Local Artists Invited to Submit Work for Competition

he City of Pembroke Pines Recreation and Cultural Arts Department and the Arts and Culture Advisory Board are currently accepting applications for the 12th Annual Art Competition and Art Exhibit.

Area artists, 18 and older, can submit paintings, sculptures, mixed media, photography and other mediums for a chance to win cash prizes. The deadline to enter up to three pieces is September 12.

“The Art Board is very excited to see the art work that will be submitted at this year’s Art Competition,” stated Rose Colombo, Arts and Culture Advisory Board Chair for Pembroke Pines. “Our selection of the work to be used for the annual art festival poster is one of the highlights of the year.”

The winning artwork from the juried competition will be on display in a new location this year, Studio 18 in the Pines, from September 23 to October 20. On September 23, from 7pm – 9pm, the public is invited to meet the artists at a reception.

Winning artists will receive cash

prizes in the following categories: Best of Show ($500), Best Photography ($200), Best Painting ($200), Best Mixed Media ($200), Best Sculpture ($200), Best Watercolors ($200), Best Drawing ($200) and Art Festival Poster Design ($200).

The artwork from one lucky winner will be used to create the poster for the 2017 Annual Arts and Crafts Festival on March 11 and 12 and will be featured on the cover of the Art Festival booklet. The winner will also receive free 10x10 tent space at the festival and $200. Last year, Carlos Fuenmayor won the poster contest for “Knightopus.”

Pembroke Pines to Observe Patriot Day at Remembrance Ceremony

n the 15th anniversary of the terrorist attacks on September 11, 2001, the City of Pembroke Pines will come together to remember those who lost their lives. On September 11, the Patriot Day Remembrance Ceremony will begin at 8:30am, at the Pembroke Pines City Center Memorial Pavilion, 10300 Pines Boulevard.

“The City of Pembroke Pines continues to honor

America’s first responders,” said Francie Novo, Special Events Coordinator for the City of Pembroke Pines Recreation and Cultural Arts Department. “It is important for our residents and all Americans to remember, honor, and respect our country’s proud tradition and history of protecting freedom.”

the recovery periods to be a part of the ceremony. The Remembrance Ceremony will begin with the Presentation of Colors by the City of Pembroke Pines Police and Fire Department Honor Guards. It will feature remarks

by Pembroke Pines Mayor Frank C. Ortis and City Commissioners. The ceremony will conclude with patriotic music.

Guests can visit the Memorial Pavilion, which was created by local artists Felix Gonzalez and Benoit Menasche.

It contains a series of steel sculptures, including a 13-foot-tall firefighter, two twisted towers, and a little girl. It also has a four-sided relief made from a nine-ton cube of Italian marble. Each side represents something different shock, grief, acceptance and rebuilding.

Carlos Rodriguez of Pembroke Pines lost his cousin in the Twin Towers. “Every time I see the Memorial Pavilion I think of my cousin, as well as all of the other victims, survivors and people who assisted in the recovery,” said Rodriguez. “I visit the memorial throughout the year, as well as on September 11.”

The community is invited to view and participate in the City of Pembroke Pines “Salute OUR Soldiers” pictorial display inside Pembroke Pines City Hall. Pembroke Pines residents can submit non-returnable photos of loved ones, living and/or deceased, who have served in the United States Military, for display on the “Salute OUR Soldiers” Patriots Wall located inside City Hall.

10th Annual Fall Arts and Crafts Show Offers Great Shopping community news

ooking for the perfect gift? Chances are you will find it at the 10th Annual City of Pembroke Pines Community Services Fall Arts and Crafts Show. The annual event benefits the City of Pembroke Pines senior services programs. It will be held on September 24, from 9am to 5pm, and Sept. 25, from 10am to 4pm, at the Southwest Focal Point Community Center, in Pembroke Pines, in over 54,000 sq. ft. of air conditioned space. Admission is free and open to the public.

“The show features a wide variety of carefully chosen artists, who are all present at the show to discuss their original and handmade work,” said Helen Daniels, Recreation Division Supervisor. “It is an excellent opportunity to browse and purchase beautiful one-of-a-kind handcrafted arts and crafts for the upcoming holidays.”

There will be more than 70 vendors from throughout the state of Florida, including many new ones. Visitors will find photography, gourmet chocolate & popcorn, handmade soaps, lotions & candles, hand sewn fabric crafts, pottery, knitted baby items, knitted accessories, crochet clothing and accessories, children’s clothing and accessories, hand crafted cold porcelain dolls, handmade doll clothes, etched yard stones, paper quilling, handcrafted

stationery, leather handbags, handcrafted holiday items, license late creations, hand carved wooden crafts, hand crafted jewelry, one of a kind hand crafted pens, silk floral arrangements and wreaths, locally grown orchids, and more.

The show also features pottery from the Empty Bowls group, comprised of students from the Community Center’s day and evening Pottery Studio program. The Artists in Action donate their time, talent and supplies to help feed the “empty bowls” of the hungry. The proceeds from the sale of their pottery will benefit the Community Center’s annual Thanksgiving Basket Food Drive for needy families in the community. Instructor Leroy Daniels will be demonstrating the pottery wheel throughout the arts and crafts show, allowing patrons the opportunity to understand the processes that the artists go through to create their finished works.

The SWFP Community Center offers adults 18 and older an opportunity to meet new people, build a support network or gather information. It is also a place that they can go to simply read a book or shoot pool. The Center offers trips and special events on a regular basis including selfimprovement classes, educational classes, health classes and support programs presented by area professionals.

