Mandy Vatter: One of the key things that truly sets PAM Health apart is our unwavering commitment to providing individualized patient care. We take the time to genuinely understand each injured worker's job requirements and personal living situation, allowing us to better prepare them for a safe return to both their home and work environments. Additionally, our extensive experience and abundant resources enable us to offer customized solutions that cater to the unique needs of injured workers, delivering exceptional outcomes. Q: Can you share the story of how PAM Health began and what motivated you to focus on workers' compensation? Christopher M. Maglaras III: The story of PAM Health began back in 2006 when Anthony Misitano founded Post Acute Medical, LLC with just three hospitals. Since then, we have grown exponentially by building new hospitals and acquiring existing ones across multiple states. In 2018, we launched our Workers' Compensation Program in response to feedback from our insurance partners who expressed concerns about patient care at local hospitals. We heard about issues related to cost management, communication breakdowns, and poor patient outcomes, which motivated us to create a tailored solution. Since the inception of our program, we have proudly helped over 1,000 injured workers receive the specialized care they need and deserve.

The practice has been recognized as a top choice for employers seeking reliable and effective medical services for their injured workers. As part of the esteemed team at South Florida Orthopaedics and Sports Medicine, Dr. Ramos excels in his field and has become a trusted name in workers' compensation. The practice itself has gained recognition for its commitment to excellence, being named on the list of top best practices in workers' compensation for 2022. Q: What would you say is the unique part of your specialty? A: A unique aspect of my specialty is the ability to help people recover from injuries and restore normal function through multidisciplinary approaches. With Pain Management as a subset of Anesthesiology training, I possess a deep sense of empathy for my patients. My background in Pain Management enables me to take a well-rounded multidisciplinary approach to address all aspects of their injuries, encompassing not only the physical aspects but also the psychological and social distress that often accompany loss of function and livelihood. Q: How many years have you been practicing? A: I have been practicing in the Treasure Coast of southeast Florida since 2016. While I am originally from Venezuela, I consider Florida my home. Prior to my current position, I underwent training at Mayo Clinic in Jacksonville and the University of Florida in Gainesville.
Q: Tell us something interesting about yourself that most people don't know. A: Most people may not know that I am an avid guitar player and have a great passion for music. During my training years, I volunteered with Musicians on Call, where I provided musical relief and mental hygiene for the sick and elderly. Additionally, I enjoy camping and outdoor activities with my family and dogs in our Volkswagen 1970s bus. Q: What is your "why?" What inspires you every day to do more and do better? A: My driving force is to do my best for a better community and a better world for future generations. Love and caring for one-another is at the core of my inspiration and beliefs in making a positive impact. Q: What skills are the most important for your job? A: Attention to detail regarding a patient's condition, responsive communication between physician, patient, and the workers' compensation team for timely care, comprehensive and empathetic approach tailored to the patient's needs, and excellent injection skills are all essential for my job. Q: What is your favorite thing to do when you are not working? A: When I am not working, I find joy in spending time with my dogs, engaging in sports activities and camping with my children, enjoying and playing music, and attending concerts. BLOOM MAGAZINE | 30
Q: Take us back to when you first began in medicine. What was it like for you? A: My initial experience in medicine was in my home country of Venezuela. In the last year of medical school, which is also the first year of practice, every medical student is sent to an underserved rural area to work as an intern under the guidance of the only physician in the town or village. This experience was incredibly special to me, teaching me the values of gratitude and humbleness. Q: What is the most challenging part about your job? A: The most challenging aspect of my job is maintaining the highest standard of care and providing the best possible treatment for my patients within a professional environment where setbacks are common, paperwork can be extensive, and exceptional care may sometimes be denied. I am grateful for my office staff and collaborators who assist me and my patients in navigating these challenges to ensure exceptional care for the injured. Q: What does an average day look like for you? A: An average working day typically begins around 7:30 am and ends close to 6 pm, once all paperwork and miscellaneous tasks are completed. I assess patients three and a half days per week and dedicate one and a half days per week to performing fluoroscopic guided injections. Q: What is your philosophy when treating injured workers? A: My philosophy in treating injured workers revolves around prompt diagnoses and treatment. It is essential to maintain good communication with the workers' compensation carrier and employer, ensuring that everyone remains aware of the patient's diagnoses and needs. Additionally, active patient participation in therapies that facilitate retraining and adapting the body for an efficient return to duty is imperative. Q: If you could change one thing about the workers' compensation industry, what would it be? A: While I believe the workers' compensation industry is generally good, one thing I would change is to expedite responses and resolutions to patients' problems as fast as possible. I also advocate for more multidisciplinary involvement, such as psychological care and alternative therapies like acupuncture and massage therapy to enhance patient outcomes. Q: What's your biggest professional accomplishment to date? A: Every day, I take pride in the work I do and consider helping each of my patients a significant accomplishment. Q: What final thoughts would you share with those in workers' compensation? A: To those in workers' compensation, I encourage you to keep your head held high and maintain positive spirits. Together, we will overcome your injuries and strive to restore you back to your baseline as quick and comprehensively as possible.
