Happy 2013 to All! If you are reading this, then I guess the Mayans were wrong. Since the world has not ended, I’m hoping that we will all be inspired to make 2013 the best year ever - for our businesses, our families, our customers, and our community.

This year we are celebrating “100 Years of Quality Service Through the Code of Ethics”. We can celebrate that, though our real estate industry is constantly evolving, our core values have not changed. As NAR President Moe Veissi explained “Only members of NAR can call themselves REALTORS®, and as a condition of membership, REALTORS® subscribe to NAR’s strict Code of Ethics. Realtors® are the heart of the deal, and the Code of Ethics is our guiding principle.”

He added, “ The Code of Ethics is one way REALTORS® demonstrate value to home buyers, sellers, and investors. Buying a home is one of the most important investments people will make in their lifetimes, so having a REALTOR® who abides by a Code of Ethics can provide an added layer of security.”

You can be proud to be a member of NAR - an association that is more than a century old and gives us the resources we need so that we can best represent our customers during the whole transaction process.

Thank you to all who completed our 2012 survey - we have our marching orders from our members and affiliates - and have planned our education and events around what you have said is important. I’m hoping to see many of you attending as the year progresses. Some exciting things are coming and, as always, we will continue to solicit feedback from you.

I’m reminded of the Starfish story about the old man walking on the beach after a storm, seeing hundreds of starfish washed up on shore, and coming upon a young boy reaching down to pick up a starfish and throwing it back into the sea. The old man says to the boy - “there are so many starfish on the beach - what difference can you possibly make?” The young boy picks up a starfish, throws it back into the sea, and says “ it makes a difference to this one!”

YOU make the difference in our association and each of you has something to contribute. I encourage you to get involved in your association during 2013. Remember - OSCAR is not a building - OSCAR is each of us working together to make this the best association in service to our customers and respect for each other.

2012 President Renee Clark and OSCAR Association Executive, Carol Platt, were joined by the celebrity couple, Mickey and Minnie Mouse, as they attended the 2012 Future of Florida Forum this past October.

Economy, which focused on the cornerstones of Florida’s economy, tourism, agriculture and development - and the presentation on “Healing What Ails Us - Healthcare’s Impact on Prosperity”.

OSCAR members, along with members of the Florida Chamber of Commerce attended the annual forum which featured keynote speakers, Wisconsin Governor Scott Walker, University of Texas Professor, John Doggett and former U.S. Secretary of Education, William J. Bennett.

Meanwhile, OSCAR Associate Executive Carol Platt participated in a St. Petersburg College Collaborative Labs workshop on Trade and Logistics: Convergence and Clarity and attended the roundtable breakout session, A Powerful Future: The Elements of Florida Energy Policy. As an integral part of Florida’s Future, OSCAR was present and engaged!

This annual event is attended by Florida’s business, industry, and governmental leaders with a common purpose and commitment to securing Florida’s Future. Chairperson, Bentina Chisolm Terry, led the 2012 Forum with a focus on healthcare, energy and privatization, entrepreneurialism in Florida’s Innovation Industries, agriculture, tourism, and development.

As we begin a new year of our lives in the Florida real estate profession, planning properly (for investment of time and funds, for targeted expenditures, and for operational costs) is the key to success for Brokers and Associates alike.

Lawrence Yun is the National Association of REALTORS®’ premier economist who has given us consistently accurate projections over the years that help REALTORS® plan for success, has set a few national benchmark projections as follows: Commercial Office Space: Vacancy rates in the office sector are expected to fall by 15.6 percent in the third quarter of 2013. Office rent is projected to increase by 2.6 percent in 2013.

Commercial Industrial Space: Industrial vacancy rates are forecast to decline by 10.5 percent in the third quarter of 2013. Annual industrial rent is likely to rise by 2.4 percent next year.

Commercial Retail Space: Retail vacancy rates are projected to decline by 10.7 percent in the third quarter of 2013. Average retail rent is forecast to rise by 1.3 percent in 2013.

rates drop to 4.2 percent in the third quarter of 2013; vacancy rates below 5 percent generally are considered a landlord’s market with demand justifying higher rents. Average apartment rent is likely to increase another 4.4 percent next year.

Yun warns us, however, that a fiscal cliff scenario of higher taxes and sharp spending cuts beginning in early 2013, which may be an unlikely event but still worth noting, would lower the sales projection to 4.5 million. In addition, because of measurably lower inventory supplies, the forecast for home prices has been upwardly revised with the median existing-home price projected to rise by 4 to 5 percent in 2013, with wide local market variations.