“Proceeds from events such as our Annual Fall Arts & Crafts Show help us continue to provide services and programs for our members,” said Daniels.

Emilio’s Café will be open during show hours for all vendors and patrons. It features Latin food, fresh salads, sandwiches, fruit, soup, pastries, snacks, beverages and much more.

Poster Contest Encourages Students to Place Smoke Alarms in Bedrooms

tatistics show that more than 30 percent of smoke alarms installed in homes across America are non-operational due to poor maintenance or battery removal and three out five fire deaths resulting from fires in properties without working smoke alarms. This month, Pembroke Pines students in grades k-5th will be learning about the importance of making sure smoke alarms are working. They will be competing in the Pembroke Pines Fire Department’s 20th Annual Fire Prevention Week Poster Contest, which promotes Fire Prevention Week’s theme “Don’t Wait - Check the Date!

Replace Smoke Alarms Every 10 Years.” The deadline to submit posters is September 19.

“This year’s fire prevention week message is so important,” said Fire Marshal Sandra Lluis. “People do not realize how essential it is to have properly installed and working smoke alarms. Non-operational smoke alarms are just as reliable as not having smoke alarms. To optimize your chances of survival from a fire, having working smoke alarms properly installed along with a consistent testing, maintenance and replacement program is a must.”

The Pembroke Pines Fire Department recommends the following smoke alarm tips for increased survival in the event of a fire in your home: ▸▸ A closed door may slow the spread of smoke, heat and fire.

▸▸ Install smoke alarms in every bedroom, outside each separate sleeping area and on every level of your home. ▸▸ Interconnect all smoke alarms throughout the home. This way, when one sounds, they all do. ▸▸ Make sure everyone in your home knows the sound of the smoke alarm and understands what to do when they hear it. ▸▸ Make a home escape plan. ▸▸ Discuss and practice the plan with everyone in your home. ▸▸ If the smoke alarm sounds, GET OUT AND STAY OUT. ▸▸ Test alarms at least monthly by pushing the test button. ▸▸ Replace all smoke alarms when they are 10 years old or sooner if they don’t respond properly. ▸▸ To find out how old a smoke alarm is, look at the date of manufacture on the back of the alarm; the alarm should be replaced 10 years from that date.

According to the rules, the poster must contain the Fire Prevention Week theme.

Each child must make their own poster, which will be judged on originality. Posters can be made on any suitable material and should be appropriate for vertical display.

Trophies will be awarded for 1st, 2nd, and 3rd place winners in each grade. The winning posters will be displayed at Pembroke Pines City Hall during Fire Prevention Week, from October 10-13.

During the seven-day campaign in October, the Fire Department will offer a variety of programs aimed at educating the public on fire safety. In addition to the poster contest, there will be fire safety presentations and fire station tours. The Fire Department will also give away thousands of brochures, firefighter helmets, coloring books, and stickers.

Seniors to Test Their Spanish Spelling Abilities community news

I

n recognition of National Hispanic Heritage month, seniors will once again compete for the title of “Spelling Bee Champion.” The 5th Annual Senior Spanish Spelling Bee will be held on September 13, at 12:30pm, at the City of Pembroke Pines Southwest Focal Point Community Center. The deadline to sign up is September 9.

“Our members are looking forward to the Spanish Spelling Bee this year, so they can stimulate their minds,” said Suzy Felix, Activities Coordinator. “They always enjoy the excitement that the competition brings when competing with their friends.”

Pembroke Pines Director of Community Services and Housing Jay Shechter, who loves to play Scrabble, came up with the idea for a Spelling Bee. After holding the first two in English, the Spanish-speaking seniors wanted a turn. Schecter agreed to hold the next contest in Spanish. The Center now offers two Spelling Bees each year – one in English and one in Spanish.

“Every year we see an increase in participants,” said Silvia A. Aguilar, SWFP Community Services Administrator. “It takes a lot of courage to get on stage and participate under pressure with so many people watching.”

Last year, participants ranged from 50 years old to 80 years young. The tension was high throughout the competition, as sixteen contestants spelled a wide

range of words using the pronunciation from the Spanish alphabet, including any special punctuation.

The contest 2015 Spelling Bee winners were: Adela Nazzarri (1st), started with Luz Pardo (2nd) and Candelaria Vergara (3rd). easy words, such as “blusa” and “hablar” and progressed with more difficult ones. Once contestants misspelled a word, they were eliminated.

After some intense competition, the winners of the fourth Senior Spanish Spelling Bee were declared. Adela Nazzarri won after she correctly spelled “Quebradizo,” which means something that is brittle or breaks easily. She received $50. Luz Pardo, who placed third in the 2014 Spelling Bee, was the 2015 second place winner ($30) and Candelaria Vergara won third place ($20). All three also received a Certificate of Recognition and earned bragging rights for the year.

This year’s Spelling Bee will follow the same rules and offer the same cash prizes as last year.

Dogs Have a New Place to Play in Pembroke Pines

he City of Pembroke Pines recently held a ribbon cutting and park renaming ceremony for its second dog park, Steven L. Josias Dog and Equestrian Park, which is located at 5836 SW 193rd Way. The park is named for City Attorney Emeritus Steve Josias. Mayor Frank C. Ortis introduced Josias and his wife Marlene, who flew in for the ceremony (minus Tank, their blonde Schipperke).

