Spring Returns Making Old New Again

As we enter the fourth month of the year, we can feel the energy of new beginnings and fresh starts that come with the arrival of spring.

The start of spring represents a time of renewal, growth, and rejuvenation. The sun shines brighter, the flowers bloom, and the air feels lighter. It is a time to let go of the old and embrace the new, to take a deep breath and start afresh.

As poet and writer, Rainer Maria Rilke once said, "And now we welcome the new year, full of things that have never been." This quote perfectly encapsulates the essence of spring - a time for new experiences, new beginnings, and new possibilities.

Hoppin’ into Springs Egg Hunt

Coral Springs Parks & Recreation Department will host its free Hoppin’ into Springs Egg Hunt at the Sportsplex Park (2800 Sportsplex Dr.) for children ages 3-8 years old. During the event, colorful, plastic eggs will be scattered across an open field where children can run to collect as many eggs as possible. High school students are encouraged to participate in the 2023 Teen Political Forum - an open mic-style forum for students to raise questions and converse with state, county, and local elected officials about issues that are important to them. Parkland Celebrates Turning 60

The City of Parkland celebrated its 60th anniversary on March 11th with its annual Parkland Day. The city, which started out as a sparsely populated farming community, is now home to more than 35,000 people. The day began with a parade, followed by a festival at Pine Trails Park, and culminated with a fantastic concert headlined by the popular band “Sugar Ray.”

Rescue Rings Installed at Coral Springs Parks Honor Aden Perry

The City of Coral Springs has partnered with the Aden Perry Good Samaritan and Scholarship Fund to install more than 70 rescue rings near bodies of water in city parks, both as a safety enhancement and to honor the memory of a heroic teen, Aden Perry.

The first set of rescue rings were installed at Cypress Park (1301 Coral Springs Drive) in Coral Springs following a ceremony with Sarah Perry (or “Aden’s Mum” as she likes to be called) along with Coral Springs city officials who placed the first apparatus near the body of water closest to the roadway. Teams of city park employees, Coral Springs-Parkland Firefighters and EMTs, and Coral Springs Public Works Staff, Park Rangers, and more worked together to install additional rescue rings throughout the park.

Aden Perry was a 17-yearold high school student who tragically lost his life in April 2022 while trying to save another teen who had just accidentally driven his car into a lake. He heroically dove into the water where the car had careened to provide aid to the driver, but sadly, both young men died.

Following her son’s passing, Aden’s mum has devoted her

life to ensuring that lifesaving Rescue Rings are now available near bodies of water.

The Coast Guard-regulated rescue rings are attached to a rope and are meant to allow anyone in the public to assist during a potential water emergency, without needing to enter the water themselves. To honor Aden’s memory, most rescue rings will feature a photo of

Aden and a “Hero Message” that says: “A hero is a person of distinguished courage and ability, admired for their brave deeds and noble qualities in spite of overwhelming obstacles.”

In addition, Perry’s heroic actions have resonated nationally. He was recently the recipient of the Carnegie Hero Fund Medal, North America’s highest honor for civilian heroism.

City of Parkland Seeking Residential Developer for Heron Bay Golf Course Property

The City of Parkland published an Offering Memorandum to develop 21 acres of the former Heron Bay Golf Club on March 1, 2023. The city is seeking a residential single-family home developer to build homes on the so-called "dog leg" portion of the property that previously was the site of the first three holes of the golf course.

The City intends to work closely with its selected developer through the approvals for the project, which the City envisions as a high-end complement to the surrounding area that integrates seamlessly with the Heron Bay Homeowners Association (HOA).

The Offering Memorandum is the latest milestone in the property’s politically-charged journey since being closed as a golf course in 2016. After several years as unused greenspace, the 223 acre property was purchased by The North Springs Improvement District (NSID), which, among other things, provides water treatment, wastewater collection, and stormwater management to nearly 40,000 residents in the cities of Parkland and Coral Springs.

NSID indicated that approximately 150 acres of the property will be used for stormwater management. The resulting green space would also allow for

recreational walking trails.

To help recover its $32 million purchase price, NSID intended to develop the remaining approximately 70 acres. The resulting proposals included large retail and commercial developments that were not in character with the surrounding community and created a political firestorm led by prominent members of the Heron Bay Community.

