GEORGE TENREIRO LGBT IMMIGRATION ATTORNEY
The LGBT community had much to celebrate this Fourth of July, including in the area of LGBT immigration rights. Odyssey interviewed George Tenreiro, an LGBT immigration attorney, who is experienced in asylum cases based on sexual orientation. We also interviewed one of his recent asylum clients, Da CucKoo, a Brazilian national who has reemerged on the NYC drag scene now that she is allowed to stay and work in the US. FIRST, MR. TENREIRO, PLEASE TELL US ABOUT THE DOMA DECISION AND WHAT IT ALL MEANS. The Supreme Court’s striking down the Defense of Marriage Act (“DOMA”) on June 27 was an historic decision because it went further than any previous Court decision in recognizing LGBT rights in general, and same-sex marriages in particular. The Court made clear in very favorable and broad language that every married same-sex couple is entitled to all of the same federal rights afforded to their married heterosexual counterparts. This includes immigration rights, and, so, for the first time, the US will begin to accept legal permanent resident (green card) petitions based on same-sex marriages. The future will tell us the full impact of the decision, but it clearly signals a new day for LGBT recognition and rights in the US. WILL SAME-SEX MARRIAGES BE RECOGNIZED IF THE COUPLE WAS MARRIED IN ANOTHER COUNTRY, FOR EXAMPLE, CANADA? Yes. WHAT ABOUT IF THE COUPLE WAS MARRIED IN ANOTHER ODYSSEYMAGAZINE.NET • JULY 12-25, 2013
COUNTRY OR STATE BUT NOW RESIDES IN A STATE THAT DOES NOT RECOGNIZE THESE MARRIAGES? Yes, the Government has confirmed that these couples are also eligible. WHAT ABOUT DOMESTIC PARTNERSHIPS? It remains unclear if the Court’s DOMA ruling covers domestic partnerships. To the extent possible, couples in domestic partnerships who are in a position to get married should do so, because the “marriage” label likely matters for immigration purposes. SO, FOR MANY LGBT INTERNATIONAL COUPLES, THEY NOW HAVE AN OPPORTUNITY TO IMMIGRATE TO OR LEGALLY STAY IN THE UNITED STATES? Yes. It is important to remember, however, that marriage alone does not automatically result in a green card. The US may still deny a green card for other reasons (for example, petitions may be denied because of a criminal record or if the applicant has been in the US illegally). This is why it is important to discuss one’s particular circumstances with an experienced immigration attorney. My firm is providing free consultation to any same-sex couple needing immigration assistance on a marriage petition. DOES THE COURT RULING AFFECT ASYLUM? No, that is a separate issue that does not turn on marriage. But for those who are single or not in a relationship with an American citizen or Lawful Permanent Resident (green card holder), asylum still provides a special immigration status with
work authorization and a path toward citizenship. Asylum is a form of immigration relief that is extended to those who are persecuted (intensely mistreated) or have a reasonable basis to fear persecution in their home country based on their sexuality. I have successfully represented individuals from several countries, including China, Brazil, Colombia, Cameroon, Jamaica, and Indonesia. WELL, DA CUCKOO IS ONE OF THOSE SUCCESS STORIES. TELL US, DA CUCKOO, WHAT DOES IT MEAN TO YOU THAT YOU NOW HAVE ASYLUM? It means I am finally free. Free to pursue a career and life in a much more accepting and open community. For so long, I had to exist fearing for tomorrow and wondering if ever I would be able to feel whole and to feel like I mattered because conditions in Brazil, despite some of the hype, remain extremely difficult and dangerous for the LGBT community, especially for a drag performer. I was over the moon when I found out that I was granted asylum because it means a free and open life. And it means I was able to work on specific projects. For example, I just completed a music video for Forbidden Lover, which is the first single off my 2014 debut album entitled Da CucKoo & The Co. WHEN WILL THE RECORD BE AVAILABLE? Forbidden Lover will be available on iTunes on September 1, and the video will premiere on Vevo on the same day. DID YOU FEEL YOU WERE HELPED BY WORKING WITH AN ATTORNEY? Helped doesn’t even cut it. I owe the success of obtaining asylum solely to my lawyer. The process is quite complex and requires a good amount of research and factual data as well as a thorough understanding of the process. To have attempted to go at it alone would have meant I would have become overwhelmed, and