Following brief comments by the Pembroke Pines Commission, Josias thanked the City for the honor and complimented them on continually working to meet the needs of Pembroke Pines

residents.

“I am honored by my long time association with a City that cares so deeply for all.... even the pets that add so much to our lives,” said Josias.

Horses are still welcome at the five-acre park, which was repurposed from its 2007 Equestrian Park status to that of a Dog and Equestrian Park.

For dogs, it now offers dog obstacle courses, separate play areas based on dog weight, water bowls and doggy “poo” bags. For people, it has bathroom facilities, water fountains and ample parking. Gazebos in each area provide shade and seating, which complement newly planted 25 foot live oak trees.

With the addition of the new park,

Pembroke Pines now has dog parks on both sides of the city - Steven L. Josias Dog and Equestrian Park on the west and Pembroke Pines Dog Park (9751 Johnson Street) on the east.

The opening of the new dog park was timed with the temporary closure for renovations of the old one. Park hours are Monday through Saturday, 8am until dusk, and Sundays, 8am until 6pm.

Rules and regulations are posted and park etiquette is based on the Golden Rule - treat the park and its guests of dogs and people as you would like to be treated.

Renovations at the east park will be completed in time for the 4th Annual Bow Wow Ween, which will be held there on October 8, from 9am to 1pm.

The four hour event will feature a variety of dog friendly vendors, dog activities, dog wading pools, shade, music and the popular costume contest at 10am. Applications are available on the City’s website, www.ppines.com.

Girl Scouts Are Recruiting New Members community news

Girl Scouts of Southeast Florida serves more than 15,000 girls in grades K-12. It builds girls of courage, confidence and character, and provides them with a safe place to discover more about themselves and the world around them, to connect with others, and to take action to make the world a better place. This month, the Wildflower Service Unit, which serves Pembroke Pines, will be recruiting new girls for the upcoming school year. They can join existing troops or form new ones.

There are many troops located in Pembroke Pines, including #10845. Formed in January 2015 with 8 girls Troop #10845 will start the new school year with 18 members. It is a multi-level troop, with girls from ages five to thirteen. Most of the girls attend the Pembroke Pines Charter Schools, and some have been in the group for as long as seven years. The troop is always in search of interesting projects to help the community and earn badges. Learning activities have included camping, environmental projects, managing finances,

community work and more.

Troop leader Johanna Vega was a Girl Scout for 10 years.

“Our kids are growing in a new generation with high-tech proficiency, which is important to succeed in our competitive workforce society,” said Vega. “It is fundamental, however, that our girls learn basic life skills to ensure that they can endure life independently by the time they go to college. It is slightly alarming how many girls leave the nest without the most basic knowledge of day-to-day life, because they´ve always relied on parents to take care of things. This concern became one of the main aims of our organization.”

Three of Vega’s own children are in her troop – Madeline, 14, Clarissa, 11, and Bárbara, 6.

“I have learned very interesting facts about environmental issues and how to make a difference,” said Clarissa, who has been in scouting for the past five years. “We are really getting involved with important

organizations.”

Troop members Madeline Barnett and Barbara Rodriguez have also had positive experiences.

“I was elected Girl Scout Delegate this past year, and I am having the best experience of getting involved with real professionals who are joining efforts to make the organization stronger,” said Madeline. “I love the opportunity to be part of the board meetings and express my opinions and suggestions.¨ “I like Girl Scouts, because it’s fun,” said Barbara.

“We play and we sing, but also we help others.”

City of Pembroke Pines Participates in #SaferBy4 Initiative SECTION HEAD community news

very year, young children lose their lives in the water or while sleeping.

The City of Pembroke Pines is participating in the #SaferBy4 Campaign to reduce these preventable child deaths by bringing awareness to water safety and safer sleep practices for infants. The campaign was designed to help children reach their fourth birthday.

Drowning Drowning occurs in as little as two minutes. Broward County has one of the highest rates of drowning fatalities among children ages one to four each year.

Most children who die from a drowning were never intended to be in the water.

They wandered away from a supervised area to enter water alone.

The #SaferBy4 Campaign offers the following tips: ▸▸ L ayers of supervision: Make sure that someone is always actively watching the water when a child is in the pool. Assign a “water watcher” to ensure that a responsible adult is supervising the child. ▸▸ Barriers: Children should never have accessibility to water without being accompanied by an adult. Have several barriers (in case one fails) to physically block a child from a pool. Barriers include door alarms, pool fences, self-latching gates, child proof locks and pool covers. ▸▸ Emergency Response: Early activation of EMS, CPR and Rescue Breathing can mean the difference between life and death. Keep a phone by the pool and learn CPR and Rescue Breathing. ▸▸ Swim Classes: Register your 1-4 year old for one of the Parent and Child or Preschool Level 1 Swim Classes at one of the following Pembroke Pines locations: Pembroke Lakes Pool, Price Park Pool and Towngate Pool.

“This campaign helped save my daughter’s life,” said Pembroke Pines resident Betsy Joseph. “We had never thought about assigning a ‘water watcher.’ If we had not, my two-year-old daughter might have drowned during a family gathering.”

City of Pembroke Pines Police Explorers Win Back to Back at States SECTION HEAD community news

Pines ranges in age from 14 to 21 years. Team members included: Alce Jimmitry, Stephen Scopa, Emilio Falcon and Tyler Gruber. They spent hundreds of hours training for the competition with Officer Sean Yap, Officer Joseph Pence, Officer Thomas Moloney and Crime Scene Investigator Michael Boone.

