became a general contractor in the winter or 1993, and joined OMB in 1994. Back then, I was very young and inexperienced when it came to running a business.

My skills and expertise laid really in only knowing my trade and craft of being a Remodeler.

OMB and BIAW have been invaluable to ALL their members, providing us with this much needed information, both good news and bad news. I have no idea how I would have received the “real” news or information (specific to our industry) if I wasn’t a member!

Joining OMB surrounded me with like-minded professionals with common goals. Many OMB and BIAW members helped me professionally and personally learn and grow as a business owner and I created lifelong friends along the way.

Both OMB and BIAW staff have been working tirelessly on our behalf (from home) advocating for us and providing us with the specific information we need as business owners such as, permitting information, job site safe work practices, live webinars, and the ability to ask questions and get solid answers from BIAW’s legal staff.

I have never been so thankful for my membership with OMB and BIAW as I am right now in the middle of the Covid-19 worldwide pandemic.

This came down the line and hit us fast and hard - I don’t think any of us were prepared. When COVID-19 began to ramp up in our region, there was little to no information out there, especially for business owners on how to proceed to protect ourselves, our staff and our customers.

I am thankful for the support and information, but more than that, I am proud of OMB and BIAW’s staff who have continued to provide us information as we are all doing our best to stay safe, and stay in business.

Meet Jenn Wasson, OMB's New Office Administrator Jenn has lived in the Olympia area since moving here in 1976. She attended WWU and then St. Martin’s University. She spent the next 19 years teaching at Evergreen Forest Elementary. Go Bobcats! After many years in the field of education she was ready for some new challenges. She began doing de-escalation training for adults and when the opportunity to join the team here at OMB arose she jumped at the opportunity to work in a position that would provide her the chance to become more involved in her community in a totally different capacity.

2018 Energy Code DELAYED! Governor Inslee announced a delay in implementing the new state building codes from July 1 to November 1, 2020.

We anticipate that training on the new code will be rescheduled in late Summer or early Fall.

OMB Members in the Community M ost of you know Mike Auderer as an OMB Member and business owner of Olympia Construction. What many of you may not know is that Mike has recently shifted gears to help battle the issues of homelessness in Thurston County.

As a business owner downtown, Mike found himself growing frustrated with not being able to assist with a response to the issue of homelessness arising in his community. So, like any successful entreprenuer, he decided to put his skills to use and create ideas, products and strategies to offer as solutions. Utilizing his welding and construction skills, he developed three styles of “Shelter Solutions� Units - using 20 foot conex shipping containers.

The first is a 3-person unit for individuals and the second is a couples/ADA unit which will provide two shelter spaces. And the third, needed more than ever in the face of COVID-19, is the Hygiene Unit, which is a 3-stall unit, each stall complete with a shower, toilet and sink, with one stall being ADA compliant. Shelter Solution Units can be shipped like any other container which makes them very easy to place onsite with a forklift or crane. They can hook to domestic water with a hose, waste can go to an OSSS, city sewer or an above ground holding tank that can be pumped out.

would have never imagined we would be in the middle of a Pandemic when 2020 kicked off, but here we are - daily navigating the fallout from COVID-19. I know many of you are making tough choices for your businesses and families. My heart goes out to you all. This issue of Chalk Line is now dedicated to sharing information and resources to support your business, along with showcasing the businesses that were affected by the cancellation of the 2020 BIG Home and Garden Show.

OMB staff, in concert with other local associations and the Building Industry Association of Washington (BIAW), has been working around the clock to respond to the consequences of COVID-19 and provide useful information to help members navigate the current reality. We all have also been working toward the common goal of getting residential construction back to work safely. As I write this, BIAW

is starting to produce some results by advocating to the Governor for home building to be considered an essential industry. There have been major partners in this effort, from State Legislators, to Congressional Delegates, to other associations like the NW Pulp and Paper Association. The effort has been broad and multi-faceted. You can read more about the advocacy efforts on page 10. Along with advocacy, we have been working to provide up-todate information and business resources so you’re not stuck navigating it all on your own. You can read more on pages 8-9.

We will continue to work with local jurisdictions, offering support and solutions so we’re prepared as an industry when it’s time to go back to work.

How the CARES Act Benefits the Construction Industry The construction industry, like many others, is facing unprecedented turmoil due to the ongoing COVID-19 pandemic sweeping the country. As Governor Inslee’s guidance considers commercial and residential construction “non-essential” with limited exceptions, some construction companies remain operational while others have had to shutter their windows for the near future. This has led to economic uncertainty for many construction business owners.

In an attempt to help struggling businesses and individuals see their way through these uncertain times, President Trump recently signed into law a $2.2 trillion stimulus package designed to abate the economic damages caused by the COVID-19 pandemic. The Coronavirus Aid, Relief, and Economic Security (CARES) Act contains many provisions that can directly impact your operations.

There are three items that can provide financial relief to construction businesses, including:

Paycheck Protection Program Business Disaster Loans

Employee Retention Credit

How can I use it?

