5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - With this first Supervisor’s Notes of 2018, I extend my appreciation to my fellow Town employees for their professional and courteous service to residents and businesses in 2017. I also thank Lowell Knapp, the publisher of Our Towne Guilderland, for including these monthly notes which help keep residents informed of happenings in our Town. As with prior years’ opening notes, I am providing an abbreviated “State of the Town of Guilderland for 2018.” With the support of the Town Board, the Town intends to pursue the following actions to further advance the quality of life for residents: ·

Starting the revaluation of all real property in the Town.

·

Awarding construction contracts for installing storm water infrastructure improvements to alleviate the flooding of basements in McKownville homes.

·

Awarding construction contracts for a sidewalk on Western Avenue from Regency Park to the Guilderland Public Library with a crosswalk to the Guilderland Elementary School, and a sidewalk on West Old State Road from Carman Road to Lynnwood Elementary School.

·

Working with DOT on the design of the proposed improved Carman Road and Lydius Street intersection, with new sidewalks and crosswalks.

·

Working with DOT on its planned repaving Western Avenue from the City line to the Northway, with added bicycle lanes and enhanced pedestrian accommodations.

·

Awarding contracts for a new pump station and adding infrastructure that will link Guilderland and Rotterdam water systems.

·

Awarding a contract for the planning of hiking trails linking neighborhoods with parks and open spaces.

·

Continue acquiring land and adding improvements for parks, playfields, and open space.

·

Further enhancing the Town’s website by providing more online forms and access to public records, and adding to on-demand video content.

The safety of residents and Town employees is paramount at all times but our winter weather gives rise to special concerns. Please remember that overnight parking is prohibited on Town roads during winter months and that motorists should keep a safe distance from Highway Department trucks. Please help our Town firefighters by keeping fire hydrants free of snow and ice, and making sure that your house street number is visible from the road.

Barber - Town Supervisor I also want to recognize Lynne Buchanan, Receiver of Taxes, and her staff for their extraordinary work which allowed residents to prepay 2018 property taxes in 2017 to mitigate the double taxation caused by recent federal tax legislation. Late on Friday, December 22nd, the Governor empowered local tax collectors to receive early payments. Over the Christmas weekend, Lynne worked with County tax officials to obtain the warrant which was required for her collection in 2017 of 2018 property tax bills. Lynne also ensured that the Town’s vendor could prepare tax bills, and provide mailing and online payment options. Through her efforts, the Town was the first municipality to start collecting 2018 property taxes on Tuesday, December 26th. Over the next four days, including during extended hours on Thursday and Friday evenings, Lynne and her deputy Amanda Beedle, along with invaluable assistance from Heather Wienhold and Melissa Wood in the Assessor’s Office, who answered hundreds of phone calls and emails from residents about prepayment options, and accepted in-person payments from 1414 residents totaling over $4.2 million. Hundreds of residents also mailed or paid online the 2018 property tax bills through December 31st. I received numerous compliments from residents for these Town employees’ kindness, efficiency and professionalism. I thank Lynne, Amanda, Heather and Melissa for helping residents deal with the consequences of the federal tax bill. The end of 2017 brings the retirement of Linda Cure who, for more than 10 years, headed the Town’s summer recreational program and GPAC schedule. Linda’s tireless efforts touched the lives of countless children and families. Linda was also instrumental in upgrading the Town’s website and adding video content, and enhancing the transparency of Town government. I join with fellow residents in wishing Linda a well-deserved and enjoyable retirement.

Our Town park system is open for winter recreation activities, including snowshoeing, groomed cross-country skiing, and sledding. Please check the Parks and Recreation Department’s webpage or call the Parks Office at (518) 456-3150 for information on current conditions and activities.

On behalf of the Town of Guilderland and its employees, we wish all of our residents, their families, and businesses a happy, safe, and prosperous New Year.

I also want to thank Town employees who provided essential services to residents over the Christmas holiday. Highway Department employees sacrificed time with their families to keep Town roads free of snow and ice by working long hours on Christmas Eve and Day. Parks Department employees also spent the Christmas holiday clearing snow from more than 20 miles of sidewalks.

