This years National Aboriginal Day event was held at Komasket park. The day started off with lots of sunshine, pancakes, and sausage. The breakfast was hosted by chief and council.

To open the day, there was a welcome from Allan Louis and prayer from Patricia Gregoire and some hand drumming.

The first event of the day was the annual Run for the Drum. The runners ran from the ball park to the first set of cattle guards at the Daycare all to way to other cattle guards beside Public Works and back for a total of 2.5kms.

The next activity for the day was the Okanagan Nation Transition Emergency House Amazing Race.

The family based event had a bannock making station, a dress up station, spear throwing station, and some obstacle courses.

At 1pm the bingo cards came out. A few games were played until the rain and thunder came rolling in.

Everything was taking down fast with the help of everyone pitching in, and then food was moved to the HOL hall.

The storm didn`t hinder the day as a lot of people showed up for dinner and it got to point where there were almost not enough chairs. During the dinner

many door-prizes were given out, and some special acknowledgments were addressed as well. Cathy Gottfriedson, Sherry Louis, Glenda Louis, and Sharmaine Gregoire were all gifted Pendleton towels for all the hard work that they do in the community and for volunteering so generously in the past on National Indigenous Day. This year was a success, and it couldn`t have been done without all the planning and hard work from the many volunteers, thank you. Also thank you to Pierre Richard and Derek Campbell for helping to make the drums and to Ron Felix and Roddy Gregoire for taking care of the water stations during the run for the drum.

OKIB Colonial Reserve Specific Claim - Negotiations at an Advanced Stage 1. Colonial Reserve Specific Claim

As discussed in earlier briefing documents, this specific claim relates to a reserve that was set apart for the Okanagan Indian Band in 1861 by the Colony of British Columbia. The reserve contained a considerable piece of what is now Vernon. A few years later, the Colonial government changed its mind and unilaterally cut the reserve back. The Okanagan Indian Band did not consent to, and never was compensated for, this illegal reduction of the Colonial Reserve.

In 1877, the Joint Reserve Commission returned a portion of the cut off colonial reserve lands and extended the reserve to include additional lands to the north and west of Lake Okanagan. That allotment failed to return a significant portion of the most valuable reserve lands included within the original

Colonial Reserve.

In 2003, the Okanagan Indian Band filed an extensive specific claim seeking compensation for the lost reserve lands. In 2011, Canada accepted this specific claim for negotiation. After seven years of active negotiation, the claim is now moving into the final stages of the negotiation process. Our goal is to push hard to have Canada make a settlement offer to Okanagan Indian Band within one year. Provided that we can obtain an acceptable settlement offer from Canada, the claim will then come before the full membership for a ratification vote.

2. Confidentiality

The OKIB Council is committed to keeping members informed with respect to this significant specific claim. While we know that it is very difficult to keep news of a claim of this magnitude confidential, we urge our members not to discuss this specific claim with anyone other than members or staff of OKIB.

Control of information is important and breaches of confidentiality could interfere with our ability to settle this claim. That would be hugely disadvantageous to OKIB and its members.

We urge members to think about and discuss this claim, but only with members and staff of OKIB.

3. The Specific Claims Negotiation Process

As set out in earlier briefings to the community, the specific claims process was established by Canada to allow First Nations to obtain a negotiated resolution of certain historical grievances without resorting to the courts. The specific claims negotiation process is partially supported by loan funding. It is far less expensive than litigation. Most significantly, in the specific claims process Canada is prevented from invoking limitations or other time-based defences (which Canada would vigorously advance if the claim was before the courts).

The Okanagan Indian Band has experience with specific claims. We settled our Cut-Off Specific Claim in 1984 and our Boundary Specific Claim in 2002. If successfully concluded, the Colonial Reserve Specific Claim settlement will be far larger than either of the Band’s earlier specific claims settlements. We will only know the dollar value of the specific claim once the negotiations with Canada have been completed.

4. The Negotiations to Date

Most Colonial Reserve specific claims filed to date have been rejected by Canada. Having Canada accept the Okanagan Indian Band’s specific claim was a real achievement. What it meant, however, was years of intensive, and sometimes frustrating, negotiations with Canada. While the process has been slow, we have made a lot of progress on the range of negotiation issues that Canada has brought forward.