Q: What makes your practice unique? A: I practice at South Florida Orthopaedics and Sports Medicine, which is part of a multidisciplinary orthopaedic group. This allows me to provide my patients with comprehensive care, including physical therapy, medication management, injections, and even surgery if necessary, with the support of our orthopaedic colleagues. Our patients benefit from having all their needs met within one practice, bypassing the challenges associated with larger hospitals. Q: What strategies do you use to ensure effective communication with all parties involved in workers' compensation claims? A: To establish effective communication with injured workers, employers, and other involved parties during workers' compensation claims, we employ any means necessary. Our practice has dedicated staff members who manage our Worker Comp patients, ensuring an open line of communication with WC adjusters and case managers. Personally, I am always available and actively advocate for the timely and effective fulfillment of our patients' needs. Q: What are the best ways to reach the practice, you, and the staff? Claudia and Gary share their passion for improving the lives of injured workers in the workers' compensation industry and how their organization's unique approach has set them apart from others in the field. Claudia begins by introducing their organization's mission: "At Senior Nannies and SN Home Healthcare, our primary goal is to ensure a swift and successful recovery for injured workers. We specialize in providing optimum skilled and non-skilled care, with a strong focus on catastrophic cases, such as Traumatic Brain Injury, Spinal Cord Injuries, Multiple Traumas, Quadriplegics, Paraplegics, and Ventilator-dependent individuals. Our services cover the entire state, offering comprehensive care to injured workers and their families." When asked about how their organization effectively solves the challenges faced by customers in the workers' compensation field, Claudia and Gary highlight their commitment to responsiveness and timely care: "We understand the urgency in workers' compensation cases, so we make sure to be available 24/7. Our same-day staffing ensures that skilled professionals are promptly available to start the care process. Additionally, we provide a quick turnaround on notes within 24 to 48 hours, and we keep all stakeholders informed with daily and weekly updates. Whether the case is long-term or short-term, we offer state-wide coverage to address the needs of injured workers across the state." What sets Senior Nannies and SN Home Healthcare apart from other firms, organizations, products, or services in the workers' compensation industry? BLOOM MAGAZINE | 56
Claudia and Gary point out several key differentiators: "Several aspects make us stand out. Firstly, our state-wide coverage ensures that injured workers in any region can access our services. We have an inhouse clinical team that specializes in handling catastrophic cases, which sets us apart from many others. Our commitment to providing same-day service and having a 24/7 live on-call clinical and nonclinical support is also unique. Additionally, our emphasis on technology and personalized communication with in-house case managers further enhances the quality of care we deliver." Claudia and Gary then share the inspiring story of how their organization began and what motivated them to focus on workers' compensation: "Our journey started 28 years ago when Claudia founded the first Assisted Living Placement Service, helping people relocate to Independent Living, Assisted Living, or Memory Care in the tri-county area. Recognizing the growing need for skilled and nonskilled services for the senior population, we established Senior Nannies and SN Home Healthcare. As we expanded our services, we realized there was a significant gap in the workers' compensation arena, and we decided to get involved. We became preferred providers for ancillary networks and gradually extended our care services statewide." With nine locations already in operation, Claudia and Gary highlight their plans for future expansion: "Currently, we operate nine locations, and we are continuously growing to meet the increasing demand for our services. Expansion remains a key part of our vision as we strive to reach and assist more injured workers in need." Claudia Wechter and Gary Loffredo's remarkable journey from founding the first Assisted Living Placement Service to establishing Senior Nannies and SN Home Healthcare exemplifies their unwavering dedication to making a difference in people's lives. Through their organization's vision, mission, values, and unique approach to workers' compensation, Claudia, Gary, and their team are actively empowering injured workers on their path to recovery, leaving a positive impact throughout the state and beyond. WHO IS RESPONSIBLE FOR THE OUTCOME IN CATASTROPHIC INJURY CLAIMS? Written by Donna Check
My articles on catastrophic injuries, including traumatic brain injury, acquired brain injury, spinal cord injury, and other severe lifechanging injuries, come from from my perspective leading, working, founding and being fully entrenched in specialized catastrophic injury rehabilitation programs for 25 years. There are many more articles written which will be published, and many more I need to put on paper. Nothing written in any article is blaming anyone or any company. The Specialized Rehabilitation Program Specialized rehabilitation facilities see and deal with everything involved with each patient. The interdisciplinary team interacts with every injured employee, and every family, and ALL the professionals involved externally (meaning not being directly involved with the patient every day): adjusters, internal nurse case managers – many of whom are phasing out as are Catastrophic Injury Claim Units within carriers and TPAs – field nurse case managers, claims managers, external treating physicians (neurosurgeons, orthopedic surgeons, orthopedic traumatologists, etc.) transportation companies, durable medical equipment companies, schedulers, externally contracted services, pharmacies, hospitals, other rehabilitation facilities and programs, etc., sometimes employers, and claimant attorneys if they are retained and, occasionally, plaintiff/personal injury attorneys and insurance defense attorneys. The consistent daily interactions and proximity to each patient may be why rehabilitation programs become such strong advocates. They SEE.
