Petites Surprises -

What a surprise! There were not too many weights available on the German art market this year. But one piece seemed to be of special interest. Finally the 20 tical lion we found was an exciting masculine beast. When we came across a famous market “somewhere” in Southeast Asia, a small collection of earliest lion weights of particular rarity and high quality luckily just appeared on that day. Now offered for sale here in the catalogue.

Later we got two unique Arakan weights (a lion and a bird) from different collections.

Another German collector was interested to sell a part of his collection. So we were able to acquire a few more beautiful pieces.

From a well-known London collection we purchased old silver works of ethnic groups of the Golden Triangle, which can be rarely found today in this quality and purity of silver, collected in the 70s and 80s of the 20th century, well documented in Paul and Elaine Lewis’ book.

So, finally we offer some exceptional objects of Asian arts and crafts, which - at least after closer examination - seem to be real surprises, even quite small in size

1 Toe 1A with horse tail, 10 tical, prior to 1600

The old lion weight with the split beard and rare horse tail is made of a reddish brown bronze. Even if the surface is weathered, all the details, like decoration lines, beard, horns, ears are still well visible. There is a verification mark in front of the base, shown a symbolized lion in a square depression.

2 Toe 1A with lotus tail, prior to 1600

This T1A weight shows three verification marks, the original circular depression in front of the base, a 2nd circular mark front right and base right a 5- or 6-rayed star mark. The weight is heavily worn with traces of black coating. Only two decoration lines on the base and one on the chest are still visible.

3 Toe 1A with lotus tail, prior to 1600

This lion weight is a real treasure. It’s in great condition. Even worn with a smooth surface, all the decoration lines are well visible. The patina, shining through the black coating where worn off, is extraordinary. A wonderful, over 400 years old collector’s piece!

4 Toe 1A with lotus tail, prior to 1600

A great small lion with mouth appendage is sitting on an octagonal base. There is a large square depression in front of the base as verification mark. An additional cross below could be an owner’s mark. This rare old weight is in good condition with rich dark brown patina.

5 Toe 1A with short horse tail, prior to 1600

This standing lion on a rectangular base shows a lovely spinach green patina with traces of black coating. Even well worn, a few decoration lines, horns, ears and the mouth appendage are still visible.

A sitting lion on a tall octagonal stepped base with a depression in front. The weight is in good condition with rich traces of black coating and attractive dark patina. The lion seems to wear a necklace with a bead in front of the chest (can be well seen on the photo below)

7 Toe 1A – Toe 1C, important transitional form, circa 1600

An extremely rare lion weight on a circular base. The weight is very detailed elaborated with unusual big elongated eyes, open mouth with detailed teeth, Vee-shaped mouth appendage and nose with nostrils. The polished testical are well visible. The base is well-shaped with horizontal decoration lines and a circumferential groove. The verification mark is a precise square depression in front of the base. Traces of red and black coating. A collector’s treasure!

8 Toe 1C, extreme rare 50 tical weight, circa 1680

Herewith we offer the unique opportunity to add an extreme rare 50 tical (½ viss) weight to your T1C-set. With the typical handle shape, detailed decoration, open mouth with single teeth and the rod-shaped mouth appendage, our weight is in very good condition. Attractive silvery patina with a few traces of black lacquer.

Toe 1C, 20 tical, circa 1680

An extraordinary finely crafted T1C weight in nearly perfect condition. The rare octagonal stepped base shows a circumferential groove between horizontal lines. The first verification mark is a square depression, second a 6-rayed star base right. Great patina.

10 Toe 1C, 20 tical, circa 1680

Another T1C lion weight, slightly worn, but still in excellent condition considering age and use. The 1st verification mark is a circular depression base front, the 2nd mark is a 4-rayed star front left. The trefoil mouth appendage is detailed elaborated. The lion is sitting on a beautiful stepped octagonal base.

11 Toe 1C, 10 tical, circa 1680

Octagonal stepped base with square depression in front. The weight has a smooth surface with dark brown patina and traces of black coating. Slightly readjusted with lead it weighs now 146 g (nominal value 150 g). It’s just a beautiful T1C weight with Vee-shaped mouth appendage and horse tail. Good condition.