Active MAnAgeMent – cAn You Win the Loser’s gAMe? by

Guilderland, NY - Investors are faced with a choice between more than 8,000 distinct mutual funds (excluding multiple share classes of the same fund), according to data from Morningstar. How can investors be expected to choose wisely from such a large investment universe? As it turns out, the first step may well be to filter out all actively-managed mutual funds. Standard & Poor’s, a leading financial market benchmarking firm, prepares a semi-annual analysis called the S&P Indices Versus Active Funds Scorecard, or SPIVA Scorecard. The Scorecard seeks to compare the performance of various mutual funds to relevant benchmarks tracked by S&P. The Scorecard is particularly useful for the following reasons: 1. S&P considers all funds available at the beginning of a sample period, and not just those funds which survived through until today, thereby eliminating survivorship bias. 2. The Scorecard compares each mutual fund to a relevant benchmark, as opposed to comparing all funds to a single benchmark such as the S&P 500. 3. S&P provides analysis on an asset-weighted basis, which reflects the fact that an investor is more likely to have access to, say, the Vanguard Total Stock Market Index Fund ($663 billion in assets) than the Integrity Growth & Income Fund ($36 million in assets). For the period ending 06/30/2017, the SPIVA Scorecard showed that on a 10-year trailing basis, between 64% and 98% of US equity mutual funds were outperformed by a relevant S&P index. This means that even in the best-performing category of US equity mutual funds (those in the Large Cap Value space), only 36% of funds outperformed their benchmark. This lends strong evidence to the wisdom of utilizing index funds (rather than

We find two common objections to the advice to avoid activelymanaged funds – the first is to only use actively-managed funds in the “less-efficient” asset classes, such as small-company stocks or emerging markets stocks. However, the SPIVA Scorecard confirms that active-manager underperformance is as robust in these asset classes as it is in more common asset classes such as large-cap US stocks. The second objection we hear is that investors should limit their choice of actively-managed funds to those with good track records. Bradford Cornell’s 2008 paper “Luck, Skill and Investment Performance invalidates this strategy. His results “indicate that most of the annual variation in [fund] performance is due to luck, not skill.” If skill is scarce while luck dominates, then past performance should not be relied upon to make investment decisions for the future. As we are told time and time again, past performance is not indicative of future results. Finance author Charles Ellis offered this sage advice in his book ‘Winning the Loser’s Game’: “Everything I know is known by the market and worked in to the market…The best way to invest is through benign neglect. Get your asset allocation right and leave your investments alone.” We couldn’t agree more!

Lose For Winning by Leyla Kiosse

Guilderland, NY - The New Year is a time to reflect on the year gone by. For me, the New Year is a time to reflect on the many cases and clients that we have had throughout the year at our office. Every case is different, and with each one there is a new lesson to learn or a reminder of past lessons learned. Attorneys are bound by many ethical rules, which are set forth in the Rules of Professional Conduct (22 NYCRR Part 1200). The lawyer is an advocate for the client, and is duty bound to advocate for what that client wants.1 This means that the lawyer is also bound to abide by the client’s objectives, including the client’s decision to settle a matter. (22 NYCRR 1200 Rule 1.2(a)). For example, we were involved in several cases where our adversary (i.e. our client’s spouse) made a settlement offer that was completely unrealistic for our client, or the spouse making the offer, or both. For example, in one case, our client’s spouse (“Jim”) wanted to keep the marital residence. But Jim had terrible credit and would have trouble refinancing the mortgage to remove our client from the debt. Jim’s solution to this was to offer to sell the house if he could not refinance, but Jim did not want to sell the house for at least two more years. The problem with this solution was that Jim did not make enough money to afford to maintain the house. Jim’s proposal presented huge financial risk for our client. If Jim defaulted on the mortgage or otherwise failed to maintain the house, the result for our client would be a foreclosure or bankruptcy (or both), or the house being in such terrible shape at the time of sale that it would negatively impact the sale price. Our client rejected Jim’s proposal. Interestingly, Jim’s proposal also put him (Jim) in a terrible financial position because he was attempting to hang onto a house that he could not possibly afford. The math was not in JIm’s favor. This was apparent to everyone involved in this case, except Jim. For me, this case is a reminder that, while attorneys have an obligation to pursue the client’s objectives, the attorney also has an obligation to exercise independent professional judgment and render candid advice to the client. In rendering that advice, the attorney may refer to the law, or moral, economic, social, psychological, or political factors that may be relevant to the client’s situation. 2 Sometimes a client can be so focused on achieving his objective that he fails to appreciate the consequences that achievement will bring, no matter how much candid advice his lawyer gives to him. Unfortunately, this means that for those like JIm, one can “lose for winning.”

