notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - Despite July’s record rain, the Town’s summer recreation program, sport camps, and swim lessons were at capacity with a record number of children participating. The evening performances at Guilderland Performing Arts Center and the Pines Pavilion at Western Turnpike Golf Course also were very popular and offered enjoyable concerts. With fall’s arrival, please remember that the Town is the home of more than 30 miles of hiking trails in Tawasentha Park, Vosburgh Trails Open Space, Albany Pine Bush Preserve, Bozen Kill Preserve, and Black Creek Marsh Wildlife Management Area. , and. Over the summer, the Parks Department added new hiking trails and improved trail routes in the Vosburgh Trails Open Space. Hike Guilderland!, the Town’s GIS mapping app, provides trail descriptions and locations in Town. And while I hope that I am not jinxing the weather, many of these hiking trails are also ready for snowshoeing. In late September, you will receive in the mail the Town’s fall 2021 Newsletter with a street-by-street schedule for leaf-pickup starting in early October. The schedule will also be posted on the Highway Department’s webpage. Please help Highway Department workers keep our streets safe for all users, including walkers, strollers, and bicyclists, by raking or depositing leaves on the edge of your lawn, and not on the pavement. With shorter daylight hours, it is important to keep streets clear of leaf piles and allowing pedestrians and bicyclists to stay on the side of the street and out of passing traffic. You can also help by keeping storm drains near your property clear of leaves, debris, and lawn bags which helps to avoid stormwater runoff damage and flooding problems. If you have any questions, please do not hesitate to call the Highway Department at (518) 861-5108. With the end of a very successful 2021 season and after over four decades of heavy use by performers and other groups, the Guilderland Performing Arts Center will soon undergo a major renovation, thanks to a $700,000 grant award sponsored by former State Senator George Amedore and advanced by State Senator Michelle Hinchey. The remodeling includes five levels of landscaped terraces, a new dance area in front of the stage, and a new lighting and sound system. The grant also includes refurbishing Tawasentha Park’s main bathrooms and improvements at the large pavilion. GPAC and the Park’s covered pavilions have experienced very heavy and welcomed use by the Town’s summer recreation program, and by school music groups, graduation ceremonies, dance groups, and other groups. The renovation should be completed before next year’s summer camp program and GPAC season. 4

I am very pleased to announce that the State has issued final approval of the $250,000 grant sponsored in 2019 by Assemblymember Peter G. Barber - Town Supervisor Patricia Fahy. With the Town Board’s approval, the grant will allow the Town to incur expenses that will be reimbursed under the grant award. The work includes acquiring two powerlift stretchers which will allow EMS staff to safely lift patients, often weighing well over 200 pounds, into Town ambulances and avoid back and related injuries. The work also includes significant improvements at the historic Mynderse-Frederick House in Guilderland Center, including new energy-efficient windows and roof, and exterior painting. There are also improvements at Abele Park in McKownville including a new bathroom facility, new playground equipment, resurfaced basketball court, new softball field backstop, picnic tables, improved pedestrian pathway, and new entrance sign and kiosk. I thank Assemblymember Fahy for her latest effort to improve the quality of life for Town residents Other Town infrastructure improvements are expected this year. With rights of way acquired and DOT’s anticipated approval of final designs, contracts should be awarded later this year for the construction of new sidewalks on West Old State Road from Carman Road to Lynnwood Elementary School and on Western Avenue from Devonshire Drive to the Guilderland Public Library. We are also working with DOT on its final design of the new roundabout on Carman Road at Lydius Street. DOT is also finishing the design of a second roundabout on Carman Road at the I-890/90 ramp in Rotterdam. Later this fall, DOT intends to issue a request for proposals for a single contractor to construct both roundabouts. Because of traffic flow and management, the Rotterdam roundabout is scheduled to be constructed first with the Lydius Street roundabout likely next spring. You may see some site preparation work, including the removal of the abandoned Nedco building, take place this year. The project also includes the installation of a new sidewalk on Carman Road from Jessamine Drive to the Pine Bush Elementary School. The Census Bureau recently released 2020 data which showed that the Town’s 2020 population is 36,848 persons, an increase of 1,545 or 4.35% over the past decade. It was a bit less than the State’s growth rate of 4.45% to 20,201,249, and more than the County’s 3.50% increase to 314,848. The Village of Altamont’s 2020 population