Yun says that these price gains will measurably reduce the number of underwater homeowners. “For example, a 5 percent national price gain means the number of underwater homeowners would fall to about 9 million from current estimates of around 11 million. A 10 percent gain, say over the next two years, would reduce the underwater status to about 7 million households out of 75 million owner-occupied homes,” he said.

Yun is not alone in his optimism for stability and improvement in the marketplace. A Wall Street Journal

SUNRAIL SNEAK PEEK

WOWS COMMUNITY LEADERS

Over 160 business and community leaders, along with elected officials, participated in a SunRail Sneak Peek ride on Friday, September 14, 2012, from 7 a.m. to 3 p.m., traveling on the regularly scheduled, daily Amtrak train that runs through Central Florida. After assembling at the LYNX Central Station in Downtown Orlando, they were transported by LYNX buses

to the Deland Station to board the train. Several participants joined the group in Deland.

Once on the train, members of the Central Florida Commuter Rail Commission and the Florida Department of Transportation were on hand to point out important stops along the commuter rail line and answer any questions participants had. The Amtrak train stopped only at the regularly scheduled Amtrak stops and not at all the commuter rail stations, but the amount of work already underway on laying double tracks and pouring concrete for the SunRail station platforms was quite evident.

Upon arriving at their final destination, the City of Kissimmee arranged for a special welcome as participants were guided from the Kissimmee Station to the Kissimmee Civic Center, where there was an opportunity to visit a number of SunRail exhibits before entering the luncheon area. Transportation Experts Harry Barley from MetroPlan Orlando; Larry Adams, ACi Orlando; John Lewis, LYNX; and Tim Jackson, Florida DOT; provided a briefing on the commuter rail system.

Participants were transported back to the LYNX Central Station and to Deland.

A Thank you letter from Patsy Heffner Florida Realtors Political Action Committee 7025 Augusta National Drive Orlando, FL 32822-5017 Dear Members: Thank you for your continued support of my campaign. I am honored to have received your endorsement and pledge to you that your faith in me will never be taken lightly.

Your contribution is particularly welcomed because, as a Constitutional Officer, I cannot vote to put roads through private property, I cannot award large contracts to businesses, and I cannot vote to rezone properties. Therefore, contributors don’t typically look at us as someone that can help them, leaving us at a disadvantage in financing our campaigns. And yet, unlike board and commission members, we must run county wide, significantly increasing our expenses. We need more signs, we have to print up more brochures, and we must mail to a much larger universe than any other local candidate.

Few people understand why we elect our Constitutional Officers. To understand that, you have to know why we were created in the first place. Please allow me to share a bit of history with you...Our forefathers were wise beyond their years when they created the State Constitutional Offices. The purpose was to create a means of delivering state services on the local level. They intentionally established them as independently elected officers to address three specific issues: 1.

The first and foremost, was to create a system of separation of power and of duties and responsibilities and to provide a system of checks and balances. The purpose of this was to insure that each of us only had a piece of the pie, thus eliminating the ability of any one of us to make decisions that could favor one citizen or be detrimental to another. This was their means of assuring that all citizens would be treated equally.

2. The second was to insure that as a deliverer of state services, we would be directly responsible to and responsive to the citizens of the counties we serve.

3.

And the third was to insure that there would be no undue influence or interference with our ability to provide state

services, thus the reason that our budgets are approved by the State Department of Revenue.

The best example of separation of powers can be found in the tax collection service. It is the Property Appraiser’s responsibility to determine the value of property. It is the taxing authority’s responsibility to establish the millage rate that will apply to that value. Once the Property Appraiser merges the millage rates into the tax roll, it is certified and delivered to the Tax Collector’s office for billing, collection, and distribution. In the event a taxpayer disputes the assessment, they must first apply to the Board of Adjustment. If they are unsuccessful in that venue, they then may file suit with the Clerk of the Circuit Court. The Clerk is the official record keeper and prepares the summons based on the complaint. The summons is then delivered to the Sheriff for service and he/she must return to the Clerk evidence of service. It is the Supervisor’s responsibility to ensure that all citizens have an equal opportunity to elect all of us. None of us has access to alter or modify documents or procedures of another’s office.

Our offices play a vital role in ensuring fairness and equality in the delivery of state services. By reporting directly to the citizens, the bureaucracy is eliminated, giving our citizens direct access to the “CEO” of their office.

I am proud of the fact that I have accounted for every penny of the over $4.5 billion that I have collected since taking office.

