The Emotional Toll of COVID-19

A

ugust marks nearly two and a half years of our world being impacted by the COVID-19 pandemic. As we return to some semblance of normalcy, it feels like we have not had any time to collectively reflect on or work through what we experienced as we lived during such uncertain and stressful times. We never collectively paused, pondered, or reflected. We seem to just keep chugging along, without taking Karen L. Persis, Esq. the time to process the enormity of what we just went through. Or are we still going through it? It is hard to tell when the pandemic is really considered “over.”

Whether it is the stress of the pandemic, political division, gun violence, personal family issues, or loss, we’ve all been through a lot lately. And we shouldn’t deny the impact that such events can have on our mental and physical health. Just because the traumatic event may be deemed “over,” it can still have lasting effects on our lives.

I am certainly no expert on the topic, so I reached out to Dr. Pamela Mark, a licensed psychologist whose practice is in Orlando, to provide some insight. Dr. Mark sees patients seeking help with a variety of mental health issues, with a focus on depression and anxiety. She said that the pandemic appeared to accentuate the problems that a particular person was struggling with, such as anxiety, loneliness, substance abuse, or martial problems. As some people feel overwhelmed and traumatized by the news and the events of the world, Dr. Mark indicated it is important for people to recognize what effect one person can have, and then commit to that action.

“Trauma worsens when you feel there is nothing you can do to produce change and feel out of control. What we need to protect ourselves from is the feeling of learned helplessness, which makes us give up trying, and deepens depression,” Dr. Mark said.

Though people frequently throw around the phrase, “PTSD,” which is a specifically diagnosed medical condition, Dr. Mark indicated that exhaustion probably describes what many of us are experiencing better.

“We have been struggling in a world that has changed since the start of the pandemic. It is one that is more fractured and divided,” she said. “We must identify what we can control. There are times when hearing more news and information may be overloading us. There is a time to find solace in quieting the world around us, turning off the television and news. There is time to listen less about the world around us and concentrate on the home and relationships you have created.”

While some people are very aware of the anxiety or depression that current world and personal events are causing them, many others are unaware of their feelings. “They may be more likely to report headaches, backaches, GI distress or fatigue,” Dr. Mark said. “They may feel more agitated and argumentative, and others may be using substances to cope. We all struggle differently.”

Other signs to consider are: sadness, tearfulness, irritability, loss of motivation, lack of concentration, feelings of helplessness, feelings of hopelessness, fatigue, gaining or losing significant weight, sleep disturbance, thoughts of death or dying, low self-esteem, low frustration tolerance, changes in the desire to interact with others or do activities that you used to enjoy, not bathing, brushing your teeth, or changing clothes, increased anxiety, having panic attacks, or ruminating on negative topics.

Dr. Mark said that these feelings can decrease productivity at work and home. They may diminish our feelings of love and being loved. And they also may prevent us from trying new things or joining in activities that could reduce our stress levels. Thus, the problem worsens a self-reinforcing cycle.

So, if we are feeling emotionally exhausted or overwhelmed, what can we do to cope?

“There are techniques to reduce tension in your body such as Tense and Release,” Dr. Mark said. “The idea is to tense each part of your body for a count to three and then release it. So, hold your hands in a fist and hold them for a count to three and release them for a count to three. Then, tense your arms and shoulders for a count to three and release them for a count to three. Then, tense your face and release, tense your torso and bottom and release, and finally your legs and feet and release. And then feel how your body feels. Once you can really feel what a tense body feels like you will better be able to feel a relaxed body.”

Dr. Mark said that the best coping skills are not novel ideas, but simple ideas we forget to use, that can be applied easily every day.

Such ideas are: self-care, getting enough to eat, getting enough rest, connecting with like-minded people, exercise, getting outside, spending time with loved ones, journaling, writing a gratitude list every day, listening to music, playing a sport, or having a hobby. Meditation and yoga also help us to stay in the moment and quiet the mind.