decreased by 2.6% or 45 persons to now 1,675. The larger towns in the County had comparable growth rates, including Colonie (85,590, +4.90%) and Bethlehem (35,034, +4.09%). Other interesting reported 2020 Census data shows the Town’s growing diversity including that 12.8% of persons aged 5 years or older in Town speak a language other than English and that 11.2% are foreign born. The Town also has a much lower population density than other large municipalities, with 609.7 residents per square mile, compared with Colonie (1,458.5), Bethlehem (686.4), and Albany (4,575.2). On Friday, September 10th from Noon to 6pm, the American Red Cross is holding a blood drive at Town Hall. You can make an appointment by calling 1-800-RED CROSS or visiting RedCrossBlood.org with the sponsor code: guilderlandtown. You can expedite sign-in by completing a pre-donation form at: RedCrossBlood.org/RapidPass. On Saturday, September 25th, Albany County DOH is offering a rabies clinics for dogs, cats, and even ferrets at the Village of Colonie Department of Public Works Garage, 1 Thunder Road. Please note that to avoid animal skirmishes, cats and ferrets are vaccinated from 1pm to 2:30pm and dogs from 2:30pm to 4:00pm. Vaccination is required in New York State. Pre-registration for this event is required and closes on Friday, September 17th: https:// www.albanycounty.com/depar tments/health/rabies- clinicschedule or by calling (518) 447-4620. On Saturday, October 2nd from 8am to 2pm, the Town is holding the Fall Household Hazardous Waste Day and Confidential Document Shredding Event at the Highway Garage in Guilderland Center. The event will again be a “contact-less” event. Please bring proof of Town residency. Additional information on what is allowed or not is available on the Transfer Station website. On Saturday, October 23rd from 10am to 2pm, the Police Department is holding its bi-annual National Prescription Take Back Day in the auxiliary parking lot at the Guilderland Public Library. You can confidentially dispose of both unused prescriptions (remember to remove any identification on the label) and overthe-counter drugs (no needles or sharp objects). This responsible disposal promotes public safety and health by preventing the accidental use or abuse of prescription drugs often found in home medicine cabinets. You can also dispose of pet medications. The April 24th event resulted in the responsible removal nationwide of 839,543 pounds of prescription drugs, including 32,236 pounds in New York State. The Town is following the CDC’s facemask guidance for indoor spaces which recommends the wearing of facemasks, regardless of vaccination status, if the County’s COVID-19 transmission rate exceeds 50 per 100,000 residents on a seven-day average. The wearing of facemasks also includes all public meetings and court proceedings. The Medical Director and EMS Director have opined that the Delta variant is spreading in our community, and that fully vaccinated people can catch and spread it. Medical staff are monitoring local conditions, and will adjust precautions as needed. Peter G. Barber, Town Supervisor

GOT FOOT PAIN? WE CAN HELP! By: Dr. Kim Leis-Keeling Guilderland, NY - Are you living with chronic foot pain that does not seem to go away? Have you been told you have Plantar Fasciitis or a bone spur on the bottom of your foot? Many people ignore this relentless pain, hoping it will just go away. You don’t have to wait any longer, we can help! Plantar Fasciitis is classically described as a sharp pain on the bottom of your foot, either by your heel or in the middle of your arch. It is especially sharp those first few steps out of bed in the morning. The pain gradually feels a little better as you get moving but then can be tender again after sitting for a period of time. What causes Plantar Fasciitis? There are several causes, but we often find that it is a combination of issues that can trigger an exacerbation. Many patients have a bone spur on the bottom of their heel which can become painful from walking too far in inappropriate footwear. Others have calf muscles that are too tight and then become aggravated by wearing shoes with little support, or a change in exercise routine such as running hills or jumping. It can also be caused by foot mechanics that are described as either too flat or too high of an arch. Left untreated, it can lead to other joint pains in the knees, hips and low back. This is due to altered walking mechanics because the individual is trying to avoid stepping on the painful foot.