Loan for certain payroll expenses, interest on mortgage obligations, rent, utilities, and interest on pre-existing debt obligations

In addition to the items noted above, the CARES Act included provisions that: • Delay the payment of employer payroll taxes through December 31, 2021 • Reduce potential limitations on the ability to deduct interest expense • Provide more favorable depreciation provisions for qualified improvement property allowing for increased depreciation deductions • Reduce limitations on net operating losses and allow companies to carry back net operating losses for up to five years • Suspend the limitation on excess business losses No matter what unfolds over the next few months, it is very important to keep detailed records of your projects costs, delays, losses, and other important information. The more information you obtain during this time, the easier it will be to file for assistance.

OMB COVID-19 Resources Tax Credits:

There are COVID-19 IRS Payroll Tax Credits Available to small and midsize employers.

Unemployment Insurance:

The Washington State Department of Revenue is allowing businesses to request a one-time, 24-month penalty waiver if you have not owed a late penalty in the last 24 months. Also, businesses can request a 30-day extension of B&O taxes without payment or 30+ days with deposit.

In Washington state, the minimum one can receive on unemployment is $188 and the maximum is $790. The CARES Act provides an additional $600 per week on top of whatever a person would normally receive – limited to the next 4 months (expires July 31, 2020). Washington provides access to unemployment benefits for up to 26 weeks.

The CARES Act provides federal funding for an additional 13 weeks for those who need it. Funding for this expires December 31, 2020.

IRS Extends 2020 Tax Filing Date: The tax-filing deadline

will remain July 15, but the IRS will waive penalties and interest on tax payments for 90 days.

Excise Tax Filing Assistance: The Washington State Depart-

ment of Revenue will work with businesses that cannot file or pay their excise taxes on time due to the COVID-19 outbreak. Affected businesses may qualify for filing extensions or penalty waivers.

SharedWork Program: SharedWork is a voluntary business

sustainability program that provides flexibility to retain employees at reduced hours. This is a little known but powerful program to help workers stay employed while drawing needed benefits.

The Washington State Department of Revenue: A help-

ful guide that outlines frequently asked questions about how to file and pay online, audits, and more.

Under the Economic Injury Disaster Assistance program, employers are eligible for $10,000 in immediate funds to assist with operating expenses, like payroll.

This loan is forgiven by the SBA. You do need to apply for SBA assistance, which also includes larger loans with no payments for 12 months at a rate of 3.75% for business owners. The agency has streamlined the application process and you are eligible for the $10,000 regardless if you’ve been denied a loan in the past.

Advocacy in Response to COVID-19 Here just some of the ways OMB has fought for your business and the construction industry during the COVID-19 crisis:

• Continual coordination with BIAW and other local associations on policy responses • Development and distribution of an Interim Permitting Action Plan • Advocating for long term permit vesting, including providing sample ordinance language • Recommending B&O and property tax deferral to support small business cash flow • Coordinating Letters to the Governor with Counties and Mayors requesting the reclassification of residential construction as ‘essential’.

• Advocating for a delay in the 2018 Building Codes • Development of on-site safety guidance for residential construction • Tracking daily changes to permitting and inspection changes at all jurisdictions as well as project-specific advocacy while changes were on-going.

BUILDING CODE DEFERRAL

In early April, Governor Inslee announced a delay in implementing the new state building codes from July 1 to Nov. 1. OMB, BIAW, the Washington Association of Building Officials and several members had jointly asked the governor for the delay to ensure builders and officials could be adequately trained on the new codes prior to their implementation. This delay is crucial for our members to be fully educated on the changes in the codes and to allow for the materials to be available locally before the building codes are implemented.

At time of publication, OMB is working with local jurisdictions to request that the delay be extended until July 01, 2021. We anticipate that training on the new code will be rescheduled in late Summer or early Fall, but will adjust depending on the final date of the Stay Home, Stay Safe order.

EARLY ADVOCACY: OMB’S PERMITTING ACTION PLAN

As soon as OMB began to see potential impacts to the normal course of business, we began working with all our jurisdictions to develop a Permitting Action Plan to with recommendation on how to adapt permitting and inspection activities and ensure long term economic recovery.

On March 22, 2020, OMB sent a letter to County Commissioners, County Managers, Mayors, Councils and City Managers in the OMB region, requesting they implement an Action Plan that included: • That vesting for permits expiring between March 1 be extended to a minimum of September 2020.

• That for jurisdictions with online submission, they ensure permitting offices have a designated point of contact, even if the local staff are working remotely or not available face-to-face.

• That for jurisdictions without online submission, they create a physical, no-contact, permit drop off location so staff can process permits remotely.

• That for inspections, a formal on-site, no contact protocol be established to include: inspectors calling the site contact from their vehicle and doing an inspection with no one else on site, or via video, or delayed, ex post facto inspections.

• That all ongoing code enforcement activities and defer new code enforcement be suspended until after conclusion of COVID-19 emergency unless directly related to public health, safety, or welfare.

• That the collection of impact fees be deferred until Certificate of Occupancy is issued or until sale.

• That occupancy of structures with previously approved designs be allowed, without inspection, as well as a post-construction verification or permit process be created to verify compliance once emergency restrictions are lifted.