And of course, we should not be afraid to seek advice from a licensed therapist or psychologist to help us through challenging, unprecedented times.

Clerk’sCorner Guardianship Improvement Task Force

I

’m pleased to share some steps are in motion to help improve the guardianship system in Florida to protect the most vulnerable in our community.

During the legislative session in the Spring, the Florida House and Senate unanimously passed a bill to create a statewide guardianship database. And as I write this, the bill is waiting on the Governor for his signature. The goal of the database is to help track guardianship cases across the state.

The reform was a recommendation put forth by a statewide Guardianship Improvement Task Force earlier this year which called for better data, and in some cases, stricter oversight of Florida’s guardianship system.

The Florida Court Clerks & Comptrollers (FCCC) organized this task force last summer with members including court clerks, court system employees who work with guardianships, lawyers, representatives from The Florida Bar’s Elder Law and Real Property, Probate and Trust Law sections, consumer advocates, a former ward, and others. It was directed to reach whatever conclusions it wanted on reforming Florida’s guardianship system.

The group met a total of eight times with two in-person meetings

and five virtual meetings to learn from expert presentations, hear from residents involved in the guardianship system, consider public comment, and decide on recommendations based on majority vote.

I want to thank the members of the task force for participating in this important process and volunteering their time, expertise, and contributions to the final report.

I feel the final report of the Guardianship Improvement Task Force is the product of the many diverse perspectives represented by its members. I believe what was accomplished as recommendations to the legislature will begin addressing concerns and issues with guardianships in our state.

This is only the beginning. The guardianship process is very complex. There are multiple stakeholders who each have legally specified roles and responsibilities per Florida statute. These partners include the State Office of Public and Professional Guardians (OPPG), the judiciary, the guardian, an attorney, and Florida court clerks. When evaluating guardianship, we have to look at all the partners and the roles they are authorized to play.

When it comes to guardianship, all of us involved in the process are working toward a common goal: to protect individuals who cannot protect themselves. We want the system to work effectively and efficiently on their behalf. My office and clerks across Florida welcome feedback and oversight, and we will work with all responsible parties to help improve the system so that, together, we can better serve those in our care.

The Privilege of Self-Regulation and the Importance of Professionalism

he Supreme Court of the United States recently denied certiorari petitions from attorneys in Texas, Oklahoma, and Michigan seeking to prohibit the use of mandatory bar associations.1 The challenges were premised on First Amendment grounds that the implementation and use of a mandatory bar association violated the right to freedom of speech.

Patrick M. Delaney, Esq. Florida is one of thirty states, including Texas, Oklahoma, Michigan, and the District of Columbia, with a mandatory bar association.2 Mandatory bar associations require all attorneys in a state to be dues-paying members in good standing in order to practice law.3 The Florida Bar therefore functions as a regulatory body for all attorneys and handles the admission, licensing, continuing education, benefits, and discipline of its members.

Underscored within the functions of The Florida Bar is the privilege of self-regulation. Because The Florida Bar is a mandatory bar association, its members are tasked with regulating themselves and, when necessary, disciplining those lawyers that violate the Rules Regulating The Florida Bar.4 “The purpose of professional regulation is to ensure that those members of the public who may be impacted are protected from the unskilled or unethical practice” of law.5 We therefore have an unwritten pact with the public: The Florida Bar takes on the responsibility of self-regulation, and in exchange the members of The Florida Bar swear to be held to the Bar’s standards and written Rules.

The importance of self-regulation cannot be understated. The Bar is tasked with enforcing rules which affect not only its members, but also our clients. This, in turn, affects how attorneys are viewed, and how the profession is perceived, by the general public.

For example, attorneys that violate the rules regarding the use of trust accounts and client funds are some of the most often disciplined cases reported by the Florida Supreme Court each month.

It is easy to see why. The public must know that they can trust attorneys, and public trust is where self-regulation and professionalism interact.