BLOOM MAGAZINE | 62
Workers’ Compensation We know professionals working within the workers’ compensation industry have much to consider early on regarding the circumstances, conditions, and employee status at the time an injury occurred. We know the guidelines, tasks, legal and other responsibilities. There is much going on in the background – the “claim” – while the injured employee is hospitalized. And everyone knows adjusters have an overwhelming number of “claims,” with each “claim” representing a human being who is hurt. The Injured Employee and Family Who contacts the family after the injury occurs? Does a call from the adjuster help the family and with the claim? To me, I am relieved when I hear from the family that the adjuster has been in touch with them from the day the injury occurred, and that the adjuster continues to communicate with the family. I am never surprised to hear the patient experience was “very good” to “excellent” when immediate initial contact with a family was made by the adjuster. It appears to me when the adjuster expresses concern, compassion, is kind and remains in close communication, families are less stressed and feel better because the lines of communication are open. They feel supported and know their family member is considered important and valued as a person and as an employee. The BIG Question Is the outcome of the injured employee and the outcome of the claim any different with immediate and open communication? Let’s consider: The Claimant Attorney The general public hears warnings on television all day such as, “Don’t talk with your adjuster.” And no offense is intended here but is hiring a claimant attorney immediately after an injury occurs really helpful to the injured employee or the claim at this early stage? Some claimant attorneys block communication between the injured employee/family and the adjuster and nurse case manager assigned to provide medical case management services.
A Huge Fear for Family Members Families are extremely fragile and how they are treated matters very much. With poor or zero communication the family may conclude that the injured employee did something wrong, or the injury and care is not covered or not work-related. Much worse, they may feel the employee is not important or valued. It’s not usual for outsiders from the trauma to believe the family is coming to grips with the situation and adjusting. Without strong communication and support, the family feels alone and completely alienated from the very people who are supposed to be helping the injured employee. I believe it is understandable that each concern here could be good reason and often why family members seek the help of a claimant attorney. Communication. The Employer The word “fragile” above may have some confused as not all families present that way. It is not unusual for family members to be angry, lash out, cry, or yell in a waiting room, on the phone, to the physicians and hospital staff and to one another. Their feelings are raw and as each hour or day passes, a variety of emotions are running on the same adrenaline that is keeping the family members functioning. They most often are angry, and they may look to blame someone for what has happened. That can easily be the employer. Again, it is their fear, loss of control, and sense of helplessness they feel deeply. Not knowing the future is overwhelming. When the employer stays away, doesn’t call or visit, family members can conclude the employer did something wrong. Communication.
BLOOM MAGAZINE | 63
Empathy. Compassion. Caring. Understanding. Kindness. Love. Patience. Always. No matter the state, the workers’ compensation industry has rules and regulations, along with individual company-related policies, procedures and protocols. Nothing in the process indicates all the players having roles helping and working with the injured employee must feel and show empathy, compassion, caring, understanding, kindness, love, and patience. There is also nothing stating...Each injured employee and their family should be treated the way the professionals involved in the claim process would want the person they love the most in their lives treated in relation to the injury. How would you feel? Would you want an initial call from the person responsible for the claim? What about open communication with the adjuster? Does kindness and compassion make a difference? Does that connection between adjuster and family matter? I strongly believe it does and have shared this information for many years when providing CE Courses to carriers, TPAs, to attorney groups (claimant and defense), and at conferences. It takes a village It’s wonderful to know adjusters are open and available to families. It takes a village, a real team, with one main objective. It’s not the doctors or the nurses or the catastrophic nurse case managers or the rehabilitation facilities and programs… EVERYONE involved contributes to and is responsible for the outcome of every injured employee and the claim itself. Earliest Possible Communication If the timely initial point of contact fails, the domino effect can very easily occur. A claim can go downhill right from the beginning. It can be extremely difficult to get it back in a positive direction. Injured employees need encouragement and to know EVERYONE is routing for them every step of the way. A phone call with a positive and kind mindset knowing a person is injured and what is needed and right to help and support that person may be all it takes to starting off pro-actively.
Everyone should be focused on the needs and outcome objective for the injured employee as well as helping and supporting the family. It’s important to keep in mind the family has not realized the injury is life-changing, not only for their loved one but for all family members who love and care about the injured employee. Empathy. Compassion. Support. Love. Kindness.
Question: Would YOU want YOU to be involved with the “claim” of the person you love the most in the world?

GET READY TO RECLAIM YOUR FUTURE NOW! Written by Licia Thompson It’s no secret that many who are leaders don’t regard themselves as such. Merriam-Webster defines a leader as: “A person who has commanding authority or influence.” Influence is: “affecting or changing someone or something in an indirect, but usually important way.” As a certified Leadership Reinvention Strategist and published author, I’ve encountered some who don’t recognize they’re leaders. Leadership originates in the mindset of a person who inspires, influences and cares about others. A few ways to determine if you’re a leader: You’re skilled at seeing what’s invisible to others. You see challenges, obstacles and struggles as opportunities to grow. You’re optimistic and can make the impossible possible. You tend to remain calm in chaos. You do things with integrity. You honor your well-being. You seek to find purpose. You’re consistent and people trust you.
