has never worked with you, you must realize that they have no idea what your

rates are, your operating costs/overhead, additional charges allowed or required by your city or state – and you present them with a bill, and they lose their minds. Can you really blame them? They truly had no idea what you were going to charge. How many times have you heard the

question “why so much, you only towed it 5 miles?!” – when you know that’s a standard fee schedule based on your police contract rates – but how would a consumer know about these rates? Please don’t expect them to know...

The same is true in a repair shop

– unless an estimate is given and signed by the consumer, it is law in many states that the consumer does not have to pay your bill beyond basic diagnostic charges. I dealt with a scenario in Pennsylvania where a kid owned a car, the shop made it “fast and furious” to the tune of $15,000 invested, but never got a signed authorization for the work –all over the phone from New Jersey. Seems the kid thought that he wouldn’t have to pay for all the modifications and 300+ hours of labor since he never signed anything and was never asked for a deposit. The shop finally recouped the money, but only after a year-long fight and $5,500 in legal fees and a lot of bad publicity. A signed mechanic’s repair order with an estimate, and a faxed signature on increased estimates would have given the shop the upper hand to keep the car until the bill was paid, with little or no extra time for the shop owner.

Tow operators have a unique job, in that many times, you’re towing a vehicle for someone who is upset or downright angry. They see shiny tow trucks and figure the company has deep pockets, so that dent, scratch, or scrape that was already there now becomes the tow company’s responsibility, and unless you can prove otherwise, you’re paying a claim. Take photos from several angles before hooking up. Make sure to note damage on the tow invoice and get separate photos of damaged areas. Many companies have gone to onboard cameras for this reason. Make sure your folks are well trained in the CYB principle and watch your liability costs drop. Your insurance agent may even lower your rates if you show that these measures are in effect in your work. Be safe out there, and CYB!

When I started TowTrax, I knew I had a great idea that would change the industry. I had a strong developer, and a few good people to help me with the tow companies. I knew I needed a big investor to help me get this off the ground. Other companies had investors willing to give over $50 million. I held a meeting at my office building and invited all the tenants to come and see a demo of my product. I had 22 people in the room, and at the end of the meeting I had three major investors who were willing to invest in TowTrax.

I thought we were on our way when the next day covid hit; all my investors went and hid. I needed money to keep on going so I looked for other ways to get it. I called on the following:

Our goal was to raise $240,000; I was able to raise that. I had good luck with friends and family; they are rooting for me to succeed. Investment firms were a waste of time. I saw an ad on Facebook from an investment firm that would lend me up to $5 million. I filled out all the paperwork and jumped through all their hoops. They came back and said they could lend me $118,000 paid over 18 months with weekly payments and an interest rate of 29%. Once I applied with them, I heard from no less than ten other companies all wanting to lend me money. It was crazy with the deals they offered. High interest rates with short term payback.

I decided to go to banks. They have lots of money. Again, a waste of time. If you don’t need money, they will give it to you. They wanted a personal guarantee from me on the loan. If I had a personal guarantee, I would not need a loan.

My next step in looking for seed money was tow companies. I thought I could raise money from the industry. We wanted to raise one million to keep us going. I reached out to tow companies because they saw what I had developed, and they knew there was a need. I set up a plan

where these tow companies could purchase stock. I had a tow company in Oregon, that I did not know, purchase $375,000 in stock. He is now one of my best friends. Another investor in Alabama purchased $100,000 in stock. Another investor in Texas purchased $100,000 in stock. He had already invested $200,000. I had tow companies in Minnesota, Michigan, Ohio, Pennsylvania, Wisconsin and another in Texas, all of which I did not know, purchase stock in TowTrax. We raised our million.

I thought we were out of the woods when the price of gas shot up. This kept consumers from traveling, and tow companies cutting back on their tows because of the gas price. When our volume dropped, our revenue dropped. This made it hard to operate and grow because I needed money to grow. There were two companies that had over $50 million in investments, and they are struggling. They came to us for help. We have added them as customers, and this should triple our growth along with three other potential customers we are adding.

This is good for the tow companies because we are sending them more tows. We are expanding our markets from 13 states to 31 states and from 17 cities to 151 cities. We are adding tow companies every day as we continue to grow. Our projections for 2023 are outstanding. For our investors, the price of the stock has gone from $1.19 a share to $2.00 a share and should continue to increase in 2023.