12 Toe 1C, 20 & 5 tical, circa 1680

Both weights are heavily worn from use over the centuries. The verification mark (square depression in front of the base) is still visible, also the trefoil mouth appendage. Decoration lines as well as eyes, ears, horns already disappeared or barely visible. Both are real market weights with a lot of wear, what gives them their own beauty.

Toe 2, 20 tical catalogue no. 13b)

13 Toe 2, 10, 20, 10 tical, circa 1680

The Toe 2 (left) is in almost perfect condition with only most minor signs of wear. The mouth wide open, the lion shows every single tooth. There is a square depression as verification mark in front of the octagonal base. Also the wrathful 20 tical lion shows his large teeth. The weight has a smooth surface dark brownish patina and traces of black coating. The 10 tical lion (right) has a lovely worn surface, the extremities, as eyes, horns, ears are barely visible. The weight is without damages, just with a perfect patina.

Super rare in this great condition. Special base with the grooved profile, the three spikes of the tail are only slightly worn, eyes, ears, horns and beard in excellent condition. The 9rayed star on the octagonal base front right is well visible.

16 Toe 1D, 20, 10 tical, prior to 1776

Both weights are very worn, leaving a lot of character. The 20 tical tall, long-legged Toe 1D bears a deeply stamped precise 9-rayed star mark. The 10 tical weight is a “compact” guy with additional full lead adjustment, smooth surface and great patina.

20 tical weight readjusted with quite a lot of lead. Dark, partly greenish patina. The 10 tical weight is still in great condition. Only the tip of the upper tail spike with tiny chip. The 5 tical, long-legged, shows a lot of wear, leaving a smooth golden brown patina.

18 Toe 1B, T1C, group of 5 tical, circa 1640 / 1680

It’s a good chance to complete a set of T1B or T1C weights with the 5 tical missing piece. The T1B weight has a 2nd mark on the octagonal stepped base front left (4 ray star). Apart from a vertical 7 mm cut to the chest it’s still in good worn condition with great patina and traces of black coating. Also the T1C in the centre bears a 2nd mark on the octagonal stepped base right (6 ray star). The lion weight is worn with almost black patina and a Veeshaped mouth appendage. The T1C right has a trefoil mouth appendage and a 2nd verification mark (4 ray star base front left) too. It shows remnants of black coating and a beautiful bronze patina, where worn.

20 Chinthe 1, 5 tical, circa 1730

All three market weights are heavily worn, leaving a rich bronze patina. The weight left is readjusted with lead, filled the whole space between body and base and brings it almost back to the standard. Also the weight in the centre has been slightly readjusted with lead. The 4-rayed-star in front right of the octagonal base is still visible on each weight. The trefoil mouth appendage of all three weights is worn, but still intact.

It’s a nice set of Chinthe 1 with trefoil mouth appendage, slightly worn with rich smooth bronze patina. The weights are still in good condition with all signs of daily use over the centuries. The 4-rayed star mark front right of the octagonal base is still visible. All three weights, but especially the 20 and 10 tical pieces, show the hair decoration on the legs (symbolized by notches).

Here we offer three interesting C2A weights. Left with quite rare grooved base decoration and attractive patina. Centre an unusual tall 10 tical weight, worn, but readjusted with a lot of lead. The Chinthe right is decorated with 7 copper inlays left, right, chest front and eyes.

The C2B left with the special knobbed handle shows a great patina. The 9 ray star is still partly visible on the square base right. The weight in the centre bears a precise 9-rayed star mark (7 rays still visible). The weight right is very worn (weighs only 305 g), verification mark disappeared, but got an attractive dark, partly greenish patina.

The weight left is worn (the handle has a crack near the tail but is not broken), the verification mark is not visible anymore. C2B centre is also worn, but all details are still intact. The mane is finely curved upwards. The weight right shows traces of black coating. The upper part of the 9 ray star is still visible. Rich dark brownish patina.

A rare set of the so-called “Sleeping Ducks” from the Mon State. All three weights with beautiful dark shining patina and 6-rayed star mark on the octagonal base front right. 20 and 10 tical according to the “old” standard with 15 g/tical (therefore prior to 1700). 5 tical “new” standard (16,3 g/tical).

Rare Karaweik shape. Remarkable crest. The two (instead 3) head knobs bent backwards. Two rows of neck feathers and three peaks on the upwards curved tail. Excellent condition. Dark shining patina. Octagonal base with a ring of vertical notches above two horizontal lines

The bottom of the base shows the 9 fields raster image for astrological fortune telling.