People often underestimate the power of effective leadership, present in all levels of society. Learning to see challenges as opportunities can be the mindset shift that places you in a position to soar. It begins with selfawareness, a trait that leaders cultivate through the years. The more you practice, the easier it can be to embrace the journeys of life. Questions to ask yourself: How do you cultivate your self-awareness? How do you adapt when challenges arise? How do you determine when pivoting is appropriate? Generally, how are you, emotionally and energetically? Some of the most inspirational leaders are parents, teachers, clergy, athletic coaches, choir directors, mentors, writers and more. Not all leaders are born with this skill. You can learn to be a leader. Not all leaders are the smartest in the room. In fact, many of them didn’t perform well in school. BLOOM MAGAZINE | 66
Leaders are not invincible and they’re not perfect. It’s important to remember that each new day provides opportunities to improve. Let’s talk about transparency. Effective leaders are those who are authentic. No one gets everything right all the time. Asking for forgiveness or apologizing is a strength. Doing so helps to create stronger relationships. While you and I are being transparent, I’ll share...There were a couple of decades during my early years when I was an introvert. I wasn’t a follower. I was self-motivated and secure in myself. I recognized this during my first corporate job, two years after college, as a Station Editor for TV Guide Magazine. I was twenty-four and everyone in the department was between 35-55. Not only was I the youngest, but I was also the only Black person. I was also the only person with a college degree. Take a moment, right now to reflect. Begin to recognize you can lead the direction of your future despite personal challenges you’ve endured. It takes time and effort to become comfortable at it. You are wise. You have strengths. You valuable! Begin to believe in yourself and your abilities. Begin to create new habits to increase your ability to lead yourself. No one is exempt from injury, illness, grief, divorce, empty nesting, caregiving and more. Rather than to turn away from the unknown variables of life, I want you to turn toward reality. Embrace your life as it is. Minimize avoidance and maximize your willingness to explore options. If you don’t like how your life looks and feels, be willing to do the work it’ll take to create what you desire. Change your thinking so that you no longer tell yourself what you can’t do. If slow and steady is your speed, purpose yourself to stay the course. Making incremental growth leads to lasting change.

Written by Neil A. Ambekar, ESQ
TREATERS, IMES, AND EMAS – OH MY! Since 1994, §440.13(9)(c), Fla. Stat., has allowed Judges of Compensation Claims (“JCCs”) to appoint an expert medical advisor (“EMA”) to assist the JCC when there is a conflict in the medical opinions. Up to May 25, 2023, the statute provided that “If there is disagreement in the opinions of the health care providers… [the JCC] shall, upon his or her own motion or within 15 days after receipt of a written request by either the injured employee, the employer, or the carrier, order the injured employee to be evaluated by an expert medical advisor.” Understanding the EMA rule requires an understanding of the rest of the statute and case law. What is a “health care provider”? This term is defined in §440.13(1)(g), Fla. Stat., as “a physician or any recognized practitioner licensed to provide skilled services pursuant to a prescription or under the supervision or direction of a physician. The term “health care provider” includes a health care facility.” In other words, the term does not only include physicians, though most EMA appointments are the result of disagreements between physicians. It can extend other professionals such as psychologists, chiropractors, physician assistants, nurse practitioners, nurses, and so on. The disagreeing providers may be treating physicians or IMEs, and they do not have to be in the same specialty. Keeton v. Kentucky Fried Chicken, 74 So.3d 1125 (Fla. 1st DCA 2011); AA Gutter Cleaning, Inc. v. Cesario, 49 So. 3d 281 (Fla. 1st DCA 2010). However, not all health care providers are qualified to “disagree” about all issues. For example, a psychologist cannot testify about an impairment rating or medical restrictions for physical injuries. Hernandez v. Geo Group, Inc., 46 So.3d 1123 (2010); AT & T Communications v. Who pays for the EMA? Under §440.13(9)(f), Fla. Stat., the answer is simple in theory: the party requesting the EMA pays. In practice, it is nearly always the employer/carrier because of the provision for appointment “upon the JCC’s own motion.” It seems likely this was intended for situations where the JCC was uncomfortable deciding the issue without additional medical testimony – perhaps because none of the existing opinions were clearly stated, or because the issue was in a field of medicine in which the JCC had no experience. However, in Banuchi v. Dep't of Corr., 122 So. 3d 999 (Fla. 1st DCA 2013), the First District Court of Appeal held that the JCC was required to appoint an EMA whenever a party brought a medical dispute to the court’s attention – even if that party did not actually request an EMA. In Banuchi, the employee filed a “notice of conflict” stating that there was a disagreement in medical opinions, and asking the JCC to appointment an EMA on his own motion. Previously, the established mechanism was for the requesting party to file a motion asking the JCC to appoint an EMA, and the JCC declined to appoint an EMA because no motion was filed. However, the appellate court held that the “notice” was sufficient to trigger the JCC’s obligation to appoint an EMA on his own motion. §440.13(9)(f), Fla. Stat., makes the carrier responsible for the cost of an EMA appointed on the JCC’s own motion, so Banuchi effectively made the carrier responsible for the cost of an EMA in every case. What disagreements require appointment of an EMA? Well, all of them really. The statute specifically provides for EMAs in cases where “there is disagreement in the opinions of the health care providers, if two health care providers disagree on medical evidence supporting the employee’s complaints or the need for additional medical treatment, or if two health care providers disagree that the employee is able to return to work…” This language has been read broadly to permit an EMA on virtually every issue that medical providers are competent to testify about. For example, though not specifically mentioned in the statute, an EMA can be appointed to address permanent work restrictions. Brandywine Convalescent Care v. Ragoobir, 124 So. 3d 344 (Fla. 1st DCA 2013). Who is qualified to serve as an EMA? §440.13(9)(a), Fla. Stat., requires the Division of Workers’ Compensation to maintain a list of certified experts. The Division currently limits application to board-certified physicians under Fla. Admin. Code R. 69L-30.004. If there is no appropriate provider on the certified list, the statute allows the JCC to appoint any “qualified provider,” with such qualifications left up to the JCC.