Happy New Year to All! This is the time of year when many people make New Year’s resolutions. Here are six resolutions for you to consider that can improve your dental health, your overall health and save you some money too. 1. Floss at Least Once a Day It’s great if you can floss more than once a day, but if you can only floss once, make sure you do it before bed so bacteria don’t have a chance to grow while you are sleeping. Your mouth produces less saliva while you are asleep making your mouth more susceptible to bacterial growth. Flossing regularly also helps eliminate bad breath and helps avoid future dental issues. 2. Stop Drinking Sugary Drinks Soda, energy drinks, sports drinks, juice and sweetened tea wreak havoc on your teeth. Drinks like this break down the enamel on your teeth and cause teeth to erode, become more sensitive, and eventually become more painful since they have less natural protection. 3. Eat Tooth-Friendly Foods Some foods are better for your teeth than others. For example, hard, crunchy foods like apples, cauliflower and raw carrots are natural cleansers. And dark chocolate contains antioxidants that prevent bacteria from sticking to your teeth. 4. NEW YEAR, NEW MINDSET By: Dr. Amanda Boccio

Guilderland, NY -The start of a new year is a great time to review, reflect and plan. Many of us make resolutions to eat healthier, exercise more, and lose the extra weight gained over the holiday season. This year, why don’t we shift our mindset and resolve to improve selfcare? In doing so, we make goals to take better care of who we are now, by improving physical, mental and emotional health. Here are some suggestions to improve self-care in 2018: Focus on Personal Wellbeing: At first, you may think that self-care is selfish. This is simply not true. Many of us are not used to putting our own needs before the needs of those around us. Remember, you cannot pour from an empty cup. In fact, self-care is necessary if we want to continue to be able to provide and care for others to the best of our ability. Eat colorful, nutrient dense foods, move everyday, prioritize a good nights sleep, get outdoors, set aside some “me-time”, start and end your day with gratitude. In the long run, making the time to focus on your own health and well being will make you a better parent, spouse, partner and friend. Let Go of Unrealistic Expectations: We are often our own biggest enemy when it comes to setting high expectations for ourselves and “failing” to achieve them.

Let go of the idea of perfection and high

expectations when setting New Year’s resolutions. Make the conscious choice to be kind to yourself and to focus on your needs at the present moment. This will significantly lower stress levels and lead to a significantly happier and healthier daily life. Establish Healthy Boundaries: A key component of self-care is setting boundaries and sticking to them. This means learning to say NO and to not feel guilty about it. This can be a hard practice at first, because we often worry about letting down or upsetting our friends, family and co-workers. Be true to yourself and in your particular needs at the present moment. Saying “no” allows you to focus your effort and intent on particular tasks that you have already committed to. De-Clutter: Cleaning up, clearing out, and organizing your surroundings is very empowering. Donate items that you have not worn, that no longer serve purpose, or do not bring joy to your life. A clutter-free space will make you feel much less mentally cluttered as well. Remember that self- care is an essential part of achieving optimal physical, mental and emotional wellbeing. Make a resolution to become the best version of yourself this year. Wishing you and your family a happy, healthy 2018! From the Library: All of us here at Guilderland Public Library want to wish you a Happy New Year! It may be cold outside, but we have a ton of great activities scheduled for January and February, so if you have cabin fever, come check us out! It’s always warm and welcoming here.

Our first ever Winter Reading Challenge has us partnering with 99 other

libraries coast-to-coast to see if we can collectively read 55,000 books. If we do, then Mark Cuban, the “Shark Tank” investor, will donate $25,000 to First

Book, a charity working on literacy. Just go to guilderlandlibrary.beanstack. org to sign up, and log your reading. Guilderland’s goal is 300 books, but we

are hoping to shatter that number! Why not make it a household competition, to see who can read the most from January 1-31?

January marks the 200th anniversary of the great novel “Frankenstein,” by Mary Shelley. GPL is responding with a full slate of book discussions, movies, and more, and we are even giving away a copy of the book every day in January. Make sure to sign up at our reference desk to enter your name for a chance to win a copy.

We love to put the acoustically sublime Helderberg Room to use in the winter, so we will have a Duke Ellington program by the Sonny and Perley Trio on Sunday, January 28 at 2 pm. This will be preceded by a talk on Ellington by music expert Bill Saxonis on January 13.