We tend to see an increase in cases of Plantar Fasciitis during the summer. When we transition from winter shoes, where our entire foot is covered, to wearing flip flops and sandals, there can be some initial strain on your feet and legs. Many summer shoes lack adequate support for spending longs days outdoors. Flip flops typically have the least amount of foot support and are best worn for a short duration such as a quick trip to the store or when they need to be removed frequently such as going to the beach or the pool. Strap type sandals with good arch support are better for longer walking trips or activities. Supportive shoes help to prevent strain on the intrinsic foot muscles, legs and hips. Over the years, we have treated many cases of plantar fasciitis with great success. Treatments typically include Active Release Techniques, Instrument Assisted Soft Tissue Techniques, Cold Laser, Ultrasound Therapy, Rehabilitation exercises for the feet, and lastly Custom Orthotics if indicated. The combination of these treatments has been very successful over the years to combat that nagging foot pain. If you or someone you know has been suffering from foot pain, we would be happy to help. TAX PLANNING VS. TAX PREPARATION by Douglas Bauer Many people focus their attention on income tax preparation at the beginning of each year, prior to the annual April 15th income tax filing. While filing income tax returns in a timely manner is certainly a prudent strategy, it is often too late to engage in any effective income tax planning, as the year for which you are filing your tax return has already passed! Income tax planning should be a year-round activity. Here are some items you may wish to consider for tax year 2021: •

Ensure that you are on pace to make your desired level of employer-sponsored retirement plan contributions (401k, 403b, etc.). For 2021, the maximum employee contribution amount to such plans is generally $19,500 per employee, plus an additional $6,500 for those who are age 50 or older. Additionally, many plans now offer the option to make contributions to a post-tax Roth account. Verify whether you are eligible to make a tax-deductible contribution to a Traditional IRA or a contribution to a Roth IRA. You can contribute as much as $6,000 to such an account in 2019, plus an additional $1,000 if you are at least 50 years old as of 12/31/2021. Taxpayers in the 12% or lower federal marginal income tax bracket (taxable income of $40,525 or less for a single filer, or $81,050 or less for joint filers) may wish to take advantage of the 0% federal long-term capital gains rate. For example, a married couple with taxable income of $50,000 could realize up to $31,050 of long-term capital gains with no federal capital gains tax bill! However, please be aware that realizing capital gains may impact the amount of your social security which is taxable, and may impact eligibility for certain income-tested programs.

On the other hand, capital loss harvesting can be an effective income tax reduction strategy. Taxpayers are allowed to claim up to $3,000 per year in capital losses, in addition to washing out any realized gains, as a direct reduction in adjusted gross income. For a taxpayer in the 22% marginal federal tax bracket, a realized capital loss of $3,000 can reduce her federal tax bill by as much as $660.

Consider “bunching” or “prepaying” future charitable donations through the use of a donor-advised fund. Such a fund potentially allows a taxpayer to take an immediate income tax deduction this year for planned giving which may not occur until many years down the road.

Please consult your tax preparer and/or financial advisor to determine if any of the above strategies are appropriate for your overall financial situation. With taxes, as in many other areas of life, a little bit of planning can go a long way. We encourage you to make tax planning a year-round activity, and not just the one hour per year you scramble to assemble your records for your tax preparer!

HOW DO I KNOW IF I AM REALLY MARRIED? by Margaret C. Tabak

Guilderland, NY - This is not a question that crosses my desk on a daily basis, although many a client has tried to squirm his/her way out of a valid marriage. For example, one of my client’s was married by a religious officiant. Some 25 years after the marriage, the officiant was de-frocked. Much to my client’s chagrin, there is no question that at the time of the marriage the officiant was more than qualified to perform the marriage. In Yusupov v. Baraev1, the Wife alleged that the parties had a religious ceremony and that each signed the religious marriage contract . She alleged that the marriage occurred at her mother's apartment and that besides the officiant, her mother and cousin were present. There was no marriage license, photographs of the wedding, and she did not indicate on her tax returns that she was married. The Defendant/Husband stated that he never signed the religious contract, and the signature was written in a language he did not know. When the Wife sought a divorce, the Husband sought to dismiss the divorce stating they had never been married. The Husband won. While there is a strong presumption favoring the validity of marriages, and it is not necessary for all persons intending to marry to obtain a marriage license2, the marriage is not void for failure to obtain the license if it is solemnized3, which means: No particular form or ceremony is required when a marriage is solemnized as herein provided by a clergyman or magistrate, but the parties must solemnly declare in the presence of a clergyman or magistrate and the attending witness or witnesses that they take each other as husband and wife. In every case, at least one witness beside the clergyman or magistrate must be present at the ceremony. If you want to ensure you are married: 1. 2. 3. 4.

Obtain a marriage license (and keep a copy of it); Have the marriage performed by a clergyman or magistrate qualified in New York State; Make sure you have at least one witness present; Take pictures!

