Getting Results and Looking To Another Successful Quarter Amazing that the first quarter of our year is over and the monumental “100th Day” of the Presidential year is upon us. I’m glad to report that OSCAR in its 91st year of existence; has grown to be a medium sized association with 2200 members; and is robust in finances, leadership, membership, with a strong Association Executive, and Member Advocates as well. It is a great sense of joy realizing our values, commitments, and goals are fused together making your career successful and significant.

We are alerting members of the Federal change starting 8/1/15 on New Loan Estimate & Closing Disclosure Forms, to better prepare you to help your buyers & sellers.

We hosted a successful RPAC Investor Awards ceremony & Casino Night Our Advocates assisted members in transitioning to new Supra lockboxes and were instrumental in the success of our MLS login numbers being changed as required.

2015 OSCAR President, Karen Dierickx We continue to provide a number of FREE education classes that earn CEs towards your license renewal.

Our Member & AE/Advocates attended the FR MidWinter Meetings to keep us up to date on public policy, law changes, professional standards, education, REALTOR® benefit programs, etc.

And on March 3rd-4th OSCAR Leadership & Members attended the annual Great American REALTOR® Days in Tallahassee or “Rally in Tally”. There were over 1,000 members wearing blue REALTOR® shirts and ‘Ask Me! I’M A REALTOR®’ Buttons.

We had a chance to directly connect with our State legislators and have an actual voice. We were armed with specific talking points stating what we’d like to see amended, reformed, initiated, etc. in this year’s sessions. All this connects REALTORS® and Communities to Tallahassee. Florida Realtors urged the following actions to be taken for this current session: • • • •

Begin a phase out of the current sales tax on commercial leases Vote YES on SB 140/HB101 Cap fees charged by community associations for stopped letters Vote YES for SB 736/HB 611 to fully fund the Sadowski Trust Fund and support legislation that dedicates a portion of these funds to the Department of Children and Families for programs for the homeless Vote YES on HB 379, AMEND SB 586 to increase distributions to the housing trust funds

OSCAR member John Goldsborough has been appointed to the Affordable Housing Advisory Committee through the end of 2017. This Committee is set up to review established policies and procedures, ordinances, and land development regulations. This Committee also serves to recommend specific actions or initiatives to encourage or facilitate affordable housing, while protecting the ability of the property to appreciate in value.

Q. If a seller is presented with multiple offers from the listing agent, all at list price, is it the obligation of the listing agent to disclose terms of the other offers to the buyer’s agents so the buyers are aware not only that there are multiple offers but also that the buyers might want to enhance their offers?

A. In any multiple-offer situation, it’s the seller, not the listing agent, who calls the shots. The listing agent’s duty under Article 1 of the Code is to “protect and promote the interests of their client” and to “treat all parties honestly.”

The listing agent should give their seller client information and advice about negotiating multiple offers. Standard of Practice 1-15 provides “REALTORS®, in response to inquiries from buyers or cooperating brokers shall, with the sellers’ approval, disclose the existence of offers on the property.”

Talk with the seller about whether he or she wants the existence of multiple offers disclosed. If the seller approves such disclosure and a buyer or cooperating broker asks if there are multiple offers, then the listing agent is required to disclose that.

Standard of Practice 1-13 gives guidance for both buyer’s agents and listing agents about disclosure of the terms of the multiple offers. “When entering into buyer/tenant agreements, REALTORS® must advise potential clients of . . . the possibility that sellers or sellers’ representatives may not treat the existence, terms, or conditions of offers as confidential unless confidentiality is required by law, regulation, or by any confidentiality agreement between the parties.”

Buyer’s agents should discuss how multiple offers may be handled, including the fact that once an offer leaves the buyer and buyer’s agent’s hands, there is no duty of confidentiality that the seller or listing agent has to the buyer to keep the terms of the offer confidential unless state law prohibits a listing agent or seller from disclosure of terms or there is a preexisting confidentiality agreement with the parties. Listing agents should always look first to their seller client for direction in negotiating multiple offers.

5 THINGS you should never do in online marketing

With online marketing there are plenty of opportunities to reach new customers and gain a following. There are many businesses that are made possible by the Internet.