How is an EMA selected? Under the statute, the parties can agree on the EMA, but if the parties are unable to agree the JCC decides. As parties rarely agree on the EMA, the JCC’s decisionmaking power is significant. However, methodology is lacking. Some JCCs literally draw a name from a hat. Others roll a die. Some go through the doctors on the local list in alphabetical order, appointing each in turn as the cases come before them. Some pick the same doctor in every case because they trust the doctor to serve as an honest broker. In many cases, there may be only one doctor who is qualified to serve, or only one willing (which is quite possibly the major impetus for the recent change in the law). What is the deadline for requesting an EMA? “The EMA statute does not set a deadline for EMA requests.” Steinberg v. City of Tallahassee, 186 So. 3d 61, 65 (Fla. 1st DCA 2016). However, the request should be made with “reasonable promptness” once the conflict is known. AT&T Wireless v. Frazier, 871 So. 2d 939 (Fla. 1st DCA 2004). What is the effect of the EMA’s opinion? The EMA’s opinion is “presumptively correct.” So if the EMA’s opinion is favorable to one party, that party is not required to prove that the EMA is correct. Rather, the other party must prove the EMA is wrong by clear and convincing evidence, a high bar. If the other party fails to do so, the JCC is required to accept the EMA’s opinion even if the JCC personally disagrees. The First District Court of Appeal has described the opinions of an EMA physician as “nearly conclusive.” Cromartie v. City of St. Petersburg, 882 So. 2d 439, 440 (Fla. 1st DCA 2004). It should be noted that the presumption of correctness only applies to the dispute for which the EMA is appointed. Opinions of the EMA which are beyond that issue are treated like any other medical testimony. Lowe's Home Centers, Inc. v. Beekman, 187 So. 3d 318 (Fla. 1st DCA 2016). So what changed, and why? In May 2023, the legislature amended the statute to provide that the JCC may order the employee to be examined by an EMA, instead of “shall.” In other words, a JCC is no longer required to appoint an EMA in any case even if a medical dispute exists, but has discretion to determine whether an EMA is appropriate. The change was made suddenly and with minimal discussion, but are two likely reasons for it. First, the Division of Workers’ Compensation hasn’t put much effort into the expert medical advisor certification list (https://apps.fldfs.com/provider/). There is an application process for new experts, but the Division has put almost no effort into recruiting experts, and certainly hasn’t kept up with existing experts retiring, moving their practices, and so on.
BLOOM MAGAZINE | 69
This has led over time to a very short list of EMA options in specialties other than orthopedics, with only a couple of doctors in some fields. For example, there are only six boardcertified foot and ankle surgeons on the EMA list, and four of them are in the Orlando area. There are five cardiologists. There are three neurosurgeons, three neurologists and three psychiatrists. There is one urologist and one plastic surgeon. These experts must serve a state of nearly 22 million people. Recall that for an EMA to be appointed in the first place, there must be a conflict in the medical opinions of two other physicians, making the lists even shorter in some cases where a conflict of interest would arise. But things are even worse in other fields – there is not a single obstetrician, gynecologist, ophthalmologist, internist, chiropractor, ENT, dermatologist or dentist certified as an EMA anywhere in the state. This drastic shortage of providers has caused massive delays in litigation and has surely frustrated JCCs and parties alike. I had a trial in one case delayed from March 2019 to January 2020 because the JCC was unable to find a doctor willing to serve as an EMA (in a field where there was no expert on the certification list). While this is a somewhat extreme case, similar delays occur statewide every day. The second reason for the law change is probably the Banuchi decision discussed above. An EMA is permitted to charge up to $300.00 per hour for up to eight hours per Fla. Admin. Code R. 69L-30.008(5). In practice, every EMA charges the full $2,400.00 whether they perform eight hours of work or not. EMAs are permitted to request to petition the JCC for a fee of more than $2,400.00 in extreme cases, but fortunately none of them seem to be aware of this. But in any case, this charge does not include the EMA’s deposition, which will be at least $200.00 and often approaches $1,000.00 after “record review” charges (and this does not include the court reporting fees). Because Banuchi effectively made the carrier responsible for the EMA charges in every case, it essentially increased the carrier’s exposure by $3,000.00 in every litigated case. EMA charges are taxable costs which should theoretically be repaid by the employee if the carrier wins the case, but there is no meaningful enforcement mechanism in most instances. So expense reserves have been artificially inflated by $3,000.00 or so to account for this exposure. That is not to say that a carrier will never have to pay for an unwanted EMA again. There will still be medical questions which JCCs are unable to decide, for which they elect to exercise discretion. Some JCCs will no doubt continue appointing EMAs in most cases because they are comfortable with the existing process. And the Banuchi case will still require carriers to pay for the EMA regardless of who is requesting it. However, the change should bring down overall costs in litigated claims for carriers moving forward.