Throughout the weeklong competition, the teams participated in eight law enforcement scenarios, ranging from search and rescue to domestic abuse.

They were scored on how well they handled each scenario.

In addition to being named Overall State Champions, the Pembroke Pines Explorers received awards in the following categories: ▸▸ 1st place in “Active Shooter” - responding with proper tactics to an active shooter/ killer incident in a workplace ▸▸ 1st place in “Crisis Intervention” - incidents involving critical or sensitive persons or situations ▸▸ 2nd place in “In Progress” - incidents involving police that happen in real-time ▸▸ 2nd place in “Crime Scene” - the investiga- tion of police crime scenes The post presented the trophies to the chief and command staff. Members of the Pembroke Pines City Commission congratulated the post on winning.

Key Lime Baking Challenge Is A Success community news

ey lime pie is named after the small Key limes that are naturalized throughout the Florida Keys. Several Pembroke Pines residents had Key lime recipes that were worth some money. They recently participated in the Master Chef Florida Key Lime Baking Challenge at the Southwest Focal Point Community Center.

“This challenge gives home ‘chefs’ the chance to showcase their culinary skills and possibly win a cash prize,” said Helen Daniels, Recreation Division Supervisor. “Judges are not only looking for the best tasting dessert, they are also looking for the dessert that is beautiful to look at.”

All the desserts in the challenge had to be homemade and contain Florida Key limes. They could include traditional Key lime pie, Key lime cheesecake, Key lime cookies, Key lime cake or any other creation.

The panel of judges included Key lime experts Bob and David Roth, from Bob Roth’s New River Groves, home of Terry’s World Famous Key Lime Pie. Pembroke Pines Police Officers Andrew Feldman and Manny Salinas helped round out the judging for the summertime challenge.

After judges sampled each of the desserts, they rated them on taste and

appearance.

“The first place dessert scored a 97,” said Bob Roth. “The Key lime cheesecake cookies had just the right amount of tart sweetness and a fine tasting crust.”

The winners of the Key Lime Master Chef Baking Challenge were: Sandra Levine (1st place) for her Key lime cheesecake cookies; Shirley Schwartz (2nd place) for her Key lime coconut macaroon pie and Cathleen Norris (3rd place) for her Key lime pie.

The winners received cash prizes - 1st ($50), 2nd ($30), and 3rd ($20), as well as bragging rights as “Master Chef.”

Following a presentation to the three winners, SWFP teen volunteers and staff served everyone a sample of each Key lime dessert.

The next SWFP Master Chef Challenge date will be held on December 1. The theme has not been announced yet.

ost weekends, Harry Bogorad and his family can be found at the City of Pembroke Pines Chapel Trail Nature Preserve Nature Preserve. Often called one of Broward County’s best kept secrets, it has become a favorite spot for families, environmentalists, photographers, Audubon Society members, bird watchers and many others.

It is accessible to pedestrian, bicycle and vehicular traffic.

“It is so close to home, but when you are there it feels so far away,” said Bogorad. “We rent canoes and ride bikes and always spot lots of wildlife. We have seen alligators, snakes, deer, birds and so much more. It is a great way to see wildlife up close.”

The Preserve encompasses over 450 acres of reconstructed habitat in Florida’s first known wetland

bank (Chapel Trail Conservation District). Since it officially opened in January 2005, it has received numerous honors and awards for serving as an excellent example of how to recreate a wetland.

There are 1,650 feet of elevated boardwalks that extend out over the marshy area. The boardwalks allow visitors to view the Preserve’s large assortment of wildlife, which consists of over 120 species of birds, deer, rabbits, alligators, snakes, turtles, largemouth bass, insects, butterflies and more. Educational signs along the boardwalk inform visitors about the plants and wildlife that call the Preserve home. Rest stations also line the boardwalk and provide visitors with an opportunity to take a break to reflect and enjoy the scenery.

Residents and students can also take advantage of the Preserve’s Environmental Interpretative

Center, which is available by appointment. It offers a unique environmental educational opportunity and enhances the learning experience for visitors who want to observe and learn first-hand about the wonders of Florida’s habitat.

On Saturdays, from 9am to 12noon, visitors can get a close-up view of the area by renting canoes for only $7/hour. During the self-guided waterway sightseeing excursion, visitors will see surprises at every bend.

onstructing a model railroad layout involves sculpting, building, painting, and even some electronic engineering. In the next few weeks, the Florida Citrus Model Train Society will be offering area residents two ways to learn more about model trains.

Pembroke Pines Fire Department Helps Make a Dream Come True community news

early a year ago, 16-year-old David Frey was diagnosed with Acute Lymphocytic Leukemia.

After enduring nine months of treatments, one of his dreams recently came true when Pembroke Pines Fire Chief John Picarello swore him in as an honorary firefighter in front of several family members, including his great grandma, and over 50 Pembroke Pines firefighters. Pembroke Pines Officials Mayor Frank Ortis, Vice Mayor Carl Shechter, Commissioners Angelo Castillo, Jay Schwartz and Fire Division Chiefs Ruben Troncoso, Jorge Hernandez, Sandra Lluis and John Penick presented David with his own custom firefighter uniform and gear.

“The morning ceremony was made more meaningful when David’s sisters and grandfather pinned on his honorary firefighter badge to his Class B shirt,” said Division Chief Sandra Lluis, Pembroke Pines Fire Marshal.