29 Karaweik 1, 20 tical, circa 1820

A Karaweik weight with a distinctive, clear form, two rows of neck feathers, the lower one of striking size. Reddish brown copper-bronze. Bird mark on the octagonal base front right. Upwards curled tail. Slightly worn with a tiny cut on the base right, but good condition overall.

30 Karaweik 1, circa 1820

Karaweik 1, worn from daily use on the market over the decades. Three rows of neck feathers. Ring of notches and two horizontal lines around the upper part of the base. Symbolized bird mark on the octagonal base front right.

Remarkable is the owner’s mark at the bottom of the base, a beautiful 5 petals “golden flower” (please see the front cover of the catalogue)

31 Karaweik 1, 10 tical, circa 1820

Three Karaweik weights in various degree of wear and tear (see the ascending weight from left to right: 147 to 159 g), but with wonderful smooth shining surface and amazing dark patina. Only the Karaweik right has been readjusted with lead between body and base, barely showing the bird sign front right. The two weights left and centre are strongly worn, so the verification mark vanished already. The notches and decoration lines on the base are almost worn off.

An extraordinary fine crafted Hintha 3A2. It’s our first Hintha weight with this pronounced knobbed base decoration. Also the neck feathers deviate from the standard. Detailed elaborated it bears the bird sign, as it should be. Rich dark patina, excellent condition.

Beautiful smooth surface, rich patina, short beak, base hexagonal to circular, carved-out wing extension behind the main wing (please compare with the other H3-weights, where the extended wing is only hinted as decoration or simply nonexistent). Very worn with loss of material.

Nice set of H3B market weights, still finely crafted during the Konbaung dynasty. Worn, but in good condition compared to the later brass weights. The four weights bear a ring of notches around the hexagonal base. The extended wing is hinted by decoration.

A group of Hintha weights of the early Konbaung Dynasty, differ fairly clear from the later, more compact H3-weights (please see the previous double page to compare). With the elongated body, a distinctive acute angle between neck and body as well as the bird mark, they seem to resemble the Karaweik 1 weights.

On the hexagonal base of the weights b), c) and d) the bird mark is still visible (front right). Weight c) with rich traces of black coating. Although worn, they show a remarkable good patina.

A Hintha 4D weight in extraordinary rare distinctive shape. The long upwards curved tail nearly reaches the same height as the massive crest. Almost the whole weight is still covered with black lacquer. Only the extremities worn off from daily use over the decades, leaving the shining metal surface.

The octagonal base shows a finely crafted horizontal multiline decoration. A bird mark can be seen on the hexagonal base front right, slightly faded from use.

39 Hintha 4D, 20 tical, late 19th / early 20th century

It’s an interesting couple of Hintha 4D weights to compare. H4D left is made of bronze, probably late 19th century, right made of brass, early 20th century. The bronze weight, even a few decades older, is in almost perfect condition, only slight wear to the extremities. The brass weight right is heavily worn with loss of material, what results in a lower weight (312 g). The bronze weight shows the multiline decoration around the base with the outline of a bird front right, the base decoration of the brass weight is worn off, only barely visible on the base back right with traces of two dotted lines.

It’s a beautiful group of most attractive Shan birds, all with the 6-rayed or 6-dotted star on the hexagonal base front right and minor signs of wear, nice detailed decoration and one, two or three head knobs. The weight right (3 head knobs) has some small chips on the edge of the tail. Apart from this, all weights are in good condition with attractive patina.

A very detailed Arakan Toe weight resembles a Burmese Toe 1D. The lion shows rich remnants of black lacquer and a smooth, golden brown patina, tall base, bead necklace, mouth open wide. The typical T1D beard has been engraved as line decoration. Octagonal multistepped base. Worn, but good condition overall.

Even with strange shape, the Hintha bird is elaborated detailed. The weight has been original covered with thick red lacquer, which partly remained. The circular base is unusual flat. The tail is curved upwards with fine feather decoration. Rich dark, partly shining bronze patina. A rare special weight, due to the protruding eyes and the shape of the neck feathers the shape resembles to the H3B standard form.

The wooden core is covered with silver sheet, rich decorated with silver filigree work. On the top a small container with the original silver lid, connected with the hair pin by a chain. The container used to be filled with opium and herbal fragrances.