This article delves into five dynamic strategies, infused with the vibrant essence of glitter and sparkles, that empower individuals to shine brightly on their unique career journey. By mastering the art of understanding their company, thinking innovatively, expanding their brand persona and network, and recognizing when it's time to let their radiance dazzle elsewhere, professionals can pave their own path to brilliance and leave a lasting mark in the corporate galaxy. 1. Comprehensive Understanding of Your Company: To emerge as a star within your organization, you must first unveil the enchanting story that weaves its history and culture. Embark on a captivating journey of research, unearthing not only the past but also the present dynamics that shape the company's unique tapestry. 2. Thinking Outside the Glitter Box: Amidst the sea of conformity, it is your innovative spirit that sets you apart and allows your brilliance to truly shine. Embrace the bold and daring as you transcend the boundaries of convention, for mere adherence to basic metrics is but a faint twinkle compared to the radiance you can achieve. Elevate your value by dedicating time to concoct practical and extraordinary ideas that can revolutionize your organization. Embrace the thrill of risktaking, fearlessly venturing into uncharted territories, and learning from any setbacks encountered along the way. Cultivate a lifelong commitment to advocating for your passions, seizing every opportunity to self-advocate and showcase your unique brilliance. Keep a meticulous work diary that captures not only your progress but also your triumphs, serving as a testament to your luminous journey. 3. Aspire to Be an Innovation Luminary: Within the corporate cosmos, it is your quest for innovation that can transform mere stars into radiant constellations. Uncover the flaws and possibilities hidden within your company, harnessing your unique skillset to paint a sparkling vision of transformation. Illuminate your organization's brand by championing community outreach programs and social causes that resonate with its values. Join notable organizations in your field of specialization, becoming a guiding star that illuminates uncharted territories. Remember, in the realm of social media, the visual is the gateway to enchantment. Let eye-catching visuals tell your story, leaving room for intrigue and captivating the hearts and minds of your audience.
5. Knowing When to Let Your Light Shine Elsewhere: Even amidst the most dazzling constellations, there may come a time when your brilliance outgrows the current stage. Recognize when it's time to gracefully step into the spotlight of new opportunities and plan your exit strategy accordingly. Embrace your worth and put yourself first, for settling for mediocrity or remaining in a toxic environment can dim even the brightest stars. Conduct thorough research, carefully paving the way for a brighter future that aligns with your aspirations. Aim to leave at the peak of your professional standing, ensuring that as one door closes, another opens to reveal even more sparkling opportunities for growth and fulfillment. In the symphony of self-advocacy, infusing your authentic spirit elevates your corporate journey to extraordinary heights. Thriving in a Hated Job: Finding Growth Amid Challenges If you've ever found yourself stuck in a job you dislike, you're not alone. Many people have experienced the frustration and dissatisfaction that comes with being in an unfulfilling workplace. Whether it's due to poor leadership, a toxic office culture, or simply feeling unengaged, being in a job you hate is a tough spot to be in. While you're actively seeking new opportunities, here are some practical tips to help you navigate and find growth in your current situation.
BLOOM MAGAZINE | 75
Improve your situation (if possible). If there are aspects of your job that you can address, take proactive steps to improve them. Communicate openly with your colleagues or superiors about your concerns and explore possible solutions. This could involve seeking clarification on expectations, requesting more challenging assignments, or finding ways to address issues related to poor leadership or a toxic work environment. While not all problems can be solved, making an effort to improve your circumstances can create a more positive work experience. Acknowledge your situation, but don't dwell on it. It's important to recognize and acknowledge your feelings of unhappiness in your current job. However, dwelling on negative emotions will only amplify discontentment. Instead, accept your circumstances and focus on finding ways to improve your situation or cope until you can move on. Remember that this phase is temporary, and better opportunities await you.
Take regular breaks. In a job that brings you unhappiness, it's easy to become overwhelmed and burnt out. Prioritize taking regular breaks throughout the day to recharge and rejuvenate. Step away from your work area, engage in activities that help you relax and clear your mind. Even brief breaks can provide much-needed respite, allowing you to approach your tasks with renewed focus and energy. Make your workday more enjoyable. Find ways to inject enjoyment into your workday, despite the unfavorable circumstances. Personalize your workspace with items that uplift your mood, such as pictures or inspiring quotes. If allowed, listen to music or podcasts that make you feel motivated and positive. Seek opportunities for collaboration or social interaction with supportive colleagues. By adding elements of enjoyment to your work environment, you can make each day more pleasant.