Newly sworn in as First Honorary Firefighter, David reported for duty at Station 69, located at Pembroke Pines Fire Department Headquarters, with a PPFD badge, ID card, helmet, bunker coat and gear bag. He participated in crew line-up and received his first assignment with Rescue 269. At Station 33/Perry

Airport, David got hands-on experience operating the controls and discharging water from the Aircraft Rescue Firefighting truck.

Next, he boarded Engine 99. He was briefed on his assignment at the Pines Fire Training Facility, where he responded to multiple fire scenarios. He extinguished an LP Gas fire, was raised 125 feet in the bucket of ladder truck # 99 and used the water cannon to extinguish a fire on a tanker and storage container. David honed his hose line skills by knocking down orange cones using the hose water stream.

West Broward High School Performance Ensemble to Entertain in Disney World

est Broward High School’s Performance Ensemble is reaching for the stars.

They have already performed in the Macy’s Holiday Parade at Universal Orlando Resort and have been invited this December to perform in the parade at Disney World in Orlando. One day, they hope to represent Pembroke Pines in the Macy’s Thanksgiving Day Parade in New York City.

To qualify for the event in Disney World, the Ensemble submitted two performance videos. One week later, they learned that they were selected. The entire Performance Ensemble will attend.

“The students are so proud to be representing West Broward High,” said Beth Birdsong, president of the West Broward High School Band Parent Association. “It’s their opportunity to showcase a great Pembroke Pines performance group to all of Florida and to let everyone know that they are more than just a successful competition ensemble.”

In addition to the special performance in Orlando, the group typically travels to Tampa/St. Petersburg to compete in the Florida Marching Band Coalition state championship and/or the Bands of America Super Regional competition in Atlanta Georgia.

The Ensemble has won several times at the local level, 2nd place in the FMBC state championship and 9th place in the Bands of America Super regional competition. The school will host a golf tournament in November to help raise travel funds.

The West Broward High School Performance Ensemble is led by Director Dean Calmer and Assistant Director Jason Bloom. There are approximately 200 students in the group, which consists of woodwinds, brass, percussion and Color Guard. They are best known for their cutting-edge marching shows, which are choreographed to original pieces that showcase their talented performers. This year’s show is called, “Chakras.” Students also perform in one of three concert bands in the orchestra, as well as in winter Color Guard units, jazz band and competitive winter percussion.

Sarah Birdsong, 10th grade, has played the clarinet in the Performance Ensemble for two years.

“I love how there’s a sense of family and how everybody will always be there to show you the right way or correct you if you need anything,” said Sarah.

Flavio Corsi, 12th grade, has been a drum major in the ensemble for four years.

“Leaving the football field or stage after a successful show, knowing that you gave everything you had, and telling a story to the audience through music and dance is an incredible sensation,” said Flavio. “The performance ensemble is much more than a program that teaches students how to play an instrument. We learn leadership skills and life lessons, while creating bonds with a dedicated and diverse group of people.”

Natalia Veitia, 10th grade, is performing with the Ensemble for the third year.

“I love the feeling of performing to a crowd more than anything in this world,” said Natlia. “Being a part of the Performance Ensemble has taught me many life lessons and given me some of the greatest friends I could have asked for.”

Mediating Work Injuries Legally Speaking

“W

hat will happen at my Worker’s Compensation mediation? Will the Mediator be fair? Do I need to be represented? Why do I need to go to mediation?” These are just a few of the concerns you may have as a Claimant when you receive a notice setting your case for mediation. In Florida, an injured worker who feels an owed benefit has been denied begins the process by filing a Petition for Benefits. If the benefits sought in that Petition are denied, then mediation must be scheduled.

Mediation is a face-to-face negotiation between the Claimant, the Employer and the insurance company in an attempt to resolve any disputes in your claim. During the mediation process the merits of your case are discussed and at times the carrier may opt to offer you a lump sum settlement to resolve your case in its entirety.

Most mediations are scheduled with a Mediator employed by the State of Florida. However, in more complex cases the insurance carrier might opt to hire a private mediator. In either case, the Mediator is a neutral party and presumed to be impartial. Private mediations, afford the Claimant much more time to discuss the issues and a better chance to settle more complex cases.

At the start of the mediation both sides will have an opportunity to tell their side of the story. The Mediator will separate the parties into two rooms where the mediator has an opportunity to speak with each side in private. It is the Mediator’s job to tell each side the downfalls of their case and attempt to bring the parties to an agreement that they can both live with.

This often leaves one of the sides – too often the Claimant – feeling that the Mediator is against them or is not being fair.

As the Claimant, you are not required to accept any terms presented to you at mediation. Although the attendance at mediation is mandatory, resolution of the issues and/or settlement is not. Although an agreement at mediation is not mandatory, once an agreement is reached it becomes an enforceable contract. If you later change your mind as to the terms of the agreement or feel that you did not get a good deal, the insurance carrier may file a motion to enforce settlement.

Although there is no requirement to be represented by an attorney during mediation, an unrepresented Claimant is at a serious disadvantage.

The Employer and the insurance carrier will undoubtedly have an attorney well versed in the law who will try to make the best deal for his/her client. A Claimant, unfamiliar with his/her rights and how to obtain those rights, might fail to obtain the benefits owed. A knowledgeable Workers’ Compensation attorney can guide you through the mediation process as assist you in getting the best deal.

