Reflections and Plans for the Future We had record turnout from both the public and vendors at the 2015 OMB BIG Home & Garden Show. You can expect more greatness at the Show in 2016, with some added vendor space, the return of some of the popular extras and maybe the addition of some more fun in the form of beer and wine tasting. s I prepared for the 2015 Christmas Party that was held on December 11, I begin reflecting on what a great year we had and what I wanted for Olympia Master Builders in 2016. Yes, I just said it, 2016. I still can’t believe we’re already here! I appreciate the confidence of all of you in allowing me to serve as your President again this year. I am confident that we have the leadership and staff in place to continue our upward trend as an Association.

For those of you that didn’t make the Christmas Party and Awards Ceremony, you missed out. It was a FUN, well attended party. We gave out awards to well deserving OMB and community members and we had a great time!

Now I’d like to share with you some the messages that I shared with the party crowd after I was sworn in as your 2016 OMB President.

We will continue Beer With a Builder, the casual gathering we started last year. This event is really great for the builders. As I looked around the room at the Christmas Party I thought, as much fun as it is to brush off the saw dust and get dressed up, I feel at home during Beer With a Builder events. It gives the builders time to have fun and commiserate with each other and the Associate members, and, best of all, you can walk right in from the job site!

In my mind, one of the highlights of last year was the addition of our Membership Appreciation Night at the Tacoma Rainiers. This event was another well-attended, casual event thanking all the members who support the industry by writing their membership checks each year. We are going to double the number of tickets available so that even more of you can attend in 2016. I can’t wait to see you all there on July 21st!

I could start every paragraph with another great highlight, but seriously, 2015 was full of them. Another highlight for me was bringing back the Quarterly Building Official meetings.

We had around 30 people at the last meeting and building officials repre-

senting most of the jurisdictions in our territory were among the attendees. If you haven’t been to one yet, you need to go! There is no agenda, just candid conversation on what is happening at the local jurisdictions. Seriously, you learn good stuff at this meeting! Actually, maybe you should stay away, then I will be the only one who knows all the good stuff…

I probably should have started with this, but the response we’ve had on the Thurston County Mazama pocket gopher litigation has been overwhelmingly positive. There has been great media coverage and new stories from community members are coming out every day. The OMB office has been fielding thank you calls from dozens of citizens, many who have been negatively impacted by Thurston County’s interim gopher permitting process. It is issues like this one that really crystalize in my mind what OMB is all about. We will continue to keep you updated as things progress throughout the year.

You can also read more about this litigation and Thurston County’s Habitat Conservation Plan (HCP) process in the pages of this magazine.

For 2016, I am not looking to add a bunch of additional events, programs, and more bells and whistles. I want leadership and staff focusing on things that have proven to work well and provide VALUE to our members’ bottom lines! This will also give us the opportunity to focus our attention on membership growth in 2016. Cheers to a great 2015 and an even better 2016!

W

e’ve all heard the stories: The disabled resident who can’t build a wheelchair ramp for his home; the family who can’t get a permit to rebuild their home lost to fire; the couple looking forward to retirement but can’t sell their property; the farmer who can’t build a pole barn to protect equipment from the weather – the list goes on and on.

Welcome to Thurston County’s interim land use permitting process for the Mazama pocket gopher.

On November 24th, the Olympia Master Builders (OMB), along with the Thurston County Chamber of Commerce and Hinkle Homes, filed two separate legal actions challenging the legality of Thurston County’s 2015 interim process – one, a petition for review before the Western Washington Growth Management Hearings Board, and the other, a complaint in Lewis County Superior Court.

Our lawsuit really isn’t about the gopher; scientifically, the 2015 Interim Process for gopher review does not give any greater protection to the Mazama pocket gopher than Thurston County’s current Critical Areas Ordinance (CAO). It’s about fairness, following the law, and ensuring that Thurston County citizens are allowed to have their voices heard.

The 2015 Interim Process is the County’s reaction to the 2014 federal listing by the United States Fish and Wildlife Service (USFW) of four subspecies of the Mazama pocket gopher in Thurston and Pierce Counties as “threatened” under the Endangered Species Act.

This new process requires several land use decisions in Thurston County additional screenings and site visits, for the next 30 years. n May 9th, 2014, United States Fish and Wildlife Service (USFWS) determined that four subspecies of the Mazama Pocket Gopher (Olympia, Tenino, Roy Prarie, & Yelm) were given threatened species status. Any form of construction within the gopherโ s habitat, from paving a driveway to building a new structure, became unlawful without the proper documentation from USFWS.

Habitat Conservation Plans (HCPs) are an increasingly prevalent tool that seeks to balance the needs of endangered or threatened species with the needs of non-federal landowners. Essentially an HCP is an agreement: in exchange for specified protections, landowners are granted an Incidental Take Permit that allows them to complete projects that could potentially harm protected species under the Endangered Species Act.

It is unlawful to cause โ takeโ to any threatened species, to โ harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct.โ Under the Endangered Species Act, an Incidental Take Permit must be acquired in order to build or do any activity that causes, or could cause, take on the species or its habitat. An essential component of the application is the Habitat Conservation Plan.

