Pennsylvania, and North Carolina, Biden eventually established a clear lead. Biden’s victory may be less attributed to his own campaign’s ability to energize voters, and more so the incumbent’s tendency to alienate more moderate republicans, such as those residing in the late senator John McCain’s home state of Arizona. The red wall that rose in 2016 was again rattled in Georgia, where 2018 gubernatorial candidate Stacey Abrams led a charge of first-time voters to participate. This came in the wake of her campaign that was hindered by actual voter suppression against predominantly-black communities. Abrams will likely continue to be a necessary force of progress in the years to come. Biden’s victory is historic not in his rare win over a sitting president, but instead the election of his vice-president, Kamala Harris. Harris is the first woman to hold the office and is the first person of AsianAmerican descent to do so as By Daniel Bokemper well. Though she is the first to do so she is not, as she said in her victory speech Saturday evening, “the last.” Harris’s victory could elevate the careers of many other prominent, democratic women including the aforementioned Abrams and U.S. Representative Alexandria Ocasio-Cortez. As of now, Trump has continued to push the narrative of a “stolen election” due to illegitimate ballots. Trump’s legal team has filed lawsuits across several closely-contested states, but without any substantial evidence of fraud, most were dismissed with prejudice. RECAP Not even a pandemic and thousands of statewide power outages can keep Oklahomans from voting. In fact, this year marked the highest voter participation nationwide despite the ongoing challenges presented by COVID-19. Regardless of any baseless claims of widespread voter fraud, the election is over. This is especially true locally, where the sputtering blue geyser that emerged from the 2018 races was harshly plugged. Though it is reasonable to consider these results as a return to the tendencies that have rooted Oklahoma at the dead, very red center of the Bible Belt, local elections were more contested than the raw results would suggest. National races also witnessed what could largely be seen as a series of decisive victories for republicans, as GOP candidates narrowed the majority democrats held in the house while simultaneously holding their senatorial ground. These victories, of course, are bookended by one critical exception.

infrastructure that Hiett’s reelection coincides with one of the largest power outages in recent memory. Hiett is expected to continue his advocacy for the state’s fossil fuels industry, specifically its existence on tribal land.

U.S. SENATOR Incumbent Jim Inhofe defeated democratic challenger Abby Broyles by one of the widest margins in the state. This victory emerges despite what could be considered a mostly useless incumbency at best, and a destructive term at best. Given Inhofe will be 92-years-old by the time his new term concludes, there is a chance this could be his last. Broyle’s campaign was powerful, but it may have leaned too much on criticism of Inhofe, many of which fell on deaf ears to traditionally straight-ticket voters. It is harsh to fault Broyles for identifying the incumbent’s inadequacies, though in the absence of a debate, this strategy likely did little to persuade republican voters. However, Broyles did well to explain as is, Oklahoma’s primary industry is unsustainable. This is, hopefully, far from the end of Broyle’s career, as her focus on agriculture could ensure the state’s long-term health. Afterall, an Inhofe-sized vacancy may be closer than one would expect.

U.S. REPRESENTATIVE, DISTRICT 05 In an upset, democratic incumbent Kendra Horn was defeated by republican challenger Stephanie Bice. This race was one the most watched nationally, as Horn only won her seat from GOP control in 2018. This victory adds to the five seats republicans are projected to win as a result of this election. This seemed almost inevitable, as Horn’s previous victory was secured by one of the narrowest margins, forcing republican strategists to take aim at her incumbency. Bice’s campaign was leveraged most by her support of Oklahoma’s oil and gas industry and the fear Horn would parrot Nancy Pelosi. Though Horn’s voting record indicates that she does support the oil and gas industry, such as her noted opposition to fracking bans, the rest of her track record does parallel centrist, democratic alignments. Horn’s campaign cited the need for additional federal aid and continued support for the state’s educators. Bice will, presumably, will act in line with the expectations of Governor Kevin Stitt.

Democratic incumbent Collin Walke was re-elected in a decisive victory over republican challenger Valerie Walker. Walke ran unopposed in 2018, posing the question of whether or not his support would hold when faced with an opponent. Walke cited his track record of authoring several implemented policies, most of which related to courtroom staff and legal issues reflective of his career as a litigation attorney, as the primary reasons for his victory. Moving forward, Walke is expected to tackle meaningful criminal justice reform, as his major contributions on that front have yet to be seen. Unlike many of his republican colleagues, Walke’s acknowledgment of Oklahoma’s systemic incarceration problems may be, at the very least, a step in the right direction.