Professionalism is frequently discussed in the context of our communications with opposing counsel or our demeanor during dep-

ositions and hearings. Professionalism, however, goes beyond extending common courtesies and maintaining a polite demeanor.

Those factors are important, but they focus on the internal effect of professionalism which makes the practice of law enjoyable on a day-to-day basis. Professionalism also has an external effect because it influences how we, as attorneys and members of The Florida Bar, are viewed by the general public. This does not seek to improve the daily enjoyment of the profession so much as it acts to impute a sense of pride in each member of The Florida Bar. As professionals, and members of The Florida Bar, we must acknowledge that our conduct affects not only our personal reputation, but also the reputation of the entire Florida Bar and, in turn, our profession. Attorneys are viewed as community leaders and their assistance is sought out in every facet of daily life. As members of The Florida Bar, and the Orange County Bar Association, we should raise the level of professionalism by recognizing that the right to call ourselves attorneys and members of the Bar is not the accomplishment of a goal. In other words, becoming a member of The Florida Bar is not the finish line; rather, it is an acknowledgement of the responsibility to the profession that The Florida Bar believes we are ready for and need to maintain in our daily practice.

Instances of attorney misconduct that make headlines should be viewed by the public as the exception. When such events occur, however, the public must also know that we can and will maintain their trust through an established form of self-regulation that seeks to protect them from the unskilled or unethical practice of law.

Legal Aid SocietyTeaching Tips Placement: A Child’s Need for Safety, Stability, and Permanency

H

ow did your home life as a child shape the adult you are today? Now think of all the uncertainty a foster child faces.

Placement of a child in juvenile dependency cases is one of the most important issues addressed by the court. Placement shapes the child’s daily life: where the child goes to daycare, school, the Jonathan H. The Legislature has found that it is a basic tenet of child welfare practice that a child be placed in the least restrictive, most family-like setting available. This must be near the home of their parents and the child must be placed in a permanent home in a timely manner according to § 39.4021(1), Fla. Stat. (2021). Stability and continuity of placement are factors that the court considers when making a best interest determination for placement and whether it is in the child’s best interest that termination of parental rights be granted. §§ 39.01375, 39.810(8), Fla. Stat. (2021).

As Guardians ad Litem (GAL), we can ensure that the child’s placement is safe, stable, and meeting their needs through a variety of ways. One of the first things to look for is the approved home study conducted by the Department of Children and Families (Department). If the child has been removed from the home and will be remaining with a relative, parent, or other adult approved by the court, a home study report concerning the proposed placement shall be provided to the court. § 39.521(2)(o), Fla. Stat. (2021). The home study must include an interview with the proposed custodian, criminal records checks, childcare arrangements, and other information on how the caregiver will meet the child’s needs. Id. Ensuring that the caregiver has the support they need is vital to placement stability. One of these supports available is financial assistance through the Relative Caregiver Program. The Relative Caregiver Program shall offer financial assistance to caregivers who would be unable to serve in that capacity without the caregiver payment because of financial burden, thus exposing the child to the trauma of placement in a shelter or in foster care. § 39.5085(2)(a)(4), Fla. Stat. (2021). The caregiver may also be eligible for additional benefits under the Guardianship Assistance Program if they go through the licensure process under section 39.6225, Florida Statutes. The Department can also assist setting up funding with providers such as Community Coordinated Care

When issues arise that can impact the stability of the placement, it may be beneficial for the GAL to request a Placement Stability Staffing or Multidisciplinary Team Meeting. The Legislature has found that services for children and families are most effective when delivered in the context of a single integrated multidisciplinary team staffing that includes the child, his or her family, natural and community supports, and professionals who join together to empower, motivate, and strengthen a family and collaboratively develop a plan of care and protection to achieve child safety, child permanency, and child and family well-being. § 39.4022(1)(a), Fla. Stat. (2021). In this setting, any barriers or issues may be addressed by the team who creates a plan of action to resolve those barriers in the best interest of the child.