Another case of mine involved a "commitment" ceremony, as one of the parties was still married. Be careful that your commitment ceremony does not duplicate a marriage, or you will be committing bigamy, which is a felony in New York State.

WHAT COULD I HAVE DONE TO HAVE PROTECTED MYSELF There is a doctrine in law known as res judicata. Simply defined, once a lawsuit is decided, the same issue or an issue arising from the first issue cannot be contested again. The doctrine of res judicata "operates to preclude ... claims for different relief which arise out of the same factual grouping or transaction and which should have or could have been resolved in the prior proceeding." In determining whether a factual grouping constitutes a transaction for res judicata purposes, a court must apply a pragmatic test and analyze how the facts are related as to time, space, origin or motivation, whether they form a convenient trial unit and whether treating them as a unit conforms to the parties' expectations or business understanding. See Chen v. Fischer, 6 N.Y.3d 94 (2005); Smith v. Russell Sage Coll., 54 N.Y.2d 185 (1981). You may be wondering how this concept effects people in matrimonial cases. In one case Baronow v. Baronow4 a former wife brought a lawsuit after the divorce concerning the marital residence. It had been titled in the sole name of the husband and was not litigated in the divorce. The Wife sough a constructive trust, seeking half the value of the residence. The case made its way up to New York State's highest court, that had held that the parties should be able to plan for the resolution of all issues related to the marriage relationship in a single action, and sent her on her way. In another case5 a wife's subsequent personal injury action against the husband was allowed as the court ruled that the interspousal tort action did not form a convenient trial unit with the divorce proceeding. One would think the same set of facts, different legal claim, should have been heard together. Another “you can’t go back” concept is collateral estoppel. Collateral estoppel is based upon the notion that a party should not be permitted to relitigate an issue decided against it. Two requirements must be satisfied. First, the party seeking the benefit of collateral estoppel must prove that the identical issue was necessarily decided in the prior action and is decisive in the present action. Kaufman v. Lilly & Co., 65 N.Y.2d 449 (1985). Second, the party to be precluded from relitigating an issue must have had a full and fair opportunity to contest the prior determination. D'Arata v. New York Cent. Mut. Fire Ins. Co., 76 N.Y.2d 659, 664 (1990). The party opposing the estoppel must demonstrate the absence of a full and fair opportunity to contest the prior determination. Nappy v. Nappy, 100 A.D.3d 843 (2d Dep't 2012. What does this mean to the average person? If you feel that there is an issue remotely attenuated to your spouse, or property owned by either or both of you, you must bring it to the attention of your attorney. If the attorney does not know about a potential dispute surrounding a divorce litigation, she cannot properly advise you and seek what may be appropriate compensation. For example, after her divorce a client called me about a dispute over her/ their hot tub. As I did not know she had a hot tub, it was never on my radar. Unless you are inviting me over for a relaxing soak, understand I probably do not know about the amenities in your home. You don’t want a court to tell you later “don’t let the door hit you on the way out.”

BUILDING ON THE FUTURE By Library Director Tim Wiles The finish line is in sight – the ribbon cutting is just around the corner! We are excited to prepare to welcome you back into the newand-improved Guilderland Public Library this fall! Here’s an FAQ run-down of what you can expect. WHEN WILL THE LIBRARY REOPEN FOR PUBLIC BROWSING? Thank you for your patience! At long last I can announce that the Guilderland Public Library will fully reopen on Monday, September 27th! Now, on to the caveats: That date is subject to change based on the newly resurgent Covid-19 problem. But that is the date when we currently plan to open the doors to fully masked library patrons! Not everything will be immediately available, but the majority of our collections and services will be, and by that time, we’ll have finished working on all but a few cosmetic construction details. We will be returning to our standard hours: • MONDAY-THURSDAY 9:30-9 • FRIDAY 9:30-6 • SATURDAY 9:30-5 • SUNDAY 1-5 WHAT’S GOING ON INSIDE RIGHT NOW? We are working on technology installations, some final electrical and lighting details, some painting touchups, and the all-important process of turnover—that is, the time when the building is no longer the responsibility of the general contractor and subcontractors, but is turned back over to the library. It’s a bit like closing on a house. One moment, the building and its contents are still under construction, and so if anything goes wrong, the contractors fix it. The next moment, it’s the library again. As good stewards of public funds and a building, we need to get everything in top shape before the transition occurs. 16