COUNTY CLERK Republican David Hooten defeated democratic newcomer Christina Chicoraske. Though the race was closer than anticipated, Hooten still secured approximately 60% of the vote. During his campaign, Hooten promised to continue modernizing the clerk’s office while protecting conservative values. Not unlike Abby Broyles, Chicoraske built her platform on accountability and transparency within the clerk’s office. Given her continued role as the city’s Water Conservation Coordinator, Chicoraske is expected to continue championing civic causes.

COUNTY SHERIFF Republican Tommie Johnson III defeated democrat Wayland Cubit in a close race. Regardless of victor, this election yielded an historic first for Oklahoma county: A black sheriff. Though openly conservative, Johnson has expressed a need to rejuvenate the sheriff’s office. Johnson feels the office needs to evolve into something productive, rather than the “anchor” that it has been for several decades. In a year where tensions between the community and police have been at an all-time high, Johnson notably does not acknowledge systemic racism within the police force. It can be difficult to believe in meaningful reform when one of the most pertinent and harmful aspects of the police is disregarded.

COUNTY COURT CLERK Republican incumbent Rick Warren defeated democratic challenger Charles De Coune. Notably, almost all in-person votes cast on Tuesday favored Warren, leading to his 57% victory. While there is some indication that Warren’s tenure may have ended due to what many con6

sider his recent misuse of CAREs Act funding, opting to send $40 million in aid to state prisons, most voters did not consider this a point of concern. The implication of Warren’s reelection means the clerk will make more decisions regarding aid that is almost certain under the first year of Biden’s presidency. The hopes this funding will be used for Oklahomans in need, especially at the height of the state’s COVID infections, are extremely dim.

JUDICIAL RETENTION All eight of the supreme court justices and judges up for retention secured the votes needed to maintain their respective offices. Matthew John Kane IV, the most recent conservative justice appointed by Governor Stitt in 2019, notably retained. These results reaffirm the notion that very few judges lose their position outside of retirement or resignation. With the exception of Tom Colbert, Oklahoma supreme court will remain predominantly conservative. Though criminal justice reform is necessary for the state, judiciary backing is unlikely.

STATE QUESTIONS STATE QUESTION NO. 805 Designed to eliminate the sentence enhancement for non-violent felony convictions, this state question failed to pass. Those against the question suggested that eliminating sentence enhancement would encourage criminals to repeat their crimes due to a lack of meaningful punishment. They further suggested in Oklahoma, several forms of domestic abuse and sexual assault are not considered “violent,” and would thus circumvent sentence enhancement. However, there is no clear indication that such repeat offenders wouldn’t suffer a more severe, subsequent sentence depending on the severity of their crime. This question was not inherently retroactive, so already incarcerated individuals would have still just as difficult a path as they do now for shortening their enhanced sentences. Unfortunately, the continued use of sentence enhancement will likely only increase Oklahoma’s bloated prison population. This vote seems to echo the sentiment that as a whole, criminal rehabilitation is not a priority for most of the state. As other failed attempts at mass incarceration have shown, locking up an individual indefinitely does not eliminate crime, but instead compounds it.


STATE QUESTION NO. 814 Oklahomans voted “no” in response to this state question as well. The less impactful of the two, 814 sought to reduce funding sent to the Tobacco Settlement Endowment Trust (TSET) and instead channel that funding into Oklahoma’s Medicaid program. One reason this question likely failed to pass was that the specific use of this funding surplus was never clear, whereas the applicable uses for the funding with the TSET are more or less explicit. Additionally, this funding was not expected to fully cover the state’s anticipated medicaid expansion, likely funding less than half of the resources needed for Medicaid’s target growth of 10%. There was a rising concern that this funding could have been used for something other than Medicaid expansion. Though this concern has been addressed ad nauseum by legislators, voters did not appear to be swayed. However, if Medicaid is not successfully funded by some means, this can severely offset other sectors, most notably education.