With volumes increasing, this also means our expenses are increasing. That means we need more money. We are talking to several venture capital firms all showing a high interest in either investing in TowTrax or purchasing TowTrax. These deals

All of this being said we are proud of what we accomplished. Starting a business from scratch with no working capital, a pandemic, and a gas shortage while still having the success we are having is incredible! Lots of towers know John Weaver who lives and serves the city of Canton, Georgia. John was also a trainer and did a fine job for Wreckmaster for many years. John and his wife, Debbie Mauldin Weaver, and their daughter, Angela, manage Mauldin Body Shop & Towing.

John’s decorated truck has become a tradition in Canton, Georgia. People expect to see it multiple times a week during the holiday season. The other night, as my wife and I were driving to watch our granddaughter sing at a local park with the 4th and 5th grade school choir, Sheila mentioned that John’s truck was only a couple of cars ahead of us. This truck attracts attention because it’s very hard to miss during the Christmas season. Most of you probably call him, Johnny.

John and his family have been showcasing his lighted truck at Christmas since 2011. Folks, John’s truck is fully equipped from top to bottom and front bumper to rear of

the truck. A sight to behold, not one square inch is missing lights. A few years ago, when I traveled with John during the evening, he would wear a Santa hat and present gifts to many poor families in Canton which in turn gave him a chance to talk to them about God. They tried to come up with a process so the lights would stay in place. Today, PVC pipes outline the Body of the Truck. As Weaver says, “after weeks of heating and bending pipes to fit the wheels and obvious contours of the truck, the lights were finally ready to be attached.” Nestled, Christmas lights make the truck hard to miss. Not only is this truck gleaming with brightly colored lights, but it also plays Christmas Carols.

Here’s how the International Towing and Recovery Museum refers to John’s truck: “Christmas Pete.” It’s basically called “Christmas Pete” because the truck is a Peterbilt truck with a 60-Ton Century Rotator. At Christmas time, this monstrous truck stands out with 175,000 LED lights, powered by two onboard generators, a holiday

music sound system consisting of a mixer board and iPod, and five 1,000WATT amplified speakers.

Every year, John’s team adds more lights and just this year “Christmas Pete” has 187,000 LED lights. John’s favorite part is the Christmas tree on the back of the truck and how the boom is now wrapped in blue lights which offers an inspirational message. “When you wrap it and put a tree on it, there appears to be a cross behind the Christmas tree and the cross pops so much that a person gets the message that we couldn’t have Christmas if we didn’t have the cross in the first place.” An empty cross symbolizes hope and joy for Christmas, and we know this as birth, rebirth, and redemption.

John told me, “It is still all for fun.” Lots of people know his truck, and they also know who owns it. John and Debbie’s granddaughter, Sierra, and their daughter, Angela, ride along and give out candy canes to children who stop by the truck.

Whenever the team goes to dinner, “Christmas Pete” is parked in the Walmart parking lot with lights on and music playing. It’s a wonderful backdrop for families to use for group photos. Everyone enjoys seeing, hearing, and being around John’s truck at Christmas. Chad, Angela’s husband does most of the driving these days.

Two weeks before Christmas, the truck is out every night. Families all over Canton call dispatch, asking where the truck is going to be. Due to the truck’s popularity at Christmas, the Weaver family is well-known in Canton. Even more importantly than seeing the truck is watching John’s leadership skills unfold. I have come to know John as a wonderful, Christian man who truly cares about his family and his neighbors. John makes the name of a towing family better because of his actions.

John Weaver was placed into the Hall of Fame in 2016. It was my privilege to be in the audience. Every time the museum inducts another

tower into the Hall of Fame, each inductee is given a sequential number. Appropriately, John’s number came up as John 316. That number is special to John and his family, and we can certainly understand why.

I told you that Johnny Weaver taught lots of Wreckmaster classes for many years. He ended every class in the same way. So, let me end this

The 701 slides in, is now available with neg and power tilt. The unit is based off Dynamics 701 wrecker. With the same Cyds, valves and steel parts as a regular wrecker. These units are made for the professional towers, not the weekend warrior. The Survivor Fund

The “Survivor Fund” was created in 2006 to complement the International Towing and Recovery Museum’s Wall of the Fallen. This fund was established to help those families who have lost a loved one in the line of service.

A Survivor Fund committee was formed of people from all over the United States from the towing industry. The committee is given the information regarding the fallen and the application is processed within 24 hours of receipt. Once the decision is made, a check is sent right away to the family to assist with immediate nancial issues during this tragic time in their lives.

Company owners, family members, or friends can submit the application for bene ts on behalf of the family of the deceased. The application can be found on the website at www.thesurvivorfund.com and can be submitted by mail, fax, or e-mail.

They can be driven at a max speed of 5mph and primarily to move vehicles on and off tow beds, drive on lots, and into body shops for vehicle repair.