A landowner can develop their own HCP and negotiate directly with USFWS, just as two developers in Thurston County currently are, but this is an expensive process. Another option is utilizing a regional HCP that includes the site in question. Thurston County is currently developing an HCP that can be used on any unincorporated land within County boundaries that has gopher habitat (currently over 40 percent of the county). Ideally, this document would

provide guidance for new development by defining impacts to endangered species and direct the mitigation required for such projects.

However, in the first stakeholder meeting on the draft HCP, Thurston County officials laid out their initial plans for mitigation. For each acre of development on gopher habitat (prairie land), a mitigation acre must be purchased and maintained at a cost of $15,876 to $86,854 per acre. This is known as mitigation banking.

While the organizers of the meeting were careful to specify that this was the cost of mitigation banking, and that they were not proposing any revenue mechanism, it is possible that this cost could be transferred solely onto new development. If this was the case, how would they look in the context of other fees homebuilders currently have to pay?

Under the Endangered Species Act, an Incidental Take Permit must be acquired in order to build or do any activity that causes, or could cause, take on the species or its habitat.

Building new home usually involves permit, utility, and impact fees. All of these rates are determined by local governments to pay for the cost of services delivered, or already constructed, in and around the property. For example, the impact fees in the top graph to the right, apply a 2,500 square foot, single family residence built in Olympia, Lacey, Tumwater, Yelm and Thurston County.

These costs are transferred directly to the new home owners. For example, the impact fees for roads, parks, and schools in the City of Olympia raise the cost of a new home by $14,396. At the other end of the spectrum, these impact fees in the City of Yelm add up to just $4,512.

All of this information indicates that a new, single family residence constructed on a single acre could be paying more in impact fees for gophers than for roads, parks, & schools combined, as shown in the bottom chart on the right.

The good news is that OMB is currently involved in the development process of the Thurston County HCP. We are working hard to communicate the need for this document to be reasonable in its outcome, take into account the population increases estimated in Thurston County over the next 30 years, and factor in the needs of affordable housing in our region.

Based on these numbers, gophers could cost as much as nineteen times more than roads, parks, & schools combined for new homeowners. This could dramatically increase the cost of housing in Thurston County and make home ownership unattainable for most individuals.

Government Affairs Highlights Olympia Master Builders (OMB) is currently working on and/or monitoring many issues related to the building industry.

Here are a few recent highlights:

City of Shelton

Streamlines Transportation Funding – On November 9th,

the Shelton City Commission approved an ordinance that restructures the funding mechanisms for transportation. In the past, a separate Transportation Benefit District Board met to address needed street and transportation improvements.

This ordinance dissolved that board and transferred its rights, powers, functions, and obligations to the City Commission, hopefully streamlining the process and reducing redundancies in public meetings. At this point, the consequences of this transfer are unclear, but OMB staff will be paying attention to any transportation changes that affect the City of Shelton or other jurisdictions.

Thurston County

Thurston County and Other Jurisdictions Implement LID – Low Impact Development is a stormwater and land use

management strategy that strives to mimic pre-disturbance hydrologic processes by emphasizing conservation, use of onsite natural features, site planning, and distributed stormwater management practices. Over the past several years, the use of these techniques, and their incorporation into municipal building code, has been voluntary. However, federal and state law mandates that these processes be integrated into local code by the end of 2016. The City of Olympia is near the end of this process, while the City of Lacey and Thurston County are still working to make these changes. It is vital that the building community be involved in these discussions to ensure practicality. OMB will host Olympia Planning Officials at the January Government Affairs meeting on January 28th at 4:00 pm.

Lewis County Maintains Current Growth Policies–

According to the Growth Management Act, each year the Board of County Commissioners is required to approve or amend Countywide Planning Policies. While changes were discussed at the Planned Growth Committee in April and amongst the Lewis County Planning Commission in July, both groups recommended no change based upon virtually no change in population forecasts. With public hearings completed in September and November, the Board of County Commissioners is expected to pass the measure. This is good news for builders in Lewis County, allowing for continuity and maintaining growth trends in the jurisdiction.

Government Affairs Committee Chair: Ron Deering, Deering & Nelson, Inc. Meets the fourth Thursday each month at 4:00 pm Mission: Oversee and coordinate the government affairs activities and programs of the association in order to execute its public policy goals and objectives.

Membership Committee/Spike Club Chair: TBA Meets the last Monday each month at 4:00 pm Mission: Plan and promote activities and policies for growth of the Association’s membership. Develop goals for enrollment, member renewal and membership value, develop and implement programs to achieve those objectives.

Nominating Committee Chair: John McKinlay, Olympia Overhead Doors Meetings are called as needed Mission: Organize and supervise the election of the Association’s officers and directors, interview candidates for election and provide recommendations on qualified candidates to the general membership.

Remodelers Council ($85 yearly fee) Chair: TBA Meets the third Tuesday every other month at TBA Mission: Promote the remodeling industry by offering its members information, education, networking opportunities for the exchange of ideas, and recognition programs for quality craftsmanship. The council advocates professionalism, business and technical excellence, community involvement, and the opportunity to assist in providing safe, affordable housing through preservation and improvement of existing housing.

The Affordable Housing Council ($125 or $85 if you’ve already paid your $40 voluntary contribution) Chair: TBA Meetings are called as needed Mission: TAHC is the political action committee for the Olympia Master Builders. It provides financial support to political candidates who understand and support the issues of the building industry.