PROPOSITIONS MODIFICATIONS TO THE STATE CHARTER All nine of the propositions present on the ballot were passed, yielding several necessary updates to Oklahoma City’s charter. Among them includes Proposition 7, which changes the term “councilman” within the charter to “council member” or “councilor.” Though seemingly insignificant, this revision is crucial for women and nongender conforming individuals seeking to participate in local politics. Among the measures passed was also Proposition 5, which will expedite the mayor and councilors’ ability to provide feedback to the City Manager about city employees. This modification will, ideally, elevate effective personnel while disciplining lame ducks. This perhaps goes hand in hand with the final measure passed, Proposition 9, that rephrases the charter to prohibit potentially exploitative transactions.

REFLECTION It should not be a surprise Oklahoma as a whole voted the way it had, though the 2016 and 2018 elections led some to believe the metropolitan areas would remain blue. However, it was projected as quickly as Wednesday morning that any democratic rumblings in the state have been muffled. However, GOP strategists would be wise to continue to monitor District 5, as Bice’s incumbency is far from guaranteed. Fresh faces in the state’s senatorial race are almost certain in the next decade, provided Inhofe does not run as a centenarian.

Perhaps the most important takeaway is, despite a myriad of natural disasters, democracy is still alive. Still, the comments of the outgoing president negate much of the optimism brought by this year’s historic voter turnout. Many have rightfully questioned the relevance of the electoral college, as it often attributes more value to geography rather than an individual voter. Yet, when the process of voting as a whole is doubted without cause, there are few paths that do not end in violence.

It was a rough week for anyone to the political left of Benito Mussolini. While Joe Biden won the election by a wide margin of the popular vote (a fact will not change no matter how many tweets or temper tantrums hit the news cycle) in a rebuke of President Donald Trump’s recklessly ignorant tenure in the White House, it certainly was not the crushing defeat many predicted. Democrats narrowly held control of the House of Representatives and still stand to pick up a majority in the Senate in Washington, D.C., but here in Oklahoma, the right wing dutifully turned up to cast their ballot for a man who barely campaigned and could not be bothered to show the respect for his challenger to even show up to a debate.

Republicans also flipped back a House seat previously snatched by Kendra Horn for a single term. Mayor David Holt even came out of his burrow to congratulate Representativeelect Stephanie Bice, but promptly got scared of his own shadow and retreated, which means six more weeks of abandoned leadership for Oklahoma City. Statewide, Trump beat out Biden two-to-one and took super-spreader rally ground zero Tulsa by a fifteen-point margin. But here in Oklahoma County, he only held the lead by one percentage point and a hair more. You heard that right. The un-American, un-Oklahoman socialist liberals have all but taken over the state’s capital. Maybe things aren’t all bad here after all.

ICE, ICE BABY

Well, 2020 certainly has no shortage of surprises, and what better way to further fray the narrow band between reality and a mass psychotic break than a freak ice storm knocking out electricity to half a million customers during the first cold snap of the season. OG&E stood back as tree limbs and their infrastructure came crashing to the ground, a painful reminder of all the maintenance they didn’t do since the last major ice storm brought tree limbs and their electrical infrastructure crashing to the ground. If those who forget the past are doomed to repeat it, OG&E is condemning the rest of us to its blunders for two miserable weeks once a decade for the rest of our lives. Unfortunately for us all, it happened during a once-in-a-century pandemic that doubtlessly seeded community spread as

people scrambled desperately around a ghost city in search of light and heat. And they can’t blame the short-term memory loss on the passage of State Question 788, because, while they can’t seem to find the money for infrastructure upkeep, they somehow found $25,000 in the sofa cushions to oppose its passage in 2018. And of course they could find an extra few hundred thousand the next year to increase the compensation package of CEO Sean Trauschke to more than $6.4 million, or the cost of more than 20,000 cheap electrical generators that could have been supplied to the city’s neediest customers. But hey, these are just human lives at stake and, really, what’s tens of thousands of grandmothers shivering in the dark worth compared to the needs of the shareholders in a public monopoly that perennially fails catastrophically anyway?