With all this power to reach audiences, there are a new set of unwritten internet marketing rules that set the standard for what the business should look like. In fact, there are 5 things that you should never do in online marketing. These are taboo and will lead to the loss of customers and potential leads. Here are some of the best tips available: 1. Do not spam or overuse your email list When people give you their email address, they are giving you access to their personal lives. One of the worst things that a company can do is overuse this privilege.

It’s important not to saturate your email list with trivial matters. If you choose to send an email, make sure that it is important.

2. Do not oversell your product Too often people will oversell what their product actually does. This is not only dishonest, but short-sighted.

Creating a product that doesn’t deliver is only going to tick off customers in the long run. When marketing a product, it’s best to be honest about both its strengths and weaknesses.

3. Do not sell your customers information This is a place where online marketers often drop the ball. Companies who are willing to sell information look unprofessional and desperate. This is a terrible thing to let a customer base find out. It very quickly erodes the credibility of the company, along with scorning many

loyal customers. Selling personal information is a bad practice, and one that should be avoided at all costs.

4. There are borders with customer engagement If your product is something that a customer will only buy once, it doesn’t make sense to often re-engage that customer. That doesn’t mean that you cannot shoot for repeat business. But engaging the customer should be done on the introduction of a new and exciting product.

You don’t want to repeatedly contact the customer if you can’t provide something that is both new and exciting.

The best way to look at it is this: talking to your customers is a privilege.

5. Don’t ignore consumer trends and complaints If your customers are repeatedly telling you something, it is in your best interest to listen. Too often marketers overlook the biggest trends that their customers are presenting to them. Trends will emerge if you offer a forum for communication with your base. This does not have to be an Internet forum, just a place where communication with you can exist freely. Business ultimately boils down to people, and it’s important to address the needs and concerns of your customers.

Overall, your marketing will benefit by adapting these simple rules. There is so much garbage and spam out there that it is not surprising that people have their guard up. One of the best things you can do as a business is keep your trust. By following these simple principles you will help to ensure that your online marketing has integrity. This goes a long way in building your customer base.

UNDERSTANDING THE CHANGES TO HUD-1, CLOSING PROCESS

The days of filling out the HUD-1 settlement form and getting a Good Faith Estimate (GFE) from the lender are winding down. On August 1, those two forms are going away. The Truth in Lending Act (TILA) disclosure form is going away, too. Replacing them are two new forms: the Closing Disclosure and the Loan Estimate.

You can familiarize yourself with these new forms on the website of the Consumer Financial Protection Bureau (CFPB), which has taken over administration of the Real Estate Settlement Procedures Act (RESPA) from HUD. Just go to CFPB.gov and type in the name of the forms in the search box.

There are also new rules for the closing procedure.

One rule requires all forms to be ready three days prior to closing. NAR is recommending you actually get everything ready seven days prior to closing, so when you go into the three-day period, you don’t have to make any changes. Because making changes as the clock winds down comes with a cumbersome set of hurdles.

So you claimed your .REALTOR domain, but you aren’t really sure what happens next or where the domain is pointing to. (Maybe you don’t know what I mean by “pointing to.”) Don’t panic.

Let’s see what we can do!

The National Association of REALTORS® rolled out its .REALTOR domains to all members in October, with the “.REALTOR” part taking the place of the standard “.com” part. For example, my .REALTOR domain is www.StefanieHahn.REALTOR. I am using my domain to point to my realtor.com® profile. Your .REALTOR domain can point to your profile, your website, or anywhere else on the Web. If you still need to claim your .REALTOR domain, go to www.claim.REALTOR to get started.

You can also create and forward an e-mail address from your .REALTOR domain to another e-mail address you own. This e-mail address is an alias. You can use it anywhere you wish and it will forward messages to the e-mail address you designate. Click “Forward My Email” once you have this figured out.

Now you need to decide where you want to point your new domain. In the “Edit Name Servers” section, you can leave the domain on the .REALTOR servers (this is the default and just a holding tank, really), you can use the domain on your free profile website, or you can point the domain to the specific name servers for your website. Note: You will need to know your website’s name servers for this one.

You can also just forward your .REALTOR domain by typing in the current URL at the bottom (on the left, just under the e-mail forwarding). This is probably the easiest way to connect your domain to your real estate website.

Realtor.com®’s New Profile Websites The new profile websites are not really new. Realtor. com® has dropped SocialBios from its vocabulary (mostly) and combined the set-up. Now, you can go to solutioncenter.realtor.com or www.realtor.com/profile and update your profile there.