The following have been the key issues in negotia-

tions to date: a) The Boundaries of the Colonial Reserve The Colonial Reserve sketch map showed the location of the reserve in general terms. Unfortunately, various aspects of the map were not to scale or were otherwise geographically faulty. At the time, the reserve would have been marked out clearly for all to see. Reconstructing the exact boundaries after 170 years, however, has been a challenge.

The most contentious issue has been the exact location of the southeastern corner of the Colonial Reserve. Canada has proposed a location that would exclude from the Colonial Reserve a critical segment of the valuable lands that now form part of Vernon.

Through a combination of experts from several disciplines, archival documents, and oral history, Council has strengthened the Okanagan position on this corner point. We are reasonably confident that we have now established the Colonial Reserve boundaries sufficiently to advance the negotiations to a conclusion. b) Valuation An important part of the negotiation process is obtaining expert opinions about the current value of the lost land and the value of the revenues that would have flowed to the band over the years had the lands not been excluded from our reserve base.

We have made great deal of progress on the valuation issue and are at a point where Canada feels that it has sufficient evidence to seek a mandate to make a settlement offer to the Okanagan Indian Band.

One of the most contentious parts of valuation is the question of how to bring forward historic losses to today’s dollars. Obviously, a thousand dollars that was owed in 1870, for example, was worth far more than a thousand dollars today. In this claim, the historic losses need to be brought forward for each

and every year between 1865 and today. Recent legal rulings have rejected Canada’s traditional (and conservative) approach for bringing forward past losses.

Canada is struggling internally to develop a new policy for bringing forward past losses that will apply to specific claims across the country. The resolution of this issue at a national level will have a major role in determining the dollar value of the settlement of our claim.

5. Conclusion

After many years of negotiation, this claim is finally reaching the stage where Canada’s negotiators will seek a settlement mandate. Economic Development Economic Development Update Many Indian Bands experiencing successful economic development have a professionally run corporate structure. These structures are set up as non-taxable entities that remove the liability from the Band and place the liability to the businesses set up within the corporation.

The Band Council has given direction to set up a professionally run corporation that will separate the Band Governance from the Business Governance. This corporate structure will act as an umbrella company or holding company which will hold multiple companies within it.

This will lead to an improved investment climate for the OKIB, which in turn will lead to higher revenues and allow our community to operate at the speed of business.

The Economic Development Team

Andrew Leach was hired by the Band Council as the Economic Development Consultant to assist OKIB in getting set up for successful economic development. Andrew has a PhD, Masters and Undergraduate degrees all in business and comes with extensive experience in economic development and interim management. While Andrew was in the role of interim executive director, he identified the organizational gap in economic development.

The responsibility of economic development was shared by several employees in addition to their existing roles which limited the time to focus on this important goal.

This gap is a barrier to create businesses that would be able to compete for bids on project contracts in Okanagan (Syilx) territory, which would increase revenue and provide new economic development opportunities.

Jenelle Brewer will be supporting Andrew to complete this work in the role of Economic Development Coordinator. Jenelle completed her Bachelors of Business Administration in Management at Okanagan College and holds a Diploma in Marketing and has been working for

the Band in numerous capacities over the last four years including proposal writing, project management, reporting, economic development, policy development and has served on Council for two terms. Jenelle has the knowledge of the work completed so far that will support the goals of the economic development team.

Joining the Economic Development team as a research assistant over the summer is Justen Peters. Justen has recently graduated with his Associate of Arts degree, and he has also acquired post-secondary entrepreneurship/ business training from the A.C.E. program with the University of Victoria. As an avid traveler, Justen spent 4 months in rural Uganda, visited the Maori of New Zealand, and partook in an independent research trip to Dubai to study the economic development practices of the U.A.E. Justen intends to further his education and career in Economic Development and appreciates this opportunity as a valuable step towards helping First Nations achieve economic prosperity through meaningful business practices and community health.

Board of Directors

A recruitment process will take place over this summer to find independent professionals who are business experts.

The Band Council will develop an Economic Development Strategy that will guide this Board of Directors when they are making business decisions. The strategic plan will be developed based on the opportunities available through our Title and Rights, and viable industries in the area. A qualified candidate for the Board will have the following experience: • sitting on a corporate Board; • senior level management experience;

a financial or legal background; experience working with First Nations; and a track record of successful startup companies.