The 45 S is a new and improved version of the award-winning GUNIWHEEL 45. We have listened to feedback from the industry and made a stronger, more efficient shop wheel solution. We have greatly increased the offset of the wheel to a staggering 94mm, an increase from 51mm from the original model. With the new amount of offset, GUNIWHEELTM 45 S allows free rotation of the wheel on vehicles with large performance brake calipers without the need for a spacer, a needed upgrade for high-end sports performance vehicles. We also increased the strength around lug hole area by adding a 6mm metal plate to the back of the wheel. This connection point places the axle being lifted in the middle of the effort being used to lift the truck for towing. Less effort is needed to lift heavy weight. Once lifted, the truck in tow is secured to the booms creating a rigid connection. The truck in tow simply becomes a semi-trailer. Weight transferred forward is properly imposed down onto the fifth wheel. This is how your tractor is designed to work and means no overloaded drive axles. Other fifth wheel attachments are attached in a fixed manner to the after frame of tractor they are mounted onto and use a traditional stinger to lift at the axle directly. The lifting effort is out at the end of the stinger. This means the rearmost drive axle sees most of the weight and in many cases becomes severely overloaded.

• No Special Tractors or Modifications Needed – A TruHitch can be connected to or disconnected from any tractor in just a few minutes. The Tru-Hitch is simply connected at the fifth wheel, and when transported uses a small set of integrated travel legs that rest on the after frame of the tractor. When disconnected, the Tru-Hitch is free standing, without the need for support arms etc., ready to back under the next time you need it. Because the Tru-Hitch properly places weight onto, and pivots at the fifth wheel when towing, there are no special mounting brackets, binders, or fixed mounting points needed. Also, because towing with a Tru-Hitch places weight properly onto the fifth wheel, there is no need to stretch the frame of the tractor in an effort to get weight forward off the rear axle. Nor does a Tru-hitch need to have additional lift axles added to safely lift tow.

• No Lightened or Unsafe Steering when TowingBecause the load becomes a semi-trailer when using a TruHitch, the steering axle of the towing tractor actually GAINS weight! Your tractor acts normally. This leads us to another important point.

• No Uneven Braking – Because there are no overloaded drive axles and the steering axle stays properly planted to the road this means the brakes are evenly loaded. This keeps your driver, the load, and the people traveling near you safer.

• There are no pinch points when towing with a Tru-Hitch – Towed loads are secured to the Tru-Hitch booms and pivots at the fifth wheel. You can make turns at up to 90 degrees without worrying about pinch points. And just like a trailer, the load follows you around corners. Other under-lifts that pivot at the stinger mean maneuverability is limited. When you turn left the load wants to go right and vice versa. This is never an issue with a Tru-Hitch.

• Cost- Traditional tow trucks are heavy, long, and expensive to operate. Other fifth wheel attachments require modified wheelbase tractors and complicated bracketry to mount and use. A Tru-Hitch comes complete, ready to attach to a standard tractor, with no special mounting requirements or additional cost. It can run on its own self-contained hydraulics, or connect it to a PTO, it’s your choice. Radio remote control and rigging items are included. Big personal insurance companies spend billions each year on TV ads convincing people that price is all that matters when shopping for insurance. In the commercial world, that is horrible advice. Instead of shopping for the cheapest insurance, you should be shopping for the right insurance agent. Just like not all insurance is the same, not all agents are the same. Towing is a niche market for us because Hal Kresser, the agency principal, is very interested in the industry. He worked for a towing service when he was young and even today he is Wreckmaster Level II certified and can operate your equipment. Can your current agent do that? Hal is also involved in the industry. He is an active, participating member of the Towing and Recovery Association of Ohio. In fact, he is so well respected that he was nominated and elected to be president of the local region and is currently serving his fifth term. Before he was an insurance agent he spent 20 years as a cop. He is certified in accident reconstruction and knows the laws and how to deal with police officers. He’s good to have as an advocate in some of the collision claims that happen when there are disputes as to fault and he can help you decide when to fight traffic tickets and violations and when not. For example, we had one two years ago where a person on a bicycle rode into the side of a rollback that was making a right turn. The police officer listed the driver at fault for violating a crosswalk. After talking to the driver, Hal learned that

the bike hit the truck by the back axel. That meant the truck was almost fully through the turn before being struck. That makes it the bicyclist’s fault. He contacted the traffic supervisor and discussed how the report was improperly written and explained why it was not the driver’s fault. The supervisor agreed and got the officer to re-write the report correctly. This saved the customer from having a chargeable accident on his record and saved the insurance company from paying a personal injury claim. Claim adjustors are trained to take a police report as gospel. Unfortunately, not all crash reports are written correctly. Hal has the experience to know and can help when it happens to keep our clients from being unjustly charged with accidents.