Focus on learning and personal growth. Even in a job you dislike, there are opportunities for learning and personal development. Identify areas where you can acquire new skills, expand your knowledge, or take on additional responsibilities. Seek out projects or tasks that align with your interests and allow you to develop transferable skills. By focusing on selfimprovement, you can make your current situation more bearable while enhancing your qualifications for future endeavors.
Plan fulfilling activities outside of work. When you're unhappy with your job, it's crucial to have fulfilling activities outside of the workplace that bring you joy and purpose. Engage in hobbies, spend quality time with loved ones, exercise, or pursue personal projects that ignite your passion. Cultivating a well-rounded life outside of work will help maintain your overall well-being and remind you that there are fulfilling aspects beyond your current job. BLOOM MAGAZINE | 76
Seek support and expand your network. In addition to the tips mentioned above, consider seeking support from mentors or professionals in your desired field. Networking can open doors to new opportunities and provide guidance during your job search. Attend industry events, join professional organizations, or connect with like-minded individuals online. Their experiences and advice can be invaluable as you navigate through this challenging phase. Remember, being stuck in a job you dislike is undoubtedly challenging, but it doesn't have to define your entire professional life. By acknowledging your situation, focusing on learning and personal growth, improving what you can, taking regular breaks, making your workday more enjoyable, planning fulfilling activities outside of work, and seeking support, you can navigate through this difficult phase. Remember, this is a temporary situation, and with resilience and a positive mindset, you'll eventually find yourself in a more fulfilling and satisfying job.

Explore the lush landscapes, taste exotic fruits straight from the trees, and learn about the island's rich agricultural history. The tour also includes a traditional Jamaican lunch, complete with jerk chicken and fresh tropical juices. Travel Tips: Montego Bay has a tropical climate, so pack lightweight and breathable clothing, sunscreen, and mosquito repellent. English is the official language of Jamaica, making communication easy for English-speaking travelers. Don't forget to try Jamaican cuisine, such as jerk chicken, ackee and saltfish, and patties, which are available at local restaurants and street food stalls. HOW TO BECOME A MORNING PERSON Not everyone finds joy in waking up early, but with a few lifestyle adjustments, you can transform yourself into a morning person. Establishing a morning routine and making the most of your early hours can bring a sense of accomplishment and productivity to your day. If the thought of an early start fills you with dread, fear not! Here are some practical tips to help you find motivation and embrace the beauty of mornings. BLOOM MAGAZINE | 105
Protect Your Sleep for a Fresh Start A good night's sleep can make you feel like a whole new person. Prioritize your sleep by creating a sleepfriendly environment and practicing good sleep hygiene. Consider incorporating natural remedies like ashwagandha, valerian, or oats, which contain tryptophan to regulate your body's circadian rhythms. You’ll wake up feeling refreshed and ready to conquer the day by ensuring a restful night’s sleep. Begin with Meditation Kickstart your mornings with a short meditation session. Spend five to ten minutes sitting quietly and focusing on your breath. Allow yourself to find calm and be present in the moment. When thoughts arise, acknowledge them without dwelling on them, and then let them go. Returning your attention to your breath will help cultivate a sense of peace and clarity that will set the tone for your day. Set a Wake-Up Intention Before you go to bed, make a pact with yourself to wake up earlier than your current wake-up time. Start with small increments, gradually working your way towards your desired wake-up time. For example, if you currently wake up at 8 am and aim to wake up at 6 am, break it down into manageable steps. Aim for 7:45 am initially and gradually reduce it by 5, 10, or 15 minutes each day. This gradual approach makes the transition smoother and more achievable.
BLOOM MAGAZINE | 106
Try Brain Dumping If your mind feels cluttered with thoughts and ideas, try a brain dump. Set aside some dedicated time to write down anything and everything that's on your mind. It could include reminders, stressors, plans for the future, or worries. By externalizing your thoughts, you create space in your mind and feel a sense of relief. Schedule regular brain dumping sessions to maintain mental clarity. Find Inspiration through Podcasts and Audiobooks Start your mornings by listening to inspiring podcasts or audiobooks from influential individuals. Seek out content that resonates with you and aligns with your goals and aspirations. By exposing yourself to uplifting messages, you'll cultivate a positive mindset that can carry you throughout the day. Adjust Your Bedtime Routine The secret to becoming a morning person lies in getting to bed earlier. Aim to have a bedtime between 9:30 pm and 10 pm to ensure you get a solid seven hours of sleep. Establish a relaxing nighttime routine that signals to your body it's time to wind down. Consider activities like reading, taking a warm bath, or enjoying a soothing and organic nighttime tea. These rituals will prepare your mind and body for restful sleep.