The Strategic Plan

A strategic plan identifies priorities for the Board to follow with guiding principles identified by the Band Council; from the strategic plan, an action plan is created.

An example of a “Strategic Goal “would be Land Development; the action plan will complete studies on a property that would be suitable for development. The existing economic development strategic plan is outdated and needs to be revised because it is eight years old. A strategic plan will provide direction for the Board of Directors to identify key economic development activities relevant to the local and evolving industries’ opportunities.

Asset Transfer

One of the steps that will take place is an asset transfer process, which takes existing corporations and other responsibilities from the Band to the corporate structure.

This includes identifying what responsibilities the corporate structure will take over from the Band as well. This may include the existing forestry company, property such as Sun Valley Ranch and duties may include annual reports for the corporation. It is important the asset transfer be done correctly so that OKIB can maximize its ability to maintain a tax-free status.

The Corporate Structure

In the first level, OKIB “the Band” is the top circle and is the Limited Partner or “LP” to the OKIB Holdings Incorporation (Holdings Inc.). The Holdings Inc. is the General Partner or “GP” to the Band. The General Partner will be responsible for overseeing the businesses in the corporation on behalf of the Band.

This means the Band is not liable for the operations in the Corporation. If the Band were liable, it would mean that the Band would have to cover any losses by the corporation and it would be at a financial risk. However, the Corporate Structure prevents these risks from harming the Band’s financial health.

The next level in the Corporate Structure is how the businesses under the Holding Inc. will operate. In this level, the Holdings Inc. will become the “Limited Partner” or “LP” and the business that are developed become the General Partner or “GP”. The Holdings Inc. will be protected from liabilities of the Businesses that operate under it.

Each business that is developed will have its own name and corporation to protect each company from the others.

If one business fails or loses money, the other businesses are protected. This structure is important because if one of the businesses were to lose money it would not affect the Band’s cash flow because it is separate from the Corporation. Each of the corporations will have their own Board of Directors, each of these Boards would have some members from the Holdings Inc. Board of Directors.

Cultural Immersion School June Report

Way’ Another school year is rapidly coming to a close and it appears to have been a very successful year.

We will be sad to see our grade 7 grads leave, but excited as they move forward with their lives and their school careers. This will be a large group we are sending to the District and we are sure they will be very successful.

We had an enjoyable time at the OKIB Wellness Fair

The Year End Field trip on June 13, 14, 15 was very successful. Especially all our visit to the Secwepmc Museum & Heritage Park plus BC Wildlife Park. The trip ended with activities culminating in the Traditional Games in Merritt.

On June 19 our grade 6 and 7 students got to participate with Dr. Brigman and Mariel Belanger in learning about the work that he does in recovering Interior Salish Implements. In this case they watched the launch of a Salishan Sturgeon Nose Canoe that he had built at the New Horizons Building. Some of our students had the honour of riding in the canoe.

Summer Learning (Literacy) Program

We have again applied for the Summer Learning (Literacy) Program and we have been approved. We will have a program running for 125 hours this summer to support our primary literacy leaners who struggle. Mrs. Saddleman Joe and Mrs. Mihalcheon will be our summer instructors. This program is for OKIB CIS and Daycare students grades K to 3.

BC Government – NEW Child Care Initiatives

Our application has been approved by the Ministry of Children and Family Development for the Child Care Fee Reduction Initiative. This has enabled us to reduce the parent fees that we charge for daycare.

On September 1, 2018, the new Affordable Child Care Benefit (ACCB) will replace the Child Care Subsidy Program. This means that child care will soon become even more affordable for thousands of B.C. families.

Starting in June, parents receiving a Child Care Subsidy will be receiving a letter in the mail about the new ACCB and what they need to do to qualify for the new program.

You may see some minor changes to forms; however, there will be no significant changes to the way claims are submitted and you do not need to update care arrangement forms where a benefit plan is already in place.

The new Affordable Child Care Benefit will increase savings for parents whose children are in licensed infant and toddler care, beginning in September 2018. Where the existing subsidy benefits families with incomes of up to $45,000/year, the new benefit is available to families with incomes up to $111,000/year.

Families with children attending full-time licensed child care and who have pre-tax incomes of $45,000 or less per year will receive the full benefit, up to the cost of care (a maximum of $1,250/month), while those who make up to $111,000 will receive a reduced amount, according to how much they earn and the amount of care required.