Placement of the child may become permanent through adoption or permanent guardianship if reunification is not able to be achieved. It is critical at every stage of the proceeding, from the initial Shelter Hearing, all the way through a potential Termination of Parental Rights. GAL advocacy not only helps ensure that the best interests of the child are served in a safe and stable placement, but that placement serves as the firm foundation for the rest of their lives.

Another component that helps to ensure stability of placement is having support from others. Relatives and non-relatives are integral in this aspect. A child benefits greatly from all supportive relationships and the people that want to help. It could be caring for the child while the caregiver is working, helping to supervise the parents’ visitation, or even having the child stay with them for the weekend due the caregiver’s unexpected need to travel. The GAL can advocate for background checks and home studies to be conducted immediately on individuals identified so that the child can have the benefit of these supportive relationships as early as possible.

We Are Trying to Reach You on Your Hope’s Extended Warranty

or anyone who has ever been to a high school or undergraduate graduation ceremony, you’ve probably heard at least one of the speakers quote a line from Dr. Seuss’ “Oh the Places You’ll Go.” This book is chosen by so many because it represents the hope many students have towards their fast approaching, Ritcy Canelon, Esq. new, yet completely unknown future. They hope and anticipate that the unknown and winding journey they are about to take, is as wonderful and fantastical as their dreams are. This hope is what pushes them forward. Hope is the last thing many of our clients at the Legal Aid Society of the Orange County Bar Association, Inc. (Legal Aid Society) have left.

Here at the Legal Aid Society, we work with hope. We combine the hope our clients have for a better future with our legal knowledge and ability to help the members of our community who depend on that hope. Many of the clients we represent come from extremely difficult life situations, needing a route out

of dire circumstances to leave the uncertain roads they’re all too familiar with. They are stuck in the “waiting place,” waiting for a chance, an opportunity, a change. A change that can be provided through an injunction for protection against an abusive partner and through a dissolution of marriage when the only thing the person wants is a way out.

Injunctions for protection against domestic violence, commonly referred to as “restraining orders,” are just one of the practice areas of law we do here at the Legal Aid Society. Clients come to us with hopes that this violence can end. Injunctions for protection against domestic violence cases are usually very quick in nature from their legal “start” once a petition is filed, to the closing of a case, with either a final injunction granted, or the entire petition dismissed. When a petition for an injunction is filed, a temporary injunction is granted by the court if it finds that the petition has met the requirements and elements for Florida Statute 741.30.

The next court date is usually scheduled for three weeks later. The respondent, or the alleged abuser, needs to be served before a full hearing on the matter may take place. The Court usually runs on a 3, 6, or 9 weeks return hearing cycle. These are excruciating weeks for individuals seeking this protection from an abuser. For many continued page 18

clients, these are the moments of deepest despair, where hope is just but a dim light in a moonless and starless night. As their attorney, it is important to contact the client during these times for many reasons.

One is to keep them updated with their case and the next steps. Another is to let the client know they are not in this alone, they have someone advocating for them when they need it most. Many domestic violence victims are people who have been silenced by their abusers for a very long time. It is their hope that someone manages to hear their whispers, in a society that only seems to listen to those who shout the loudest.

Because the life cycle of an injunction case within the court system is quick, explaining to the client the process they are being catapulted into helps ease the client’s tension. After having an injunction granted, I always talk to the client about what just happened in terms of the hearing and in general. Because this is an extremely emotional, and at many times twisted and convoluted legal process, clients may not grasp and cling to every word their attorney says.

Therefore, when I have conversations with the clients after the court grants them the

injunction, I tell them to keep at least three copies of their final injunction: one in their car (if they have one), one at home, and one at work.

After the client’s injunction case, some clients also seek dissolutions of marriage.

Countless new reports have emerged since 2020 with rising numbers of domestic violence cases due to COVID-19. This is attributed to more time at home, more stress between couples, and more mental and emotional fatigue. Injunctions can provide a type of relief from abuse for many of the individuals seeking help. Dissolutions of marriage provide longer lasting solutions for many individuals seeking to break free of the violent circumstances they endure.