This hair pin is an antique piece with dents and cracks in the silver sheet along the wooden shaft. There are still new hair pins in perfect condition available, but original antique pieces are rare to find, especially in this large size.

Seated Buddha in lotus position with the right hand touching the earth. Long arms, elongated torso and head. Large regularly arranged hair curls, some are broken off and lost. The wooden image is lacquered and richly gilded. The radiance in the early simple shape of a stylized lotus bud. Cracks to the lacquer, lower part of both earlobes are chipped, base lost. Despite the damages, still a collectible and rare piece of Lao art.

68 Set of Burmese bronze buffalo bells, circa 1st half of the 20th century Traditional Burmese buffalo bells with geometric decoration around the base. All the bells with wear and tear from use over the decades. The big bell measures 91 mm width and 58 mm height and still bears a clapper. Watercolour

Lieutenant Joseph Moore - serving with the 89th Regiment in Burma during the first AngloBurmese war between 1824 and 1826 - documented his war time by drawings. Later a few of the drawings were turned into 18 famous prints by George Hunt, published by Thomas Clay, London 1825/1826.

Probably this quick watercolour painting, not realized as one of the 18 aquatints, was one of its original sources from 1824. Anyway it's a good reference of history and a nice piece of art.

Glued to the passe-partout, which was damaged (not visible when framed), while someone tried to remove the painting. The painting itself is in good condition with some foxing, please see also back cover of the catalogue. Framed in black wooden frame

78 Extraordinary rare lacquer box for precious clothes, Mandalay, Burma before 1900 (probably around 1850)

An extreme rare lacquer box, usually commissioned by high officials of the court or noble people to store precious clothes. Made of wood, woven bamboo and lacquer.

The box is incised with extremely fine and densely yun decoration of nobles, horsemen, chariots, parrots, other animals, trees and flowers in orange to red with green, inside red lacquer With one inner tray.

Large crack on the lid, chipped on the edges, a few imperfection, otherwise good condition (U Than Htun: “… it is unlike that anyone will find such a box in good condition.”).

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstige Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Revocation consequences

In the event of a valid revocation, the performance delivered by either party is to be returned and the proceeds of any utilization (e.g. interest) submitted.

If you cannot submit / return the received performance and benefits (e.g. utilization benefits) to us, or submit / return them only partially or in a deteriorated condition, you need to compensate us to the required extent. You must pay compensation for degraded items only insofar as the deterioration is due to handling of the items beyond testing of properties and functionality. Testing of properties and functionality is to be understood as testing and evaluation of the respective goods as is possible and common in retail shops, for instance.

Items which can be dispatched in packages are to be returned at our expense and risk.

Items which cannot be dispatched in packages will be fetched from your premises. Payment obligations must be fulfilled within 30 days.

The time limit becomes effective on dispatch of your revocation notice or the item for you, and on its receipt for us.

Allgemeine Geschäftsbedingungen (AGB)

§ 1

Geltungsbereich & Abwehrklausel

(1) Für die über die Galerie Michael Herrfurth Asiatische Kunst (Online-Galerie unter www.opiumgewichte.com) begründeten Rechtsbeziehungen zwischen dem Betreiber (nachfolgend „Anbieter“) und seinen Kunden gelten ausschließlich die folgenden Allgemeinen Geschäftsbedingungen in der jeweiligen Fassung zum Zeitpunkt der Bestellung.

(2) Abweichende Allgemeine Geschäftsbedingungen des Kunden werden zurückgewiesen.

(2) Maßgeblich sind ausschließlich die auf Anfrage dem Kunden per Email mitgeteilten Preise. Die in der Internetpräsentation bzw. im pdf-Katalog im Übrigen enthaltenen Angaben, insbesondere Preise, enthalten kein verbindliches Angebot und sind freibleibend. Irrtümer auf voran geschalteten Website oder abweichende Preisangaben auf Websites Dritter haben keine Verbindlichkeit im Verhältnis der Vertragsparteien.

(3) Alle angegebenen Preise verstehen sich in Euro zzgl. der jeweils geltenden gesetzlichen Mehrwertsteuer. Diese wird in der Rechnung separat ausgewiesen.