Parents will be asked for their consent to collect their Canada Revenue Agency (CRA) income records to determine their eligibility for the benefit. This represents a faster, easier way to confirm eligibility than under the current Child Care Subsidy Program, and is consistent with how other government benefit programs, like Provincial Pharmacare, confirm income information. If parents have not filed taxes with the CRA, an alternative mechanism for determining their income will be available.

The letter also explains that if parents have a current benefit plan approved for September, they will receive a replacement benefit plan letter in August. Child care providers will also receive a copy of the replacement benefit plan letter. If parents who currently receive a subsidy do not have a benefit plan approved for September, they will receive a letter in August with instructions for how to complete the easy online renewal.

More information is available on the website at www. gov.bc.ca/childcarebenefit, including the steps parents need to take to transition to the new ACCB. Beginning in July parents will also be able to view the new ACCB rates online and estimate how much they may be eligible for.

Summer Day Camp for 6 to 12 Year Olds

• Session 1 Monday, July 9 to Thursday, July 26 • Session 2 Monday, July 30 to Friday, August 17 (closed August 6 for BC Day) The Summer Day Camp is a fun recreational program with a focus on outdoor play and sports, a weekly field trip, arts and crafts and cultural activities. A morning and afternoon snack is provided. Children bring their own lunch and any extra healthy snacks. We encourage everyone to drink lots of water and to wear sunscreen and a hat every day.

The fees for each 14 day session are $112.00 for status children and $182.00 for non-status. Fees must be prepaid in full before children can attend any days.

Visit our back yard and playground to see the changes.

All of the cottonwood trees had to be removed because they were becoming unstable in the wind and the roots had caused a lot of damage to the surfacing, bike path and equipment. We are now challenged to find shade. We hope to have some new trees planted outside of the fence that will provide shade over time. We will need trees with a root system that will not destroy our playground. In the meantime, we will be purchasing some large umbrellas.

Infant/Toddler Daycare

We have been enjoying the nice weather, all the children are enjoying all our outside time, with that being said please make sure they come prepared for the warmer weather! We wear hats everyday so please send your child with one, also a change of clothes for water play and please apply sunscreen before coming in, we will reply for afternoon play. We encourage lots of water drinking so a water bottle that your child can leave at the Center will be greatly appreciated!

We have been seeing tons of changes at the Center over the last little bit, and the children have been able to observe all the work and are super excited to talk about all the equipment and workers! She is originally from Victoria. She moved to the Okanagan recently with her family and is happy to be raising her child in this beautiful land. Jane has experience working with the Ministry of Children and Families and the school system.

Her outstanding navigation skills, advocacy skills and values regarding family and community make her an excellent addition to the Wellness team.

Stim Aspuus Health and Wellness Fair

The wellness fair at Komasket park on July 8-9 was a success.

There were two pancake breakfasts to help fundraise for the Cultural Immersion School and the Taekwondo group. Many vendors such as massage, vegan cosmetics, horse therapy, osteopath, Vernon Friendship Society, and many more showed up.

The first OKIB wellness fair couldn’t have been done without the help of the many volunteers. OKIB LANDS AND THE ENVIRONMENT

Environmental Site Assessments (ESA): Activities on Okanagan Indian Band reserve lands must be carried out in an environmentally responsible manner. Land instruments may only allow land uses or activities that are consistent with the environmental condition of the subject parcel of land as determined through an Environmental Site Assessment (ESA).

Land instruments may be defined as designations, permits, leases, land transfers, etc.

In late 2016, Teranis Consulting Ltd was engaged to update and verify any findings on the previous Phase 1 Environmental Site Assessments (ESA) on all Okanagan Indian Band reserves. As ESAs have a shelf life of 5 years and the previous Phase I’s were conducted in 2011. The objective of the project was to update and verify the findings of the 2011 ESA and determine if there have been any changes in existing land use and if any additional potential contaminated sites needed further investigation. As part of this process, the community was engaged through 2 community meetings. Site inspections were conducted where possible and other reports were reviewed.

Teranis clearly lays out that the Information in the ESAs should not be relied on solely to assess the environmental condition of the land. There may be other information which was unavailable at the time of the assessment.

In the near future the OKIB Lands webpage will be updated with links to the ESAs. There are some resources available to members which might be helpful including: • Fill Management on First Nations Lands: An Environmental Consultants perspective.