Most importantly, the injured worker is not burdened with the cost of legal representation, since the attorney representing the Claimant only gets paid when benefits are secured for the Claimant and these costs are usually the responsibility of the insurance carrier who has failed to timely and properly provide the benefits. How Florida Consumers Can Earn Huge Money from Harassing Debt Collection Calls (Part 3 of 3)

I

n our last article, we discussed the Fair Debt Collection Practices Act (“FDCPA”) - a set of federal regulations designed to protect and reward consumers who have fallen victim to unlawful tactics used by creditors attempting to collect an outstanding debt. This article will discuss the FDCPA’s stronger counterpart, the Florida Consumer Collection Protection Act (“FCCPA”). While the acronyms between these two Acts may appear similar, the penalties against a debt collector and the amount of money an individual may receive for a creditor’s violation are significantly greater when a claim is presented under the FCCPA. If a consumer has been harassed by a debt collector, it is not unusual for an attorney to sue the collector under both the FDCPA and FCCPA. This strategy may result in a huge benefit to a Florida consumer by casting a wider net of remedies, under both state and federal law. Under the FDCPA, a consumer is limited to only raising a claim against a “debt collector,” which is an individual or entity that purchased a debt from the original creditor or is collecting the debt on behalf of the original creditor. In other words, if the debt collector calling daily is the original creditor, you have no recourse against them under the FDCPA. Unlike the FDCPA, a claim under the FCCPA may be brought against any debt collector, whether they are the original creditor or not.

The FCCPA also differs from its counterpart in that it also allows a consumer to seek an award of punitive damages against a debt collector.

An award of damages under the FDCPA is capped, but a violation under the FCCPA may allow for an award of damages that is virtually unlimited. In a recent case, a federal court in central Florida awarded $22,000 in damages to a consumer, and $10,000 of that award was punitive damages under the FCCPA. A sample of the most common FCCPA violations debt collectors commit include providing information about your debt to someone else; threats or using abusive language; making debt collection calls outside the specific hours; pretending to be someone else; and making debt collection calls to an individual who is represented by an attorney.

Moderation: The Best Approach to Plastic Surgery

T

oo much of a good thing is not always the best. Moderation in life results in the ideal balance in many facets of our lives. This holds true for cosmetic surgery as well. From noninvasive treatments to plastic surgery procedures, moderation is the approach I feel yields the best long term aesthetic results.

From celebrities to people in our local community, we have all seen the overdone, over-filled or excessively pulled face that resembles an aquatic animal or alien life form more than a natural aesthetic enhanced face or body. The most common mistake is the over-injected face and mouth.

When fillers are excessively injected to improve facial lines and wrinkles the natural contours of the face become distorted. Too much Botox or Dysport can leave a patient with a flat, waxy appearing forehead or brow and a motionless masklike face. The fish mouth or duck lips result from exaggerated injections of soft tissue fillers in and around the mouth. Soft tissue fillers, such as Juvéderm and Restylane, should be injected to fill lines and creases and restore volume where is has been lost throughout the aging process. It is the physician’s responsibility to know when enough is enough with regard to appropriate injection volume.

Facial skin laxity or looseness can’t be treated with fillers alone. Skin tightening, such as performed during a facelift, is necessary to lift and achieve the optimal cosmetic result in cases when soft tissue fillers are not sufficient.

More filler does not tighten excess facial and neck skin. When facelift surgery is indicated, the technique utilized should be individualized according to the patient’s anatomy.

Excessively large breast implants and oversized buttocks enhancement will lead to long term problems for these patients. Breast implant volume is ideally determined by careful measurement of a woman’s anatomy, including breast width, height, soft tissue thickness and stretch. Bigger is not always better. Think moderation and individualized enhancement to achieve the ideal aesthetic improvements.

The excessively large, wide buttock from large volume fat transfers or B.B.L. will eventually need to be reduced at some point in that person’s life, as the effects of aging and gravity results in a large, sagging buttock. It is up to the physician, as the professional, to help guide a potential patient to make the appropriate decision to achieve best cosmetic enhancement. I highly recommend that any individual who is considering plastic surgery or any cosmetic procedure consult with a physician who is board certified by the American Board of Medical Specialties (ABMS) organization, such as the American Board of Plastic Surgery with documented experience prior to proceeding.

However, keep in mind that estate planning without an attorney’s counsel may end up hurting your family at the very time you need your estate plan to work. So while we caution against doit-yourself estate planning, there are definitely steps you can take by yourself. One of the simplest and most important things that you should do, no matter your age or marital status, is to verify that assets and beneficiaries are properly titled, and that all beneficiaries are identified.

Let’s consider the following all-too-common scenarios, based on recent calls to our office.

Sam Jones is a 75-year old man, who has been married to Hazel for over 30 years. Tragically, Sam dies suddenly. Hazel eventually contacts their insurance company and is startled to learn that the beneficiary on one of Sam’s policies is his sister, designated before he was married.

Although Sam and Hazel were married for many years, the primary beneficiary was never changed. Review all life insurance and retirement plan beneficiaries to ensure they are current.

Sadly, after a long illness Mama Maggie loses her daughter Melissa, a 45-year old divorced woman, with no children. Maggie later learns of a life insurance policy on Melissa’s life, issued years ago by a former employer. The policy shows no named beneficiary, so therefore funds cannot be released without a judge’s order from the probate court. This means probate administration is required. Have you collected life insurance policies, IRAs and 401(k)s over the years? Make sure they all have beneficiaries and contingent beneficiaries designated.