§ 2

Zustandekommen des Vertrages

(1) Die Präsentation der Waren in der OnlineGalerie stellt kein bindendes Angebot des Anbieters auf Abschluss eines Kaufvertrages dar. Der Kunde wird hierdurch lediglich aufgefordert, durch eine Bestellung ein Angebot abzugeben.

(2) Durch das Absenden der Bestellung per Email gibt der Kunde ein verbindliches Angebot gerichtet auf den Abschluss eines Kaufvertrages über die durch ihn in der Email genannten Waren ab. Mit dem Absenden der Bestellung erkennt der Kunde auch diese Geschäftsbedingungen als für das Rechtsverhältnis mit dem Anbieter allein maßgeblich an.

(3) Der Anbieter bestätigt den Eingang der Bestellung des Kunden durch Versendung einer Bestätigungs-E-Mail. Diese Bestellbestätigung stellt noch nicht die Annahme des Vertragsangebotes durch den Anbieter dar. Sie dient lediglich der Information des Kunden, dass die Bestellung beim Anbieter eingegangen ist. Die Erklärung der Annahme des Vertragsangebotes erfolgt durch die Auslieferung der Ware oder eine ausdrückliche Annahmeerklärung.

§ 3 Leistungsbeschreibung

(1) Die Beschaffenheiten der angebotenen Gegenstände werden im Einzelnen durch die Beschreibung auf der Website bzw. in einem per Download oder Email zur Verfügung gestellten Katalog im pdf-Format links oder rechts neben, unter oder über der Abbildung verbindlich und abschließend dargestellt. Sonstige öffentliche Äußerungen des Anbieters, dessen Gehilfen oder Dritter enthalten keine ergänzende oder ändernde Leistungsbeschreibung.

(2) Den Parteien ist bewusst, dass es bei der Übertragung und Anzeige der Bilddateien möglicherweise zu Abweichungen zwischen dem Original und der Darstellung auf dem Monitor z.B. hinsichtlich der Farbtöne kommen kann. Eine farbgetreue Wiedergabe der zugrunde liegenden Originale ist nicht geschuldet. Geringfügige Abweichungen zwischen der Darstellung des Bildes auf den Monitor und dem Original sind vertragsgemäß. Vertraglich geschuldet wird jedoch die in der Produktbeschreibung enthaltenen Eigenschaften (z.B. Material, Alter, Herkunft) auf der Website bzw. im Katalog zum Zeitpunkt der Bestellung.

§ 4 Preise

(1) Alle Preise verstehen sich in Euro.

(4) Die Kosten für Lieferung und Verpackung trägt der Kunde. Die Art der Lieferung wählt der Kunde. Äußert sich der Kunde nicht zur Art der Lieferung, wählt der Anbieter die für ihn günstigste Versandvariante.

(5) Bei Lieferungen in Länder außerhalb der Europäischen Union können zusätzliche Kosten für anfallende weitere Steuern und Zölle entstehen, auf die der Anbieter keinen Einfluss hat. Diese Kosten werden in vollem Umfang vom Kunden getragen.

§ 5 Zahlung

(1) Der Kunde wählt bei Abgabe seiner Bestellung unter mehreren durch den Anbieter vorgegebenen Zahlungsweisen die gewünschte aus. Zahlungen gelten ungeachtet der gewählten Zahlungsweise erst dann als geleistet, wenn der Anbieter uneingeschränkt über den Betrag verfügen kann.

(2) Der Kaufpreis ist sofort ohne Abzug fällig.

(3) Der Kunde ist vorleistungspflichtig.

(4) Der Kunde kommt ohne weitere Erklärung seitens des Anbieters 14 Tage nach Lieferung der Ware in Verzug, soweit er nicht bezahlt hat. Die Verzugsfolgen richten sich nach den gesetzlichen Bestimmungen.

§ 6 Vorbehalt bei Nichtverfügbarkeit

Der Anbieter sichert nicht zu, dass die Website bzw. der pdf-Katalog stets aktuell und die dargestellte Ware noch verfügbar ist.

§ 7 Eigentumsvorbehalt

Die gelieferte Ware verbleibt bis zur vollständigen Bezahlung im Eigentum des Anbieters.

§ 8 Fälligkeit

Die Zahlung des Kaufpreises ist mit Vertragsschluss fällig.

§ 9 Gewährleistung

(1) Die Gewährleistungsrechte des Kunden richten sich nach den allgemeinen gesetzlichen Vorschriften, soweit nachfolgend nichts anderes bestimmt ist. Für Schadensersatzansprüche des Kunden gegenüber dem Anbieter gilt die Regelung in § 6 dieser AGB.