The Helderberg Room will be rockin’ on Sunday, February 11, at 2 pm, with “Libraries Rock! Live with WEXT’s Local 518,” featuring The Magdalens, Ferriday, and Zan Strumfield and her Band.

Join Mary Ellen Johnson of the Guilderland Historical Society on Sunday, January 21 at 2 pm for a

talk called “In the Beginning: Guilderland’s First 100 Years.” This talk grew out of a conversation with the ministers at Hamilton Union Presbyterian Church, which recently celebrated its 220th

anniversary, and Helderberg Reformed Church, which celebrated its 250th at the same time! Among

many other facts, did you know our community was briefly called Hamiltonville, after surveyor Alexander Hamilton?

Then perhaps you’ll want to attend a showing of the important documentary “SCREENAGERS,” presented at Farnsworth Middle School on Tuesday, January 30 at 7 pm. We are cosponsoring this event with the Guilderland Central School District.

We have lots of events for kids too, of course, including a full slate of activities for “Take Your Child to the Library Day,” on

Saturday February 3. From 10 am to 4 pm, there will be a scavenger hunt, craft activities, board games, and other exciting activities. WINTER RESTAURANT WEEK 2018

The Guilderland Chamber of Commerce will host Guilderland Winter Restaurant Week from Sunday, February 4th through Saturday, February 10th, 2018. The event is open to all interested restaurants, cafes, bistros, and eating establishments in the Guilderland, Altamont and Voorheesville area. For a fixed price, restaurants offer patrons a threecourse meal that would otherwise be more expensive. The week provides restaurants with increased dining traffic, and a wonderful chance to highlight their menu. In order to include more eateries, there are options: We will offer the standard $20.18 price point for an appetizer, entrée and dessert, for those restaurants who have had success with this, and would like to continue. In addition, we will allow others to offer their own “Special” for the week that would be a discount from regular menu pricing, in order to encourage more customer participation. This can include Family Take Out Meals as well, if you choose. We will post each Restaurant’s menu and/or special for the week on our website, and provide the information in our advertising campaign. The GCC will provide advertising on the Guilderland Chamber website and social media, along with print ads in local papers. Our website promotion will include your menu and the link to your website. The Chamber will also craft press releases, along with GCC member e-mail blasts, and promotion to our members and the community during the weeks prior to the event. Happy New Year! Guilderland, NY - As we begin the new year we enter a phase in the annual cycle of our lives when people ask each other what their resolution is. For me, such resolutions for self-improvement can be made any time, it’s just that the new year provides what feels like a new start. There are many examples of things that feel like new starts and these all provide opportunities for resolving to be better. Birthdays, a new job, a new school or a new home are all good examples of new starts. As the saying goes: “I’m only human.”, so apparently humans have been succumbing to weaknesses and making mistakes for quite some time. Fortunately, being human also allows us the ability to think and plan and notice these new starts so that we can try to improve ourselves. For me there are many new starts, even the start of a new day. As simple as it is, such small new starts provide opportunity to focus on missions or goals in the short term. A big new start for me is when I test for a new level of blackbelt. I tested for sixth degree blackbelt on my birthday this past fall. It was a wonderful experience in New York City where I spent the weekend with my wife and son. I remember it so fondly because I was nervous and so grateful for their support and company. Over the weeks since my test I have been thinking of what has happened in my life while I was a fifth degree. There was a lot because it took the required five years plus one for me. Such reflection is important and I hope you spend the time for yourself because it can help you lead toward resolutions. You can examine the events of last year and make a plan for the new year. Just make sure that you reflect on all of the events you experienced; not only the bad, but also the good and the great. There are obvious resolutions for me as I prepare over the next six years for seventh degree, which will earn me the title grandmaster. To be called a grandmaster I feel like I must obtain a level of unlimited patience in any situation, total relaxation and a disregard for such wasteful feelings as worry and an increased focus on selfless behavior. Mostly I use the examples of my wife and children for how I want to be. When they present me with my new belt next month at our blackbelt tea ceremony, this will be emphasized and begin the focus of my new cycle. This ceremony will be the focus of next month’s installment. I hope you are able to meet all of your goals whatever they are. We all just need the five tenets of Taekwondo to help us along the way: Perseverance, Self-Control, Courtesy, Integrity and Great Spirit. With a focus on these five, you can do anything!