If you were familiar with SocialBios, this new version is simplified: It has the standard “about me” section, recommendations, and connections to your social profiles. Consumers can read up on you and then reach

Recommendations are a necessity in our industry right now, and everyone is scrambling to rack up the positive juju via a peer recommendation. If you are just getting started with this profile, you might be feeling a little lonely in the recommendations section. Of course, you can ask people to recommend you or even wait around until they find you here, but there is a better way!

I love this realtor.com® profile because it is one of the few that allows you to add a recommendation that you received somewhere else online (on LinkedIn, Zillow, etc.) or offline. Offline? Yes! Think about the thank-you cards you get: Ask for permission from the client who sent you the card to use their words on your profile, type those little golden nuggets in the form, and — poof!

— you have an online recommendation. Sourcing the recommendation by adding a photo of the transaction and indicating how you know the recommender adds credibility, so do this every time.

Recommendations are easily shared by clicking on the share box at the bottom (after the recommendation is created). You can share to any of the social networks you connected to in the initial setup. Check your “Account Settings” section to add or edit your social networks.

Make sure you know where your .REALTOR domain is pointing to, and get that realtor.com® profile up to snuff!

Social media has changed the landscape for everyone.

For you, it’s made it easier to target clients. And for criminals, it’s made it easier to target you.

Any bad guy you would potentially deal with before, during, and after a showing is playing a role. He’s pretending to be someone you, the victim, can trust.

From the time he first contacts you, he will stay in character until he either executes his plan or bails out.

Pulling off that charade is a whole lot easier with free and easy tools online that he can use to create an identity and follow your trail.

On Facebook and other social media platforms, a criminal may be able to find out what college you attended, what sports teams you like, how many kids you have, and where you like to vacation. He can even see highly detailed images of where you work, live, and the place where he is going to meet you for a showing.

A criminal’s ability to “pull off his role” is magnified because it’s much easier to create rapport with target audiences online than ever before. As convenient as the cyber world has made doing business for the good guys, it’s made it a whole lot easier for bad guys, too.

Remember that online communities are comprised of three groups of users: the safest third, the not-so-safe middle third, and the highly dangerous bottom third.

When it comes to the highly dangerous bottom third, some are transparent in their aggressive hostility and easy to see and avoid. However, it’s the more cunning psychopath that is more difficult to recognize because he is an expert at playing the good guy and gaining favor.

Here are some tips to make it more difficult for bad guys to target you online.

Keep your social media identity focused solely on your real estate business. Controlling and protecting your Identity is important. As much as you’d like to show the world your new granddaughter, it’s far better to show your new property. The property can’t be kidnapped and held for ransom.

Posting your birth date — and those of your family members — is increasingly risky, as criminals are getting creative at cross-referencing information and using it for bad intentions. When you share your birthday, it’s one less thing an identity thief has to dig for. John Smith might be hard to distinguish from other John Smiths when a thief is trying to steal your identify, but John Smith plus his exact birthday makes it one step easier.

Some businesses encourage you to “check in” in exchange for a promotional bribe. Think twice about letting the world know where you are. If you check in for a workout, bad guys know you are at the gym for at least 30 minutes. Checking in for a movie is even a longer window of opportunity.

What you may think is an innocent asset to a home could signal the perfect opportunity to attack for a criminal. Property descriptions such as “enjoy your privacy in this remote setting…” can be an invitation for trouble. Remote locations with privacy are exactly what an attacker wants.

Post only your professional contact information online.

Keep your personal information private.

Never post that you are alone or where you are going, either professionally or personally. Friends with warm smiles are not the only ones reading your posts. It’s a dangerous mistake to post something like, “Just me, my favorite movie, and some wine tonight. Can’t wait!”

That’s a red light invitation that you are alone and possibly intoxicated — neither of which looks good to anyone but a potential attacker.

We’ve all heard that “what goes online stays online.”

Even if you are careful and follow that warning, someone else may post something about you that is revealing or embarrassing. Create a Google Alert for your name, your phone, your address, and each member of your family so if there is any mention of any of this information, you’ll get an e-mail with a link to the page it’s on.

I encourage you to volunteer today- be on one of our great committees, attend our Learn and Earn meetings, help with one (or more) of our Community events. Make a life.