(2) Die Verjährungsfrist für Gewährleistungsansprüche des Kunden beträgt bei Verbrauchern bei neu hergestellten Sachen 2 Jahre, bei gebrauchten Sachen 1 Jahr. Gegenüber Unternehmern beträgt die Verjährungsfrist bei neu hergestellten Sachen und bei gebrauchten Sachen 1 Jahr. Die vorstehende Verkürzung der Verjährungsfristen gilt nicht für Schadensersatzansprüche des Kunden aufgrund einer Verletzung des Lebens, des Körpers, der Gesundheit sowie für Schadensersatzansprüche aufgrund einer Verletzung wesentlicher Vertragspflichten. liche Vertragspflichten sind solche, deren Erfüllung zur Erreichung des Ziels des Vertrags notwendig ist, z.B. hat der Anbieter dem Kunden die Sache frei von Sach- und Rechtsmängeln zu übergeben und das Eigentum an ihr zu verschaffen. Die vorstehende Verkürzung der Verjährungsfristen gilt ebenfalls nicht für Schadensersatzansprüche, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Anbieters, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen. Gegenüber Unternehmern ebenfalls ausgenommen von der Verkürzung der Verjährungsfristen ist der Rückgriffsanspruch nach § 478 BGB.

(3) Eine Garantie wird von dem Anbieter nicht erklärt.

§ 10 Haftungsausschluss

(1) Schadensersatzansprüche des Kunden sind ausgeschlossen, soweit nachfolgend nichts anderes bestimmt ist. Der vorstehende Haftungsausschluss gilt auch zugunsten der gesetzlichen Vertreter und Erfüllungsgehilfen des Anbieters, sofern der Kunde Ansprüche gegen diese geltend macht.

(2) Von dem unter Ziffer 1 bestimmten Haftungsausschluss ausgenommen sind Schadensersatzansprüche aufgrund einer Verletzung des Lebens, des Körpers, der Gesundheit und Schadensersatzansprüche aus der Verletzung wesentlicher Vertragspflichten. Wesentliche Vertragspflichten sind solche, deren Erfüllung zur Erreichung des Ziels des Vertrags notwendig ist, z.B. hat der Anbieter dem Kunden die Sache frei von Sach- und Rechtsmängeln zu übergeben und das Eigentum an ihr zu verschaffen. Von dem Haftungsausschluss ebenfalls ausgenommen ist die Haftung für Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Anbieters, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen.

(3) Vorschriften des Produkthaftungsgesetzes (ProdHaftG) bleiben unberührt.

§ 11 Abtretungs- und Verpfändungsverbot

Die Abtretung oder Verpfändung von dem Kunden gegenüber dem Anbieter zustehenden Ansprüchen oder Rechten ist ohne Zustimmung des Anbieters ausgeschlossen, sofern der Kunde nicht ein berechtigtes Interesse an der Abtretung oder Verpfändung nachweist.

§ 12 Aufrechnung

Ein Aufrechnungsrecht des Kunden besteht nur, wenn seine zur Aufrechnung gestellte Forderung rechtskräftig festgestellt wurde oder unbestritten ist.

§ 13 Rechtswahl & Gerichtsstand

(1) Auf die vertraglichen Beziehungen zwischen dem Anbieter und dem Kunden findet das Recht der Bundesrepublik Deutschland Anwendung. Von dieser Rechtswahl ausgenommen sind die zwingenden Verbraucherschutzvorschriften des Landes, in dem der Kunde seinen gewöhnlichen Aufenthalt hat. Die Anwendung des UN-Kaufrechts ist ausgeschlossen.

(2) Gerichtsstand für alle Streitigkeiten aus dem Vertragsverhältnis zwischen dem Kunden und dem Anbieter ist der Sitz des Anbieters,

sofern es sich bei dem Kunden um einen Kaufmann, eine juristische Person des öffentlichen Rechts oder ein öffentlich-rechtliches Sondervermögen handelt.

§ 14 Salvatorische Klausel

Sollte eine Bestimmung dieser Allgemeinen Geschäftsbedingungen unwirksam sein, wird davon die Wirksamkeit der übrigen Bestimmungen nicht berührt.