I probably would have failed to present myself with the confidence and certainty Mr. Tenreiro was able to provide to me. I strongly recommend that anyone seeking asylum needs to work with an experienced asylum attorney. GEORGE TENREIRO: I just want to add that it was a pleasure to work on Da CucKoo’s asylum application because I so admire Da CucKoo’s courage and spirit. Every case is unique and requires a different approach. For his application, we focused on how the everyday living conditions in Brazil are hostile despite some political LGBT advances, and we did so through different voices, including a statement in support of the application by the great Sherry Vine. TELL US ABOUT THE ONE-YEAR FILING DEADLINE ON ASYLUM, MR. TENREIRO? Many individuals who call me are ineligible for asylum because they have waited too long and have missed the oneyear filing deadline (though there are exceptions). The good news is that if the anticipated Immigration Reform Bill, that is being worked on in the Legislature, passes and remains in its present form, it will abolish the one-year filing deadline. Additionally, applicants who were previously denied asylum because of the deadline will be given an opportunity to reapply for asylum, including those individuals currently on Withholding of Removal. Unlike asylum, Withholding of Removal does not provide a path toward citizenship. If the one-year filing deadline gets abolished, it will be yet another positive immigration development that will help many LGBT individuals. Since they were a little short on staff-- and we all prefer long staffs -- during the busy Pride season, they decided to have me interview myself about the project. So here goes! WHY DECIDE TO START YOUR RECORDING RECORDING CAREER AT 50, YOU CRAZY BITCH? I’ve actually written and recorded music for 15 years, but haven’t really focused on a full-scale solo release with remixes until now. I’ve appeared in two duets with RuPaul in his last two albums, including the recent, “Lick It Lollipop”. But the new song, called “Take Me Up High”, better represents the kind of music I’d like to make on my own: soulful and rooted in classic house music. It’s a sound that I danced to in New York for decades until the dreaded top 40 disease starting forcing DJs (including myself) to play only what’s on the radio. I’m so sick of going into a club with more than one DJ in different rooms, and both are playing the same Rihanna song. After “Call Me Maybe”, “Gangnam Style” and “Harlem Shake”, I hardly even wanted to DJ any more. But then I said, “Stop whining and create some good music if you know so damn much.”
IS THE RECORD INDUSTRY REALLY LOOKING FOR THE NEXT OVERWEIGHT TRANSVESTITE? I THOUGHT THEY WANTED COOKIE-CUTTER GIRLS WITH WEAVES AND BARE MIDRIFFS? The dance world was always a place where outrageous characters like Kevin Aviance, Sylvester, Celeda or Divine could bypass industry gatekeepers. And dance music was one genre which often overlooked an artist’s image (or weight) because they sounded good. I hope these factors work in my favor. And if you like “Take Me Up High”, then request it! I know for a fact that if enough people request a song, a DJ will get it and add it to their sets. IS THE SONG COMICAL LIKE YOUR ACT? Not intentionally! The video will be campy with an outer space theme, but there aren’t actually punch lines. Writing music, like DJing, acting, performing and activism, is just another thing that I do. Not all people like every aspect, so some will enjoy the comedy and not the music. But if you like my DJing, then you may well like the song since it sounds like something I’d spin and twirl to. I reached out to some celebrity friends to provide me with quotes to help push the song and I got a very mixed bag of responses.