There is a tremendous influx of people seeking dissolutions of marriage. Due to this, the Legal Aid Society is experiencing an increased need for help for dissolution of marriage cases, for clients with and without domestic violence. A dissolution of marriage is such a pivotal point in the lives of many, but to a domestic violence survivor, the hope of being able to get a dissolution of marriage is like that of a shipwrecked person on a lifeboat in the middle of stormy seas, waiting for a boat that can bring them to safety.

life can change when hope is at the forefront. Katie came from a marriage where her spouse abused her repeatedly. For Katie, if bruises were the only lesions left, she thought she was lucky, since her husband split her head open in the past. No trips to the hospital meant no “real” problems since she could continue with her daily living. As if that were not enough, her husband started threatening the lives of her children. While she lived in fear, she wished that her family would stay intact.

Unfortunately, one day her husband got too close to fulfilling his threat of harm to her children when he destroyed their family home. Katie hoped for a better future and gathered the courage and left during the night with her children while her husband knowingly closed the door behind her. Legal Aid was able to help her get an injunction for many years, and with the help of a gracious pro bono attorney who is helping Katie get a dissolution of marriage, she is on the road to a life free of harm to her and her children.

There is a great need in our community for more attorneys to help and handle dissolution of marriage cases. We are deeply grateful for attorneys who take these cases through Legal Aid, helping us deal in the currency of hope. Hope is something our clients always have, even if it’s not quickly discernible. Hope is something every volunteer attorney can give – hope that we can help someone escape their current horrific conditions in exchange for the possibility of a future that is cleaner, brighter, and full of peace. Hope works, and it lives at the Legal Aid Society.

s players in our justice system, criminal and civil, we are all too familiar with loss professionally. Judges, lawyers, paralegals, clerks, etc., all encounter members of our commuMichael V. Andriano, Esq. nity usually on their worst day.

Frequently, our clients come to us, and litigants come before the court, from broken places. Attorneys are tasked with fixing and/ or mitigating that brokenness and the judiciary, through their narrowly limited scope of applying the law, is impartially tasked with rendering justice, all in efforts to make broken people whole.

What a daunting task indeed. But, as members of the legal community, we are called to serve in this way. Service in any capacity, especially in the legal field, is for the promotion of others and for a greater purpose. Here, that greater purpose is mitigating brokenness, seeking justice, and doing what we can to prevent people from going back to those broken places. Sure, it does not always work, but hope, optimism, and being intentional go a long way.

Importantly, we cannot adequately serve our clients and litigants

if we have not dealt with our own personal losses and suffering.

We cannot deliver our best day if we have personal issues left unresolved; our clients and litigants deserve our best day. We go on in life because we have to, but we must deal with our traumas and suffering; feel it all and keep moving. We have lives to bless and our best days to deliver.

At the June Luncheon, Attorney Tom Dukes provided an engaging and informative presentation on opening statements and closing arguments. Thank you, Mr. Dukes, for filling in! It was also a pleasure to see so many new faces at the luncheon.

Vaughn Glinton, Esq. On June 18th, we held Part 2 of Wills for Heroes and assisted our heroes in fully executing their wills, durable powers of attorney, and health care surrogate documents. This year we were able to help over 150 heroes. Thank you to committee chairs Linnea Eberhart and Cooper Powell for organizing the event. Special shout out to volunteers from FAMU Law, Barry Law, and Barry Law’s Veteran Law Society. Your help is greatly appreciated.

We hosted our annual Young Lawyers & Law Clerks Reception on July 14th. Law school students and young attorneys had the opportunity to meet and receive words of wisdom from experienced attorneys, community leaders, and judges. YLS partnered with Central Florida Association of Criminal Defense Lawyers on July 22nd for our monthly luncheon. Members had the opportunity to meet and mingle with all the judicial candidates for Orange County Judge and Ninth Circuit Judge!