Nadine Rogers’ husband passes away. All of the couple’s savings and checking accounts were owned jointly. While sorting through her late husband’s papers, Nadine sees a statement from an old savings account, in only her husband’s name. She is surprised to find out that their bank will not allow her access to the money because Nadine is not named as an owner. As with Mama Maggie, money will only be released with a judge’s order from the probate court following probate administration. Her options are to hire an attorney to start a probate proceeding, or allow the money to eventually be claimed by the state.

All cash accounts should either have a joint owner, or be designated P.O.D. (payable on death) to a named beneficiary.

There are several other relatively easy things you can do, with the help of an attorney, which can assure your family that your real estate and business property will transfer smoothly, efficiently, and without the need for probate administration following your demise. These include life estate deeds for your residence and buy/sell agreements for stock and other business interests.

he American Optometric Association (AOA) reports that over 7 out of 10 of the Americans that work each day from a computer monitor (about 143 million people) suffer from computer vision syndrome (CVS) or eye strain. Prolonged computer use can result in eye stress and effect typical vision processes in kids and adults. If you are working at a computer longer than 2 hours each day, it is likely that you will suffer symptoms of computer vision syndrome.

What Are The Causes of Computer Induced Eye Fatigue?

Eye fatigue from prolonged computer use is caused by the necessity for our visual processing pathways to adapt to processing text on a computer screen in a different way than they do for letters in print. While our eyes are used to focusing on printed material that contains solid black characters with sharp edges, they are less familiar with characters on a digital screen that lack the same degree of contrast and sharpness.

Words on a screen are created by combinations of tiny dots of light (pixels), which are most luminous at the center and diminish in intensity toward the edges. Therefore it is harder for our eyes to focus on these images. Instead, our eyes reduce focus to the ‘’resting point of accommodation’’ or RPA. Our eyes involuntarily adjust to the RPA and then have to make a great effort to regain focus on the text. The continuous strain on the muscles of the eyes to focus results in the fatigue and eye strain that is sometimes present during and after use of a computer or digital device. CVS isn’t a matter of concern just for those who spend a lot of time on computers. Other electronic gadgets such as smart phones or tablets can cause similar conditions and in some cases even worse. Since mobile screens are often small, in addition to pixilated, the user often strains even more to focus on images.

Treatment for Computer Vision Syndrome and Eye Strain

If you think that you might be at risk for CVS, you should make an appointment with an eye care professional sooner than later.

At a computer vision exam, your eye care professional will perform tests to detect any particular vision problems that might worsen symptoms of computer eye strain. Depending on the results of these tests, your optometrist may prescribe prescription computer eyeglasses to reduce discomfort at your screen. An anti-reflective coating is highly recommended for computer glasses. An anti-reflective coating lessens glare that may interfere with your ability to focus on images on your screen.

Ergonomics for Computer Vision Syndrome

Ergonomics, or changing your work environment to reduce strains in vision or posture, can help relieve some of the discomfort of computer vision syndrome.

Proper lighting and frequent breaks will cause some relief. However, since ergonomics alone cannot resolve a visual problem, using ophthalmic computer eyeglasses is also necessary.

nce again, the summer has quickly passed us by and it is time for the school year to begin again. It is an exciting and often stressful time, as children begin a new year with new classes, new teachers and sometimes new schools. For children of divorced parents, there can be some additional stress. Of course, parents who place the children first can make it much less stressful.

These days we are seeing more equal time sharing between mom and dad. This also means equal responsibilities for each parent as well. In an intact marriage, parents usually assume certain roles and assist each other. In a one parent household, there are no longer defined roles. Mom and Dad must each get the children up and ready on time, perhaps pack lunches and, most importantly, make sure the kids complete homework assignments.

Communication between parents is the key to a successful school year.

Each parent must realize that they are on the same team and they should not be looking for a “gotcha” moment. Each should be ready to assist each other rather than try and find fault to be used in a court proceeding. Joint parenting is not a contest - Mom vs. Dad. It is an attempt to have both parents do what is best for the child, as opposed to trying to prove who may be the better parent.

The most common equal time sharing schedule is two nights with one parent (Monday and Tuesday), two nights with the other parent (Wednesday and Thursday) and the weekend (Friday to Monday) rotating from week to week. A set schedule, such as this, gives a child some stability and doesn’t cause him/ her to wonder where he/she will be sleeping from day to day.

Of course, communication between parents is still necessary. Class projects, homework and school events must be known to each parent. Parents should not rely on their children to deliver this information. Often, teachers will be accommodating and provide duplicate information, so each parent is aware of assignments and future school events. Shared Parental Responsibility requires shared information. Sometimes I encounter parents who are so angry with each other that their focus is on the other parent’s possible shortcomings rather than working together to assist the children.

Unfortunately, emotions sometime interfere with common sense.

It is difficult to successfully maintain an equal time sharing schedule if the parties do not reside in close proximity to one another. Getting a child to school on time can be a problem if one of the parents resides far from the school. It is not in a child’s best interests to have to wake up extremely early to accommodate a parent who chooses to reside a distance from his/her school.

If a parent truly wants to have equal time, the child’s needs must come first.

A child who has both parents in his/her life will derive a benefit, but only if the focus of each parent is the child and his/her needs.

Growing Pains in Children or Merely Flatfeet? section ask the expert head

F

oot, ankle and leg problems in the growing child are often considered to be “Growing Pains” in the bone and muscles of the lower extremity. While in a small number of cases this might be true, in a majority of the cases the pains that plague these children and teenagers may be caused by lower extremity malalignment problems.