Following strong public opposition by the Heron Bay Community Association and homeowners with properties abutting the land, multiple lawsuits were filed in an effort to prevent the proposed project from moving forward. Parkland Mayor Richard Walker subsequently proposed that the City purchase the property to resolve the situation.

In September 2022 the City of Parkland Commission stepped in to purchase the developable ~70 acres for $25.4 million. The city has subsequently divided the property into two pieces: the 21-acre residential parcel and a larger parcel where the former driving range was located. The city intends to develop the latter property for commercial/ retail use.

After a residential developer is selected and the project is taking shape, the City will begin the search and selection process for a developer for the commercial/retail portion of the property.

The selected developer will ultimately facilitate a number of public stakeholder meetings. The planning sessions will likely include residents, planners, City officials, architects, a landscape architect, a transportation expert, public safety officials, and others. The City believes that a collaborative planning mechanism would enable the most desirable outcome for all of Parkland.

It is undetermined when the planning process will begin for the commercial property.

ur office receives many calls from clients inquiring about the use of revocable living trusts to “avoid probate” of their assets when they die. Indeed, so long as the trust is properly funded, assets passing under such a trust are not typically subject to a probate proceeding. However, many trustees responsible for handling trust assets are often misinformed or misunderstand their obligations beyond simply “distribute the assets and walk away.”

Assets titled in a revocable living trust are not equivalent to payable-on-death (“POD”) accounts or direct beneficiary designations. Those designations are contractual in nature and funds held with the financial institution

Othe trust beneficiaries, estate creditors, and other interested parties. There are numerous specific duties of a trustee, but generally, a trustee’s obligations include a fiduciary duty to all trust beneficiaries, avoidance of self-dealing with respect to trust assets, and a duty of impartiality toward all trust beneficiaries. The trustee must also prudently invest trust assets and pay only reasonable and proper expenses from the trust (including trustee commissions, attorney fees, taxes, and creditor claims).

Proper administration of a trust becomes more imperative when the trust contains ongoing obligations, such as when trust assets are to be held for a period of time before distribution to the beneficiary. This may occur when the beneficiaries are minors, spendthrifts, or have a disability that precludes an outright distribution of assets. When dealing with disabled beneficiaries, the trustee may be obligated to establish a special needs trust (“SNT”) for the benefit of the disabled individual. SNT’s carry with them their own duties and obligations. In addition to claims for breach of duty, a trustee’s failure to properly administer an SNT may jeopardize any public benefits (such as Medicaid or SSI) for which the

While payment of creditor claims is first an obligation of the Grantor’s probate estate, should the probate estate contain insufficient assets to handle these claims then such claims may be satisfied from revocable living trust assets. Under Florida law, creditors have 2 years in which to seek payment for any claims (although this may be shortened by opening a probate administration for the purpose of barring creditors). The trustee may be personally liable should any distributions be made without first ensuring any creditor claims are satisfied or barred. The trustee should also be aware that certain debts, such as IRS debt, may not be bound by state limitations on creditor claims.

All trustees should seek the advice of a trust attorney, CPA, and other professionals as needed to assist them with proper administration of trust assets. This not only helps protect the trustee, but it protects the beneficiaries and other interested parties to whom the trustee owes an obligation.

April UPDATE

Thank you to everyone who attended our pre-session Town Halls in January and February.

Now, we are right in the middle of our 60-day Legislative Session. This is the time when the state budget starts to solidify and bills continue to move through the process. While we have many good bills addressing housing, workforce shortages, and resilience projects making their way through the process, we also have controversial bills such as permitless carry and a 6-week abortion ban making their way through the process. You can follow all bills that have been filed at myfloridahouse.gov. There, you can also read staff analyses and watch the committee debate and questioning. I will do my best to keep you updated during Session through our email newsletter and social media. If you have any questions, you can also reach out via email. When Session is over, we will be scheduling Legislative Updates in the cities and in the District. In the meantime, if you need assistance with any of the state agencies, please do not hesitate to reach out to our district office in Coconut Creek City Hall. We are here to help in any way we can.