NOV 21, 28 & DEC 5, 12 AUTOMOBILE ALLEY Cruise down historic Automobile Alley for the district’s holiday open house and its stunning light display at the 5th Annual Lights On Broadway event! To make the event as safe as possible and decrease sidewalk and in-store congestion, the event will be spread out over four Saturdays this season: November 21 and 28 and December 5 and 12. Each Saturday from 4-8pm, various retail shops and restaurants will feature buzz-worthy window displays in addition to family-friendly activities, special promotions, and giveaways. Holiday Pop-Ups Outdoor Market

Oklahoma’s medical cannabis program requires the testing of products before they hit dispensary shelves, but with a loose regulatory framework, patients still cannot be sure that the products that they are consuming are actually what is represented by provided results. In fact, one of the state’s most prominent cannabis laboratories chose to surrender its license after the Oklahoma Medical Marijuana Authority moved to revoke it due to fabricating test results, court records show. Kyle Felling, the former public face of F.A.S.T. Laboratories, claimed to be the owner and operator of the lab to the OMMA, but apparently has been an Arkansas resident during operations, according to the license revocation application filed by the state. F.A.S.T. stood for Felling Analytical Services and Technology. “All toxicology testing data, which includes testing data for microbials, heavy metals, residual solvents, and pesticides, went through Mr. Felling on QBench even though Mr. Felling was typically in Arkansas and uninvolved with the actual testing of samples. In other words, Mr. Felling was the one who would complete and publish COAs in the system that would then be reported to FAST Labs’ clients,” the application states. On June 16, 2020, the Department received an anonymous complaint that Respondent, and specifically Mr. Felling, was falsifying cannabis test results. An investigation was initiated. On June 19, 2020, OSDH performed an onsite investigation of Respondent’s medical marijuana laboratory to review records, system software, and samples. The purpose of this investigation was to investigate falsified laboratory reports produced by Respondent and other reporting inaccuracies and testing violations. During the June 19, 2020, onsite investigation of Respondent’s medical marijuana business, OSDH learned of instances where Mr. Felling had entered a completed status on medical marijuana samples prior to conducting any testing on those samples in violation of [state statute]. Moreover, OSDH also found multiple instances where Mr. Felling had fraudulently changed raw testing data to ensure a passing testing result, and the passing result was reported on a [certificate of analysis] to FAST Labs clients without further testing being done. During the June 19, 2020, onsite investigation, Mr. Felling himself admitted to OSDH investigators that he had altered microbial and heavy metal results that were reported on COAs. Mr. Felling did not retest the samples that he altered. Upon information and belief, Mr. Felling would frequently report residual solvent results prior to testing ever being completed. This became more common when Respondent’s instrument that tested residual solvents went down for a period of time in April or May 2020 and there was a backlog of testing for this analyte,” the application states.

It is unknown how long the lab had apparently been altering test results. They were one of the first to be operating in the state. “Throughout the investigation, Petitioner has performed numerous onsite visits of Respondent’s medical marijuana business. The investigation revealed widespread, flagrant, continuous and willful violations that place the public’s health and safety at risk, including evidence that Respondent fraudulently manipulated testing data, completed and reported COAs that showed the test samples did ‘PASS’ without having supporting testing data, and failed to implement and/or adhere to basic standard operating procedures to ensure the integrity of the testing process. Medical marijuana patients rely on licensed medical marijuana testing laboratories to properly test the medical marijuana and medical marijuana product samples to ensure what is being consumed and/or inhaled is safe,” according to the application. Samples that had received passing results from the lab were found to contain levels of lead, salmonella and staphylococcus, or staph, that exceeded legal thresholds for safe consumption, according to the OMMA’s application. Fast Laboratories of Oklahoma City, LLC surrendered its license on Sept. 23. The owner on the surrender form is listed as Mary Roberts and the reason given was “disputes among members of closely held management company made continued operations undesirable,” the surrender of license form shows. Felling is not named on the surrender form. OMMA spokeswoman Terri Watkins said the investigation into the laboratory is ongoing, though fines cannot be assessed since the company’s license was surrendered, she said. But products failing product testing are still making their way onto dispensary shelves. On Nov. 4, the OMMA announced another recall, this time vape cartridges manufactured by Empire Strains, LLC and KushCandy 420, LLC. “The products being recalled are vape cartridges labeled as Empire Strains or Ju·Ju that show Batch Number 153, Lot A on the labeling. Medical marijuana products labeled as Empire Strains or Ju·Ju that show Batch 153, Lot A have failed required testing and may not be safe for consumers,” the recall notice states. No further information on what prompted the recall was immediately released by the OMMA. However, the authority’s laboratory oversight manager said that upcoming changes to how the agency tracks cannabis plants and products as well as updated and strengthened inspection protocols should lead to more patient confidence in the certificates of analysis that will be available for their inspection before purchase. “We have executed the contract with the quality assurance lab,” Lee Rhoades said.