I am proud of the fact that I have received a perfect audit... performed by outside, independent auditors...every year that I have been in office, and I am proud of the fact that I have saved the taxpayers of Osceola County 442 million dollars since I have been in office...but then, I believe that is exactly what our citizens elected me to do.

Your contribution will play a vital role in the success of my campaign and my continued ability to continue to serve the citizens in the manner in which they deserve.

5 Rules for Keeping Your Tax Records &

For disorganized people April is indeed the cruelest month.

Step Three: Group your records into 4 main categories:

If you haven’t gotten your tax information to your tax preparer by now, it’s probably because you’ve been running around like Robin Williams on Red Bull trying to locate your receipts.

Receipts, Expenses, Fixed Assets, Inventory, Liabilities Set up a folder for each category as follows:

You look in the glove compartment of your car and find a few records there. You look in your wallet and find a few receipts stuffed between a crumpled dollar bill and a business card from someone you don’t ever remember meeting.

But mostly you try to avoid thinking about it because when you do it makes you more nervous than a Chihuahua in the front row at an AC DC concert.

Unless you’re a masochist and enjoy self-torture, you will want to put an end to this by following the 5 steps discussed below.

But remember, without your commitment change simply cannot take place and like a Pavlovian dog you will continue to dread rather than embrace the most beautiful time of the year.

Include in the Receipts folder a copy of your reconciled bank statements for the year and any cash register slips or other information about your income Include in the Expenses folder copies of all vendor invoices for the year and copies of all cancelled checks and credit card transaction reports Include in the Fixed Assets folder copies of all invoices for the year relating to the purchase of furniture, fixtures, automobiles and equipment and copies of documentation for any sales of such assets you made during the year.

Include in the Inventory folder copies of all invoices related to the purchase of inventory or raw materials during the year and records of all physical inventories taken at year end.

Include in the Liabilities folder copies of all promissory notes, mortgages, equipment or premises lease agreements and payment schedules relating to same.

Step One: Keep Your Records Electronically

Every self-employed person or small business owner should keep their books using a reputable accounting software package such as Quickbooks or Quickbooks Pro.

Step Four: Further group your Expenses

And even if you are not self-employed, it’s a good idea to electronically keep track of your personal records and finances.

Keeping your records electronically is just the beginning, you still must have a system for retaining and organizing your underlying accounting records.

Here is how we recommend our self-employed and small business clients keep their records.

Step Two: Segregate your tax records by tax year Whether you file your tax returns on a calendar or fiscal year, you report the results of your business operations for a twelve month period.

Consequently, your tax records should be separated by tax year.

This seems like a no-brainer, but more than a few times we’ve had clients give us boxes of records that contained several years receipts rather than just the receipts for the tax year we were handling.

This made our job more difficult and (you guessed it) resulted in an increase of our fees.

Your Expenses folder will contain the most documents and, therefore, needs to be organized further as follows: • • •

Print out a Chart of Accounts from your Accounting Software Create a folder for each expense account category included in your Chart of Accounts Group in separate sub-folders all vendor invoices and/or canceled checks by expense account category

Step Five: Prepare and Maintain a Fixed Asset Schedule Prepare a list of all furniture, fixture, equipment, real property and vehicles owned by your business.

The list should include the following information: • • • • • •

The date you purchased the asset; A description of the asset; The amount you paid for the asset; The date you began using the asset for business purposes; The date you sold, disposed of or ceased using the asset for business; and The amount you sold the asset for.

Keep everything related to your business and organize it on a daily basis in accordance with the above instructions and you will minimize your accounting and potential tax problems.

EXPLORING THE uk:

A HORSE OF A DIFFERENT COLOR Global agents are aware of the ways in which differences in culture and business practices can complicate transactions.

Yet the U.S., Canada, and the U.K. share a cultural heritage, a common language, and their governmental and legal systems share roots. How different can real estate practices in the U.K. be?

Astoundingly different, say buyers who have bought property on both sides of the pond. Since buyers’ expectations can create stumbling blocks to international transactions, here’s a primer on the players and the process for buying real estate in the U.K., and the implications for dealing with British buyers in the U.S.

Agent Qualifications and Compensation U.K.: There are no licensing or educational requirements for estate agents (real estate agents). Most estate agents work for an agency as salaried employees.

Implications: A brief explanation of licensing requirements and professional designations will bolster credibility with U.K. buyers. By discussing how commissions work in the U.S. they’ll also understand an agent’s financial interest in helping them purchase the right property.

Do offer to introduce clients to a U.S. accountant to help them structure their purchase with appropriate tax considerations, and/or to a U.S. property attorney who is versed in international property law. Also have a good relationship with a U.S.

immigration attorney who can advise them on their ability to use their own property, should that be their intention.