Growing pains are often seen in children who are excessively flatfooted or whose feet point to the outside. Children may also appear very knockkneed. Tight calf muscles can not only cause but significantly aggravate the pain that these children are experiencing, especially at night.

Leg pain is most commonly seen, especially at night after a long day of activity. Pain with activities, especially along the inside of the knee, lower leg, ankle and foot, may also be seen. This is often associated with a general avoidance of activities and sports and premature fatigue with many activities.

Many children can also develop lower back pain.

Treatment is important early on. Changing a child’s shoe gear to add more support to the foot and ankle may provide immediate help. Avoiding barefoot and flat shoes is necessary. Custom molded orthotics (shoe inserts) will immediately help to realign the foot and the entire lower extremity. This will almost overnight eliminate the problem. Physical therapy may also help to decrease overall muscle tightness and to improve muscle strength and coordination. If the foot is flat and associated with tight calf muscles, stretching the calf muscles in a walking cast is critical to not only eliminate the problem but to prevent a recurrence. If the flatfoot deformity is severe, there is a small percentage of children that will benefit from a procedure to realign and “correct” the flatfoot.

An excellent prognosis is always seen when the cause is identified and the problem treated.

he once vacant property on the south side of Pines Boulevard now reveals the muchanticipated, ten-acre building site of the Pembroke Pines City Center. The complex, scheduled to open early 2017, will house our new city hall, a grand hall for performances and meetings, the commission chambers, and the Frank C. Ortis Art Gallery and Exhibit Hall. “The Frank” is the colloquial name for the two-story, 11,000 square foot art gallery and learning space at City Center.

I’m honored to have the gallery display my name.

This administrations’ dedication to supporting the arts has been an ongoing and important part of the city’s development as a cultural destination.

Pembroke Pines’ commitment to promoting the arts as an integral part of the community will be anchored by the multi-disciplinary inclusive arts programming, and experiences offered at The Frank.

Programming will include curated exhibitions, community engagement events, and informative intriguing workshops at the gallery.

In addition to a state-of-the art contemporary gallery offering opportunities for interaction, a one-acre plaza will anchor City Center. In 2014, the National Endowment for the Arts awarded Pembroke Pines the prestigious “Our Town” grant to support the plaza design, and fund an arts-centric launch event to welcome the public to the space. To enhance the user experience, the plaza includes: an expansive green space, an original public art entry, shade canopy sculptures, an interactive wall designed by local artists and a mural depicting the community painted by accomplished artists. The audio rich, lighting-enhanced, tree laden oasis will become the site of festivals, ceremonies, concerts, acoustic musical performances, film screenings, and curated events to will encourage interaction between fellow residents and visitors alike. I’d like to also encourage everyone to attend our Patriot Day Remembrance Ceremony on Friday, September 11, from 8:30am to 10am, at the Pembroke Pines City Center Memorial, 10300 Pines Boulevard, west of Pembroke Pines City Hall. The ceremony, to remember all of the victims tragically lost in the attacks on 911, begins with the Presentation of Colors by the City of Pembroke Pines Police and Fire Department Honor Guards. It will also include guest speakers, community leaders and patriotic music featuring local school bands and area musicians. This event is free and open to the public.

And, please remember, especially during this time of our rainy season and to prevent the Zika virus, take precautions when it comes to mosquitoes.

Suggestions include: drain standing water around your house and maintain a proper water balance with pool chemistry in swimming pools. If you must be outside when mosquitoes are active, cover up by wearing shoes, socks, long pants, and long sleeves. Apply mosquito repellent to bare skin and clothing. Since 2009, the Pembroke Pines YMCA Family Center has been empowering people to make positive choices and lead healthy lives. With its wide variety of classes and programs, it offers something for everyone.

Julie Sundstrom, Senior Director of Membership, answered some commonly asked questions about the Pembroke Pines YMCA Family Center.

What is the Y’s overall commitment to its members? The Pembroke

Pines YMCA Family Center is committed to building healthy, confident, connected and secure children and adults by ensuring that every individual has access to the essentials needed to learn, grow and thrive. We are dedicated to enhancing lifestyles through programs that build a healthy body, mind and spirit for all. We strengthen the community by nurturing the potential of youth, improving the health and well-being of our community, and fostering a sense of social responsibility.

What are some of the classes/programs you offer? Every day the Y

empowers people to make positive choices and lead healthy lives through group exercise classes, weight training, personal training, swimming lessons, afterschool care, and youth sports programs, along with family activities and more. A Y membership also includes access to our

Aquatic Center and Water Park, which has double flume slides, a splash park, dive well and large wading pool with beach entry. With a team of highly knowledgeable staff, we provide exciting, specialized programs like travel volleyball and Silver Sneakers among others.

What distinguishes you from your competition? The Pembroke Pines YMCA serves the entire Pembroke Pines community by bringing kids, families, adults and seniors together through programs that encourage good health and foster connections through fitness, sports, and shared interests.

Describe your role as a nonprofit. As a leading nonprofit in the com-

munity, the Pembroke Pines YMCA is a critical part of improving the lives of local residents regardless of age, income or background. Each year our members and partners contribute towards our annual scholarship campaign, which enables us to support our Pembroke Pines neighbors by offsetting the cost of participating in YMCA programs. In the last four years, the Pembroke Pines YMCA has awarded more than $300,000 in financial assistance.