ALLUSIA ALUSIA Hey now, kittens! Come over here and let me yell at you for a minute about some hot new things happening in the mean streets of West Hollywood. First up is a fresh’n’fancy-free new night at Micky’s every Tuesday from 10pm-2am! What do you get when you mix a pack of lawless, f*ck the rules drag and burlesque entertainers with the beats of resident DJ Johnny Jewel, and my particular brand of Quirk‘n‘Twerk hosting on the mic? You get WHORE HAUS! Helmed by punk rock mistress of the night Saint Peter D’vil, Whore Haus embodies her no-holds-barred approach to just plain old having a good time. Come as you are or how you want to be. Her tagline of “No gender, no rules, no religion” sums it all up perfectly. DJ Johnny Jewel consistently crafts the perfect soundtrack to the Freak show, displaying quite a knack for knowing just what his crowd needs to hear to take the party to the next level. Ranging everywhere from old-school punk to modern pop to industrial to everywhere in between, he’s got my vote for President. The rotating cast of performers rounds out the night quite nicely. Varying from theater trained to punk rock “I’m going to roll on the floor and make you eat it” to burlesque hotties to classic drag performance, we’ve got something for everyone. Next on my list is one of my favorite new shows: Drag Happy Hour at Lola’s, every Sunday starting at 4pm. Hosted by Misty Violet, she brings her brand of accidentally on purpose dumb girl humor to the table and it works every time. Misty seems to never be quite sure what the words coming out of her mouth mean, which results in her malapropos monologues never failing to leave me and the rest of the audience gasping hysterically on the floor. She brings that same “Where Am I” humor to her performances and her “dance moves”. Not saying anything, but you should see what she can do with a shake-weight. Imogene Autry is her weekly powerhouse knock’em’dead performer and co-host. Imogene brings such a light and energy to each of her performances that you simply can’t help but fall in love with her. They bring in a rotating cast of girls, giving the show a lil’ extra dash of spice for sensational pleasure! P.S. Try the Misty Violet Cocktail. I hear it tastes like purple and shame. 1) DJ Ricardo! Presents Out Anthems 8 (Ultra Music) Yes, a shameless plug for my own album. However, I can’t ignore the bestselling Pride collection from America’s largest dance label specifically formulated for that summer beach trip or BBQ. 2) Sasha- Invol<3r (Ministry of Sound) Progressive house pioneer Sasha is all grown up now, and “Invol<3r” is his most polished, mature album yet. Sasha is famous for taking you on a journey with music, and “Invol<3r” is a ticket to bliss. Just in time for the summer, this is the album you want to pop in when the sun is setting, or while taking that long awkward drive back from the beach. Sasha immediately starts our journey with dreamy ambient landscapes which culminate into luscious vocals with lyrics like “you blow up the moon, just to turn the tide”. “Invol<3r” is thought provoking music that is mellow yet provocative while also being very sexy. Every single track on this album has been reworked and remixed by Sasha himself in order to weave you in and out of the tracks flawlessly. He even included an ambient “beatless” mix of the entire album, perfect for that afternoon summer snooze or a romantic drink at sunset.

3) Daft Punk- Random Access Memories (Columbia) This was one of the most anticipated albums of the year, and first week sales gave them their first #1 album on Billboard Top 100. However, once people listened to the album, the anger over lack of dance friendly tunes began to grow: “What the hell is this? It’s so slow! Is this even dance music?” No people, it’s an electronic album, and a beautiful one! That’s right! While the first single, “Get Lucky” feat. Pharrell Williams is the summer dance song of 2013, the rest of the album is quite different. Perhaps, a huge ‘fuck you’ to todays “EDM” pop sound which Daft Punk helped create, and has now become stale. “Random Access Memories” is eclectic and diverges from the typical “Daft Punk” sound. More of an album to listen to when going through a break up at the end of a summer fling. Mostly produced by legendary dance ‘godfather’ Giorgio Moroder, cuts on this album remind me of musical interludes and ballads from 1980’s “Flashdance” soundtrack, which he produced. It’s genius, unexpected, and takes a few listens, but please don’t expect to listen to this album at the gym!

Some popular phrases have always struck me wrong, sometimes leaving me with worry and concern: “Is that the way people really feel?” If so, we need to start looking at things differently. From simple and easy matters of just including others, and taking opportunities to sit and address concerns of those in our sphere, we have once again given over to the shaping of evolvement, and as the Beatles said, “Little darling, the smiles returning to the faces... the ice is slowly melting...here comes the sun.” Here comes the sun. Indeed. I know some of you took time out to celebrate the Nation’s Birthday.