HAVE YOU HAD ANY COVID-RELATED MATERIALS DELAYS? We have. Currently, we are anxiously awaiting the arrival of our new shelving, as well as facing delays in getting anything that contains a computer chip, interior window glass, and basic furniture including tables and chairs. On September 27th, we almost certainly will have succeeded in getting our final shelves shipped, assembled, installed, and loaded with books. COVID-related supply chain delays have that particular part of our operation about two months behind schedule. Thankfully, we accelerated construction earlier in the process, before many of those shortages and supply chain issues began to occur. After we open, there may still be an occasional contractor putting finishing touches on things here and there, but overall, we will be ready for you to visit. There are some expected delays in getting chairs and tables that may make the place look and feel a little spare for a month or two, but generally speaking, we’ll be able to serve you. WILL YOU STILL OFFER CURBSIDE PICKUP? Curbside services will continue through the end of the day on Sunday, September 26th, but will be unavailable for at least the first few weeks the library is open for public browsing, and possibly indefinitely. We are not sure if we will be able to offer curbside at the same time that we serve patrons in the building, nor are we sure how much demand there will be for curbside among library patrons. We’ll have to wait and see. Like so many things in this pandemic era, organizations are forced by ever-changing conditions to refine themselves on the fly. HOW ABOUT MEETING ROOMS AND STUDY ROOMS? Meeting and study room use is expected to resume Monday, October 4th. Beginning that day, patrons can begin calling or emailing to reserve the two adult community rooms. Simply email meetingrooms@guilderlandlibrary.org, or call 518-456-2400 x110. WHEN WILL COMPUTERS BE AVAILABLE FOR PUBLIC USE? We don’t exactly know, but we expect the new computers to arrive by mid-to-late October. They’ve been difficult to obtain, given the worldwide computer chip shortage.


HOW ABOUT LIBRARY PROGRAMS—STORY TIMES, BOOK CLUBS, SPEAKERS, FILMS, CONCERTS, ETC? Due to continuing concerns about COVID, library programs will continue to be held virtually, and occasionally outdoors at local parks throughout the fall. IS PHOTOCOPYING AVAILABLE? Yes, the public copier will be available. Right now, we are making copies at no charge, within reasonable limits. HOW ABOUT LIBRARY FINES? Library fines remain suspended for now. We’ll give you ample notice when they return. WHAT’S THE LATEST ON THE NEW CAFÉ? We issued an RFP for proposals for owner/operators who would like to rent the space. While we had three parties interested, none submitted a proposal by the deadline. We are following up with them now to address any concerns, and we are likely to re-issue the RFP with a new closing date in the near future. At least one potential vendor has told us it is extremely difficult to hire people to work in such positions at this time. So, we won’t have a café upon reopening, but we will secure a vendor as soon as possible. GOT ELECTRIC CHARGING STATIONS? Yes! We have two Level 2 EV charging stations, each capable of charging two cars at a time. What’s even better is that the rebate offered by NYSERDA covers the entire cost of purchase and installation, so these stations were essentially free. FINAL THOUGHTS ON THE PROJECT? The final financial books are not yet closed on the project. It will likely take two or three more months of cleanup before we can say that everything is done and all resulting minor problems addressed. However, we are confident that we will be finishing construction about 10.5 months earlier than expected, and at a cost savings of at least a quarter million dollars below the anticipated project cost. We were fortunate to hit very few major snags throughout the process. We also thank you for your patience—our original plan called for only occasional closures of a few days at a time. When COVID threatened to close the facility anyway, we capitalized on that and were able to realize the cost and time savings above. The new facility is 20% larger, with projected utility costs 20% lower, due to advances in technology and green initiatives. Plans are in the works for a Grand Reopening celebration of all we have accomplished as a community in creating this totally transformed facility for all to benefit from. More details to come - watch this space! A HOLE IN ONE The Guilderland Library Foundation, a separate non-for-profit dedicated to raising funds to enhance the library experience, held a very successful golf tournament in August at the Western Turnpike municipal golf course. A total of 47 golfers enjoyed 18 holes, while 72 individuals or businesses donated cash, refreshments, and/or prizes. Five companies and one very generous library supporter sponsored the tournament at the $1000 Birdie level: Dr. John Brennan; Jaeger & Flynn; Monaco, Cooper, Lamme & Carr; The William Coons Team at Howard Hanna Real Estate; and Turner Construction.