On July 28th, we partnered with CFAWL in hosting a happy hour at the Twisted Handle in order to raise funds for backpacks for the students at Washington Shores Elementary School and Rock Lake

Elementary School. Committee Chairs Gabrielle Sanandajian and Lauryn Day made sure this event was a hit! As always, thank you CFAWL for the collaborating with us for this event!

To end July, we held Morning at the State Courthouse on July 29th. Chief Judge of the Ninth Judicial Circuit Judge Lisa Munyon, a panel of judicial assistants, and a panel including several judges from the Ninth Judicial Circuit provided practical tips and insight into practicing in state court to law school students and young attorneys. ith school back in session, Central Florida students are not the only ones preparing for a new year ahead.

Many of our voluntary bar associations transitioned to new leadership over the summer. Here is just a glimpse of what our voluntary bar associations have been doing to celebrate their outgoing boards and welcome their new ones.

The Federal Bar Alena V. Baker, Esq. Association, Orlando Chapter The Bench Bar Fund of the Middle District of Florida & the Orlando Chapter of the Federal Bar Association (FBA) continued their 2022 Summer Series for law students working in and around Orlando. On June 6, 2022, the FBA presented the “Components of the Federal Criminal Justice System” and on June 24, 2022, the FBA presented on “Professionalism & Ethics.”

The Greater Orlando Asian American Bar Association On June 21, 2022 the Greater Orlando Asian American Bar Association (GOAABA), co-hosted a Latin Asian Fusion Night with the Hispanic Bar Association of Central Florida (HBA). Thanks to the overwhelming response of the many attorneys, judges, and community leaders who attended, GOAABA and HBA were able

to raise $500 for a food donation to the Philippine Nurses Association of Central Florida (PNACF).

Also in June, GOAABA attended the inaugural Asian American Pacific Islander Coming Together (ACT) townhall meeting at the Orange County, FL Supervisor of Elections.

Then, on July 28, 2022, GOAABA held their annual Installation Event at Oudom Thai & Sushi Orlando. Congratulations and best wishes to all the new GOAABA board members and job well done to all the outgoing board members.

The George C. Young Central Florida American Inn of Court On June 16, 2022, members of The George C. Young Central Florida American Inn of Court (Inn), attended an Orlando City Soccer game as part of the last social event of the year. Prior to the game they enjoyed a tailgate party which provided a great opportunity to network and get to know fellow members better.

Then on June 21, 2022, the Inn celebrated a wonderful year of hard work. In addition to the fun, the Inn presented a $1,500 scholarship award to Seth Hernandez who is a law student at FAMU as part of the George C. Young Scholarship. The Hispanic Bar Association of Central Florida Members of the Hispanic Bar Association of Central Florida (HBA) attended the 2022 Florida Bar Conference in June.

Also in June, members of the HBA attended “Immigrant Appreciation Day” put forth by the Orlando Center for Justice.

The Paul C. Perkins Bar Association On June 1, 2022, the Paul C. Perkins Bar Association (PCPBA) held their Annual Judicial Reception and Installation Ceremony. Congratulations on a job well done to the PCPBA outgoing board and best wishes to Ashley Wright and the new PCPBA board!

The Central Florida Association for Women Lawyers On July 8, 2022, the Central Florida Association for Women Lawyers (CFAWL) held their “Pass the Gavel” ceremony. Ninth Judicial Circuit Judge Elizabeth Starr swore in the new Board of Directors and Leadership Team for 2022-2023. Attendees were able to reflect all of the incredible achievements from Immediate Past President Heather Meglino and got to wish new President Lauren Millcarek the very best.

Then on July 19, 2022, CFAWL held a HobNob featuring Central Florida candidates for various political offices. Attendees mixed, mingled, and met candidates for office in races on the Orange, Osceola, and Seminole County ballots.