Earth Day is Saturday, April 22. This year’s theme is Invest In Our Planet, encouraging all of us to come together in partnership for our environment. The City of Margate is hosting a tree giveaway for Margate residents (proof of residency is required) on 4/22 at 8am at the NW corner of State Road 7 and Margate Blvd. The City of Coconut Creek is hosting a tree giveaway for Coconut Creek residents (proof of residency is required) on 4/19 from 8am-12pm at Coconut Creek City Hall, 4800 West Copans Road. The City of Parkland is hosting an environmental expo at the Parkland Farmer’s Market on 4/16 from 9am-1pm at 8350 Ranch Rd., Parkland. The City of Coral Springs is hosting Earthfest on 4/22 from 9am-12pm at the Sawgrass Nature Center, 3000 Sportsplex Drive. In our own homes, we can also make a difference by reducing our water and electricity usage, making use of reusable containers and bottles, composting, and recycling effectively, thereby lowering contamination.

I personally want to wish a Happy Easter, Happy Passover – Chag Sameach, and Ramadan Mubarak to all who celebrate. We are blessed to live in an area with diverse religions, and this month is a special one with several holy days. It is also a wonderful opportunity to learn more about our own and other religions and traditions from our families, friends, and neighbors.

CORAL SPRINGS COMMISSION APRIL MESSAGE

Spring is upon us, and Coral Springs is blossoming with events and community happenings for all ages and interests.

Teen Political Forum (TPF) will be held on Tuesday, April 4 at 6:30 p.m. at the Coral Springs Center for the Arts. We offer this event annually for high school-aged students to ask questions to state, county, and local elected officials via an open mic-style forum where they can learn more about issues that are important to them. High schools with the highest event attendance can win up to $1,000 with prizes sponsored by Baptist Health and WastePro of Florida and take home the TPF trophy.

Many important causes are nationally recognized during the month of April. Coral Springs will strive to honor these initiatives with special events and acknowledgments.

April is Autism Awareness Month. A Touch-A-Truck event will be held on Saturday, April 15 at 11 a.m. at Mullins Park where individuals with special needs will be invited to interact with and familiarize themselves with the various vehicles and equipment in our emergency response fleet. We will also hold a registration for our special needs database. The database allows first-responders to be made aware in advance if they receive a call to assist someone who has unique needs.

In April, Coral Springs will celebrate Earth Month. Residents can attend Earthfest at the Sawgrass Nature Center on Saturday, April 22 to enjoy free nature exhibits, plant giveaways, and more. For more information and a full list of upcoming city events visit coralsprings.org/events.

April is also Financial Literacy Month. Follow along on Coral Springs social media accounts for financial tips and insights from our Budget and Strategy team all month long.

Lastly, we’ll be highlighting our 911 Dispatchers during the week of April 10 for National Public Safety Telecommunicators Week. Our team of highly trained dispatchers are the first, first-responders to provide support in an emergency for Coral Springs, Parkland, and Coconut Creek. Follow our public safety social media accounts for more special features throughout the month.

ocial media has become an integral part of our lives, and, in order to ensure our children are using it safely and responsibly, parents need to get engaged. With the changing complexities involving the uses of social media, parents need to be aware of the potential risks and pitfalls that come with it.

First and foremost, parents need to be aware of the content their children are viewing and sharing on social media. Parents also need to realize that Facebook, Twitter, and Instagram are just the tip of the iceberg, when it comes to social media platforms. Younger children of Generation Z (born in 1995 to 2009) and Generation Alpha (born in 2010 to 2024) may be downloading new social media outlets adults are not familiar with.

What are our children posting on social media? What is being posted about our children? Parents should also be aware of cyberbullying, as well as the potential for

Stheir children to be exposed to inappropriate content. Sharing personal information, such as passcodes, is also problematic. Children need to know that they should not share personal information such as addresses, phone numbers, and financial information with anyone.

In addition, parents should be aware of the potential for their children to be exposed to online predators, which can be accessed not only on smartphones, but also on gaming devices. Our children need to know that they need to avoid strangers, who use these entry points to target them.

Finally, parents should be aware of the potential for their children to become addicted to social media. Children don’t always say they appreciate guardrails, but they inherently seek guidance. Setting limits on screen time usage will provide the parameters they need to avoid debilitating social media addiction that could become a distraction from schoolwork and physical fitness.

In conclusion, it is important for parents to get engaged, in order to ensure their

children are using social media safely and responsibly. Parents should be aware of the potential risks that come with social media and should explain to their children the importance of not sharing passwords, not sharing personal information, not engaging with strangers online, and limiting their time on social media.

By doing so, parents can help ensure their children are using social media safely and responsibly.