Buyer Representation U.K.: Estate agents only represent sellers. Buyers must look out for their own interests.

Implications: Since the concept of buyer representation doesn’t exist in the British real estate market, U.K. buyers may not be familiar with it. For buyers expecting to navigate a foreign market on their own, it will be a welcome surprise. Explain that a buyer’s representative owes duties of confidentiality, accounting for the buyer’s funds entrusted to the agent, and full disclosure of materially relevant information during the buying process. Though only a minority of states require a written agency/representative agreement, all agents have an obligation to disclose material facts - even those who represent sellers.

MLS and Market Transparency U.K.: There is no shared listing information among estate agents. Sellers often list their property with multiple agencies and agents sell only their own company listings. Buyers may narrow their search by visiting public real estate portals and then contacting listing agents, or by viewing agency websites in their locations of interest.

Implications: The MLS and concept of market transparency may be new to U.K. buyers. Explain that most agents are

members of an MLS and therefore have access to information for ALL listings, comps (comparables) on similar properties and can show all properties meeting a buyer’s criteria.

Property Viewing U.K.: Sellers are often present and a sense of privacy may discourage buyers from examining properties in detail.

Implications: British buyers may not realize it’s acceptable and expected for them to look in closets, attics, and cabinets when viewing a property. Advise them prior to a showing that they have tremendous leeway in exploring the property, both outside and in.

Making an Offer and Negotiating U.K.: Buyers make verbal offers to sellers through the seller’s agent. There may be verbal counteroffers. If a price is agreed upon, the buyer contacts a conveyance solicitor (real estate attorney) who will draw up a contract and work with the seller’s solicitor. At this point the estate agent pulls the listing and exits

the process. The accepted offer is not binding until the actual signing of contracts and full payment by buyer in exchange for transfer deed. No firm date is set for closing. The buyer will show commitment by making a small deposit, perhaps £500 to £1000, into the solicitor’s account.

“Gazumping” (in which a buyer is informed late into the purchase agreement, often on the very eve of contract completion, that someone has come along and offered the seller a better price) and “gazundering” (in which a buyer informs a seller late in the purchase period that they are no longer willing to pay the agreed price, but will purchase the property at a new and lower price) are bewildering and not uncommon practices which may arise in a purchase.

Implications: U.K. buyers may not realize that in the U.S., written contracts are exchanged throughout the negotiation process, and that the terms and timing specified in them are fixed and binding. They also may not be aware that an earnest money deposit of one to three percent of the offer price is required of them for escrow, which may be forfeitable if they do not complete the sale.

Advise them on using contingencies to protect their position during the transaction, and let them know that their agent will assist them through closing.

Let them know that gazumping and gazundering are not allowed. Also, explain the Foreign Investment in Real Property Tax Act (FIRPTA) requirements and assist them in obtaining a U.S. International Taxpayer Identification Number (ITIN) from the IRS.

Closing U.K.: The buyer’s solicitor will check the property title, encumbrances, and history of the property, and then finalize the contracts details with the seller’s solicitor. A day is set to exchange signed contracts and turn over the deposit. The sale is not closed until the completion date, which may not immediately follow the contract exchange. On that

continued from page 25 date the key is handed over and remaining funds are delivered in return for the transfer deed.

Implications: In the U.K. the process of drawing up final contracts and setting the date of completion are fluid. At any time during the process a sale can and often does fall through. U.K. buyers will no doubt appreciate that U.S. transactions adhere to a firm time schedule and that their agent will help coordinate the players for a timely and smooth closing.

In short, the process of buying property in the U.S. is usually more predictable and reliable than in the U.K. and requires less work on the part of buyers. Educate British buyers on what to expect during a purchase and emphasize the binding nature of timing and terms with written contracts. They will be glad to have solid representation guiding them through the completion of their transaction.

While this example focused on the U.S. and the U.K., other nuances exist from country to country. It is important to educate your clients and make sure each party has a clear understanding of the transaction process no matter where you live.

TECH HELPLINE UPDATES ITS PROCESSES Florida REALTORS® Tech Helpline has updated the way it processes phone calls in order to more quickly connect members with an analyst that can help.

Once finished, the sort rep will then transfer the member to the analyst best suited to help - a Forms Tech if it’s related to Form Simplicity, or a Tech Analyst for other problems.

This new system allows the Tech Helpline to answer calls faster. The first analyst, a sort rep, will gather necessary member information and talk about the reason for the call.

The second analyst will be able to help quickly since the technical details and member information has already been logged into the system under the new process.
