Colonial Life Takes Business As Usual Approach to IRS Memo On Jan. 20, 2017, the IRS released Memorandum 20170313 regarding the tax treatment of pre-tax funded fixed indemnity health plans. The guidance provided that pre-tax funded indemnity benefits are income, regardless of whether the payee had unreimbursed medical expenses. This is contrary to Colonial Life’s current position for several of our indemnity products, and has caused a lot of confusion in the market. What does this mean for us? We understand the primary purpose of the memo was to address wellness programs and other products that try to exploit loopholes in the law that provide unintended tax advantages. After very careful review of all the laws and facts around this topic, the Colonial Life official stance is “business as usual,” with no changes in our current approach to our pre/post-tax policy at this time. Several other insurance carriers have indicated to us that they are taking a similar position. Our legal team has contacted outside counsel who specialize in this area. Outside counsel agrees with our position and has also reached out to the IRS to clarify the intent of the memo and to communicate our position. Early indications from the IRS are that the memo may not have been as clear as it could have been, that the intent was not to dissolve tax laws already in place and that a clarifying statement may be forthcoming, though we don’t know exactly when. Again, there are no changes to Colonial Life’s pre-tax policies at this time. We will keep you updated if there are any changes to this approach.