When you choose the right agent, he will be able to place you with an insurance carrier that best suits your needs. As an independent agent we have the ability to add new companies that enter the market. We have seen companies come into the towing market for a few years and then get back out. When that happens, you can lose your insurance through no fault of your own. A good agent is on top of that and can make transitioning to another carrier seamless. You need to build a relationship with your agent. He can help you decide when to file a claim or when to pay out of pocket. He can advise you on ways to keep your rates down as well as help you implement plans to avoid liability claims. We recommend things like putting cameras

in the trucks to document crashes. They can be invaluable in situations where fault is in dispute.

Choose the right agent and build the relationship on trust and integrity. The agent should be viewed as a stakeholder in your business. In a recent Google review of our agency, Tiffany Corey of John Wayne Towing wrote “even when we were told there was no hope by everyone else, they didn’t give up and kept pushing forward. I work for John Wayne Towing and we are a small company so something as major as insurance can really make or break a company. So, if you are needing insurance, I would highly recommend giving them a chance.” You need a good, well managed insurance portfolio to help your business be successful and the agent needs your business to be successful to make his business successful. If you are contemplating any big expansion plans such as adding a new building or moving to a larger facility in another part of town, or adding more trucks you should involve your agent during the planning stage to find out in advance what the impact on the insurance will be. Many times, I get the call to add something like a building, a second location, or a 50 ton rotator to the policy after the fact. Then the insured is upset when he sees how much it costs. Now it’s too late.

Is your Comprehensive and Collision coverage for your power units and/or trailers written on a Stated Amount or Cost New (ACV) basis? Not knowing the difference could cost you thousands at the time of a loss.

Imagine, your prized heavy-duty wrecker was just the subject of an unforeseen accident and your insurance company has deemed it a total loss after identifying the extent of the damages. How and on what basis your full coverage (comprehensive and collision) insurance was written could be the difference between being in an equity or inequity position which could ultimately cost you thousands. According to their contract, the insurance carrier owes the fair market value toward the replacement of the insured power unit regardless of how much is owed to the respective lienholder. If your policy is written on a Stated Amount basis, that amount is the MOST the insurance company will pay, minus your deductible toward the replacement of your power unit regardless of its fair market value. Conversely, if your policy is written on a Cost New basis, the insurance company will pay the fair market value even if it is more than what is listed as the COST NEW amount on the actual policy.

Given the same example, if the policy is written on a Cost New basis, the insurance on a Stated Amount basis, you should review the value listed on the policy with your insurance agent to make sure it corresponds with the fair market value. Since power units depreciate, it is vital to adjust these values downward annually with your representation on an annual basis. If your agent sits down with you at renewal, that is the perfect time to work out these fine details. Also, and of note, when a power unit is added by endorsement during the policy term, be certain to let your agent know the value of the power unit or trailer given the current market value in your respective operating territory.

Premium comparisons between polices written on Stated Amount vs Cost New are roughly the same given the overall underwriting criteria on an account-to-account basis. Meaning some policies written on a Stated Amount are more premium dollars than policies written on a Cost New basis…and vice versa.

FINANCING FACTS MUST KNOW’S BEFORE FINANCING

This may be a confusing statement, but what I have seen through my tenure is that many banks, credit unions, or other equipment finance and capital funding companies will file a blanket lien or incumbent on the business. They do not take advantage of the customer by burying the blanket lien language in the fine print.

Early Payoff Numbers at the Beginning

In same context of “buried” info, note what the real prepayment or early payoff numbers look like at the beginning of your decision making. Be specific in your questions, so you can learn what all your financing options are. A good of example of options is leasing. Most of my customers prefer to do a lease purchase for tax benefits. However, in an early buyout situation, a small penalty on the “Principle Remaining Balance” is massively more beneficial than having to pay the whole remaining schedule.

Leasing’s Tax Advantage

As some of you may know, the tax advantage of a lease purchase program far exceeds that of a traditional loan. A lease purchase program is 100% tax deductible as an expense to the company. A traditional loan is considered an asset where a standard depreciation schedule is applied. This results in a fraction of the write-off to the business.

A common misconception is that a lease-purchase program is more expensive. When, in fact, after factoring in the expense deduction, the result is most beneficial to the entity. The underwriting requirements do not differ whether I structure the agreement as a lease or a loan. Most financing companies, Alliance Funding included, can do either type of agreement. The lease purchase agreement allows for a longer balloon payment (i.e. 10-30% balloon payment). By doing this type of structure, you are simply allowing yourself more options when the term is over and giving yourself a lower monthly payment through the term.