g still problematic “One of the first orders of business that we’ve undertaken with them, and it’s a process that’s underway as we speak, standard samples have been sent to each of our licensed laboratories in which they’re all testing for the same thing off of the same sample and we’re going to get their results back and see what the central tendency is, see who it is that’s perhaps aways out from the central results that we get and that will help guide us in making some decisions, certainly not to be punitive, but to try and figure out why we would have a dispersion of results around something that we have a target value for,” he said. To do so, they have purchased hempbased “certified reference materials” with a reconstitution process and are using manufacturer guidelines. “As time goes by, we may look into using actual retained marijuana samples and do the same thing because sample preparation has a large effect, obviously, on the quality of your result. Right now, we’re really trying to see, if we take that off the table, what kind of results are we seeing from each labs for just a simple analytical portion of what they’re doing?” Rhoades said. They plan to test the labs at a minimum of three times a year to make sure all of them are presenting results within the same range. “We will kind of let the data guide us to see if we need to do that more often. And we always have the authority to do more along with interlaboratory comparisons as we see fit. Kind of the flip side of the coin on that is we will also be testing from various sources the same sample batches that the labs are on an individual basis and just kind of comparing results from that. Kind of going from dispensaries working our way back up upstream just so that we could see if the certificate of analysis that was produced correlates with the results that the QA lab gets,” Rhoades said. In other words, there will be mystery shopping and result comparisons. “When growers and processors have samples sent to the laboratory for testing, you’re supposed to create what’s called a primary sample and as well as a secondary sample, a reserve sample, that will be created out of the same homogenization process as the primary. And then you’re required to store that reserve sample in a manner that keeps it from being contaminated or degraded. And we will also be testing those so we can compare head-to-head off of essentially the same sample what the laboratory got and what the QA lab got. Of course, we will rely heavily on the QA lab’s technical expertise but those of with the lab program in the OMMA will be reviewing those results as well,” he said. Demeter was chosen as the quality assurance laboratory through a competitive bidding process. “We created a set of criteria of deliverables that we wanted and asked them to respond with how they would implement those things. Asked for a number of things

such as years of experience from your director, your analytical staff, recommendations from other people that have used your services specifically in the Oklahoma marijuana industry. We had a number of technical specifications we requested such as throughput, whether or not you possessed ISO 17025 accreditation or not. Demeter has actually had their accreditation since early 2019 before it was even in any of the requirements for laboratories. They went ahead and got it on their own,” Rhoades said. By the end of December, OMMA anticipates having a data-based operation plan in place that has everyone “singing from the same sheet music, so to speak,” he said. Rhoades and the laboratories already operating have had an ongoing dialogue for over a year and has actively solicited opinions and feedback as to the direction that the industry should head. While 2020 should see more of a streamlined process as Demeter and the Metric seedto-sale program are put into place, it is still an ongoing process and one that will never be flawless 100 percent of the time. “I’m well aware that even the best of labs can have an issue from time to time. I’ve been in the lab world for 40 years and so anybody that says they never have a problem just hasn’t been in the business very long at all. So we’ve opened it up and made it a little bit easier for growers and processors to understand how and when to retest and how to interpret those results. We’ve also opened the door a little bit more on what we call remediation but we’re also calling some things decontamination. What you can do, for instance, when you fail a microbial test, and your repeat testing confirms it so we’ve not shut down those supply channels by opening other avenues of ways to still be able to transfer or sell that product,” Rhoades said. Pesticide detection and heavy metal detection are not currently allowable for remediation, he said, but the next legislative session will hopefully result in more remediation guidelines. Microbials and residual solvents can now be remediated, but pesticides and heavy metals have not been clearly shown to be able to be successfully remediated, he said. “We have to keep in mind that particularly for people that inhale marijuana, you basically bypass all of your body’s defense mechanisms and it’s different than ingesting it, so we have to keep that in mind with our stance on whether or not this stuff is in there,” Rhoades said. While the process is still fallible, dispensaries are required to have certificates of analysis available for patients to request and inspect, Watkins said. “We want patients to look at those certificates of analysis and know the product they’re getting and where it came from,” she said.