Embracing early mornings may seem daunting at first, but with consistency and a positive mindset, you can transform yourself into a morning person. Protect your sleep, practice meditation, set wake-up intentions, try brain dumping, find inspiration through podcasts and audiobooks, and adjust your bedtime routine. By implementing these steps, you'll greet each day with renewed energy and a sense of purpose. Embrace the beauty of mornings and witness the positive impact it has on your life. Remember, taking care of your mind, body, and soul is key to living your best life. By incorporating these habits into your routine, you'll experience increased productivity and overall well-being. Embrace early mornings and watch as your life transforms into a healthier, happier version of itself.

Behind My Notebook Collection Written by Mari Diaz As I write this article, I feel an overwhelming sense of gratitude for the precious collection of notebooks that have been by my side since the very beginning of my business journey. From the start, I understood the importance of writing down my thoughts and experiences. These notebooks have become my trusted companions, storing the memories, lessons, and secrets that have shaped my professional growth.
Each notebook holds a special place in my heart. They are secret treasures that only my eyes can see. If you are wondering why I don't share photos, it's because their covers were carefully chosen, and their pages have become a canvas for my thoughts, dreams, and vulnerabilities. Within their protective embrace, I have poured out my heart, confiding secrets and fears that only the pages can truly understand. The stories that have unfolded in these notebooks are like beautifully woven tapestries, capturing the essence of my experiences.
BLOOM MAGAZINE | 108
The notes, sometimes quickly written and hard to read, serve as snapshots of inspiration, fleeting thoughts, and meaningful conversations. These notebooks have become a safe space, allowing me to express myself fully and document the highs and lows of my journey. And oh, the lessons! The wisdom that has emerged from these pages is like a precious gift. Each note contains a valuable lesson that I have learned through firsthand experience. Some lessons are clear and powerful, while others serve as gentle reminders. They have taught me about the importance of listening, building genuine connections, and staying true to my values.
But these notebooks hold more than just lessons; the scribbles share little details like "this person loves flowers." I've always been someone who enjoys adding a personal touch to show my appreciation for those who help me. It's those thoughtful gestures that can make a meaningful difference in how we connect with others. Whether it's surprising a colleague with their favorite coffee or bringing a small potted plant for the nurse who I met over lunch, these simple acts of kindness can brighten someone's day and create a sense of warmth and gratitude in our interactions. After all, it's the human connection that makes the journey through life more enriching and meaningful. As I reflect on the pages of these notebooks, I am reminded of their immense value. They are not simply collections of paper and ink; they are vessels of growth and truth. They capture the stories, the secrets, and the wisdom that have shaped me both personally and professionally. I encourage you to find solace in your own collection of notebooks. Embrace the transformative power of writing and allow your experiences to come to life on the page. Through the tangible act of writing, our journeys find meaning and permanence—a testament to our growth, resilience, and the beauty of the human spirit. BLOOM MAGAZINE | 109

Written by Mari Diaz In the lively city of Miami, Ari Flores, a single mother and successful risk manager, faced a big decision. Her career had gone well, but she craved new challenges. A top international company offered her a dream job in London, with a salary three times higher than what she earned now. It was an opportunity too good to ignore, but it meant leaving everything she loved behind. Ari's heart was torn - she longed for career growth, but she also cherished her teenage daughter, Lily. As rumors about the job spread, Ari felt both excitement and uncertainty. One evening, Ari sat down with Lily, who noticed her mom's distraction. "Mom, is something bothering you?" Lily asked. Ari took a deep breath, searching for the right words. "I've been offered an amazing job in London," she said. "But it means we'd have to move there." Lily's eyes widened, and her emotions showed on her face. "London? But my friends are all here! I don't want to leave them." Ari felt a tug in her heart, knowing how much Lily valued her friendships. "I understand, sweetheart. It's a tough choice, and I want what's best for us." In the following days, Ari tried to ease Lily's worries, but the decision weighed heavily on her. Lily struggled with the idea of leaving her friends behind. As the decision day approached, Ari was torn. She knew the London job was a golden opportunity, a chance to advance her career and give them a better life. But she also couldn't bear the thought of uprooting Lily from her familiar life. One evening, as they sat on the balcony, Ari tried to talk to Lily about it again. "Lily, I need you to be honest," she said gently. "How do you really feel about moving to London?"
Lily hesitated, looking for the right words. "I'll miss my friends, Mom, but I know this is a great chance for you. You've always put my happiness first. It's time for you to follow your dreams too." Ari's eyes filled with tears as she hugged her daughter. "Thank you, sweetie. You're so mature. I promise your happiness will always come first." In the following days, Ari sought advice from friends and mentors, weighing the pros and cons of each choice. Finally, the decision day arrived. Ari took a deep breath and called the international company. She had made her choice. The next morning, Ari gathered Lily and said, "I've thought long and hard about this, and I've decided to accept the job in London," she said, feeling both excited and nervous. In the next edition, brace yourself for an enthralling encounter as Ari meets her new boss in London. The air crackles with anticipation as she steps into this new chapter of her life. Will the city of London live up to its promises of excitement and opportunities? What challenges and triumphs await Ari in her dream job?
